  Przewodniczący. – Kolejnym punktem porządku dnia jest debata nad pytaniem wymagającym odpowiedzi ustnej skierowanym do Komisji przez Antonio Tajaniego, Andreasa Schwaba, Evelyne Gebhardt, Ditę Charanzovą i Reinharda Bütikofera w imieniu Grupy Europejskiej Partii Ludowej i Grupy Postępowego Sojuszu Socjalistów i Demokratów w Parlamencie Europejskim w sprawie dalszych kroków dotyczących nowych kierunków działań na rzecz usprawnienia wykonywania wolnych zawodów (O-000080/2015 - 2015/2771(RSP) B8-0569/2015).

  Antonio Tajani, Autore. Signor Presidente, onorevoli colleghi, cara Commissaria, in Europa 4 milioni di liberi professionisti creano 11 milioni di posti di lavoro, con un giro d'affari (interviene il Presidente)

Dicevo che in Europa 4 milioni di liberi professionisti creano 11 milioni di posti di lavoro, con un giro di affari di oltre 500 miliardi di euro. Dobbiamo sostenere questa categoria di lavoratori, bisogna risolvere i problemi che i liberi professionisti incontrano per accedere ai finanziamenti, al credito, eliminando oneri e costi amministrativi inutili. Occorre fare in modo che i liberi professionisti possano usufruire delle stesse opportunità a disposizione delle piccole e medie imprese come, ad esempio, l'accesso ai bandi diretti dell'Unione europea e a quelli indiretti delle regioni. Bisogna anche valutare il ruolo delle casse professionali per garantire finanziamenti agli iscritti.

Un gruppo di alto livello che avevo creato nel mio ruolo di Commissario europeo per l'industria, ha elaborato nel 2014 una serie di raccomandazioni per sostenere lo sviluppo dei liberi professionisti in Europa, non solo attraverso un miglior accesso al credito, ma anche con più formazione, con più informazioni e puntando sull'internazionalizzazione. È arrivato ora il momento di implementare queste raccomandazioni e l'obiettivo dell'interrogazione orale che ho elaborato con colleghi di vari gruppi politici, è proprio quello di chiedere alla nuova Commissione europea in che modo essa intenda dare seguito agli impegni assunti.

Noi ci aspettiamo un impegno forte da parte della Commissaria Bieńkowska. Cara Commissaria, le assicuro che potrà contare sul sostegno di una larga maggioranza di questo Parlamento per proposte legislative, iniziative politiche, programmi e finanziamenti a favore di una categoria fondamentale per la ripresa economica e l'occupazione in Europa, una categoria che ha bisogno di sentire le istituzioni europee vicine. Ecco perché ci aspettiamo da lei una forte iniziativa politica destinata a garantire lo sviluppo delle libere professioni, che hanno bisogno di più libertà e meno democrazia, meno burocrazia, scusate.

  Evelyne Gebhardt, Verfasserin. Herr Präsident, Frau Kommissarin! Die freien Berufe sind äußerst wichtige Berufe und ein Rückgrat für die Gesellschaft der Europäischen Union. Diese Berufe haben auch eine sehr hohe Qualifikation, befinden sich in der Regel in den Bereichen der Gesundheit, der Justiz und anderer wichtiger Sicherheitsfragen. Deswegen ist gerade in diesem Bereich eine hohe Qualifizierung von äußerster Wichtigkeit, und es gilt, dafür zu sorgen, dass auch klare Regeln vorhanden sind, die ihnen auch Sicherheit geben für die Qualität ihrer Berufe. Wie mein Kollege Tajani bin ich damit einverstanden, dass wir keine überbordende Bürokratie brauchen, aber gleichsam brauchen wir die Sicherheit, dass eine hohe Qualität der Dienstleistungen in diesen Bereichen gewährleistet werden kann. Das ist eben genau das, was wir brauchen.

Im Rahmen der Umsetzung der Berufsqualifikationsrichtlinie machen Sie auch gerade einen Evaluationsprozess. Ich weiß, dass in diesen Bereichen zurzeit dieser Prozess sehr genau geprüft und angeschaut wird. Die Frage, die Sie sich stellen und die ich auch gerne von Ihnen beantwortet wissen möchte, ist: Welchen Impetus gibt es in diesem Bereich, was ist von Ihrer Warte aus der Sinn und Zweck dieses Evaluierungsprozesses, und was sind die Konsequenzen, die Sie daraus herausarbeiten möchten? Denn das sind Dinge, die uns sehr beschäftigen.

