Commission's position on issuing visas to EU citizens' family members, when those family members are not EU citizens, and the appeals procedure

A Polish citizen attempted to get an entry visa to Ireland for his wife, a citizen of the Republic of India. The visa was not granted, however, and he received no response to his appeal. Under EC law (Article 5(2) of Directive 2004/38/EC of the European Parliament and of the Council of 29 April 2004), Member States should grant family members every facility to obtain the necessary visas. Such visas should be issued free of charge as soon as possible. The use of an accelerated procedure is also possible.
