  President. – The next item is the report by Mr Balz, on behalf of the Committee on Economic and Monetary Affairs, on stocktaking and challenges of the EU Financial Services Regulation [2015/2016(INI)] (A3-0360/2015).

  Burkhard Balz, Berichterstatter. Frau Präsidentin! Als Berichterstatter freue ich mich, dass Lord Hill heute an unserer Aussprache über die Finanzmarktregulierung teilnimmt.

Unser Ausschuss, der Wirtschafts- und Währungsausschuss, hat sich mit breiter Mehrheit dafür ausgesprochen, dass die Finanzmarktgesetzgebung der vergangenen fünf Jahre umfassend geprüft wird. Das bedeutet keine Deregulierung. Das bedeutet, dass wir erstmals eine Gesamtübersicht über die bestehenden Banken-, Versicherungs-, Fonds- und Marktregulierungen sowie ihre Wechselwirkung erhalten. Das bedeutet auch, dass Schwachstellen aufgedeckt und behoben werden. Es bedeutet ebenfalls, dass die Effekte der Regulierung transparent werden.

Als die Finanzmarkt- und Schuldenkrise in den Jahren 2007/2008 ausbrach, war der Gesetzgeber in nicht gekannter Weise zum Handeln aufgefordert. Wir haben Finanzmarktregulierungen im Krisenmodus betrieben, und wir waren – so finde ich – erfolgreich darin. Kein Stein ist auf dem anderen geblieben. Wir haben das ganze Gebäude schnell umgebaut, schnell neu gebaut, mit neuen Aufsichtsbehörden, mit für alle verbindlichen EU-weiten Standards und mit einer weitreichenden Bankenunion. Doch während wir weiter bauen, sollten wir uns anschauen, wo Lücken sind, wo schief, wo ungenau und wo zu schnell gebaut wurde.

Deshalb fordere ich als Berichterstatter, dass die Kommission bis Ende dieses Jahres eine umfassende Auswirkungsstudie über alle Finanzmarktsektoren hinweg erstellt. Dabei zählen wir für die Prüfung vor allen Dingen folgende Punkte auf. Erstens: Die Konsistenz und die Passgenauigkeit der bestehenden Gesetze, denn die Regeln sollen sich nicht widersprechen oder gegenseitig in Frage stellen. Sie müssen für den Anwender verständlich und auch praktikabel sein.

Zweitens: Die Verhältnismäßigkeit der Gesetzgebung, denn wir wollen für die Verbraucher die Marktvielfalt erhalten und wir wollen die kleinen und mittelständischen Unternehmen nicht überfordern.

Drittens: Die Komplexität und Vielschichtigkeit der europäischen und internationalen Anforderungen, denn wir wollen international mit unseren europäischen Finanzdienstleistern auch weiterhin wettbewerbsfähig sein. Wir wollen eine starke Stimme haben, wenn beim Banken- oder Versicherungsausschuss in Basel oder bei IOSCO in Madrid entschieden wird.

Viertens: Der Zugewinn am Nutzen für die Verbraucher und Investoren, denn wir wollen, dass die Gesetzgebung nicht nur Informationsmaterial produziert, sondern gezielt den Bedürfnissen der Verbraucher und Investoren gerecht wird. Wir wollen auch, dass Hürden für den Produktzugang verringert werden und der Binnenmarkt für die Finanzdienstleistungen wirklich gelebt wird.

Fünftens: Die wirtschaftlichen Effekte, denn wir fordern, dass die Finanzwirtschaft wieder dort am stärksten wird, wo sie positiv wirken kann, nämlich indem sie der Realwirtschaft dient. Dafür muss der Gesetzgeber die Möglichkeiten schaffen.

Dies sind für mich als Berichterstatter und für die EVP-Fraktion insgesamt essenzielle Punkte, die wir verbessern möchten. Hier fordern wir eine quantitative und eine qualitative Analyse, und zwar von der Kommission selbst in Kooperation mit den europäischen Aufsichtsbehörden.

Finanzmarktregulierung muss das Ziel der Finanzmarktstabilität und des Verbraucherschutzes erfüllen, das bleibt erste Priorität. Doch sind der Erfolg und die Ausgestaltung der Finanzmarktregulierung auch ein Standortausweis für die europäische Finanzwirtschaft.

Wenn Sie, Herr Kommissar, über die Kapitalmarktunion die Investitionsstärke der europäischen Wirtschaft beleben wollen, dann müssen Sie alle Finanzmarktbereiche – auch die Banken und die Versicherungen – mit einbeziehen, und deswegen, Herr Kommissar Hill, zählen wir darauf, dass wir in einem Jahr zu genau diesem Thema uns hier wiedersehen, und zwar anlässlich der Präsentation der dann fälligen Auswirkungsstudien.

  Jonathan Hill, Member of the Commission. Madam President, thank you for giving me the chance to come along this evening. I want to congratulate Mr Balz for this excellent report and for setting out the issues at stake so clearly. I share 100% his goal of creating an effective legislative framework for financial services. For that to happen, people need to know that it will be implemented. But they also need to know that it will be proportionate and that it can respond to changing circumstances, and that is the logic that sits behind the call for evidence that forms part of the Capital Markets Union (CMU) action plan. I therefore see this report and the call for evidence as being consistent, the one with the other.

