The cross-sectorial correction factor (CSCF)

On 28 April 2016, the European Court of Justice declared invalid the maximum annual amount of free ETS (EU emissions trading system) allowances determined by the Commission in September 2013 for the period 2013-2020. The Court found that this ceiling, used to determine the value of the cross-sectorial correction factor (CSCF), was miscalculated. Consequently, the Court deemed the CSCF invalid and called upon the Commission to adopt the necessary measures to remedy the invalidity within 10 months following the date of the judgment. Following these recent developments, a clear understanding of the Commission's calculation of the CSCF is necessary to ensure trust in the ETS system.

1. Could the Commission please describe the procedure, data and methodology it will use to modify the value of the CSCF?

2. In line with the principles of better regulation and transparency, could the Commission grant public access to the raw data used to recalculate the CSCF?
