  El Presidente. − El siguiente punto es el debate conjunto sobre

- la declaración de la Vicepresidenta de la Comisión/Alta Representante de la Unión para Asuntos Exteriores y Política de Seguridad referente al informe anual sobre los derechos humanos (2008),

- el informe de Heidi Hautala, en nombre de la Comisión de Asuntos Exteriores, sobre las políticas de la UE en favor de los defensores de los derechos humanos (2009/2199(INI)) (A7-0157/2010),

  Heidi Hautala, esittelijä. − Arvoisa puhemies, haluaisin todella ilmaista iloni tästä keskustelusta, jossa voimme käsitellä laajasti Euroopan unionin ihmisoikeusstrategiaa. Olen erityisen iloinen siitä, että korkea edustaja Ashton on täällä mukana keskustelussa ja esittelee vuosiraportin.

Sitä ennen haluaisin esitellä ulkoasianvaliokunnan mietinnön, jonka tarkoituksena on parantaa ihmisoikeuspuolustajien suojelua. Joka päivä saamme tänne parlamenttiin vetoomuksia ympäri maailmaa siitä, miten voisimme suojella niitä ihmisiä, jotka panevat usein jopa elämänsä likoon sen takia, että he ovat ihmisoikeuksien asialla. Näitä vetoomuksia tulee kaikilta mantereilta. Usein emme voi tarkemmin edes määritellä, mikä on ihmisoikeuspuolustaja, ja on tärkeää, että hyväksymme, että heitä on hyvin monenlaisia: toimittajista lakimiehiin, tavallisiin rohkeisiin naisiin ja miehiin, jotka asettavat omat etunsa sivuun ja ryhtyvät puolustamaan ihmisoikeuksia – useimmiten muiden ihmisoikeuksia.

Minulla oli todella etuoikeus laatia valiokunta-aloitteinen mietintö, koska ensinnäkin ihmisoikeuspuolustajien suojelu on hyvin keskeinen osa ihmisoikeuspolitiikkaa. Ei ole ihmisoikeuspolitiikkaa ellei ole ihmisoikeuspuolustajia.

Toiseksi olen varma, että Euroopan unioni voi tehdä paljon nykyistä enemmän. Parlamentti, korkea edustaja, uusi ulkosuhdehallinto, me kaikki voimme tehdä parempaa yhteistyötä ja vaihtaa tietoa keskenämme. Myös Euroopan unioni voi tehdä parempaa ja tiiviimpää yhteistyötä muiden kansainvälisten toimijoiden kanssa – tässä tarkoitan esimerkiksi Euroopan neuvostoa ja YK:ta ja tietysti lukemattomia kansalaisjärjestöjä, joiden kanssa olemme jatkuvasti yhteydessä.

Täytyy myös todeta, että tämä uusi tilanne Lissabonin sopimuksen myötä antaa meille uusia mahdollisuuksia ja uusia velvoitteita tehdä työmme entistäkin paremmin, jotta ihmisoikeuksia voidaan puolustaa koko maailmassa. Tässä mietinnössä esitetään muutamia ideoita. Ne eivät kaikki ole uusia, mutta haluan painottaa sitä, että on tehty erittäin hyviä ajatuksia, joita ei ole kuitenkaan vielä pantu toimeen kunnolla.

Esimerkiksi kun Tšekki oli unionin puheenjohtajavaltio, tuotiin esiin ajatus siitä, että voitaisiin tukea turvakaupunkiverkoston shelter cities perustamista. Uskon, että tämä on tapa, jossa äärimmäisessä tilanteessa toimivia ihmisoikeuspuolustajia todellakin voidaan auttaa. Olen huomannut tätä mietintöä valmistellessani, että ajatus on herättänyt paljon vastakaikua erilaisissa kansalaisjärjestöissä. Osa heistä jo nyt tänä päivänä tekee tätä turvakaupunkityötä. Uskon kuitenkin, että Euroopan unionin kannattaa paneutua ja satsata tähän nykyistä paljon enemmän.

Toiseksi haluaisin korostaa sitä, että usein vaikeassa tilanteessa toimivan ihmisoikeuspuolustajan on päästävä pois maastaan nopeasti. Vaikka meidän ihmisoikeusihmisemme jäsenvaltioissa ja ulkoministeriömme olisivat hyvinkin halukkaita auttamaan, aina on kuitenkin puhuttava sisäministeriölle. Toivon, että tämä mietintö saa aikaan sen, että jäsenvaltioissa, joissa päätösvalta viisumeista on, harkitaan nykyistä joustavampia ja nopeampia viisuminmyöntämiskäytäntöjä.

Kolmanneksi mietinnössä esitetään, että Euroopan parlamenttiin, tulevaan ulkosuhdehallintoon ja EU:n ulkomailla toimiviin edustustoihin tulisi yhteyshenkilöt, jotka vastaavat ihmisoikeuspuolustajien suojelusta. Tämän korostamiseksi mietinnössä esitetään myös, että myös korkea edustaja, ulkosuhdekomissaarit ja erityisedustajat tapaisivat aktiivisesti ihmisoikeuspuolustajia matkustaessaan. Kaiken tämän tarkoituksena on, että me todellakin lunastaisimme lupauksemme ja velvoitteemme, jotka meille asettavat jo ihmisoikeuksien puolustajia koskevat EU:n suuntaviivat.

  Gabriele Albertini, Autore. − Signor Presidente, onorevoli colleghi, l'articolo 5 della Dichiarazione universale dei diritti dell'uomo sancisce: "Nessun individuo potrà essere sottoposto a tortura o a trattamento o a punizione crudeli, inumani o degradanti". Tale divieto vale per qualsiasi circostanza ed è norma perentoria del diritto internazionale e come tale si applica a tutti gli Stati. Non soltanto la Dichiarazione universale dei diritti dell'uomo, ma anche la Convenzione delle Nazioni Unite e la Convenzione europea perseguono tale protezione dei diritti dell'uomo contro la tortura.

L'Unione europea e i suoi Stati membri prendono molto seriamente tali obblighi. Anche in considerazione della celebrazione della Giornata contro la tortura la settimana prossima, riteniamo che la lotta alla tortura costituisca una priorità assoluta per l'Unione europea. Proprio per rispettare tali importantissimi obblighi giuridici e morali occorre un controllo attento del commercio di materiale destinato ad infliggere tortura o altro trattamento o punizione inumani o degradanti.

L'adozione del regolamento ha rappresentato, al momento della sua adozione, un grande passo avanti, come confermato anche dal relatore speciale delle Nazioni Unite per la lotta alla tortura. Non solo, tale regolamento costituisce un modello in termini di legislazione internazionale in materia. Sfortunatamente, l'applicazione di tale regolamento non è stata esemplare come l'adozione dello stesso: solo sette Stati membri hanno presentato una o più delle relazioni pubbliche annuali previste dall'articolo 13 del regolamento stesso, contenenti informazioni dettagliate sulle autorizzazioni concesse all'importazione e all'esportazione di merci che potrebbero essere utilizzate per la tortura. Tali relazioni costituiscono un elemento imprescindibile per valutare il pieno rispetto del regolamento.

Da un'analisi delle autorizzazioni concesse vengono fuori numerosi quesiti sull'uso finale e sulla destinazione delle merci. Le autorità dirette ad autorizzare le esportazioni debbono pertanto compiere una valutazione politica maggiormente approfondita prima di procedere. Gli Stati membri che hanno egualmente comunicato le informazioni relative alle sanzioni applicabili per la violazione delle disposizioni del regolamento del Consiglio, come previsto dall'articolo 17 dello stesso, non sono molti.

A quasi cinque anni dall'adozione del regolamento, la lista delle merci individuate negli allegati del regolamento deve essere aggiornata. L'uomo può essere molto crudele e talora sembra che l'immaginazione umana su come infliggere sofferenze ad altri sia senza limiti. Quindi è di fondamentale importanza restare al passo con gli sviluppi tecnologici in questo triste ambito.

In ragione di tutto ciò, è giunto il momento di sollevare la questione in seno al Parlamento europeo e di chiedere che l'Unione europea e i suoi Stati membri dimostrino di essere all'altezza degli impegni presi. In qualità di membri del Parlamento europeo è nostro dovere, per mandato democratico, assicurare un operato responsabile delle Istituzioni. È per questo che desideriamo informazioni dettagliate su quanto è stato fino ad ora fatto per un pieno rispetto del regolamento, ma anche per quanto concerne le misure che permettono di migliorare la situazione in futuro.

Accogliamo con favore, come primo passo, la decisione del comitato che sovrintende all'applicazione del regolamento in oggetto alla fine di questo mese. Non dimentichiamo mai che il regolamento (CE) n. 1236/2005 del Consiglio non rappresenta solo belle parole ma è uno strumento fondamentale ed essenziale cui dev'essere data piena applicazione adesso.

