Regulation (EEC, Euratom) No 1182/71, Article 3:
‘Where a period, expressed in days, weeks, months or years, is to be calculated from the moment at which an event occurs or an action takes place, the day during which that event occurs or that action takes place shall not be considered as falling within the period in question’.
The Irish Interpretation Act 2005, Section 18(h):
‘Periods of time. Where a period of time is expressed to begin on or be reckoned from a particular day, that day shall be deemed to be included in the period and, where a period of time is expressed to end on or be reckoned to a particular day, that day shall be deemed to be included in the period;’.
Council Regulation (EC) No 4/2009, ‘Maintenance obligations’, and Directive 2014/24/EU, ‘Public Procurement’, are two of many EU acts in which Regulation 1182/71 applies.
— Are rights of Irish residents under these acts, to which Regulation (EEC, Euratom) No 1182/71 applies, denied because of a conflict with the Irish Interpretation Act 2005 which, in Irish Law, takes precedence over that regulation?— When can we expect urgent action to remedy these denials of rights to Irish citizens?
