  Der Präsident. − Als nächster Punkt folgt der Bericht von Sophia in't Veld im Namen des Ausschusses für bürgerliche Freiheiten, Justiz und Inneres über die Politik der EU zur Terrorismusbekämpfung: wichtigste Errungenschaften und künftige Herausforderungen (2010/2311(INI)) (A7-0286/2011).

  Sophia in 't Veld, rapporteur. − Mr President, I had actually prepared a rather different intervention for today, but things seem to be developing very rapidly.

First of all, I think it is regrettable that we are not having a full debate. This is a very important topic. I think this is underlined by the controversy about the report, and therefore I think it would have merited the presence of the responsible Commissioner, the Council and many colleagues, including the shadows.

I am rather unpleasantly surprised by the extreme reluctance – both within the European Parliament and the European Commission – to evaluate the EU counter-terrorism policies. As a Democrat, I think evaluation is an essential part of democracy. It is about transparency, accountability to our citizens and making our policies better and more efficient. I think that a democracy that is unable and unwilling to take a critical look at its own policies is not worth the term ‘democracy’. If we are convinced that we have got it right in our policies, I think we can be confident that they will stand the test.

We do not only have a duty to our own citizens, we also have to be a moral compass in the world. Frankly, colleagues, I feel that if we are unable to carry out a thorough evaluation of the measures we have taken over the last ten years, we lose all credibility and moral authority, and that is particularly important at the time of the Arab Spring. How can we look the young people in North Africa in the eye and say to them – with credibility – you have to create democracy and the rule of law, respect human rights and live by the principles of accountability and transparency, if we do not live up to that and are unwilling to do it ourselves?

I have to say that there is a great deal of controversy around this report; I think this is very regrettable and disappointing. I did expect a controversial debate, but I did not expect it to be quite this acrimonious. We voted in July, but ever since the vote, several Members and Groups have changed their positions, in some cases by 180 degrees. Texts that were agreed unanimously are now being put forward for deletion by several Groups. I find that surprising.

Now let us have a look at the texts that are so incredibly shocking and radical that they have to be taken out. First there is a paragraph – paragraph 26 – that was agreed unanimously (I underline unanimously) by all the political groups, referring to Article 70 of the Treaty – very shocking, very radical – calling for an evaluation on the basis of that same Treaty. There is, for example, a paragraph saying that we should not only address the consequences of terrorism but also the causes; very radical. There is a paragraph calling for impact assessments and proportionality tests; very radical – except it is already compulsory. There is another paragraph referring to proper access to documents: that is the official position of this House!

So I have to say I am very surprised by some of the requests for separate votes. However, I do think that in this case – and I will conclude on that, Chair – it is much more important that we achieve a result. I will try until the very last moment to bring people together and see if we can arrive at some sort of agreement, because we owe it not to this House, but to our citizens and to the rest of the world.

  Agustín Díaz de Mera García Consuegra (PPE). - Señor Presidente, rechazo este informe por improcedente, equivocado, desinformado, extemporáneo y subjetivo. La lucha contra el terror es muy necesaria y debe ser eficaz, disuasoria y también preventiva. Aunque se debe valorar, nunca se deben evaluar sus costes en términos económicos. ¿Cuántos euros cuesta una vida? ¿Y cuántos cuestan tres mil vidas?

Apoyo a los jueces y policías democráticos y confío en ellos, y creo en nuestra vitalidad democrática para corregir los abusos de poder que se pudieran producir. También cito el salmo 46 en términos solidarios: «Por tanto, no temeremos, aunque la tierra sea removida y se traspasen los montes al corazón del mar». Y la ausencia reflejada también la comparto; está presente en mi corazón y en mis oraciones como lo están las víctimas, todas: las de Madrid, las de Londres, las de Marrakech, las de Casablanca, las de Bali: todas.

No, señor Presidente, este informe de iniciativa es una mala iniciativa.

