  La Présidente. - L'ordre du jour appelle le débat sur le rapport de Roberto Gualtieri, au nom de la commission des affaires constitutionnelles, sur la modification de l'accord interinstitutionnel relatif au registre de transparence (2014/2010(ACI)) (A7-0258/2014).

  Roberto Gualtieri, relatore. - Signora Presidente, onorevoli colleghi, la trasparenza delle istituzioni europee nel loro dialogo con la società civile è un principio fondamentale sancito dai trattati. Affinché la democrazia europea funzioni correttamente, evitando che la forza dei pochi prevalga sugli interessi dei molti, l'attività dei gruppi d'interesse che vogliono far sentire la loro voce nel corso del processo legislativo deve essere trasparente e seguire norme di condotta severe e rigorose.

Le modifiche dell'accordo interistituzionale, che il Parlamento ha negoziato con la Commissione, costituiscono un passo in avanti in questa direzione. Ma un passo in avanti parziale, soprattutto rispetto alla richiesta del Parlamento di istituire un registro obbligatorio. Siamo consapevoli dell'assenza di una base giuridica nei trattati, ma esiste una clausola di flessibilità che consente di rendere i poteri dell'Unione coerenti con i suoi obiettivi e il Parlamento chiede con forza di utilizzarla nella prossima legislatura qualora non si realizzi una revisione dei trattati. Il Parlamento chiede inoltre al Consiglio di aderire anch'esso al registro.

Pur nei limiti di un meccanismo volontario, basato su incentivi, il nuovo accordo contiene comunque dei progressi rispetto al passato e la risoluzione che precede il testo dell'accordo li sottolinea e li precisa. Chi si registra dovrà dichiarare tutti i clienti per i quali svolge attività di lobby, legando chiaramente ciascuna attività svolta con ciascun cliente. Le norme del codice di condotta sono rese più severe per limitare al massimo comportamenti non conformi o abusi.

Ci siamo impegnati per chiarire il ruolo degli ex deputati, richiedendo che non utilizzino i vantaggi derivanti dal loro status nel caso esercitino attività coperte dallo scopo del registro. Gli incentivi alla registrazione – punto, questo, importante – sono concepiti nella risoluzione anche e soprattutto come disincentivi per chi non si registra rispetto alla libertà di azione, attualmente molto ampia, consentita ai lobbisti. Alla Commissione europea è chiesto di essere altrettanto ambiziosa e severa quanto il Parlamento ha deciso di essere.

C'è poi la questione del ruolo degli studi legali, che è precisato meglio distinguendo le attività di assistenza legale da quelle coperte dal registro, ed è positivo il fatto che alcune associazioni di studi legali di avvocati vogliano accogliere questo principio su cui dovremo continuare a lavorare.

Un'altra questione importante che è emersa riguarda i comuni. Vorrei precisare che sindaci e i rappresentanti di quelle istituzioni non dovranno registrarsi, mentre dovranno farlo gli uffici di rappresentanza permanenti. Nelle linee guida che seguiranno sarà forse utile chiarire e precisare questo aspetto.

Per quanto riguarda gli emendamenti – alcuni dei quali saranno accolti – c'è la questione del legislative footprint. In proposito vorrei esprimere la mia opinione: a mio giudizio, un meccanismo obbligatorio rischierebbe di avere un effetto controproducente e quindi di incentivare un'attività di lobby per ottenere il proprio nome registrato nelle relazioni approvate. Possiamo valutare la proposta di un altro emendamento, di un meccanismo volontario sul quale sono pronto ad ascoltare i suggerimenti che emergeranno nel dibattito.

Nel complesso, comunque, ritengo che, nei limiti dei trattati attuali e di un negoziato non semplice, il Parlamento abbia compiuto un passo in avanti e che con il nuovo registro la trasparenza e quindi i diritti di tutti i cittadini saranno rafforzati.

  Tonio Borg, Member of the Commission. - Madam President, I would also like to thank the rapporteur, Mr Gualtieri, as well as the members of the High Level Working Group, for their constructive approach to the revision of this transparency register.

