Although a well developed Air Passengers' Rights Regulation ((EC) No 261/2004) exists, to which an amendment was tabled in 2013, neither text yet contains any rules concerning the need to pay air fares well in advance of the date of travel.
More and more passengers are complaining about having to pay the full air fare to the airline in advance, particularly when booking well before the date of travel.
Taking into account the above:
- 1.What is the legal basis for the rule that airline passengers must pay the full fare long in advance of the flight?
- 2.What happens if the airline becomes insolvent or goes bankrupt? Who is liable in such cases?
- 3.Has any consideration been given to how this rule might be amended?
