Local government authorities in the United Kingdom are abolishing the 85‑year rule, which enables local government workers to claim full pension rights at 60. The local government pension scheme's 85‑year rule permits members whose age plus years in service adds up to 85 to retire at 60, rather than 65. The British Government has claimed that this rule breaches European age discrimination legislation because workers with the same length of service could be treated differently depending on age.
Does the Commission believe that the 85-year rule contravenes Directive 2000/78/EC[1]?