This register is an example of fruitful cooperation between Parliament and the Commission at a political but also a technical level. Our cooperation is, after all, there to benefit European citizens, but it is equally for stakeholders engaged in lobbying, as well as for the institutions of the European Union themselves. Since its launch in June 2011, the register has shed much light on the Brussels lobbying scene, answering questions about what interests are being pursued, by whom, and how much is invested in these efforts. Today the website includes 6 500 entities of various natures and sizes – consultancies, NGOs, think tanks, trade associations, law firms and also self-employed lobbyists. The register continues to grow every day, in my opinion demonstrating that we are on the right track.

I would like to stress in this context that there is no charge for the regions. In many countries they have a legislative role to play and are therefore not covered by the register. Regions can, however, register their representative offices in Brussels if they so wish. The scheme can certainly be further improved. There are gaps in the representation of certain sectors and the quality of data varies. The website could be modernised and clearer guidelines could be provided for registrants. For instance, not all EU officials are aware of the register or use it. Therefore we have not yet reached all relevant external stakeholders either.

These are the challenges that the joint transparency register secretariat, supported by all those committed to transparency, should address. In 2017, at the time of the next review, we will again take stock of progress. The Commission will shortly issue internal guidelines on the application of the foreseen incentives for registration.

Finally, let me be clear that the register is not the only transparency instrument implemented by the Commission. Other initiatives, promoted via the transparency portal, include for instance the regulation of public access to documents, the registers of experts’ groups and comitology, and information about recipients of EU funds. We look forward to further cooperation with Parliament during the implementation of the revised interinstitutional agreement.

  György Schöpflin, on behalf of the PPE Group. – Madam President, my congratulations first of all to Mr Gualtieri for his report. I am happy to go along with most of what he has said, if not, indeed, all. It seems to me there will always be tension between politicians and lobbyists, principally because their objectives both overlap and converge. Lobbyists offer information and politicians can find this useful, but that information may turn out to be slanted. The problems arise when either the information is dubious in some way or when the lobbying becomes intrusive and inappropriate. Not least, lobbyists can be in possession of considerable financial resources, which can then pressure politicians.

It is to tackle these potential and actual abuses that the transparency register – the subject of an interinstitutional agreement – seeks to develop a framework that will further clarify practices. Lobbyists are expected to register, but this is not mandatory. In this connection it would make a major difference if the Commission were to take steps to provide a proper legal base for the transparency register. All the same, the net is cast wide. Lobbyists are expected to declare their interests and the identity of their clients. They should not become fronts, hiding whom they are representing, and they should not be intrusive. Law firms should declare the identity of clients, but lawyer/client confidentiality is respected – and incidentally, regions do not, as such, fall into the category of lobbyists. There are carrots as well as sticks. Registered lobbyists will be placed in a superior position to those not registered in terms of access and participation. In all, this report represents a very welcome step in the direction of greater transparency.

  Sandra Petrović Jakovina, u ime kluba S&D. – Hvala gospođo predsjednice, dozvolite mi da izrazim prije svega potpunu podršku ovom izvješću kolege Gualtierija koje predstavlja važan korak naprijed u poboljšanju transparentnosti i mogućnosti nas kao zastupnika da obnašamo demokratsku kontrolu. Neophodno je da institucije održavaju otvoren, transparentan i redovit dijalog s predstavnicima udrugama i civilnim društvom, a taj dijalog zahtjeva dobro funkcioniranje zajedničkog registra organizacija i samozaposlenih osoba koje sudjeluju u postupku oblikovanja i provedbe politike EU-a.

Pozdravljam prijedlog za uvođenje obveznog registra odnosno upisa u vezi s provođenjem aktivnosti lobiranja i prijedlog da Komisija u okviru budućih prijedloga reforme Ugovora podnese prijedlog prikladne pravne osnove kojom se omogućuje uvođenje obveznog registra u skladu s redovnim zakonodavnim postupkom. To je potrebno kako bi se spriječila tamna strana lobiranja i sukob interesa provođenjem jasnog i transparentog postupka i regulirao na najjasniji mogući način pristup plaćenih lobista u ovom tijelu.

