  Julia Reda, rapporteur. Madam President, there are two ways to look at this copyright evaluation report. On the one hand, it is a great step forward. It recognises that users of copyrighted works have rights – a foreign concept to the current Copyright Directive.

According to the Directive, rights holders have rights and users have exceptions to those rights. These exceptions are optional to the Member States. They can simply be disabled by a contract or by technological restrictions. Circumventing those restrictions is illegal, even for legitimate purposes. So it is illegal to make a book that has a technological lock available to a blind person, but the terms of service that simply erase an exception to copyright are completely legal. The Copyright Directive, so far, protects digital locks more than it protects the people.

This report calls for a clear set of European consumers’ rights. It states that copyright exceptions must not be overridden by a contract, and that you cannot charge a levy for private copying on the one hand, but then, on the other hand, use technology that makes private copying impossible. This report calls for interoperability and cross-border access, so you should be able to buy and to use works on any device or in any country. It sides with the right to education and with allowing libraries, museums and archives to do their jobs in the digital world and to make our shared cultural heritage accessible to anybody, regardless of their social status.

But, at the same time, this report is also a tragically-missed opportunity. Just a year ago, thousands of Europeans participated in a public consultation on copyright, and they expressed how they come into daily conflict with a law that is unfit for the digital age. Then Commissioner Kroes recognised that copyright must be radically reformed so that it would not become irrelevant. President Juncker announced his goal to tear down national silos in copyright, and Commissioner Ansip boldly took on geo-blocking. The message was clear: now is the time to act decisively.

Not from this Parliament. Parliament recognises, in the report, that 28 different copyright laws are too complicated, but still it considers our cultures to be so different that we cannot possibly agree on simple things like the fact that drawing a caricature should not require permission, a rights holder should not forbid a journalist from quoting a work in order to criticise it, or public pictures of public space should remain royalty—free. This Parliament is at its best when it is the voice of the people. It has rejected the ACTA Treaty because the people we represent embrace the internet as an integral part of their reality.

With copyright, you have seen tens of thousands of your young people on the streets opposing ACTA and holding signs saying ‘this video is not available in your country’. You have had thousands of responses to the consultation on copyright asking for more Europe in copyright law. You have had half a million petitioners demanding freedom of panorama. Now you have the chance to take up this call and to update copyright law to the digital age.

Personally, I wonder if this report, as it stands, is really the best that we can do if this is what European leadership looks like. I also hope that you, my colleagues, will wonder why people considered it necessary to form a party that is solely based on reforming copyright, to give it the ridiculous name of the Pirate Party and to elect me here to the European Parliament to tell you that copyright reform is urgently needed.

I am hoping that, when the reform from the Commission comes, my colleagues will be bolder in demanding European copyright and common rules for everybody. I also hope that we can make sure that Parliament is not just following the Commission proposal but is also a decisive player in making sure that copyright is fit for the digital age and understandable to ordinary people.

  Günther Oettinger, Mitglied der Kommission. Frau Präsidentin, meine sehr verehrten Damen und Herren Abgeordneten! Ja, die Kommission hat eine Priorität formuliert, nämlich das Urheberrecht auf europäischer Ebene an das digitale Zeitalter anzupassen, es also zu modernisieren und es zu harmonisieren und möglichst stark europäische Regeln für Verbraucher, für Urheber im europäischen digitalen Binnenmarkt zu schaffen. Ich danke der Abgeordneten Reda, aber auch vielen Kollegen hier im Parlament für eine intensive Befassung damit mit Rückblick, aber auch mit Ausblick. Wir werden Ihren Bericht in die weiteren letzten Schritte der Erarbeitung eines Gesetzgebungsvorschlags der Kommission einbeziehen.

Meine Damen und Herren! Es geht hier um mehrere Ziele. Es geht darum, dass wir die digitalen Technologien aufgreifen und darauf aufbauend unser geltendes Copyright-Paket auf europäischer Ebene überprüfen und modernisieren. Es geht zweitens um eine faire Balance zum Teil unterschiedlicher Interessen. Wir sehen das von Frau Kollegin Reda formulierte Interesse unserer Informationsgesellschaft, unserer Bürgerinnen und Bürger, unserer Nutzer, unserer Verbraucher – einerseits. Deswegen wollen wir, dass der Zugang zu Inhalten grenzüberschreitend weitestmöglich gewahrt oder geschaffen werden soll. Ein europäischer Markt ohne nationale Gebietsgrenzen muss der Grundsatz sein und Portabilität – das Mitnahmerecht ohne Grenzen – parallel ebenso.

Andererseits sind wir in starkem Maße gefordert, die Kreativwirtschaft Europas und ihre unternehmerischen beruflichen Perspektiven zu stabilisieren. Ich sage nicht zu konservieren, sondern neu zu stabilisieren. Es geht um unser kulturelles Erbe, aber auch um unsere kulturelle Zukunft. Wenn man Autoren, Drehbuchautoren, Schriftsteller, Filmregisseure, Journalisten, die recherchieren und kommentieren, Komponisten, Musiker und Sänger beispielhaft als Vertreter unseres kulturellen Erbes, aber auch unserer Kreativwirtschaft, die Zukunft haben soll, nimmt, wenn man dann zwischen dem Nutzer in der Informationsgesellschaft und dem Urheber noch Verleger, Transporteure, Formateure, Vertreiber von entsprechenden Inhalten nimmt, dann ist die Balance nicht leicht zu finden.

Dies aber ist unser Ziel, und dem wird unser Gesetzgebungsvorschlag entsprechend dienen. Der Grundsatz heißt: keine Grenzen innerhalb Europas, so viel Binnenmarkt wie sinnvoll und möglich. Aber Grundsätze schließen Ausnahmen und/oder Übergangszeiträume nicht aus.

Wenn wir den europäischen Film nehmen: Die Filmwirtschaft Europas wäre, gäbe es nur einen Binnenmarkt und wäre das Prinzip der Territorialität von heute auf morgen weg, nicht lebensfähig. Der europäische Film, der in den letzten Jahrzehnten stark gefördert wurde, der herausragende Wurzeln in Frankreich, Italien, aber auch in neuen Mitgliedstaaten hat, ist aufgebaut auf unseren Sprachräumen, und aufgebaut auf den nationalen Filmförderungen, die er abruft. Und wäre er einem europäischen Markt von heute auf morgen ausgesetzt, würden Hollywood, Bollywood, Google und Amazon diesen europäischen Film hinwegfegen. Das kann nicht im Interesse unserer vielfach kulturellen europäischen Gesellschaft sein.

Deswegen werden wir Vorschläge machen, wie wir in Kenntnis des Ziels des Binnenmarkts mit der Schaffung der Portabilität trotzdem die Territorialität in unserem Vorschlag verankern.

Ich könnte eine zweite Ausnahme erwähnen: den Sportsektor. Sowohl der Fußball wie Sportarten wie Basketball, Volleyball, Tennis und andere sind in ihrem Geschäftsmodell auch auf Territorialität aufgebaut. Dies kann man zumindest nicht von heute auf morgen, vielleicht im Übergang, verändern, entwickeln. Aber hier wäre die Durchführung des Grundsatzes auf einen Schlag mit Sicherheit ein Schlag gegen unsere Sportverbände und unsere Sportler in der Europäischen Union.

Grundsätze und Ausnahmen werden das tragende Prinzip unseres Vorschlags sein. Stichwort Ausnahmen im umgekehrten Sinne: Wenn man Bildung, Forschung und Wissenschaft ernst nimmt, dann werden wir auch Möglichkeiten des Zugangs, des unbeschränkten oder auch kostenfreien Zugangs zu Inhalten der digitalen Welt schaffen müssen. Hier sind wir noch in der Prüfung, ob die Forschung, die öffentlich-rechtlich getragen wird, oder aber auch die Industrieforschung von dieser Ausnahme des freien Zugangs ohne Kosten erfasst sein soll.

In den letzten Wochen hat die Panoramafreiheit eine große Rolle gespielt. Dahinter steckt sicherlich ein objektives Interesse, aber auch ein bisschen Marketing. Gestatten Sie mir eine klare Aussage: Die Kommission hat nicht vor, die Panoramafreiheit einzuschränken. Für mich gilt folgender Grundsatz: Was man mit dem Auge als Bürger auf öffentlichen Plätzen und Straßen in Europa sehen darf, sollte man auch mit der Kamera fotografieren dürfen. Ich mache zwischen dem Auge und der Speicherung des Auges durch Kamera und Bilder keinen Unterschied. Deswegen: Hier war manche Aufregung, zumindest was die Kommission anbelangt, unnötig. Wir haben nicht vor, bei diesem Thema einigen Vorschlägen aus dem Parlament und im Fachausschuss zu folgen. Wir glauben, dass die bisherige Grundlage, dass ein freies Europa auch freie elektronische Ablichtung von europäischen Städten, Gebäuden und Denkmälern erhalten sollte, nicht eingeschränkt werden darf. Wir machen von diesem Grundsatz auch in Zukunft Gebrauch. Deswegen will ich hier, zumindest was die Kommission anbelangt, Entwarnung geben. Hier ist keine Einschränkung unsererseits geplant.

  José Blanco López, Ponente de opinión de la Comisión de Industria, Investigación y Energía. Señora Presidenta, durante lo más duro de la crisis, las industrias culturales europeas han seguido creando empleo.

Eso habla de su vitalidad y de su fortaleza. Y en el núcleo de esa fortaleza están los autores, que son los motores de la industria cultural y que son los motores de la cultura, y los derechos de autor son también los que tienen que garantizar la remuneración por ese trabajo crucial para nuestra diversidad y para nuestra riqueza cultural.

Todos queremos desarrollar las industrias culturales en el nuevo entorno digital, aprovechar su potencial para generar nuevos empleos, impulsar industrias innovadoras. Pero que nadie plantee la reforma de los derechos de autor que nos anuncia el Comisario como un enfrentamiento entre autores y usuarios, en el que unos deben perder para que los otros puedan ganar.

Proteger a los autores es proteger a todos, porque es proteger la creación cultural, es proteger los contenidos. Si no lo hacemos, perderemos todos.

Europa necesita, ya se ha dicho, revisar su legislación, pero para reforzar sus industrias culturales, no para debilitarlas. Los contenidos son, a mi juicio, el nuevo oro negro de internet, y lo que tiene que hacer Europa es precisamente reforzar ese papel, reforzar los contenidos, reforzar nuestro liderazgo.

