  Herbert Reul, Verfasser. − Frau Präsidentin, sehr geehrte Kolleginnen und Kollegen, Herr Kommissar, Vertreter des Rates! Netzneutralität ist die Beschreibung dafür, dass wir eine neutrale Übermittlung im Internet haben wollen, unabhängig von Ursprung und verschicktem Inhalt. Das ist gegenwärtig der Fall.

Wir haben aber ein offenkundiges Problem, dass sich das weltweite Datenvolumen bis 2014 – so ist die eine Berechnung – auf 767 Exabyte möglicherweise vervierfachen wird und dass der festnetzgestützte Datenverkehr um jährlich 35 % und der mobilfunkgestützte Datenverkehr um jährlich 107 % zunehmen wird. Es wird eng auf den Datenautobahnen, und temporäre Überlastungen und Staus können zu Qualitätsverlusten führen.

Das heißt erstens: Der Ausbau der Netze ist zwingend notwendig. Dazu hat dieses Parlament schon viele Initiativen ergriffen, gerade jüngst noch unter der Federführung des Kollegen Hökmark. Wir haben ein Problem beim Netzausbau, das auch daraus resultiert, dass Telekom-Unternehmen für den Netzausbau zahlen, die Anbieter im Internet dafür aber nichts bezahlen. Das ist ein Stück der Grundlage, warum eine Debatte jetzt in den letzten Jahren verstärkt stattfindet, dass nachgefragt wird: Gibt es jetzt schon bestimmte Reaktionen von Betreibern, die Einschränkungen im Netz vornehmen lassen. BEREC hat Anfang 2010 eine entsprechende Untersuchung unter den Mitgliedern vorgenommen und hat festgestellt, dass bestimmte Betreiber Daten teilweise ungleich behandeln – also im Zusammenhang mit Einschränkung der Geschwindigkeit, mit Erhebung oder Sperrung oder Erhebung von zusätzlichen Gebühren, um Beispiele zu nennen.

Auf europäischer Ebene gibt es – und das macht die Debattenlage ja jetzt aus – keine einheitlich feste Definition, was Netzneutralität ist. Es gilt der Grundsatz, die Endbenutzer müssten in der Lage sein, Informationen abzurufen und zu verbreiten oder beliebige Anwendungen und Dienste zu nutzen. Das ist auch bisher in allem, was wir hier beschlossen haben, festgeschrieben, z. B. in der Rahmenrichtlinie von 2002 und auch im Telekommunikationsreformpaket aus dem Jahr 2009. Das war eine sehr anstrengende Verhandlung. Frau Kollegin Trautmann wird sich daran noch gut erinnern. Auch da hat die Kommission noch einmal die Absicht formuliert, dass die Erhaltung des offenen, neutralen Charakters des Internets eine hohe Bedeutung hat und die Netzneutralität zu erhalten ist. Dies sei ein politisches Ziel, das auch von den nationalen Regulierungsbehörden festgeschrieben werden solle.

Was jetzt ansteht und die uns beschäftigt hat – und das war auch der Grund, warum der Industrieausschuss, aber nicht nur er, sondern auch der IMCO-Ausschuss sich zum jetzigen Zeitpunkt mit der Frage befasst –, ist, dass wir feststellen, dass es in einzelnen Mitgliedstaaten schon Reaktionen darauf, gesetzgeberische Entscheidungen gibt, und dass auf der anderen Seite die Untersuchung von BEREC vorliegt und der Zusatzauftrag der Kommission, die Daten doch noch einmal genauer zu untersuchen, um festzustellen, an welchen Stellen es welche Probleme gibt. Insgesamt formuliert die Kommission ja offensichtlich den Hinweis, dass es keine größeren Probleme gibt.

Und weil im Dezember der Telekommunikationsrat tagt, sind wir der Auffassung, dass wir als Parlament uns vorher mit dieser Frage befassen müssen, und haben diese deshalb hier eingebracht, und zwar im Zusammenhang mit der Debatte über den Auftrag an die Mitgliedstaaten, die Bestimmungen des Telekommunikationsreformpakets bis zum 25. Mai 2011 umzusetzen. Zwei Fragen sind vom Rat zu beantworten. Wir möchten wissen, wie der Rat die Auswirkungen dieses Reformpakets von 2009 auf die Sicherstellung des offenen Internets und der Netzneutralität in Europa einschätzt und wie der Rat einen gemeinsamen Ansatz im Hinblick auf das offene Internet und die Netzneutralität im gesamten EU-Raum gewährleisten will.

Für uns als Ausschuss ist wichtig, dass wir der Auffassung sind, dass es hier eine europäische gemeinsame Grundlage geben muss, dass wir keinen zersplitterten Raum haben können und dass wir deswegen die Lage beurteilen, analysieren, dann aber auch notwendige Konsequenzen ziehen müssen, fall es notwendig ist. Wir bekommen eine Unterlage der Kommission und erwarten jetzt die Antworten.

  Malcolm Harbour, author. − Madam President, it is a privilege to be working once again with my distinguished colleagues on the Committee on Industry, Research and Energy, because we had a very fruitful partnership in the reform of the telecoms package. I am very pleased that Mrs Trautmann and Mrs Pilar del Castillo Vera, who were jointly, with me, the three rapporteurs on the Telecoms Directive – sometimes rather unkindly known as the three musketeers for some reason – are together again and addressing this issue.

My colleagues will remember that, from the side of the consumers’ and users’ rights reforms, together with the basic principles in the framework directive we spent a huge amount of time and energy crafting amendments to the existing telecoms framework to deal with some of the potential issues that might arise in a framework in which broadband speeds, access to much greater bandwidth of communications and ability to offer different ranges and types of services on the internet might bring about the sort of anti-competitive behaviour which would restrict the rights of consumers to access and distribute content and services of their choice.

That indeed was the fundamental piece that was introduced into the framework directive itself. It is worth just recalling that – that ability of end users to access and distribute information and to run applications and services of their choice is absolutely at the heart of this whole debate about so-called net neutrality and the choices that were put on the table.

The Commission, at our invitation, has been following this very closely, but of course my fellow chairman, Herbert Reul, is quite right in saying that the test at the moment is to see how the reforms that we put in place in the Telecoms Package are actually working out in practice.

What were the issues that were put on the table to deal with ensuring that this open character of the internet is maintained and continues to be delivered?

First of all there was the whole principle of ensuring competition – giving consumers choice of services, but above all actually being able to switch providers if they did not like the types of services that were on offer or indeed any restrictions that might be placed on access to certain types of services. There is nothing intrinsically wrong with having offers that may be limited in choice at a lower price, provided that consumers know what they are getting. That is the crucial point here. So within the universal service and users’ rights element we ensured that the ability to switch easily – and particularly if it was a voice service to take your number or indeed your internet address very speedily and quickly within one day – was enshrined within that.

Secondly, the transparency of the offers that consumers are getting is absolutely fundamental. The Commission has been consulting about, and a number of regulators have been looking at, the whole issue of what the actual advertised delivery speed of one’s connection is, what the management measures are and what service providers are doing to deal with times where there may be limitations of capacity in times of network overload. That applies particularly to mobile operators – as many of us will know.