  Anneli Jäätteenmäki, ALDE-ryhmän puolesta. – Arvoisa puhemies, ensiksi haluan kiittää mietinnön esittelijää hyvästä yhteistyöstä. Keskustaliberaaliryhmäni kannattaa avointa ja EU:n eri instituutioille yhtenäistä lobbarirekisteriä, niin sanottua avoimuusrekisteriä.

Vaikuttaminen EU-lainsäädäntöön on luonnollista, mutta vaikuttamisen pitää olla avointa, ja tämän vuoksi tarvitaan rekisteri, jonne etujärjestöt, eri laki- ja konsulttifirmat voivat rekisteröityä. Kun tällaiset viralliset etujärjestöt tulevat keskustelemaan, me kaikki tiedämme, että he edustavat tiettyä tahoa. Sitten jos tulee konsulttifirma tai joku lakifirma, sieltä voi aamulla tulla tupakan vastustaja ja illalla tupakan kannattaja. Tämän vuoksi olisi erinomaisen tärkeää, että on yksi yhteinen rekisteri, johon merkitään firmat ja myös kuinka paljon rahaa on käytetty.

Toinen tärkeä asia on se, että kun parlamentissa laaditaan mietintöjä, niin otettaisiin käyttöön niin sanottu lainsäädännöllinen jalanjälki, eli merkittäisiin mietintöihin keitä mepit ovat kuulleet mietintöä valmistellessaan. Tämä on myös osa avoimuutta, luottamuksen palauttamista tähän Euroopan parlamentin ja EU:n toimintaan, jota niin kovasti tällä hetkellä kaivataan.

  Gerald Häfner, im Namen der Verts/ALE-Fraktion. – Frau Präsidentin! Demokratie braucht Transparenz, so wie das Leben das Licht. Sonst schimmelt sie und fängt an zu stinken. Als Abgeordnete haben wir die Aufgabe, dem Gemeinwohl und den Bürgern zu dienen. Aber die Bürger sind weit weg und die Versuchungen groß. Zigtausend Lobbyisten schwirren um uns herum. Dutzende von Einladungen jeden Abend. Das neue Transparenz-Register will Licht in das Dunkel des Lobbyismus in Brüssel bringen: Wer nimmt hier Einfluss und auf welche Weise? Ich meine, dass die Bürger und die Medien das nachvollziehen können müssten.

Ginge es nach den Grünen, hätten wir ein verpflichtendes Register. Aber das scheitert nicht am Parlament, sondern am Rat – der eigentlichen Dunkelkammer europäischer Politik, gegen die das Parlament wirklich ein lichter Raum der Demokratie und Transparenz ist.

Wir haben viel durchgesetzt und mit diesem Bericht und dem Agreement die zweitbeste Lösung erreicht, so gut es geht. Deshalb stimmen wir dafür. Ich will dennoch zum Ende noch Eines sagen: Ich persönlich glaube nicht, dass Bestimmungen alles regeln. Ich glaube, wir brauchen auch ein Stück Moralität, Gewissen, inneren Kompass, den ich allen Kollegen auch in Zukunft in jeder Sekunde ihres Tuns wünsche.

  Rina Ronja Kari, for GUE/NGL-Gruppen. – Fru formand! Jeg vil gerne starte med at sige tak til ordføreren for et stort stykke arbejde. Samtidig må jeg dog konstatere, at det er dybt beklageligt, at denne revision ikke betyder indførelse af et obligatorisk lobbyregister. Fravalg af et obligatorisk lobbyregister betyder, at borgerne reelt ikke får mulighed for at holde øje med hvilke interesser, der er blevet lyttet til i udformningen af EU-lovgivning.

