Violation of the property rights of the individual is a clear breach of one of the EU's fundamental principles.

 

Can the Commission bring proceedings before the European Court of Justice against a Member State which disregards the judgments of its own courts, which consistently rule in favour of citizens who are prevented from enjoying the use of  property which they legally own? What sanctions, if any, are provided in Community law in the event of a ruling against such a Member State?
