Law-breaking by the President of Hungary's National Office for the Judiciary

According to the National Judicial Council, in many cases Tünde Handó, President of Hungary’s National Office for the Judiciary, has broken the law in carrying out her duties. Inter alia, the President decreed, without giving reasons, that certain procedures to fill senior posts in the judiciary had failed to identify any suitable candidates; she did not state reasons for her decisions on personnel matters; and she appointed a court President not in order to reduce the case load but to perform management tasks. After declaring the procedures to fill senior posts in the judiciary in 2016 and 2017 unsuccessful, she failed to act without delay to fill those posts. According to a position adopted by the National Judicial Council, the President of the National Office broke the law by acting in this way.

Does the Commission consider that the actions of the National Office for the Judiciary infringe the principles of the independent administration of justice?

How do the unlawful appointment procedures, and the appointment of persons to perform management functions, as described, contribute to the independence of the judiciary?