  Vital Moreira, Autor. − Senhora Vice-Presidente da Comissão Europeia, Alta Representante da União para os Negócios Estrangeiros, Senhores Deputados, cabe-me justificar, em nome da Comissão de Comércio Internacional deste Parlamento, a pergunta oral conjunta com a Comissão das Relações Internacionais sobre a implementação do Regulamento que proíbe ou condiciona o comércio internacional de produtos ou instrumentos destinados a, ou susceptíveis de, serem utilizados para a aplicação da pena capital, da tortura ou de outros castigos ou práticas cruéis desumanas ou degradantes.

De facto, em 2001, em resposta às preocupações levantadas por governos e organizações não-governamentais sobre a utilização de equipamentos policiais e de segurança para actos de tortura, o Parlamento Europeu aprovou uma resolução instando a Comissão a apresentar uma proposta de legislação europeia que regulasse o comércio de tais artigos.

A Comissão apresentou a sua proposta no ano seguinte, que foi aprovada em 2005, constituindo o Regulamento (CE) n.º 1236, de 27 de Junho desse mesmo ano. O regulamento introduz, pela primeira vez, um controlo vinculativo sobre uma série de equipamentos comummente utilizados em sérias violações dos direitos humanos, mas que não têm sido incluídos nas listas de equipamento militar de dupla utilização ou de exportação estratégica dos Estados-Membros.

Proíbe a exportação e a importação de produtos destinados àquele objectivo, que só podem ter essa utilização, e submete a autorização a exportação e importação dos produtos que podem ter essa utilização. O Regulamento impõe obrigações de informação e de reporte dos Estados-Membros sobre a aplicação das suas normas. O Regulamento de 2005 representa, como já foi dito, um notável avanço na defesa dos direitos humanos mais essenciais, designadamente da vida humana e da integridade pessoal, que integram o cerne da Carta dos Direitos Fundamentais da União Europeia, bem como de instrumentos e de convenções internacionais de direitos humanos, tanto das Nações Unidas quanto do Conselho da Europa.

A entrada em vigor do Regulamento foi aplaudida por organizações especialistas em direitos humanos e, como já foi referido, o relator especial das Nações Unidas para a tortura saudou o regulamento como um importante marco na luta contra a tortura e como modelo que pode ser seguido por países noutras regiões.

Mas, caros Colegas, de que vale um regulamento desta natureza se ele não for apropriadamente aplicado? E como podemos nós saber sequer se ele está a ser devidamente implementado se os Estados-Membros, que são responsáveis pela sua implementação, não apresentam os relatórios sobre os seus resultados, tal como é imposto pelo Regulamento?

Na verdade, é profundamente frustrante saber que somente sete países forneceram informação sobre as decisões de licenciamento dos artigos abrangidos. E mesmo alguns dos relatórios contêm informação insuficiente para permitir uma análise responsável da situação. Não podemos continuar a admitir que Estados-Membros da União Europeia continuem a consentir ou a fechar os olhos ao fabrico e ao comércio internacional dos produtos proibidos ou condicionados pelo Regulamento.

Em primeiro lugar, os Estados-Membros devem ser explicitamente instados a cumprir integralmente as suas obrigações, tal como previstas no Regulamento, e a apresentar atempadamente relatórios públicos anuais sobre a sua actividade, fornecendo informação pormenorizada que permita um escrutínio público apropriado, incluindo nesses relatórios como o mínimo exigível o seguinte: o número de requerimentos de exportação ou de importação recebidos, os itens incluídos e os países de destino para cada requerimento, bem como as decisões tomadas em cada caso, o relatório de não-actividade, se for caso disso.

Seria ainda interessante saber mais sobre que medidas foram tomadas ou estão previstas para casos de violação do Regulamento por parte dos operadores comerciais. Porque sem a adequada punição não existe obviamente cumprimento do Regulamento. Existem, finalmente, razões para actualizar e introduzir procedimentos mais regulares para a revisão do próprio Regulamento e, em particular, dos seus anexos.

Senhores Deputados, este Regulamento é a prova de que a protecção dos direitos humanos pode exigir a proibição ou restrição de trocas comerciais de certos produtos. O comércio livre não pode, decididamente, valer para instrumentos de morte ou de tortura. Vamos, por isso, levá-lo à prática seriamente para que ele possa ser o modelo que foi pensado para ser para a União e também para outros países fora da União Europeia.

  Catherine Ashton, Vice-President of the Commission/High Representative. − Mr President, I am extremely pleased to have the opportunity to discuss human rights in this House. On many occasions, the House has stated its commitment to this subject. It is a commitment that I fully share.

For the European Union, human rights matter. They are at the core of our identity and they are at the heart of what we do around the world. Our own history of entrenching human rights, democracy and the rule of law across 27 Member States is a success story and acts as a source of inspiration to others. So it is logical that we have developed a strong set of mechanisms for promoting these values in different contexts – as the report on human rights and democracy in the world sets out.

To give just one example, over the last 18 months we have provided EUR 235 million in funding for 900 NGO projects in 100 countries. This work is extremely important and it must continue.

But we are not the only actor and ours is not the only economic and political success story. Therefore, as the world changes, we also need to make sure that we ask ourselves what we could do better.

While human rights are universal, a ‘one size fits all’ approach does not work. That does not mean we should change the message on the importance of human rights, but there is room to be smarter in how we deliver it. We will make most progress if we approach the human rights agenda in a focused and realistic way. We need to target our efforts, tackling each case based on a detailed understanding of the country at hand.

We also need a sharper focus on results. Previous resolutions of this House have called for more information to better assess the effectiveness of our policies. I share your concern. We must judge our efforts by outcomes, even if our contributions to improving human rights situations are an investment over the long term.

The work of the Human Rights Subcommittee and its Chair, Mrs Hautala, on human rights defenders is an extremely good example of this and I very much welcome the report and its findings and pay tribute to those who have worked so hard on it.

Let me address some specific aspects by making clear that I will continue to meet civil society actors and human rights defenders, both in Brussels and abroad, as I have done in Gaza, in China and, most recently, in Brussels. I expect colleagues in delegations and here in Brussels to do the same.

A good example of being smart and well-organised has been our work on promoting the ratification of the Rome Statute in the run up to the Kampala conference this year. We have worked with specific countries, offering EU support, at delegation and headquarters levels, working with Member States and the EU Presidency.

To name just one success story, when I visited the Seychelles last month, I discussed a range of issues on which they and the EU could strengthen our cooperation, with piracy as a top priority. I also raised the ICC and encouraged the President, Mr Michel, to submit the ratification bill to Parliament. Upon my return to Brussels, I was pleased to receive a letter confirming that the Government has now launched this process.

Looking ahead, I want to see what more we can do to support the abolition of the death penalty worldwide. I want to assure this House that work on abolishing the death penalty is a personal priority for me. I will see to it that work advances, both bilaterally and in multilateral fora, beginning with the United Nations in September.

As this House knows, the promise of the Lisbon Treaty is a more coherent, more consistent and hence more effective EU foreign policy. This is also a chance for our work on human rights, democracy and the rule of law. These will run like a silver thread through everything that we do externally. The External Action Service, once in place, will give us the chance to realise our potential and strengthen our ability to speak with one voice. With its integrated structure, the new Service should help to ensure that human rights issues are reflected in all areas of our external action, including CSDP, development and trade.

In this respect, let me refer to the oral question on trade in goods used for torture. The EU takes its commitment to the fight against torture very seriously. Any shortcomings in the implementation of Regulation (EC) No 1236/2005 must – and will – be addressed. In that spirit, we have invited Amnesty International and the Omega Research Foundation to present their findings to a meeting later this month of the Regulatory Committee with our Member States.

On human rights, as in other areas, we have to pull together. We need the continued commitment of Member States, of this House and of the other EU institutions. We need to review the work we do regularly and to make sure that we get the best use of all available instruments – from human rights dialogues to EU guidelines, from the European Instrument for Democracy and Human Rights to our bilateral assistance and our actions in multilateral fora.

Revisiting our overall EU human rights strategy could be a useful exercise, and I intend to launch a consultation process to inform the development of a new human rights strategy this year.

Honourable Members, dear friends, Eleanor Roosevelt used to say, ‘It is better to light a candle than curse the darkness’. This is valid for our human rights policy too. In the European Union we have many tools to help make the world a better place. We need to mobilise and connect them better. That is what I want to do, maximising the potential of the new Lisbon set-up and continuing to count on your vital support.

  László Tőkés, on behalf of the PPE Group. – Mr President, as shadow rapporteur on behalf of the PPE Group, and also as my group’s coordinator for the Subcommittee on Human Rights, first of all I would like to thank Ms Hautala for her great work on this report. As the votes in the Human Rights Subcommittee showed in April, the report enjoys great support across different groups, as the issue of protection of human rights remains of joint interest to us all. We reached good compromises, taking into account the different points of view.