Det giver mindst tre problemer: For det første betyder det, at særinteresser trives på bedste vis i EU. For det andet: Der er ikke langt fra lukkethed til korruption. Korruption er naturligvis ulovlig, men gennemsigtighed er alt andet lige det bedste redskab til at sikre, at korruption ikke forekommer. Og for det tredje: Vi kan ikke få et klart billede af, hvor mange penge der skal til for at blive hørt. F.eks. har Corporate Europe Observatory udgivet en rapport, som viser, at finansindustrien har 1700 lobbyister ansat og bruger over 120 mio. euro om året på lobbyvirksomhed i EU.

Det forklarer måske, hvorfor finanssystemet i EU fortsat er nøjagtig lige så sårbart over for spekulationer, som dengang finanskrisen ramte. Derfor har jeg også været med til at arbejde for et obligatorisk lobbyregister, og derfor må vi holde Kommissionen fast på dens løfte om, at der vil komme et obligatorisk lobbyregister, også selv om det først vil blive oprettet i slutningen af 2016.

  Jaroslav Paška, za skupinu EFD Účasť záujmových skupín a lobistov na tvorbe politiky Európskej únie neustále narastá. Podľa aktuálnych štúdií sa dnes rozhodovanie európskych inštitúcií pokúša ovplyvňovať okolo 1700 lobistov.

Najvýznamnejšou skupinou sú lobisti z finančného sektora, ktorí na svoje aktivity minú v Bruseli viac ako 120 miliónov eur ročne. Počet lobistov z finančného sektora prevyšuje v pomere 5:1 množstvo lobistov z oblasti organizácie občianskych spoločností alebo odborových organizácií.

Ešte výraznejší je nepomer medzi uvedenými skupinami v oblasti finančných zdrojov, ktorými disponujú. Finančná loby poskytuje svojim reprezentantom na presadzovanie jej záujmov 30- násobne viac prostriedkov, ako sú možnosti občianskych organizácií alebo odborov.

Z uvedenej kvantifikácie je zrejmé, že materiálne možnosti záujmových či lobistických skupín môžu vážne deformovať naše demokratické prostredie. Preto musíme čo najdôslednejšie monitorovať aktivity lobistov v európskych inštitúciách a rozšíriť okruh informácií a osôb, ktoré budú podliehať evidencii v registri transparentnosti.

Len precízne pravidlá vymedzujúce priestor na korektnú komunikáciu predstaviteľov Európskej únie so záujmovými skupinami môžu prispieť k eliminácii rizika deformácie demokratického prostredia v Únii.

  Evelyn Regner (S&D). - Frau Präsidentin! Es gibt in Brüssel mehr als 700 Finanzmarkt-Lobbyorganisationen. 450 davon sind nicht einmal im Transparenz-Register eingetragen. Das sind mehr als 1 700 Finanzmarktlobbyisten, das sind viermal so viele Menschen wie in der Kommission tätig sind, wenn es um Finanzmarktregulierung geht. Diese Lobbyisten sind in High Level Groups, Expertengruppen der Kommission, sie tummeln sich in Intergroups, und sie hosten Mittagseinladungen. Das wirkt sich natürlich auf die Gesetzgebung aus.

Das ist genau jener Grund, warum wir so dringend ein noch umfassenderes Transparenzregister brauchen, und zwar ein Transparenz-Register, das verpflichtend ist. Ein Transparenz-Register, das auch den Rat umfasst, den ich heute Abend wieder einmal schmerzlich vermisse, und ein Transparenz-Register, das auch die Rechtsanwaltskanzleien umfasst, denn diese treten immer mehr als Wirtschaftslobbyisten auf. Dementsprechend ist es natürlich auch wichtig, dass die Mandanten offengelegt werden, wenn es um solche Wirtschaftsinteressen geht.

  Andrew Duff (ALDE). - Madam President, transparency is an essential prop of a parliamentary democracy, and it is ours – the legitimacy of this Parliament – that is being tested in the election campaign as we speak. We ought to be setting a platinum standard which would include the banning of propaganda on our premises from suspect third parties. It should certainly include a mandatory register and a legislative footprint, and I do hope that the next Parliament and Commission will be able to take forward such constructive proposals.

