  President. − The next item is the debate on six motions for resolutions on the Democratic Republic of Congo, mass rape in South Kivu province(1).

  Charles Tannock, author. − Madam President, the Democratic Republic of Congo is something of a misnomer, as it is certainly not democratic, nor is it really a functioning republic. If it was, we could perhaps hope to see the government take action to prevent the mass rape of women and to prosecute those responsible for that heinous crime. But in reality the government has little authority over vast swathes of this anarchic country.

The latest mass rapes in South Kivu province are another sorry chapter in the violent and troubled history of the DRC, which is verging on being a failed state. Those crimes were allegedly committed by former rebels who had been integrated into the national army but then deserted. Perhaps the most frustrating aspect of this appalling case is that the perpetrators are unlikely ever to be brought to justice. Nevertheless, that should not stop us trying, as impunity is completely unacceptable in the modern world. Having the International Criminal Court as a body of global jurisprudence for such vile crimes offers us at least some glimmer of hope for the victims of this savagery to see some justice – victims to whom we say today that we in this Parliament will not ignore what has happened to you.

  Raül Romeva i Rueda, author. − Madam President, we have to remind ourselves that we are all responsible in different ways for what is happening because UN Resolution 1325 emphasises it is the responsibility of all states to put an end to impunity and prosecute those responsible for crimes against humanity and war crimes, including those relating to sexual or other violence against women and girls.

The time has come to go beyond condemnation; the Congolese Government and the UN should assume responsibility and take concrete action to end these atrocities. For the Congolese Government, for instance, it is necessary to make dealing with violence against women a national priority and put in place mechanisms such as establishing transitional justice to promote truth, requiring accountability for sexual violence; and organising a national campaign to heighten public awareness of the mass rape of women.

For the Commission: it is time to review the DRC’s Country Strategy Paper and the national indicative programme of the EDF (2008-2013), with the objective of making the issue of mass rape and sexual violence against women a national priority to combat impunity. The EU’s development funds to the DRC should be allocated as a matter of priority to providing medical, legal and social support for victims of sexual abuse and empowering women and girls as a way of preventing further sexual abuse.

en République démocratique du Congo, en particulier, dans la province du Sud–Kivu.

La MONUSCO n'a pas su apporter une protection suffisante contre ces viols massifs et il incombe au gouvernement de la RDC d'assurer la sécurité sur son territoire et de protéger les civils. Les fonds alloués n'atteignent absolument que peu de victimes, et la coordination de l'aide n'est plus du tout assurée.

Il est essentiel que la Commission maintienne les financements qu'elle accorde à l'aide humanitaire dans l'est de la RDC.

Le plan de résolution du conflit au Sud–Kivu consistant à privilégier la solution militaire s'avère être un échec. La solution à apporter à ce conflit doit être politique et on ne peut que regretter le manque de courage de la communauté internationale.

Enfin, je conclurai en disant que les médias ont également un rôle essentiel à jouer, qu'ils ne jouent pas toujours, et, notamment, pour que la mobilisation reste forte et que l'opinion publique soit dûment alertée.

  Marietje Schaake, author. − Madam President, the systematic and widespread practice of rape as a war crime may amount to crimes against humanity, according to the UN. The organisation has extended its mission to the DRC but, if our conclusion is that the mandate is insufficient to effectively intervene, we must encourage its revision. The UN must also carry out an independent inquiry so that we can learn about the scope and the scale of these horrific crimes. The impunity has to end. The international community, as well as the media, have an essential role to prevent sexual violence and to raise awareness. The authorities of the DRC must prioritise the ending of violence and of sexual violence in particular.

As a result of taboos, victims often do not speak out and, when they do, they risk being excluded from their communities. The fact that there are so many problems in the DRC must make us more vigilant and engaged. We must never allow a situation where rape is routine and where hundreds of thousands of people, particularly women, suffer in silence. At home we demand more transparency on the use of conflict minerals. We all use ICT products that potentially contain the minerals that fuel the conflicts in the DRC.