The EU has already worked out mechanisms and tools of great value so, as I have already emphasised in previous discussions, we have to make sure that we achieve better implementation of the existing guidelines, with the evaluation of existing policies developing more effective protection.

Finally, I strongly encourage Member States to show stronger political will to support the action of human rights defenders, as the report highlights. With the Lisbon Treaty in place, it is important that the protection and security of human rights defenders be made a priority issue in the EU relationship with third countries and integrated at all levels of the Union’s foreign policy, in order to increase the coherence, effectiveness and credibility of the EU’s support for human rights.

  Véronique De Keyser, au nom du groupe S&D. – Monsieur le Président, l'Union européenne suscite beaucoup d'espoir dans les pays qui nous entourent, car elle continue à incarner les droits de l'homme. Mais trop souvent cet espoir est déçu car peu de résultats concrets viennent étayer nos discours généreux. Or, on sait que les droits de l'homme ne s'imposent pas par la force, et que c'est uniquement et avec le temps, à travers des politiques cohérentes s'appuyant sur des sociétés civiles et sur des forces démocratiques émergentes, que l'on peut faire changer les droits de l'homme dans le monde, en particulier quand les régimes politiques sont corrompus ou dictatoriaux.

Or, l'Europe s'est dotée d'un merveilleux instrument, à savoir l'instrument d'observation électorale dans le cadre du BIDDH. Mais ce que nous constatons, nous qui participons aux observations électorales, c'est que, dans de trop nombreux cas, les élections sont déclarées largement défaillantes ou frauduleuses, sans entraîner nécessairement, de la part du Conseil ou des politiques européennes, une réaction coordonnée et audible.

Et finalement, quand des politiciens commettent des fraudes, ils font le gros dos après la période post électorale et répriment assez durement la population. Cela finit par passer et, assez paradoxalement, avec le temps nous finissons par légitimer, par lassitude, des régimes qui sont corrompus, ce qui est effectivement un effet pervers de nos instruments.

Alors, Madame Ashton, avez-vous l'intention – et nous soutenons cet instrument, je le répète – d'avoir une stratégie de réponse qui soit un petit peu plus audible, lorsqu'effectivement on se trouve face à ces cas. Je n'ai pas voulu citer d'exemple, mais ils sont, hélas, très nombreux.

  Метин Казак, от името на групата ALDE. – Как да се ограничи и да се регулира търговията със средства за изтезание и нехуманно наказание е проблем, който буди безпокойство в няколко парламентарни комисии. Като либерал аз съм убеден, че коректни и партньорски търговски и икономически взаимоотношения не могат да се градят, ако човешките права и свободи се пренебрегвани.

Откъде идва безпокойството на тези две комисии? Списъкът със средствата за изтезания не е обстоен. Трябва не просто да се актуализира, а да се изготви подробен списък по ясни критерии кои стоки следва безусловно да се забранят и разпространението на кои от тях трябва да се контролира. Редица страни членки са пропускали да предоставят годишни доклади как изпълняват задълженията си по регламента. Други страни не са предоставили информация за налагане на санкции в случаи на нарушение на разпоредбите на регламента.

И ако досега е липсвала политическа воля, то вече няма извинение за неспазването на задълженията в сферата на тази търговия. Затова с резолюцията, която подготвихме, настояваме Комисията да публикува подробен доклад за търговията със стоки за изтезание. Европейският парламент очаква засилени мерки за контрол върху производството и разпространението, както и за регулиране на международната търговия с такива стоки, което е неделима част от ангажимента ни към зачитането на правата на човека.

  Barbara Lochbihler, im Namen der Verts/ALE-Fraktion. – Herr Präsident, Hohe Vertreterin/Vizepräsidentin der Kommission! Es ist erklärte Politik der EU, den Kampf gegen die Folter weltweit zu führen, und durch die Umsetzung der EU-Anti-Folter-Leitlinie oder durch das EU-Exportverbot für Folterinstrumente wird dafür auch viel getan.

Aber es brauchte einen NGO-Bericht, um die Kommission und das Parlament darauf aufmerksam zu machen, dass dieses Exportverbot Schlupflöcher hat, die sofort geschlossen werden müssen. Wie? Dazu finden sich genügend Vorschläge in der Entschließung, über die wir morgen abstimmen werden. Völlig unverständlich ist aber, dass in der Entschließung darauf verzichtet wird, einzelne EU-Staaten beim Namen zu nennen, die entweder noch keinen Bericht abgegeben haben oder bei denen die Nichteinhaltung des Exportverbots nachgewiesen wurde.

Im aktuellen EU-Menschenrechtsbericht von Lady Ashton heißt es, dass zunehmend von außen betrachtet wird, wie die EU selbst mit Menschenrechtsschutznormen umgeht. Das ist richtig, und das ist verständlich. Wir müssen konsequent und selbstkritisch Menschenrechtspolitik betreiben, und es darf nicht das erste Ziel der Politik sein, vor allem die eigene Region in gutem Licht erscheinen zu lassen, wenn wir denn glaubwürdig bleiben wollen.

  Charles Tannock, on behalf of the ECR Group. – Mr President, history teaches us that usually countries with the highest standards of human rights are also the most prosperous and peaceful. We should therefore be proud of what the EU has achieved in this respect, but those achievements compel us to redouble our efforts to promote human rights around the world.

We are currently faced with many egregious examples of wanton disregard of human rights. Take the case of Iran, where adulterers, homosexuals, religious minorities, political dissidents and even minors are regularly executed. Look at North Korea, where isolation means we can only surmise what horrific abuses are actually taking place there in their concentration camps, particularly for those attempting to flee that brutal Stalinist nightmare. Consider Burma, where the military junta terrorises the population, and Venezuela, whose leader Hugo Chávez has systematically stifled political dissent and closed down the media.

Closer to home, the award last year of Parliament’s Sakharov Prize to Russian human rights defenders underlines our concerns about that country, where impunity still prevails, particularly in the investigation of murdered journalists. And what exactly does their army get up to in the North Caucasus? We do not really know.

Of course, human rights cannot, and must not, be the sole arbiter of the EU’s relations with third countries. The People’s Republic of China, for example, enjoys a growing economic and strategic relationship with the Union, but continues to brutally suppress fundamental freedoms and even censors the internet. We have similar links to Saudi Arabia, where alcoholics are beheaded, and Pakistan, which bans the Ahmadi Muslims.

We need to be realistic about what we can actually achieve, but we should never stop trying to convince others of the virtues of our democratic values that have served us so well and are the universal sign of a civilised society. Prohibiting the trade in instruments that can be used exclusively for torture is one very useful action that the EU can take in demonstrating that we do take this issue very seriously indeed.

  Marie-Christine Vergiat, au nom du groupe GUE/NGL. – Monsieur le Président, les défenseurs des droits de l'homme se reconnaissent avant tout par ce qu'ils font. Ce sont tous ceux et toutes celles qui, souvent au péril de leur vie, se battent partout à travers le monde pour mettre en œuvre, faire vivre et défendre tous les droits tels qu'ils résultent de la Déclaration universelle des droits de l'homme et des textes qui l'ont complétée.

Je me reconnais pleinement dans cette phrase du rapport. Oui, notre conception des droits de l'homme doit être celle des Nations unies, c'est-à-dire que nous devons défendre une conception universelle et indivisible des droits de l'homme. Universelle, c'est-à-dire partout à travers le monde, indivisible, c'est-à-dire que tous les droits de l'homme doivent être défendus à égalité, sans les opposer les uns aux autres, qu'il s'agisse des droits civils et politiques, des droits économiques et sociaux, des droits environnementaux et des droits culturels.

L'Union européenne a mis en œuvre un certain nombre d'instruments dans ce domaine, et je me félicite que le rapport les passe au crible, y compris au regard des nouvelles compétences du Parlement dans ce domaine. Je voudrais donc remercier Mme Hautala pour la qualité de son rapport et la façon dont elle a accepté de travailler avec nous.

Ce rapport est assez critique vis-à-vis de la politique de l'Union européenne. Nous savons tous qu'entre les discours et les actes, il reste beaucoup à faire. Trop souvent, les intérêts économiques et diplomatiques passent avant les droits de l'homme, et ses défenseurs sont les premières victimes de ces ambiguïtés. La politique de l'Union européenne, tout comme celle de ses États membres, est souvent à géométrie variable. Pour la militante des droits de l'homme que je suis, cela reste insupportable.

Avec ce rapport, au-delà de la condamnation de toutes les violences dont sont victimes les défenseurs des droits de l'homme, nous esquissons un certain nombre de pistes qu'il nous faudra construire étape par étape pour que l'Union européenne renforce sa crédibilité sans aucune instrumentalisation.

Oui, Madame Ashton, nous avons beaucoup à faire dans ce domaine. Le débat précédent nous l'a montré, comme celui, demain après-midi, sur la Libye nous le montrera, comme aussi la politique qui sera retenue en matière de ventes d'instruments de torture effectuées par un certain nombre de pays européens.

