  Preşedintele. – Următorul punct de pe ordinea de zi este dezbaterea privind raportul lui Marietje Schaake, în numele Comisiei pentru comerț internațional referitor la propunerea de regulament al Parlamentului European și al Consiliului de modificare a Regulamentului (CE) nr 1236/2005 al Consiliului privind comerțul cu anumite bunuri susceptibile de a fi utilizate pentru a impune pedeapsa capitală, tortura și alte pedepse și tratamente cu cruzime, inumane sau degradante (COM(2014)0001 – C7–0014/2014 – 2014/0005(COD)) (A7–0267/2015).

  Marietje Schaake, rapporteur. – Mr President, the cross-party collaboration and the successful outcome of the negotiations with the Commission and Council sent three strong messages today: Europe delivers, and it is stepping up its efforts to curb the trade and promotion of torture and death-penalty goods; trade policy helps strengthen human rights; and the European Parliament played a decisive role in achieving this important upgrade and update of the legislation. So I would like to thank very much the shadow rapporteurs, as well as everyone in this House, for working towards the biggest majority we have seen on a trade-related issue in the current parliamentary term. This strong EU position and EP position allowed us to improve key points, despite initial reluctance in Council.

I am glad that advertising online for banned goods, and also trade fairs, will be illegal. This extends the ban on services facilitating this dreadful market of torture and death-penalty goods and services. I am glad we included the ban on transit via the EU for prohibited goods and that, in addition, knowledge-based transit bans will be in place for multipurpose goods. We also added the urgency procedure, which allows for rapid bans or controls on new products, and, to make the rules future-proof, we expanded the reach of the urgency procedure to cover all annexes to the legislation, thus enabling the Commission swiftly to add new items to annexed lists of banned or controlled items if this is necessary.

We will add law-enforcement standards, so that, when the competent authorities are looking at the supply of technical systems related to Annex 3 goods, they must see that there is a provision promoting law-enforcement standards that respect human rights and contribute to the prevention of torture. Another key element is the inclusion of several steps for better sharing of information. The updated agreement covers the possibility of the competent authorities sharing information with the national preventive mechanisms established under the optional protocol to the UN Convention against Torture.

An Anti-Torture Coordination Group will monitor the application of the rules, with Parliament’s experts attending meetings on the preparation of delegated acts and the updating of annexes.

We have made this EU regulation a baseline, and there is room for national measures. Member States are permitted to adopt or maintain additional national measures that restrict certain ancillary services, such as transportation, financial services, insurance, advertising or promotion in relation to Annex 2 goods. And, in order to keep the door open for possible further strengthening, we have asked that the Commission, when reviewing the rules at the end of July 2020, should assess whether they should also include activities of EU nationals abroad. This is something that we in Parliament requested, and I hope it can be included in the review.

This whole update would not have been possible without the active involvement of civil society and of a number of people in the EU who care deeply about upgrading and updating our human rights record, and I would like explicitly to thank them as well. I would emphasise that we want to make sure we practise what we preach in Europe, and that we have to make sure that all foreign policy instruments, including for trade, help to address the world’s most pressing human rights issues.

  Cecilia Malmström, Member of the Commission. – Mr President, it was actually on Human Rights Day, on 10 December 2015, that we had the first trilogue on this issue of how to reform the so-called Anti-torture Regulation. Thanks to very good cooperation between the Commission and the Parliament and, of course, the Council, we managed to get something I think we can all be very proud of. I welcome this agreement. It is ground—breaking. I would like to thank the rapporteur, Marietje Schaake, and the shadow rapporteurs and, of course, the rapporteur for the Committee on Foreign Affairs, Mrs Barbara Lochbihler.

Many countries have, like the EU, abolished the death penalty for all crimes, but we know that the death penalty still exists, and the abolition of the death penalty worldwide remains one of the flagship objectives of our human rights policies. Today we show how we can concretely deliver trade’s contribution to this. We are leading the way. It is a ground-breaking revised version of the regulation designed to stop the trade in equipment used for the torture or execution of people.

The new reforms of the regulation from 2005 is now a robust export—controlled regime designed to prevent EU involvement in trading goods that are intended to be used for capital punishment or torture in third countries. As the rapporteur said, there are some very important new elements in this regulation. It covers such activities as brokering services, concerning goods located outside the EU, for which an authorisation will now be required, technical assistance, which will also require an authorisation, and also advertising. For the first time, we are introducing a ban on the display of goods in trade fairs in the EU. For those products made in third countries and exported in transit through the EU, we are making it more expensive and more difficult by introducing a ban. We simply cannot tolerate that these torture and execution products are circulated through our ports or through our territory.

We know that technology evolves and new products for torture may reach the market. That is why it is imperative that the list of products under export control can be updated quickly. The Commission will now have the possibility to use a fast—track – or urgency – procedure to amend the list of goods to which the regulation applies on the lists or the list of countries benefiting from the general export authorisation. Let me stress that, if this procedure is applied, it does not in any way deprive Parliament and the Council of their right to scrutiny of the delegated acts.

This regulation sets a high EU trade standard, which takes into account the need to respect human rights. It is an excellent example of the new value—based trade that is so essential for our trade policy. We have shown leadership when it comes to human rights. It is not only an empty statement, but this is a concrete way to contribute to it. With concrete action, through concrete measures, we show that we are taking the death penalty and torture seriously. We want to make it difficult and to remind countries, such as Saudi Arabia, Iran, China and also the US, that we do not tolerate, and we condemn, these practices. It is a message of support to all those people suffering torture and inhumane treatment in prisons and police stations that we care about them and we are listening to them.

The original regulation already made the point that restrictions on trade are instrumental in promoting respect for human rights and human life and thus it serves the purpose of protecting public morals in compliance with the WTO rules in this respect. In our contacts with third countries, be it with members of parliaments or governments, we should promote our values and explain that these restrictions are justified and proportionate. We should of course continue our fight against abolishing capital punishment for all crimes, and invite countries to apply similar end-use control to their exports. We should also explain that these trade restrictions are not intended to deprive third countries of listed medicinal products, but have to prevent such products from being used for the death penalty. We know that in the past that has actually worked. So authorisations can be granted for exports of medicinal products if it is shown that they are being used for the treatment of patients – i.e. the purpose for which they were originally developed.