I would like briefly to focus on two issues raised by the report: the need for a regulatory framework that supports growth, and the need to make sure that smaller businesses have access to finance. It is clear that the major reforms we have introduced in recent years have made the financial system stronger, and now it is time to check whether, looked at in the round, those 40 separate pieces of legislation that we passed have had any unintended consequences. As Mr Balz said, it is part of good law making to check that our rules are doing what they set out to do. The call for evidence will close at the end of this month. I hope it will give us a better understanding of the impact of our legislation. It will help determine our approach to over 100 reviews of existing legislation planned over the next five years. It will inform how we monitor the effectiveness of legislation in the future, and I know that your report makes a number of interesting recommendations in this area. We need legislation that is proportionate if we are going to create an environment that supports investment. If legislation can be streamlined, if it can be simplified and yet achieve the same prudential objective, let us be ready to change it. I am looking forward to reporting back to you when we have been through the ‘call for evidence’ responses and completed our analysis.

Improving access to finance for smaller companies is also one of the priorities in the report that I strongly support. If we need companies, if we want companies to start up and grow and create jobs here in Europe, we have to improve the funding conveyor belt. That is what lies behind the work to build a Capital Markets Union. I am grateful for the support that you have given it in this report. As you know, we have made a quick start. Among the initiatives relevant to the report, we have proposed to overhaul the Prospectus Directive. We are looking forward to working with you on our proposal to relaunch simple, transparent and standardised securitisation, and that is to free up lending capacity in the banking sector and increased lending to the wider economy. The Council reached an agreement on that in record time. I hope we can keep up the same kind of pace.

Those were just two of the main areas in your report, but there is a wealth of recommendations in there. It has strengthened my belief that, by continuing to work closely together, we have a real opportunity to refine our legislation, to make sure it strikes the right balance between maintaining financial stability, giving consumers confidence, and supporting investment and growth across Europe.

Naturalną konsekwencją głębokiego kryzysu finansowego, który zaczął się od rynków finansowych, jest kompleksowa regulacja usług finansowych, której priorytetem musi być bezpieczeństwo produktów, oczywiście również bezpieczeństwo systemu bankowego i stabilność makroekonomiczna, a to oznacza koszty i na ogół zwiększoną złożoność regulacyjną. Dlatego przyszedł czas na udrożnienie i dywersyfikację pozabankowych kanałów finansowania gospodarki realnej – bez iluzji, że osiągniemy proporcje właściwe po drugiej stronie Atlantyku. Przyjmujemy z zadowoleniem zieloną księgę Komisji Europejskiej nt. unii rynków kapitałowych. Sugerujemy jednak, aby bardzo poważnie brać pod uwagę przy dalszych opracowaniach kontekst globalny, konkurencyjność w przekroju międzynarodowym, dostęp małych i średnich firm do finansowania, a nade wszystko wsłuchanie się w głos rynku, bo czasami usuwanie barier jest ważniejsze niż nowe regulacje.

  Theodor Dumitru Stolojan, în numele grupului PPE. Doamnă președintă, felicitări domnului Balz și tuturor colegilor care au lucrat la acest raport foarte bun.

Într-adevăr, în ultimii 7 ani, am adoptat o multitudine de reglementări europene cu privire la serviciile financiare, ca urmare a crizei. Ce am urmărit: să restabilim și să păstrăm stabilitatea financiară, să întărim protecția consumatorilor și să evităm, în viitor, ca excesele de pe piețele financiare să fie acoperite din banii contribuabililor europeni. Acum este momentul să vedem cum sunt implementate aceste reglementări, care este impactul, care sunt rezultatele, să vedem unde sunt necesare corecții la această legislație europeană.

Apreciez în mod deosebit propunerile din raport cu privire la evaluarea accesului întreprinderilor mici și mijlocii la finanțare, precum și la obstacolele care încă există în ceea ce privește finanțarea pe termen lung a proiectelor.

  Paul Tang, namens de S&D-Fractie. Er zit zand in de raderen van de Europese economie. Investeringen blijven achter en de groei is daardoor kwetsbaar. Banken en met name mkb-bedrijven kunnen elkaar moeilijk vinden. Kapitaalmarkten zijn onderontwikkeld. De kapitaalmarktunie kan dan ook een kans zijn om financiële innovatie te stimuleren, om barrières tussen lidstaten te slechten en om kapitaal efficiënt in te zetten. De Commissie heeft daarbij goed naar de Verenigde Staten gekeken. Het is al vaak gezegd dat kapitaalmarkten daar 80 procent van de kredieten verstrekken en hier slechts 20 procent. Maar om met David Bowie te spreken: "This is not America". Uit de 80/20 verhouding is de conclusie te trekken dat kapitaalmarkten beter ontwikkeld moeten worden, maar ook dat bancaire financiering beter tot stand moet komen. Het is belangrijk om banken te repareren. Het is daarbij goed om wederom naar de Verenigde Staten te kijken. Daar is een scheiding tussen spaargeld en zakenbankieren tot stand gekomen. Daar is volgens OESO-onderzoek de categorisatie van banken beter geregeld.