That transparency of contract terms is a fundamental requirement of the telecoms package and we have asked the Commission to make sure that, in every country, regulators are enforcing those transparency and information requirements alongside the switching aspect.

Finally, in terms of what we put in – and colleagues will remember the famous Article 21 of the reform on the Users’ Rights Directive – we have actually given regulators, for the first time, the ability to intervene in the marketplace if they see that an operator is actively discriminating against a content carried on its networks that competes with content of its own. In other words, if an operator actually artificially degrades the quality of service provision for a particular service where it is providing a competing service. I think we would all agree that this is absolutely unacceptable. That is clearly discriminatory behaviour as regards quality of service on the internet and undermines the whole principle of net neutrality.

We have given the regulators those powers and they are invited to use them. Of course, one of the major achievements of the telecoms package was to have a body of European regulators – the BEREC that was in Mrs del Castillo Vera’s proposal – and they are the people whose job it is to ensure that that is being carried out.

There is a lot on the table. This is a good report and a good resolution, but the proof of the pudding will be in the implementation of what we have asked for.

  Magdalena Gaj, Urzędująca Przewodnicząca Rady. − Pani Przewodnicząca, Panie Komisarzu, Panie Posłanki, Panowie Posłowie! Na początku chciałabym podziękować za pytania obu komisjom i obu przewodniczącym: panu przewodniczącemu Reulowi i Harbourowi. Jest to niezwykle istotne, że możemy dzisiaj dyskutować właśnie na temat pakietu telekomunikacyjnego z 2009 r., a w szczególności o tak istotnej kwestii, jaką jest otwarty internet i zasada neutralności sieci. Kwestie te są niezwykle ważne, a w szczególności w dzisiejszych czasach, kiedy to internet i wszystkie narzędzia informacyjno-komunikacyjne są motorem napędowym naszej gospodarki i być może będą jednym z narzędzi, które pomogą wyjść Europie, a nawet całemu światu z kryzysu. Sukces internetu w mojej ocenie to sukces osiągnięty dzięki otwartości i możliwości korzystania z niego w prosty, przystępny i jasny sposób przez każdego z obywateli. Dlatego właśnie ta dyskusja jest w mojej ocenie jako urzędującej przewodniczącej Rady niezwykle istotna.

W odniesieniu do pierwszej części pytania związanego z oceną implementacji tego pakietu w państwach członkowskich, chciałabym po pierwsze wskazać, że wszyscy jesteśmy świadomi, iż od chwili przyjęcia nowych unijnych przepisów dotyczących telekomunikacji w listopadzie 2009 r. od krajowych organów regulacyjnych wymaga się promowania wśród użytkowników końcowych możliwości dostępu do informacji oraz korzystania z wybranych przez nich aplikacji i usług. Promowanie tych możliwości następuje poprzez wspieranie wymogów przejrzystości informacji kierowanej do abonenta. Ponadto krajowym organom regulacyjnym przyznano również bardzo istotne prawo do ustalania minimalnych wymogów w zakresie jakości usług. Państwa członkowskie uznają znaczenie skutecznego wdrażania tych wymogów przy zachowaniu otwartego charakteru internetu i zagwarantowaniu ogólnie dostępnego stabilnego internetu. Państwa członkowskie są również świadome pewnych obaw co do dyskryminujących form zarządzania i postępowania z danymi, przejrzystości cen i jakości usług, zarówno w sieci, jak i w zakresie ochrony danych osobowych. Państwa podkreślają zatem znaczenie zapewnienia konsumentom przejrzystych informacji tak, aby każdy mógł świadomie wybrać ofertę, na którą się decyduje, czy to ograniczoną, czy po innej cenie w pełnej wysokości – konsument musi być jednak świadomy oferty, która jest do niego kierowana, oraz podkreślają potrzebę zajęcia się kwestiami dyskryminacji i pogarszania się jakości usług, które mogą być skutkiem pewnych praktyk w zarządzaniu ruchem w sieci. W związku z tym Rada podkreśla ważną rolę BEREC i Komisji Europejskiej wraz z krajowymi organami regulacyjnymi w zakresie analizy rynku i oceny zgodności działań operatorów z przepisami ram regulacyjnych.

Co stało się do tej pory? Oczywiście wiemy o tym, że nie wszystkie państwa członkowskie dokonały już implementacji pakietu – musimy pamiętać, że jest to kilka obszernych dyrektyw, które wymagają głębokiej analizy, i te procesy implementacji mają się ku końcowi w każdym państwie członkowskim. Natomiast wprowadzenie zasady neutralności sieci i wszystkich wymogów związanych z przejrzystością już wywołały ogromne debaty w poszczególnych państwach członkowskich. Takie debaty odbyły się chociażby w Polsce, czy we Francji – debata z uczestnikami rynku i z uczestnikami łańcucha internetowego, czyli operatorami telekomunikacyjnymi, dostawcami treści i poszczególnymi uczestnikami rynku powoduje, że będziemy mogli za chwilę dyskutować też o częściowej samoregulacji, która jest bardzo istotna. Zatem te przepisy zaczynają już funkcjonować.

W odniesieniu do drugiej części pytania chciałabym wskazać, iż Rada, zauważając konieczność jednolitego podejścia do tej kwestii, przygotowała swoje konkluzje do komunikatu Komisji w sprawie otwartego internetu i neutralności sieci. W związku z tym na najbliższej Radzie Ministrów w dniu 13 grudnia br. będziemy przyjmować takie konkluzje Rady i myślę, że to zapewni wspólne i powiązane z przepisami zmienionych ram regulacyjnych podejście do tego tematu. Rada z zadowoleniem przyjmuje zobowiązanie Komisji do monitorowania procesów wdrażania ram regulacyjnych Unii oraz jej gotowość do dalszej analizy tych aspektów neutralności sieci, z którymi wiążą się znaczne i trwałe problemy, zachęca Komisję oraz BEREC do monitorowania obecnych praktyk, aby eliminować przypadki złego zarządzania ruchem. Jeśli następuje już zarządzanie ruchem, powinno ono odbywać się z poszanowaniem proporcjonalności, przejrzystości, zapewnienia niezakłóconego przepływu oraz zagwarantowania przejrzystości cen i takiej formy wymogów dotyczących jakości usług, która nie wpływa na neutralność sieci.

W konkluzjach Rada popiera wyrażony przez Komisję zamiar oceny w oparciu o dane zaczerpnięte z badania BEREC, potrzeb opublikowania dodatkowych wskazówek lub przyjęcia dalszych regulacji. Jeśli taka potrzeba wystąpi, takie dokumenty zostaną przygotowane, to Rada zgodnie z przysługującymi jej kompetencjami legislacyjnymi zajmie się tymi dokumentami. Przepraszam, że przekroczyłam czas.   Karel De Gucht, Member of the Commission. − Madam President, I am pleased to be here to respond on behalf of the Commission in the absence of Neelie Kroes, who has had to go to Warsaw.

Open internet is an issue that affects every one of us and is increasingly an economic essential. The Commission has stressed on several occasions the importance of having an open internet, accessible to everyone, from the innovators who provide content, to those who use it.