  Véronique De Keyser, auteure. − Madame la Présidente, c'est avec beaucoup d'émotion, avec colère et, parfois, avec rage que je vois revenir sur la table le dossier de ces femmes violées dans l'est du Congo. Ce n'est pas la première fois et on reste impuissant devant cela.

Je voudrais dire simplement que je ne peux pas croire à cette impuissance. On a énuméré ce qui a été décidé à l'ONU et à la MONUSCO. Une loi est aujourd'hui en préparation en République démocratique du Congo pour instaurer des juridictions particulières pour ce genre de violations. On l'a dit, c'est une négociation politique qu'il faut dans cette partie du pays où la guerre civile est en train de reprendre.

Mais laissez-moi vous dire, aussi, qu'il y a quelque chose qui me révolte encore plus que tout: nous avons rendu visite à ces femmes, nous les avons entendues, ici, au Parlement. Celles qui ont été violées n'ont même pas droit à une interruption volontaire de grossesse, et, aujourd'hui, les enfants du viol sont rejetés par toutes les communautés. C'est aujourd'hui un drame humain.

Ne croyez pas, chers collègues, que je veuille remettre sur la table le dossier de l'avortement, à la lumière des urgences. Dans la plupart des législations qui, aujourd'hui, refusent l'avortement, le cas du viol constitue une exception; il ne l'est pas encore au Congo, et ces cent femmes et les trois cents autres que nous avons rencontrées auront des enfants qu'elles n'aimeront pas et qui feront partie de ces enfants rejetés dans la rue au Congo.

Voilà, il y a là un drame humain. Je voudrais que l'on s'y attarde dans un autre lieu, à un autre moment. C'est inacceptable à tous points de vue.

  Filip Kaczmarek, w imieniu grupy PPE. – Pani Przewodnicząca! Szanowni Państwo! Sytuacja w Kiwu Południowym jest bardzo trudna. Trwa tam długotrwały konflikt, w wyniku którego codziennie dochodzi do aktów przemocy. Od początku tego roku Lekarze bez Granic pomogli tylko 500 ofiarom masowych gwałtów w regionie Fizi, w Kiwu Południowym. Zgadzam się z panią De Keyser, że jest to bardzo frustrujące, że w zachodniej Demokratycznej Republice Konga systematyczne rośnie liczba masowych gwałtów na ludności cywilnej, i że kolejny raz o tym musimy mówić. Ale musimy o tym mówić, dlatego że przemoc seksualna jest nie do zaakceptowania. To jest coś, w obliczu czego nie możemy milczeć. Wojsko miejscowe niewiele robi, żeby w tej sytuacji pomóc. Jest ono źle wyszkolone, źle wyposażone, zdarza się, że to sami żołnierze gwałcą. W związku z tym to na nas spoczywa obowiązek, aby bardziej pomagać ofiarom. Być może trzeba rozważyć, żeby zamiast wydawać 7 milionów euro na obserwację wyborów w Demokratycznej republice Konga, przeznaczyć te środki na pomoc ofiarom i na ściganie przestępców seksualnych.

  Ana Gomes, em nome do Grupo S&D. – Os crimes de violência sexual no sul do Kivu têm que ser investigados e os responsáveis têm que ser punidos. É essencial combater a cultura de impunidade para impedir que outras atrocidades como esta se repitam. A União Europeia tem de fazer desta questão uma prioridade na sua cooperação com a RDC e tem que denunciar e condenar as empresas envolvidas na exploração de minerais que sustentam os militares e as milícias armadas envolvidos nestes crimes hediondos.

Assim como tem, também a União Europeia, que acordar com as autoridades congolesas outras graves violações dos direitos humanos, como a recente prisão de Agostinho Chicaia, um activista cívico de Cabinda, Angola, detido a 20 de Junho no aeroporto de Kinshasa, quando se deslocava em serviço da ONU. A detenção foi feita com base numa lista negra feita pelas autoridades de Angola, que dizem que não pediram a detenção, é um caso kafkiano que mostra que os direitos humanos também são, desta maneira, violados na República Democrática do Congo. Chicaia deve ser imediatamente libertado e a União Europeia tem de se bater também por isso.

