Failure of the Italian State to carry out a census of migratory species of wildlife for the purposes of the implementation of Directive 147/2009/EC

Article 9 of Directive 2009/147/EC provides that Member States may authorise derogations to allow for the hunting of certain species of wild bird.

Law No 157/92 has transposed the directive in its entirety into national law. Article 10 of Directive 2009/147/EC requires Member States to pay particular attention to gathering data on population levels of migratory birds.

ISPRA, the technical and scientific body answerable to the Ministry, faced with requests to allow hunting in derogation of Article 9, Paragraph 1 (c), has for several years argued that there is a lack of data on levels of the aforementioned wildlife populations.

ISPRA has also pleaded its inability to apply the small population calculation method, a problem the Commission itself has referred to. This has thus prevented the implementation of Article 9 of the directive.

That being so, could the Commission say whether it considers it necessary to conduct a detailed study on the effective implementation of Article 10 of Directive 2009/147 EC in relation to Article 1, paragraph 7 (a) of Law No 157/92, and in particular Annex V of the directive and the holding of a wildlife census by ISPRA?

Does the Commission agree that it should specify the practical arrangements for applying the small population calculation method, as provided for by the interpretative guidelines for the directive?
