Imminent violation of the Birds Directive with the planned construction of a ski lift on the Riedberger Horn in Bavaria

The Federal State of Bavaria is planning to construct a ski lift on the ‘Riedberger Horn’ mountain, after the communities of Obermaiselstein and Balderschwang, which would be affected, voted in favour of the project.

The area concerned is home to the black grouse (Lyrurus tetrix), which is an endangered species in Bavaria.

Directive 2009/147/EC (the Birds Directive) sets out rules for identifying and classifying special protection areas for the conservation of rare and endangered species, which are listed in Annex I of the directive. The choice of such areas, definition of their boundaries, their incorrect designation and inadequate legal protection could trigger an infringement procedure. This applies not only to designated areas but also to areas which should have been designated. According to a study commissioned by Bavaria’s bird protection association, the Riedberger Horn satisfies the conditions for designation as a bird protection area.

Is the Commission aware of the plans to construct a ski lift on the Riedberger Horn in Bavaria?

What action will the Commission take to ensure the late notification of the Riedberger Horn as a bird protection area and update the list of Important Bird Areas?

In the Commission’s view, does the planned project comply with EC law? What further action will it take to prevent the violation of EC law?