So I hope that Parliament with the vote today will confirm the agreement that we reached last May. It is indeed a very important decision. A strong vote in this plenary will, of course, send a very powerful signal, showing that trade policy is not only about economies, jobs and investment, but is also a way to promote our values. I want again to reiterate my deepest thanks for the contribution and for the good collaboration we have had with this Parliament.

  Barbara Lochbihler, Verfasserin der Stellungnahme des mitberatenden Ausschusses für auswärtige Angelegenheiten. – Herr Präsident, sehr geehrte Frau Kommissarin Malmström! Ja, es gibt immer noch Unternehmen in der EU, die sogenannte Sicherheitsgüter vermarkten und exportieren, die aber eigentlich für Folter oder für die Umsetzung der Todesstrafe verwendet werden oder verwendet werden können. Dem wollen wir heute ein Ende setzen. Die Anti-Folter-Verordnung der EU etabliert ein Ausfuhrkontrollsystem für Güter und Aktivitäten, die für die Todesstrafe, Folter oder andere grausame, unmenschliche und erniedrigende Behandlung genutzt werden oder genutzt werden können.

Allerdings war bisher die Liste der Schlupflöcher, die wir bei unserer bisherigen Verordnung hatten, sehr groß. Ich freue mich deshalb sehr, dass wir viele dieser Schlupflöcher schließen konnten und dass wir einen guten überarbeiteten Text haben, in dem wir vieles verbessern konnten. Lassen Sie mich am Anfang eben auch als AFET—Berichterstatterin sagen, was Sie, Frau Malmström, ausgeführt haben. Ich denke, in unseren auswärtigen Beziehungen sollten wir alles daransetzen, dass auch andere Regionen solche Ausfuhrregulierungen machen, auch in den Beziehungen mit unseren Drittstaaten.

  Santiago Fisas Ayxelà, en nombre del Grupo PPE. – Señor Presidente, señora Comisaria, me gustaría antes que nada felicitar a la ponente Schaake por el gran trabajo realizado en este dosier de gran complejidad técnica y enorme trascendencia política.

La abolición de la pena de muerte y de los tratos inhumanos y degradantes se inscribe entre las grandes prioridades de la política de derechos humanos de la Unión. La Unión Europea, a través de este Reglamento, reafirma su política tendente a la eliminación de la pena de muerte en el mundo. Es un instrumento único, que permite asegurar el respeto de los derechos humanos consagrados tanto en la Carta de los Derechos Fundamentales de la Unión como en el Convenio Europeo de Derechos Humanos, en particular el respeto y la protección de la dignidad humana, el derecho a la vida y la prohibición de la tortura y los tratos o penas inhumanos o degradantes. Este acuerdo es un paso muy importante en la lucha contra la tortura y sentará un precedente que, espero, sirva de ejemplo a otras partes del mundo.

Como muy bien ha explicado la ponente, en mayo de este año alcanzamos un acuerdo con el Consejo sobre un texto de compromiso que incluye una gran parte de las recomendaciones del Parlamento. Me congratulo por ello. Se han prohibido una serie de productos destinados a infligir tortura o pena de muerte, así como su publicidad, promoción o tránsito por el territorio de la Unión. Para otro tipo de productos se han introducido una serie de controles para garantizar que su uso sea el correcto y no sirvan para fines de tortura o para imponer la pena capital.

No debemos olvidar que ciertos instrumentos o medicinas sirven para garantizar nuestra seguridad o curar nuestra salud, por lo que hay que buscar un equilibrio, definir de forma clara sus usos legítimos. Aquí está toda la dificultad: un mismo producto, bien empleado, puede salvar vidas y, mal empleado, utilizarse para ejecutar a una persona.

Desde el Parlamento Europeo también hemos conseguido que se cree un grupo de coordinación antitortura y que se adopten unas directrices sobre buenas prácticas en la verificación del uso final de estos instrumentos.

En conclusión, el texto resultante del trílogo nos parece apropiado y contribuye a la protección de los derechos humanos, y hace de la Unión Europea una pionera en la reglamentación del comercio de estos productos. Espero que podamos aprobarlo por una gran mayoría.

  Inmaculada Rodríguez-Piñero Fernández, en nombre del Grupo S&D. – Señor Presidente, en primer lugar, quiero felicitar a la ponente por su excelente trabajo, por su sensibilidad e incorporación de las enmiendas que he presentado y por el buen resultado obtenido en la negociación, fruto también del excelente trabajo de la Comisaria Malmström y de su equipo, a quienes también felicito.

Y mi especial reconocimiento a Amnistía Internacional y a la Fundación Omega por su encomiable trabajo y por su implicación. Más de 1 600 personas fueron ejecutadas en 2015, mientras más de 20 000 esperaban en corredores de la muerte.

La Unión Europea es líder mundial en la defensa contra la tortura y la pena de muerte, pero de nada sirve si no viene reforzada por acciones firmes y vinculantes como la que ahora debatimos.

Hoy damos un gran paso adelante con la aprobación de este nuevo Reglamento en defensa de los derechos humanos, actuando contra la tortura y la pena de muerte. Con importantes avances para que ningún nacional ni empresa europea pueda lucrarse con este comercio en el seno de la Unión Europea. Extendiendo la prohibición y control a todas las actividades necesarias para su uso, como los servicios de intermediación, de asistencia técnica, de transporte, de publicidad o de exhibición en las ferias comerciales. Exigiendo un mayor deber de control y de información a los Estados miembros, y también la aplicación de sanciones. Y defendiendo las prerrogativas del Parlamento Europeo, incorporando a nuestros funcionarios expertos en el Grupo de coordinación, gracias al empuje del presidente de nuestra Comisión, el señor Lange.

Con este nuevo Reglamento, la Unión Europea —ya lo han dicho quienes me han precedido en la palabra— eleva los estándares para erradicar la tortura y la pena de muerte. Y por ello mi Grupo está satisfecho con el acuerdo; ojalá consigamos que se sumen el resto de países para que podamos acabar con las peores prácticas contra los derechos humanos.

Pero queda camino por recorrer. Lamento que no se haya incorporado la cláusula catch—all, aunque el procedimiento de emergencia, es verdad, es un avance para impedir el nuevo comercio de instrumentos que puedan ser considerados de riesgo. Y, desde luego, también nos hubiera gustado que se incorporase la extraterritorialidad, aunque confío en que el acuerdo de la Comisión de proceder a su evaluación en julio de 2020 tenga un final feliz.

Sigamos trabajando. Sigamos trabajando para conseguir una mayor vinculación del comercio como un instrumento fundamental en defensa de los derechos humanos. Hoy hay motivos para el optimismo.