Het verslag van Burkhard Balz - mijn complimenten voor de rapporteur - heeft als uitgangspunt dat de financiële sector de reële economie moet dienen. Regulering is daarbij een middel. Het is niet een doel op zichzelf, het is niet een kwaal op zichzelf, het is een middel. Het is door die evenwichtige benadering dat de S&D-Fractie dit verslag kan onderschrijven. Het doel van de regulering moet steeds zijn dat de financiële sector dienend is. Dan is het ook goed om periodiek de dienstbaarheid van de financiële sector te toetsen. De kapitaalmarktunie kan uiteindelijk alleen werken als de Europese context erkend wordt. Dat betekent innovatie stimuleren én banken repareren. Zo halen we het zand uit de machine en kunnen we op weg naar nieuwe groei en banen.

  Kay Swinburne, on behalf of the ECR Group. Madam President, firstly I would like to thank Mr Balz for all his hard work on this file and the Commissioner for extending the deadline for his consultation. As others have stated, over the past five years the EU has put in place an unprecedented amount of financial services legislation. Therefore it is right that we take a step back and look at the overlaps and crossovers at this time.

Mr Balz’s report clearly emphasises that this review needs to go beyond value judgements and qualitative statements and stresses that any meaningful review should have a strongly quantitative aspect to it. For me the key areas of this report refer to the overlaps between files, particularly the crossover between MiFID and CRD IV, where we have brought new firms into markets legislation without adequately tailoring the capital standards to suit these new types of firms as yet. A similar issue of scope is seen with the clearing obligation in EMIR: the arrangements for non-financial firms that were intended to prevent financial firms from misusing a justified exemption have led to huge amounts of red tape for businesses that were never meant to be included.

I hope to work with the Commission on solutions via the formal consultation and review, where possible by issuing level two standards to solve these issues and give practical weight to better regulation.

  Petr Ježek, on behalf of the ALDE Group. Madam President, I am pleased with the outcome of this report. It comes at a key moment where we move from a regulation designed primarily to repair the legislative holes which were so evident in the crisis, towards the Capital Markets Union, which aims to encourage more investment and growth in Europe. The key aspect of the stocktaking report is the call for the Commission to undertake cumulative impact assessments and, at regular intervals, of all of the new legislation enacted in the aftermath of the crisis. I fully support this call.

In my view it is imperative that the impact assessment looks at how different pieces of European legislation in the area of financial services interact with each other. Are there any gaps or loopholes? Are there any unintended consequences? How has Europe’s competitiveness been affected globally? We must gain a full understanding of the new legislation, at which point we can focus on building a robust and competitive Capital Markets Union.

There are a number of points which I have pushed during the negotiation. Firstly, in order to ensure Europe’s competitiveness on a global level, we must have a coherent framework in place with regard to dealing with third countries, for example in UCITs. Secondly, access to finance for SMEs is key in order to bring Europe back to sustained growth. We must ensure that the regulation in place does not hinder this process, and must reduce as much as possible any barriers for SMEs’ financing which are due to excessive regulation.

  Fabio De Masi, im Namen der GUE/NGL-Fraktion. Frau Präsidentin, Herr Kommissar Hill, Kollege Balz! Die Zeichen in der EU stehen wieder auf Deregulierung der Finanzmärkte. Die Finanzlobbyisten in Brüssel haben daher den Schampus wegen better regulation kalt gestellt, um unliebsame Regulierung zu beseitigen. Dabei muss eine kluge Regulierung der Finanzmärkte nicht komplex sein. Der „US Glass Steagall Act“ zur Trennung der Investmentbanken und der Kreditbanken umfasste 37 Seiten, die weit schwächere EU-Bankenregulierung umfasst 1000 Seiten.

In der EU ist das Problem der Banken, die zu groß, zu vernetzt und, ja, auch zu mächtig zum Scheitern sind und somit auf Kosten der Steuerzahler leben, überhaupt nicht gelöst. Der demokratische US-Präsidentschaftsbewerber und alte Knochen Bernie Sanders hat dazu das Richtige gesagt: split them up!

Burkhard Balz hat seriös gearbeitet und auch einige unserer Bedenken aufgegriffen. Dafür gilt ihm mein Dank. Die EU-Kommission will jedoch auf die Investitionsschwäche und Kreditklemme mit der Kapitalmarktunion und der synthetischen Verbriefung der Verpackung von Schrottkrediten antworten. Dabei hängt die Investitionsschwäche mit der Kürzungspolitik und der unzureichenden Ausmistung von Bankbilanzen zusammen.

Herr Hill hat letztens in einer Rede in den USA festgestellt, dass das Märchen, dass gerade die mittelständischen Unternehmen von der Kapitalmarktunion profitieren würden, vor allem ein PR-Gag ist. Europa bräuchte ein echtes öffentliches Investitionsprogramm, ein dezentrales Bankensystem unter öffentlicher Kontrolle und eine strikte Regulierung der Finanzmärkte mit einem Finanz-TÜV. Der ehemalige Präsident der US-Notenbank, Paul Volcker, hat leider Recht: Die einzige sinnvolle Finanzinnovation der letzten Jahre war der Geldautomat.

