  Alejo Vidal-Quadras, Presidente de la Delegación en el Comité de Conciliación Señor Presidente, después de largas y laboriosas negociaciones, la Delegación del Parlamento Europeo en el Comité de Conciliación aprobó por una amplia mayoría, el pasado 25 de octubre, el acuerdo alcanzado con el Consejo. En el arranque de mi intervención quiero expresar mi agradecimiento a todos los colegas de la delegación del Parlamento y especialmente a los del equipo negociador, así como al Consejo, por su actitud abierta, y a la Comisión, por su permanente ayuda.

Debo decir, como Presidente de la Delegación del Parlamento Europeo en el Comité de Conciliación, que el resultado en su conjunto es satisfactorio para el Parlamento. Teníamos un desafío política e intelectualmente interesante, que era adaptar los instrumentos de financiación en curso a las exigencias del nuevo Tratado y esto se ha conseguido, señor Presidente, situando los aspectos esenciales de esos instrumentos —prioridades, objetivos, resultados esperados y asignación de recursos en términos generales— bajo codecisión, lo que coloca al Parlamento y al Consejo en pie de igualdad.

Por otra parte, otro logro importante que quiero destacar es que, gracias a nuestras conversaciones en esta conciliación, la Comisión ha reforzado extraordinariamente su declaración sobre el uso de actos delegados en futuros instrumentos de financiación de manera explícita.

Otro punto que quiero subrayar es la declaración política del Consejo sobre el uso de actos delegados en futuros instrumentos de financiación externos, que el Consejo se compromete a considerar de manera adecuada. Esta era una línea roja para el Consejo, que, en principio, se resistía a realizar esta declaración, pero finalmente la fuerza de nuestros argumentos pudo convencerles.

Sobre los instrumentos en sí cabe señalar lo siguiente: en el caso del instrumento para países industrializados, conseguimos que figurasen en un anexo los umbrales de recursos por prioridad y por área geográfica, y en el caso del instrumento para países exportadores de plátanos, definimos con toda precisión los criterios de asignación de recursos y la metodología a aplicar, eliminando cualquier arbitrariedad o cualquier margen de maniobra de la Comisión que no estuviera sujeto al control del Parlamento. Debo reconocer, señor Presidente, que hubo un punto concreto en este instrumento sobre el que el Parlamento no consiguió hacer prevalecer sus tesis. Pero, señor Presidente, una conciliación es conciliar posiciones, no es ganar al 100 %. Y, por tanto, de la misma forma que nosotros impusimos nuestras líneas rojas, el Consejo tenía derecho a tener también alguna línea roja.

Quiero añadir, señor Presidente, que en caso de que el Parlamento no apruebe mañana el instrumento referido a los países exportadores de plátanos, las consecuencias de esta decisión serían muy graves. Los programas se cancelarían porque, en contra de lo que dicen algunas de sus Señorías —que entiendo que lo hacen de buena fe—, no hay dinero, no hay recursos en otras partidas para atender esos programas. Por tanto, sectores sociales muy vulnerables en estos países se verían gravemente perjudicados por nuestra decisión y las consecuencias políticas serían asimismo muy dañinas, por no hablar de los acuerdos que estamos obteniendo en la Organización Mundial del Comercio sobre los plátanos, que se verían también gravemente perturbados.

Señor Presidente, el Consejo ha aprobado ya este acuerdo. En virtud de nuestro acuerdo de caballeros con el Consejo, se espera que nosotros mañana seamos coherentes y ratifiquemos también el acuerdo. Por tanto, mi recomendación, como Presidente de la Delegación del Parlamento Europeo en el Comité de Conciliación, señor Presidente, es que mañana esta Cámara dé su apoyo a este acuerdo de conciliación.

  Charles Goerens, rapporteur. − Monsieur le Président, le règlement concernant les mesures d'accompagnement dans le secteur de la banane comporte deux volets: un volet coopération au développement et un volet institutionnel qui a trait au pouvoir codécisionnel du Parlement européen. Il n'y a pas de problème quant au premier volet. C'est au niveau des aspects institutionnels, cependant, que nos idées divergent.

Comment peut-on rendre compatible le règlement MAB (mesures d'accompagnement dans le secteur de la banane) avec les dispositions du traité de Lisbonne, et notamment de son article 290? Pour être clair, d'après le traité de Lisbonne, le Parlement européen détient désormais un pouvoir égal à celui du Conseil pour ce qui est de l'approbation des priorités stratégiques dans la programmation des fonds européens, y compris ceux destinés à la coopération au développement.

En tant que rapporteur, conformément au mandat fixé par la conférence des présidents de notre Parlement, et en vertu des décisions arrêtées tant au niveau de la commission du développement que de la délégation du Parlement européen à la conciliation, j'ai, tout au long des huit trilogues avec le Conseil et la Commission, respecté les deux lignes rouges suivantes.

Premièrement: pas question de renoncer au traitement d'égalité entre le Parlement et le Conseil en matière de fixation des priorités pour la programmation financière. Deuxièmement: dans le même esprit, pas question de renoncer aux prérogatives de scrutin démocratique du Parlement européen dans le cadre de cet instrument et de créer un fâcheux précédent pour l'avenir.

Après huit trilogues et devant la rigidité du Conseil, qui n'est même pas présent aujourd'hui, les résultats des courses donnent lieu à deux réactions divergentes. Dans sa majorité, la délégation a voté pour le projet de compromis tel qu'il vous est soumis. Une forte minorité, cependant, n'a pas appuyé le compromis négocié dans le cadre de la conciliation. En ma qualité de rapporteur et en tant que démocrate qui respecte les majorités, je me trouve dans l'obligation de vous transmettre les résultats de nos délibérations, ce qui a été fait.

