Rights of workers used by online platforms to make home deliveries

More and more European workers are being employed by multinational companies in the so-called ‘gig economy’. Most of these are delivery drivers or riders used by online platforms specialising in home deliveries. The main problem affecting this particular category of workers concerns the nature of their employment contracts. These persons are generally recognised as casually employed freelancers, but as a rule the way in which they are used is more suggestive of formal employment. Furthermore, more and more people are this working in this way on a continuous basis and therefore want it to be possible to be regarded as employees, which would confer upon them a whole range of health insurance and social security rights. In many EU Member States, including Italy, there are legislative loopholes that make it impossible to provide appropriate protection for people working in this way.

1. How has the Commission addressed, or does it intend to address, this type of work, which is rapidly becoming more widespread, especially among young people in Europe?

2. Will the Commission propose recommendations to encourage Member States to adopt legislation covering these new working arrangements?