  Catherine Stihler, rapporteur for the opinion of the Committee on the Internal Market and Consumer Protection. Madam President, I would like to thank the rapporteurs, shadows, and also to the Committee secretariats for all the work on this dossier. I know it has not been an easy task, but I think we have a good compromise in front of us. I thank the rapporteur and others for taking on so much from the opinion of the Committee on the Internal Market and Consumer Protection (IMCO).

I think Commissioner Oettinger is right about the balance that we need to strike between the new digital world that we exist within and the rights of the creators of content. This is the challenge if we want to make our digital single market work effectively. So the challenge is there, and we will meet it.

The key points I wanted to raise are on e-book access, the ratification of the Marrakesh Treaty, and text and data mining. There are still too many barriers to libraries being able to provide books in electronic format, and I hope that we will see concrete proposals from the Commission later this year to try to address some of these problematic issues. Publishers and libraries have been working together to seek solutions, and these discussions must continue. Leading on from this, the ratification of the Marrakesh Treaty is no further forward than when we last discussed this in this House. The book famine, which visually impaired and blind people still face, is a clear breach of human rights. Let us remind ourselves that less than 5% of the books published in Europe are available in a format that is accessible. I urge Member States to take action and ratify this treaty.

Finally, on text and data mining, which the Commissioner just touched upon in his speech: currently in the UK, as you know, we have got an exemption for non-commercial purposes under the current rules. The impact this is having on research is phenomenal. What would have taken years can now literally take hours, and for scientific discoveries and historical analysis the benefits are endless. I hope that we will see a new exemption for text and data mining at EU level and an assessment about the extension of this for commercial purposes too.

Signora Presidente, onorevoli colleghi, prima di tutto mi preme ringraziare la relatrice per questa relazione e tutti i relatori ombra della commissione cultura. Sono dispiaciuta che quest'ultima non sia riuscita a presentare il proprio parere e quindi nel testo manca e mancherà il punto di vista di questa importante commissione.

Avevo proposto anche di ripresentare gli accordi di compromesso che erano stati raggiunti durante l'ultima riunione dei relatori ombra e devo dire che sono anche stata rimproverata per questa mia iniziativa. Spero che in futuro, comunque, ciò non si ripeta e che la commissione cultura possa far sentire forte la propria voce, meglio se in qualità di commissione associata e non soltanto con un semplice parere.

The report being presented today reflects the balance necessary for end users to benefit from enhanced access to creative content, as well as this Parliament’s role in continuing to foster investment in the sector, encourage employment and job creation and give the industry an opportunity to embrace digital technologies.

With these aims in mind, I have considered challenges experienced by users, as well as by creators and other rights holders. Together with other shadow rapporteurs and the rapporteur, whom I thank for their efforts, I worked to ensure that opportunities in the creative sector are not lost to the creators or to the users. This report seeks to make copyright work in both the analogue as well as the digital world by giving users and creators the full possibility of drawing on the potential of both these worlds. It emphasises the importance of portability of content across borders, further remuneration for creators, respect for contractual freedom, market—driven solutions that reflect the ever—changing expectations of users, and the provision of solutions which are evidence-based.

With this report, Parliament continues to show its belief in creators, as well as its aspirations to continue to make avenues available to make European cultural and creative works more accessible, by seizing the opportunities that the digital age provides. I look forward to a favourable vote on this report. I also thank the Commissioner for indicating that Parliament and the Commission seem to be following the same principles, and I look forward to the Commissioner’s proposals.

  Mary Honeyball, on behalf of the S&D Group. Madam President, my thanks to the rapporteur and to everybody who worked on this report. Ms Reda’s report, as we all know, reviewed the 2001 Information Society Directive and as such, or perhaps not as such, it has achieved some notoriety. For an own-initiative report of this kind it has certainly received more attention than perhaps we would have expected. But the report, as a result of that, is both wide-ranging and forward-looking. We had lengthy negotiations amongst all the political groups in the Committee on Legal Affairs, and I believe – and I think my colleagues also believe – that we did eventually achieve a fair balance between the competing interest groups – between consumers and creators. And it is not either consumers or creators: both need to be taken into consideration and both need to be in the reforms that eventually come forward for copyright.

But my focus, and I believe the focus of the Socialist and Democrat Group, has always been on creators – to give creators fair remuneration, to make sure that they are adequately paid. Because if they are not, we will not have music as we know it, we will not have much in the way of television and radio, and we will have very few new books. This is really a matter for our culture across the European Union, and we need to see it in that light.

That is why I welcome very much what the Commissioner said earlier. I do not believe, as Ms Reda said, that we have missed an opportunity. I think what this report, as amended by the committee, does is to put forward constructive proposals which I very much hope the Commission will take on board. And although, of course, we would eventually like to see pan-European laws, at the moment we simply have to take account of Member States’ cultural diversity and we too must ensure that diversity is carried out.

One final word on freedom of panorama. I urge you all to vote to delete the whole of paragraph 46 tomorrow because if we do that, with one press of our button in the European Parliament, it will mean that photographers across Europe can safely continue to press their buttons.

Г-жо Председател, уважаеми представители на Комисията, уважаеми колеги, в качеството ми на докладчик в сянка нека да се изкажа по доклада на колегата Реда за хармонизирането на някои аспекти на авторското право и сродните му права в информационното общество. Искам да благодаря на колегите, с които работихме продължително и упорито за постигане на един, според мен, добре балансиран доклад.

Този крехък баланс, резултат от продължителни разговори и противоречия по много теми, който успяхме да постигнем, е резултат от дълги и тежки преговори и се надявам, че по време на днешното гласуване ще успеем да запазим постигнатото дотук. Важно е да подчертаем съществуващите чувствителни теми и да изпратим според мен правилното послание към Европейската комисия.

Убеден съм, че докладът ще послужи за добра основа на Комисията преди предстоящо преразглеждане на съществуващата правна рамка в сферата на авторското право и сродните му права, което се очаква до края на тази година. Трябва да се уверим, че преразглеждането и модернизирането на съществуващото днес законодателство ще постигне правилния баланс между интересите на потребителите в държавите - членки на Европейския съюз, но също така ще защити и правата и законните интереси на творците и на носителите на авторски права.

  Jean-Marie Cavada, au nom du groupe ALDE. Madame la Présidente, Monsieur le Commissaire, ce rapport très commenté est le fruit d'un travail collectif de la quasi-totalité des groupes politiques de ce Parlement, ce qui a d'ailleurs permis son adoption en commission juridique par 23 voix contre 25, dont celle du rapporteur, ce qui n'est pas rien. Je m'inscris donc dans le droit fil de ce qu'ont dit notamment Mme Comodini et Mme Honeyball, que je remercie publiquement.

Le résultat est satisfaisant et le texte est équilibré. Ce rapport qui sera voté aujourd'hui est très loin du texte original, qui aurait eu pour effet de réduire le droit d'auteur sans pour autant défendre réellement le consommateur. Qu'est-ce qu'une défense des consommateurs dans laquelle la diversité des cultures des 28 pays membres n'aurait pas de protection juridique réelle pour durer?

Je soutiens toutes les pistes intéressantes qui évoquent l'avenir des droits d'auteur et je considère que nous revenons d'ailleurs d'assez loin, car le niveau de protection des créateurs nécessaire à l'innovation et surtout à la puissante industrie culturelle européenne a été maintenu. Je me réjouis donc que le rayonnement de la compétitivité économique, d'une part, et de la singularité de l'Europe culturelle, d'autre part, aient été reconnus et même nettement protégés.

Je me félicite que ce rapport ait fait également un premier pas vers la responsabilisation des hébergeurs, sujet sensible, car ces plates-formes ne peuvent pas continuer à nous dire qu'elles ne sont que des autoroutes.

Leur responsabilité est de plus en plus saillante. On le voit bien maintenant avec un autre domaine, qui est celui de la liberté culturelle, de la sécurité à protéger, et même de la lutte contre la criminalité financière. Il est temps que la Commission et notre Parlement se penchent sur ce que j'appelle la règle des trois responsabilités, dont il sera question, Monsieur le Commissaire, lorsque vous reviendrez au mois de décembre.

Je veux également profiter de cette intervention pour inviter tous les collègues à voter contre l'amendement 3. Je précise, comme l'ont dit Mme Honeyball et Mme Comodini, que j'ai accepté, tout naturellement, à la demande de Mme la rapporteure, de voter contre le paragraphe 46, qui était pourtant issu d'un amendement que j'avais moi-même déposé. J'insiste sur l'aspect consensuel de ce document et vous remercie vraiment d'y avoir tous participé.

  Jiří Maštálka, za skupinu GUE/NGL. Paní předsedající, já bych se chtěl připojit k poděkování paní zpravodajce a všem stínovým zpravodajům, kteří se podíleli na této vypracované zprávě náročnou a kvalitní prací.

Od přijetí směrnice o informační společnosti v roce 2001 stále dochází k rychlejšímu vývoji technologií, digitalizaci a rozvoji sociálních sítí. Můžeme konstatovat, že technologie předbíhají zákony. Osobně jsem se však přesvědčil, že je velmi obtížné, ne-li nemožné, najít shodu v tom, jakým způsobem je třeba reagovat. Důvodem je dlouhodobá existence kulturních a právních tradic v autorském právu jednotlivých členských států.

Dnes hodnotíme implementaci směrnice o informační společnosti. Zpravodajka původně přišla s ambiciózním návrhem prosazujícím větší harmonizaci. Naše frakce se však obává, že takové návrhy by zvýhodnily řešení založená na fungování neviditelné ruky trhu a přinesly by další výhody velkým firmám, jako je například Google. Po několikaměsíční intenzivní práci jsem jako stínový zpravodaj naší frakce došel k závěru, že zatím nejsme připraveni vytvořit skutečně unifikované evropské autorské právo, které by nahradilo národní autorská práva v členských zemích. Asi nejlépe o tom svědčí vášnivá diskuse o tzv. svobodě panoramatu, která je v různých členských státech upravena odlišně. Napříč politickým spektrem se nám nakonec po složitých jednáních podařilo zformulovat kompromisní návrh, který představuje vyrovnanou úpravu mezi ochranou autorů a jejich odměňováním i ochranou uživatelů a práv občanů.