  Sven Giegold, im Namen der Verts/ALE-Fraktion. Herr Präsident, Herr Kommissar, Burkhard Balz, liebe Kolleginnen und Kollegen! Zunächst einmal: Aus meiner Sicht setzt dieser Bericht die richtigen Schwerpunkte. Er ist – anders als es zum Beispiel von der Kollegin Swinburne gesagt wurde – keine Aufforderung zur einseitigen Deregulierung. Er zielt sowohl auf Doppelregulierung als auch auf Lücken, er zielt auf die Verminderung von unnötiger Komplexität, aber nicht auf einseitige Deregulierung und sollte so auch nicht missverstanden werden. Der Bericht betont zu Recht, dass wir in einigen Bereichen nicht genug getan haben, während wir in anderen nicht proportional vorgegangen sind. Das muss bei der Überarbeitung eine Rolle spielen.

Richtig ist auch, dass dieses Finanzsystem vom Nutzer her gedacht werden muss. Daher die Frage: Sind Finanzprodukte nicht viel zu teuer im Vergleich zu dem, was an Erträgen erwirtschaftet wird? Geht nicht zu viel in die Taschen der Intermediäre und zu wenig in die Taschen der Sparer? Diese Fragen sind sehr berechtigt und gehören in ein Review.

Ich will aber auch, um Missverständnisse zu vermeiden, sagen, dass in dem Bericht aus meiner Sicht zwei Lücken existieren. Zum Einen: Die Finanzkrise ist nicht vorbei, sondern sie ist lediglich verschüttet. Wenn Sie die Zinssätze am langen Ende betrachten, sehen Sie, dass wir zu viel Kapital im Markt haben, das nicht weiß, wohin es soll. Ich stimme Fabio De Masi zu: Dies kann man nicht dadurch lösen, dass man am Finanzsektor einige Schräubchen dreht, sondern wir brauchen eine Politik, die dieses überschüssige Kapital in nachhaltige Investitionen lenkt. Deshalb bitte ich Sie auch, und der Bericht fordert Sie auch dazu auf, die makroprudenzielle Seite des Finanzsystems in den Blick zu nehmen und insbesondere auch darauf zu achten, dass sich nicht dadurch neue Risiken auftun, dass nicht nachhaltige Investitionen in den Banken- und Versicherungsbilanzen neue zukünftige Risiken aufwerfen. Die Klimakonferenz sollte auch in der DG FISMA, auch bei Ihnen, Lord Hill, angekommen sein. Wir sind gespannt auf Ihre Vorschläge und Maßnahmen.

  Steven Woolfe, on behalf of the EFDD Group. Madam President, John Maynard Keynes stated that if you owe a bank 100 pounds you have a problem, but if you owe the bank a million, they do. In the EU financial regulation crisis the banks were owed billions, but it was the taxpayers and citizens of Europe who had the problem. This report states that EU Financial Services regulations will prevent that happening again, but it also stresses the need to reduce the burden of financial regulation, because it recognises it increases costs and makes EU financial services businesses uncompetitive. But the idea that the EU will reduce regulation is as fanciful as the idea that Britain needs to be a member of the EU to trade with it, or indeed that Lord Hill will support a vote for Brexit.

It is inherent in the EU’s DNA to create more regulation – more Europe – and more costs. That is why, increasingly, so many more UK and US financial services companies understand that, in order to be really free from the shackles of EU regulation, the UK needs to vote to leave the EU.

  Bernard Monot, au nom du groupe ENF. Madame la Présidente, Monsieur le Commissaire, chers collègues, je regrette que ce rapport sur les enjeux de la régulation financière fasse l'impasse sur plusieurs sujets majeurs.

Premier sujet majeur, la séparation bancaire. Je veux parler de la vraie séparation bancaire, projet toujours au point mort depuis la crise de 2008. En effet, toutes les réglementations sur la régulation sont vaines si l'on ne sépare pas hermétiquement les activités à risque des activités de dépôt bancaire. En d'autres termes, il s'agirait de mettre fin au schéma de banque universelle qui prend en otage les déposants et les épargnants pour jouer à la roulette des marchés spéculatifs avec l'argent d'autrui. C'est ça, l'ultralibéralisme que les patriotes dénoncent: faire des profits avec une prise de risque sur le dos des autres. Et là, le PPE et les socialistes sont favorables au statu quo dans les banques privées. Pire, comme l'Union européenne est en état d'urgence financier, non seulement elle ne protège pas les citoyens, mais, depuis le 1er janvier 2016, elle fait même l'inverse, avec la funeste union bancaire, qui légalise la spoliation de l'épargne, puis des dépôts. Dernier exemple en décembre: le scandale bancaire en Italie. C'est le devoir des dirigeants politiques responsables de protéger l'épargne des ménages et la trésorerie des entreprises dans les banques et les compagnies d'assurance-vie.

Deuxième sujet majeur: la relance de la titrisation. Vous devriez vous inquiéter des risques d'un mécanisme qui a fait des dégâts sociaux et des pertes financières lors de la crise des subprimes de 2008. Attention à la boîte de Pandore. L'objectif visé est de prêter à l'économie productive et non de favoriser encore l'affairisme des banques.