  Mark Demesmaeker, namens de ECR-Fractie. – Ik spreek in naam van onze schaduwrapporteur Sander Loones. Evenredigheid, helderheid en flexibiliteit zijn de elementen van de herziening van deze verordening uit 2005 die onze fractie het meest waardeert. We juichen toe dat er evenredige controles worden ingesteld zonder dat die overbodige lasten creëren, lasten die de handel in goederen voor legaal eindgebruik zouden beperken. We staan ook achter de techniek van specifieke beknopte goederenlijsten die uit- en invoerders helderheid bieden en die snel kunnen worden aangepast aan veranderende technologieën en veranderende ontwikkelingen in de wereld. Door die combinatie van goederenlijsten en spoedprocedure wordt de geoorloofde toegang tot geneesmiddelen en farmaceutische producten niet in het gedrang gebracht. Ook andere aanpassingen van de verordening kunnen op onze goedkeuring rekenen, zoals de vereiste van een voorafgaande vergunning voor tussenhandeldiensten en technische bijstand voor goederen die vallen onder bijlagen III en III bis en het verbod daarvan voor goederen van bijlage II; het verbod van de doorvoer van goederen die vallen onder bijlage II en - als de transporteur weet dat de goederen voor foltering of doodstraf kunnen worden gebruikt - ook voor goederen van bijlage III en II bis, en ten slotte het verbod op reclame en het tentoonstellen en voor verkoop aanbieden op handelsbeurzen van bepaalde goederen.

We hopen samen met u op een kamerbrede goedkeuring. Onze felicitaties aan rapporteur Schaake en ook aan commissaris Malmström.

  Eleonora Forenza, a nome del gruppo GUE/NGL. – Signor Presidente, onorevoli colleghi, noi oggi qui approviamo un aggiornamento del regolamento sulla commercializzazione di beni che possono essere usati per pena di morte o tortura, dopo un trilogo impegnativo con il Consiglio e la Commissione.

Vorrei quindi, prima di tutto, ringraziare la relatrice on. Schaake per il lavoro egregio che ha svolto insieme al suo ufficio, al lavoro della segreteria della commissione INTA e del Servizio giuridico del Parlamento. Un lavoro che ci ha permesso di arrivare a un risultato che valutiamo positivamente e che contribuisce a migliorare un regolamento, quello del 2005, che ha presentato nella sua applicazione concreta alcune scappatoie che ne avevano impedito una piena implementazione.

Noi crediamo giusto e importante che l'Unione si impegni affinché non vengano commercializzati strumenti che possono essere usati per trattamenti disumani e degradanti, trattamenti lesivi della dignità umana. Proprio per questa ragione, proprio perché ritengo un segno di civiltà bandire pena di morte e tortura, colgo l'occasione per ricordare come episodi gravissimi di tortura e di violazione dei diritti umani accaddero quindici anni fa nel mio paese, in occasione delle manifestazioni contro il G8 a Genova. Lo ricordo anche perché ero presente in quei giorni, in quelli che Amnesty International ha descritto come la più grande sospensione dei diritti democratici in un paese occidentale dopo la Seconda guerra mondiale.

Ebbene, quindici anni dopo quegli atti gravissimi, dopo la sentenza della Corte europea dei diritti umani di Strasburgo, che nel 2015 ha condannato l'Italia per la condotta tenuta dalle forze dell'ordine durante l'irruzione alla scuola Diaz al G8 di Genova, dove appunto ci fu una vera e propria rappresaglia per provare l'umiliazione e la sofferenza fisica e morale delle vittime, l'Italia non si è ancora dotata di un provvedimento che riconosca il reato di tortura. Credo che il fatto che accada questo in questa Unione europea sia assolutamente grave.

  Barbara Lochbihler, im Namen der Verts/ALE-Fraktion. – Herr Präsident! Ja, wir haben es geschafft, viele der Schlupflöcher zu schließen, die die bisherige Anti-Folter-Verordnung noch gehabt hat, und das ist sehr positiv. Nun soll beispielsweise auch der Transit von Gütern durch die EU verboten werden, wenn Grund zu der Annahme besteht, dass die Ware im Zielland zur Folter oder zur Anwendung der Todesstrafe genutzt wird. Da es aber auch auf diesem furchtbaren Markt immer Weiterentwicklung an Technologie für potenzielle Folterwerkzeuge gibt, wird nun auch dieses neue Eilverfahren eingeführt. Damit wird die Kommission in die Lage versetzt, ohne viel Aufwand neue Produkte auf die Liste verbotener oder genehmigungspflichtiger Güter zu setzen, und wird so hoffentlich auch schnell auf diese Entwicklungen reagieren können.

Endlich konnten wir uns auch darauf einigen, die Werbung für Folterwerkzeuge auf europäischen Handelsmessen zu verbieten. Zukünftig wird es also nicht mehr möglich sein, Folterinstrumente in einem EU-Mitgliedstaat auf Messen auszustellen. Diese Messen ziehen ja auch immer viele Interessenten aus nichteuropäischen Ländern an.

Besonders zu begrüßen ist schließlich auch, dass nationale Behörden nun Informationen über bestimmte Handelsgeschäfte an die nationalen Stellen zur Verhütung von Folter weitergeben müssen, die die Unterzeichnerstaaten des Übereinkommens gegen Folter einrichten müssen. Diese Forderung war uns gerade aus menschenrechtlicher Sicht besonders wichtig, und es war eine Kernforderung bei uns im Menschenrechtsausschuss, dass wir das in die Verordnung hineinbekommen.

Alle diese Änderungen waren längst überfällig. Es ist aber jetzt auch absolut notwendig, dass die Mitgliedstaaten die neuen Bestimmungen zügig und konsequent umsetzen, und wir sollten uns auf allen Ebenen dafür starkmachen, dass auch andere Länder im Kampf gegen Folter und Todesstrafe voranschreiten. Dieses Ausfuhrkontrollsystem, das die EU geschaffen hat, ist das einzige seiner Art weltweit und eines der wenigen Beispiele dafür, dass Handelspolitik durchaus mit Menschenrechten nicht nur in Einklang zu bringen ist, sondern ihrer Durchsetzung und ihrem Schutz dienen kann.

