In its legal opinion, what does the Commission consider a legal act in the meaning of Article 4(2)(b) of Regulation (EC) 211/2011?

Articles 288-290 TFEU are clear about what is to be considered a legal act within the legislation of the European Union, and it clearly does not include the cases within the meaning of Article 7 TEU. This notwithstanding, the Commission has stated, in its answer to written questions E-016063/15, E-016064/15, E-016098/15, E-016062/15 and E-016065/15, that, in its legal assessment, Article 7 TEU ‘provides for the adoption of a legal act on a proposal inter alia from the Commission’.