Enfin, sur l'union des marchés de capitaux, oui au mode de financement d'économies hors intermédiation bancaire, mais les chances de succès sont infimes, en l'absence de demande intérieure en Europe et de débouchés économiques réels dans les entreprises, entreprises européennes sous-financées, qui souffrent trop de la concurrence déloyale mondiale, des charges et des impôts pour se risquer à investir.

Au-delà de ce constat, Lord Hill, je crains fort que votre Commission européenne n'ouvre en grand le marché juteux de la dette essentiellement aux banques américaines basées à la City de Londres. Nous serons donc très attentifs sur les enjeux de ces dossiers.

  Krisztina Morvai (NI). Az itt jelen lévő európai uniós biztos úrnak szeretnék a témával kapcsolatban kérdést feltenni. Ez a bizonyos új szabályzat a fogyasztók szempontjából három lényeges dolgot követel meg. Az egyik a nagyon alapos tájékoztatása a fogyasztóknak, a másik a banki vezetőknek, a bankároknak a felelőssége, illetőleg a bankfelügyeletnek a kellő erőssége és határozottsága. Azt kérdezem Öntől, biztos úr, tisztában van-e azzal, hogy az én hazámban, Magyarországon, a legsúlyosabb társadalmi probléma, de nem csak Magyarországon, számos más európai uniós tagállamban is, a devizahitelesek tragédiája. Az hogy nagy tömegekben helyeztek ki csaló jellegű, úgynevezett devizahiteleket. Kérdezem, hogy akkor hol voltak ezek az elvárások? Miért olyan új elvárások ezek, hogy megfelelően tájékoztatni kell a hitelfelvevőt, hogy a bankárnak felelőssége van, hogy bankfelügyeletre van szükség? Mi az Ön álláspontja erről, és mit gondol, az Európai Unió mit tehetne a tragikus helyzetbe jutott több százezer devizahiteles család érdekében?

  Jonás Fernández (S&D). Señora Presidenta, en primer lugar me gustaría felicitar al señor Balz por el trabajo que ha realizado para que podamos tener este documento que debatimos hoy aquí, y desearía agradecer asimismo la presencia de Jonathan Hill en este debate que, de alguna manera, debería ayudarnos a orientar las políticas financieras de la Comisión Europea y el trabajo de este Parlamento para los próximos meses.

Creo que en la agenda tenemos dos grandes proyectos muy importantes: la unión bancaria, que tenemos que terminar y que tenemos que cerrar con ese seguro de depósitos; y la unión de capitales, que de alguna manera debería ayudar a mejorar ese mercado europeo de capitales de la zona del euro, pero también de los países que están fuera de la zona del euro, y ayudar a movilizar el ahorro y a movilizar el capital en nuevos proyectos de inversión.

Y yo creo que hay dos grandes ideas que están sobre la mesa, dos propuestas que están en algunos debates y que a mí me incomodan en demasía. La primera de ellas es la idea de que es necesario revisar que la deuda pública sea un activo libre de riesgos. Yo creo que esta iniciativa, en ausencia de un auténtico activo libre de riesgo de la zona del euro, podría suponer la fragmentación de la zona del euro y dar pasos atrás en lo que hemos conseguido con la unión bancaria y en lo que queremos hacer con la unión de capitales. Y la segunda cuestión que está de alguna manera en la atmósfera es que nos hemos pasado en la regulación del sector financiero. Yo creo que esto no es cierto. Lo que tenemos que hacer es regular mejor, ver dónde hay duplicidades, ver cómo podemos rerregular el mercado financiero, pero estamos muy lejos de una supuesta excesiva regulación.

  Sander Loones (ECR). Ik wil focussen op een thema dat de komende maanden steeds belangrijker zal worden, namelijk onze spaarcenten, ons spaargeld. Wanneer een bank nu in de problemen komt, dan is ons spaargeld beschermd tot 100 000 euro. De overheid staat daar vandaag voor in. In de toekomst is het echter de bedoeling dat de banken die verantwoordelijkheid op zich zullen nemen, dat zij voor die bescherming zullen opdraaien. De vraag is dan ook: zullen die banken ook verstandiger met ons spaargeld omspringen? Vooral ook omdat we weten wat de plannen van Europa zijn.

De plannen van Europa zijn dat alle banken in de Europese Unie dit voortaan samen gaan doen. Laten we ook duidelijk zeggen wat dat dan precies betekent: dat banken in het noorden van Europa garant zullen staan voor banken in het zuiden, banken van Vlaanderen voor banken in Griekenland, banken die mogelijk wel eens over de kop zouden kunnen gaan.

Dat is dus de vraag: hoe kunnen we vermijden dat dit gebeurt? Ik ben dan ook zeer blij dat ik als schaduwrapporteur voor mijn fractie daarop zal kunnen toezien.

  Miguel Viegas (GUE/NGL). Senhora Presidente, ao imputarmos a crise de 2007 a uma suposta falta de regulação, estamos a errar no diagnóstico. Estamos, ao mesmo tempo, a criar uma ilusão, dando a entender que o sistema financeiro pode ser disciplinado. Estamos a criar a ilusão de que é possível alinhar os interesses da banca e dos fundos de investimento com os interesses das populações e dos trabalhadores.

