Article 1(17) of Regional Law 35 of 29 December 2016 (‘Stability Law for the Lombardy Region ’) states that:
‘To improve the bankability of the Pedemontano Lombardo Road Network project, as per CIPE Decisions No 97/2009 and No 24/2014, the Regional Government is authorised to issue the appropriate guarantee to ensure the regular servicing of the debt owed by the concessionnaire, Autostrada Pedemontana Lombarda SpA. For this purpose, it allocates the annual sum of EUR 22 500 000.00 to its regional budget for the period 2025-2044, up to a total value of EUR 450 000 000.00, in order to provide financial cover for the guarantee.
The availability of resources for this allocation of expenditure is ensured by current revenue, as per Titles 1, 2 and 3 of the Regional Budget. Through a subsequent measure, the Regional Government, as the controlling entity of the Pedemontana SpA company, will identify further modalities and conditions for the granting of the aforementioned guarantee.’[1]
Can the Commission say:
- —Whether it was aware of this legislative development?
- —Whether it will take this into account during the investigation into the Italian motorways, referred to in Question E-003742-16?
- —Whether such an allocation might lead to the granting of illegitimate state aid?
