At its sitting of 18 November 2003 Parliament adopted its position at first reading on the proposal for a European Parliament and Council decision on Interoperable Delivery of pan-European eGovernment Services to Public Administrations, Businesses and Citizens (IDABC) (COM(2003) 406 – 2003/0147(COD)).

At the sitting of 15 January 2004 the President of Parliament announced that the common position had been received and referred to the Committee on Industry, External Trade, Research and Energy (14816/1/2003 – C5‑0017/2004).

The committee had appointed Imelda Mary Read rapporteur at its meeting of 10 July 2003.

It considered the common position and the draft recommendation for second reading at its meetings of 27 January 2004, 18 February 2004 and 8 March 2004.

At the last meeting it adopted the draft legislative resolution unanimously.

DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the Council common position for adopting a European Parliament and Council decision on Interoperable Delivery of pan-European eGovernment Services to Public Administrations, Businesses and Citizens (IDABC)

The European Parliament,

–   having regard to the Council common position (14816/1/2003 – C5‑0017/2004),

–   having regard to its position at first reading[1] on the Commission proposal to Parliament and the Council (COM(2003) 406)[2],

–   having regard to the Commission amended proposal (COM(2004) 13)[3],

–   having regard to Article 251(2) of the EC Treaty,

–   having regard to Rule 80 of its Rules of Procedure,

–   having regard to the recommendation for second reading of the Committee on Industry, External Trade, Research and Energy (A5‑0124/2004),

1.   Amends the common position as follows;

2.   Instructs its President to forward its position to the Council and Commission.

Amendment 1
Recital 15

(15)   For the delivery of pan-European eGovernment Services it is necessary to take into account the provisions of, in particular, Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data [4].

Justification

This Directive is also relevant. The amendment has the support of both the Commission and the Council.

Amendment 2
Article 6, paragraph 7

7.   Results achieved by other relevant Community and Member States activities, in particular the Community research and technological development programmes and other Community programmes, such as eTEN, eContent, eInclusion, eLearning and MODINIS shall be taken into account, whenever appropriate, in the definition of projects of common interest and horizontal measures in order to avoid duplication and to speed up the development of eGovernment services. Projects in the planning or the development phase shall also be taken into account.

Justification

This is a technical amendment to correct a drafting error. eInclusion is a Community policy but not a Community programme. The change has the support of the Commission and the Council.

Article 10, paragraph 8

By [two years after the date of entry into force of this Decision], mechanisms to ensure the financial and operational sustainability of infrastructure services, whenever appropriate, shall be defined and agreed in accordance with the procedure referred to in Article 11(2).

Justification

This is an amendment to correct an error in the original text. It was always intended to set a deadline for the end of 2006.

EXPLANATORY STATEMENT

The rapporteur's first reading report (A5-375/2003) explains her support for this funding programme and the potential benefits that it will bring.

The Common Position that has been adopted by the Council takes into account all of the European Parliament's first reading amendments and introduces further changes which, in the rapporteur's opinion, strengthen the text. The rapporteur recommends that the European Parliament supports the Council Common Position, with the addition of some minor technical amendments which aim to give legal clarification to the text. With these changes, an agreement with the Council at second reading should be achievable.
