  Manuel Lobo Antunes, Presidente em exercício do Conselho. Senhor Presidente, Senhoras e Senhores Deputados, decorreram dois anos desde que a rejeição da Constituição em dois dos Estados-Membros veio ensombrar as actividades da União. Passado um ano de reflexão a Presidência alemã foi mandatada, em Junho de 2006, de procurar uma via que permitisse sair dessa situação de impasse e, em nome dos meus colegas, gostaria de felicitar a forma notável como a Presidência alemã conseguiu assegurar um acordo global no Conselho Europeu. Julgo que temos todos os motivos para estarmos gratos de uma forma muito particular à Chanceler Angela Merkel pelo empenho pessoal que dedicou à votação deste acordo.

Como já aqui foi referido, o acordo alcançado no Conselho Europeu implica que seja elaborado um novo Tratado reformador que abra o caminho à realização de uma rápida Conferência Intergovernamental na perspectiva de que o novo Tratado entre em vigor a tempo das eleições para o Parlamento Europeu em 2009. Recomendo-o vivamente a todos vós!

É óbvio que muitos de vós encontrarão elementos neste acordo que não considerarão tão satisfatórios. Nenhum de nós pode fingir que este é exactamente o mandato que teria formulado se tivesse tido total liberdade para o fazer. A Presidência alemã viu-se, desde o início, confrontada com a difícil tarefa de conciliar opiniões muito divergentes acerca do caminho que deveríamos trilhar. Quem havia já ratificado a Constituição desejava, e é compreensível que assim fosse, manter inalterado o mais possível o texto existente. Outros pretendiam um novo texto que se distinguisse o mais possível do projecto de Tratado Constitucional. O texto é, pois, um compromisso entre estas duas posições. Todos tiveram já a oportunidade de apreciar o resultado e não me demorarei por isso nos detalhes. Estou convicto de que estamos perante um texto equilibrado e de que não teria sido possível alcançar um acordo melhor do que este.

O acordo alcançado no Conselho Europeu confere à Presidência portuguesa um mandato que, por ser global e exaustivo, permitirá à Conferência Intergovernamental, à qual caberá a tarefa de transformar em plenitude o mandato no texto de um Tratado, concluir os seus trabalhos com a maior brevidade possível. O Parlamento Europeu será plenamente envolvido nos trabalhos da Conferência Intergovernamental e o Conselho Europeu concordou com uma proposta portuguesa de que o Parlamento dispusesse de três representantes nessa Conferência.

Conhecendo o empenho desta Assembleia em garantir que a União possa agir, de futuro, com a maior eficiência e legitimidade democrática, muito me congratulo com essa representação reforçada. O Parlamento Europeu foi, obviamente, sendo consultado ao longo de todo o processo que conduziu à Conferência Intergovernamental. Sei que o contributo dos Senhores Deputados foi particularmente apreciado pela Presidência alemã, que o teve em inteira consideração ao formular o mandato.

Senhor Presidente, Senhoras e Senhores Deputados, o Conselho convidou o Parlamento a apresentar o seu parecer sobre a convocação de uma Conferência Intergovernamental e é a esse parecer que são hoje dedicados os debates nesta Assembleia. Encorajava-vos a apresentar o parecer tão rapidamente quanto possível para que os trabalhos da CIG possam arrancar ainda antes das férias do Verão. É essa a nossa firme determinação. Espero que concordem comigo quando afirmo que esse objectivo é do interesse de todos nós.

Terão certamente algumas observações de pormenor a fazer e que gostariam que fossem tidas em consideração na Conferência Intergovernamental, mas espero que possam colectivamente dar o vosso amplo apoio ao mandato que foi legado a esta Presidência. É a única forma de garantir que os trabalhos da Conferência Intergovernamental sejam coroados de êxito e o único caminho a seguir para que a União saia finalmente do impasse em que se encontra.

  Margot Wallström, Vice-President of the Commission. Mr President, only a few months ago, not many observers were fully convinced that the European Council could successfully relaunch the treaty review process. Opinion across Europe was fragile and there were wide divergences of views but, thanks to the admirable determination of Chancellor Merkel and the German Presidency and through a real collective effort by Member States and our institutions, the European Council last month reached agreement on a clear and stringent mandate for a new IGC, and it is important that we today recognise this success.

Yesterday, the Commission adopted its opinion on the IGC and, today, you are discussing Parliament’s opinion. This process will allow the Portuguese Presidency to launch the Intergovernmental Conference later this month, but it is not only on timing that our institutions walk side by side. We also do so more importantly on the substance.

The Commission shares the globally positive assessment of the IGC mandate which Mr Leinen’s report provides. The mandate contains many positive elements which are to be welcomed. Like any compromise text, it is also a carefully crafted balance between different interests, between ambition and political realism, and this means that some of the changes agreed in the 2004 IGC were not retained. It is also the reason why a number of derogations were granted to individual Member States.

I shall set out four reasons why the Commission believes that this mandate will allow us in the IGC to provide the European Union with the sound institutional and political basis which we need to meet the expectations of our citizens and the challenges of our societies.

Firstly, the mandate will lay the ground for modern and more accountable institutions for the enlarged Union. We warmly welcome the provisions which will refresh and reinforce the European Union’s democratic legitimacy, a stronger and wider role for the European Parliament, transparency of Council deliberations, more codecision, more decisions taken by qualified majority, a clearer division of competences.

National parliaments will have greater opportunity to be involved in the work of the European Union, while the role of the European institutions will be fully respected. We are also very pleased to see that the innovations of the constitutions on democratic participation, including the citizens’ initiative, have been safeguarded.

Secondly, the Union will have a Charter of Fundamental Rights to protect the citizens, not just a declaratory text but one which will have legal force. Citizens will be able to claim before the courts the rights enshrined in the Charter. The Charter will be binding for the European institutions and for Member States when they implement EU law, even if this does not apply to all of them.

Thirdly, the Union will be able to speak with one single voice on the global scene and be better able to protect the European interest. If we really want to tackle globalisation and address common concerns on sustainable development, climate change, competitiveness and human rights in the world, the Union should use to the fullest its great potential to act collectively.

My fourth remark concerns the policy areas, because the mandate develops the Union’s capacity to deliver swifter and more consistent decisions in the area of freedom, security and justice. Furthermore, it reinforces the legal basis to deal with the challenges of energy policy and climate change.

How can we assess these changes? In our view, the overall balance is positive: the disappearance of some elements, including some of a symbolic nature, as well as the changes that reduced the readability of the text, were necessary parts of a package agreement which could be subscribed to by all Member States. Without an effort to compromise from all those involved, success would not have been possible.

