DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION
on the proposal for a Council decision amending Decision 90/424/EEC on expenditure in the veterinary field

The European Parliament,
– having regard to the Commission proposal to the Council (COM(2005)0362)[1],
– having regard to Article 37 of the EC Treaty, pursuant to which the Council consulted Parliament (C6‑0282/2005),
– having regard to Rule 51 of its Rules of Procedure,
– having regard to the report of the Committee on Fisheries (A6‑0067/2006),
1. Approves the Commission proposal as amended;
2. Calls on the Commission to alter its proposal accordingly, pursuant to Article 250(2) of the EC Treaty;
3. Calls on the Council to notify Parliament if it intends to depart from the text approved by Parliament;
4. Asks the Council to consult Parliament again if it intends to amend the Commission proposal substantially;
5. Instructs its President to forward its position to the Council and Commission.

Justification | |
The entry into force of the proposed changes should be postponed in line with an amendment by the rapporteur of the report on a directive on animal health requirements for aquaculture animals and products thereof, and on the prevention and control of certain diseases in aquatic animals (2005/153(CNS)). The Commission's draft decision will not be adopted until mid-2006. Given that transposition generally takes between 12 and 18 months, 30 June 2007 appears more realistic. |

EXPLANATORY STATEMENT
AIM OF THE PROPOSAL
The aim of the proposal is to amend Council Decision 90/424/EEC on Community expenditure in the veterinary field to bring it into line with the planned Council directive[1] on animal health requirements for aquaculture animals and products thereof, and on the prevention and control of certain diseases in aquatic animals.
SUBSTANCE OF THE PROPOSAL
With this proposal, the Commission is seeking to make the necessary amendments to the current Council Decision 90/424/EEC so that EU financial support will be granted for veterinary measures affecting aquaculture animals as well as terrestrial animals.
These amendments are necessary to guarantee adequate financial support for the Member States in combating serious diseases in aquaculture animals using appropriations from the Fisheries Fund. At present, financial support is available only for eradicating infectious salmon anaemia (ISA) and infectious haematopoietic necrosis (IHN), also among salmon. The proposal will ensure consistency with compensation arrangements for eradication and slaughter measures in relation to diseases in terrestrial animals.
The following additions are to be made to Decision 90/424/EEC:
· the Member States may allocate funds as compensation for disease-eradication measures within the framework of the operational programmes set up under Title III of the new Regulation on the European Fisheries Fund;
· the list of animal diseases whose eradication is eligible for a Community financial contribution is expanded to include certain aquatic animal diseases.
ASSESSMENT OF THE PROPOSAL
The rapporteur supports the Commission's view that the same rules should apply to eradication and slaughter measures in relation to diseases in both terrestrial and aquatic animals.