  Juan Fernando López Aguilar (S&D). - Señor Presidente, el debate de este informe de iniciativa tiene lugar en el momento en que conmemoramos diez años de los atentados del 11 de septiembre en los Estados Unidos, que nos ponen de manifiesto que la amenaza del terrorismo es una amenaza real, no un producto de nuestra imaginación, y además está aquí para quedarse, de modo que el mundo en el que se vivió, en el que la Humanidad vivió a mediados del siglo XX, no va a volver.

Por tanto, tenemos que ser muy conscientes de que este es el momento en que una competencia tradicional de los Estados —proveer seguridad— es también una responsabilidad de la Unión Europea, y lo es de todas sus instituciones. Lo es de las agencias especializadas —Europol, Eurojust—, pero lo es también del Parlamento Europeo, que ciertamente tiene un compromiso con la transparencia, con el escrutinio político y, por tanto, con la evaluación de las políticas en materia de seguridad que el Tratado de Lisboa confía ahora, a partir de este momento y en lo sucesivo, a la Unión Europea y también al Parlamento. Pero este también tiene un compromiso con la seguridad: no solamente debe velar por los derechos de libertad, sino por los derechos de seguridad, y emitir un mensaje de solidaridad con las víctimas del terrorismo, con los países que luchan contra el terrorismo en Europa...

  Izaskun Bilbao Barandica (ALDE). - Gracias, Sophia, por tu trabajo, porque necesitamos una asistencia específica para las víctimas, porque tenemos que saber lo que gastamos en luchar contra el terrorismo, qué impacto tiene ese trabajo en las libertades de todos y cuánto cuesta en términos humanos, sociales, económicos y políticos. Debemos esa transparencia a la ciudadanía si queremos generar confianza y consenso.

En mi país el terrorismo ha matado a casi novecientas personas, y ese es un coste injustificable, en vidas, en dolor. Algunos creyeron, además, que mataban en nuestro nombre, y vivimos escoltados mientras nos acusaban de colaborar con ETA. Los prejuicios políticos han impedido que la policía vasca participe en Schengen, y eso ha costado vidas. Hasta cerraron un periódico injustamente, y nuestro Parlamento ha perdido legitimidad porque algunas sentencias facilitaron mayorías absolutas a quienes no las tienen en las urnas.

El independentismo y la defensa del derecho de autodeterminación son ideas legítimas; lo que es peligroso es ETA, que afortunadamente acaba. Es una expresión de extremismo violento como otras; reprimirla obliga a detenerles, pero además hay que fortalecer la democracia con debate, transparencia y más respeto a la ciudadanía.

Vielen Dank an die Berichterstatterin Sophia in't Veld für die Vorlage dieses Berichts, der im Ausschuss für bürgerliche Freiheiten, Justiz und Inneres eine breite Mehrheit erhalten hat! Ich wundere mich ein wenig, dass das hier von einigen Fraktionen wieder aufgemacht werden soll. Ich wundere mich auch über die Reaktion von Herrn Díaz de Mera.

Ich halte es für absolut notwendig, dass wir die Antiterrorismuspolitik der EU evaluieren, und zwar vor allen Dingen, um eine bessere Terrorismuspolitik zu gewährleisten. Das heißt also, wer wie ich absolut dafür eintritt, dass wir Terroristen verfolgen und dass wir Terroranschläge verhindern, der muss dafür eintreten, dass wir auch die zehn Jahre Bemühungen, die wir hinter uns haben, effektiv evaluieren, und zwar sowohl was die Prioritätensetzung angeht, was die Kosten angeht, als auch was das Verhältnis der Eingriffe z. B. in Bürgerrechte und in rechtsstaatliche Normen angeht, und dass wir auf der anderen Seite die Maßnahmen evaluieren, die wir ergriffen haben. Ich denke, dass das der Bevölkerung und auch diesem Parlament wichtig ist, und dass es richtig wäre, das jetzt zu tun. Ich halte es für absolut gefährlich, jetzt hier sozusagen wieder in die Lager zurückzufallen.