  Izaskun Bilbao Barandica, en nombre del Grupo ALDE. – Señora Presidenta, una vez más las mujeres son las grandes víctimas de los conflictos. En el Congo, ha vuelto a practicarse la violencia sexual como arma de humillación y destrucción máxima del adversario. En este caso, además, están claros los intereses económicos que hay detrás de un conflicto en el que una acción más decidida sobre el comercio y la utilización, en productos que utilizamos todos los días, de los llamados «minerales del conflicto» sería una verdadera herramienta de paz.

Por eso, pido más control y determinación en este aspecto concreto, y apoyo esta propuesta de Resolución, que apuesta por la democracia para evitar la violencia y la guerra. Creo que es bueno recordar, además, que se pide más coraje a las instituciones europeas también en el apoyo a los procesos políticos, que son los que acaban resolviendo, siempre, este tipo de conflictos. Espero que esa sea la implicación de todos nosotros.

  Ryszard Czarnecki, w imieniu grupy ECR. – Pani Przewodnicząca! Jest nas tu niewielu, ale jednak jesteśmy i wołamy w imieniu Europy. Ten głos musi być słyszalny. Kraj, o którym mówimy, jest jednym z najbiedniejszych w Afryce. Z jednej strony nie ma tam władzy, panuje anarchia, władza leży na ulicy, a z drugiej strony władza jest bardzo silna, bo jest wszystkim. Czasem reprezentant władzy, policjant czy wojskowy, może decydować o życiu i zdrowiu ludzi. Jest to straszne. Chciałem powiedzieć, że Parlament Europejski po raz kolejny zajmuje się tą sprawą i po raz kolejny w sposób bardzo dramatyczny zwraca się do władz Demokratycznej Republiki Konga, aby rzeczywiście chroniły one własną ludność. Kończąc, chciałem zaznaczyć, że – jak powiedział pan poseł Kaczmarek – tak naprawdę rzeczywiście trzeba zastanowić się, na co idą pieniądze europejskiego podatnika w tym kontekście.

  Bastiaan Belder, namens de EFD-Fractie. – Voorzitter, slechts enkele uren geleden had ik uitgebreid telefonisch contact met een Nederlandse hulpverlener in Kivu, Oost-Congo. Hij toonde zich oprecht verheugd dat het Europees Parlement, ons Huis, vanmiddag aandacht besteedt aan de acute nood van de Congolese bevolking, waarvoor hij zich met hart en ziel inzet. Want internationale aandacht, dus ook onze aandacht vanmiddag, waarbij het straffeloos begaan van gruweldaden en teugelloos geweld in Oost-Congo veroordeeld wordt, samen overigens met de zichtbare presentie van de VN-missie MUNISCO ter plekke, werkt écht preventief en doorbreekt ook het verstikkende zwijgen en lijden van de talloze slachtoffers van massaverkrachtingen.

Klopt overigens, mevrouw de commissaris, het persbericht dat ik gistermiddag onder ogen kreeg dat het gerechtelijk onderzoek naar de verkrachting is opgeschort vanwege dreigementen met vergeldingsacties? Dat zou een barslecht signaal zijn, het meest naar de slachtoffers en hun families.

  Franz Obermayr (NI). - Frau Präsidentin! Verbrechen gegen die Menschlichkeit haben im Kongo leider eine 150-jährige Tradition. Kautschuk, Elfenbein und Kupfer waren Hauptexportgüter der belgischen Kolonie und die Bevölkerung wurde zu Zwangsarbeit auf den Plantagen und in den Minen gezwungen. Die Methoden der Ausbeuter waren grauenhaft. Den einzelnen Dörfern wurden Lieferquoten auferlegt, bei Nichterfüllung wurden die Bewohner bestraft: Auspeitschung, Vergewaltigung, Abhacken von Gliedmaßen, Massenhinrichtungen waren an der Tagesordnung. Ich glaube, Europa, vor allem das koloniale Europa, hat hier einiges vor Ort wiedergutzumachen.