Wie gesagt, wir wollen dafür sorgen, dass diese Dienstleistungen auf höchstmöglichem Niveau geleistet werden und dass die Verbraucher, die Patienten, viele Menschen, die von diesen Dienstleistungen profitieren, auch sicher sein können, dass auch die entsprechende Qualität gewährleistet ist.

  Elżbieta Bieńkowska, Member of the Commission. Mr President, thank you very much for the opportunity to stress the importance and role of the liberal professions in Europe because, as your question crucially underlines, liberal professions are first and foremost recognised for their entrepreneurial spirit. Lawyers, architects, engineers create their businesses as independent enterprises. They invest in their own assets and professional know—how, they bear the business risks and reach out for economic success. They are, of course, entrepreneurs creating jobs and providing high-quality products and services.

For this very reason, the Commission decided to make a very special commitment to the promotion of liberal professions in its Entrepreneurship 2020 Action Plan. In this context, a working group ‘Bolstering the Business of the Liberal Professions’ was set up to assess their specific needs as entrepreneurs and businesspeople, such as acquiring know—how and skills, access to markets or access to finance. This is almost the same as for the others, but we are very much focusing on those professions.

This autonomous working group submitted a series of recommendations which are included in a report that will be finalised around the end of the year and which is built around five thematic blocks.

The first block is entrepreneurship, education and training, because liberal professionals need to acquire managerial and entrepreneurial skills. I would like in this place to highlight that liberal professionals can already benefit from the exchange programme Erasmus for Young Entrepreneurs.

The second block highlights the importance of facilitating access to finance, and from this perspective it also has to be stressed that they are offered money from programmes like COSME and Horizon 2020, and the use of the advisory services of the Enterprise Europe Network. The third block analyses access to markets. The fourth block invites representatives of the liberal professions to contribute to the reduction of their regulatory burden, which Members mentioned a few times, by identifying bottlenecks and best practices across the EU.

Finally, the working group expressed its wish to strengthen the representation and participation of the liberal professions at European level. Therefore, I decided that the liberal professions will be represented and invited to participate at in the 2015 SME Assembly which will take place in Luxembourg in November this year. This should enable liberal professions to be more directly informed about all the policies put in place.

As far as the regulated professions are concerned, it should be said that the Commission is currently carrying out a transparency and mutual evaluation exercise in each Member State as a follow-up to the Professional Qualifications Directive. This is also, it has to be stressed, an exercise in very good cooperation with national authorities, and has already made it possible to identify more than 5 000 regulated professions in all sectors of activities and in all Member States.

This is particularly helpful since we know that a large majority of the liberal professions are regulated ones. The regulation of professions limits access to professions and may reduce employment opportunities. In this context, I want also to mentioned that the Commission will adopt – it is planning, but will adopt in a month, on 21 October – the Internal Market Strategy, and the key element of the strategy will be to address remaining barriers to services, and to further advance the integration of the single market in services, thus facilitating the economic activities of liberal professions.

I would be very pleased to discuss this further with Members once the Internal Market Strategy is adopted, because it is a very comprehensive document with some new points added by us.

  Andreas Schwab (PPE). Herr Präsident! Liebe Kolleginnen und Kollegen! Frau Kommissarin Bieńkowska! Herzlichen Dank für Ihre Ausführungen darüber, wie sie sich die Rolle der freien Berufe im Rahmen des europäischen Binnenmarktes vorstellen. Der Kollege Tajani hat ja sehr deutlich und klar darauf hingewiesen, welch große Bedeutung wir als EVP-Fraktion den freien Berufen in all ihren Variationen beimessen und deswegen sehe ich es auch mit einer gewissen Sorge, dass in einzelnen Vertragsverletzungsverfahren gegen verschiedene Mitgliedstaaten jetzt bestimmte Regelungen, die verbraucherschutzpolitische Natur besitzen, angegangen werden.