  Max Andersson, on behalf of the Verts/ALE Group. Madam President, my first computer had 3 583 bytes free – not kilobytes, bytes. The world has changed a lot since then. Culture has changed. But copyright is still basically in the old paradigm. The computer I have in my hand has a memory that is two-and-a-half million times larger than my first computer, but the sense of change is far greater than that. My first computer was connected to a tape recorder. This one is connected to the world. I would urge you, everyone, to vote for the good things in this report. They are a sign that the political system is waking up to the enormous change that has already taken place, and I would also urge you to consider the changes that are going to take place in the coming decades and the world we will be living in then.

  Joëlle Bergeron, au nom du groupe EFDD. Madame la Présidente, chers collègues, je crois que les bonnes intentions ne conduisent pas forcément aux bonnes mesures politiques, ni à la bonne législation.

La rapporteure Reda a sans doute été animée d'une très grande bonne volonté et de la générosité liée à sa personne quand elle s'est attaquée à cet épineux problème du droit d'auteur. Mais elle a manifestement oublié quelques principes qu'il est urgent de rappeler.

Défendre la culture, c'est aussi défendre le droit d'auteur, qui est à la fois la juste rémunération de la création artistique et de la protection du droit moral des artistes. Je regrette d'ailleurs que ce droit moral n'ait jamais été évoqué tout au long de ce rapport, C'est le droit moral des artistes qui détermine tout le reste.

Le créateur doit pouvoir veiller à ce que son œuvre ne soit ni dévaluée ni dénaturée artistiquement, ni politiquement, ni idéologiquement. Or, l'exception de panorama, que la rapporteure défend à tout prix, ouvre une brèche dans la protection de ce droit économique et moral. Et si on enlève aux auteurs un droit de contrôle sur l'exploitation de leur œuvre, ils n'ont plus aucun respect de leur personne. Contrairement aux rumeurs folles qui circulent sur l'internet, ce contrôle n'entrave en rien la possibilité pour chacun de photographier des œuvres publiques. Il offre seulement l'indispensable garantie que l'œuvre ne sera pas exploitée à des fins obscènes, politiciennes ou idéologiques par des personnes farfelues ou malveillantes.

The whole issue of harmonising authors’ rights in Europe is a crucial issue in order to treat the authors and creators properly, which does not mean locking everything. Madame la Présidente, le rapport Reda voulait consacrer la liberté de panorama, c'est-à-dire le droit de diffuser librement des photographies de monuments sans l'autorisation des architectes concernés et sans droit d'auteur. Un amendement a heureusement supprimé cette funeste initiative qui ne protégeait pas assez le droit d'auteur des architectes.

Cette suppression permettra à chaque État de trouver un équilibre plus raisonnable entre le droit d'auteur et le droit des photographes. La France, par exemple, ne reconnaît pas la liberté de panorama, mais a un système beaucoup plus subtil qu'elle appelle la "théorie de l'accessoire". Cette théorie protège le droit d'auteur des architectes, mais permet néanmoins de diffuser librement les photographies d'un bâtiment quand celui-ci n'est que l'élément accessoire d'un paysage plus vaste.

Grâce à la modification apportée au rapport Reda, la France pourra conserver ce beau système et je m'en réjouis.

Das Urheberrecht folgt einer gegensätzlichen Logik. Der Satz „Alle Rechte vorbehalten“ bedeutet eigentlich: Alles ist verboten, was nicht ausnahmsweise erlaubt ist. Die Nutzung von Fotografien, Videos, von Abbildungen, die dauerhaft an öffentlichen Plätzen stehen, sollte auch weiterhin ohne Einschränkungen möglich sein.

Der Urheberrechtsextremismus muss gestoppt werden. Die Panoramafreiheit muss sichergestellt sein. Jahrhundertealte Kulturgüter gehören der Allgemeinheit und sollten auch weiterhin frei zugänglich sein.

Pozwolę sobie przedstawić kilka uwag wyjaśniających, które warto poczynić przy tym właśnie sprawozdaniu, dlatego że naszym obywatelom należy się jasna, rzetelna, niezwykle klarowna informacja o tym, czym my się tutaj zajmujemy i czego tak naprawdę dotyczą dokumenty, nad którymi pracujemy. Ja uważam, że to sprawozdanie na pewno zrobiło wielką furorę, ale także zrobiło i wprowadziło ogromne zamieszanie w całym świecie kreatywnym. Do mnie dotarły takie informacje z mediów, że jest to sprawozdanie, które wprowadza reformę prawa autorskiego. Doskonale wiemy, że to sprawozdanie nie jest reformą prawa autorskiego i możemy spodziewać się, że być może pod koniec tego roku otrzymamy projekt ze strony Komisji. Dziękuję Panu Komisarzowi za wstępne uwagi na ten temat.

Dotarła do mnie także informacja z mediów, że jest to ustawa panoramiczna, uściślając, że jest to dokument, który wprowadzi przepis, że każdy obywatel, który będzie chciał sobie zrobić zdjęcie na przykład na tle Koloseum, będzie musiał za to zapłacić: nie wiadomo ile i nie wiadomo komu. Ja rozumiem, że każdy chce zbić swój kapitał polityczny tam, gdzie jest to możliwe, ale przede wszystkim winni jesteśmy rzetelną, klarowną informację naszym obywatelom. A zatem, po pierwsze, trzeba przekazać, że jest to sprawozdanie z inicjatywy własnej, które nie niesie żadnych skutków legislacyjnych i po dzisiejszym głosowaniu nic w rzeczywistości prawa autorskiego się przecież nie zmieni.

Po drugie, warto powiedzieć, czym to sprawozdanie jest, a właściwie czym być powinno: powinno być to sprawozdanie, które ocenia wprowadzanie w życie w państwach członkowskich dyrektywy InfoSoc z 2001 r. Niestety z przykrością muszę powiedzieć, że tej treści w tym sprawozdaniu akurat zabrakło. Ale jedno możemy stwierdzić, że po wielomiesięcznych trudnych negocjacjach możemy uznać ten tekst za tekst wspólny i tekst dobry. Tekst, który jest bardzo zbalansowany, który z jednej strony broni praw osób, konsumentów, w dostępie do treści legalnie nabytych, z drugiej zaś gwarantuje twórcom, autorom możliwość obrony ich praw. Jeśli tak będziemy podchodzić do reformy prawa autorskiego, jestem o nią spokojny.

It is of course right that – providing we deal with the voting in the way that we feel the large groups in this House are about to – we will arrive at a situation where the national positions of each of our Member States remain protected, so that they can deal with that in the way that they feel is appropriate. Naszym obowiązkiem jest zagwarantować, by tak właśnie się stało, aby nikt nie mógł nikomu narzucać, w jaki sposób ma kreować tę właśnie przestrzeń swobody obywatelskiej.

  Dietmar Köster (S&D). Frau Präsidentin, liebe Kolleginnen und Kollegen! Der Bericht könnte die Überschrift tragen: Freier Zugang und faire Vergütung.

Im Bericht ist es gelungen, eine ausgewogene Balance zwischen den Interessen der Kulturschaffenden an einer fairen Vergütung und dem freien Zugang der Internetnutzer zu Online-Angeboten herzustellen. Im digitalen Zeitalter müssen die Künstlerinnen und Künstler von ihrer Arbeit leben können, und wir wollen zugleich keine Kriminalisierung – in welcher Form auch immer – von Internetnutzern.

Weitere wichtige Ergebnisse des Berichts sind: Die Rechte der Kulturschaffenden werden im Verhältnis zu anderen Rechteinhabern gestärkt. Es werden europaweite Mindeststandards für Ausnahmeregeln zum Urheberrecht gefordert. Ausnahmen werden für pädagogische Zwecke und auch für Bibliotheken festgeschrieben.

In der Öffentlichkeit wurde zuletzt stark über das Thema Panoramafreiheit diskutiert. Hier produzierte ein Teil der Medien Sensationsmeldungen, die leider nichts mit der Realität zu tun hatten und zum Teil eher antieuropäische Vorurteile bedienten. Diese verbreiteten Meldungen lösen sich mittlerweile in Wohlgefallen auf.

Hier muss heute vom Parlament ein deutliches Signal ausgehen: Die Panoramafreiheit wird nicht beeinträchtigt. Daher sollten wir – müssen wir – gegen die entsprechende Ziffer 46 stimmen.

Für die künftige Gesetzgebung ist zu überlegen, die bewährten nationalen Praktiken zur Panoramafreiheit beizubehalten.

  Dawid Bohdan Jackiewicz (ECR). Budowa jednolitego rynku cyfrowego wymaga usunięcia jeszcze bardzo wielu barier w przepływie informacji cyfrowych. Przestrzeń cyfrowa zmienia się w błyskawicznym tempie, więc i przepisy prawne, które ją regulują, muszą ulegać zmianom. Muszą to być jednak zmiany, które realnie odpowiadają potrzebom społeczeństwa informacyjnego i szanują prawo nas wszystkich do poruszania się w przestrzeni publicznej.

Otrzymałem setki wiadomości, próśb o to, aby dzisiaj głosować przeciwko ograniczaniu prawa do panoramy, i zamierzam wsłuchać się w ten głos, bo to głos rozsądku. Głos ludzi, którzy realnie poruszają się w przestrzeni cyfrowej. Burza, jaką wywołał ten temat, przypomina mi sprawę ACTA. W moim kraju wówczas na ulice wyszły setki, tysiące ludzi, którzy protestowali wobec ograniczania wolności w sferze cyfrowej. Dziś także nie pozwólmy, aby nasza prywatność była niepotrzebnie ograniczana. Musimy odróżnić wykorzystywanie fotografii w celach prywatnych i w celach komercyjnych. Dbajmy o prawa autorskie, gwarantujemy twórcom zyski, ale róbmy to w mądry sposób! Nie wprowadzajmy kolejnych pozbawionych sensu przepisów! Nie otwierajmy furtki do absurdów!

Pessoalmente, apoiarei a alteração 46 apresentada pela minha colega Marietje Schaake. Só posso aceitar limites à liberdade de panorama que venham do próprio Estado por razões de segurança ou razões de defesa nacional, nunca com base em direitos de autor. Aquilo que é público é democrático, é de todos, e não pode ser restringido com base em direitos privados. Aliás, considero que é um abuso de direito pretender limitar a liberdade de panorama com base no direito de autor, porque é proteger o direito de autor para além dos limites impostos pelos fins sociais e económicos do próprio direito e pelos princípios da boa-fé. Que é que se protege realmente com o direito de autor? Que direito tem o autor de impedir alguém de fotografar um monumento que está na via pública? Portanto, exceto se as fotos forem tiradas para fazer postais ilustrados e comercializá-los, aí sim...