Leider ist die Lage in anderen Regionen und Ländern eine ganz andere. Der Handel mit Sicherheitsgütern wird sehr viel weniger stringent geregelt als beispielsweise der Handel mit konventionellen Militär- oder Rüstungsgütern, und das obwohl sich die Technologie für diese Dual-use-Güter laut Amnesty International in den letzten Jahren maßgeblich weiterentwickelt hat. Auch mussten wir einen Anstieg in der Anzahl der Firmen, die solche Güter herstellen und vertreiben, sowie auch deren geografische Ausbreitung vornehmlich in Ländern mit wenig bis gar keinen Herstellungs- und Handelskontrollen verzeichnen. Wenn wir aber eine Welt ohne Todesstrafe und ohne Folter wollen, dann muss es ähnliche Ausfuhrkontrollsysteme auch in anderen Ländern und Regionen geben. Und wir sollten vielleicht auch beginnen, an einem internationalen Abkommen zu diesem Bereich zu arbeiten.

  Tiziana Beghin, a nome del gruppo EFDD. – Signor Presidente, onorevoli colleghi, contrariamente a quanto si crede, noi europei non abbiamo abolito la pena di morte, l'abbiamo solo delocalizzata. In Europa, infatti, non si uccide più, ma prodotti e medicinali fatti in Europa sono usati per infliggere torture o addirittura la pena di morte in paesi senza scrupoli.

Dal 2005 esiste un regolamento che cerca di mettere un freno a questo traffico, ma aveva bisogno di essere aggiornato e, insieme ai colleghi e guidati dalla relatrice Schaake, che ringrazio, è proprio quello che abbiamo fatto. Abbiamo aggiornato la definizione di tortura, rafforzato i controlli, creato un sistema di scambio d'informazioni e di aggiornamento rapido e addirittura vietato il transito sul nostro territorio di molti di questi strumenti. Il risultato finale non racchiude il 100 % delle nostre richieste, ma è senz'altro un passo avanti.

Per fermare la pena di morte e la tortura il Movimento 5 Stelle vota sì. Mi chiedo però che cosa farà il Partito democratico, che predica bene qui al Parlamento europeo ma dall'Italia continua ad esportare armi e strumenti di tortura verso le dittature.

  Λάμπρος Φουντούλης (NI). – Κύριε Πρόεδρε, έχουμε εδώ άλλη μία έκθεση για τη δημιουργία εντυπώσεων και τίποτα παραπάνω. Δεν πρόκειται τα βασανιστήρια και οι εκτελέσεις να αποτραπούν με την απαγόρευση εμπορίας των αντικειμένων που χρησιμοποιούνται σήμερα διότι είναι πολύ εύκολο να χρησιμοποιηθούν άλλα, απλά, καθημερινά και εύκολα προσβάσιμα αντικείμενα προς τον σκοπόν αυτόν. Τους εικονικούς πνιγμούς στο Γκουαντάναμο, με μια πετσέτα κι ένα μπουκάλι νερό, πώς θα τους απαγορεύσετε; Στο καλύτερο σενάριο, θα καταφέρουμε απλά να κάνουμε τις εκτελέσεις ακόμη πιο οδυνηρές. Ήδη συζητούν στις ΗΠΑ το ενδεχόμενο να αντικαταστήσουν τη δύσκολα ανευρέσιμη και ίσως προσεχώς απαγορευμένη θανατηφόρο ένεση με την αγχόνη ή με το εκτελεστικό απόσπασμα.

Όλοι οι πολιτισμένοι άνθρωποι καταδικάζουμε τα βασανιστήρια. Άποψή μου πάντως είναι ότι πρέπει να ξανανοίξει η συζήτηση πάνω στη θανατική ποινή. Είμαστε σίγουροι ότι θέλουμε να στέλνουμε πίσω στην κοινωνία δράστες ιδιαιτέρως ειδεχθών εγκλημάτων; Ορισμένες χώρες της Ένωσης έχουν ελαστικές ποινές και διαφυλάσσουν υπερβολικά τα δικαιώματα του δράστη, αδιαφορώντας όμως για τα δικαιώματα του θύματος. Εμείς αρκούμαστε σε ενός λεπτού σιγή για τα θύματα. Έχει αποδειχθεί ότι κατά συρροή δολοφόνοι, τρομοκράτες, μεγαλέμποροι ναρκωτικών συνεχίζουν τη δράση τους και μέσα από τη φυλακή. Γιατί να έχουν αυτοί περισσότερα δικαιώματα από τα εκατοντάδες θύματά τους;

  Daniel Caspary (PPE). – Herr Präsident, geschätzte Kolleginnen und Kollegen! Wir sollten alles dafür tun, dass Folterwerkzeuge wie elektrische Stühle, Daumenschrauben, Streckbänke und anderes weltweit nicht eingesetzt werden, dass sie nach Europa nicht eingeführt werden können, dass sie aus Europa nicht ausgeführt werden können und dass wir alle Produkte, die irgendwie durch Europa durchgeführt werden, stoppen und aus dem Markt und aus der Lieferkette entfernen.

Deswegen unterstützt unsere Fraktion diese Gesetzgebung und die Änderung. Wir sind für ein Transitverbot. Alle Produkte, die unter diese Regelung fallen, müssen wirksam von unseren Behörden entfernt werden. Wir sind für das Verbot von Werbung und bei Messen. Wir sind dagegen, dass für solche Produkte in irgendeinem Medium Werbung gemacht werden darf. Wir unterstützen es, dass die Mitgliedstaaten zusätzliche Maßnahmen ergreifen können. Wenn ein Mitgliedstaat merkt, dass etwas schiefgeht, wenn ein Mitgliedstaat merkt, dass eine Lücke da ist, dann muss es schnell möglich sein, entsprechend zu verschärfen.

Wir sind für ein Verbot der Vermittlungstätigkeiten und für technische Hilfe. Es ist doch geradezu pervers, wenn immer noch Bürger aus der Europäischen Union in anderen Ländern Diktatoren, Despoten oder andere Organisationen dabei beraten, wie man Menschen am besten foltern kann oder welche Instrumente dafür einzusetzen sind.

Wir unterstützen die Überprüfungsklausel, die vorgesehen ist. Wir müssen sicher sein, dass nach einigen Jahren auch überprüft wird, inwieweit unsere Regulierung greift. Wir sind für die Einführung des Dringlichkeitsverfahrens. Wir müssen sicherstellen, dass wenn neue perverse und perfide Methoden erfunden werden, diese schnell in die entsprechenden Anhänge aufgenommen werden. Wir wünschen uns, dass die Europäische Kommission und die Mitgliedstaaten bei all ihren Gesprächen mit Drittstaaten auf dieser Welt sicherstellen, dass alle Dinge, die irgendwie dazu beitragen, Foltermethoden und anderes zu verhindern, eingesetzt werden.

