Legislation posing a threat to the rule of law in Spain

Over the past few years the Spanish Government has brought in a series of measures that jeopardise the rule of law. Rights International and Judges for Democracy highlighted this in a recent report, in which they call on the Commission to take action to ensure that the EU’s fundamental values are upheld. For example, the Court Fees Act breaches the principle of equality before the law by imposing the same fees on all legal persons regardless of their means, and the new Public Safety Act poses a threat to freedom of speech in that many of its provisions are vague, which may result in it being enforced arbitrarily.

Given that the Commission has reaffirmed its right to take action when it considers that the rule of law is under threat in one of the Member States:

Does the Commission take the view that this legislation may pose a threat to the EU’s values, and that as a result the Spanish authorities should be contacted with a view to addressing this matter?