Arvoisa puhemies, aika hyvin tilanteen muuttumista sitten vuoden 2001 informaatioyhteiskuntadirektiivin jälkeen kuvaa se, että kun levisi käsitys siitä, että parlamentti aikoo jotenkin rajoittaa panoraamaoikeutta, 500 000 ihmistä vetosi meihin, että emme tekisi sitä. Vuonna 2001 ei olisi tullut kuuloonkaan, että niin moni ihminen olisi niin nopeasti saanut tietoa siitä, mitä parlamentissa tapahtui. Kaikille voi kuitenkin kertoa, että lopputulos tulee olemaan siinä mielessä onnellinen, että jätämme tässä vaiheessa tämän asian todellakin kansallisesti päätettäväksi.

Se, että huomio on kiinnittynyt tällaiseen yksityiskohtaan, johon liittyy myös paljon vääriä pelkoja, on myös todistus siitä, että tämä mietintö on äärimmäisen tasapainoinen. Se tulee olemaan todella hyvä pohja tulevalle lainsäädäntötyölle. On oikeastaan ihmeteko, että valiokunta on pystynyt saamaan aikaan näin hyvän kompromissin tekijöiden, kuluttajien ja erilaisten välittäjien oikeuksien välillä. Sitä kompromissia ei tulisi nyt äänestyksessä horjuttaa.

Signora Presidente, onorevoli colleghi, al di là delle varie questioni di merito che ci fanno apprezzare nel suo complesso la relazione Reda, fatte salve alcune criticità che ne minano l'efficacia e la totale condivisione da parte nostra, non è secondario a mio avviso ricordare che la relazione in esame costituisce il primo, concreto atto d'iniziativa legislativa di un Parlamento democraticamente eletto in materia di copyright negli ultimi 20-25 anni.

È a tutti noto, infatti, che le riforme in materia di proprietà intellettuale dell'ultimo ventennio sono state non solo ispirate ma anche realizzate dall'Organizzazione mondiale per il commercio attraverso gli accordi TRIPS del 1994. Tutte le varie direttive, i regolamenti e le leggi che ne sono seguiti sono state mere applicazioni, interpretazioni o sviluppi di quanto concepito in una sede non molto dissimile, forse anche più oscura, da quella che riguarda i TTIP.

Ne consegue che, anche solo per questo motivo, la relazione Reda, se andrà in porto, rimarrà un'iniziativa che rimarrà nella storia del copyright e della democrazia. Per questo motivo, vi chiedo di non compromettere questa buona proposta con previsioni estranee al copyright come responsabilità degli intermediari alla tutela .......

Madame la Présidente, s'il est évident que de nouvelles règles sont à mettre en œuvre, cette bataille autour du droit d'auteur s'inscrit parfaitement dans l'opposition entre les défenseurs de la nation et les mondialistes. En effet, l'Union européenne cherche à faire disparaître les particularismes nationaux au profit d'un commerce mondial sans règles. Briser les barrières nationales en matière de réglementation du droit d'auteur et de la protection des données, comme Jean-Claude Juncker l'a demandé, implique toujours moins de contrôles et de restrictions. Cela avantagerait, bien évidemment, les grandes multinationales, telles que Google ou Amazon, qui pratiquent déjà allègrement l'évasion fiscale en Europe. J'avais déjà interrogé, antérieurement, le commissaire à la culture sur les pratiques fiscales des plates-formes de vidéo à la demande.

De plus, nous devrons trouver un cadre qui protège les créateurs et les petits auteurs tout en permettant la libre expression sur l'internet. En effet, la propriété intellectuelle est devenue une arme politique et c'est sous ce prétexte que l'on peut demander à des internautes de retirer des vidéos critiques. Cette évolution ne doit pas ouvrir la voie à une Union sans frontières et doit laisser la possibilité aux États membres de continuer à légiférer en faveur du respect, de la conservation et de la promotion de leur identité.

  Angelika Niebler (PPE). Frau Präsidentin, verehrter Herr Kommissar, liebe Kolleginnen, liebe Kollegen! Die europäische Urheberrechtsrichtlinie stammt aus dem Jahr 2001. Wir müssen das Urheberrecht modernisieren und an die Anforderungen des grenzüberschreitenden digitalen Binnenmarkts anpassen. Für mich ist dabei wichtig, die Interessen der Nutzer und der Rechteinhaber angemessen, vernünftig auszugleichen. Darum geht es ja auch schließlich im Urheberrecht. Copyright darf nicht nur die Perspektive der Konsumenten im Auge behalten, sondern eben gerade auch derjenigen, die kreative Arbeit leisten.

Deshalb, liebe Kolleginnen, liebe Kollegen, werbe ich heute bei Ihnen nochmals um Unterstützung für Änderungsantrag 1. Darin ist nicht gefordert – ich möchte das noch mal unterstreichen –, dass ein europäisches Leistungsschutzrecht eingeführt wird. Wer dies behauptet, hat den Antrag nicht gelesen oder will bewusst etwas Unwahres verbreiten. Erlauben Sie mir, dass ich den Änderungsantrag noch mal kurz vorlese. Darin wird die Kommission aufgefordert, „zu prüfen, wie Qualitätsjournalismus auch im digitalen Zeitalter bewahrt werden kann, und einen entsprechenden Vorschlag vorzulegen, um Medienvielfalt zu garantieren, insbesondere unter Berücksichtigung der wichtigen Rolle, die Journalisten, Autoren und Mediendienstleister wie Presseverleger hierbei spielen“.

Für mich ist Medienvielfalt nicht nur, dass jeder seine Meinung äußern und kommunizieren kann. Ich schätze die Arbeit der Journalisten, der Redakteure, der Autoren, auch derer, die Recherche durchführen, die für ihre Leser sortieren, die einordnen, die kommentieren. Das ist für mich Qualitätsjournalismus. Deshalb, liebe Kolleginnen und Kollegen, habe ich diesen Änderungsantrag eingereicht und würde mich sehr freuen, wenn Sie diesen heute Mittag bei der Abstimmung unterstützen könnten.

Sehen Sie nicht, dass dadurch der Kompromiss, den wir im Rechtsausschuss gefunden haben, infrage gestellt wird und der Bericht dadurch in Gefahr gebracht wird?

  Angelika Niebler (PPE), Antwort auf eine Frage nach dem Verfahren der „blauen Karte“. Vielen Dank für die Frage, Frau Reda. Erst einmal freue ich mich, dass Sie heute in Ihrer Muttersprache sprechen und nicht nur auf Englisch. Das zeigt doch, dass Sie etwas für Kultur übrig haben.

Um Ihre Frage zu beantworten: Qualitätsjournalismus, dieser Begriff kommt in Ihrem ganzen Bericht nicht vor. Deshalb – bin ich der Meinung – kann man diesen Änderungsantrag nochmals unterstützen. Er steht überhaupt nicht im Widerspruch zu irgendeiner Aussage in Ihrem Bericht, sondern ergänzt das, worauf es mir ankommt, nämlich hier dem Qualitätsjournalismus noch einmal eine besondere Bedeutung beizumessen und die Kommission aufzufordern, einen Arbeitsauftrag in Richtung Kommission zu erteilen, wie man dieses Thema einfach konstruktiv lösen kann.

Europejski sektor kreatywny i branża twórcza przynoszą rocznie około 4,2% PKB Unii, dając ponad 7 mln miejsc pracy w państwach członkowskich, w tym wiele związanych ze środowiskiem cyfrowym. Niestety obecne procedury związane z respektowaniem prawa autorskiego w internecie działają słabo, jeśli w ogóle, co jednocześnie utrudnia wzrost innowacyjności. Korzyści ekonomiczne z dobrze wykształconych pracowników, nowatorskich badań naukowych oraz wymiany wiedzy pomiędzy uniwersytetami i przedsiębiorstwami są ewidentne. Niestety europejska dyrektywa o prawie autorskim regulująca tylko niekomercyjne cele badawcze wyklucza praktycznie transfer wiedzy z uniwersytetów do sektora przemysłu prywatnego. Europejskie firmy nie mogą w tym względzie mierzyć się ze swoimi amerykańskimi konkurentami, którzy korzystają z bardziej elastycznych regulacji istniejących za oceanem.

Mimo że nie udało mi się przekonać posłów do słuszności pełnej harmonizacji wyjątków od praw autorskich, to jednak cieszy mnie ich miniujednolicanie na poziomie edukacji i bibliotek, a także postanowienia o dostępie transgranicznym. Mam nadzieję, że posłowie z innych grup politycznych dotrzymają słowa w sprawie odrzucenia pewnych szkodliwych poprawek ograniczających między innymi wolność panoramy i wolności linkowania. W obecnej formie raport jest do granic możliwości rozciągniętym kompromisem pomiędzy zwolennikami harmonizacji prawa autorskiego, do których należę, a środowiskiem konserwatywnym. Jako taki nie jest w pełni satysfakcjonujący dla żadnej ze stron. Tym niemniej gratuluję entuzjazmu i cierpliwości sprawozdawczyni Julii Redzie.

  Vicky Ford (ECR). Madam President, we do need to update copyright for the digital age, and people expect to be able to take their music, films and books with them when they travel. Consumers should be able to access legally-available content and know when they buy it how portable it is. But portability must not be an excuse for piracy – 8 million people work in the creative sector and they should be paid properly. Therefore, exemptions need to be clear and targeted.

Text and data mining has brought huge benefits for science and research in the non-commercial sector in my Member State, and there are some interesting examples of e-lending in rural areas. So perhaps the Commissioner could build on the experience in the countries that are doing this in his work.

In the UK and in other countries, the right to take pictures in public places of public buildings is a cherished freedom and an EU limitation is not appropriate. Incidentally, I would like to say to Ms Niebler that we do not need an internet tax across Europe either.

  Antanas Guoga (ALDE). Madam President, Europe needs competitive copyright policy. Europe needs to set up conditions for new innovative businesses such as Spotify and Netflix. At the moment, it is pretty difficult for these kinds of businesses to function in Europe in a single market.

Creative industries today have created 8 million jobs for people linked to this sector in Europe. It could be much more. It could be 20 million. That is what we should aim for, but in order to be competitive we need to be innovative. Copyright reform has to be one of those innovative moves for Europe.

I urge the Commission to be ambitious and to come up with a revolutionary copyright proposal in the autumn. Let us do it. We need to give cross border access to online content, we need to ensure portability, and we need to remove legal uncertainties and inconsistencies that affect the functioning of the internal market. I hope that Parliament will give clear guidance for the Commission today.