Solche Gewalt erzeugt einen Teufelskreis über Generationen hinweg und erzeugt neue Gewalt. Vergewaltigung wird in kriegerischen Konflikten gezielt eingesetzt, um grenzenlose Macht über das Opfer zu demonstrieren, es zu erniedrigen, zu demütigen, zu verletzen, und zerstört neben der Seele der direkt betroffenen Frauen ganze Familien. Und zu den körperlichen und psychischen Auswirkungen kommt, dass Vergewaltigung als Schande gilt, besonders wenn daraus eine Schwangerschaft resultiert, und dann werden Frauen in letzter Konsequenz auch noch von ihren Familien verstoßen.

Hinzu kommt die Unfähigkeit der Demokratischen Republik Kongo, Mitglieder der eigenen Streitkräfte für Verbrechen nach dem Völkerrecht vor Gericht zu stellen. In den seltenen Fällen, in denen eine Frau dann tatsächlich gegen ihren Peiniger vorgeht, wird ihr de facto kein Rechtschutz gewährt. Derartige Verbrechen an der Menschlichkeit dürfen nicht toleriert werden. Hier ist massiver, insbesondere finanzieller Druck auf die Republik Kongo auszuüben. Es darf nicht sein, dass Europa sehr wohl auf die Reichtümer des Kongo schielt, bei Kriegsverbrechen aber beide Augen zudrückt!

  Monica Luisa Macovei (PPE). - Mă alătur celor care condamnă crimele din provincia Kivu de Sud şi violenţa sexuală ca armă de război. Surse locale arată că aproximativ 40 de violuri sunt comise zilnic şi, deseori, autorii fac parte din armată sau grupuri armate. În timpul acesta, asistenţa medicală, socială sau juridică pentru victime lipseşte, iar autorii crimelor rămân neanchetaţi şi nepedepsiţi. Este necesară protecţia celor 170 de victime şi a celor care pot depune mărturie, pentru a face posibilă o anchetă urgentă, independentă şi imparţială pentru pedepsirea autorilor acestor violenţe din iunie.

Insistăm să se pună capăt acestei situaţii şi culturi a impunităţii. Solicit Comisiei să deblocheze urgent fonduri suplimentare pentru combaterea violenţei sexuale şi acordarea de asistenţă pentru victime. Presiunea financiară a Uniunii Europene trebuie folosită pentru această cauză.

Ir jokios, nei nacionalinės, nei tarptautinės priemonės nepajėgia jų sustabdyti. Ir tas bejėgiškumas ypač ryškus, turint omenyje Jungtinių tautų taikdarius, kurie irgi nieko negali padaryti. Sutinku su kolegomis, kad reikia finansinių injekcijų, ir Europos Sąjunga turi parodyti pavyzdį rasdama lėšų nusikaltimo aukoms pagelbėti ir nusikaltėliams išaiškinti. Na, ir tos tarptautinės monopolijos, kurios gauna pasakiškus pelnus iš Kongo gamtos turtų, iš elgetiškai apmokamo darbo, turėtų jausti ne tik moralinę pareigą, bet ir tarptautinės bendrijos įpareigojimą irgi prisidėti prie šios epidemijos išnaikinimo.

This area has been described as the rape capital of the world. That is not a soubriquet that its citizens can be proud of, but it is probably true, because there is the rape of natural resources, which is destroying the wealth of the country and continuing the poverty cycle, and then the rape of women and children.

In particular, from 10 to 12 June, 170 women were raped. That is outlandish. The consequences for them, and for the children born as a result, are unbelievable. We therefore have to do everything in our power to try and bring some sense to bear on the situation, and particularly to get the government there to make the fight against rape a national priority, to combat impunity and eventually to bring the perpetrators to justice.