The European train is back on track, but we are not yet at the end of the journey and the citizens must be on board. The mandate is not yet the final product. To steer this new consensus to a successful IGC will require intensive efforts from the Portuguese Presidency, the Member States and our institutions. We particularly welcome the decision of the European Council to strengthen the involvement of the European Parliament in the IGC.

However, our collective negotiating efforts on their own will not be enough. We all – the Commission, the Member States and Parliament – should draw some lessons from the previous ratification process and from the listening phase of Plan D. I am glad to see that the European Council has recognised the importance of communicating with citizens, providing full and comprehensive information on the EU and involving them in a permanent dialogue. This should be even more important in view of the changes that have reduced the readability of the treaty text.

In the coming months, the Commission will present some ideas on how a debate around the reformed Treaty could be organised during the ratification period. We want to work closely with you in the European Parliament, all the Member States and other institutions. Together, we should use this window of opportunity; together, we should engage in this new process without any delay and with all our energy.

  Jo Leinen (PSE), Berichterstatter. – Herr Präsident, Herr Staatssekretär, Frau Vizepräsidentin, liebe Kolleginnen und Kollegen! Wir führen hier eine Debatte fort, die schon seit 9.00 Uhr im Plenum läuft. Vielleicht wäre es sinnvoller gewesen, die Aussprache über die portugiesische Präsidentschaft mit der Aussprache über unsere Stellungnahme zur Regierungskonferenz zu verbinden, weil diese Regierungskonferenz das Herzstück der portugiesischen Präsidentschaft ist, und ihr Erfolg oder Misserfolg wird sich daran messen, ob wir einen Vertrag von Lissabon bekommen oder nicht.

Die Botschaft, die von unserer Stellungnahme ausgeht, lautet: Das Europäische Parlament gibt grünes Licht für die Einberufung der Regierungskonferenz. Die Frist für die Beratungen dieser Stellungnahme war äußerst knapp, viele Kollegen haben das auch kritisiert, aber wir haben große Anstrengungen unternommen und wir wollen keine Hürden aufbauen. Wir wollen niemandem Steine in den Weg legen, weil wir selbst ein Interesse an einer schnellen Einberufung und auch an einem schnellen Abschluss dieser Regierungskonferenz haben. Wir hoffen, dass es uns gelingt, bereits beim Gipfel im Oktober ein Ergebnis vorweisen zu können. Das ist möglich, weil dieses Mandat sehr präzise ist und die Texte wortwörtlich vorliegen. Insofern sollte es mehr eine Arbeit für Juristen als eine Arbeit für Politiker sein, wenn sich denn alle an die beim Gipfel in Brüssel getroffenen Abmachungen halten.

Und hier kommt der erste Appell an die portugiesische Präsidentschaft: Bleiben Sie hart, bleiben Sie konsequent, lassen Sie nicht zu, dass es erneut zu Disziplinlosigkeit zwischen den Mitgliedstaaten kommt, dass neue Punkte auf die Tagesordnung gesetzt werden, dass Nachforderungen gestellt werden, dass manche vorgeben, etwas nicht verstanden zu haben, was sie tags zuvor sehr wohl verstanden haben. Bleiben Sie hart, bleiben Sie genau auf der Linie des Mandats, dann werden Sie auch Erfolg haben!

Wir sehen, dass es einige Verluste gibt. Wir haben einen Preis zu zahlen, und dabei geht es nicht nur um Symbole. Der Reformvertrag ist konzeptionell etwas anderes als der ursprüngliche Verfassungsvertrag. Die Idee eines Europas der Bürger und der Staaten, und nicht nur eines Europas der Staaten, geht ein Stück weit verloren. Der Artikel 1 verschwindet, und es heißt nur: „Die hohen Vertragsparteien gründen den Reformvertrag“, und nicht mehr „Der Wille der Bürgerinnen und Bürger und der Staaten“. Man mag das für gering erachten, aber das ist eine Schleifspur, die sich noch einmal als negativ erweisen kann. Wir weisen darauf hin.

Wir sehen auch mit großer Sorge die zunehmende Zahl von Ausstiegsklauseln. Man muss sich fragen, ob noch alle das gleiche Europa wollen. Gibt es noch den politischen Willen für mehr Integration oder haben wir es bereits mit zwei Gruppen von Ländern zu tun, die nur noch künstlich in derselben EU zusammengehalten werden? Diese Frage muss man sich stellen. Das Parlament kritisiert äußerst scharf die von Großbritannien durchgesetzte Ausstiegsklausel für die Grundrechtecharta!

Diese EU will eine Wertegemeinschaft sein. Wir treten in der ganzen Welt mit der Einforderung von Menschenrechten, von Grundrechten auf. Ich höre schon Herrn Putin oder den chinesischen Premierminister sagen: Ihr selbst seid Euch doch gar nicht einig über Eure Grundrechte! Das ist ein Schlag gegen die Glaubwürdigkeit der EU als Ganzes, und es ist auch eine Diskriminierung von Bürgern, die in Großbritannien wohnen, oder auch EU-Bürgern, die dort arbeiten und leben. Wir fordern in unserer Stellungnahme die Institutionen und die Regierungen auf, nochmals alles zu versuchen, um die Einheit des Grundrechteschutzes herzustellen, und das kann auch gelingen! Der Gerichtshof hat hier eine wichtige Rolle zu spielen.

Der Verfassungsvertrag wurde von einem Konvent ausgearbeitet, jetzt haben wir eine Regierungskonferenz, die nach anderen Methoden arbeitet. Trotzdem, Herr Ratspräsident, größtmögliche Transparenz! Veröffentlichen Sie die Dokumente, die zur Beratung vorgelegt werden, verfolgen Sie mit uns und der Kommission eine Strategie des Dialogs mit der Öffentlichkeit und den Bürgern!

Der so genannte vereinfachte Vertrag wird ja leider ein komplizierter Vertrag werden. Hier braucht man auch eine konsolidierte Fassung vor Ende der Regierungskonferenz, und nicht wie bei Amsterdam erst ein Jahr danach. Wir brauchen bei Abschluss der Konferenz einen lesbaren Text. Vielleicht wäre es auch sinnvoll, diesem Text eine Erklärung beizufügen, in der die Hauptelemente und die wichtigsten Botschaften an die Bürger erklärt werden.