O mecanismo de supervisão único, assim como o mecanismo de resolução único, não funcionam e não resolvem os problemas do sistema financeiro, tal como pudemos observar recentemente em Portugal, onde a informação foi sistematicamente ocultada e manipulada com o consentimento dos agentes supervisores.

O problema das grandes instituições financeiras, ditas demasiadamente grandes para falir, não se resolve com meros paliativos, que apenas se destinam a procurar dar a ideia de que alguma coisa está a ser feita, ficando tudo na mesma. O problema resolve-se com a separação bancária e com o controlo público do sistema financeiro, como o tempo depressa se encarregará de nos dar razão.

  Neena Gill (S&D). Mr President, firstly, I would like to offer my congratulations to the rapporteur on this report. I believe it strikes the right balance between improving channels of funding to the real economy and at the same time undertaking a comprehensive assessment of the cumulative impact of the EU Financial Services Regulation – identifying shortcomings and loopholes, but not deregulating.

The ongoing crisis in China demonstrates the importance for us not to forget the lessons that we learned from the financial crisis and the need for a robust financial regulatory framework. It is important to keep this perspective. Also this initiative, the Capital Markets Union, is not going to be a panacea. It is not a miracle solution that will solve the level of growth. However, it can deliver alternative sources of finance to companies in the whole of the EU, and not just to the ones in the handful of Member States where we have developed capital markets.

The challenge in front of you, Commissioner, is this: can we really speak about a financial services union, a place where capital can circulate freely, unhindered by extra layers of national legislation? Not really. It is critical that you address this, otherwise the EU investment funds will remain a drop in the ocean compared with the American ones. The Commission must tackle national fragmentation urgently. Alongside action on this, it is important that mid-caps are able to maximise their potential. Therefore, the prospectus proposal has to be a real gateway to the capital markets for this group. It has to be short, effective and affordable and, at the same time, an instrument that truly informs investors about securities.

  Ivana Maletić (PPE). Gospodine predsjedniče, pozdravljam povjerenika i čestitam izvjestitelju na izvrsnom izvještaju. Pozdravljam napore uložene u definiranje mjera za uspostavu unije tržišta kapitala. Očekujem da će te mjere, a posebno razvoj sekuritizacijskog tržišta i revizija Direktive o prospektu ispuniti cilj lakšeg pristupa malim i srednjim poduzećima kapitalu na tržištu.

Važno je da naši napori u razvoju financijskih tržišta na europskoj razini pridonesu daljnjoj konvergenciji na način da države i njihovi poduzetnici koji imaju slabo razvijena tržišta kapitala mogu iskoristiti sve prednosti unaprijeđenih europskih financijskih tržišta. Naravno, pri tom ne smijemo zaboraviti da istovremeno države članice moraju odraditi svoj posao, a to je provesti strukturne reforme usmjerene na poboljšanje poduzetničke klime, a bankovni sustav mora dati jaču podršku malim i srednjim poduzetnicima kroz prošireni izbor modela financiranja.

Pane předsedající, já bych chtěl velmi podpořit tuto zprávu, která nám byla předložena, protože po zevrubném prostudování mám za to, že skutečně odráží reálnou situaci, ve které se evropské finanční služby nacházejí. Myslím, že se v tom odráží i jak moc se liší situace v Evropské unii a v USA. My skutečně potřebujeme zajistit přístup k financím, k investicím, zajistit inovace pro náš průmysl, pro naše služby, pro náš finanční sektor. Samozřejmě je nezbytné, aby tato politika, kterou chceme realizovat, nebyla pouze jenom nástrojem, ale aby obsahovala i cílové efekty, to znamená, kam skutečně dojít v deregulaci trhů. Já docela rozporuji myšlenku, kterou zde řekl jeden z mých kolegů z levé strany spektra, který nepodporuje deregulaci trhů a zároveň si stýská nad tím, že není dosaženo decentralizovaného bankovního systému. Já si myslím, že to jde ruku v ruce.

Κύριε Πρόεδρε, το ζήτημα των χρεώσεων των διατραπεζικών και άλλων συναλλαγών έχουν κομβικό ρόλο για τους καταναλωτές και ιδίως στην Ελλάδα όπου οι τράπεζες έχουν ανακεφαλαιοποιηθεί πολλάκις με τον ιδρώτα του ελληνικού λαού και όπου τα capital controls είναι ακόμη σε ισχύ. Οι αυξημένες χρεώσεις που επιβάλλουν οι τράπεζες στις διατραπεζικές συναλλαγές επιβαρύνουν υπέρμετρα τους Έλληνες.