  Corina Creţu (S&D). - Nu este prima dată când aducem în atenţie situaţia din Congo şi condamnăm cu toată fermitatea nu numai atrocităţile comise cu o ritmicitate înfiorătoare în această ţară, ci şi pasivitatea autorităţilor congoleze. În ultimele cinci luni, doar 11 militari au compărut în faţa unui tribunal, acuzaţi de viol. Dar rapoartele organizaţiilor non-guvernamentale vorbesc despre 400 000 de femei violate în Congo în ultimul deceniu şi, potrivit statisticilor, 48 de femei cad victime violului în fiecare oră. Această criză umanitară este amplificată de impunitate şi de prejudecăţile care transformă violul într-un tabu, altfel, victimele riscă excluderea din familie şi comunitate. E cazul multora dintre cele 121 de femei care au declarat că au fost violate în iunie în provincia Kivu de Sud.

Fac un apel către Comisie să aloce fonduri şi atenţie sporite creării de centre de îngrijire a victimelor şi acţiunilor pentru reintegrarea lor familială şi socială. Reînnoiesc, de asemenea, apelul pentru crearea unui tribunal penal internaţional pentru Congo, singura soluţie viabilă împotriva impunităţii. De asemenea, solicit ca autorităţile ţărilor europene să faciliteze obţinerea de permise de şedere pentru victimele violurilor care se refugiază în Uniunea Europeană.

  Sari Essayah (PPE). - Arvoisa puhemies, Kongon itäosassa on käyty sotaa epävakaissa oloissa aina 1990-luvun alusta lähtien, ja seksuaalinen väkivalta on osa tätä sodankäyntiä.

Tuhansia ja tuhansia naisia on raiskattu vuosien 2006–2007 aikana eikä raiskausten määrä ole vähentynyt tämän jälkeenkään, kertovat tuoreimmat kansainväliset raportit, joiden tutkimustulokset ovat paljon synkempiä kuin aiemmat YK:n tilastot. Viimeisimmät joukkoraiskaustapaukset ovat tältä vuodelta: Mai Mai -kapinallisiin aiemmin kuuluneiden Kirafun joukkojen epäillään raiskanneen yli 60 naista tammikuussa ja nyt kesäkuussa myös Nakielen alueella lähes sata naista.

EU:n on harjoitettava voimakasta painostusta Kongon hallitusta kohtaan, jotta tämä tilanne saadaan lopetettua ja rikolliset saadaan vastuuseen. Myös YK:n on saatava alueella tilanne hallintaan.

  Mitro Repo (S&D). - Arvoisa puhemies, Kongossa tapahtuneet vakavat ja erityisesti naisiin kohdistuneet ihmisoikeusrikkomukset ovat äärimmäisen tuomittavia. Naisiin kohdistunut fyysinen väkivalta on yksi vakavimmista ihmisoikeusrikkomuksista.

Erityisen vakavaksi teon tekee Kongossa se, että rikoksen tekijät ovat vielä valtion armeijan sotilaita. Kongossa tapahtuneiden joukkoraiskausten uhreja ovat myös koko perhe ja yhteisö. Törkeä rikos jättää pysyvät arvet nuoriin naisiin ja tyttöihin koko heidän loppuelämäkseen. Rikoksen tekijät tuleekin ehdottomasti saattaa vastuuseen teoistaan.

Rikostutkimusten ohessa on erittäin tärkeää suojella uhreja leimautumiselta ja tarjota heille riittävää kriisiapua sekä oikeudellista ja psykologista tukea. Naisiin kohdistunut väkivalta tulee tuomita kaikissa sen muodoissa, ja ihmisoikeuskoulutusta tulisi lisätä osana armeijakoulutusta kaikkialla.