  Jaroslav Paška (EFD) - Úvodom považujem za potrebné potvrdiť konštatovanie uvedené v bode 12 správy, že v Európskej únii má hrozba terorizmu viac rozmerov a že mnohé nebezpečenstvá pramenia aj zo separatistických nálad podnecovaných separatistickými hnutiami. Preto musíme v budúcej stratégii vnútornej bezpečnosti Európskej únie rozlišovať medzi medzinárodným, nábožensky motivovaným terorizmom a teritoriálnym, separatisticky orientovaným terorizmom s viacerými tlejúcimi ohniskami aj vo vnútri Európskej únie. Lepšou koordináciou vnútroštátnych politík v oblasti boja proti terorizmu s politikou Únie musíme dosiahnuť to, aby opatrenia a nástroje v oblasti boja proti terorizmu sa zbytočne nezdvojovali, ale aby v systéme ani nezostávali možné prázdne medzery. Vzhľadom na to, že terorizmus je dynamicky sa vyvíjajúcim javom, musí byť aj Európska politika na jeho potieranie kreatívna tak, aby dokázala eliminovať všetky jeho hrozby.

  Martin Ehrenhauser (NI). - Herr Präsident! Der britisch-österreichische Philosoph Karl Popper hat einmal gesagt: „Wir müssen für die Freiheit planen und nicht für die Sicherheit, wenn auch vielleicht aus keinem anderen Grund als dem, dass nur die Freiheit die Sicherheit sichern kann.“ Meiner Ansicht nach sind die Europäische Union und auch ihre Mitgliedstaaten von einer gegenteiligen Erkenntnis geleitet und bauen sukzessive den liberalen Rechtsstaat zu einem Präventionsstaat um. Ein Beispiel: Im Siebten Rahmenforschungsprogramm werden insgesamt 1,4 Mrd. Euro für den Bereich Sicherheit ausgegeben. Von den zirka 120 Projekten beschäftigen sich lediglich zwei mit Datenschutz oder mit den juristischen und den sozialen Fragen. Genau aus diesem Grund ist es wichtig – und das ist genau, was Frau Kollegin in't Veld gemacht hat –, dass man immer wieder sehr kritisch die Grundrechte hinterfragt und auch mit Blick auf die Privatsphäre den Datenschutz in den Bericht aufnimmt. Es ist auch wichtig, dass man die letzten zehn Jahre evaluiert. Aus diesem Grund werde ich den Bericht selbstverständlich unterstützen und in den nächsten Stunden auch für weitere Unterstützung werben.

  Teresa Jiménez-Becerril Barrio (PPE). - Señor Presidente, quisiera decir a todos que existe solo un tipo de terrorismo: existe solo aquel terrorismo que destroza la vida de inocentes, no importa de donde venga.

Las víctimas del terrorismo, a las que represento –porque la organización terrorista ETA asesinó a mi hermano y a su mujer–, tienen un hilo conductor y, en nombre de ellas, quiero decir que este informe, con este título tan largo, podría haber sido una cosa ambiciosa y no lo es. El resultado es decepcionante. Este informe no nos representa, no representa las aspiraciones de justicia ni ese equilibrio, del que tanto hablamos aquí, entre libertad y seguridad. No nos representa, y creo que un informe que habla de terrorismo tendrían que agradecerlo las víctimas del terrorismo, que no lo agradecen. Por lo tanto, pido un voto contrario a este informe.

  Anna Hedh (S&D). - Herr talman! Jag vill tacka Sophia in 't Veld för ett bra jobb. Jag beklagar verkligen de problem som har uppstått under vägens gång. Det är skamligt.

Denna fråga är högst aktuell, inte bara med anledning av 10-årsdagen av 11 september utan också på grund av terroristattacken på Utøya i Norge i somras. Trots att medlemsländerna har olika erfarenheter av terrorism och att hotbilderna ser olika ut, måste vi samarbeta så att terroristerna inte utnyttjar de olikheter som finns i EU med avseende på lagstiftning, kapacitet att bekämpa terrorism och avskaffandet av gränskontroller.