Gleichwohl bin ich aber mit Ihnen einig, dass wir natürlich die Mobilität im europäischen Binnenmarkt erhöhen müssen und insofern durch diese Vertragsverletzungsverfahren auch Klarheit darüber hergestellt wird, ob diese Maßnahmen zulässig sind oder nicht und insofern warte ich mit Interesse die Entscheidung des Europäischen Gerichtshofs in diesen Verfahren ab. Gleichwohl, Frau Kommissarin, ist unser Interesse natürlich vor allem darauf gerichtet, dass die freien Berufe von ihrer Natur her und angesichts ihrer Selbstverwaltung in einem europäischen Binnenmarkt ihre Position behalten können. Und da sind Sie als zuständige Kommissarin für den klassischen Teil des Binnenmarkts – im Unterschied zum digitalen Binnenmarkt – natürlich diejenige Kommissarin, die für die Verteidigung der freien Berufe auch ihr Wort einlegen muss.

Und das gilt umso mehr, weil sie ja auch an verschiedenen Stellen genau die Regeln überprüfen, die diese freien Berufe treffen, und deswegen hoffe ich, dass wir in der Binnenmarkt-Strategie, die sie in wenigen Monaten vorlegen werden, auch zum Thema freie Berufe das eine oder andere Positive lesen werden.

  Nicola Danti, a nome del gruppo S&D. Signor Presidente, onorevoli colleghi, signora Commissario, in un'Unione che deve puntare sempre di più sulla conoscenza quale motore del suo sviluppo, il mondo delle professioni costituisce un importante fattore di crescita, anche se riceve ancora troppa poca attenzione da parte delle istituzioni comunitarie. La necessità di una maggiore integrazione del mondo delle professioni, sulla base di regole chiare e condivise, è confermata anche dai dati del commercio interno di servizi e dalla scarsa mobilità dei professionisti europei.

Lo studio promosso dalla Commissione indica chiaramente molte delle linee direttrici su cui bisogna lavorare. Tra queste, ritengo che sia prioritario scommettere su istruzione e formazione per affrontare e vincere la sfida della competizione internazionale. Sarà importante anche procedere a una riduzione degli oneri normativi nonché aggiornare e completare un quadro giuridico che deve essere efficace e chiaro, al fine di fornire certezze ed opportunità Accogliamo dunque con favore gli impegni assunti questa sera dal Commissario per accompagnare una maggiore integrazione e uno sviluppo regolato di questa importante realtà economica e sociale.

  Dita Charanzová, on behalf of the ALDE Group. Mr President, from doctors to lawyers to architects, liberal professions are a great part of our lives. We need to treat them all with respect, and equally. This is why Article 59 of the revised directive is so important. By the start of next year, Member States will have to justify why some professions have national requirements that any normal person would say are simply not needed or are designed to be discriminatory against those not born or educated in that Member State.

The Commission must be extremely strict when deciding what is an acceptable reason and call out those Member States that are not honouring the spirit and principles of the law. Mr President, as long as Czech engineers or accountants are faced with a bureaucratic wall when they simply want to move to Germany, there is more to be done. Not only are these professionals losing out, so too are all Germans and all EU citizens who have missed a chance for better service and more choice in their daily lives. Over—regulation of these professions is, in essence, denying these workers access to the fundamental freedoms of movement and establishment.

Monsieur le Président, c'est en ma qualité, sous la précédente législature, de rapporteure au nom du groupe PPE sur la révision de la directive relative à la reconnaissance des qualifications professionnelles que j'ai le plaisir de m'adresser à vous ce soir. Au sein de la commission des marchés intérieurs, nous avions beaucoup œuvré pour essayer de rendre plus efficace et plus facilitatrice la directive sur la reconnaissance des qualifications professionnelles. Je m'attacherai donc à un enjeu tout particulièrement important à mes yeux, celui de la mobilité des professionnels à travers l'Union européenne. Nous savons que c'est l'une des clés pour favoriser l'emploi, la croissance et le développement des échanges de manière générale.

L'une des innovations majeures de la directive révisée sur la reconnaissance des qualifications professionnelles, c'était la carte professionnelle européenne, instrument concret et pratique qui devait fluidifier, faciliter et améliorer les procédures de reconnaissance des qualifications professionnelles pour un ensemble de professionnels et pour un certain nombre de professions réglementées.

