Protocol No 24 annexed to the Treaty of Amsterdam on asylum for nationals of Member States of the European Union considers that Member States constitute safe countries of origin in respect of each other for all legal and practical purposes in relation to asylum matters, given the level of protection of fundamental rights and freedoms by the Member States of the European Union.

Taking into account that the Prosecutor General of Spain has brought charges of rebellion, sedition and misuse of public funds against the former President of the Generalitat de Catalunya, Carles Puigdemont, and that — as the President of the European Parliament stated in his letter of 7 September — ‘any action against the constitution of a Member State is an action against the European Union's legal framework’, can the Commission say:

Does it consider that there is any valid reason under this Protocol that justifies the granting of asylum by an EU Member State to avoid Spanish justice?