Επιβάλλονται χρεώσεις από 2 έως και πάνω από 10 ευρώ για απλή ηλεκτρονική μεταφορά χρημάτων για ποσά μέχρι 1000 ευρώ, προμήθειες από 1 έως 1,25 ευρώ για πιστωτικές κάρτες, προμήθεια στην τράπεζα της τάξης του 2 με 2,5% για μικρά και μεσαία εμπορικά καταστήματα, ενώ αντίθετα για τα πολύ μεγάλα καταστήματα η προμήθεια είναι χαμηλότερη του 1%, μολονότι o κανονισμός (ΕΕ) 2015/751 προβλέπει μεταξύ άλλων μέγιστες χρεώσεις για πιστωτικές και χρεωστικές κάρτες 0,30 και 0,20 ευρώ αντίστοιχα. Ταυτόχρονα, οι τράπεζες καθυστερούν υπερβολικά την έκδοση των απαραίτητων βεβαιώσεων και εγγράφων τα οποία είχαν και έχουν ακόμη ανάγκη οι δανειολήπτες με κόκκινα δάνεια για να ενταχθούν στις ρυθμίσεις του νόμου Κατσέλη και για να γλιτώσουν τα σπίτια τους από τα κοράκια. Αυτές οι πρακτικές των τραπεζών πρέπει να σταματήσουν και εσείς, κύριε Επίτροπε, οφείλετε να λάβετε άμεσα μέτρα.

  Ivan Jakovčić (ALDE). Gospodine predsjedniče, cilj je dobro postavljen. Želimo uniju tržišta kapitala.Pa i podciljevi su dobro postavljeni. Želimo dobar pristup potrošača kreditima, želimo više ulaganja, želimo olakšati pristup srednjim i malim poduzećima financijskim uslugama svih financijskih institucija u Europskoj uniji. Dakle, ciljevi i mnogi drugi podciljevi, ne samo ovi koje sam naveo, su dobro postavljeni.

Ali, mi moramo učiti na našim greškama, moramo učiti na onome što je izazvala financijska kriza i pogotovo moramo učiti na onome što su banke činile građanima u smislu klasičnih financijskih prevara. Čitajte: ono što su banke učinile građanima koji su uzimali kredite u švicarskim francima svojedobno u mnogim zemljama Europske unije. To je klasična prevara, molim da to uzmete u obzir i da brinete o tome u budućnosti.

  Igor Šoltes (Verts/ALE). Torej finančna kriza seveda ni še v celoti odpravljena in tudi negativni učinki te krize še niso odpravljeni.

Morda so kazalci o okrevanju nekje spodbudni, nekje bolj, nekje manj, vendar slišimo, da se ti kazalci neposredno ne odražajo, tako ne v koristih državljanov, potrošnikov kot tudi ne investitorjev, tudi malih in srednjih podjetij.

Mislim da, seveda pri temu, kar sledi, se pravi tudi v finančnih oziroma v spremembah urejanja finančnih trgov in v novih zakonodajnih okvirih seveda moramo biti ustrezno previdni, moramo upoštevati nauke, ki smo jih znali v zadnji krizi, ker sicer ne bomo naredili koraka naprej.

Predvsem pa je ključno vprašanje seveda, kdo komu sledi in komu bodo namenjeni ti ukrepi.

Mislim, da seveda ko govorimo o kapitalu, ko govorimo o trgih, ne smemo pozabiti na človeka, na potrošnika, ker konec koncev smo tukaj predvsem zaradi njih, in zato mislim, da moramo odgovoriti, komu bodo namenjene te politike, ali bankam ali potrošnikom ali realnemu sektorju.

  Jonathan Hill, Member of the Commission. Mr President, I would like to thank the Members very much for that wide range of interventions. If we concentrate on the report, I think a lot of the comments point to the unique position that the financial sector holds in Europe’s economy. As was said, it is a means to an end, and we should think of it as that and not an end in itself. We need a strong financial sector at the heart of Europe’s recovery – and indeed of our wider society – providing funding for businesses to grow and create jobs and to give citizens the certainty that they need to plan ahead to prepare for their old age and to protect against ill health.

It is for that reason that, after introducing the range of legislation in response to the financial crisis, it is so important – as Mr Balz’s report makes clear – that we should check that it is working as intended. It is not to question the fundamental architecture of the reforms that we put in place, but it is to ask whether, in maintaining financial stability, we do not stand in the way of the investment Europe needs to remain competitive and to create jobs. In other words, as so often in financial regulation, it is a question of balance. As was said, we need to think about our competitiveness at a global level and, of course, how we can build consumer confidence in markets.

The first stage of our call for evidence, which I think has been inspired by the thinking behind this report, ends in a fortnight. We are not approaching it with preconceptions but in the hope that it will give us detailed information – as many colleagues have said – to understand exactly how the legislation is working, what the connections are between it, whether there are overlaps or, indeed, whether there are any gaps that need to be addressed. I hope it will give us that detailed information on which we can build our analysis and recommendations.

When we have got those, I look forward to discussing them with you and to continue working closely with Parliament to overcome these national barriers and obstacles that were raised here again tonight and to build a genuine single market for capital in Europe.

  Burkhard Balz, Berichterstatter. Herr Präsident! Ich möchte allen Kollegen für die Beiträge, die sie heute Abend hier geleistet haben, danken. Sie waren sehr hilfreich und haben auch nochmal im Einzelnen gezeigt, was jedem von uns wichtig ist.

