DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the Council position at first reading with a view to the adoption of a regulation of the European Parliament and of the Council laying down measures concerning open internet access and amending Directive 2002/22/EC on universal service and users’ rights relating to electronic communications networks and services and Regulation (EU) No 531/2012 on roaming on public mobile communications networks within the Union

The European Parliament,

–  having regard to the Council position at first reading (10788/2/2015 – C8‑0294/2015),

–  having regard to the reasoned opinion submitted, within the framework of Protocol No 2 on the application of the principles of subsidiarity and proportionality, by the Irish Houses of the Oireachtas, the Maltese Parliament, the Austrian Federal Council and the Swedish Parliament, asserting that the draft legislative act does not comply with the principle of subsidiarity,

–  having regard to the opinion of the European Economic and Social Committee of 21 January 2014[1],

–  having regard to the opinion of the Committee of the Regions of 31 January 2014[2],

–  having regard to its position at first reading[3] on the Commission proposal to Parliament and the Council (COM(2013)0627),

–  having regard to Article 294(7) of the Treaty on the Functioning of the European Union,

–  having regard to Rule 76 of its Rules of Procedure,

–  having regard to the recommendation for second reading of the Committee on Industry, Research and Energy (A8-0300/2015),

1.  Approves the Council position at first reading;

2.  Notes that the act is adopted in accordance with the Council position;

3.  Instructs its President to sign the act with the President of the Council, in accordance with Article 297(1) of the Treaty on the Functioning of the European Union

4.  Instructs its Secretary-General to sign the act, once it has been verified that all the procedures have been duly completed, and, in agreement with the Secretary-General of the Council, to arrange for its publication in the Official Journal of the European Union;

5.  Instructs its President to forward its position to the Council, the Commission and the national parliaments.

EXPLANATORY STATEMENT

This Regulation will introduce harmonised rules to safeguard open internet access, to protect users' rights and to end roaming surcharges.

The Parliament adopted its first reading position on 3 April 2014.

On 2 September 2014 the ITRE Committee took the decision according to Rule 74 of the Rules of Procedure to open inter-institutional negotiations. The first trilogue took place on 23 March 2015. The Parliament's and Council's negotiating teams, with the participation of the Commission, reached an informal agreement on the file on 30 June 2015. The text of the agreement was presented to the ITRE Committee for a vote of approval on 22 July 2015, and was approved by an overwhelming majority. Following legal-linguistic verification, Council adopted its first reading position, confirming the agreement, on 1 October 2015.

As Council's first reading position is in conformity with the agreement reached in the trilogues, your Rapporteur recommends to the Committee to accept it without further amendments.