  David Campbell Bannerman, on behalf of the EFD Group. – Mr President, I have no doubt that all of us here are in favour of human rights. Indeed, many of these are rooted in the finest traditions of English laws – such as Magna Carta of 1215, which outlawed arbitrary imprisonment, and the work of the British lawyers who wrote much of the European Convention on Human Rights after the war.

But it seems that a worthy agenda of human rights has now been hijacked by greedy lawyers and political opportunists. Over the water from the UK, here in Strasbourg, sits the European Court of Human Rights. Now its Committee of Ministers has ruled that Britain must overturn its ban on allowing prisoners to vote because it violates the human rights of prisoners.

But are human rights not meant to protect decent, law-abiding citizens, not terrorists, hijackers, murderers and law-breakers? Is it really any court’s job to ask us, as politicians, to seek votes from the likes of Ian Huntley, the paedophile who murdered two little girls in Soham, in my constituency? Is it justice to seek his approval? Is it right to knock on the cell door of Rose West, a serial killer, securing her support? And what of Abu Qatada, Bin Laden’s right-hand man in Europe? Who will he be voting for? Possibly the Liberal Democrats, because they support this nonsense!

Yet, seriously, these large prison populations could swing marginal votes, especially at the local level. So there should be no equivalence of rights between decent, law-abiding citizens and those of murderers and criminals. They forfeited their right to participate in the political process when they took other people’s lives, other people’s rights and other people’s property. What about the rights of victims? What about human responsibilities rather than just rights? Like the euro, I believe the currency of human rights is rapidly being debased. We need a return to good common sense.

  Nicole Sinclaire (NI). - Mr President, as the rapporteur points out, under the terms of the United Nations Charter every Member State has a responsibility to ensure that respect for human rights is universal. The European Convention on Human Rights, however, seems to think differently, as it bestows special rights on some at the expense of others. The special rights, for example, bestowed on travellers have meant that in the UK, in my own West Midlands constituency, local people have seen their own rights eroded.

With the protection of the Convention, so-called travellers can build on land that our people have nurtured and set aside for future generations to enjoy. This is known as greenbelt land. With the protection of the Convention, travellers enjoy special privileges in health care and education, services built up at great expenses by successive generations.

In my local community, citizens are mounting 24-hour vigils in wind and rain in order to ensure that travellers comply with legal obligations. They are prepared to lie down in the road at great personal risk in order to stop convoys of lorries from delivering concrete and asphalt. These are hardworking, law-abiding citizens who only want to protect their own rights and those of their families. Thanks to the Convention, we now have to fight for those rights in the fields and lanes of rural England.

I agree with the rapporteur. We must pay tribute to the defenders of human rights wherever they may be, in Iran, in Gaza, in Cyprus – or, thanks to the Convention, in the English countryside. This may seem trivial when compared to the plight of so many people in the world, but the point I am trying to make is that human rights are in danger everywhere; rights that were so hard fought in our own land are as precious to us as they are to anyone else.

  Andrzej Grzyb (PPE). - Panie Przewodniczący! Parlament Europejski i my jako posłowie przywiązujemy ogromną wagę do praw człowieka i ich przestrzegania. To ważny składnik również polityki międzynarodowej, w szczególności teraz z nowymi kompetencjami i zapisami traktatu z Lizbony. Sprawozdania, które przedstawili sprawozdawcy, to ważne dokumenty, jednak nie do wszystkich można się odnieść w krótkim wystąpieniu. Mamy wielu partnerów w Unii, w Radzie Europy, w ONZ, wśród rzeczników praw człowieka i obrońców praw człowieka.

Chciałbym po pierwsze wyrazić zadowolenie, że prowadzony jest dialog w zakresie praw człowieka. Nie zawsze przynosi on szybkie i dobre rezultaty. W szczególności zaś, jeżeli dotyczy to właśnie polityki sąsiedztwa i również krajów partnerstwa wschodniego. W moim przekonaniu, i jest to apel również do pani Ashton oraz do pana komisarza Füle, powinniśmy stworzyć jak najwięcej zachęt oraz środków, aby promować prawa człowieka.

Zgadzam się z tym co powiedziała pani Wysoka Przedstawiciel, że powinniśmy być inteligentni w przekazie, a wszelkie naruszenia praw człowieka powinny spotykać się z reakcją czy to polityczną czy również z gospodarczą. Powinniśmy wspierać obrońców praw człowieka. To było między innymi w sprawozdaniu pani Heidi Hautala. Pragnę wyrazić nadzieję, że przyznawana przez Parlament Europejski nagroda Sacharowa dla obrońców praw człowieka będzie skutkowała tym, że będą oni wspierani przez wszystkie instytucje Unii Europejskiej, aby dużo lepiej wykorzystać sieć tych laureatów. Ostatnio odbywał się szczyt Unia - Rosja. W tym samym czasie demonstranci w Rosji (w Petersburgu i w Moskwie) protestowali przeciwko łamaniu prawa do zgromadzeń. Nie było ze strony Unii w tym samym czasie reakcji, a między innymi jednym z apelujących do nas w tej sprawie był laureat nagrody Sacharowa.

Powołujemy nową Służbę Działań Zewnętrznych. Wpiszmy w jej działanie od samego początku wszystkie sprawy, które dotyczą praw człowieka. Na pewno dużo lepiej będziemy wykorzystywali wszystkie instrumenty, które możemy w tej sprawie wyłożyć jako Unia Europejska.

  Vittorio Prodi (S&D). - Signor Presidente, onorevoli colleghi, signora Vicepresidente Ashton, i difensori dei diritti umani svolgono un ruolo cruciale in tutto il mondo mettendo spesso a repentaglio la loro stessa vita. Il rispetto dei diritti umani è uno dei valori fondanti dell'Unione europea e da sempre è collocato alla base della sua costruzione. Ecco perché è importante mantenere sempre alta l'attenzione sul rispetto di questi diritti nel loro complesso.

In tal senso, è cruciale il lavoro svolto in Parlamento su questo tema e per questo ringrazio la collega relatrice Heidi Hautala per l'ottima relazione alla quale il Gruppo dei socialisti e democratici ha contribuito in maniera determinante e costruttiva. Il nostro sguardo, infatti, deve andare oltre. Io credo sia il momento di assumerci una chiara responsabilità, cioè quella di iniziare a trattare il rispetto dei diritti umani come un fenomeno complesso che oggi ci impone di dar loro un'accezione più alta e più completa. Sono fermamente convinto, signor Presidente, che i diritti fondamentali dovrebbero includere il diritto di un equo accesso alle risorse naturali, all'acqua come al cibo, il diritto alle cure sanitarie, il diritto all'istruzione e il diritto di accesso all'informazione.

Con l'entrata in vigore del trattato di Lisbona, poi, ritengo sia doveroso sfruttare al meglio il nuovo Servizio di azione esterna comprendendo al suo interno anche strutture e figure votate al rispetto dei diritti umani. Già la signora Ashton stamattina ne accennava a proposito della Federazione russa e dei rapporti con questa. Sfide, queste, che sono spesso sottovalutate, ma che affrontiamo quotidianamente. Sfide nelle quali l'Unione europea può e deve continuare a svolgere un ruolo da protagonista assoluto sulla scena mondiale.

  Kristiina Ojuland (ALDE). - Ma tahaksin alustada ka tänusõnadega leedi Ashtonile, kes on seni seisnud inimõiguste kaitsel ja ka täna oma sissejuhatavas sõnavõtus võttis väga selge seisukoha. Meie kolleegi Heidi Hautala koostatud raportis on juhitud tähelepanu väga olulisele aspektile. Nimelt on raportis märgitud, et inimõiguste klauslit sisaldavad kaubanduslepingud annaksid Euroopa Liidule võimaluse nõuda kaubandustingimustena inimõiguste austamist.

Et inimõiguste temaatika ei jääks tühjasõnaliseks retoorikaks, peab Euroopa Liit oluliselt suurendama oma poliitikate sidusust ning suunama ka liikmesriike koordineerima oma poliitikaid kolmandate riikide suhtes. Meie kasutada on majanduslikud ja kaubanduslikud hoovad, mida saame tingimuslikkust kasutades rakendada inimõiguste olukorra parandamiseks maailmas. Ühtlustamata poliitikad lubavad inimõigusi mitteaustavatel riikidel bilateraalsete suhete kaudu üksikute liikmesriikidega oma huvisid ellu viia, hoolimata riikideülesest pühendumisest inimõiguste kaitsmisele, ning õõnestavad meie ühiseid jõupingutusi.