  Claude Turmes (Verts/ALE). - Frau Präsidentin! Die Intransparenz und die übermächtige Lobby der Wirtschaftsinteressen sind auf nationaler, aber auch auf europäischer Ebene ein reelles Problem für die Demokratie. Leider bringt das neue interinstitutionelle Abkommen auch da keine Lösung, denn es hat drei große Schwächen – auch wenn der Bericht von Herrn Gualtieri ein guter Bericht ist.

Erste Schwäche: Das Register wird nicht verbindlich. Zweite Schwäche: Es erfasst die Lobby in den Hauptstädten nicht. Wir haben das ja auf besonders beeindruckende Weise bei dem Dossier „CO2 und Autos“ gesehen, als nach einem abgeschlossenen Vermittlungsverfahren eine Regierung interveniert hat und sogar Spenden von einem betroffenen Unternehmen in Höhe von Hunderttausend Euro erhalten hat.

Drittens: Das neue Register bringt kein Licht in das schwarze Loch der Lobbypolitik: die Rechtsanwaltskanzleien. Es ist einfach nicht hinnehmbar, dass diese bestbezahlten Lobbyisten in Brüssel – und das wird wohl nicht ohne Grund sein – immer noch Schlupflöcher haben. Wir brauchen hier eine Lösung, weil das System sonst komplett unterwandert wird.

Mich stört auch – und das ist vielleicht auch etwas, was Sie an den Präsidenten weitergeben können –, dass wir hier im Haus einen besonders krassen Fall von einer Lobbytätigkeit haben, die sich hinter einer Anwaltstätigkeit versteckt. Leider sitzt unser Präsident, Herr Schulz, seit Wochen auf einem Brief, der wesentlich mithelfen könnte, Licht in diese Affäre zu bringen, und ich hoffe, dass Herr Schulz noch diese Woche Zeit findet, diesen Brief zu unterschreiben und auf den Weg zu bringen.

  Zita Gurmai (S&D). - Madam President, congratulations to Roberto Gualtieri for his excellent work. The perceived and often genuine lack of transparency of the European institutions remains one of the main issues raised by European citizens, one that contributes to the growing gap of distrust towards the European Union and politicians in general. While an increasing number of issues are being regulated at EU level it is therefore paramount to ensure that activities of interest representatives are properly monitored.

Dialogue with and involvement of civil society is crucial in the work of the European institutions, and it has to be conducted in a transparent manner within a clear legal framework. In this respect the setting up of the transparency register has been an important step. It is now time to be more ambitious and to aim for the establishment of a mandatory register that would be joined by the Council as well. This is why I welcome the position outlined in this report. We are now counting on the Commission to provide an appropriate proposal, based on a sound legal basis, that would enable us to continue on the way to a more transparent European Union for the benefit of all.

  Paul Rübig (PPE). - Frau Präsidentin! Meine Frage richtet sich an Kommissar Borg. Die Europäische Kommission vergibt pro Jahr ungefähr 5 Milliarden Euro an Nichtregierungsorganisationen. Wie hält es die Europäische Kommission eigentlich mit der Compliance? Überprüfen Sie regelmäßig, ob diese NGO nicht auch Gelder bekommen aus Steuerparadiesen oder Offshore-Gesellschaften? Und natürlich auch umgekehrt, wenn hier eine Förderung gegeben wird, wie ist es um die Transparenz der Auswahlverfahren bestellt? Glauben Sie, dass es auch hier im europäischen Sinne einer neuen Transparenz bedarf, nämlich nicht nur hinsichtlich derer, die unmittelbar diese Förderung erhalten, sondern auch dessen, wer hinter diesen Gruppierungen steht?

  Silvia-Adriana Ţicău (S&D). - Doamnă Președintă, domnule Comisar, articolul 11 alineatul (2) din Tratatul Uniunii Europene prevede că instituțiile Uniunii mențin un dialog deschis, transparent și constant cu asociațiile reprezentative și cu societatea civilă.