Wir sind für eine Stärkung des Informationsaustauschs. Wir müssen die Behörden in unseren Mitgliedstaaten besser motivieren, ja geradezu dazu zwingen, dass sie Informationen austauschen, um wirklich grenzüberschreitenden Handel mit solchen Produkten zu stoppen. Und wir unterstützen die neue Koordinierungsgruppe Verhütung von Folter, denn wir wollen gemeinsam unsere Gesetzgebung weiterentwickeln und sicherstellen, dass die Europäische Union weiterhin beispielgebend dafür sein kann, wie man Folter und andere menschenverachtende Methoden verhindert.

In diesem Sinne unterstützt unsere Fraktion grundsätzlich freie Handelsbeziehungen. Aber wir setzen uns gerade deshalb dafür ein, dass dort, wo freier Handel missbraucht wird, wir diesen auch unterbinden. In diesem Sinne freue ich mich, dass wir in diesem Haus mit breiter Zustimmung diese Gesetzgebung vorantragen.

  David Martin (S&D). – Madam President, I would like to thank the rapporteur and the Commission for the excellent work they have done on this report. The anti-torture regulation is an excellent example of the value-based trade on which trade policy should be focused. It demonstrates that values can have, in the right circumstances, priority over business and over profits, and therefore it is to be warmly welcomed.

This is also a great success for Parliament, as most of our recommendations have been taken on board. Measures agreed which have already been mentioned include the EU transit ban for torture and capital-punishment goods, which will make sure that, in the future, the EU in no way contributes to the trade in these goods thus inadvertently participating in violations of human rights and international law.

We now have a system in place which should guarantee that there are no loopholes in this law but, as Daniel Caspary has rightly said, what is now important is the full commitment of all the Member States to continued monitoring of the situation. And, while I welcome the regulation, it is worth pausing in a debate like this to remind ourselves that, incredibly in the modern world, torture is actually still on the increase and the use of the death penalty went up in the last three years for which have statistics. So this is a good step in the right direction, a good victory for Parliament and a good decision by the European Union to strengthen the 2005 regulation, but let us not be complacent about the situation we face in the current world.

  Helmut Scholz (GUE/NGL). – Frau Präsidentin, Frau Kommissarin! Ich möchte auch im Namen meiner Fraktion der Berichterstatterin Anerkennung für den Verhandlungserfolg aussprechen, auch den Schattenberichterstattern.

Mit der neuen Verordnung schaffen wir sicherlich Folter nicht ab. Laut Amnesty International haftet die Schande der Anwendung von Folter an 82 % der Staaten dieser Erde. Für Folterinstrumente wurde bislang sogar auf Messen geworben, unter anderem auf der skandalösen Messe „Enforce Tac“ in Nürnberg in Deutschland. Zumindest damit soll mit dieser Verordnung Schluss sein.

Doch Folterknechte sind erfinderisch. Für Waterboarding benötigen die Täter keine EU-Technologie. Deshalb meine ich: Wir müssen Organisationen und Institute auch finanziell erheblich stärker fördern, die mit ihrem mutigen Einsatz Fälle von Folter oder Fälle von Handel mit Folterinstrumenten aufdecken. Staaten, in denen immer wieder gefoltert wird, sollten jegliche Handelspräferenzen seitens der EU verlieren.

VN Sonderberichterstatter De Schutter hat zu Recht Durchsetzungsmechanismen für Menschenrechte auch in internationalen Abkommen verlangt. Entsprechende Regelungen sind deshalb in die Nachhaltigkeitskapitel von EU-Handelsverträgen verbindlich aufzunehmen.

Und nicht zuletzt noch ein Blick nach Ungarn: Wir müssen geflüchtete Opfer von Folter aufnehmen und schützen. Wir müssen ihnen bei der Bewältigung ihrer Traumatisierung auch alle medizinische Hilfe ermöglichen.

Chciałbym zwrócić uwagę, że Amerykanie, również w Polsce, stosowali jako torturę duszenie wodą, i zakaz eksportu wody powinien być również wprowadzony. W krajach sowieckich stosowano wbijanie zapałek i wykałaczek pod paznokcie. Zapałek już nie ma, ale zakaz eksportu wykałaczek powinien być koniecznie wprowadzony. A teraz mówiąc poważnie: takiej ilości głupoty to jeszcze w tym parlamencie nie widziałem. Rozumiem, że ludzie, którzy to zrobili, to ludzie zacni, ale proporcja głupoty do zacności nie może przekraczać pewnych granic. Gdyby ktokolwiek czytał rezolucję Parlamentu Europejskiego, to byśmy byli przedmiotem żartów satyryków na całym świecie. Na szczęście nikt tego nie czyta, a poza tym sądzę, że Unia Europejska musi być zniszczona.

  Seán Kelly (PPE). – Madam President, this is a very important topic and I think it highlights again the amount of good work that the European Union endeavours to do and its efforts to achieve a good standard of human rights across the globe, especially in areas with which we have dealings in relation to trade. I would like to compliment the rapporteur, Marietje Schaake, for her good work: as always, it has been comprehensive and dedicated.

This is really about closing the loopholes, and that is what has been achieved to a large degree. You will never, of course, close loopholes one hundred percent, and it has been pointed out that some goods traded could be used both to save and to kill people. Be that as it may, movements such as abolishing the death penalty are something that we are very strong on, and this is something we have to work towards continually.

So this is a positive action by the European Union to help promote human rights across the globe and that is to be commended.

  Bernd Lange (S&D). – Frau Präsidentin, Frau Kommissarin! In der Tat: Fußfesseln mit Stromstößen bei Folter oder Daumenschrauben auf einer Messe in Europa oder Medikamente zum Vollzug der Todesstrafe – alles das made in Europe! Nein, das darf nicht Wirklichkeit sein. Wir müssen klarmachen, dass Folter und der Vollzug von Todesstrafe nicht in unserem Wertekanon, nicht im Interesse der Europäischen Union ist, und insofern haben wir heute eine Gesetzgebung vor uns, die dafür sorgt, dass eben keine Folterwerkzeuge mehr exportiert werden, dass dafür nicht geworben werden darf, dass sie nicht ausgestellt werden dürfen und dass es auch keinen Transit gibt. Und das ist ein großer Schritt in die richtige Richtung für eine wertbasierte Handelspolitik, die deutlicher macht, dass Handel nicht allein über ökonomische Beziehungen zu organisieren ist und ökonomische Interessen zu verfolgen hat, sondern in der Tat auf Werten der Europäischen Union basiert.