Κυρία Πρόεδρε, η συζήτηση για την προστασία των δικαιωμάτων του δημιουργού στην κοινωνία της πληροφορίας υπενθυμίζει την ανάγκη να επιτύχουμε ταυτόχρονα δύο στόχους: αφενός να προστατεύσουμε τους δημιουργούς και τα πνευματικά και περιουσιακά τους δικαιώματα, δηλαδή στην πραγματικότητα να προστατεύσουμε την ανανέωση της κοινής πολιτισμικής μας κληρονομιάς μέσα στον χρόνο και αφετέρου να δημιουργήσουμε νέες ευκαιρίες πρόσβασης στην καλλιτεχνική και πνευματική δημιουργία.

Έχουμε δύο προκλήσεις να αντιμετωπίσουμε: πρώτον, τις νέες τεχνολογίες, που δημιουργούν νέες δυνατότητες δημιουργίας αλλά ταυτόχρονα και πολλούς κινδύνους για τα δικαιώματα των δημιουργών. Δεύτερον, την οικονομική κρίση και τη λιτότητα, που και απομακρύνει τους λαούς μας από την τέχνη και τα γράμματα και στερεί από τους πνευματικούς ανθρώπους τους αναγκαίους για τη δημιουργία πόρους. Είναι επομένως ανάγκη όχι μόνο να ρυθμίσουμε την προστασία των δικαιωμάτων των δημιουργών αλλά πάνω απ’ όλα να εγγυηθούμε τη συνέχεια και τον πλουραλισμό του ευρωπαϊκού πολιτισμού.

  Tim Aker (EFDD). Madam President, when I see harmonisation in this place, it means one thing: making the free less free. You tried it once with the Anti-Counterfeit Trade Agreement, and you are trying it again with paragraph 46 to restrict the rights of panorama. I have had hundreds of emails and letters from graphic designers, Web designers, professional photographers, who fear for their livelihoods. They fear that the regulations coming out of this place are going to mean that their jobs are redundant.

But my message to those people is not to listen to the blank reassurances from this Chamber. They have their chance to defend their interests, and that comes when our referendum comes. They can vote ‘no’. They can vote to leave this place and have a government at Westminster – a government they can vote out, instead of the Commissioners that they did not vote for – deciding their laws. We can break free of this place. My appeal to those people who have written to me and to every single British MEP is: defend your interests, vote ‘no’, let us leave the European Union and take back control.

Signora Presidente, onorevoli colleghi, ritengo necessario, anche in questo settore, tutto l'impegno che l'Europa deve offrire per dare agli operatori un quadro di regole che possa permettere loro di lavorare con certezza e giusto profitto. Siamo consapevoli di vivere in un mondo che ormai non deve neanche più parlare di rivoluzione digitale, perché anche l'arte, la cultura, che vengono diffusi tramite la rete, sono una realtà che accompagna la nostra vita quotidianamente. Quindi si impone la necessità di sfruttarne tutte le possibilità, ma con grande attenzione, ricordandoci sempre il nostro dovere di tutelare, prima di tutto, la proprietà intellettuale degli autori e tutto il lavoro che ruota attorno al mondo dell'editoria.

Quindi, non facciamo pasticci da questo punto di vista. Quella di oggi è un'iniziativa del Parlamento, migliorata dal lavoro della commissione giuridica rispetto all'inizio, ma che è solo un'indicazione per la Commissione. Speriamo che almeno questa volta essa rinunci a voler imbrigliare, come al suo solito, con una serie di vincoli giuridici inutili, i cittadini europei e le aziende del settore e si concentri su pochi, chiari strumenti a tutela del lavoro e dei diritti.

  Pavel Svoboda (PPE). Paní předsedající, naše výchozí pozice nebyla jednoduchá. Původní návrh této zprávy o implementaci směrnice o autorském právu v informační společnosti obsahoval málo informací o takové implementaci, ale byly tam hlavně informace o budoucnosti této oblasti. Informací, jak který stát směrnici provedl, jaké s tím měl problémy, jaké kolem toho byly soudní pře, takových informací je tam minimálně. Důsledkem bylo zmatení veřejnosti. Veřejnost nezná rozdíl mezi legislativní a nelegislativní zprávou, a tak byla přesvědčována, že již dnes tady budeme něco harmonizovat, dělat změny. Považuji tuto záměnu žánrů a na ni navazující politické kampaně za škodlivé. Rozhodně tuto zprávu nepovažuji za příklad hodný následování, pokud jde o implementaci čehokoliv.

Nicméně je pozitivní, že se podařilo dopracovat zprávu do přijatelné podoby. Chci za toto poděkovat kolegům z Výboru pro právní záležitosti. Návrh představuje dobrý základ pro budoucí diskusi o reformě autorského práva, která je nezbytná. Evropský parlament musí dát najevo, že v oblasti autorského práva si je vědom výzev jednadvacátého digitálního století, aniž by ohrozil kreativitu a kvalitu obsahu.

  Enrico Gasbarra (S&D). Signora Presidente, onorevoli colleghi, vorrei ringraziare la relatrice, la collega Reda, tutti i colleghi relatori e i colleghi degli altri gruppi e delle altre commissioni per aver trovato un accordo su un testo comune in un ambito così complesso.

Con questa relazione si compie certamente un passo avanti, seppur non definitivo, perché si arriva finalmente a un'indicazione chiara e soprattutto molto equilibrata per la Commissione europea, utile a un quadro innovativo di sviluppo dell'Agenda digitale, capace di tutelare il diritto d'autore, il diritto all'accesso alla conoscenza, pur promuovendo il ruolo delle industrie culturali e creative e senza trascurare la responsabilità di tutti gli operatori.

Auspico che nel testo vi sia l'abolizione del paragrafo 46, affinché venga ribadito il principio di libertà di panorama, e rivolgo un ultimo appello alla Commissione e al Consiglio affinché si dia attuazione al trattato di Marrakech per veder garantito il diritto all'informazione e alla cultura dei non vedenti.

  Peter van Dalen (ECR). Fotografen, krantenredacties en kunstenaars volgen vandaag dit debat omdat de vrijheid van panorama mogelijk wordt vervangen door een juridisch dictaat. Ik ben tegen paragraaf 46 in het verslag, want daarin staat dat al het commerciële gebruik van beelden van openbare werken vooraf moet worden goedgekeurd. In heel veel Europese landen is dat gewoon toegestaan. Waarom dan nu hier het strengste regime kiezen? Ik begrijp dat niet. Mijn stelling is: handen af van de openbare ruimte. Die is van iedereen. Bovendien, waar bemoeit Europa zich mee? Lidstaten kunnen prima zelf regelen hoe om te gaan met de openbare ruimte. Ik zal dus elke poging om de vrijheid van panorama in te perken afwijzen. Dat is voor mij echt een cruciaal punt. Ik roep de commissaris op, wanneer hij dit najaar met wetgeving komt, borg te staan voor de vrijheid van panorama.

  Juan Carlos Girauta Vidal (ALDE). Madam President, cultural industries are a significant generator of growth and jobs. Copyright is the cornerstone of cultural policy. However, the current regime needs to be better tailored to the digital environment in order to ensure fair remuneration to creators and to conform to consumer expectations.

This is the reason why I welcome the Commission’s commitment on the modernisation of the Copyright Directive. The lack of harmonisation of exceptions in the EU creates legal uncertainties. At least a core of exceptions should be made mandatory. Restrictions linked to geo-blocking prevent European citizens from enjoying cultural diversity across borders and European companies from fully benefiting from the possibilities offered by the digital environment. We need to find legislative and market—driven solutions so that European citizens can access any work available in a Member State from anywhere in the EU. Last but not least, I also believe strongly in freedom of panorama.

  Isabella Adinolfi (EFDD). Signora Presidente, onorevoli colleghi, il Parlamento europeo, nell'immaginario, dovrebbe essere un'istituzione progressista che è vicina agli interessi dei cittadini e combatte per difenderli. Invece oggi dimostra tutta la sua stanchezza, apprestandosi a licenziare faticosamente un testo che mi sento di definire a dir poco reazionario, contenente principi contrari al mercato unico digitale e imbevuto di un'ideologia neoliberista: i punti del PIL sono ripetuti come una cantilena, le cifre sui posti di lavoro vengono citate con molta approssimazione e si sbandiera in continuazione il mantra della crescita.

Addirittura avete sentito la necessità di riaffermare con enfasi che il diritto di proprietà privata sia il fondamento della società moderna. Ma non dovevamo dare indicazioni per la modernizzazione del diritto d'autore e renderlo adeguato alle nuove tecnologie e al nascente mercato unico digitale? Cosa abbiamo fatto, invece? Abbiamo scelto con cura gli aggettivi, affinché tutto cambiasse senza cambiare nulla, spaventati dal fatto che anche soltanto un soffio di vento potesse portare una ventata di freschezza.

Inaccettabile il richiamo all'introduzione della responsabilità degli intermediari digitali e dei service provider, nonché un enforcement robusto, che rischia di essere, prima di tutto anacronistico, vista la sua frequente inefficacia, oltre che pericoloso per i diritti fondamentali.

I diritti degli autori vengono poi citati strumentalmente per giustificare il mantenimento di posizioni di rendita sul mercato, che non hanno più senso viste le opportunità offerte dalle nuove tecnologie. Da membro della commissione cultura sono inorridita quando ho letto che la cultura viene considerata un prodotto da vendere e chi vuole beneficiarne – cito testualmente – "deve pagare per farlo". Ma non dovevamo costruire un'Europa per i cittadini e dei cittadini?

La libera diffusione della cultura e della conoscenza non dovrebbe essere la stella polare di una riforma che voglia definirsi tale e al passo con i tempi? Perché avere paura dell'introduzione di eccezioni e limitazioni al diritto d'autore, a tutela dei diritti fondamentali e dell'interesse pubblico?

Colleghi, io non mi accontento di questo testo e continuo a credere che abbiamo il dovere verso tutti i cittadini europei di fare di più…..

Madame la Présidente, en premier lieu, je m’oppose à toute harmonisation dans le domaine des droits d’auteur, ne serait-ce qu'à cause de l’ambiguïté du terme copyright, dans la version anglaise, alors que les deux notions relèvent de philosophies différentes. La directive Infosoc existe, soit. Cette directive n’a pas permis l’harmonisation des droits d’auteur. Tant mieux!