The Commission thinks that the best way to deliver an open internet is through competitive markets. But for competition to work properly, consumers need to make informed choices, and to know exactly what service they are getting. They also need to be able to switch operators easily and quickly.

The new telecoms rules approved in 2009 specifically require operators to be transparent about the service they offer and the traffic management techniques they apply. They also help their consumers to switch operator, in particular by improving number portability procedures and conditions for contract subscription and termination. If needed, they empower national regulators to set minimum quality of service requirements.

These rules, which had to be implemented by May this year, have not yet been fully transposed in all Member States. The Commission is vigilantly monitoring their implementation. This will allow us to ensure that open and neutral internet principles are respected in practice.

In addition, the Commission has asked the Body of European Regulators for Electronic Communications (BEREC), in which all the Member States’ telecoms regulators are represented, to undertake a rigorous fact-finding exercise on these issues, including barriers to changing operators, blocking or throttling of internet traffic, voice over internet services, transparency and quality of service.

We need to know what the situation is: whether customers really do know what service they are signing up to, whether throttling and blocking are really common practices and what the impact is on the service quality delivered to the end-user. We also want to make sure that consumers can switch providers easily, if they do not like the service they are getting.

In parallel, BEREC is working on guidance and transparency. It is working on a framework for net neutrality and quality of service, which looks specifically into how to use minimum quality of service requirements as specified in Article 22 (3) of the Universal Service Directive. It is also working on the competition issues relating to net neutrality.

Building on BEREC’s and any industry’s inputs and based on its own analysis, the Commission will decide whether additional guidance or more stringent measures regarding open internet and net neutrality are necessary – and by the way, as the Council has rightly stated, we will make public BEREC’s findings.

It is very important that we have the facts and figures before acting. If we do need to act, we must do so in a coordinated way across Europe. I would therefore urge national regulators to collaborate with their peers and the Commission when considering regulatory action in this area, and to act on the basis of facts.

At this stage, I cannot yet tell Members yet whether the Commission will develop additional guidance or general legislative measures to enhance competition and consumer choice, such as by further facilitating consumer switching. However, we are very confident we will receive all the necessary input to make an informed decision. The House can be sure that any proposal in this area will be subject to an in-depth assessment of their impact, including on fundamental rights.

Much is at stake in the area of open internet and net neutrality. The Commission wants to make sure that sound policy initiatives are developed that help deliver the objectives of the Digital Agenda for Europe.

  Lambert van Nistelrooij, namens de PPE-Fractie. – Voorzitter, vertegenwoordigers van de Raad en de Commissie, collega's, de EVP-fractie heeft de netneutraliteit als één van de belangrijkste uitgangspunten verankerd en ondersteund in het telecompakket van 2009. We willen daarmee innovatie stimuleren, het aantal internetdiensten uitbreiden. Dat lukt, ook in deze crisistijd, wonderwel. Het aantal functies neemt sterk toe, en het gaat hier om een echte groeisector, misschien wel de grootste groeisector in Europa. Breedband opent een nieuwe wereld, een wereld van functies voor burgers, voor bedrijven en voor overheden. Fun en functie gaan hier nadrukkelijk samen.

Nu gaat het om die omzetting in de lidstaten. Er zijn netwerkbeheerders die nieuwe aanbieders daadwerkelijk blokkeren, onnodig hoge rekeningen presenteren. Dat was ook in Nederland het geval. Herbert Reul heeft daarstraks ook al andere voorbeelden gegeven. Zo werden Skype en WhatsApp gehinderd. Daarom is er in Nederland een aanvullend wetsvoorstel in behandeling. Op zich is daar niets mis mee, maar het kan toch niet zo zijn dat alle landen eigen regelgeving gaan maken, waardoor je uiteindelijk wat betreft die ene internetruimte in Europa toch weer inlevert. De meerwaarde van de ene digitale ruimte, een open internet, staat bij ons buiten kijf.

Afsluitend, beide commissies geven nu een signaal af naar de lidstaten, om helder te zijn ten aanzien van de omzetting. Ten tweede, voor ons, voor de EVP hoeft nieuwe regelgeving niet het antwoord te zijn, als men inderdaad maar gerichte omzetting levert. In principe ondersteunen we de netneutraliteit, we hebben hoge verwachtingen van functies, van innovaties en jobs. Daar gaat het ons om.

  Catherine Trautmann, au nom du groupe S&D. – Madame la Présidente, Monsieur le Commissaire, Madame la ministre, mes chers collègues, lors des négociations sur le paquet Télécom, le Parlement européen avait déjà défendu le respect de la neutralité du net.

La transparence dans la gestion du trafic en cas de congestion et une qualité de service minimum sont des conditions de base, mais les blocages persistants de contenu, comme cela vient d'être dit, ou d'application démontrent qu'elles ne suffisent plus. Nous rappelons donc le caractère essentiel d'internet pour les droits fondamentaux et le pluralisme des médias et la nécessité de garantir la confidentialité des communications et la vie privée.

Les opérateurs de télécom peuvent contribuer à la relance. Il faut leur donner la possibilité d'investir et d'innover en développant de nouveaux services, mais la qualité de l'internet de base, tel que nous le connaissons, ne doit en aucun cas être dégradée au profit des services payants.

Nous nous opposerons à la création d'un internet à deux vitesses qui discriminerait les foyers à revenus les plus modérés, déjà fortement touchés par la crise.

Enfin, si les conclusions de BEREC en démontrent la nécessité, nous demanderons à la Commission de prendre ses responsabilités et de produire un texte contraignant garantissant la neutralité du net.

  Cristian Silviu Buşoi, on behalf of the ALDE Group. – Madam President, without a shadow of doubt, the internet has radically changed our societies and our lives and has been a driver for competitiveness, innovation and economic growth in Europe over the past years. It has boosted cross-border trade through e-commerce, contributing to the development of the internal market, and it has allowed for the development of online services to the benefit of European consumers.

What we have achieved so far has been possible to a large extent thanks to the openness of the internet. We should continue on this path and take all necessary measures to preserve the open internet, which will help us further develop the digital single market.

Of course, traffic management is necessary in order to be able to provide an adequate quality for different services. But this should not be a pretext for anti-competitive practices such as blocking, throttling and so on. We have all witnessed cases where mobile Voice-through-IP services have been blocked. I therefore call on the Commission, BEREC and the national regulatory authorities (NRAs) to closely monitor traffic management measures, especially for mobile internet, and take the necessary measures where anti-competitive behaviour is proved.

In my view, the revised telecoms framework agreed in 2009 provides the necessary safeguards against such anti-competitive practices, but we probably need more active NRAs, which use their prerogatives to set minimum quality-of-service requirements.

Potential abuse in traffic management can be harmful to competition and can also affect freedom of expression and the freedom to conduct business, which are of the utmost importance. Consumers should also be more effectively protected against misleading advertising, namely on the speed of the internet. I believe that some additional guidelines from the Commission on these questions could help Member States to better apply EU legislation and would enable consumers and businesses to profit from the open internet.

