Planned processing in Russia of damaged nuclear fuel assemblies from the Paks incident in 2003 — compliance with EU regulations

Fuel assemblies damaged during the incident that occurred at the Paks nuclear power plant in 2003 are still being stored next to the reactor at Unit 2 that was affected by the incident. To the best of our knowledge, there are plans to transport this nuclear waste to the Mayak complex in Russia later this year for processing and final disposal. Russia, however, does not have a final disposal facility for high-level radioactive waste, and therefore the exemptions referred to in Article 4 of Council Directive 2011/70/Euratom cannot apply.

1. Has Hungary notified the Commission of the planned delivery, its manner and date and the processing and disposal technology concerned, in accordance with Euratom rules?

2. If so, do the planned transport by rail through Ukraine and the reprocessing conditions at Mayak comply with Council Directive 2011/70/Euratom (considering, furthermore, that Euratom rules do not permit any transfer of responsibility with regard to nuclear fuel assemblies)?