Wir begrüßen natürlich all die Fortschritte. Wir wollen ein wichtiges Etappenziel erreichen, und zwar vor den Europawahlen, damit wir uns im Wahlkampf 2009 auch anderen Themen widmen können. Es liegt also noch harte Arbeit vor uns, aber mit Wille und Engagement muss es gelingen, und das Parlament unterstützt die portugiesische Präsidentschaft.

  Íñigo Méndez de Vigo, en nombre del Grupo PPE-DE. – Señor Presidente, para el Grupo del Partido Popular Europeo (Demócrata-Cristianos) y de los Demócratas Europeos era bueno que el Consejo Europeo llegara a un acuerdo y, por eso, esta mañana, en la resolución que vamos a votar dentro de unos minutos, mi Grupo va a votar favorablemente para que la Conferencia Intergubernamental, de acuerdo con el artículo 48 del Tratado, pueda reunirse.

Pero ahora lo importante es que ese acuerdo, el acuerdo resultante en la Conferencia Intergubernamental, sea bueno. Entiéndaseme bien: nosotros lo que le decimos a la Conferencia es «¡adelante!», pero juzgaremos a la Conferencia Intergubernamental por sus resultados.

Y quiero decir también que para mi Grupo, que estará representado por el señor Brok en esa Conferencia Intergubernamental, será una cuestión política importante el hacerse guardián de la Constitución. Nosotros queremos que el contenido, que la sustancia, que el acuerdo del Consejo Europeo esté presente en el acuerdo final del Tratado resultante después de la Conferencia Intergubernamental.

Una cuestión que ha sido evocada por el señor Sócrates es la de los referenda. Mire -ahora que no nos oye nadie-, déjeme que le diga una cosa: no se fíen de los partidos que están en la oposición y piden referenda. Y no se fíen tampoco de aquéllos que piden referenda para votar que no, porque ésos quieren destruir Europa. Unos quieren destruir al Gobierno de turno y otros, a Europa.

Y, por tanto, me parece que las palabras del señor Sócrates de esta mañana son determinantes. Ningún país puede crear un lío al resto de los países y, en estos momentos, todos tenemos que apuntar en la misma dirección para sacar a Europa del impasse.

Ese primer acuerdo del Consejo Europeo es el primer paso y ahora creo que todos tenemos que ponernos a trabajar, por un lado, en lograr un buen acuerdo y, por otro lado, en empezar, una vez que nos hemos quitado esa hipoteca del impasse constitucional, a trabajar.

Porque a mí lo que me ha preocupado de verdad, señor Presidente, es el clima de recelo, de desconfianza en Europa, que he visto en el último Consejo Europeo. Y eso es algo que debe preocuparnos a todos y algo contra lo que todos tenemos que luchar juntos.

  Richard Corbett, on behalf of the PSE Group. – Mr President, the Socialist Group welcomes the convening of the IGC, accepts the mandate and supports the timetable.

Many people have commented that this mandate salvages some 90% of the content of the Constitutional Treaty, and this has given rise to much comment. But colleagues will also know that recent scientific research demonstrates that human beings and mice are genetically 90% identical. However, the 10% difference is rather important. And so here with this mandate, the 10% difference is rather important.

The loss of the constitutional designation of the Treaty, the failure to change the name of the high representative to foreign minister, the failure to mention in the Treaty the supremacy of Community law, the loss of the symbols and the numerous derogations and opt outs for particular Member States mean that for those Member States the percentage – be it 90 or whatever – is even lower. All these make it a very different treaty that is envisaged than the Constitutional Treaty.

That will be a matter of regret for this House and for a large majority of the Member States. Nonetheless, those changes will make it possible, will make it easier to ratify the Treaty in all 27 Member States, and that is the crucial point that we have to recognise.

  Andrew Duff, on behalf of the ALDE Group. – Mr President, my group welcomes the prospect of a quick and efficient IGC that clears up the ambiguity following the period of reflection, secures legal certainty and builds a strong consensus behind the reform treaty. Of course, it is especially appropriate for Parliament to seek, inside the IGC, to protect what it stood to profit from in the 2004 treaty. But we should also be certain that the growing number and crowd of opt-outs and minimalistic footnotes do not contaminate the integrity of the corpus of European law and the jurisdiction of the courts. We will fight to prevent a political spillover from the UK protocol on the Charter; a multi-tier Council is one thing, but Parliament cannot tolerate first- and second-class citizenship.

We should fight the popular suspicion that the IGC is nothing more than a grand exercise in the obscurantism designed to extricate certain states from pledges to have referenda, and I was very pleased that Prime Minister Sócrates is determined that plebiscites should not be pitched to oppose parliaments. Maximum transparency is desirable and Parliament’s greater role, superior strength and more pluralistic presence inside the IGC will assist to secure such transparency.

  Konrad Szymański, w imieniu grupy UEN. – Panie Przewodniczący! Mam wrażenie, że przynajmniej w przypadku traktatu ten Parlament nie zna bądź nie lubi słowa kompromis. Krytyka mandatów w sprawozdaniu jest w moim przekonaniu głęboko niesprawiedliwa. Mój kraj, Polska, wykazał się w tej dziedzinie wielką elastycznością i wolą kompromisu, dlatego z niepokojem czytam te twardogłowe zapisy sprawozdania, które nie chcą uznać mandatu za oczywisty sukces.

Wbrew zapisom sprawozdania nowe nazewnictwo, symbole europejskie w traktacie, przyniosłyby jedynie nieporozumienia, sugerowałyby, że Unia wchodzi w fazę parapaństwową. Elastyczność mandatu w zakresie opt-out jest wyrazem mądrości, realizmu, nie jest jego słabością. Dotyczy to także Karty praw podstawowych.

Z jedną rzeczą można się na pewno zgodzić - w ciągu nadchodzących dziesięciu lat jest wiele rzeczy, także system głosowania, które trzeba przemyśleć raz jeszcze. Także konferencja międzyrządowa stoi przed podjęciem wyważonych, szczegółowych decyzji w tej sprawie. Bez nich ryzykujemy bowiem impas w zakresie ratyfikacji.

  Johannes Voggenhuber, im Namen der Verts/ALE-Fraktion. – Herr Präsident! Seit dem Europäischen Rat in Brüssel verbreitet sich so etwas wie melancholische Zufriedenheit. Vielleicht ist es ja nur der nahende Urlaub. Tatsächlich: Wenn man das Mandat zu dieser Regierungskonferenz betrachtet, dann ist man versucht zu sagen, Europa ist mit einem blauen Auge davongekommen. Ich fürchte nur, der Schlag ist härter. Es ist nicht das Auge der Staaten, das verdunkelt ist. Argwöhnisch betrachtet und belauert man sich, argwöhnisch betrachtet man seine Souveränität. Es ist die Frage, ob Europa nur ein blaues Auge hat oder ob es auf einem Auge blind ist. Auf dem Auge der Bürger, die nicht mehr sehen können, was der eigentliche Charakter dieser Union ist.