Consider că pentru ca dialogul respectiv să se desfășoare într-un climat de transparență este necesară o bună funcționare a unui registru comun al organizațiilor și persoanelor care încearcă să influențeze procesele de elaborare și de punere în aplicare a politicilor Uniunii Europene. Susțin înregistrarea obligatorie în ceea ce privește desfășurarea unor activități de lobby în instituțiile Uniunii Europene, așa cum s-a menționat în Rezoluția Parlamentului din 8 mai 2008 și în decizia sa din 11 mai 2011. Solicităm Comisiei să prezinte până la sfârșitul lui 2016 o propunere legislativă de înființare a unui registru obligatoriu în temeiul articolului 352 din Tratatul de funcționare a Uniunii Europene.

Este important ca revizuirile viitoare ale registrului de transparență să fie transparente, să implice pe deplin comisiile competente ale Parlamentului și să permită participarea societății civile.

  Carl Schlyter (Verts/ALE). - Fru talman! Självklart ska vi ha ett obligatoriskt register för lobbyister. Men det räcker inte, utan vi måste också stödja de grönas förslag om att ha en obligatorisk plikt att se till att den information som lobbyister skickar till parlamentet också ska bli offentlig. Det är viktigt att alla vet var förslag kommer ifrån för att kunna avgöra vad de har för effekt. Jag hoppas verkligen att kammaren kan stödja detta förslag. Den bördan ska inte ligga på parlamentariker, utan styrelsen får se till att det är lobbyisternas ansvar.

Det är tråkigt att jag inte har kunnat få stöd för mina förslag om straffrätt eller åtminstone böter och avgifter för de lobbyister som bryter mot regelverket. Att bara byta ut en lobbyist mot en annan är inte en tillräcklig konsekvens för att se till att de följer regelverket. Vi måste skärpa lobbyreglerna. Annars hotar det EU:s framtida utveckling. Lobbyismen i dag tenderar att bevara gamla maktstrukturer och gamla ekonomiska modeller.

  Nikola Vuljanić (GUE/NGL). - Hvala gospođo predsjednice, za lobiranje u Bruxellesu tvrtke troše 120 milijuna eura godišnje. Kad toliko plaćaju pa valjda im se i isplati. Stoga je neophodno da taj postupak bude reguliran i maksimalno transparentan. Kako stvari danas stoje ne možemo biti sigurni niti u legalnost lobiranja, a pojma nemamo o efektima tog lobiranja. Znamo samo da brojni visoki dužnosnici europskih institucija nakon mandata dobivaju istaknute funkcije u velikim korporacijama. Slučajno? Možda.

Transparetnost i regulacija ključni su kako za funkcioniranje banaka i financijskih institucija, tako i za odnos krupnog kapitala i europskih institucija. U suprotnom, u institucijama će se izglasavati privilegije korporacijama, a nauštrb europskih građana. Obavezan registar lobista i lobiranja i transparentnsot ovog posla u svim europskim institucijama treba podržati jer ćemo jedino tako zaštititi građane od sirovih komercijalnih interesa.

  Krisztina Morvai (NI). - Kedves képviselőtársaim! Időről időre elcsodálkozom azon, hogy hogyan képesek politikusok olyan gonosz és embertelen döntéseket hozni, amelyek következtében Európa-szerte milliók és milliók elszegényednek, nyomorúságos élethelyzetbe kerülnek, miközben a bankok és a multicégek virágoznak. Most az osztrák szakszervezeti unió és néhány más szervezet kiadott egy tudományos jelentést, amely megadja a választ. A jelentésből nyilvánvaló, hogy a döntéseket nem a politikusok hozzák, hanem azok a lobbisták, azok a nemzetközi, pénzügyi érdekkörök, amelyek évente 120 millió eurót költenek a lobbizási tevékenységre. 1700 fizetett lobbistájuk van, és még mielőtt valaki azt mondaná, hogy de hát vannak jó lobbik is, hétszer annyi pénzügyi lobbista van, mint ahány civil lobbista és harmincszor annyi pénzt költenek a politikusok „befolyásolására”, mint a civil szektor.

