Consent when upgrading to Windows 10

Many constituents have contacted me regarding the Windows 10 upgrade, which has been automatically downloaded onto their PCs and laptops.

Until recently, the upgrade installer could be ignored; however this policy has changed and I understand users are obliged to repeatedly postpone the upgrade without being able to definitively ‘opt-out’.

For many users this could harm functionality, due to reported problems with drivers or other incompatible software. For some constituents in particular their attempts to reject the upgrade have caused their computers to malfunction, and require repair.

Given that Microsoft appears not to be asking its users for their explicit and informed consent before upgrading to Windows 10, this would appear to violate the Unfair Commercial Practices Directive.

Could the Commission confirm that it intends to enforce the UCPD appropriately, in tandem with Member State competent authorities?