Dass wir das so hingekriegt haben, war in der Tat ein Erfolg des Europäischen Parlaments. Herzlichen Dank an die Berichterstatterin, Frau Marietje Schaake, aber auch an Frau Malmström herzlichen Dank für die gute Zusammenarbeit mit der Europäischen Kommission!

Leider kann ich den Dank nicht unbedingt an den Rat weitergeben, weil wir den Rat und die Mitgliedstaaten doch sehr stark drängen mussten, diese Gesetzgebung in dieser Form jetzt so zu verabschieden – gerade auch, was einen Schnelltest für neue Produkte anbetrifft. Aber wir haben jetzt wirklich ein tolles Modell auf dem Tisch. Dieses Modell sollten wir auch als Blaupause für eine Gesetzgebung nehmen, die kommt. Die Kommission hat jüngst letzte Woche die Gesetzgebung zu Dual-use-Gütern veröffentlicht, also dem Export von Gütern, die sowohl militärisch als auch zivil genutzt werden können. Auch da müssen wir klarmachen: Wir stehen zu unserer wertbasierten Handelspolitik. Güter, die missbräuchlich genutzt werden, dürfen nicht exportiert werden.

  Patrick Le Hyaric (GUE/NGL). – Madame la Présidente, s'interdire de fournir des produits, des médicaments, des poisons destinés à torturer ou à donner la mort est un acte de civilisation. C'est donc le sens de notre soutien à ce texte. Continuons d'agir pour l'abolition de la peine de mort partout où elle existe dans le monde.

Il nous faudra aussi réviser nos politiques commerciales de telle sorte que les pays qui dispensent des traitements inhumains ne bénéficient d'aucun traitement commercial préférentiel. Pour cela, il conviendrait d'avoir le courage d'utiliser toutes les clauses inscrites dans les accords de partenariat pour faire respecter les droits humains et la démocratie en suspendant ces accords commerciaux ou d'association, comme toute coopération militaire, dès lors que des faits de torture ou des traitements inhumains sont constatés. C'est la condition de la mondialisation du progrès humain.

  Daniel Buda (PPE). – Doamnă președintă, pedeapsa capitală, tortura, dar și tratamentele cu cruzime inumane sau degradante sunt incompatibile cu principiile și valorile care guvernează Uniunea Europeană. Împrejurarea că unele substanțe sau produse din Uniunea Europeană pot fi utilizate pentru execuția ființelor umane prin injecție letală este o realitate, astfel încât este necesară adoptarea unor măsuri suplimentare prin care să se prevină încălcarea drepturilor omului sub acest aspect. În acest context, este important să se asigure o îmbinare adecvată a măsurilor de natură legislativă, administrativă, judiciară și externă ale Uniunii Europene pentru a preveni și interzice producția, comerțul și utilizarea bunurilor destinate torturii, precum și a controla în mod efectiv elementele cu utilizări potențial letale și inumane. Importanță majoră și eforturi sporite trebuie direcționate către controlul exporturilor, dar și către elaborarea unei liste specifice cu bunuri care urmează a fi controlate. Cu toate acestea, eforturile nu pot fi limitate doar în direcția de eradicare a torturii prin reducerea disponibilităților echipamentelor cu care se pot comite abuzuri, ci și cu promovarea unor controale adecvate dincolo de frontierele sale. În continuarea acestor eforturi, Uniunea Europeană ar trebui, de asemenea, să încerce să controleze alte servicii care pot contribui la răspândirea produselor ce pot fi utilizate pentru tortură sau pedeapsa capitală, cum ar fi serviciile financiare, dar, mai ales, cele de comercializare. Pe de altă parte, în ceea ce privește asistența tehnică a furnizorilor ar trebui să le fie interzis să acorde instruire, consiliere, formare sau să transmită cunoștințe sau tehnici practice care ar putea ajuta la comiterea unor execuții judiciare. Nu în ultimul rând, trebuie subliniată necesitatea de a monitoriza în mod adecvat punerea în aplicare a angajamentelor statelor membre, inclusiv obligația lor de raportare și schimb de informații prin intermediul unui sistem securizat și criptat.

  Alessia Maria Mosca (S&D). –Signor Presidente, onorevoli colleghi, l'esito dei negoziati con Consiglio e Commissione rappresenta una vittoria politica del Parlamento e dell'Unione europea tutta. La normativa proposta tocca da vicino uno dei valori di cui l'Unione è portatrice: il sostegno ai diritti umani e la lotta contro la pena di morte.

Ci sono due principi generali che sono alla base della questione. Anzitutto, l'Unione europea, capofila nella lotta alla pena capitale, deve essere coerente. Non siamo credibili se pretendiamo di proteggere i diritti umani in paesi lontani, mentre permettiamo che le nostre aziende commercializzino in quegli stessi Stati alcuni fra i prodotti che contribuiscono alla perpetuazione di soprusi contro la dignità umana.

In secondo luogo, il testo si inserisce coerentemente nella strategia commerciale europea, una politica volta a promuovere sviluppo sostenibile e crescita, imponendo alla globalizzazione i principi di tutela e giustizia sociale. Il nostro obiettivo è garantire agli attori del commercio globale una base di regole comuni che permettano di correggere e prevenire gli effetti collaterali della globalizzazione. È indispensabile che l'Unione europea sia all'avanguardia in questa battaglia di civiltà per evitare che i cambiamenti che stanno accompagnando la nostra epoca diventino armi in mano a pochi, a svantaggio dei più deboli. Il bando alla commercializzazione, alla promozione e al transito di queste merci risponde proprio a questa necessità e per questo auspico che l'Aula si esprima nel modo più unitario possibile.

  Javier Couso Permuy (GUE/NGL). – Señora Presidenta, creo que es positivo y necesario que se regule el comercio de determinados productos que pueden utilizarse para aplicar la pena de muerte, infligir tortura o tratos degradantes, y por ese motivo creo que este informe va en la dirección correcta. Pero hay que tener claro que la Unión Europea no tiene ninguna credibilidad mientras continúe pasando por alto lo que hacen sus socios en cuanto a la tortura, o lo que hacemos nosotros mismos.

