At its sitting of 18 December 2003, Parliament adopted its position at first reading on the proposal for a European Parliament and Council regulation on promoting gender equality in development cooperation (COM(2003) 465 – 2003/0176(COD)).

At the sitting of 26 February 2004, the President of Parliament announced that the common position had been received and referred to the Committee on Women’s Rights and Equal Opportunities (5402/1/2004 – C5‑0093/2004).

The committee had appointed Olga Zrihen Zaari rapporteur at its meeting of 2 October 2003.

It considered the common position and the draft recommendation for second reading at its meeting of 16 March 2004.

At that meeting it adopted the draft legislative resolution unanimously.

The following were present for the vote: Anna Karamanou (chairwoman), Marianne Eriksson (vice-chairwoman), Olga Zrihen Zaari (vice-chairwoman and rapporteur), María Antonia Avilés Perea, Regina Bastos, Marie-Hélène Gillig (for Christa Prets), Lissy Gröner, Rodi Kratsa-Tsagaropoulou, Maria Martens, Amalia Sartori, Miet Smet, Joke Swiebel and Anne E.M. Van Lancker (for Mary Honeyball).

The recommendation for second reading was tabled on 17 March 2004.

DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the Council common position for adopting a European Parliament and Council regulation on promoting gender equality in development cooperation

(5402/1/2004 – C5‑0093/2004 – 2003/0176(COD))

(Codecision procedure: second reading)

The European Parliament,

–   having regard to the Council common position (5402/1/2004 – C5‑0093/2004),

–   having regard to its position at first reading[1] on the Commission proposal to Parliament and the Council (COM(2003) 465)[2],

–   having regard to Article 251(2) of the EC Treaty,

–   having regard to Rule 78 of its Rules of Procedure,

–   having regard to the recommendation for second reading of the Committee on Women’s Rights and Equal Opportunities (A5‑0160/2004),

1.   Approves the common position;

2.   Notes that the act is adopted in accordance with the common position;

3.   Instructs its President to sign the act with the President of the Council pursuant to Article 254(1) of the EC Treaty;

4.   Instructs its Secretary-General duly to sign the act and, in agreement with the Secretary‑General of the Council, to have it published in the Official Journal of the European Union;

5.   Instructs its President to forward its position to the Council and Commission.

EXPLANATORY STATEMENT

On 30 July 2003, the Commission submitted to the European Parliament and the Council, pursuant to Article 251(2) and Article 179 of the EC Treaty, the proposal for a European Parliament and Council regulation on promoting gender equality in development cooperation.

Parliament delivered its opinion at first reading on 18 December 2003, with this containing 21 amendments to the Commission proposal. The Council adopted its common position on 19 February 2004.

20 of Parliament's amendments were approved in full by the Commission and Council and incorporated into the common position. The only amendment not taken up in the common position is amendment 21, which concerned an increase in funding from 9 to 11 million euro. Amendment 21 was not approved by the Commission either.

At an informal meeting of the representatives of the three institutions, the representatives of the European Parliament approved the Council common position.

The Committee on Women's Rights and Equal Opportunities approves the common position, including the maintenance of funding at 9 million euro put forward by the Commission in its proposal.