Ja, es ist richtig: Das Mandat sichert die zentralen Errungenschaften der Verfassung. Aber das Mandat verschleiert den wahren Charakter Europas, es verbirgt Europa, es verdunkelt die Idee der europäischen Integration. Herr Barón Crespo, ich glaube nicht, dass es eine Übung in politischem Realismus ist, die wir hier vor uns haben. Wir haben es hier mit einem ganz offen aufflammenden Nationalismus, einer Kleinstaaterei und einer Eigenbrötelei der Regierungen zu tun.

Die Union der Bürgerinnen und Bürger – ist es wirklich nur eine Verpackungsfrage, dass sie verschwunden ist und wir wieder vor einer Union der Staaten stehen? War das die Forderung der Menschen, die in Frankreich und in den Niederlanden Nein gesagt haben? Wo sind deren Forderungen nach einem sozialen Europa und nach mehr Demokratie? Ist das nicht realistisch? Ist das nicht notwendig? Ist das nicht die Aufgabe Europas? In welcher Weise haben wir uns bemüht, diese Verfassung in klarer, verständlicher Sprache, in einem verständlichen Dokument niederzulegen? Die Regierungen haben sich seit Monaten nur ein Ziel gesetzt: einen dunklen, chiffrierten, unverständlichen, unleserlichen Vertrag zu schreiben, den die Bürger nicht lesen sollen!

Nein, es ist kein blaues Auge, das Opting-out aus der Grundrechtecharta, es ist der innerste Kern unseres Selbstverständnisses als Wertegemeinschaft. Es ist unerträglich, dass diese Union sich als eine Wertegemeinschaft bezeichnet und es gleichzeitig zulässt, dass ein Teil ihrer Bürgerschaft davon ausgeschlossen ist!

  Francis Wurtz, au nom du groupe GUE/NGL. – Monsieur le Président, je peux concevoir que les dirigeants de l'Union soient enthousiastes à l'idée de voir ressusciter leur ex-Constitution, fût-elle privée de certains de ses atouts. À cet égard, je rejoins ce que vient de dire M. Voggenhuber. Ce que j'ai plus de mal à comprendre, c'est pourquoi, alors que ces mêmes dirigeants semblent si convaincus de répondre ainsi aux vœux les plus chers de nos concitoyens, ils déploient tant d'efforts pour éviter que les citoyens s'approchent de trop près de cet objet institutionnel non identifié.

Comment interpréter autrement la forme très particulière de démocratie qui caractérise le processus engagé? Un mandat de négociation totalement illisible pour un non-initié, une accélération suspecte du calendrier et, surtout, une peur panique d'éventuels referenda. En leur for intérieur, nos dirigeants se disent sans doute que le fait de changer les mots – constitution, ministre, loi – et de supprimer les références à l'hymne et au drapeau risquerait de peser de peu de poids face aux préoccupations des gens au sujet de l'actuel modèle européen si, d'aventure, ressurgissait un débat public de fond du niveau et de la force de celui qui a secoué une partie de l'Union il y a deux ans, et pour cause!

Dans le futur traité, les structures économiques libérales, qu'elles touchent à la Banque centrale, à la concurrence, au libre-échange, à la circulation des capitaux, resteront pour l'essentiel inchangées. La Charte des droits fondamentaux, on vient d'en parler, non seulement y conservera ses graves lacunes, mais est appelée à avaliser une réalité en contradiction absolue avec son essence même, à avaliser une exception, en l'occurrence, britannique, ou, si vous préférez, le droit à la discrimination, le droit aux privilèges. Enfin, les dispositions nouvelles sur la politique de sécurité et de défense, qui avaient en maints endroits alimenté de nombreuses réserves et craintes, sont toutes reconduites. Il ne faut pas chercher ailleurs la gêne perceptible de nos gouvernements respectifs.

En Espagne et au Luxembourg, ils vont expliquer qu'une nouvelle consultation populaire est superflue du fait que la substance du traité déjà ratifié est entièrement préservée. En France ou en Suède, à l'inverse, le gouvernement avancera qu'un référendum n'est plus pertinent puisque la nature du texte a profondément changé. Quant au Danemark et au Portugal, où un vote des citoyens était programmé, le toilettage cosmétique opéré par rapport au traité de 2004 risque de justifier un lâche renoncement à cette épreuve de vérité. Il n'y a qu'en Irlande que le référendum est, aujourd'hui comme hier, incontournable.

Voilà pourquoi, en respectant pleinement les différences d'opinion et les spécificités nationales, mon groupe va s'engager, avec la même détermination que dans un passé récent, dans un vaste effort d'information, de clarification des enjeux, de confrontation d'idées autour du contenu du futur traité avec, partout, une même exigence démocratique: la consultation effective des citoyennes et des citoyens. Dans quelques jours, la CIG commencera ses travaux mais, au vu de l'expérience, j'ai la conviction que la messe n'est pas dite: à bientôt.

  Bernard Wojciechowski, on behalf of the IND/DEM Group. – Mr President, the new Treaty is a decoy for the implementation of the former constitutional Treaty. The report stresses that the mandate safeguards the substance of the constitutional Treaty. Two nations said ‘no’. It is therefore little more than a sloppy attempt at federalising the Union at any price. It also suggests that Parliament reaffirm its intention to maintain an open dialogue.

This Parliament has become so arrogant that if it were not so pathetic it would be funny. To say that we maintain an open dialogue with anyone is a mere joke. Support for the constitutional Treaty has not increased. Scholars and politicians declare it a complete failure. Any new Treaty ought to consider the following aspects.

Firstly, the final product will have to be ratified in all Member States pursuant to the constitutional provisions, and referendums should be repeated. The attempt to solve the issues of integration over the heads of civil society is unacceptable.

Secondly, the constitutional Treaty embodied a compromise between the Member States and the political systems. The revised Treaty will not go further than the arrangements contained in that Treaty. It will become a dwarfed constitutional Treaty.

Thirdly, the attempt to make another treaty causes a significant delay at this stage of the political reform of the EU. Reform is possible, yet for some reason, it is not pursued. The changes within the first pillar are feasible in the areas provided for by the TEC. The implemented reforms within this procedure may include the intergovernmental area, basically the second and third pillars.