Ejemplos hay muchos: los vuelos secretos de la CIA, las cárceles, o que en Guantánamo se tortura impunemente desde hace ya catorce años, por no hablar de nuestra subcontratación de la deportación de inmigrantes o la concesión del estatus de país seguro a Turquía o, según un acuerdo secreto, a Afganistán.

No tendremos ninguna credibilidad en nuestra llamada «lucha contra la tortura» mientras continuemos lucrándonos con la venta de armas a Arabia Saudí o nuestros socios, como Israel o Estados Unidos, tengan legalizada la tortura. Los papeles lo soportan todo, pero, si estamos realmente contra la tortura, ¿no deberíamos empezar por presionar y condicionar nuestras relaciones con aliados y actores relevantes hasta que cumplan con la Declaración Universal de Derechos Humanos?

  Javier Couso Permuy (GUE/NGL), respuesta de «tarjeta azul». – Bueno, yo creo que más que una pregunta era una declaración para que constara en sus estadísticas, pero vamos, creo que hay muchos mecanismos para que nuestras relaciones comerciales estén supeditadas a una acción política. Sabemos cómo se puede hacer, lo que pasa es que tiene que haber consecuencias. Nunca hay consecuencias cuando se incumplen los derechos humanos si el socio es grande; si es pequeño, claro, cortamos relaciones inmediatamente.

  Pedro Silva Pereira (S&D). – Senhor Presidente, Senhora Comissária, a União Europeia é bastante mais do que um simples mercado e sendo a proteção dos direitos humanos um valor fundamental da União, esse valor tem de estar no centro da política europeia de comércio. É por isso que as novas regras anti tortura acordadas no trílogo das instituições europeias merecem o apoio desta Casa, justamente porque constituem um passo muito importante para uma política comercial mais responsável e mais conforme com os nossos valores, capaz até de se constituir como uma referência exemplar neste domínio à escala global.

Quero, por isso, saudar o trabalho da Comissão e da delegação da Comissão do Comércio Internacional no trílogo que conseguiu integrar grande parte das recomendações do Parlamento no texto final e destaco dois pontos fundamentais: a proibição da publicidade e da promoção das mercadorias destinadas à tortura e também o procedimento de urgência que permitirá uma resposta rápida à circulação de novos produtos que possam surgir no mercado e sejam suscetíveis de utilização em atos de tortura. Com estas novas regras a política comercial da União fica melhor, o nosso combate pelos direitos humanos fica mais forte e o Parlamento Europeu continuará a cumprir a sua missão, vigiando a aplicação destas regras para que a política comercial da União seja efetivamente, na prática, fiel aos valores da União Europeia.

  Josu Juaristi Abaunz (GUE/NGL). – Señora Presidenta, la ponente Schaake y las aportaciones de nuestra colega Lochbihler han mejorado la propuesta de la Comisión, que refuerza el control de los instrumentos de tortura e incorpora aportaciones de Amnistía Internacional o de Omega. Sin embargo, hay armas y proyectiles no incluidos en los anexos y que, por tanto, no están sometidos a control o prohibición. Es el caso de las pelotas de goma.

La Comisión alude o se escuda en la falta de competencias y en que la legislación comunitaria no prohíbe el uso de pelotas de goma. Esto, unido al hecho de que la Lista Común Militar y la de productos de doble uso sean aplicadas de forma diferente por cada Estado miembro, agrava la falta de garantías y de seguridad.

Es hora, en mi opinión, de que solventemos estas lagunas, para que muertes como la del joven Iñigo Cabacas en 2012, causada por el impacto de una pelota de goma lanzada por la policía autónoma vasca, no ocurran nunca más. Y es hora de que apliquemos y hagamos respetar también en casa lo que preconizamos fuera.

  Jude Kirton-Darling (S&D). – Madam President, our trade policy can and should be a crucial tool to promote human rights, and this is what this regulation is all about. The EU rightly rejects the use of torture and the death penalty, and the way that we trade must reflect these fundamental values. This legislation will ensure that no EU business can profit from torture and that no company trading for goods for execution or torture can access the EU market. Effective enforcement will be absolutely crucial.

But it is worth reminding ourselves that, because this legislation is from the EU – the biggest trading bloc in the world – it can have a real impact in setting global standards in a way that no country could ever achieve unilaterally. I support this legislation and I very much hope that, despite Brexit in my own country, both the UK and the rest of the EU will continue to strive together for a strong, value-based trade policy worldwide.

  Ana Gomes (S&D). – Senhora Presidente, há uns anos atrás, a pedido da ONG Reprieve, iniciei, com outros colegas aqui no Parlamento Europeu uma ação para obter o resultado que hoje finalmente votaremos. Felicito a relatora Marietje Schaake, que conduziu as negociações entre a Comissão, o Conselho e o Parlamento em defesa das posições do Parlamento para introduzir cruciais alterações no Regulamento de 2005, corrigindo lacunas e aumentando o alcance e a eficácia.

É o caso das cláusulas que restringem e proíbem serviços de assessoria, transporte, corretagem, marketing e outros serviços acessórios à venda de produtos de risco ou proibidos. As empresas estabelecidas na União Europeia não poderão mais promover equipamentos proibidos em feiras de armas, exposições e online. Proibimos o fornecimento de assistência técnica na utilização de medicamentos ou outros produtos suscetíveis destes usos, para tortura, aplicação de pena de morte e introduzimos um procedimento de urgência que permitirá controlar novos produtos que apresentem riscos.

Não basta sermos contra a pena de morte e a tortura, universalmente. Precisamos de garantir que a União Europeia, na política comercial como noutras, é coerente e não, de maneira nenhuma, se presta a ser cúmplice na execução da pena de morte e de atos de tortura, que as nossas empresas, que as empresas europeias, não lucram com a venda de produtos que possam ser utilizados por ditaduras ou por democracias para causar tortura e infligir a pena capital a seres humanos. Coerência na defesa da dignidade humana, na base dos valores consagrados no Tratado da União Europeia e na Carta dos Direitos Fundamentais é fundamental na política comercial como noutras.

  Nicola Caputo (S&D). – Signora Presidente, onorevoli colleghi, l'Europa ha la necessità di ribadire il suo ruolo di leadership in campo internazionale nella lotta all'abolizione della pena di morte, della tortura e delle pratiche inumane e degradanti che violano i diritti umani. I paesi membri non devono essere complici, nemmeno indirettamente, di chi continua a compiere atti di tortura e maltrattamenti in totale disprezzo della Carta dei diritti fondamentali.