Syftet med strategin mot terrorism bör vara att bekämpa terrorismens mål som är att försöka störa våra fria, öppna och demokratiska samhällen. Det säkraste sättet att bekämpa terrorism är att satsa på förebyggande åtgärder mot våldsam extremism och upptrappning av våld. Därför är jag glad över det nätverk som kommissionär Malmström presenterade häromdagen. Jag vill att kommissionen ska göra en ordentlig utvärdering av de uppställda mål som strategin för terroristbekämpning ...

  Elena Băsescu (PPE). - Salut dezbaterea acestui raport la împlinirea a zece ani de la atentatele care au schimbat politica antiteroristă la nivel global. În amendamentele pe care le-am propus, am susţinut cooperarea internaţională în combaterea terorismului, însă cu respectarea drepturilor omului. Noul Serviciu European de Acţiune Externă are un rol esenţial în acest demers. Prin coordonarea cu structurile Consiliului şi cu agenţiile europene se asigură un răspuns unic la provocările de securitate actuale.

În raport cu celelalte organizaţii internaţionale, tratatele relevante ale ONU îndeplinesc funcţia de reper legal. Atrag atenţia asupra articolului 23. În contextul ultimelor evoluţii din Africa de Est, este importantă includerea Somaliei pe lista statelor vizate de politica antiteroristă a UE.

Consider că UE are datoria de a prezenta o strategie proprie, clară şi concentrată pe rezultate în acest domeniu.

  Monika Flašíková Beňová (S&D) - Politika boja proti terorizmu sa dostáva alarmujúco do popredia a s tým stúpa aj nevyhnutnosť vytvorenia jednoznačných pravidiel na jej využívanie, a to najmä tak, ako uviedla spravodajkyňa s ohľadom na dodržiavanie základných práv a ochranu údajov občanov Európskej únie.

Chcela by som vyzdvihnúť najmä potrebu zosilnenia justičnej a policajnej spolupráce v rámci Európskej únie ako nevyhnutný a potrebný nástroj dosiahnutia všetkých atribútov demokracie. Takáto spolupráca by však podľa môjho názoru mala prebiehať pod dohľadom Európskeho parlamentu, ako aj národných parlamentov, a to najmä v rozsahu transparentnosti a prístupu k dokumentom, ako aj celej Európskej protiteroristickej politike. Navrhujem preto, aby došlo k posilneniu justičnej spolupráce, najmä v oblasti obžaloby a vyšetrovania s možnosťou zmraziť majetok, ochranu svedkov a obetí takýchto trestných činov, mieru kompenzácie pre obete terorizmu a podobne. Apelujem preto na všetky inštitúcie Európskej únie, aby pri ich činnosti aplikovali chartu a dodržiavali všetky základné práva a slobody práve v takejto citlivej oblasti.

  Antonio Tajani, Vice-président de la Commission. − Monsieur le Président, je tiens à remercier, de la part de ma collègue, Cecilia Malmström, que je représente ici ce soir, madame la rapporteure et les autres députés de ce Parlement pour leur contribution à l'élaboration de ce rapport. Il s'agit assurément d'une précieuse contribution au débat sur la politique antiterroriste.

Dans le prolongement de la communication récapitulative de la Commission du mois de juillet 2010, des rapports prévoient un programme très ambitieux pour accroître le niveau des connaissances sur les efforts des politiques antiterroristes en Europe. La Commission soutient les mesures visant à l'amélioration des évaluations et, partant, de l'élaboration des politiques. Il est indéniable que l'imposition de lourdes charges économiques ou une limitation superflue des droits fondamentaux et des libertés civiles profiteraient exclusivement à ceux que nous tentons de contrer.