  Philippe Lamberts, au nom du groupe Verts/ALE. – Madame la Présidente, je reste assez abasourdi par le fait que nous sommes en Europe et qu'en matière de Télécom, nous agissons comme si nous étions la somme d'une série de vingt-sept micromarchés. On l'a vu sur la question du spectre radioélectrique avec Gunnar Hökmark, on est en train de le voir sur la question du roaming téléphonique avec Angelika Niebler. Nous n'avons toujours pas un seul marché européen alors que, franchement, en matière de Télécom – il s'agit de télécommunications quand même – c'est l'échelle qui est la plus évidente, y compris donc pour la législation.

C'est vrai que notre collègue van Nistelrooij l'a dit, les Pays-Bas prennent une initiative en matière de défense de la neutralité du net. Je ne vais pas resouligner à quel point c'est important pour nous et là je ne partagerai sans doute pas ses conclusions. Il est sans doute important que l'Union européenne prenne une initiative.

Pour éviter qu'on se retrouve avec vingt-sept législations différentes qui essaient de protéger un bien commun qui, je pense, importe à tout ce Parlement, vingt-sept législations différentes qui sont autant d'occasions pour les opérateurs de réseau de les contourner en jouant l'arbitrage réglementaire entre un pays et l'autre. Et donc pour ma part, je défendrai l'idée d'une initiative législative européenne qui permette d'éviter cela.

Je voudrais dire à la Présidence que, quand j'entends parler d'autorégulation, ne serait-ce que partielle, j'ai envie de dire que je sors ma kalachnikov, car lorsqu'on voit comment des acteurs de marché – on peut penser bien sûr au secteur bancaire mais aussi aux opérateurs de Télécom – ont l'intérêt commun en tête, je pense que je ne me confierai pas en tout cas à eux.

  Adam Bielan, w imieniu grupy ECR. – Pani Przewodnicząca! Z zadowoleniem przyjmuję komunikat Komisji dotyczący potrzeby utrzymania otwartego charakteru internetu oraz jego neutralności jako głównej siły napędowej innowacji. Jednocześnie należy zadbać o wysoką jakość usług internetowych w oparciu o prawa własności intelektualnej, wolność wypowiedzi i swobodę prowadzenia działalności gospodarczej.

Z dostępem do internetu nierozerwalnie wiąże się szybkość i bezpieczeństwo przesyłanych danych oraz jakość tych usług. Stałym problemem jest różnica między deklarowaną a rzeczywistą szybkością połączenia. Konsument musi mieć więc możliwość podejmowania decyzji o wyborze usługodawcy na podstawie jasnych zasad, a także możliwość zmiany dostawcy na takiego, który będzie najlepiej odpowiadał jego preferencjom. Koniecznością jest więc opublikowanie przez Komisję wytycznych dotyczących prawa zmiany operatora. Liczę również na zainicjowanie przez Komisję szerokiego forum dyskusji nad przyszłością internetu w Unii oraz informowanie Parlamentu w sprawach bieżącego zarządzania przepływem informacji, rynku połączeń wzajemnych i przeciążenia sieci.

  Marisa Matias, em nome do Grupo GUE/NGL. – Senhora Presidente, o acesso à Internet deve ser hoje considerado como um novo direito fundamental dos cidadãos e não apenas como um mero objecto de comércio, porque desse direito dependem coisas essenciais como a liberdade de expressão, o acesso e a partilha de informação, o acesso e a partilha da cultura e do conhecimento, bem como o pluralismo democrático e mediático.

E é por isso que este acesso não pode estar sujeito a tarifários especulativos, nem a contratos que bloqueiam a livre escolha e a possibilidade de mudar facilmente de fornecedor, particularmente no mundo das telecomunicações móveis, como tão bem sabemos.

A cidadania activa exige, por isso, que seja facultada uma informação completa e transparente. O bloqueio à livre utilização da Internet não é apenas exclusivo de regimes políticos que têm medo dos seus povos. Pode acontecer também em resultado de opções económicas, através da oferta de privilégios a clientes especiais e de um tratamento menos igualitário a clientes que não sejam tão rentáveis.

É por isso tudo que apoio o Parlamento ao colocar-se claramente ao lado da neutralidade da Internet e da defesa do seu carácter de total abertura.

Europa tik tada galės visapusiškai panaudoti skaitmeninės ekonomikos galimybes, kai pasieks šioje srityje gerai veikiančią vidaus rinką. Manau, kad skaidrumas, paslaugų kokybė ir galimybė lengvai pakeisti operatorių yra neutraliam tinklui būtinos sąlygos, kartu galutiniams vartotojams užtikrinančios pasirinkimo laisvę. Svarbu pabrėžti, kad būtina išsaugoti atvirą internetą ir tuo pat metu teikti aukštos kokybės paslaugas, laikantis teisės aktų, pagal kuriuos būtų skatinamos ir gerbiamos pagrindinės teisės, pvz., intelektinės nuosavybės teisės, žodžio laisvė ir laisvė užsiimti verslu. Reikia šalinti kliūtis, su kuriomis susiduriama norint pakeisti operatorių, panaikinti blokavimo ir ribojimo praktiką, dominuojančią padėtį užimančių rinkos dalyvių vykdomą diskriminaciją.

  Angelika Niebler (PPE). - Frau Präsidentin, verehrter Herr Kommissar, verehrte Frau Ratspräsidentin, liebe Kolleginnen und Kollegen! Wir sind uns wohl alle einig in dem Ziel, dass wir ein offenes, ein faires Internet brauchen. Das wurde von vielen Kolleginnen und Kollegen schon ausgeführt. Wir brauchen das nicht nur für unsere Bürger, für unsere Nutzer im Netz, wir brauchen das für die Wirtschaft – der Herr Kommissar hat darauf hingewiesen –, wir brauchen es aber auch für unsere Politik, für Demokratisierungsprozesse. Ich erinnere nur an den Arabischen Frühling. Viele Entwicklungen in den nordafrikanischen Staaten und im Mittleren Osten hätten wir nicht erleben dürfen, wenn es das Internet nicht gäbe.

Wie erreichen wir das? Ich darf Bezug nehmen auf das, was Kollege van Nistelrooij gesagt hat. Die Niederlande sind mit einer Regulierung zur Netzneutralität voranmarschiert. Das ist – Verzeihung, lieber Kollege van Nistelrooij – der falsche Weg. Ich denke, es ist wichtig, dass wir hier wirklich einen europäischen Ansatz fahren, dass wir hier nicht 27 einzelne Regulierungen vorschlagen, sondern dass wir zumindest in Europa hierzu einheitlich einen harmonisierten Ansatz unternehmen. Deshalb bitte ich vor allen Dingen auch die Kommission, zügig nach fundierter Analyse der Fakten, der Tatsachen und der Einbindung von BEREC und den nationalen Regulierern mit einem Vorschlag zu kommen. In einem Teilbereich – beim Roaming – haben wir gerade die Debatte. Da wird es ja mit Blick auf Betreiberwechsel mit strukturellen Veränderungen schon Bewegung geben. Das, finde ich, ist der richtige Weg. Vielleicht brauchen wir gar keine horizontale Regulierung der Netzneutralität. Roaming ist ein Beispiel.

