Loss of Spanish healthcare assistance following periods spent abroad of over 90 days

In its answer to Written Question E-005755/2014 on the legislative reform approved in Spain under which public healthcare assistance is withdrawn from people who have spent over 90 days outside Spain, the Commission said that it had asked for clarifications regarding Spanish Law 22/2013 of 23 December 2013, and in particular the issue of whether and in what way that Law limits the possibilities of persons insured in Spain to continue enjoying entitlement to Spanish healthcare benefits when they are staying temporarily in a Member State other than Spain.

Can the Commission say whether it has received this information? If so, does it see the Spanish law as breaching the right to reside anywhere in the EU and therefore consider it necessary to open infringement proceedings under Article 258 TFEU?