Ükski riiklik majanduslik erihuvi ei tohi olla tähtsam väärtusest, mida Euroopa Liit tervikuna esindab. Seetõttu palun, et kõrge esindaja annaks parlamendile ka edaspidi ülevaate, milliseid samme ta näeb ette Euroopa Liidu liikmesriikide vastavate poliitikate...   Ryszard Czarnecki (ECR). - Pani Przewodnicząca! Inteligencja przekazu – jak to Pani powiedziała – nie obejmuje double standards, nie obejmuje podwójnych standardów.

Jest rzeczą niepokojącą, że my, jako Unia Europejska, ale może nawet nie Parlament Europejski, a bardziej Rada i Komisja często przykładają różną miarę do tych samych problemów. Gdy łamane są prawa człowieka w krajach mniej interesujących w wymiarze biznesowym, ekonomicznym z punktu widzenia największych państw Unii Europejskiej, wówczas prawa człowieka w tych krajach są dla nas absolutnym priorytetem. Ale gdy prawa człowieka łamane są w krajach interesujących z punktu widzenia wielkiego przemysłu, biznesu, największych krajów Unii, wówczas nagle ten głos Unii staje się dużo cichszy, dużo mniej wyraźny. To są podwójne standardy, tego należy absolutnie unikać.

  Laima Liucija Andrikienė (PPE). - Mr President, let me first emphasise that the report on human rights and democracy in the world is very important and long awaited. It covers the most important human rights issues. However, the major problem remains that the report merely describes the actions of the EU. The European Parliament has more than once expressed a recommendation that the Council should develop indicators and clear benchmarks, which has been mentioned by the Vice-President of the Commission in order to measure the effectiveness of the European Union’s human rights policies.

Another issue I would like to mention today is the European Parliament’s access to Council and Commission information and relevant documents, which has been limited so far, and, despite several Parliaments’ recommendations on this issue, the situation has not improved. Let me take as an example human rights dialogues which are carried with the authorities of the relevant countries. Recently the Council held a round of human rights talks with Russia. We are well aware of the situation of human rights in Russia: the continued killing of journalists, the climate of lawlessness, governmental toughness in dealing with the so-called terrorists in North Caucasus and so on, but what we would like to know is: what was the reaction of the Russians who were present at the human rights dialogue, and are they going to take any action on this? I know my time has finished, but just let me say that I fully understand that human rights fall under the common foreign and security policy but, nevertheless, human rights issues cannot be top secret...

  Richard Howitt (S&D). - Mr President, first can I pay tribute to my friend and colleague Mrs Hautala for her report on human rights defenders and also for the excellent way she chairs our human rights subcommittee.

I also want to welcome in this debate the annual human rights report and the painstaking work that is carried out at different levels in good faith for this European Union to honour our human rights obligations.

I welcome the growing number and importance of our human rights dialogues with third countries reflected in the report, but the dialogues, like the report itself, cannot be an end in themselves.

That is why I want to acknowledge the discussions that High Representative Ashton is having with us about how human rights are integrated and mainstreamed to the new external action service. It will be a crucial test of whether we mean what we say.

I want to place on record that we are discussing ideas such as maintaining a horizontal human rights directorate, vesting human rights responsibility at Assistant Secretary-General level as well as maintaining human rights desks in each geographic directorate and in every EU delegation worldwide.

Some of these may be contained in the legal decision and declaration, others may come later, and I do not want to contribute towards any further delay, but, as this Parliament learnt when it wound up its human rights subcommittee only to have to reappoint it, mainstreaming human rights is more easily said than done.

So, when the High Representative commits herself to mainstreaming human rights, I am absolutely sure her commitment is sincere, but in calling it a silver thread running through her new service, this Parliament wants to work with her to ensure it is a thread which does not work loose or get hidden inside the hem.

  Marietje Schaake (ALDE). - Mr President, I would also like to pay tribute to the colleagues we work on human rights with. It is a really pleasant collaboration on such an important topic.

There can hardly be a more urgent moment to address Europe’s responsibility when it comes to human rights in the world. I just want to stress that we, as Members of the European Parliament from all political groups, have just launched a written declaration on behalf of the European people to support the Iranian people and their call for human rights. We have just met with Nazanin Afshin-Jam, who is a human rights leader who focuses on ending child executions. This is just one reminder of the brutal things people do to each other and the practices we really have to stop.

The External Action Service will lead to a more effective and coordinated European foreign policy, and human rights deserve ongoing attention in an integrated, comprehensive manner. Unfortunately, we have a sad competition of geographical areas where human rights violations take place, as well as horizontal issues – such as women’s rights and freedom of expression – that need attention because they are being violated.

Iran’s regime serves as an example of all these violations. Iran is on our political agendas but the international community is mainly preoccupied with the nuclear challenge. As challenging as this is, we cannot allow this to be a zero-sum game versus human rights. Sanctions will be imposed by the UN and the European Union but I am not necessarily optimistic about the concrete results that these will render. Empowering the population and standing up for their rights as autonomously legitimate may also render bottom-up reforms. Domestic opposition thus far seems to move the Iranian regime more than international sanctions, so this is a clear indicator.

This week it has been one year since the presidential elections took place in Iran, and they mark the beginning of a renewed and brutal crack down by the regime against its own people. Over the past year the regime has cut off the minimal freedoms that the population still had and has virtually silenced the opposition. Many have fled and they could have an opportunity if they could be taken into Europe as human rights defenders and dissidents. They could be considered an asset in developing our policies and should not just be seen as a threat or a burden. So I would like to encourage you, High Representative…

  Marek Henryk Migalski (ECR). - Bardzo się cieszę, że pani Ashton została na sali, jest obecna, bo traktuję to jako wyraz zainteresowania kwestiami praw człowieka. Rzeczywiście jest tak, że różnimy się w Europie w sprawach geopolitycznych, społecznych, politycznych, ale w kwestiach praw człowieka powinniśmy mówić jednym głosem, pomimo różnic wynikających z naszej przynależności narodowej czy z naszej przynależności partyjnej. I to powinno nas łączyć.

Natomiast pewną kuriozalną sytuacją jest to, że nie jesteśmy w stanie obronić, czy chronić nawet tych, którym przyznajemy nagrody. Laureat Nagrody im. Sacharowa z 2006 r. – Aleksander Milinkiewicz – jest dzisiaj atakowany i represjonowany w swoim kraju. Laureaci Nagrody im. Sacharowa z zeszłego roku: Oleg Orłow i Ludmiła Aleksiejewa także są atakowani i represjonowani przez władze swojego kraju.

Apeluję do pani komisarz i do nas wszystkich, ale przede wszystkim do pani komisarz, o ochronę wszystkich obrońców praw człowieka, ze szczególnym uwzględnieniem tych, których uhonorowaliśmy naszymi nagrodami.

  Filip Kaczmarek (PPE). - Często zachęcamy do obrony praw człowieka, uznajemy je bowiem za uniwersalne i przypisane wszystkim ludziom. Tym samym nigdy nie możemy zaprzestać promowania praw człowieka na świecie. Powinniśmy jednak pamiętać, że wzywając do działań na rzecz praw człowieka w krajach, w których są one łamane, bierzemy również na siebie pewną odpowiedzialność, odpowiedzialność za los dzielnych i dobrych ludzi, których nazywamy obrońcami praw człowieka.

Obrońcy praw człowieka czasami sami stają się ofiarami łamania tych praw i dochodzi do tego również w czasie wykonywania ich obowiązków. Przypadki takie obejmują zabójstwa, groźby śmierci, uprowadzenia, porwania, arbitralne aresztowania, przetrzymywania, tortury. Naszym obowiązkiem jest pomoc dla wszystkich tych, którzy ryzykują zdrowie, wolność, życie dla ochrony wartości, które my chcemy uczynić powszechnie obowiązującymi. Nie możemy tych ludzi zostawić samych.

Potrzebne jest działanie zarówno symboliczne, emocjonalne, moralne, ale także konkretne działania prawne, polityczne i dyplomatyczne. Te zadania są pilne dlatego, że obrońcy praw człowieka giną. Dla przykładu: jutro będziemy dyskutować o śmierci kongijskiego działacza Floriberta Chebeyi Bahizire'a, który zginął kilka dni temu – 2 czerwca. To się dzieje na naszych oczach.

  María Muñíz De Urquiza (S&D). - Señor Presidente, en este debate conjunto me voy a referir a la Resolución sobre el comercio de productos que pueden utilizarse para la tortura, que vamos a aprobar mañana y que es una oportunidad para profundizar en el Reglamento (CE) n° 1236/2005 del Consejo, que, aunque es un ejemplo internacional, debemos aspirar a mejorarlo, tanto en su aplicación como en su formulación.

En relación con su aplicación, hay que felicitar a los siete Estados miembros que cumplen con la presentación de informes anuales sobre autorizaciones de estos productos y a los doce Estados miembros que introdujeron una legislación penal correspondiente en el plazo debido. El resto de Estados miembros deberían seguir su ejemplo y ser más transparentes en esta materia.