There is a possibility to regulate many issues based on international agreements concluded by the Member States. As far as the third pillar is concerned, the strengthening of the structures of judicial and police cooperation can also be achieved. It is possible to secure the EU’s democratic legitimisation through the holding of public Council meetings, the strengthening of the national parliaments, consultative position and giving this Parliament the power to designate the President of the Commission.

The rush for a new Treaty makes no sense at all. A new document may not be implemented through some back channel. This is against the will of the people. Demands for a legal personality, the single currency or the rotating system in the Commission are extreme, although over the last two years no European nation has expressed such a will.

  Philip Claeys, namens de ITS-Fractie. – Voorzitter, ik kan alleen maar vaststellen dat nu ook dit Parlement in een officieel verslag en in zeer duidelijke bewoordingen toegeeft wat iedereen na de Europese Top van Brussel al kon vaststellen, namelijk dat de Europese grondwet, die door de Nederlandse en Franse kiezers werd verworpen en die daardoor strikt juridisch gezien nooit meer in werking kon treden, via juridisch-politieke kunstgrepen bijna integraal wordt behouden en ingevoerd.

De tactiek van het tersluiks doorvoeren van stukken van die grondwet, die al na het Franse en Nederlandse referendum op tal van wijzen werd gevolgd - denk maar aan het bindend maken van het Handvest van de grondrechten, ofschoon het gaat om een niet-bindende tekst - die tactiek wordt nu ook het officiële Europese beleid. Dit Parlement zou dit Parlement niet zijn als het niet naar aloude gewoonte een onderscheid maakt tussen de zogenaamde "goede" lidstaten, zij die blindelings het federale credo huldigen en de federale weg bewandelen, en de zogenaamde "slechte" lidstaten.

Maar het toppunt van cynisme, collega's, is natuurlijk de oproep van dit Parlement om - en ik citeer letterlijk - "de Europese burgers opnieuw te betrekken bij de voortzetting van het grondwettelijk proces". In werkelijkheid heeft dit Parlement in tal van verslagen, te beginnen met het beruchte verslag-Duff-Voggenhuber, het resultaat van het Franse en Nederlandse referendum van tafel geveegd. Dit Parlement heeft lak aan de wil van de burgers die het beweert te vertegenwoordigen. Dit Parlement begint stilaan de negatie te worden van alles wat met echte democratie te maken heeft.

  Jim Allister (NI). – Mr President, we pretend we are on the side of the people but produce a report which conspicuously avoids support for popular ratification of this recast constitution. Indeed, such is the determination to rush this report through that we abandon due process in this House to a degree that would make a despot blush!

We demand of Member States that they abide by the IGC mandate but declare our unilateral intent to go beyond it by using the European flag and the anthem. We declare our determination immediately we get these constitutional changes through to demand more. This is the elephant trap of this agreement, because it permits self-amendment, which for most will mean never again having to consult the people about whose constitutional status we would make changes.

  Maria da Assunção Esteves (PPE-DE). – A Europa deu um passo em frente na última Cimeira de Junho. Não esmoreceu na crise, não deixou ninguém de fora nesta aventura comum para uma sociedade cosmopolita assente no Direito. É verdade que o consenso é menos fácil numa Europa alargada, mas a Europa é um projecto moral, um projecto da razão, um projecto vencedor. Não há outra via senão a unidade e não há outro destino senão a justiça global.

A Europa vai-se construindo em placas de ajustamento estrutural: o Tratado de Roma e a quebra do mito das fronteiras, o Tratado de Maastricht e a cidadania europeia, o Tratado de Nice e o alargamento, agora o Tratado reformador e a integração política numa democracia de larga escala. O Tratado reformador não nos abre ainda as portas de uma Europa constitucional, ainda nos deixa, em grande medida, numa Europa dos Governos, mas ele põe fim à falácia de raciocinar por contraposição, ao erro de contrapor a Europa dos resultados a uma reforma institucional da Europa.

A Conferência Intergovernamental exigirá boa-fé dos governos, participação dos parlamentos e uma séria política de comunicação. Mas não tenhamos ilusões, não será o referendo que concretiza essa comunicação, não será o referendo que legitima o novo Tratado da União. Em muitos casos o referendo vai ligado à tentação populista que nada tem que ver com a base racional das democracias. A legitimidade da Europa só se constrói sobre um processo político de comunicação contínua, que sobrepõe a política à burocracia, que valoriza o escrutínio dos parlamentos nacionais, que promove o activismo cívico, que reforça as lideranças, que liga a publicidade às instituições e que assenta as suas políticas quotidianas numa cultura de direitos e humanidade. Essa é a Europa legítima.

  Harlem Désir (PSE). – Monsieur le Président, l'Europe ne se réduit pas à ses traités; ses difficultés ne sont pas uniquement, et même pas principalement, de nature institutionnelle, et la relance européenne devra passer par les politiques, par les projets européens, par le budget de l'Union. Mais il est un fait que le blocage de la réforme institutionnelle, l'échec de la ratification de la Constitution dans plusieurs pays, les non-procédures de ratification dans d'autres, ont enlisé l'Europe, l'ont plongée dans la crise et ont éprouvé son unité.

De fait, le compromis passé pour convoquer la Conférence intergouvernementale et le mandat en vue du futur traité modificatif ne soulèvent pas l'enthousiasme. Tout est compliqué dans cet accord, qui contient bon nombre de notes de bas de page, si bien que le futur traité ne sera pas simplifié du tout et sera peu lisible pour les citoyens.

L'opting out qui a été accordé concernant la Charte des droits fondamentaux est véritablement lamentable pour ceux qui l'ont demandé. Au moins cette Charte s'appliquera-t-elle aux vingt-six autres pays de l'Union, et c'est tout à leur honneur. Mais cet accord au moins en est-il un, à un moment où l'Europe avait besoin d'affirmer son unité.

Je crois qu'il faut donner toutes ses chances à la Conférence intergouvernementale et, surtout – et je voudrais réagir sur ce point en particulier aux propos de mon collègue, Francis Wurtz –, le mandat de convocation de la CIG a au moins un mérite: celui de prendre comme base pour ses travaux les innovations institutionnelles qui étaient, pour la plupart, contenues dans la première partie du projet de constitution pour l'Europe. Il s'agit là d'un point décisif puisque celle-ci avait été peu contestée, même par les partisans du non, ceux qui se réclament de la construction d'une Europe en tout cas, dans les pays où s'est tenu le référendum.

