On 18 March 2008 Mr Franz-Hermann Bruner wrote to the Romanian newspaper Zuma admitting that on 6 May 2004 OLAF had officially requested the Belgian authorities to grant access to documents seized unlawfully from the Stern correspondent Hans-Martin Tillack.
This was in direct contradiction of the statement made by the OLAF representatives in a letter dated 30 July 2004 during the interim hearings in Court of First Instance (CFI) Case T-193/04 R.
This statement to the CFI was transparently false. On 8 January 2008 Mr Bruner again confirmed that OLAF had never sought to gain access to the documents or other seized materials.
As Mr Bruner is responsible for the operations of OLAF and as he is personally involved in the case, will the Commission rapidly institute disciplinary procedures against him over the way in which the CFI was misled during Case T-193/04 R?