Où en sommes-nous exactement aujourd'hui, Madame la Commissaire, sur la mise en œuvre de cette carte professionnelle européenne pour un certain nombre de professions qui ont fait connaître leur intérêt? Un certain nombre de professions sont censées avoir fait preuve de leur intérêt et une consultation a été lancée par la Commission européenne pour les professions suivantes: infirmiers, médecins, pharmaciens, physiothérapeutes, ingénieurs, guides de montagne et agents immobiliers. Où en sommes-nous exactement ? Quel est le suivi de ce travail créatif considérable qui avait été accompli sous la précédente législature?

  Othmar Karas (PPE). Herr Präsident, Frau Kommissarin, meine Damen und Herren! Wir haben ja bereits im Jahr 2003 einmal gemeinsam eine Entschließung zu den Wettbewerbsregeln, den Marktregelungen für freie Berufe verabschiedet. Damals auch aus dem einfachen Grund, weil die freien Berufe der Stabilitätsanker unserer Wirtschaft sind. Allerdings wird das Berufsbild vor neuen Herausforderungen stehen, insbesondere in Zeiten der Digitalisierung und der Globalisierung. Aber für uns steht fest: Freie Berufe haben im Regelfall akademische Ausbildung und ein hohes Maß an Qualität an Qualifikation. Sie sind unabhängig, eigenverantwortlich, unbefangen und neutral, und sie sind nicht über einen Leisten zu scheren. Sie sorgen für eine flächendeckende Dienstleistung und sind nicht zu verwechseln mit den gewerblichen Berufen. Sie sorgen für flächendeckende Dienstleistungen für alle Bürger in allen Regionen zu leistungsgerechten Preisen.

Wenn wir daher über Regulierung reden, müssen wir sagen, dass wir vor allem Regeln brauchen, die die Freiheit, die Unabhängigkeit und die Sicherheit garantieren. Freie Berufe brauchen kein Übermaß an Regeln. Sie müssen arbeiten können, unabhängig und frei.

Signor Presidente, onorevoli colleghi, signora Commissaria, il tema sollevato da quest'interrogazione tratta una delle vicende più discusse, se vogliamo, ma meno regolamentate, come molti colleghi hanno detto riguardo alla struttura del nostro sviluppo economico. Il protagonismo delle libere professioni è storicamente ben rappresentato dai pronunciamenti della Commissione e correttamente, come anche l'interrogazione ricorda, sono state segnalate con puntualità le principali esigenze: dal tema della semplificazione, all'internazionalizzazione, all'accesso ai finanziamenti.

È proprio su quest'ultimo punto che mi permetto di segnalare a lei come, a una verifica più attenta di quanto accade all'interno dell'Unione – anche ad esempio nel mio paese – la natura imprenditoriale della forma con cui spesso i liberi professionisti si associano, non è sostanzialmente riconosciuta, lo è formalmente, ma non del tutto sostanzialmente. Infatti, troppo spesso accade che questi gruppi di liberi professionisti abbiano difficoltà serie ad accedere a forme di finanziamento che l'Unione mette a disposizione al fine di generare sviluppo e innovazione. Quindi, le chiedo una particolare attenzione a questo particolare.

  Adam Szejnfeld (PPE). Panie Przewodniczący! Bardzo się cieszę, że podejmujemy dzisiaj ten temat, wolne zawody mają bowiem duże znaczenie nie tylko na rynku pracy, ale także znaczenie społeczne. W mojej ocenie należy w zdecydowany sposób ograniczyć regulacje wielu wolnych zawodów i innych profesji regulowanych, a w większości przypadków nawet zupełnie znieść te regulacje.

Niestety, na ogół silne lobby korporacji w poszczególnych zawodach wywiera ogromny i skuteczny wpływ na polityków w poszczególnych państwach członkowskich, skutkiem czego w Europie niewiele się dzieje w zakresie deregulacji. Ba, obserwuję nawet działania odwrotne. Nadmierne regulacje natomiast wywołują wiele szkodliwych skutków – na przykład ograniczają dostęp do wykonywania zawodów przez nowych adeptów, co ma wpływ na poziom bezrobocia wśród osób posiadających wykształcenie w danym zawodzie. Znacząco podwyższają też koszty zdobycia, a następnie wykonywania danego zawodu. Poza tym wpływają na podwyższenie cen świadczonych usług, bowiem ograniczają konkurencję na rynku danego zawodu.