Les travaux de la mission menée en France par Pierre Sirinelli, éminent professeur de droit, présentent un état des lieux de ce qu’entraînerait la révision de cette directive proposée par ma collègue Julia Reda: l’affaiblissement des droits d’auteur, ce à quoi je m’oppose fermement.

Ensuite, il n’est proposé aucune révision de la directive sur le commerce électronique, qui garantit un régime très protecteur aux prestataires de l’internet. Nous pouvons même parler d’irresponsabilité. Avec ce projet de révision, vous risquez d’accoucher, une fois encore, d’un texte mort-né au détriment des auteurs.

Qui peut prévoir ce que sera l'internet dans 5 ans? L’Union européenne est un logiciel obsolète qui ne produit que des disquettes. Nous en avons encore la preuve aujourd’hui.

  Axel Voss (PPE). Frau Präsidentin, lieber Herr Kommissar Oettinger, liebe Kolleginnen und Kollegen. Die digitale Herausforderung erfordert eben auch Anpassungen im Urheberrecht, und denen müssen wir begegnen, aber eben auch zugleich die Chancen, die sich daraus ergeben, nutzen. Wir sollten uns deshalb auch dafür einsetzen, dass die grenzüberschreitende Portabilität der Inhalte für Verbraucher verbessert wird, dieser Frage des Geoblockings in den verschiedenen Bereichen angemessen, aber auch abgestimmt auf die Bedürfnisse der Industrien oder auch der Bürgerinnen und Bürger besser begegnen.

Wir hatten – das wurde schon angesprochen von den Kolleginnen und Kollegen – in den letzten Tagen die Aufregung um die Panoramafreiheit, dass diese in Gefahr sei – dem ist ja nicht so, das wurde schon hinreichend besprochen. Wir sollten aber dafür sorgen, dass eben die Panoramafreiheit – und damit können wir heute den ersten Schritt tun – erhalten bleibt, wie sie in Deutschland oder in den anderen Mitgliedstaaten auch gilt, und hier vielleicht die Verbesserungen in der Zukunft dann abstimmen.

Aber, und das ist ganz entscheidend, wir müssen genauso mit Enthusiasmus und Zielstrebigkeit sicherstellen, dass die Rechte von den Künstlern, Autoren, Urhebern und Verwertern im Zeitalter der Digitalisierung auch geschützt bleiben.

Der Text, über den wir heute abstimmen, ist eine mehr oder weniger ausbalancierte Lösung, die sowohl die Interessen der Kunstschaffenden als auch der Verbraucher berücksichtigt. Von daher müssen wir auch in Zukunft für ein europäisches Rechtssystem sorgen und dafür sorgen, dass das Urheberrecht gut gestaltet wird. Da bin ich sicher, dass das in guten Händen ist.

Signora Presidente, onorevoli colleghi, riconosco che questa relazione d'indirizzo per la revisione della direttiva sui diritti di autore costituisca una buona base per la proposta legislativa della Commissione e apprezzo anche le parole del Commissario Oettinger. Si raccolgono molte delle istanze della commissione cultura e questo è un lavoro frutto di una grande campagna di elevata mediazione, collega Adinolfi.

Sono un po' stupita che, proprio tu, relatrice del parere in commissione CULT, sia critica del fatto che ci non sia stato un consenso sulla tua relazione.

Comunque, qui si dimostra quello che da tempo diciamo, e cioè che la portabilità dei contenuti culturali è compatibile con la territorialità, e si riconosce la specificità culturale tra l'ampliamento dell'accesso alla cultura e il riconoscimento dei diritti morali ed economici degli autori, nonché la sostenibilità economica per le industrie culturali e creative, specie audiovisive.

Aggiungo due sole annotazioni. Primo, io voterò contro l'articolo 3, paragrafo 46, ma ho il dovere, onestamente, di dire che non era in discussione la libertà di panorama, cioè la libertà di fotografare liberamente, ma semmai l'utilizzo e lo sfruttamento commerciale delle relative immagini.

Bene la proposta sulla responsabilità da chiarire degli over the top.

  Daniel Dalton (ECR). Madam President, I would like to thank the rapporteur for her good work and also for the good cooperation that we had. I am just sad that the Committee on Legal Affairs (JURI) took the wrong approach to this report. Banning the freedom of panorama exclusion, for example, was exactly the wrong way to look at the digital single market. I am glad that the groups and the author have agreed now to remove it, but I have huge concerns that the committee thought it was a good idea in the first place. It shows that there is little understanding of the immense changes that the digital environment is bringing to consumers, users, right holders and businesses.

That is not the only problem. The call to reopen the E-commerce Directive is also unwelcome, as is the very wide educational exemption, the study into the pan-European licence and the amendment for a new internet tax. But my final point is on geo-blocking. One of Europe’s biggest sporting events is taking place right now: it is the Ashes cricket series between England and Australia, and it has a global audience of billions. Yet if you bought access to watch this in the UK, you are blocked from accessing it here in France or on holiday in Spain, even though the right to work is there. I do not want a pan-EU licence, but I want portability of legally-bought content. However, on this, as in so many other areas, the report simply does not recognise how the modern digital market works.

  Milan Zver (PPE). Jaz sem vesel, da smo v največjih političnih skupinah uskladili besedilo. Na prvotni predlog je bilo namreč ogromno pritožb umetnikov in predstavnikov kulturnih industrij. Danes odpiramo novo debato, ki naj spodbudi nastanek dopolnjene zakonodaje na tem področju.

Tako kot pri mnogih drugih vprašanjih je tudi pri vprašanju avtorskih pravic potrebno iskati določeno ravnovesje. Upoštevati moramo pravice zaposlenih v kulturi, obenem pa omogočiti širok dostop kulturnih dobrim čim širši javnosti.

V poročilu smo se opredelili do izjem, kjer se lahko zanemari avtorske pravice. V Evropski ljudski stranki se zavzemamo za to, da se na področju avtorskih pravic upošteva načelo subsidiarnosti, tako da lahko vsaka država članica obdrži določeno avtonomijo na tem področju.

To je še posebej pomembno zaradi ohranjanja kulturne raznolikosti v Evropski uniji in zaradi specifičnih potreb posameznih držav, še posebej to velja za manjše članice. V javnosti zadnje čase krožijo obtožbe, da Evropska unija poskuša omejiti pravico do objave tako imenovane panorame – zasebnih posnetkov znanih kulturnih stvaritev na primer na facebook-u ali drugih socialnih omrežjih.

To enostavno ni res. Besedilo, o katerem bomo danes glasovali, je dobro. Upošteva potrebe končnih uporabnikov, obenem pa vztraja na zaščiti intelektualne lastnine. Hvala vsem avtorjem.

Madame la Présidente, chers collègues, je voulais dire que je regrette que la question du panorama monopolise autant les débats, simplement parce que beaucoup de contre-vérités ont été dites. Je vais rétablir les choses telles qu'elles sont. En aucun cas, il ne s'agit d'interdire de publier ses photos de vacances sur l'internet ou ailleurs, mais simplement de dire qu'il n'est pas juste qu'un artiste, parce qu'il choisit de produire ses œuvres dans l'espace public, ne puisse pas recevoir une rémunération équitable lorsqu'il en est fait un usage commercial.

L'objectif de ce rapport était d'adapter au monde numérique la question de la culture et du droit d'auteur. Effectivement, les bouleversements induits par les usages numériques sont nombreux: ils changent les rapports de nos concitoyens à la culture, mais pas qu'à la culture, car ils changent aussi la manière dont fonctionnent le commerce et les services. Ils changent même la conception que nous pouvons avoir aujourd'hui des rapports sociaux et du travail.

Pourquoi un traitement particulier pour la culture? Après tout, il est vrai que la culture revêt une grande importance économique: c'est le troisième secteur d'activité en Europe, et il représente plus de 500 milliards de chiffre d'affaires par an, mais moi je récuse cette vision purement mercantiliste de la culture. Elle revêt aussi une importance politique, symbolique et humaniste. Lorsque nous parlons de barrières, d'obstacles, d'entraves et de droits d'auteur, personnellement, cela heurte ma conception de la culture européenne.

Faut-il rappeler qu'il n'y a pas de culture sans artiste, que le droit d'auteur est un droit fondamental et qu'il est juste et bon que chacun puisse vivre de son travail? Je me félicite que le texte qui nous est proposé, à l'inverse de celui qui était initialement sur la table, remette les artistes au centre du débat, place qu'ils n'auraient jamais dû quitter. Notre régime de droits d'auteur permet une culture diverse et florissante. J'espère que la Commission...

  Pirkko Ruohonen-Lerner (ECR). Arvoisa puhemies, oikeus maisemaan on mielestäni perusoikeuden kaltainen oikeus. Vaatimukset rajoittaa julkisten tilojen kuvaamista, vaikkakin vain kaupallisiin tarkoituksiin, kuuluvat mielestäni menneille vuosikymmenille. Olen saanut paljon palautetta tästä mietinnöstä erityisesti nuorilta internetin käyttäjiltä, joille pelkkä ajatus siitä, että julkisen tilan käyttöä ruvettaisiin rajoittamaan, tuntuu mahdottomalta ymmärtää.

Euroopassa vallitsee suurtyöttömyys. Työttömyydestä kärsivät erityisesti nuoret, joista ainakin osa voi työllistää itsensä luovien alojen parissa hyödyntäen esimerkiksi internetin tarjoamia rajattomia mahdollisuuksia. Siksi ei pitäisi asettaa rajoituksia ja uusia esteitä nuorten omaehtoiselle työllistymiselle, vaan esteitä tulisi ennemminkin purkaa ja siten madaltaa kynnystä ryhtyä yrittäjäksi. Viime vuosina on puhuttu paljon paremmasta ja kevyemmästä sääntelystä. Toivon, että tämä tavoite toteutuisi, ja toivon, että oikeus maisemaan olisi tulevaisuudessa nykyistä laajempi perusoikeuden kaltainen oikeus.

  Victor Negrescu (S&D). Doamnă președintă, dragi colegi, acest raport nu este despre drepturile de autor sau doar despre cum afectează mediul digital. Acest document este despre modelul economic pe care vrem să îl promovăm, mai ales în spațiul online din Europa.

Noi, social-democrații, credem într-un internet sigur și corect, iar noile tehnologii trebuie să permită cetățenilor mai multă libertate și mai multe drepturi. Pentru noi, spațiul digital nu trebuie dominat sau controlat de nimeni, dar, pentru un internet liber, trebuie să îi protejăm pe cei care creează și folosesc mediul online pentru a se dezvolta.