Il fulcro della linea europea deve essere la giusta combinazione di divieti e requisiti di autorizzazione per il commercio delle merci oggetto del regolamento. Non è sufficiente il mero divieto di commercializzazione di prodotti utilizzabili ai fini del compimento di atti di tortura e pena di morte. Occorre prevedere un sistema di autorizzazione anche degli articoli destinati a più usi, che potrebbero essere quindi oggetto di un utilizzo improprio. Ritengo opportuno che si ponga in essere un severo regime multilaterale di controllo delle esportazioni nel settore in questione. Particolare attenzione dovrà essere riposta ai medicinali utilizzabili per eseguire pene capitali tramite iniezione letale.

  Νότης Μαριάς (ECR). – Κυρία Πρόεδρε, η θανατική ποινή, τα βασανιστήρια και κάθε μορφή σκληρής, απάνθρωπης και ταπεινωτικής μεταχείρισης και τιμωρίας απαγορεύονται από τις διεθνείς και ευρωπαϊκές συνθήκες. Στο πλαίσιο αυτό, ο ευρωπαϊκός κανονισμός κατά των βασανιστηρίων πρέπει να λειτουργήσει αποτελεσματικά ως εργαλείο για την προστασία των ανθρώπων από τη βίαιη μεταχείριση επιβάλλοντας αποτελεσματικούς ελέγχους σε είδη και δραστηριότητες που χρησιμοποιούνται για εκτέλεση θανατικής ποινής ή για βασανιστήρια. Αυτός ο στόχος απαιτεί άμεση αναδιοργάνωση των ελέγχων της Ευρωπαϊκής Επιτροπής στο εμπόριο οργάνων βασανιστηρίων, μια αναδιοργάνωση που, δυστυχώς, έχει καθυστερήσει σε πολλαπλά επίπεδα.

Πρέπει, λοιπόν, να απαγορευθούν οι διαφημίσεις και οι πωλήσεις αυτών των προϊόντων στο διαδίκτυο. Πρέπει ιδίως να ενταθεί ο έλεγχος των εξαγωγών των ειδών διπλής χρήσης που περιλαμβάνονται στους καταλόγους στρατιωτικού εξοπλισμού, είδη τα οποία μπορούν να χρησιμοποιηθούν και για βασανιστήρια. Εκτιμώ λοιπόν ότι δεν γίνεται να ζητά η Ευρωπαϊκή Ένωση από τη μία την επικύρωση των διεθνών συμβάσεων κατά της θανατικής ποινής σε τρίτες χώρες και από την άλλη να ανέχεται εδώ στην Ευρωπαϊκή Ένωση τη χρήση πρακτικών και εργαλείων από τα Σώματα Ασφαλείας που αποδεδειγμένα οδηγούν σε μόνιμους τραυματισμούς ή ακόμη και σε θανάτους.

  Maria Grapini (S&D). – Doamnă președintă, doamnă comisar, ca membru al Comisiei IMCO mă interesează orice reglementare legată de comerț în piața internă, așadar și acest raport. Nu trebuie însă să dezvoltăm o piață liberă cu orice preț, vorbim de o Europă digitală, de comerț online și cred că este foarte important să vedem cum putem supraveghea piața pe acest segment. Este bine că se introduce interdicția produselor care sunt susceptibile de a fi utilizate pentru tortură. Pentru condamnarea practicilor de tortură trebuie intervenit fără ezitare. Restricțiile în acest domeniu, prevăzute în acest raport, sprijină de fapt combaterea pedepsei capitale și a torturii. Este bine că avem un raport care arată că susținerea dezvoltării comerțului liber nu ne împiedică să intervenim atunci când este vorba de produse periculoase. Cred însă, doamnă comisar, că este nevoie să revizuim periodic lista acestor produse periculoase deoarece inventivitatea și inovarea funcționează și în domeniul acestor produse.   Cecilia Malmström, Member of the Commission. – Mr President, it is rare that there is such consensus on a trade-related matter in this plenary, and I salute this, but this is truly an occasion where we can all be proud. The institutions, including Parliament under the very strong and affirmative leadership of the rapporteur, worked very closely together in the trilogues to achieve something really important that has a real effect on the most vulnerable people all across the world.

This is being closely watched by members of NGOs, of course, and also by many committed citizens who have been expecting us to take action today. And with your vote in a couple of hours we will do so.

What we have been considering here is the impact of trade in instruments that actually cause death and torture – lethal drugs, injections, electric chairs, choke belts, spiked batons – and we have prohibited the promotion of those products. I was shocked to see how such products are displayed at trade fairs all over the European Union or offered in catalogues.

Today we are addressing that loophole, which so many of you have talked about, and also making sure that we address transit issues, and that we have a quick procedure for updating so that we can ban new products in a quick and effective manner.

This, of course, makes a true contribution. It will not eliminate torture or the death penalty, because we cannot do that with this instrument alone, but it is a contribution and we will continue, with the other tools we have in various dialogues and in our foreign policy, to fight against these things that have no place in a civilised society. We are also sending a very powerful signal: that the European Union stands united in taking this step. So thank you again. I am looking forward to the vote and to working with you to make sure that this legislation is swiftly implemented and that it works in practice.

  Marietje Schaake, rapporteur. – Madam President, I would like to thank everyone for their contributions, including Commissioner Malmström for her leadership across the board in her groups at the Commission. Together we have closed most loopholes, and we must ensure solid monitoring at the Member-State level. It is indeed, as the Commissioner said, hard to imagine the kinds of products and services that are offered at trade fairs and in online or offline catalogues. This must end.

Today’s update shows the EU leads in raising the bar globally to take concrete steps to end the death penalty and torture. The increase of torture and the death penalty call for such measures, from Iran to Saudi Arabia or Egypt, from China to the United States. We must push back and challenge these kinds of human rights abuses. In fact, we need more EU-wide leadership to push back against those who challenge the universality of human rights.

Today’s trade measures – and I hope they will be adopted with a large majority – will of course not in of themselves end the death penalty or torture. So we must see this step in sync with other measures and instruments the European Union has and must use.

We have to keep in mind when we do our work those people who are suffering from repression, violence, torture and the death penalty, often at the hands of their own governments. They must find in the European Union an advocate for their freedom. Today’s regulation is an important element to give meaning to the European Union’s human rights agenda, and I hope for all of your support.