Noch ein letzter Punkt: Für mich ist vor allen Dingen für unsere Leute zuhause wichtig, dass es keine irreführende Werbung über schnelle Übertragungsraten gibt. Viele Provider locken ja die Kunden mit Angeboten, dass hier die Datenmengen ganz schnell übertragen werden. Aber diese Angebote kann man dann nur um 3 Uhr morgens in Anspruch nehmen, sonst sind die Übertragungsraten weit von dem entfernt, was in der Werbung oft versprochen wird. Ich wäre dankbar – auch Ihnen, Frau Ratspräsidentin –, wenn Sie über BEREC hier nochmals nachfassen könnten, dass auch das Thema „keine irreführende Werbung über schnelle Übertragungsraten“ aufgegriffen wird.

  Marita Ulvskog (S&D). - Fru talman! Nätneutralitet kan förenklat beskrivas som en frihetsfråga. Full frihet för marknaden och dess aktörer riskerar ofta att bli mindre frihet för användarna och konsumenterna. Av det skälet var nätneutraliteten oerhört viktig i förhandlingen om telekompaketet, och av det skälet var det också en av de avgörande frågorna till Neelie Kroes när hon frågades ut av parlamentet inför det faktum att hon kandiderade till sin post som kommissionsledamot. Mot den bakgrunden så räcker det förstås inte med eventuella spår av partiell självreglering eller med det mycket vaga svaret från kommissionsledamoten.

Min uppmaning är alltså: Kom tillbaka med precisa svar på en seriös fråga från industriutskottet. Den är viktig, inte bara för utskottet utan för väldigt många medborgare i EU. Återkom då gärna även med exakta bindande texter, vilket Catherine Trautmann efterfrågade.

  Alexander Alvaro (ALDE). - Frau Präsidentin! Das Internet stützt sich auf zwei wesentliche Säulen, nämlich Offenheit und Transparenz, und hätte Tim Berners-Lee, als er das WWW damals erfunden hat, nicht bewusst auf ein Patent auf HTML und HTTP verzichtet, hätten wir wahrscheinlich kein offenes Netz. Aber er hat damit den Grundstein für den Gedanken eines freien und offenen Netzes gelegt.

Das andere ist die Frage der Transparenz: Ein beliebtes Akronym im Internet ist WYSIWYG – what you see is what you get – und das muss für Anbieter genauso gelten. Es ist gut zu hören, dass wir uns in einem Grundsatz hier alle einig sind: Das Internet gehört niemandem, oder anders gesagt, das Internet gehört uns allen. Insofern ist auch die Frage der Netzneutralität entscheidend, dass es weiterhin ein Internet derjenigen ist, die Ideen entwickeln, die kreativ sind oder schlichtweg einfach nur an der Gesellschaft partizipieren wollen.

Ein Ding überrascht mich abschließend doch. In dem Ratsdokument vom 7. November steht:

Vorher stand statt „considers“ „enshrines“: Vielleicht kann uns der Rat erklären, warum das geändert wurde.

  Sandrine Bélier (Verts/ALE). - Madame la Présidente, cette résolution du Parlement européen sur la neutralité du net démontre notre capacité de nous inscrire dans la réalité de la transformation d'une économie industrielle en une économie de la connaissance dans laquelle le respect de nos droits fondamentaux est crucial à tous points de vue.

Alors, nous nous réjouissons de l'esprit de cette résolution, qui considère internet comme un nouvel espace de démocratie et qui rappelle l'importance de garantir le respect des droits fondamentaux connexes et dépendants à la neutralité du net, que sont notamment la liberté d'expression, la protection des données privées ou le pluralisme des médias, de garantir le respect des valeurs que sont le partage et l'accès du savoir au plus grand nombre et de n'admettre aucune exception à l'application des procédures judiciaires garantissant le respect de ces droits.

Nous souhaitons que cette résolution nous conduira vers la reconnaissance et l'inscription formelle du droit d'accès à internet comme droit fondamental dans la Charte des droits fondamentaux de l'Union européenne et nous espérons, enfin, que cette résolution trouvera un écho au sein de la Commission et du Conseil pour un renforcement du cadre réglementaire européen et surtout de son application dans l'ensemble des États membres pour vraiment garantir à tout citoyen européen un internet libre et ouvert.

  Paweł Robert Kowal (ECR). - Pani Przewodnicząca! Z internetem, tak jak z wieloma dziedzinami życia, wiążą się pewne zagrożenia i to jest oczywiste dla tych, którzy dzisiaj przemawiają. Dotyczy to zarówno praw intelektualnych, jak i innego rodzaju przestępstw.

Fundamentalną sprawą jest uświadomienie sobie, czym jest dzisiaj internet, rozejrzenie się po świecie. Internet to dzisiaj miejsce wyrównywania szans, internet to dzisiaj miejsce realnej walki o demokrację. Na naszych oczach dzięki internetowi zmienia się świat, zmienia się Afryka Północna – nie zapominajmy o tym. Dlatego te fundamentalne rzeczy – wolny nieskrępowany dostęp do wysokiej jakości internetu, tak by internet – to, co miałoby być czynnikiem wyrównywania szans – nie stał się nową przyczyną podziałów społecznych, tak by to, co miałoby być impulsem do demokratyzacji, nie prowadziło do pewnego rodzaju kneblowania wolności. Dlatego dzisiaj trzeba bardzo wyraźnie powiedzieć, że wybór odnoszący się do treści, do używania internetu, powinien zawsze i tylko leżeć po stronie odbiorcy.

  Pilar del Castillo Vera (PPE). - Señor Presidente, Señor Comisario, Señora Presidenta en ejercicio del Consejo, estamos ante uno de los temas que están en la matriz del éxito de Internet, que es su carácter competitivo y el carácter neutral de la red. En ese sentido, es extremadamente importante todo aquello que tenga que ver con este aspecto.

Realmente, la resolución que estamos planteando y sobre la que estamos debatiendo esta tarde, yo diría que es, ciertamente, equilibrada. Está de acuerdo con la Comisión, en el sentido de que, cuando haya datos que nos indiquen que está habiendo una alteración del carácter neutral de la red, entonces sería el momento de plantearse algún tipo de acción legislativa, pero que, mientras tanto, hay que esperar a ver lo que dice el informe del organismo de reguladores europeos en comunicaciones electrónicas.

Yo quiero añadir algo más: hay tres condiciones sine que non que, a mi modo de ver, son fundamentales para garantizar la neutralidad de la red. En primer lugar, que haya un mercado realmente competitivo de operadores de telecomunicaciones y de servicios.

En segundo lugar, que el usuario tenga la posibilidad de cambiar rápida y fácilmente de proveedor. Si no es así, el mercado será, ciertamente, desde un punto de vista competitivo, muy débil.

Y, en tercer lugar, la transparencia. Pero la transparencia significa que los usuarios deben estar realmente informados de todos cuantos criterios utilicen los gestores de la red para que puedan realmente saber si les interesan o, por el contrario, si les interesa cambiar de proveedor, tal y como decía antes.

  Patrizia Toia (S&D). - Signor Presidente, onorevoli colleghi, le applicazioni e i servizi legati a Internet hanno ancora molte potenzialità, sia per l'economia che per una società più partecipata e inclusiva. Oggi, nella fase di trasposizione del pacchetto Telecom nella legislazione nazionale, vi è il rischio di una frammentazione del quadro europeo. Sarà dunque importante il ruolo di monitoraggio della Commissione e io dico anche il ruolo di BEREC, che alcuni di noi avrebbero voluto più forte anche nella definizione del pacchetto Telecom.