Seules des politiques mesurées pourront être légitimes, crédibles et bien comprises. Il convient de les superviser, de les évaluer et de les appliquer sans relâche. Toutefois, une simple approche économique, fondée sur une analyse coûts/bénéfices, ne suffit pas pour apprécier le caractère complexe des questions de sécurité, qui répondent à une préoccupation essentielle des citoyens et constituent un bien public fondamental de nos sociétés. En outre, plusieurs des mesures proposées pourraient s'avérer inapplicables, le champ d'application de certaines d'entre elles n'étant pas clairement défini. Ainsi, il semble irréaliste, à court terme, d'envisager une évaluation approfondie et détaillée de dix années de politique antiterroriste dans l'Union européenne, notamment en raison de la multitude des politiques et mesures de lutte contre le terrorisme proprement dites ou qui s'y rattachent. Qui plus est, la Commission ne dispose pas pour l'instant de ressources suffisantes pour accomplir pareille tâche.

Par ailleurs, un recensement de toutes les politiques antiterroristes des États membres devrait permettre d'y voir plus clair. Les coordinateurs de l'Union pour la lutte contre le terrorisme pourraient jouer un rôle important à cet égard en contribuant à cet inventaire et en assurant un travail de coordination grâce à ce lien privilégié avec les administrations des États membres.

  Bruno Gollnisch (NI), par écrit. En lisant le rapport de Mme In't Veld j'ai été surpris par la candeur de certaines de ses affirmations ou propositions. A coup sûr, Mme In't Veld n'est pas une spécialiste du terrorisme, ni même de la lutte anti-terroriste telle qu'elle est menée dans les Etats membres. Et elle a la mémoire courte ! Adversaire du profilage, elle laisse cependant entendre qu'une part du terrorisme qu'elle qualifie de "religieux" viendrait de minorités défavorisées insuffisamment intégrées. Or, la plupart des auteurs des attentats de cette dernière décennie étaient parfaitement intégrés, avaient un diplôme d'études supérieures, un emploi et la nationalité d'un pays de l'Union.... Adepte de la transparence tous azimuts, du calcul coût-avantage et du débat démocratique sur la politique menée, elle préfère ruiner tous les efforts de services de police ou de renseignement dont le succès dépend justement de la discrétion. Et ce qu'elle propose revient exactement à informer les terroristes potentiels de nos faiblesses et des meilleures cibles possibles. Si j'avais eu besoin que l'on me convainque que la lutte anti-terroriste est un domaine que l'on doit préserver au maximum de l'action néfaste de l'Union et de ses institutions, le rapport de Mme In't Veld y aurait sans aucun doute réussi.

  Ágnes Hankiss (PPE), in writing. During the year-long preparations the EPP Group presented a unanimously firm position by expressing its discontent over the tone and subject matter of the report. I had a negative opinion about the report. Reservations were twofold: a matter of both principle and the practical approach. I was critical of the tone determined by prejudices, an assumption that counter-terrorism keeps violating human rights, operates with excessive budgets and exaggerates threats. These propagandistic assumptions were based on hypotheses for which no evidence was provided by the rapporteur. The goals laid down in the report are hardly feasible in practice but the rapporteur showed no intention of reflecting on this. As data is classified for security reasons, to what extent and on which benchmarks should the proportionality between the cost of a preventive counter-terrorism operation and the threat level be assessed? As supporters of transparency and accountability, the EPP Group stands for overseeing counter-terrorism policies; however, within the established competence of designated authorities, not bodies made up of ambitious civilians or self-declared politicians. Undermining the morale of counter-terrorism, especially nowadays, is proof of irresponsible behaviour, thus the EPP is not in a position to support a report reflecting any political campaign jeopardising security.

  Petru Constantin Luhan (PPE), în scris. La 10 ani de la atacurile de la 11 septembrie 2001, ameninţările teroriste continuă să pună serioase probleme Uniunii Europene şi cetăţenilor săi, cu 249 de atacuri înregistrate în 2010 numai pe teritoriul european. Comisia Europeana trebuie să aibă în vedere o creştere a fondurilor destinate măsurilor de asistenţă pentru combaterea terorismului în cadrul viitorului Instrument pentru stabilitate.