  Cristian Silviu Buşoi (ALDE). - Sunt profund indignat de violurile în masă care au avut loc în iunie, în sudul provinciei Kivu. Din păcate, Republica Democrată Congo a fost, în ultimii 20 de ani, teatrul unor conflicte care au făcut cele mai multe victime după cel de-al Doilea Război Mondial, peste 5 milioane, şi are deja o tristă tradiţie în atrocităţi şi încălcări grave ale drepturilor omului. Consider că Uniunea Europeană trebuie să dea dovadă de solidaritate, să sprijine victimele acestor atrocităţi, şi, în măsura posibilului, să contribuie la găsirea unei soluţii durabile situaţiei extrem de dificile a Republicii Democrate Congo. Dar acum, în cel mai scurt timp, Uniunea Europeană trebuie să acorde asistenţă financiară pentru lupta împotriva violenţelor sexuale, precum şi pentru asistenţa acordată victimelor acestor violenţe. Prioritatea numărul unu trebuie să fie acordarea îngrijirilor medicale adecvate şi sprijinirea inserţiei acestor victime în societatea congoleză. Va trebui să fim siguri că banii ajung într-adevăr la victime şi că sunt utilizaţi pentru asistenţă.

  Barbara Lochbihler (Verts/ALE). - Frau Präsidentin! Wir hatten im Menschenrechtsausschuss zweimal eine Delegation von Frauen aus dem Ostkivu zu Besuch, und beide Male haben sie uns von den Gräueltaten dort berichtet, aber auch davon, was sie tun, damit man die Täter zur Rechenschaft ziehen kann, und wie sie das Leben der Frauen organisieren. Leider haben uns die Vertreterinnen vergangene Woche auch sehr glaubhaft versichert, dass sich im vergangenen Jahr die EU-Vertreter im Kongo leider nicht mit diesen Frauen treffen konnten, um zu erfahren, was für sie getan werden kann. Im Gegenteil, es wurde uns berichtet, dass sogar existierende Projekte eingestellt wurden. Deshalb verbinde ich das nun mit der Bitte an die Kommission, dem nachzugehen und dies zu korrigieren. Es wäre sehr schlecht, wenn solche Kleinprojekte, die auf die Hilfe der Opfer ausgerichtet sind, nicht mehr weitergeführt werden könnten.

  Eija-Riitta Korhola (PPE). - Arvoisa puhemies, sota ja levottomuudet Kongon demokraattisessa tasavallassa ovat tuoneet mukanaan laajalle levinneen seksuaalisen väkivallan. Pahin tilanne on idässä Pohjois- ja Etelä-Kivun alueella, missä taistellaan myös arvokkaista luonnonvaroista. YK ja kansainväliset rauhanturvaajat ovat selvästi epäonnistuneet siellä naisten ja lasten suojelemisessa.

Raiskaus on julmasti turmeleva sodankäynnin väline. Henkisen ja fyysisen väkivallan lisäksi sen avulla levitetään tauteja, ja useissa tapauksissa raiskausten uhrit joutuvat lopulta yhteisönsä hylkäämiksi. Traagista on, jos mahdollisuutta aborttiin ei ole.

Aikaa on kulunut liikaa suhteessa siihen, miten vähän asian eteen on tehty. EU:n ja YK:n on ryhdistäydyttävä ja otettava konkreettisia askeleita Kivun maakunnassa tapahtuneiden joukkoraiskausten selvittämiseksi ja pysäyttämiseksi. Kongon demokraattiseen tasavaltaan menevässä EU-rahoituksessa tulisi priorisoida raiskausuhrien lääketieteellinen ja juridinen apu ja huomioida kansainvälinen aidsin vastainen taistelu. Myös muut ihmisoikeusloukkaukset ja korruption kitkeminen on nostettava agendallamme korkeammalle.

  Monika Smolková (S&D). - Keďže Konžská demokratická republika má nedostatky v súdnom systéme postihujúcom zverstvá jednotlivých ozbrojených skupín, vítam predĺženie mandátu OSN do 30. júna 2012, ale súčasne chcem apelovať na osobitného zástupcu generálneho tajomníka OSN v Konžskej demokratickej republike, aby mandát bol vykonávaný dôsledne, aby sa nestávalo, že vedľa misijného tábora povstalci znásilňujú ženy, týrajú deti a celé rodiny tak, ako to bolo v Luvungi.