Le futur traité devrait ainsi reprendre les éléments qui font consensus pour tous les Européens sincères, qu'ils aient voté oui ou non à la Constitution: renforcement des pouvoirs du Parlement européen et des parlements nationaux, Présidence stable du Conseil, votes à la double majorité, moins de minorités de blocage, moins de décisions soumises à l'unanimité, notamment pour la coopération judiciaire et policière, renforcement de la politique étrangère et de sécurité commune, coopération renforcée et structurée en politique de défense qui sera plus facile à réaliser, nouvelles compétences en matière d'énergie, en matière de climat.

Par ailleurs, il y a aussi deux points qui étaient dans la troisième partie mais que, je crois, tous les progressistes voudront défendre: la clause sociale horizontale et un article permettant de protéger les services d'intérêt économique général et donc d'adopter une directive en faveur des services publics. J'espère que, si la CIG reprend tous ces points, tous les partisans de l'Europe, qu'ils aient voté oui ou non au projet de Constitution, soutiendront le futur projet de traité.

  Anneli Jäätteenmäki (ALDE). – Arvoisa puhemies, otan esille yhden erittäin tärkeän asian. Pyydän, että parlamentin jäsenet kannattaisivat tarkistusta numero yksi, jossa vaaditaan laajentamaan hallitustenvälisen konferenssin toimeksiantoa niin, että siihen sisällytetään Euroopan parlamentin toimipaikan siirtäminen Strasbourgista Brysseliin. Oma ryhmäni on tämän päätöksen takana.

Tämä on pieni, mutta erittäin tärkeä asia. Yksi toimipaikka vahvistaisi EU:n legitimiteettiä. Vuosi sitten yli miljoona ihmistä allekirjoitti vetoomuksen yhden toimipaikan puolesta ja HVK on se paikka, jossa asiasta on keskusteltava ja päätettävä. Parlamentti päättää tänään siitä, haluaako se yhden toimipaikan keskustelun esille vai haluaako se jatkaa kuten aikaisemminkin. Jos kannatamme yhtä toimipaikkaa, äänestämme tarkistuksen numero yksi puolesta.

  Inese Vaidere (UEN). – Godājamie kolēģi! Eiropas Parlamentam kā vienīgajai Eiropas Savienības iestādei, ko ievēl pilsoņi, ir pienākums padarīt saprotamus tās lēmumus. Gribu uzsvērt, ka cēloņi, kāpēc Konstitucionālais līgums tika noraidīts divās dalībvalstīs un bija nepopulārs arī pārējās, nav tikuši pietiekami analizēti. Manuprāt, skepse lielā mērā bija tāpēc, ka pilsoņi vēro lēmumu pieņemšanas koncentrāciju, varas augstprātību un attālināšanos no cilvēka, kā arī pārmērīgu birokrātiju. Šie ir pietiekami iemesli, lai pilsoņi kļūtu par tālākas integrācijas pretiniekiem. Mūsu uzdevums ir iesaistīt pilsoņus lēmumu pieņemšanā, nevis lemt viņu vietā. Jārunā cilvēkiem saprotamā valodā, nevis ierēdņu īpašajos terminos. Starpvaldību konferencei tas ir jāņem vērā. Vienlaikus svarīgi tālāk attīstīt solidaritātes principu lēmumu pieņemšanā, piemēram, ļoti svarīgajā enerģētikas jomā. Ar trešām valstīm mums jārunā vienotā balsī, lai nepieļautu atsevišķu valstu šantāžu. Gribētu uzsvērt, ka neraugoties uz kļūdām un trūkumiem, Eiropas Savienība ir veiksmīgs projekts.

  Gérard Onesta (Verts/ALE). – Monsieur le Président, j'appelle la Commission, d'abord, et le Conseil, surtout, à faire preuve d'un minimum de décence et de modestie dans cette affaire, car le magnifique succès que l'on essaie de nous vendre ici cache mal une régression.

Je passe sur la conduite indigne de certains chefs d'État et de gouvernement, qui ont renié leur parole publique et solennelle, qui sur la Charte, comme M. Blair, qui sur les votes au Conseil, comme les frères Kaczynski. Nous passons d'une Constitution, que nous perdons – les mots ont un sens – une constitution qui est un signal de confiance dans les valeurs et horizons communs, à un traité dit simplifié. Simplifié, quelle vaste blague! Les notes de bas de page sont plus longues que le traité lui-même. C'est donc un signal de défiance mutuelle et généralisée à laquelle nous devons faire face, et les blocages sont nombreux: opting out sur la Charte, ce qui va faire des citoyens de deuxième zone; blocages pour les votes au Conseil jusqu'en 2017 et au-delà avec le compromis de Ioannina; diplomatie certes intégrée, mais aussitôt entravée.

Bien évidemment, il faut donner mandat à cette CIG. Tout plutôt que le traité de Nice, car Nice, c'est la mort. Mais je le dis à ceux qui ont l'Europe honteuse: on ne construit rien de solide sur la défiance, surtout quand elle s'adresse au citoyen, car on ne prend même pas le temps de la concertation, pas le temps de la codécision au Parlement  - ce débat est bâclé -, pas le temps de la validation citoyenne, même pas le temps de la pédagogie. C'est vrai qu'il faut faire vite pour masquer le fait que les politiques ne sont plus sur la table, mais qu'elles sont maintenant sous le tapis. Tout cela, malheureusement, se paiera un jour.

Pour conclure, Monsieur le Président, et parce que gouverner c'est prévoir, face à l'incapacité de la Commission et du Conseil de penser le coup d'après, j'appelle le Parlement au sursaut en confirmant par son vote sa ferme intention d'utiliser son futur pouvoir de modifier le traité pour enfin et vraiment relancer le moteur européen.

  Maciej Marian Giertych (NI). – Panie Przewodniczący! Mamy dziś czarny dzień dla Unii Europejskiej, czarny dzień dla demokracji. Oto elity polityczne Unii, wśród nich członkowie tej izby, Komisja Europejska i rządy państw członkowskich, próbują oszukać swoje własne elektoraty, swoje narody. Mamy udzielić poparcia dla eurokonstytucji, której wyborcy już powiedzieli „nie”.

Hasłem dnia dzisiejszego są słowa Angeli Merkel: użyć innej terminologii bez zmiany istoty prawnej, na przykład w sprawie nazwy traktatu, określeń dla aktów prawnych Unii czy dla ministra spraw zagranicznych Unii. Właśnie to zrobiono.

Dyskutujemy nad dokumentem pod inną nazwą, z innymi sformułowaniami, ale z taką samą zawartością merytoryczną. Chodzi o dokument rzekomo niższej rangi, by tylko nie poddawać go pod referenda, więc chodzi o to, by oszukać własne elektoraty, oszukać własne narody. Prawdziwie czarny dzień - wstyd i hańba.