Dlatego potrzebne są w tym zakresie odpowiednie działania na szczeblu Unii, a następnie również w państwach członkowskich. Mam nadzieję, że w tym właśnie kierunku będą zmierzać działania Komisji Europejskiej.

  Νότης Μαριάς (ECR). Κύριε Πρόεδρε, τα ελεύθερα επαγγέλματα συμβάλλουν καθοριστικά στην οικονομική ανάπτυξη των κρατών μελών της Ένωσης. Όπως ακούσαμε, πάνω από τέσσερα εκατομμύρια ελεύθεροι επαγγελματίες δραστηριοποιούνται στην Ένωση σε σημαντικούς τομείς όπως η υγεία, η δικαιοσύνη και η ασφάλεια. Ο κύκλος εργασιών ξεπερνά τα 500 δισεκατομμύρια ευρώ. Η οικονομική κρίση, όμως, έχει χτυπήσει και τους ελεύθερους επαγγελματίες. Χρειάζονται, λοιπόν, μέτρα κυρίως στον τομέα της ελεύθερης κυκλοφορίας, της αναγνώρισης των επαγγελματικών προσώπων και της πρόσβασης σε πηγές χρηματοδότησης για εκσυγχρονισμό του εξοπλισμού τους. Στην Ελλάδα, χιλιάδες ελεύθεροι επαγγελματίες έχουν χτυπηθεί οικονομικά από το μνημόνιο. «Κτυπιούνται» από τη φορομπηχτική πολιτική της Τρόικας και χιλιάδες από αυτούς είναι πλέον άνεργοι, χωρίς κοινωνική ασφάλιση, αλλά και χωρίς να δικαιούνται καν επίδομα ανεργίας. Πρέπει, λοιπόν, να υπάρξουν κοινωνικά μέτρα στήριξης των ελευθέρων επαγγελματιών, όχι μόνο στην Ελλάδα αλλά και στα υπόλοιπα κράτη μέλη της Ένωσης, καθώς αυτοί έχουν πληγεί ανεπανόρθωτα από την οικονομική κρίση.

  Elżbieta Bieńkowska, Member of the Commission. Mr President, I would like to thank the honourable Members very much for their support and for their sometimes very detailed questions. I would like to add only that the Commission fully recognises the entrepreneurial potential of the liberal professions. In this respect we will continue to pay attention to the liberal professions – as I said before – in the framework of the Entrepreneurship 2020 Action Plan.

The liberal professions will, of course, be included in our internal market strategy, with a very strong focus on modernisation, the law and regulations. We will also try to prioritise infringement cases, as mentioned by Mr Schwab. So the internal market strategy will, and should, include a number of potential actions to address barriers – mentioned by many of you – such as disproportionate professional qualification requirements or the extensive scope of reserved activities for regulated professions.

The next subject is that of mutual evaluation, which, it should be stressed, covers all sectors of activity – not just the regulated professions. The objective of mutual evaluation is to assess restrictions related to qualification requirements and to remove unjustified and disproportionate barriers.

On the recognition of professional qualifications, the Commission is now working very closely with Member States’ representatives to reach an agreement on the proposal for an implementing act introducing the European Professional Card (EPC) – for example, for nurses responsible for general care, pharmacists, physiotherapists and estate agents. The technical infrastructure – which was the subject of the question on EPC – and the other mechanisms in the internal market information system will be completed before January 2016, i.e. in the next few months. This was Ms Le Grip’s question.

The action which will follow the mutual evaluation exercise will be announced as part of the internal market strategy. I do not want to go into detail on it here because I think we will have a lot of opportunities to discuss it at the orientation stage, after the orientation debate in the College and after adoption of the internal market strategy.

I think I have responded briefly to all the questions. To sum up, I would add that there will certainly be a focus on the liberal professions in the internal market strategy. Modernisation, innovation and diminishing the rules and barriers in these sectors are very important for us, and we will be cooperating with you on this.