Nach fünf Jahren intensiver Gesetzgebungsarbeit, nach dem Umbau der Finanzaufsicht und mit der Kapitalmarktunion in Aussicht ist es jetzt an der Zeit, sich die bisherigen Auswirkungen anzuschauen und eben mögliche Verbesserungen zu prüfen. Ich begrüße deswegen, dass die Kommission bereits erste Schritte in die richtige Richtung unternommen hat, und ich sehe auch die laufende Konsultation der Finanzmarktteilnehmer positiv. Es sollte doch klargestellt sein, dass bei der Konsultation die Punkte des Parlamentsberichts vollständig berücksichtigt werden. Ich sehe auch, dass die Revision der Eigenkapitalrichtlinie CRD IV ein großes Potenzial für Vereinfachungen und mehr Verhältnismäßigkeit bietet, insbesondere für die kleineren und die mittelgroßen Kreditinstitute. Ein Voranschreiten ist hier ebenfalls sicherlich zu begrüßen. Als ECON fordern wir ja nun zu Recht, dass es regelmäßige, mindestens jährliche Proportionalitätsüberprüfungen gibt.

Gleichzeitig möchte ich aber auch betonen, Herr Kommissar, dass es bei uns und bei der Auswirkungsstudie nicht um ein einzelnes Stückwerk geht, sondern am Ende um ein Gesamtbild. Das Puzzle an bisheriger Gesetzgebung muss endlich zusammengeführt werden, sodass die Wechselwirkungen klarer und die Anforderungen weniger komplex sind und die Ziele besser erreicht werden können. Dazu benötigen wir auch eine bessere Rechtsetzung in der Finanzmarktregulierung. Hier nehmen wir insbesondere die EU-Kommission als Initiativgesetzgeber in die Pflicht, hier nehmen wir auch die europäischen Aufsichtsbehörden und die EZB-Bankenaufsicht in die Pflicht: Die Koordinierung, die Transparenz und die Zusammenarbeit in der Gesetzgebung müssen besser werden.

Die technischen Anforderungen müssen verhältnismäßig und auch praktikabel bleiben. Die Qualität und die Einhaltung des gesetzgeberischen Willens müssen wieder Vorrang haben. Hierzu zähle ich insbesondere auf Sie, Herr Kommissar Hill!

  Romana Tomc (PPE), pisno. Regulacija finančnega sektorja in unija kapitalskih trgov je ena izmed prioritet po finančni in dolžniški krizi. Čestitala bi kolegu Balzu, ki je pripravil odlično poročilo, ki vključuje vse pomembne točke, o katerih moramo še razpravljati.

Uspešna unija kapitalskih trgov, ki ne sme omejevati posameznikov in podjetij, bi morala biti prioriteta. Prav tako mora biti vsem omogočen dostop do kapitalskih trgov EU na prijazen, učinkovit in stroškovno dostopen način. Zakonodaja na področju finančnih storitev mora postati manj zapletena, poleg tega pa moramo zagotoviti, da bodo države članice zakonodajo v celoti in tudi strogo izvrševale.

Ne smemo si več privoščiti raznih spodrsljajev, ki na dolgi rok najbolj obremenijo mala podjetja in potrošnike. Hkrati bi rada pozvala tudi države članice, ki so ključne za uspešnost modelov, o katerih se pogovarjamo. One so tiste, ki bi morale poskrbeti, da so direktive prenesene v določenih časovnih rokih. Še bolj pa je pomembno, da države članice direktive dosledno uporabljajo.

  Pablo Zalba Bidegain (PPE), por escrito.Desde que comenzó la crisis hemos emprendido numerosas iniciativas en el ámbito de los servicios financieros de la Unión Europea con el objetivo de restablecer la estabilidad financiera, reforzar la protección del consumidor y aplicar las lecciones aprendidas durante la crisis. Este informe es un primer paso en la evaluación de nuestra labor legislativa, con el fin de evaluar el trabajo hecho hasta el momento, pero también se presentan los retos a los que nos enfrentamos esta legislatura. Es el momento de mirar hacia adelante y una de nuestras prioridades debe ser la Unión de los Mercados de Capitales, la cual debe basarse en una legislación adecuada y eficaz que armonice los mercados de capital. La UMC no debe basarse en una mayor carga legislativa, sino en la armonización de la legislación vigente. Gracias a la UMC avanzaremos en una mayor integración, además de agrupar y simplificar varias iniciativas en curso; con ello lograremos una mayor coherencia en la legislación de servicios financieros.

Gli antichi latini dicevano che errare è umano, ma perseverare (nell'errore) è diabolico: basterebbe questa citazione per riassumere quello che è la Capital Markets Union, un pericoloso proseguimento e peggioramento delle caratteristiche e degli ideali perversi che ci hanno portato nella crisi in cui siamo ancora bloccati da molti anni. Consegnare le chiavi dell'economia alle mani della finanza è quanto di più sbagliato si possa immaginare, ed è purtroppo proprio quello che l'Unione europea vuole fare attraverso questo progetto (di unione dei mercati dei capitali): a questo punto bisogna ammettere che ci sia una responsabilità precisa in tutto questo da parte dell'Unione, ed è una responsabilità dolosa, perché fatta con la consapevolezza di voler distruggere ulteriormente il già martoriato tessuto economico europeo. Le nostre imprese non hanno bisogno di strumenti finanziari sofisticati o rischiosi, ma di un sistema di credito sicuro, stabile ed efficace, come è stato dal dopoguerra fino allo scoppio della bolla finanziaria. La CMU interessa solo a chi vuole speculare, a quanto pare con il sostegno e il supporto dell'Unione europea.