En cuanto a su formulación, es el momento de actualizar el listado de productos contenidos en el anexo II cuyo comercio está prohibido, de manera que los productos con efectos similares a estos productos prohibidos actualmente se incorporen a la lista de productos prohibidos, tal como va a proponer la Presidencia española al final de este mes. De esta manera, se pondría fin a la situación en la que nos encontramos actualmente, en la que es posible comerciar con productos de efectos similares porque es estrictamente legal.

Debería ser una seña de identidad internacional de la Unión Europea el que ningún material europeo de defensa o de doble uso pueda ser utilizado para acciones que perturben la paz, la estabilidad o la seguridad o, sobre todo, que puedan ser utilizados con fines represivos o en situaciones de violaciones de los derechos humanos, y tenemos un buen instrumento para hacerlo.

  Janusz Wojciechowski (ECR). - Panie Przewodniczący! Podobnie jak przedmówczyni chciałem się zająć chwilę tym rozporządzeniem dotyczącym zakazu obrotu narzędziami tortur. Takie narzędzia możemy dziś oglądać w średniowiecznych muzeach. Ciarki po plecach przechodzą, gdy się na nie patrzy, ale to przecież nie tylko przeszłość i historia, ale również teraźniejszość, bo tortury są obecne na świecie i niestety także zdarzają się takie incydenty w krajach Unii Europejskiej. W związku z tym problem zakazu obrotu narzędziami tortur jest szczególnie istotny. Unia Europejska powinna zwalczać tortury we wszelkiej postaci, zakaz obrotu narzędziami tortur powinien być jak najbardziej restrykcyjnie stosowany.

Niepokojące są próby usprawiedliwiania tortur jako metody np. walki z terroryzmem. To jest absolutnie błędna droga, bo człowiek pod wpływem tortur przyzna się do niepopełnionych win, podczas gdy rzeczywisty sprawca bardzo często pozostaje bezkarny. Dlatego apeluję i wzywam, żeby to rozporządzenie i ten zakaz tortur był rzeczywiście bardzo ściśle przestrzegany w Unii Europejskiej.

  Kinga Gál (PPE). - Az emberijog-védőknek megkülönböztetett figyelemben kell részesülniük és a figyelmen túl a gyakorlatban szükséges őket segítenünk, hogy ne csak akkor övezze őket tisztelet és figyelem, ha az már túl késő. Fontosnak tartom, hogy a Parlament véleményt nyilvánít ebben a kérdéskörben, és gratulálok Hautala asszonynak a kezdeményezéshez és a remek munkához. A jelentés részletesen összefoglalja a szükséges lépéseket, ezért itt csak arra térnék ki, hogy mit kell tennie az Uniónak annak érdekében, hogy hatékony és rendkívül gyors segítséget tudjon nyújtani a rászoruló emberijog-védőknek. Pontosan a hatékonyság és a gyorsaság sok esetben az, amire a legnagyobb szükségük van azért, hogy a személyes egészségüket, vagy akár az életüket meg tudjuk védeni. Az emberijog-védők munkájának támogatása csak egy aspektusa az emberijog-védelemnek, ezért fontos, hogy az Európai Külügyi Szolgálat struktúrának a tartalommal való megtöltésekor az emberi jogok szerepe fontos legyen, és külön emberjogi mainstream hassa át ezt a munkát, és ezt a Lisszaboni Szerződés, ahogy azt Ashton képviselő is mondta, ennek a lehetőségét Lisszaboni Szerződés megtette. Most már Önökön a sor, Önökön múlik, hogy megteremtsék a gyakorlati feltételeit is.

Dlatego chciałbym silnie wesprzeć te wystąpienia i materiały Parlamentu, które bardzo silnie zwracają uwagę na potrzeby podejmowania w Unii działań o charakterze pragmatycznym. Szczególnie ważne jest to, byśmy skuteczniej niż do tej pory wspierali obrońców praw człowieka. Mamy wobec tych dzielnych ludzi zobowiązania szczególne. Pozwolę sobie w związku z tym zadać pani Ashton dwa konkretne pytania, bo wydaje mi się, że jest to ważna sprawa.

W Unii trwają obecnie prace nad przygotowaniem wspólnotowego kodeksu wizowego. Taki kodeks ma powstać. Chciałbym się w związku z tym zapytać, czy w tym kodeksie zostanie uregulowana sprawa wydawania w sytuacjach zagrożenia życia wiz dla obrońców prac człowieka?

Tworzone są obecnie przedstawicielstwa Unii. Czy w tych nowych przedstawicielstwach powoływani są już oficerowie łącznikowi, którzy zajmowaliby się (...).

  Jacek Protasiewicz (PPE). - Pozwólcie, że zacznę od podziękowań i gratulacji dla pani Hautala za jej sprawozdanie. Cieszą mnie również wypowiedziane w tej debacie słowa Lady Ashton, że problem przestrzegania praw człowieka jest i pozostanie w centrum europejskiej polityki zagranicznej.

Niepokoi mnie jednak bierność naszej wspólnoty, gdy dochodzi do faktycznego łamania tych praw, zwłaszcza, gdy dzieje się to w najbliższym sąsiedztwie, jak chociażby ostatnio w Rosji, czy w ostatnim okresie na Białorusi. W tym drugim kraju – chcę przypomnieć – do dziś wykonywane są wyroki śmierci. Oponentów politycznych skazuje się na długie więzienia, a społeczna aktywność obywateli w niezależnych organizacjach pozarządowych skutkuje szykanami ze strony władzy, i dzieje się tak pomimo trwającego od roku formalnego dialogu pomiędzy władzami Białorusi a Komisją Europejską na temat przestrzegania praw człowieka właśnie.

Nasza polityka – jak widać gołym okiem – musi być skuteczniejsza, a w szczególności pani komisarz musi szybko i stanowczo reagować, zwłaszcza wtedy, gdy zawodzą inne unijne instytucje, jak to ma miejsce w trakcie obecnej – niestety w sprawach praw człowieka – bardzo biernej prezydencji hiszpańskiej.

Jutro będziemy głosować nad rezolucją na temat szczytu unijno-rosyjskiego i mam nadzieję, że znajdzie się tam mocniejsze odniesienie do ostatnich niedobrych zdarzeń, jakie miały miejsce w Rosji, a w sprawie Białorusi słowa już nie wystarczą. Musimy wykorzystać instrumenty, jakie daje partnerstwo wschodnie, również te natury finansowo-gospodarczej ...

  Jarosław Leszek Wałęsa (PPE). - Panie Przewodniczący! Zacznę od podziękowania pani Hautala za jej sprawozdanie, które jest zarówno szczegółowe, jak i wyczerpujące. Zgadzam się, że stanowisko Unii Europejskiej jako protektora obrońców praw człowieka na świecie jest ściśle związane z wewnętrzną zasadą poszanowania praw człowieka i podstawowych wolności. Dlatego też popieram kwestie zawarte w sprawozdaniu o powołaniu lokalnych oficerów łącznikowych w tych europejskich misjach. Ponadto zgadzam się z zaleceniami dotyczącymi oceny sytuacji w zakresie praw człowieka w krajach trzecich. Human Rights Assessment jest niezbędne dla krajów, które angażują się w stosunkach handlowych z Unią Europejską. Znaczenie stosowania sankcji wobec krajów trzecich, które dopuszczają się poważnych naruszeń praw człowieka, należy traktować z większą determinacją.

  Monika Flašíková Beňová (S&D). - V ochrane ľudských práv, ktoré sú integrálnou súčasťou demokracie, je Európska únia bezpochyby globálnym lídrom. Z toho nám ale vyplýva množstvo záväzkov a množstvo povinností, ktoré máme voči svetu.

Obhajcovia ľudských práv trpia prenasledovaním, tyranizovaním a často aj fyzickým násilím, a preto som rada, že pani Hautala predložila správu práve v takejto podobe. Po prijatí Lisabonskej zmluvy by sme mali v tejto oblasti zohrať kľúčovú úlohu, a to najmä prostredníctvom zastupiteľstiev Európskej únie v tretích krajinách. Doposiaľ sa nám to celkom nedarilo, a preto by sme mali s novými kompetenciami využiť všetky nástroje na monitorovanie situácie v oblasti ľudských práv a podporu ich obhajcov. V každej z krajín, kde je zastúpenie Komisie, by mali byť delegovaní kvalifikovaní politickí predstavitelia, ktorých prioritnou agendou by boli práve ľudské práva a demokracia. Ďakujem ešte raz spravodajkyni.

  Charles Goerens (ALDE). - Monsieur le Président, si nous voulons être entendus à l'extérieur de l'Union européenne en matière de respect des droits de l'homme, essayons d'abord d'être irréprochables chez nous.

L'Union européenne a décidé d'adhérer à la Convention européenne des droits de l'homme en tant qu'Union. Ce geste symbolique fort reflète, je l'espère, la volonté des Vingt-sept de converger davantage encore en matière de respect des obligations qu'implique l'appartenance au Conseil de l'Europe.