Le priorità che vogliamo ribadire in questo dibattito sono: garanzia di neutralità della rete, sviluppo di infrastrutture a banda larga e sviluppo di un software più aperto, sicurezza di accesso e interoperabilità dei sistemi, promozione dell'uso delle tecnologie digitali nei diversi settori industriali e dei servizi, produzione di contenuti digitali e nuovi servizi, inclusione dei soggetti oggi esclusi – penso ai disabili ma non solo –, difesa del pluralismo informativo e culturale.

Andrà inoltre previsto e garantito che gli operatori non possano imporre blocchi e limitazioni o discriminazioni ai danni degli utenti e che la loro trasparenza nelle offerte commerciali e in tutta la loro attività sia massima.

  Marietje Schaake (ALDE). - Mr President, the internet was created with no specific use in mind other than the efficient transfer of information. Over the last 20 years the internet and technology have developed at an extremely rapid pace, giving rise to huge economic and social benefits. The key driver of this unprecedented innovation has been that all information flows and services are treated more or less equally, conforming with the principle of net neutrality.

Recently, a major telecoms provider in the Netherlands bragged to shareholders about its throttling of the voice over IP and messaging services that directly compete with its core business of selling text messages and calling minutes. Within hours it became known that all major providers in the Netherlands did the same. The Dutch Parliament was quick to react and legally ensured net neutrality. It is not the job of governments to protect certain business models, and the Dutch minister said that the company had clearly overplayed its hand.

Consumers pay too much, and transparency clearly has not worked in practice. I do not imagine that Dutch telecom providers are the only ones guilty of these practices, and we need to ensure that there is an EU-wide level playing field.

The research by BEREC will show what is happening, and perhaps the Dutch example can serve as an EU-wide example. In any case, the wait-and-see approach of the Commission with regard to net neutrality is hurting consumers, innovation, competition and society as a whole.

Transparency from providers and the ability for consumers to switch easily between providers are not enough on their own, and deep-packet traffic inspection methods are threatening fundamental rights.

  Gunnar Hökmark (PPE). - Mr President, the open internet and net neutrality have been a precondition for the rapid change in development of the internet and change in our societies. This should be underlined because, if we are to have the same rapid change in the future, we need to ensure that Europe can be the home of innovative development in internet and broadband services.

I get a little bit worried when I hear the Swedish representative of the Socialist Group calling for some sort of regulation because, if the internet had been regulated ten years ago, we would not have seen the same development of new services as we have seen.

The impact and strength of the internet lie in its freedom, as we have seen in other parts of the world, and as we can see from the change in our own European Union, with all the opportunities this has created for citizens.

Net neutrality offers us the opportunity to create a digital single market – not 27 different markets, but an open market – where we can get rid of such things as international roaming in the European Union, and where we can ensure that network congestion is dealt with by increasing capacity. We can develop new and better kinds of broadband, as we have done together with the Polish Presidency. We can ensure that we lead the world in mobile data traffic.

That is the way we shall face the future and that is the way we shall ensure net neutrality and a free and open internet: not by regulating but by being open to new innovations, because then Europe can take the lead.

  Petra Kammerevert (S&D). - Herr Präsident! Ein offenes Internet und die Gewährleistung eines diskriminierungsfreien Zugangs für alle sind unabdingbare Voraussetzungen für Kommunikations- und Informationsfreiheit, für Medienpluralismus und Meinungsvielfalt.

Es ist deshalb ein wichtiges und richtiges Signal an die Kommission und auch an die Mitgliedstaaten, dass wir das Best-effort-Prinzip und auch grundsätzliche Transparenzvorschriften festgeschrieben haben möchten. Ich hätte mir allerdings gewünscht, dass wir schon heute die Kommission auffordern, Netzneutralität klar und eindeutig zu definieren und gesetzlich zu verankern. Weiteres Zuwarten birgt die Gefahr in sich, dass seitens der Netzbetreiber Fakten geschaffen werden, die hinterher nur schwer wieder zu korrigieren sind.

Gewünscht hätte ich mir auch ein sehr klares und eindeutiges Verbot von Kontrollen der Inhalte von Datenpaketen. Die Hintertür, die die Entschließung hier offen lässt, hätte ich gerne schon heute geschlossen. Und ich entnehme der Diskussion, dass viele Kolleginnen und Kollegen hier mit mir einer Meinung und glaube, daran sollten wir weiterarbeiten.

  Andreas Schwab (PPE). - Herr Präsident, Frau Kommissarin, liebe Kolleginnen und Kollegen! Die Entschließung, die auf dem Tisch liegt, und zu der die Kommission gesprochen hat, hat sich ja mit einigen ganz konkreten Fragen an die Europäische Kommission gewandt, und wir sind da bisher doch relativ im Allgemeinen geblieben. Natürlich ist zu begrüßen, dass die Europäische Kommission Faktenchecks im offenen Internet machen möchte, um Transparenz und Offenheit sicherzustellen, aber das Parlament wird sicherlich genau beobachten, ob es dabei bleibt oder ob nicht an der einen oder anderen Stelle auch Gesetzgebung oder andere Maßnahmen notwendig sind.

Was Offenheit und Transparenz des Internets angeht, so sind wir in der Europäischen Union hier bereits ein gutes Stück vorangekommen, wenngleich wir festhalten müssen, dass es einige Mitgliedstaaten gibt, die bei der Verteilung der Infrastruktur noch ein Stück weit zurückhängen.

Ich glaube, dass wir darauf Wert legen müssen, dass bei der Frage des offenen Internets auch Offenheit dergestalt gewährt wird, dass in den ländlichen Räumen tatsächlich ein effektiver Zugang zu hohen und wertvollen Dienstleistungen der Telekommunikation sichergestellt wird, und vor diesem Hintergrund begrüße ich die Mitteilung von Frau Kommissarin Kroes in diesem Bereich besonders, weil ansonsten die Offenheit zu einem bloßen Prinzip verkommt, das nicht überall in Europa gilt.

Zum zweiten wird die Transparenz sicherlich nicht allein dadurch herzustellen sein, dass die Europäische Kommission Faktenchecks macht. Der Kollege Habour hat darauf hingewiesen, dass die Universaldienstleistungsrichtlinie Verbrauchern und Verbraucherinnen an verschiedenen Stellen grundlegende Rechte gibt. Nur durch diese Rechte ist ein wirksamer Wettbewerb möglich, um mehr Transparenz durch Informationen gerade im Bereich des Datenverkehrs zu gewährleisten.

Der Schutz der Rechte des geistigen Eigentumsrechte darf dabei nicht vergessen werden. Dadurch profitieren europäische Verbraucher von erschwinglichen Preisen, einer kundigen Auswahl und der Möglichkeit zum Anbieterwechsel sowie von qualitativen Dienstleistungen. Ich glaube, dass wir versuchen müssen, diese Prinzipien einheitlich in der Europäischen Union zu lösen. Dazu wäre es wünschenswert, wenn die Europäische Kommission nicht nur das Internet faktisch überprüft, sondern auch sieht, welche Maßnahmen die Mitgliedstaaten treffen.

