DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the draft Council regulation extending to the non-participating Member States the application of Regulation (EU) No …/2012 establishing an exchange, assistance and training programme for the protection of the euro against counterfeiting (the ‘Pericles 2020’ programme)

The European Parliament,

–   having regard to the draft Council regulation (16616/13),

–   having regard to the request for consent submitted by the Council in accordance with Article 352 of the Treaty on the Functioning of the European Union (C7‑0463/2013),

–   having regard to Rule 81(1), first and third subparagraphs, of its Rules of Procedure,

–   having regard to the recommendation of the Committee on Civil Liberties, Justice and Home Affairs (A7-0152/2014),

1.   Consents to the draft Council regulation;

2.   Instructs its President to forward its position to the Council, the Commission and the national parliaments.

EXPLANATORY STATEMENT

The draft regulation aims to extend the application of Regulation (EU) No …/2012, known as the ‘Pericles 2020’ programme, to Member States which have not adopted the euro as their single currency.

‘Pericles 2020’ is the continuation of the programme established by Council Decision 2001/923/EC, as subsequently amended, with the aim of establishing measures designed to protect the euro against counterfeiting.

The legal basis of the proposal is Articles 133 and 139(2)(f) of the Treaty on the Functioning of the European Union (TFEU), which stipulate that the European Parliament and the Council are to lay down the measures necessary for the use of the euro as the single currency, including measures to protect the euro against counterfeiting. The extended Pericles programme will be implemented through a proposal for a parallel regulation based on Article 352 TFEU.

The assessments carried out in 2004 and 2011 showed that the programme has achieved its objectives and should be continued. The rapporteur takes the view that extending it to the remaining Member States will make it possible to improve the programme and help make action to prevent and combat euro counterfeiting more effective.

Financing for the programme in these countries is covered by Article 5 of Regulation (EU) No …/2012, which governs the bodies that can opt for funding.

In the light of this analysis, the rapporteur proposes that this legislative proposal be approved without amendments.
