Sovereignty of Member States: Poland

Question for written answer E-000408-16
to the Commission
Rule 130
Aymeric Chauprade (NI)

The Commission has once again flagrantly disregarded the sovereignty of a Member State, namely Poland.

President Juncker asked the Polish Government not to implement the law reforming the country's Constitutional Court on the pretext that no prior assessment of the court's independence had been carried out. The Commission will now hold a debate on ‘the rule of law in Poland’ on 13 January 2016.

Mr Juncker took great pride in saying that ‘our approach is very constructive’.

1. Is it really constructive for the Commission to attack anything or anyone that gets in the way of its federalist ambitions, in particular the nation state and the peoples of Europe?

2. Can the Commission reasonably criticise a government for implementing the programme on which it was elected?