Conform unor declaraţii ale Directorului Europol făcute anul acesta în cadrul Parlamentului European, grupările teroriste devin din ce în ce mai diverse şi flexibile în modul de operare, existând dovezi ale intensificării colaborării internaţionale dintre grupări. Tocmai de aceea, este necesară extinderea şi consolidarea parteneriatelor strategice existente privind combaterea terorismului şi încheierea altora noi cu ţări din exteriorul Europei.

  Andreas Mölzer (NI), schriftlich. Russen und Amerikaner haben während des Kalten Krieges die Saat für Terroristen wie Bin Laden gestreut. Bin Laden mag mittlerweile Geschichte sein. Aber er hat eine Radikalisierung der Terrorismusbekämpfung bewirkt. Als erstes fielen rechtsstaatliche Prinzipien dem „Krieg gegen den Terrorismus“ zum Opfer. Sogar in der EU wurden im Namen der „Terrorismusbekämpfung“ Menschenrechtsverletzungen begangen und vertuscht. Den USA ging es doch oft mehr darum, ihre Führungsrolle auszubauen, als dem Terrorismus die Wurzeln zu entziehen. Und diese sind nun einmal nationale, ethnische und religiöse Konflikte. Noch bevor Menschen Straftaten begehen, geraten sie nun schon ins Visier der Fahnder, müssen etwa unbescholtene Fluggäste alle Daten offenlegen – Belege für Fahndungserfolge des Daten-Striptease gibt es keine. Und jetzt will man nach dem Norwegen-Attentat gar ein eigenes Netz „zur frühzeitigen Erkennung möglicher Gewalttäter“ aufbauen. Das ist grotesk! Wird dann jeder, der „radikale Gedanken“ hat, jeder, der nicht den Vorgaben der Political Correctness entspricht, gleich als potenzieller Terrorist überwacht? Eine solche Entwicklung ist aufs Schärfste abzulehnen. Überdies muss auch beim Behördenmix aus Polizei und Geheimdienst endlich eine klare Trennung eingeführt werden. Schlussendlich ist auch die Rolle der EU-Staaten bei den CIA-Operationen restlos aufzuarbeiten.

  Siiri Oviir (ALDE), kirjalikult. Antud raport analüüsib hästi praegust ELi terrorismivastase võitluse poliitikat ning vajakajäämisi. Olen päri, et terrorismivastane võitlus vajab ühist lähenemisviisi, hoolimata sellest, et liikmesriigiti võib olukord antud valdkonnas tunduda väga erinev. Piisab sellest, kui üks ELi liikmesriik on alahinnanud terroriohtu, ning tagajärjed võivad olla katastroofilised. Terrorismivastane võitlus ei tähenda mõistagi seda, et tegeleme vaid tagajärgedega. Senisest enam tuleb investeerida rassismi ja diskrimineerimise vastasesse poliitikase. Kahtlemata peab ühiskond olema tähelepanelik, et terrorismivastase võitluse sildi all ei rikutaks meie kodanikuühiskonna liikmete põhiõigusi. Samuti pean ohtlikuks paljude nende suurriikide võimude käitumist, kes tembeldavad liiga kergekäeliselt „ebamugavaid inimesi” terroristideks, kuna nad julgevad seista väikerahvaste inimõiguste eest ning ei ole päri kõikide keskvõimu otsustega. Mõistagi tuleks konkreetselt defineerida terrorismi ja terroristi mõiste Euroopa tasandil, et iga inimõiguste aktivisti, kes on poliitiliselt vastuolus võimuesindajatega, ei hakataks alusetult terroristiks nimetama või terrorismis süüdistama, nii nagu oli see kahjuks kombeks endises Nõukogude Liidus.