  Alexander Stubb (PPE-DE). – Mr President, I should like to say to Mr Giertych that I have heard a lot of crap spoken in this House, but that was probably the biggest piece of crap I have ever heard.

I would like to inject a little positivism into this House. It sounds as if we are at some kind of a funeral with the new Treaty. As a matter of fact, I do not think we are we are entering a new phase.

I should like to make three points. Firstly, I fully trust the Portuguese Presidency. I remember doing the pre-Nice Treaty with the Portuguese Presidency, with Mr da Costa and Mr Lourtie. They always do a fantastic job. However, I should like to give them one piece of advice: be a little careful with the Council Secretariat, because the devil lies in the detail and Jean-Claude Piris is very good with detail.

My second point is that I think politics and economics go hand in hand. We have heard today and very often in this House that we want only an economic Union or we want only a political Union. I belong to the category of people who thinks that we need both: we need free and undistorted competition and we also need a political Union, and this Treaty really gives us both. I am not too worried about the opt-outs, because history shows us that any time there has been an opt-out, at the end of the day wisdom wins and people join in.

My final point is that we should look on the bright side. We have to turn the page. We have a Treaty or a draft Treaty on the table. Be positive: use the legal personality that we have, use the qualified majority voting that we have, use the codecision that we have, use the Charter, use the President, use the Foreign Minister. All I am saying today is that this is a new beginning, we have a fantastic Treaty, let us live with it and move on.

  Genowefa Grabowska (PSE). – Panie Przewodniczący! Sprawozdanie, nad którym dyskutujemy, jest dobrym, wyważonym sprawozdaniem. Będę za nim głosowała z pełnym przekonaniem. Sprawozdanie to śle rządom państw członkowskich, parlamentom narodowym, a także obywatelom Unii Europejskiej jasny przekaz: Unia będzie zreformowana, reforma idzie w dobrym kierunku.

Sprawozdanie to jest także próbą przywrócenia zaufania europejskiej opinii publicznej do samej Unii oraz jej instytucji. I właśnie w tym kontekście, w kontekście zaufania, bardzo niepokojąco zabrzmiały głosy niektórych państw członkowskich, które mają zastrzeżenia do mocy wiążącej Karty praw podstawowych. Zastanawiam się, jak rządy te wytłumaczą swoim obywatelom, że nie chcą im pozwolić na korzystanie z podstawowych osiągnięć europejskiej demokracji i nie chcą im dać praw, którymi będą się cieszyć ich unijni sąsiedzi.

Czy opór wobec Karty praw podstawowych ma doprowadzić do nowego podziału w Europie na lepszych i gorszych obywateli? Lepszych, bo korzystających z pełni praw zawartych w Karcie, i gorszych, którzy tych praw nie dostaną. Czy na początku XXI wieku powinniśmy akceptować takie podziały? Ja mówię zdecydowanie nie, zwłaszcza jeśli chcemy mieć, jak proponuje prezydencja portugalska, silniejszą Europę w silniejszym świecie.

  Bogdan Pęk (UEN). – Panie Przewodniczący! To nie jest traktat reformujący. To, z czym mamy do czynienia, to jest traktat klajstrujący. Traktat, który ma zasłaniać prawdę w nim zawartą.

Przy każdej okazji Unia Europejska i koryfeusze zasiadający w tej izbie mówią o uczciwości, mówią o wartościach, na jakich Unia się opiera. Czyż jest we współczesnym świecie, w historii ludzkości większa wartość niż prawda? Nie ma.

Traktat ten jest zaprzeczeniem prawdy, bowiem pod szyldem zmienionego traktatu usiłuje się w sposób megaoszukujący przeforsować traktat konstytucyjny, który został odrzucony przez społeczeństwa. Ta droga prowadzi donikąd.

Panie Przewodniczący, Pan również dzisiaj w tej izbie pokazał, że może Pan odbierać głos tym, którzy się z traktatem nie zgadzają, a swoim kolegom przedłużać czas wystąpień o prawie minutę. To jest właśnie wasza uczciwość.

  Manuel Lobo Antunes, Presidente em exercício do Conselho. Já debatemos esta questão do Tratado durante bastante tempo esta manhã, eu diria desde as 9 da manhã, como foi aqui recordado por um dos senhores deputados, e portanto julgo que as principais observações e comentários estão feitos - certamente muitos deles interessantes -, e dos quais a Presidência portuguesa tirará naturalmente as suas ilações.

Eu fui membro da Convenção Europeia, aliás com vários deputados aqui presentes, e também da Conferência Intergovernamental em 2004. Não vos conto que, de 2004 para cá, tive apreensões, tive até, se calhar, porventura, alguma descrença, mas sempre soube que o motor da Europa era o compromisso e a vontade de avançar. Hoje posso dizer-vos claramente que julgo que essa vontade de avançar, que essa vontade de fazer compromissos, de chegar a acordos está de volta.

Não podíamos falhar no Conselho Europeu, e não falhámos, e com isso demos um sinal inequívoco à Europa, aos cidadãos europeus e ao mundo que este é um projecto de futuro, um projecto que serve os europeus, um projecto que serve o mundo. Poderemos, naturalmente, não estar todos satisfeitos com o mandato que o Conselho Europeu aprovou, mas não tenham quaisquer dúvidas de que este mandato permitirá ter um Tratado com Instituições mais eficientes, com decisões mais democráticas e com respostas mais adequadas aos problemas internos da própria União, mas também aos problemas com que a União se tem de confrontar na sua vertente externa.

Este é e será o mandato que nós necessitávamos. Vamos ter certamente o Tratado pelo qual os cidadãos europeus há muito anseiam. Como o Sr. Primeiro-Ministro de Portugal aqui disse, "temos o mandato, não temos o Tratado" e o mandato que recebemos não é para alterar esse próprio mandato, é para fazer o novo Tratado. Esse é o nosso objectivo e fá-lo-emos com todo o nosso esforço e com toda a nossa convicção.

A meta para termos finalizado o nosso trabalho é Outubro e eu espero, em Outubro, poder anunciar aqui a boa nova de um novo Tratado para a nossa União. Não permitiremos, portanto, faltas de disciplina, como aqui foi sugerido por um dos senhores deputados. Quero também assegurar-vos que o timbre de todas as presidências portuguesas é um timbre de transparência, de comunicação com os cidadãos, de comunicação com as instituições. Continuaremos, naturalmente, a respeitar este timbre e posso assegurar-vos que este é um compromisso da Presidência portuguesa.