Prijímame veľmi striktné uznesenia i opatrenia na páchanie neprávosti inde vo svete a vysielame tam celé armády, a ku genocídam v Afrike sme benevolentnejší. Veď ako inak môžeme nazvať udalosti v Konžskej demokratickej republike v rokoch 1998 až 2003, kde zahynulo 5,5 milióna ľudí, čo je toľko, ako je obyvateľov mojej krajiny, Slovenska, a 2 milióny boli vyhnané z vlastných domovov. Prispejme aj my rigoróznejším prijatím uznesení k pokojnému životu žien a detí v tejto vojnou zmietanej africkej krajine.

  Zuzana Roithová (PPE). - Paní předsedající, válečné zločiny, jako je hromadné znásilnění, sexuální otroctví či sterilizace, jsou jednou z nejhorších forem ponížení, které navíc v Kongu znamená doživotní vyloučení těchto obětí ze společnosti.

Je alarmující, že pachatelé z řad paramilitantních oddílů i armády nejsou většinou vůbec potrestáni. Prodloužení mandátu modrých přileb Radou bezpečnosti o další rok je nutné, ale je také třeba, aby jednotky Monusco opravdu začaly chránit civilisty, aby prezident Kabila vyhlásil nulovou toleranci pro znásilňování a také aby začalo nestranné vyšetřování těchto zločinů.

Konžská vláda musí mít program pro začlenění obětí do společnosti. Komise by měla uvolnit prostředky na azylové domy, ale také navrhnout legislativu pro označení produktů s obsahem minerálů, jejichž těžba je zdrojem násilí v oblasti Kivu.

  Rovana Plumb (S&D). - Sigur că şi eu am citit o serie de studii care arată câte violuri au loc în această perioadă în Republica Congo, dar mai grav mi se pare ce mi-a povestit colega mea Veronique De Keyser, care a fost acolo şi a văzut câtă suferinţă este în rândul populaţiei, câtă teroare, mai ales în rândul femeilor şi în rândul copiilor. Această situaţie trebuie să înceteze şi trebuie să cerem cu fermitate, noi, instituţiile Uniunii Europene, de aici, din Parlament, ca autorităţile din Congo să facă toate investigaţiile necesare şi să-i pedepsească pe cei vinovaţi, şi, de asemenea, să acorde consiliere, atât medicală, cât şi consiliere juridică şi psihologică, tuturor victimelor, care trebuie să fie cuprinse într-un program de protecţie, şi, de asemenea, toată comunitatea internaţională, în special organizaţiile de femei, să reacţioneze, să punem capăt acestei situaţii din Congo.

  Michael Cashman (S&D). - Madam President, I will be very brief. These mass rapes have gone on for decades. Therefore we need to take vital action. It is vital that we support the NGOs which are bringing aid to the victims, and particularly the hospitals. However, can I please ask the Commission to bring forward a legislative proposal similar to the Dodd-Frank Act in the United States, which imposes reporting requirements on conflict materials in manufacturing? That way, those who profit from such atrocities will be held accountable. The arguments are there. It is no use saying that the Member States do not want to do it: it is up to us and the Commission to lead.

  Maria Damanaki, Member of the Commission. − Madam President, I would like to thank all the Members for their interest and their sensitive approach.

We all have again been appalled by perturbing news from Kivu, where a group of armed criminals abused and raped a considerable number of women in a systematic manner. These criminals were apparently ex-Mayi-Mayi deserting the Congolese armed forces after a transient and non-conclusive integration process.

This is an outrageous crime, and we are all concerned. It is therefore important to clarify the facts and bring the suspects before a court. In this regard we have been informed that a prosecutor of the Democratic Republic of Congo, supported by MONUSCO, should now be in the field in order to collect legal evidence and to prepare a prosecution case. We demand that the DRC authorities address this issue as a matter of urgency and to deliver justice.