Drepturile de autor nu trebuie să îngrădească potențialul de dezvoltare și de afirmare al spațiului digital, mai ales pentru educație, cultură sau antreprenoriat, dar trebuie să protejăm și munca autorilor reali. Sectorul economic digital european are nevoie de un sistem de drepturi de autor armonizat, care să îi permită să fie competitiv în raport cu concurenții săi de pe alte continente. Sunt mulțumit de compromisurile atinse pentru acest raport, dar cred sincer că puteam face mai mult pentru mediul online european.

Avem nevoie de libertate de panoramă. Avem nevoie de un sistem digital bine dezvoltat, susținut și armonizat.

  Constance Le Grip (PPE). Madame la Présidente, en votant tout à l'heure ce rapport après son adoption en commission des affaires juridiques, nous avons l'occasion d'envoyer un message fort à la Commission.

Nous avons l'occasion de dire à la Commission, dans le cadre de sa préparation de la révision de la directive sur les droits d'auteur, que nous sommes en faveur d'une adaptation du droit d'auteur à l'ère numérique, mais contre sa démolition ou sa remise en cause.

Nous avons substantiellement, en commission des affaires juridiques, réorienté et réécrit le projet initial de rapport que nous avait présenté Mme Reda et, à cette occasion, affirmé et réaffirmé des priorités et des principes forts: juste rémunération du travail et du talent des auteurs et des créateurs, respect de la diversité culturelle européenne, affirmation du principe de territorialité, nécessité de progresser en matière de portabilité – cela est parfaitement compatible, –  nécessité de lutter contre le piratage et la contrefaçon, qui sont de véritables fléaux, nécessité de mettre en place un régime de responsabilité des plates-formes, des hébergeurs, de tous les intermédiaires qui se trouvent actuellement dans un système d'irresponsabilité, nécessité d'adapter le droit d'auteur à l'ère du numérique et non de le démanteler, de le renforcer et non de l'affaiblir. Tout cela est possible, car le rapport, tel que nous l'avons puissamment amendé en commission des affaires juridiques, contient des pistes concrètes dans ce sens.

Nous attendons de pied ferme, Monsieur le Commissaire, la proposition de révision de la directive que vous nous présenterez mais, sachez que nous serons attachés au respect du principe de la propriété intellectuelle des artistes et des créateurs.

Det är ett viktigt initiativbetänkande som vi diskuterar, för det krävs att politiken tar sig an den uppgift som det handlar om; både att ge medborgarna möjlighet att kunna ta del av kultur, kunskaper och kontakter via nätet, men också ge skaparna, kreatörerna, och distributörerna rätt till ersättning för deras hårda arbete. Den balansen måste lagstiftningen kunna klara av.

Jag tycker att det är viktigt att politiken också tar ansvar för en levande kultur, och då måste vi se till att kulturutövarna får goda villkor, men vi måste också kunna sprida kulturen och ta del av de möjligheter som exempelvis e-böcker ger; sprida den till barn och ge barn möjlighet att kunna läsa tidigt. Jag ser stora möjligheter med det.

Jag vill nämna två saker som handlar om den här balansen. Den ena är utbildning. Från början tyckte jag att betänkandet innehöll synsättet att utbildningsutövare kunde sprida vad som helst utan att betala kulturutövarna. Det har vi satt stopp för och gjort bättre. Det andra handlar om panoramafriheten. Den måste värnas.

Det här är den balans det handlar om i ett konkret exempel.

Signora Presidente, onorevoli colleghi, voglio ringraziare la collega Reda per la straordinaria pazienza che ha posto in questo lavoro, che ci consente di avere un'area vasta di condivisione di un compito molto delicato, cioè quello di riscrivere e di dare una definizione legislativa al diritto di autore nel sistema della rete.

La produzione materiale di beni e di servizi viene superata e, per molti versi, cambiata dall'utilizzo delle tecnologie e dei nuovi linguaggi ed è perciò importante quello che stiamo facendo proprio a questo fine: ridefinire i diritti sia per chi produce sia per gli utenti.

Considero molto importante per questo anche gli elementi che riguardano l'incentivazione della digitalizzazione di tutto ciò che si può considerare il patrimonio culturale europeo e, allo stesso modo, è importante rafforzare l'eccezione per l'educazione e per le biblioteche.

Poi per quanto riguarda la libertà di panorama, non ci dovrebbe essere neanche bisogno di commentarla: la libertà non va messa in discussione. Altra cosa è, ovviamente, contrastare comportamenti indistinti o peggio ancora distorsivi. Per questa ragione, anch'io credo che sia molto importante cancellare il paragrafo 46.

  Evelyn Regner (S&D). Frau Präsidentin! Wir sind uns einig: Eine Reform des Urheberrechts ist notwendig. Das, was wir derzeit auf dem Tisch liegen haben, ist absolut nicht mehr zeitgemäß. Fast jeder ist täglich im Internet und in sozialen Netzwerken. Für uns alle Sozialdemokratinnen und Sozialdemokraten sind einige Dinge wichtig, die den Zugang der Menschen, der Bürgerinnen, der Bürger, jener, denen es besser geht, derer, die es nicht so leicht haben, ermöglichen sollten, nämlich den uneingeschränkten Zugang zu Informationen. Deshalb ist mir besonders die Ausnahme bei Bildungseinrichtungen wie Schulen, Universitäten und Bibliotheken wichtig, und das ist in dem Bericht enthalten.

Ein anderes wichtiges gutes Element, das wir ihnen auf den Weg geben möchten, ist das Verbot des Geoblockings, also auch eigentlich eine Eigentümlichkeit in einem Europa, in einem europäischen Binnenmarkt.

In den letzten Tagen hat es viel Aufregung um die Panoramafreiheit gegeben. Ich sage da nur so viel: Ich persönlich bin für eine uneingeschränkte Panoramafreiheit. Alles andere ist weltfremd. Wir müssen allerdings hier in diesem Haus wahrscheinlich noch einiges an Zusammenarbeit, Zusammenhalt leisten, dass das auch entsprechend sozial verträglich durchsetzbar ist.

Zum Schluss möchte ich allerdings auf einen Änderungsantrag hinweisen, gegen den ich wirklich nun bin, nämlich die Einführung eines sogenannten Leistungsschutzrechts für Presseverlage, wie es durch einen Änderungsantrag im Plenum von konservativer Seite gefordert wird. Ein solches Gesetz führte bereits in Deutschland oder Spanien bei Nachrichtenzusammenfassungen zu erheblichen Einschränkungen bei den Verweisen oder beim Linking. Es stellt eine riesige Hürde für die Innovationskraft des Internets dar. Deshalb sollte man auf alle Fälle dagegen stimmen.

  Ева Паунова (PPE). Най-голямото предизвикателство пред авторското право в 21-ви век е постигането на баланс между интересите на потребителите, авторите, разпространителите и правопритежателите. Промените трябва да стават внимателно и след изчерпателни консултации. Всяка дори и малка крачка напред отразява цели технологични епохи.

Адекватните права за интелектуална собственост са един от факторите за най-бързо и безпроблемно преминаване към новия дигитален икономически модел. Модел, който не дели държавите на малки и големи и дава равен шанс както на големите, така и на малките и стартиращи компании.

Едно от най-големите богатства, което имаме в Европа, са продуктите на нашите творци, а всички знаем, че талантите не се раждат по права пропорционалност само в най-големите, но и в по-малките страни. Затова новите правила в единния цифров пазар трябва да дават поле за изява на композиторите, артистите, режисьорите и архитектите и от по-новите страни членки, като България.

Вярвам, че с гласуването днес ще дадем силна заявка за въвеждането на работещи и балансирани правила за авторското право в интернет.

  Marc Tarabella (S&D). Madame la Présidente, le marché unique numérique n'existe toujours pas en Europe. Les consommateurs européens se voient encore souvent refuser l'accès à certains services numériques à cause de leur localisation. Il n'est pas normal que l'accessibilité transfrontalière des contenus de vidéo à la demande ne soit garantie que pour moins de 4 % de la totalité de ses contenus. Les consommateurs doivent avoir plus d'accès à des services provenant d'autres États membres et ce, d'où qu'ils soient.

Il est impératif de définir plus clairement et plus complètement les droits des consommateurs dans le cadre du droit d'auteur. Je salue la proposition d'exception pour l'éducation et les bibliothèques, qui permettra à un public plus large d'accéder à des contenus numériques.

Nous voulons un accès à la culture pour tous, y compris dans le monde numérique. Ce rapport est un équilibre entre le droit des consommateurs et la nécessaire protection des droits d'auteur, qui est garante de la diversité. Celle-ci est une richesse, qui plus est en matière culturelle, qu'il convient de préserver.

  Νότης Μαριάς ( ECR). Κυρία Πρόεδρε, ο Χάρτης Θεμελιωδών Δικαιωμάτων προστατεύει ως γνωστόν την ελευθερία έκφρασης και πληροφόρησης. Ταυτόχρονα προστατεύει και την ελευθερία της τέχνης, της επιστήμης και ως εκ τούτου το δικαίωμα στην πνευματική ιδιοκτησία. Πρέπει λοιπόν να βρούμε έναν τρόπο για να υπάρξει μια λεπτή ισορροπία μεταξύ των δικαιωμάτων του δημιουργού και του καταναλωτή, και αυτή τη συζήτηση κάνουμε σήμερα. Το πρώτο ερώτημα που πρέπει να τεθεί είναι ποιο είναι το κατάλληλο επίπεδο να ρυθμίσει αυτά τα θέματα. Είναι το επίπεδο της Ευρωπαϊκής Ένωσης; Είναι το επίπεδο των κρατών μελών; Πώς διαμορφώνεται η αρχή της επικουρικότητας; Τι μέτρα πρέπει να πάρουμε;

Το επόμενο θέμα αφορά το ίδιο το Διαδίκτυο, την ελευθερία στο Διαδίκτυο. Πρέπει να προστατευτούν οι δημιουργοί, γιατί οι δημιουργοί είναι ένα τεράστιο κοινωνικό κεφάλαιο για την Ευρώπη. Εάν δεν έχουν κίνητρα οι ίδιοι να προστατεύονται, είναι προφανές ότι δεν θα παράξουν έργο, δεν θα έχουμε στήριξη της ψηφιακής οικονομίας, των τεχνολογιών, της πληροφορίας και των καινοτομιών. Άρα λοιπόν πρέπει να βρούμε λύσεις σε όλα αυτά τα ζητήματα.