Cela implique, de mon point de vue, que les Vingt-sept devraient s'engager à respecter chacun tous les arrêts de la Cour des droits de l'homme de Strasbourg. Est-ce que vous accepteriez, Madame la Haute représentante, de faire prendre l'engagement, par tous les États membres de l'Union européenne, de respecter dorénavant tous les arrêts de la Cour des droits de l'homme et d'en référer à notre Assemblée? Cela contribuerait à mettre fin à un comportement curieux qui consiste à faire la leçon au reste du monde tout en ignorant nos propres responsabilités, le reste du monde étant notamment aussi la vingtaine de pays non membres de l'Union ...

  Catherine Grèze (Verts/ALE). - Monsieur le Président, je voudrais d'abord remercier Mme Hautala pour l'excellent rapport qu'elle nous a soumis. Dans son rapport, elle met en avant les outils dont dispose l'Union européenne pour défendre les droits de l'homme, et notamment un outil qui me paraît essentiel, qui est celui de la clause des droits humains qui figure dans chaque accord commercial.

Aujourd'hui, je voudrais mettre l'accent sur la date du 28 juin. C'est la date de la cérémonie qui, dans quelques jours, commémorera le premier anniversaire du coup d'État au Honduras, cérémonie qui se fera dans la douleur pour le peuple du Honduras puisque, depuis l'élection qui a conduit Porfirio Lobo au gouvernement, la violence continue, violence envers les femmes, violence envers les défenseurs des droits de l'homme, violence envers les journalistes dont plusieurs ont été tués.

Aujourd'hui, l'UNASUR, malgré les protestations, s'oppose à l'Union européenne et aux États-Unis qui comptent reprendre les activités commerciales comme si de rien n'était. Je voudrais en appeler à la vigilance de l'Union européenne, utilisant les outils ...

  Gerard Batten (EFD). - Mr President, Baroness Ashton, there is an abuse of human rights in the European Union which hopefully we can do something about as it is quite specific.

I would like to draw your attention to conditions in the Greek prison of Korydallos. This is the only prison in Greece where foreign nationals are held on remand. British citizens extradited to Greece will almost inevitably find themselves in Korydallos.

My constituent Andrew Symeou spent 11 months in Korydallos awaiting trial. He is now on bail, but six more British citizens that I know of face extradition and almost inevitable incarceration there.

You may be aware that Korydallos is universally condemned by organisations such as Amnesty International and Fair Trials Abroad as having some of the worst conditions of any prison in the world. It is in clear breach of Article 3 of the European Convention on Human Rights.

  Catherine Ashton, Vice-President of the Commission/High Representative of the Union for Foreign Affairs. − Mr President, for those Members who were unable to finish contributions, of course I am always pleased if Members of the European Parliament get in touch with me to raise particular issues.

I just want to say in conclusion to at least part of this that I very much welcome the chance that we have had to have this discussion. Sometimes the important parts of our work get overtaken by the urgent and I do believe this Parliament has a critical role to play in making sure that we remain true to the founding values that are spelt out in the Treaty of Lisbon and I quote, ‘respect for human dignity, freedom, democracy, equality, the rule of law and respect for human rights, including the rights of persons belonging to minorities’. Those, in a sense, are the watchwords for the External Action Service, just as they should be the watchwords for all that we do as a European Union and as Member States.

A number of honourable Members have talked about human rights defenders and the importance and significance of continuing the dialogue with them. I have already made it clear that, where we can, we are working to meet with human rights defenders everywhere that I visit in the world and indeed to invite and see human rights defenders in Brussels in my office. Recently I met with women from Afghanistan to talk about their particular concerns. We will continue to do this. It is an integral part of how the External Action Service should operate.

I know that Mrs De Keyser cannot be here now but I do take her points very much on looking forward on electoral observation. We do need to look again at having a more coherent strategy, both in terms of the preparation for electoral missions, but also better monitoring in the follow-up to that. Her work in monitoring in Sudan very much feeds into the way in which I want to take this forward when we have the service operational, so that we get better at what we do and we use the information and knowledge more effectively.

I have also described that human rights have got to be the thread that binds us in all the relationships that we have. These are important values that need to be consistently applied to people everywhere regardless, but we need to be sure that we understand what they mean and how we should approach their implementation. It is not about special rights; it is about enabling people to be able to access the rights that they are entitled to. That sometimes means that we have to examine how best to support people. Honourable Members who, like me, have worked in the field of those with disabilities will know that actually accessing human rights for disabled people requires us to make positive changes. Sometimes that is true in other parts of the world, and in other communities as well, but we also need that level of consistency which a number of honourable Members have paid attention to.

In the declaration on political accountability, which will be a feature of what we do as we move forward with the External Action Service, I have foreseen the strengthening of exchange of information and access to documents, which I hope will help honourable Members in some of the comments that have been made on that.

As for structures, I am in discussion on structures but I am not going to be bound into having structures that actually prevent us from dealing with human rights as effectively as I would like. We are ensuring that human rights is a feature of all of the work of all of the delegations, but I believe it is a feature of what everybody should be doing. It is not a silver thread if we simply put it in a box called human rights and put it in a corner. Too often that is what I see organisations doing and I will not do that with the External Action Service. It has to be a clear part of everything I do and everything that all those involved do.

Mr Zemke, I just want to pick up your point about the visa code. The Commission did indeed put forward a proposal that would do what I think you were seeking to do. Unfortunately, we have not found favour with all Member States. Any lobbying that the European Parliament is able to do on Member States would be gratefully received. We are working on a way through this but we have to get all Member States to agree to it, so I hope that you will consider that an offer to try and help us with that.

In terms of the accession to the European Convention on Human Rights, it is an important objective, very definitely within the Lisbon Treaty, and we are glad that we have the mandate to work to complete that. But it will be done in parallel with the membership of the individual Member States in terms of the obligations that we have.

Finally, thank you again for this important debate. I have particularly noted the important comments that have been made that will help me be guided for the future and I pay tribute again to the Human Rights Committee for the work that they have done.

  Heidi Hautala, rapporteur. − Mr President, I would like to thank everybody for this extremely interesting exchange of views which I think also laid a good foundation for the cooperation between the High Representative and our work in Parliament on human rights.

Many very important things were said. I believe first of all that, in order to be credible, we have to use the same yardstick to measure similar situations all around the world, understanding of course that the situations may have some nuances and differences, but we should not end up in a situation where we deal with human rights problems in some countries and in others we neglect them.

I also believe very much that in order to have a say on human rights in the world, we need to be able to look at problems within the EU. There are incredible prison conditions within the European Union. The example of the torture tools shows that we are far from being perfect. We are not living up to expectations and our own commitments.

I also believe that in the near future we should have the courage to look at the contribution and involvement of some of our Member States in the CIA renditions in the fight against terrorism. I know it is a very sensitive subject, but I think we should have the courage to look at this again.

Mr Goerens aired the excellent idea that, when acceding to the European Convention on Human Rights, the 27 member governments should commit themselves to executing the judgments of the Human Rights Court. This would be the least, I think, we can do to make a positive contribution.

Lastly I would like to say that the European Parliament has new competences. We have to use them wisely to promote human rights. Trade policy is certainly something we should look at more closely to see what we can do, so thank you, Mr Moreira, for contributing to this debate.

  Elena Oana Antonescu (PPE), în scris. – Uniunea Europeană acordă o importanţă deosebită respectării drepturilor omului, atât în interiorul graniţelor sale, cât şi în afara acestora.

Al zecelea raport anual al Uniunii Europene privind drepturile omului în lume în anul 2008, elaborat de Consiliu şi Comisie, oferă o perspectivă de ansamblu asupra activităţilor instituţiilor Uniunii Europene din domeniul drepturilor omului în interiorul şi în afara Uniunii.

Consider că atât Comisia cât şi Consiliul trebuie să depună eforturi mai mari pentru a ameliora capacitatea Uniunii Europene de a reacţiona rapid la încălcările drepturilor omului din ţările terţe, iar promovarea drepturilor omului, unul din obiectivele principale ale politicii externe şi de securitate comună a Uniunii Europene (PESC), aşa cum este prevăzut în articolul 11 din Tratatul privind Uniunea Europeană, să fie aplicate cu stricteţe în dialogurile şi în relaţiile instituţiilor UE cu orice stat al lumii.

Comisia trebuie să încurajeze statele membre ale Uniunii Europene, precum şi ţările terţe cu care sunt în curs negocieri de aderare, să semneze şi să ratifice toate convenţiile fundamentale ale Organizaţiei Naţiunilor Unite şi Consiliului Europei din domeniul drepturilor omului, precum şi protocoalele facultative anexate acestora şi să coopereze în cadrul procedurilor şi mecanismelor internaţionale în materie de drepturi ale omului.