However, indignation is not enough: I can understand this, and so we must all ask what further action needs to be taken, including by the United Nations Security Council and MONUSCO. Naturally, support for victims should be an immediate priority, and the EU is already committed to providing medical care and mitigating suffering. I can agree with you that victim support, especially healthcare, is one of the agreed priorities here, and I would like to inform you that the EU is at the forefront of these efforts through ECHO and development-funded health support actions. In addition, support for prevention, awareness-raising initiatives and political pressure is also part of the EU approach. These efforts will continue.

Sexual violence and rape continue to be pervasive in the DRC, with more than 15 000 reported cases in 2009, according to the United Nations: 15 000 rapes. It is therefore important to address the root causes of this serious issue and to ensure that Congolese justice will not remain confined to episodic reaction. The root causes are known: they lie within the endless conflicts in the eastern territory of the Republic of Congo and the absence of the rule of law in a context where the state authority remains to be concretised. Importantly, the prevalence of sexual violence both reflects and perpetuates the subordinate status of most women throughout the country.

It also has a very negative impact on a lot of children being born, as Ms de Keyser pointed out. To improve this situation, it is important to continue military and non-military action against the rebels. In this regard, it is important to bear in mind that this type of conflict – in many cases involving groups without a real political agenda, or criminals from neighbouring countries – is difficult to address in the short term. However, it is more and more urgent that decisive steps are taken in reforming the security sector. The persistent poor condition of defence, the police and justice in the Congo greatly worsens the situation.

The European Union therefore urges the Congolese authorities to give renewed priority to this challenge. Failure to make substantial progress in the defence, police and justice sectors will jeopardise the sustainability of achievements made in the economic, social and political areas. In this period of elections, tackling these issues should undoubtedly be an agenda shared by all Congolese democratic forces, as the future of the whole country is at stake.

The EU is already providing support to the security sector reform through common security and defence policy missions and the European Commission, as well as bilateral support from Member States. These actions pay particular attention to the need to combat sexual violence; for example, EUPOL has deployed a specific team of experts on sexual violence in Goma (a city in North Kivu). Support to victims also needs to be continued. The EU is ready to do more if common ground for progress is found with Member States and the Republic of Congo authorities. However, this is an area where the ultimate responsibility will always lie with the DRC itself and where the Congolese Government needs to show true leadership and determination.

  Tadeusz Zwiefka (PPE), na piśmie. – Demokratyczna Republika Konga już od momentu uzyskania niepodległości jest areną nieustannych walk, w wyniku których miliony osób poniosły śmierć lub zostały przymusowo przesiedlone. Konflikty te doprowadziły kraj do katastrofy humanitarnej, sprawiły, że zapewnienie przestrzegania podstawowych praw człowieka to fikcja. Na tym tle najbardziej cierpią zwykli obywatele, którzy żyjąc w ciągłym strachu o życie swoje i swoich rodzin, funkcjonują na skraju ubóstwa, bez pracy, nie uczęszczają do szkół. Najbardziej krytyczna sytuacja panuje w prowincji Kiwu. Mimo podpisanego 23 stycznia 2008 roku „Aktu Zobowiązaniowego”, w którym grupy zbrojne działające na terenie prowincji Kiwu Północnego zobowiązały się do zaprzestania okrucieństw, codziennie dochodzi tam do zabójstw, gwałtów, torturowania ludności cywilnej oraz werbunku dzieci żołnierzy. Jednak najczęściej popełnianą zbrodnią przez wszystkie strony konfliktu są masowe gwałty na kobietach. Znajdują się one w tragicznej sytuacji. Bez pomocy psychologicznej, w obliczu fatalnego stanu służby zdrowia, są najczęściej pozostawione same sobie, bezradne, zastraszone, często odtrącone przez swoich mężów, którzy uważają je za zhańbione. W obliczu tak ogromnej ludzkiej tragedii władze Demokratycznej Republiki Konga zachowują się opieszale, lekceważą problem, pozostawiając Kongijki bez pomocy, a sprawców - bezkarnymi. Musimy zdawać sobie sprawę, że tymczasowa stabilizacja w Demokratycznej Republice Konga to fasada, za którą dzieje się na oczach świata nieopisane okrucieństwo.