  Seán Kelly (PPE). - Madam President, I think lobbying is in some respects an unfortunate word to use, because it has a negative tone to it. Done properly, it can actually be very beneficial. I was rapporteur on data protection for the Committee on Industry, Research and Energy and the lobbying done – if you want to call it that – was open, transparent and very informative. In particular, it can give examples of where the unintended consequences of proposed legislation could be damaging and obviously amendments can be made accordingly.

But it is also very important that we have total transparency in regard to it, particularly if it is overdone. There was a lot of talk recently about the Tobacco Directive and the influence there from lobbyists. I think that once we have proper transparency, a proper register and an account of the lobbying done, that will go a long way to allaying people’s fears regarding it.

  Tonio Borg, Member of the Commission. - Madam President, first of all let me again clarify the question of the regions in Europe. The regions in Europe will not be expected to register in the future, and the status quo will therefore be upheld in regard to them. It is true that this registration is not yet mandatory, but I believe that we have strengthened significantly the incentives to join the transparency register, and the Commission will assess the results of this approach in due course. On law firms, I can say that there are consultations with the Council of Bars and Law Societies of Europe, which reveal that they are open to enter into discussions with the institutions in order to find a workable compromise so that lawyers can sign up to the register.

On the question of the assistance we give to NGOs, which will be recorded in this transparency register, yes, we do have strict financial controls on what EU funds they use and how they use them, and whether they use them according to the intention for which they were given. I do not think that there is jurisdiction to see what they get from other sources, unless of course it affects their independence of judgment and the impartiality of the judgment itself. I look forward to more cooperation in this regard on something which is of interest to European citizens, and I think that this proposal will clearly result in improving the register further.

  Roberto Gualtieri, relatore. - Signora Presidente, onorevoli colleghi, ritengo che il dibattito abbia fatto emergere un'ampia unità del Parlamento su alcuni punti importanti.

In primo luogo, quello che riguarda una situazione anomala, asimmetrica, rispetto all'attuale peso e la forza dell'attività di lobbying nel Parlamento europeo, che rischia di compromettere l'equilibrato sviluppo della democrazia in Europa. La questione della trasparenza è dunque fondamentale.

In secondo luogo, deploriamo l'assenza di un registro obbligatorio e su questo punto siamo tutti uniti. Siamo ovviamente consapevoli del fatto che le basi giuridiche attuali non lo consentono, ma indichiamo un percorso concreto per costruire questa base giuridica e invitiamo la Commissione a perseguirlo con determinazione e rapidità.

Infine, finché rimaniamo nell'ambito di un registro facoltativo, vorrei sottolineare ai colleghi l'importanza della questione degli incentivi intesi come disincentivi – elemento, questo, fondamentale. È dunque importante dare chiare indicazioni al Bureau del Parlamento sulla riduzione del margine di manovra per chi non si registra e ciò non per incentivare ulteriormente e facilitare l'attività di lobbying di chi si registra. È questo un punto discriminante che la relazione chiarisce e interpreta nel senso giusto.

Per quanto riguarda gli studi legali, ritengo che l'articolo 10 dell'accordo modificato chiarisca in modo molto netto la differenza relativa non allo status degli avvocati, ma all'attività svolta. Quindi, a mio giudizio, tutte le attività svolte da studi legali che ricadono nell'ambito del lobbying devono portare alla registrazione e chi non si registra dovrà non godere degli incentivi e ricadere quindi nel sistema di disincentivi che noi vogliamo si costruisca nel Parlamento.

Credo che su questi punti si possa lavorare insieme e penso che potremo avere anche un atteggiamento di apertura nei confronti di numerosi emendamenti che puntano a migliorare ulteriormente la nostra relazione.