  Silvia-Adriana Ţicău (S&D). - Internetul deschis şi neutralitatea reţelei în Europa sunt priorităţi pentru realizarea pieţei unice digitale. Internetul trebuie să furnizeze servicii de înaltă calitate, într-un cadru care promovează şi respectă drepturile fundamentale. Invităm Comisia să garanteze că furnizorii de servicii de internet nu blochează, nu discriminează, nu împiedică şi nu reduc capacitatea unei persoane de a utiliza un serviciu, de a accesa, a utiliza, a trimite, a publica, a primi sau a oferi orice conţinut licit, aplicaţie sau serviciu pe care îl doreşte, indiferent de sursă sau ţintă.

Solicităm Comisiei să furnizeze Parlamentului date privind practicile curente de gestionare a traficului, piaţa de interconectare şi congestionare a reţelei. Solicităm Comisiei să urmărească îndeaproape adoptarea oricăror regulamente naţionale în materie de neutralitatea internetului, efectele lor asupra pieţei interne şi asupra pieţelor naţionale. Considerăm că o concurenţă eficace a serviciilor de comunicaţii electronice, transparenţa gestionării traficului şi calitatea serviciilor, precum şi posibilitatea de a schimba uşor furnizorii, sunt condiţii minime necesare pentru neutralitatea reţelei.

Ние възлагаме много надежди на развитието на технологиите, и по-специално на Интернет, за възстановяването на европейската икономика и в същото време не трябва да забравяме, че Интернет вече е среда, която гарантира и правата, и свободите на европейските граждани. Там се пренасят и много от новите медии.

Тогава, когато говорим за Интернет неутралност, мисля, че има две неща, които трябва да бъдат много ясни. От една страна, тези, които предоставят Интернет, не трябва да ограничават по никакъв начин достъпа до Интернет и ползването на определена информация. От друга страна, обаче, трябва да се даде възможност за добро управление на Интернет, така че да няма задръствания и да няма прекъсвания.

Аз изцяло разчитам, че Европейската комисия и BEREC (ОЕРЕС - Орган на европейските регулатори в областта на електронните съобщения) ще могат да свършат работата си и да създадат този баланс, включително като включат тези въпроси в бъдещата стратегия по киберсигурност.

  Judith A. Merkies (S&D). - Voorzitter, geachte commissaris, zegt uw collega De Gucht en zegt collega Kroes nou dat er voorlopig geen maatregelen te verwachten zijn? Maar dat is wel wat het Europees Parlement wil.

Nederland heeft in juni 2011 een soort noodwetje moeten aannemen, die netneutraliteit wettelijk verplicht, als eerste land in de Europese Unie, wat een direct gevolg was van het feit dat onze grootste telecomoperator KPN de klanten wilde laten betalen voor concurrerende online-diensten zoals Skype of WhatsApp, en dat terwijl er in het eerste telecompakket van 2009 toch al was vastgelegd, dat het net in heel Europa neutraal moet zijn. Kennelijk – het is een beetje gek – moeten we zeggen dat "neutraal" echt neutraal betekent, en dat het niet aan het bedrijf is om neutraliteit te interpreteren, maar aan ons, aan de wetgever, en dat wij dat moeten garanderen, en dat het niet kan zijn dat er, vanwege veranderende gewoontes van de consument, diensten worden geblokkeerd of belast.

Ik wil toch echt pleiten voor het voorkomen van 27 verschillende interpretaties van neutraliteit. We moeten nu ingrijpen, wij willen niet een soort noodwetjes hebben, want een vrij en neutraal internet is de economische, communicatieve ruggengraat van onze maatschappij en moet transparant, kwalitatief en neutraal zijn.

  Petru Constantin Luhan (PPE). - Mr President, the European Parliament can today show its leadership in promoting human rights and entrepreneurship both in Europe and worldwide. Net neutrality is about freedom of speech, freedom to access and share information and freedom of choice for consumers.

The internet governs our lives, whether we are talking about individuals, about companies or about institutions. We need a rich content of information and to facilitate access to information which could improve our lives and lead to concrete economic growth.

However, we also need to protect our citizens and institutions from misuses of the internet, like cyber attacks, which could lead to dangerous effects on society. We have to keep the balance between protection and censorship, and at the same time to ensure that as much information as possible is accessible via the internet, in order to develop our society.

  Ioan Enciu (S&D). - Principiul de neutralitate a internetului este unul fundamental pentru păstrarea caracterului său inovator, a liberei concurenţe şi respectarea drepturilor omului. Trebuie să beneficiem de un internet neutru, european, şi nu naţional, care să permită utilizatorilor să nu aibă condiţii de limitare a accesului la aplicaţii sau servicii. Transparenţa, calitatea serviciilor, eliminarea publicităţii mincinoase, precum şi posibilitatea consumatorilor de a-şi schimba furnizorul de internet trebuie susţinute şi accentuate în vederea protejării neutralităţii şi a drepturilor cetăţenilor.

În anumite state membre, precum România, există o discrepanţă puternică regională privind accesul la internet.   Jaroslav Paška (EFD). - Balík telekomunikačných reforiem Európskej únie z roku 2009 mal priniesť zlepšenie konkurenčného prostredia telekomunikačných služieb na vnútornom trhu. Mal tiež legislatívne zadefinovať neutralitu internetovej siete a právo verejnosti na otvorený prístup k internetu. Lehota na implementáciu nových telekomunikačných pravidiel uplynula v máji tohto roku. V apríli tohto roku prijala Komisia ešte svoje oznámenie o neutralite siete.

Preto je vhodný čas na to, aby sme sa spolu pozreli na to, či tieto reformy predpisov priniesli očakávané zmeny a sú v členských štátoch aplikované tak, aby užívateľom priniesli viac informácií a transparentnosti o produktoch, väčšiu kvalitu služieb, ako aj ľahkú bezproblémovú možnosť zmeniť operátora v prípade nespokojnosti s jeho službami. Najmä problémy so spomaľovaním či výpadkami siete, ktoré je možné hodnotiť ako zníženie kvality poskytovanej služby, by malo byť regulátorom vylúčené prostredníctvom ...

  Franz Obermayr (NI). - Herr Präsident! Netzneutralität verpflichtet die Provider jeglichen Internetverkehr gleich zu behandeln, ohne ihn zu kontrollieren. Manche Netzanbieter versuchen allerdings, ihre Position auszunutzen, um andere Marktteilnehmer auszuschließen, so z. B. die Internettelefonie. Der Zugang für fremde Anbieter wird absichtlich gedrosselt, um eigene Telefondienste nicht zu gefährden. Dadurch werden Wettbewerb und Meinungsfreiheit natürlich eingeschränkt. Wir brauchen daher Leitlinien für den Mobilfunkmarkt, um auch dort die Netzneutralität zu gewährleisten.

Und zweitens: Es bedarf mehr Transparenz für den Endnutzer, also Information über Anbieter und Leistungen, denn besonders bei der Schnelligkeit im Internet fallen Werbung und Realität oft auseinander.

Drittens: Letztlich sollte jeder Nutzer die Möglichkeit haben, ohne Probleme zu einem neuen Anbieter zu wechseln.