Como vos digo, espero, em Outubro, anunciar-vos a boa nova.

  Margot Wallström, Vice-President of the Commission. Mr President, honourable Members, there must be a position between Pangloss and his over-optimism and Eyeore the Donkey thinking that everything is hopeless. It is a very rare thing in politics to get a second life and I am not referring to internet role-playing. Remember that, less than a year ago, the Constitutional Treaty or the idea of having a new treaty was declared dead, on life support or in a coma. And now we are discussing a ratification procedure coming up very soon.

I think that engaging now in a blame game will not help us a bit, and, as a final comment on this debate, I have two things to say. First of all, on the Charter of Fundamental Rights, the European Commission does not like opt-outs. We would have preferred not to have any opt-outs. But what was the real political choice here? It was a weakened charter without legal force or a charter that is legally binding for the EU institutions with an opt-out, or preserving the full text of the charter. Then, I prefer to have a charter which is legally binding, and an opt-out is also an opt-in so this is not cast in stone.

My second comment is that I would like to say that I assume that Members of Parliament do not consider parliamentary ratification less democratically legitimate than referenda.

Some Eurosceptics of course hope that the challenge of informing citizens and engaging citizens about and in such a complex issue as a treaty can be turned into a weapon that can kill further European integration. But I do not think we should allow that.

Also, regardless of what ratification method is chosen by Member States, we are all obliged to inform, to engage, to debate, to discuss with citizens all over Europe and this is what we now have to commit to, to do together, in full cooperation and in a planned manner. This is also how we will contribute from the Commission side. So, I will come back to you very soon with that kind of planning for a proper and democratic and open and transparent ratification procedure.

With that I also wish the Portuguese Presidency all the best with opening the IGC.

  John Attard-Montalto (PSE), in writing. – The last two years relating to the Treaty reform process have not been wasted. The following five steps have been identified and implementation initiated:

1. Following the mandate in June 2006, the German Presidency drew up a report.

2. The European Council agreed to convene an Intergovernmental Conference.

3. As the baton of the Council Presidency is passed to the Portuguese it has now become their priority to draw up a draft Treaty.

4. The IGC is expected to complete its work before the end of this year.

5. Ratification is expected to take place before the European elections in 2009.

In reality, what is happening is a more cautious approach: the constitutional aspect of the treaty has been restructured so as to appease the anti-constitutionality. On the other hand, substantial innovations originally proposed in the Constitutional Treaty have survived; the fact that the EU will have a legal personality being the most important of all.

  Jean-Pierre Audy (PPE-DE). – Lors du dernier conseil européen de juin 2007, les chefs d’Etat et de gouvernement ont trouvé un bon accord pour aller vers une Europe politique. Je regrette que nos amis du Royaume-Uni se soient, une nouvelle fois, singularisés en refusant l’application de la charte des droits fondamentaux ainsi que la totale coopération en matière judicaire et policière. Même s’ils sont conservés au plan matériel, je regrette que les symboles de l’Union (drapeau, hymne et devise), aient disparu du texte officiel car, tout en étant opposé à une Union européenne fédérale en ayant l’intime conviction de la très grande utilité des Nations pour le bien-être des Peuples, je considère qu’il faut des repères aux citoyens pour identifier l’Union politique. Je forme le vœu que nous revenions sur ce point. Enfin, la suppression de la référence au concept de « concurrence libre et non faussée au sein du marché intérieur » permettra, dans une concurrence mondialisée devenue complexe, de mieux utiliser la force de notre Union européenne au service des producteurs et pas seulement des consommateurs. Je salue l’action du président de la République française, monsieur Nicolas Sarkozy, qui a su déployer tout son talent pour une Europe forte et unie.

1. O mandato para a CIG recupera a essência do conteúdo do Tratado rejeitado em

2005.

2. O que as forças que estão na génese da integração capitalista europeia pretendem é

recuperar, com outros contornos, o salto qualitativo federalista, neoliberal e

militarista consubstanciado na rejeitada "Constituição Europeia";

3. Tal significa um profundo desrespeito pela vontade expressa em referendo pelo

povo francês e holandês.

4. Apenas tendo por base o mandato e relativamente às questões institucionais, ao

mesmo tempo que as grandes potências reforçam o seu peso no processo de decisão

da UE, Portugal perde:

- Na ponderação de votos no Conselho;

- Direito de veto;

- Soberania;

- Deputados no Parlamento Europeu;

- Um comissário permanente.

5. O mandato reafirma os fundamentos das políticas neoliberais da UE que integram

as causas que estão na raiz dos graves problemas socioeconómicos com que Portugal

se confronta.

6. O mandato institucionaliza a militarização da UE.

7. Isto é, só o conteúdo do mandato já justificaria a exigência da realização de

referendos nacionais vinculativos sobre a pseudo-nova proposta de Tratado, sendo tão

mais legítima esta exigência quando o que está em causa é a inaceitável imposição do

conteúdo essencial de um Tratado já rejeitado.

  Monica Maria Iacob-Ridzi (PPE-DE), în scris. – Mandatul Consiliului European depăşeşte impasul constituţional în care Uniunea Europeană se află de mai bine de doi ani, dar în acelaşi timp sacrifică unele prevederi esenţiale.

Consiliul European a decis ca simbolurile europene să fie excluse din viitorul tratat; consider acest lucru ca fiind regretabil şi susţin modificarea Regulamentului de procedură al Parlamentului pentru a adopta în mod oficial steagul şi imnul Uniunii Europene. Cetăţenii europeni respectă aceste simboluri, pe care le consideră familiare şi apropiate, după cum indică cel mai recent Eurobarometru. În România, 76% dintre cetăţeni asociază simbolurile UE cu un sentiment de încredere; de aceea, sunt convinsă că steagul Uniunii Europene va fi şi în continuare arborat cu mândrie în ţara mea.

Mandatul defineşte, de asemenea, stabilirea unei noi componenţe a Parlamentului European. Ca singurul organ ales al Uniunii şi cel care este menit să reprezinte cel mai fidel cetăţenii, consider că Parlamentul European trebuie să respecte întru totul principiul proporţionalităţii în desemnarea numărului de europarlamentari din fiecare stat. Reprezentarea fiecărei ţări nu trebuie să fie stabilită prin negocieri politice, ci trebuie să reflecte mărimea populaţiilor statelor membre.

Nu în cele din urmă, consider esenţială includerea clauzei de solidaritate în domeniul energetic. Aceasta va asigura cadrul legislativ pe baza căruia Uniunea Europeană îşi va putea proteja mai bine interesele şi întări independenţa energetică.