  Lidia Joanna Geringer de Oedenberg (S&D), na piśmie. – Obrona i promowanie praw człowieka stanowią priorytet Unii Europejskiej. Sytuacja jest wciąż daleka od doskonałości, ale Wspólnota nie ustaje w walce o egzekwowanie praw człowieka na całym świecie. Białoruś, Jemen, Namibia, Gwatemala ... Lista krajów, z którymi UE omawia kwestie związane z prawami człowieka, jest niestety imponująca.

W 2007 r. ustanowiono Europejski Instrument na rzecz Demokracji i Praw Człowieka (EIDHR), który finansuje projekty prowadzone przez społeczeństwo obywatelskie w celu promowania rządów prawa i demokracji. Na przykład w ramach EIDHR kwotą 5 mln euro wsparto reformę systemu wyborczego w Czadzie.

Jak można się domyślić, działania UE w tej dziedzinie są najbardziej efektywne w odniesieniu do krajów kandydujących do Wspólnoty. Na przykład wiele pozytywnych zmian odnotowano w Chorwacji i w Turcji. Pierwsza ratyfikowała najważniejsze konwencje międzynarodowe oraz współpracuje z Międzynarodowym Trybunałem Karnym dla byłej Jugosławii. Z kolei Turcja zaczyna przywiązywać większą wagę do walki ze swoimi tradycyjnymi problemami, takimi jak np. praca podejmowana przez dzieci.

Działania te nie powinny przesłonić faktu, że konieczne są jeszcze większe wysiłki na rzecz promowania praw człowieka. Aktualna, dramatyczna sytuacja w Kirgistanie jest tego smutnym dowodem.

  Jarosław Kalinowski (PPE), na piśmie. – Unia Europejska i jej instytucje na każdym kroku przypominają o tym, jak bardzo dbają o przestrzeganie praw człowieka na całym świecie. Zapisy prawne w tym obszarze są obecne we wszystkich traktatach i w innych dokumentach strategicznych. Z całego serca popieram wszystkie inicjatywy, o których mowa w sprawozdaniu Pani Heidi Hautali. Jednakże chciałbym przy tym wyrazić swój jednoznaczny sprzeciw wobec braku działań Parlamentu Europejskiego wobec obecnej sytuacji mniejszości polskiej na Litwie. Po pierwsze, jest to sprawa postępowania Litewskiej Głównej Komisji Etyki Służbowej, która wszczęła dochodzenie wobec litewskiego posła Waldemara Tomaszewskiego, który stanął w obronie Polaków mieszkających na Litwie i zwrócił uwagę na fakt nieprzestrzegania przez ten kraj międzynarodowych konwencji ochrony praw mniejszości narodowych, szczególnie w obszarze praw językowych. Jak długo Parlament będzie pozwalał na zamykanie ust swoich posłów? Kolejna kwestia to obecnie podejmowane działania parlamentu litewskiego w zakresie ustawy oświatowej, zmierzające do ograniczenia nauki języka polskiego w polskich szkołach na Litwie. Czy Parlament będzie zwlekał tak długo, aż dojdzie do ich likwidacji?

  Monica Luisa Macovei (PPE), in writing. – There are many cases in which family members of human rights defenders (spouses, children, parents) face human rights violations themselves, including killings, death threats, abductions and kidnappings, arbitrary arrest, defamation, job loss, and other actions of harassment and intimidation. These actions generate a climate of terror within their community, and impede on their legitimate work. Support for their families must go beyond the delivery of visas in emergency situations. Neither the short-term nor the long-term needs of their families have been sufficiently addressed. Sometimes, the price paid by human rights defenders is very high. Detention, sometimes murder, causes pain and survival problems for them and their families. We have the duty to help them. EU policies and instruments should substantially address the hardship placed on these families in their own countries. Effective strategies should offer real support and assist these families in finding solutions to their problems, providing effective remedies, including moral support, shelter, help with their reintegration into society, job search, and emergency funds. This approach will discourage the cruel measures imposed on families in order to prevent defenders from continuing their work and improve the efficiency of the human rights campaigns.

  Siiri Oviir (ALDE), kirjalikult. – Vaatamata sellele, et naiste ja meeste võrdõiguslikkus on inimõiguste teema ja kuulub Euroopa Liidu väärtushinnangute skaalale, püsib poliitilises tegelikkuses ja naiste reaalelus jätkuvalt märkimisväärne ebavõrdsus. Haridus mõjutab oluliselt meeste ja naiste võimalusi ja valikuid – see avab uksi tööturul, osutub määravaks sissetulekute ja karjääri kujunemisel. Vaatamata sellele, et pea 60% ELi naistest on kõrgharidus, on nad siiski täna sunnitud töötama vähem väärtustatud töö- ja ametikohtadel kui mehed.

Möödunud viiel aastal oleme saavutatud küll teatud edu naiste ja meeste majandusliku sõltumatuse valdkonnas ning naiste tööhõive määr tõusis pea 60%ni, kuid samas ei ole toimunud mingitki muutust paremusele naiste ja meeste palgavahe kaotamise osas. Naised said 2007. aasta andmetel keskmiselt 17% vähem palka kui mehed (mõnes riigis isegi 30%). 2007. aasta oli majandustõusu aeg. Kui suureks on palgalõhe kärisenud kriisi tõttu, seda kuuleme vast pea. Tulenevalt olukorra tõsidusest peame tõhustama ELis jõupingutusi, kasutama vähem tühje sõnu naiste ja meeste palgaerinevuse vähendamise teemal ning töötama välja toimivaid meetmeid palgaga seotud diskrimineerimise vastu võitlemiseks! Seisan ka selle eest, et neid liikmesriikides ka rakendatakse. Nõustun raportööri ettepanekuga, et aastaks 2020 peaks naiste ja meeste palgavahe vähenema 0-5% tasemele. Leian, et Euroopas peab kehtima naiste ja meeste palgavahe suhtes nulltolerants.

  Bogusław Sonik (PPE), na piśmie. – Obrońcy praw człowieka na całym świecie odgrywają zasadniczą rolę w ochronie i wspieraniu podstawowych praw poprzez codzienne zaangażowanie, często z narażeniem własnego życia.

Wspieranie obrońców praw człowieka od długiego czasu stanowi jeden z elementów polityki prowadzonej przez Unię Europejską w dziedzinie praw człowieka w stosunkach zewnętrznych. Ta kwestia nabiera teraz większego znaczenia w świetle art. 3 i 21 Traktatu z Lizbony, który umieszcza promowanie i ochronę praw człowieka w centrum zainteresowania działań zewnętrznych Unii Europejskiej. W tym kontekście jednym z priorytetów musi być promowanie praw człowieka, jako podstawowej wartości oraz celu polityki zagranicznej Unii. Struktura oraz zasoby ludzkie tworzonej obecnie Europejskiej Służby Działań Zewnętrznych powinny należycie odzwierciedlać kwestię monitorowania, promowania i wspierania działań na rzecz ochrony praw człowieka.

Za bardzo istotny element strategii UE w tym zakresie uważam wspieranie, ochronę i bezpieczeństwo obrońców praw człowieka. Te kwestie powinny być traktowane priorytetowo w stosunkach UE z krajami trzecimi i uwzględnione na wszystkich szczeblach oraz we wszystkich instrumentach polityki zagranicznej Unii tak, aby zwiększyć skuteczność i wiarygodność działań UE w tej kwestii. Dlatego zwracam się do wysokiej przedstawiciel Unii do spraw zagranicznych i polityki bezpieczeństwa o skuteczne wdrażanie klauzuli praw człowieka w umowach międzynarodowych i partnerstwach oraz utworzenie prawdziwego mechanizmu egzekwowania tej klauzuli.

  Nuno Teixeira (PPE), por escrito. – As violações dos direitos humanos são, infelizmente, uma constante mundial e, como tal, é crucial que se aumente o nível de protecção de que os defensores dos direitos humanos devem gozar e que se reforce o nível das suas condições de trabalho para que se possam atingir os resultados almejados. Estes agentes internacionais de que falo são o motor da protecção de seres humanos contra qualquer forma de abuso a que diariamente possam estar sujeitos; são eles que arriscam as suas vidas e que dão forma às iniciativas e à legislação que nós aqui produzimos.

E porque o trabalho por eles desempenhado não se esgota nos limites territoriais e geográficos da União, propagando-se sim pelo mundo inteiro, é de notar o papel decisivo que a criação do Serviço Europeu de Acção Externa, e do seu "ponto central de contacto", pode ter no reforço da protecção destes cidadãos. Assim, entendo que através do estabelecimento de medidas incisivas, como as aqui propostas, se pode promover uma articulação actual e positiva entre os diálogos e as políticas transversais e transnacionais, contribuindo-se eficazmente para a visão, pioneira e sempre realista, por que se tem pautado a actuação da UE no campo dos direitos humanos.