  Kaja Kallas (ALDE). Madam President, the discussion on copyright is far too black and white. It does not take into account the way behaviour has changed in the internet age. It is not as though the creators are going to win and the users are going to lose or vice versa. In the internet age there is no longer any clear division between the authors and the users, because every author is also a user and every user is an author. We cannot stop progress and we cannot stop innovation, no matter how hard we try. Our role is not to protect any vested interest but to create laws that actually make sense today in the internet age.

  Luke Ming Flanagan (GUE/NGL). Madam President, the European Union gets pilloried and attacked for coming out with stupid ideas from time to time. The most famous one – and I suppose, like a lot of urban myths, it might not necessarily be true – was the story of the fight for straight bananas, for some reason.

Well, the idea that you would restrict someone’s ability to distribute views of panoramas, whether that be for commercial or personal use, is completely and utterly ridiculous. The people who designed these buildings – let us say they are buildings – got paid for those designs. We have been contacted by many people who believe this is just another way for big business to make more money.

Technology was meant to improve our lives. I hope it does. When I was growing up, I could listen to any sporting event in the world on BBC radio. Even though I am from Ireland, we tune into it. I fear in the future that my grandkids will not have access to similar things because of the progress of technology and blocking. That is not what we are looking for. We are looking for progress and spreading culture.

  Günther Oettinger, Mitglied der Kommission. Frau Präsidentin, meine sehr verehrten Damen und Herren Abgeordneten. Ich danke sehr für Ihre engagierten Wortmeldungen, die Ihre Sachkunde beweisen und die mit zeigen, dass die urheberrechtlichen Fragen bei Ihnen gut aufgehoben sind.

Ich stelle fest, dass wir eine breite Mehrheit hier bei den Abgeordneten bemerken, die uns Mut machen. Es ist Zeit, das Urheberrecht zu modernisieren. Es gab kaum eine Wortmeldung, die gesagt hat: Lasst die Finger davon, werdet nicht aktiv. Ich glaube, die Option, keinen Vorschlag zu machen, wäre die schlechteste Option.

Zweitens: Wir wollen in unserem Paket für Copyright der technologischen Entwicklung und der Marktveränderung und dem Interesse der Bürger und der Verbraucher Rechnung tragen.

Drittens: Wir bemühen uns um einen ausgewogenen Vorschlag. Die Balance ist entscheidend – die Balance, die ja auch in Ihren Wortmeldungen abgebildet wurde, zwischen den berechtigten Interessen dessen, der geistige Werke erstellt, der schreibt, der recherchiert, der komponiert, der für intellektuelle Arbeit seine Zeit und seine Kompetenzen eingebracht hat, und andererseits einem breiten Zugang, möglichst keiner Grenze oder möglichst , engen Grenzen, die notwendig sind.

Wenn man vom Grundsatz der Portabilität und des offenen Zugangs europaweit abweichen will, muss man dafür – das gilt auch für mich – Belege dartun, muss man beweisen, dass dies im Interesse von Urheberarbeit notwendig ist. Ich habe den Filmsektor und der Sportsektor dafür erwähnt.

Wir haben Anregungen bekommen, dass wir Plattformen analysieren sollten, um die Frage zu entscheiden, ob man neue Anbieter in unser Regelwerk einbeziehen soll. Auch dies haben wir vor.

Piraterie so gut es geht zu verhindern ist unser Ziel.

Relativ breiten Raum nahm das Thema Panoramafreiheit ein – mir scheint, ein reines Phantom. Deswegen sollten wir auch nicht Phantomdebatten führen. Die Panoramafreiheit einzuschränken, das war keine Idee der Kommission. Das war scheinbar eine missverständliche Idee in einem Fachausschuss des Parlaments, die aber heute von niemandem mehr vertreten wurde.

Deswegen könnten wir auch hier der Öffentlichkeit sagen: Es war ein Missverständnis im Fachausschuss, es war nie der Wille einer Anzahl von Abgeordneten.

Wir wollen die bestehenden Regelungen nicht einschränken. Panoramafreiheit wird auf der Grundlage der nationalen Gesetze auch in Zukunft bewahrt und auf europäischer Ebene nicht beschränkt. Was bleibt, wäre dann ein kluger Marketing-Schachzug von Wikipedia, denen sei es gegönnt. Ab sofort zurück zu den wesentlichen Themen und nicht mehr das Phantom, das meines Erachtens erledigt ist.

  Julia Reda, rapporteur. Madam President, I would like to thank all my colleagues for their contributions to this very vibrant and balanced debate. I would especially like to thank the shadow rapporteurs for their very hard and continuous work over the several months that we have been working on this report. I also greatly appreciate the commitment from the Commission to take the results of the report into account.

Even though it is only an evaluation of the status quo of the Copyright Directive, the public attention to this debate and to the negotiations shows that Europeans are anxiously waiting for an ambitious copyright reform. I am also very glad to hear the Commissioner’s comments that photos are an extension of vision and that freedom of panorama must be preserved.

I think the great public support freedom of panorama. Even though the debate has been blown a bit out of proportion, it does show that we need a new balance in copyright, that we should not hold onto ideas that have already failed the practice test, and that exceptions and limitations are not harmful to authors. They quite often give a necessary breathing space for new creation to take place, and they give aspiring authors the necessary access to culture and education.

Not everybody in the future will be a Victor Hugo, but Victor Hugo – the initiator of the Berne Convention himself – famously said, and I quote, ‘Literature is the secretion of civilisation, poetry of the ideal. That is why literature is one of the wants of societies ... That is why there must be a vast public literary domain. That is why all poets, all philosophers, all thinkers, all the producers of the greatness of the mind must be translated, commented on, published, printed, reprinted, stereotyped, distributed, explained, recited, spread abroad, given to all, given cheaply, given at cost price, given for nothing’.

  Neena Gill (S&D), in writing. The cultural and creative sector accounts for up to 4.5% of the EU GDP and gives work to 8.5 million people, meaning it does not just contribute to cultural development and diversity but is also crucial for the real economy. Yet in many parts of the creative sector, people still do not receive fair pay for their work. Half a million performers across the EU are not fairly rewarded when their performances are exploited via online on-demand services, and many of them are in too weak a position to negotiate better terms. Technology has advanced, but copyright is still stuck in the past. I urge the Commission to ensure that authors and performers enjoy an unwaivable right to remuneration when their products become available on digital platforms, in order to safeguard the important role they play both in terms of culture and education and for the real economy.

Sprawozdanie dotyczące harmonizacji pewnych aspektów praw autorskich jest sprawozdaniem z własnej inicjatywy, nie posiada zatem mocy ustawodawczej, a stanowi pewnego rodzaju inicjatywę, ma na celu zwrócenie uwagi na pewne problemy. W ogólnym wydźwięku dokument sprzyja liberalizacji prawa autorskiego, jednak zgłoszono do niego poprawkę, która zakłada konieczność zgody twórcy lub urzędu na komercyjne wykorzystanie fotografii z obrazami, dziełami sztuki bądź zabytkami. Obecnie takie zdjęcia, bez zgody właściciela i uiszczania jakichkolwiek opłat, mogą być publikowane także w celach zarobkowych (w wydawnictwach książkowych, publikacjach telewizyjnych czy materiałach internetowych).

Jeśli sprawozdanie to byłoby wiążącym aktem prawnym, to wprowadzenie takiej poprawki wymusiłoby wycofanie z rynku istniejących już produktów bądź uzyskanie przez autorów zgody na wykorzystanie „panoramy” w swoich publikacjach, co z pewnością wymagałoby przebrnięcia przez złożone procedury administracyjno-prawne i wiązałoby się z poniesieniem stosownych kosztów. Mam nadzieję, że Parlament Europejski opowie się w dzisiejszym głosowaniu przeciwko ograniczeniu wolności panoramy, gdyż nie istnieją żadne przesłanki wskazujące na to, aby brak harmonizacji przepisów w tym zakresie stanowił jakiekolwiek utrudnienia dla twórców.

Sprawozdanie dotyczące wdrożenia dyrektywy 2001/29/WE Parlamentu Europejskiego i Rady z dnia 22 maja 2001 r. w sprawie harmonizacji niektórych aspektów praw autorskich i pokrewnych w społeczeństwie informacyjnym jest sprawozdaniem z własnej inicjatywy. Tekst nie ma mocy ustawodawczej, daje jednak obraz tego, jakie zmiany w zakresie ochrony praw należy zdaniem Parlamentu Europejskiego wprowadzić w UE. Raport kładzie nacisk na to, by chronione prawem autorskim treści były dostępne ponad granicami. W sprawozdaniu podkreśla się znaczenie licencji terytorialnych, zwłaszcza dla potrzeb finansowania produkcji filmów i utworów audiowizualnych. W sprawozdaniu pojawiła się kontrowersyjna poprawka, która miała ograniczać wolność panoramy, jednak w ostatecznym tekście sprawozdania nie ma żadnego odniesienia do tej kwestii. Po wielomiesięcznych negocjacjach Komisja Prawna zaproponowała wspólny zrównoważony tekst, który z jednej strony broni praw konsumentów do treści nabytych w sposób legalny, a z drugiej daje autorom możliwość ochrony ich praw. Sprawozdanie jest dobrą podstawą dla propozycji Komisji Europejskiej w sprawie reformy prawa autorskiego, które zostaną przedstawione najprawdopodobniej pod koniec tego roku.

  Bogdan Andrzej Zdrojewski (PPE), na piśmie. Zdobycze wolnościowe powinny być szczególnie chronione. Próba wrzucenia do omawianego dziś sprawozdania pani Julii Redy zapisu o ograniczeniu tzw. wolności panoramy jest niestety powtarzającą się praktyką psucia procesu legislacyjnego, ale także opinii samego Parlamentu.

Przypomnę przy tej okazji, iż większość państw wspólnoty europejskiej implementowała dyrektywę InfoSoc wraz z zawartym wyjątkiem „Freedom of panorama”. Polska w art. 33 ustawy o prawie autorskim zawarła wolność rozpowszechniania „utworów wystawionych w publicznych zbiorach”, na ogólnie dostępnych drogach, ulicach, placach etc.

Wiem, że nawet przyjęcie w sprawozdaniu nierozsądnego rozwiązania nie skutkowałoby zmianą prawa, ale niestety podważałoby wiarygodność nas samych i stabilności rozwiązań tworzących podstawowy kanon wolności obywatela. Jak widać apel o sukces zdrowego rozsądku ponownie jest potrzebny.