  Evelyn Regner (S&D). - Herr Präsident, sehr geehrte Kommissarin und Vertreterin der polnischen Präsidentschaft! Das Internet ist die Fortsetzung der analogen Welt in der digitalen und damit nicht der Wilde Westen. Werte, Rechte, demokratische Grundfreiheiten gelten da wie dort.

Zur Garantie der Netzfreiheit gehört, dass die Technologieneutralität und die Serviceneutralität der Internetinfrastruktur gegenüber Daten, Inhalten und Protokollen so gut wie nur möglich bewahrt werden. Unser Ziel sollte bzw. muss es sein, dass den Zugangsanbietern Diskriminierungen von bestimmten Dateninhalten durch die Übertragung mit verschiedenen Geschwindigkeiten verboten werden – europäisch und/oder national. Der Selbstregulierung traue ich da nicht unbedingt so sehr über den Weg.

Die Einhaltung dieser Verbote sollte von den entsprechenden Behörden auch wirklich kontrolliert werden, und diese sollten – wie in der analogen Welt üblich – mit entsprechenden Kontrollmechanismen ausgestattet sein.

  Monika Flašíková Beňová (S&D). - Podstata neutrality siete a základné otázky debaty súvisia predovšetkým s tým, ako čo najlepšie udržať otvorenosť tejto platformy a zabezpečiť, aby mohla aj naďalej poskytovať služby vysokej kvality pre všetkých a umožnila šíriť inovácie. Neutralita siete sa dotýka celého radu práv a zásad obsiahnutých v Charte základných práv Európskej únie, najmä pokiaľ ide o súkromie a rodinný život, ochranu osobných údajov a slobodu vyjadrovania a informácií.

Z tohto dôvodu bude akýkoľvek legislatívny návrh v tejto oblasti podliehať hĺbkovému posúdeniu vplyvu na základe práva a súladu s Chartou základných práv Európskej únie. V prípade, že by sa nezachovala neutralita siete, hrozili by vážne riziká v podobe napríklad protisúťažného správania, blokovania inovácií, obmedzovania slobody prejavu a plurality médií, ako aj nedostatočnej informovanosti spotrebiteľov a narúšania súkromia. To by poškodilo podniky, spotrebiteľov aj demokratickú spoločnosť ako celok.

And please be assured that I will convey what I have heard here to my colleague Mrs Kroes.

My colleague thanks you for this very interesting exchange of views. Your views and your commitment in the area of the open internet and net neutrality are essential. The Commission looks forward to seeing the outcome of your deliberations and to read the motion for a resolution which will be voted on tomorrow.

The Commission will reflect on the important messages that emerged from today’s exchange of views and assures you that such messages will shape any proposal that is brought forward. Overall, the Commission will be vigilant that new EU telecoms rules on transparency, quality of service and the ability to switch operator are applied in a way that ensures that open and neutral internet principles are respected in practice.

The Commission will also publish evidence from BEREC’s investigation, including any instances of blocking or throttling certain types of traffic. If BEREC’s findings and other feedback indicate outstanding problems, it will assess the need for more stringent measures. In parallel, the Commission will continue its dialogue with the Member States and stakeholders to ensure the rapid development of broadband, which is essential to reduce the pressure on internet traffic.

  Magdalena Gaj, Urzędująca Przewodnicząca Rady. − Panie Przewodniczący! Pani Komisarz! Dziękuję bardzo za tę debatę. Tak jak mówiłam, jest ona dla prezydencji, ale i dla Państwa oraz naszych wszystkich obywateli niezwykle istotna, bo to, o czym Państwo tutaj wszyscy mówiliście po kolei, niezależnie od pochodzenia partyjnego, że tak to określę, wszyscy jesteśmy za otwartym, neutralnym internetem. Jest to wartość podstawowa i nie możemy z niej zrezygnować. Musimy zagwarantować naszym obywatelom przejrzystość wyboru, świadomość wyboru i dostarczenie wszędzie i najlepszej jakości usług.

Wielu z Państwa zwróciło uwagę na właśnie prawa podstawowe, na kwestie związane z ochroną konsumentów, ochroną danych osobowych, z nieuczciwymi reklamami. Rada też te wszystkie kwestie zauważa i zwraca na nie uwagę w konkluzjach. To, o czym mówił pan Reul i pan Hökmark – budowa sieci następnej generacji, wykorzystanie kolejnych zasobów częstotliwości, to, co właśnie udało nam się w czasie polskiej prezydencji. Świetna współpraca z Parlamentem i zakończenie prac nad pierwszą polityką w zakresie widma radiowego, udostępnienie i harmonizacja państwa 800 MHz pozwoli nam na dostarczenie tego internetu wszędzie, nawet na tych trudnych, mało zaludnionych obszarach.

Proszę Państwa, państwa członkowskie uważają otwarty i neutralny charakter internetu za jeden z istotnych celów politycznych. Tutaj pan Alvaro zadał pytanie, dlaczego Rada odstąpiła od tego celu i nastąpiła zmiana zapisu w konkluzji. Absolutnie takiej zmiany zapisu nie ma, mogę w tej chwili go zacytować: „Rada podkreśla potrzebę zachowania otwartego, neutralnego charakteru internetu oraz uznawania neutralności sieci jako celu politycznego”. Absolutnie żadna zmiana tutaj nie nastąpiła. „Rada podkreśla znaczenie zagwarantowania wystarczającej przejrzystości, umożliwiającej konsumentom dokonanie lepszych i opartych na wiedzy decyzji oraz znaczenie zajęcia się ewentualnymi kwestiami dyskryminacji i pogarszania jakości usług”. Te konkluzje Rady zostaną przyjęte na najbliższym posiedzeniu Rady Ministrów dnia 13 grudnia br.

  Lena Kolarska-Bobińska (PPE), na piśmie. – Dostawcy usług internetowych to firmy usługowe, podobnie jak dostawcy wody czy gazu. Takie firmy nie powinny mi mówić, że woda w kuchni będzie płynęła szybciej, niż w łazience, ani że światło w sypialni będzie o połowę słabsze, niż w przedpokoju. Zadaniem dostawcy jest obsługa rur i przewodów, a rolą konsumenta jest decydowanie o ich użyciu. Zawartość internetu powinna być równoprawna i równoprawnie dostępna. Rola dostawcy sprowadza się tutaj do finansowego obciążenia użytkownika w sposób adekwatny do tego, jak korzystał z usług. Jeśli dostawca chce zaoferować nielimitowany plan taryfowy, a konsument jest gotowy za niego zapłacić, wszystko jest w jak najlepszym porządku. Jednakże ten nielimitowany plan musi faktycznie nie posiadać ograniczeń. Wszyscy zdajemy sobie sprawę z tego, że od czasu do czasu możemy mieć do czynienia z przerwą w dostawie wody czy prądu na skutek wypadku lub konserwacji. Czasami internet jest wolniejszy niż zwykle. Powinien być to jednak wyjątek, nie reguła. Usługi internetowe oraz zabezpieczenie treści muszą być nierozerwalne. Tak samo, jak ma to miejsce w przypadku Europy, nie możemy sobie pozwolić na internet dwóch prędkości.