Mon interprétation personnelle de la déontologie parlementaire m'interdirait de passer cette évidence sous silence. La même déontologie m'autorise toutefois à vous dire qu'à titre personnel, je trouve les résultats très insatisfaisants. Pourquoi? Je trouve les résultats insatisfaisants parce qu'en cas d'adoption du compromis par le Parlement, celui-ci risque de créer un fâcheux précédent. En effet, dans le cadre du projet MAB, le Parlement européen ne se voit accorder qu'un droit à l'information sur les choix stratégique que va arrêter la Commission en matière d'affectation des ressources de 190 millions d'euros. Le Parlement européen obtient l'information et le Conseil, seul, décide sur une proposition de la Commission.

Ceci ne constitue pas un pas en avant. Ceci constitue deux pas en arrière: un premier pas en arrière par rapport au traité de Lisbonne, un deuxième pas en arrière par rapport à la situation antérieure au 1er décembre 2009, date de l'entrée en vigueur du traité de Lisbonne. En effet, jusqu'en 2009, le Parlement européen avait, dans le cadre d'une procédure négative, la possibilité de confronter la Commission avec les vues du Parlement. Cette procédure avait un effet suspensif. Aujourd'hui, plus rien de tel. Le Conseil a réussi à priver le Parlement européen, qui est pourtant colégislateur avec lui de son droit de scrutin démocratique en n'acceptant qu'une solution où lui seul pourra adopter les choix stratégiques dans le cadre des mesures d'accompagnement dans le secteur de la banane.

Le Conseil a réussi à inscrire la mise en œuvre du programme MAB dans une logique conditionnée par l'article 291, qui a trait aux simples mesures d'exécution. Ici, on fait deux pas en arrière. À vrai dire, on recule. C'est la raison pour laquelle je ne pourrai pas voter pour ce rapport. Ce faisant, je concède qu'il s'agit pour moi d'une décision extrêmement difficile, mais je suis prêt à l'assumer, parce ce que je ne voudrais pas contribuer à créer un fâcheux précédent pour les négociations à venir portant sur les pouvoirs du Parlement européen en matière de financement des instruments de la politique extérieure.

  Helmut Scholz, Berichterstatter. − Herr Präsident, Herr Kommissar, liebe Kolleginnen und Kollegen! Als ich dieses Dossier übernommen habe, rechnete ich – ehrlich gesagt – nicht damit, dass ich darüber mehr als zwei Jahre intensiv verhandeln würde. Das ist meines Erachtens sicherlich öffentlich – sowohl in der EU gegenüber ihren Bürgerinnen und Bürgern als auch in den Partnerländern – nur sehr schwer zu vermitteln.

Bemerkenswert ist, dass bei den Verhandlungen über den eigentlichen Inhalt und die Aufgaben des Instruments in wenigen Monaten eine Verständigung erreicht werden konnte. Was die Verhandlungen so stark in die Länge zog, war die Interpretation des Vertrags von Lissabon hinsichtlich der so genannten delegierten Rechtsakte und die Weigerung einiger großer Mitgliedstaaten, dem Parlament tatsächlich stärkere Kontrollmöglichkeiten einzuräumen.

Der Rat und das Europäische Parlament waren frühzeitig übereingekommen, das Finanzierungsinstrument für die Zusammenarbeit mit industrialisierten Ländern grundlegend zu verändern. Bis zu 348 Millionen EUR wollten wir freigeben für die Zusammenarbeit in den Bereichen Wissenschaft, akademischer Austausch – dazu gehört auch Erasmus Mundus –, Kultur, Umweltschutz und erneuerbare Energien und Stimulation bilateraler Handelsbeziehungen. Kleine und mittelständische Unternehmen sollten dabei besonders berücksichtigt werden. Dabei bleibt es, aber die Verzögerung hat zur Folge, dass bis zum Ende des laufenden Finanzrahmens nur noch ein erheblich geringerer Betrag investiert werden kann. Das ist umso bedauerlicher, weil mit den neuen ICI+ auch Projekte in den Entwicklungsländern finanziert werden können, und zwar solche Projekte, die nicht unter die allgemeine Definition von Maßnahmen der Entwicklungshilfe fallen, z. B. die Entsendung von europäischen Studierenden an Hochschulen in Afrika, Asien oder Lateinamerika.

Mit der Neufassung der Verordnung haben wir die sich aus der geografischen Erweiterung ergebenden Chancen und Herausforderungen deutlich benannt. Eindeutig wird festgelegt, für wen und wofür die zusätzlichen Mittel nach dem Willen der Gesetzgeber eingesetzt werden sollen. In den in Anhang II aufgelisteten Entwicklungsländern sind mindestens 5 % der Mittel für den Themenkomplex öffentliche Diplomatie auszugeben. Explizit bedeutet das die Förderung des Diskurses mit der Zivilgesellschaft zu Charakter und Grundwerten der Europäischen Union, namentlich Demokratie, Respektierung der Menschenrechte und der Grundfreiheiten.

Mindestens 20 % der Mittel sind für die Förderung direkter Beziehungen zwischen den Bürgerinnen und Bürgern der Europäischen Union und der Partnerländer zu investieren. Neben einem Schwerpunkt auf akademischem Austausch und der Mobilität von Studierenden bedeutet dies auch die Vernetzung von Akteuren auf wirtschaftlichem, sozialem und kulturellem Gebiet. Und mindestens 50 % der Mittel sind für die Vernetzung wirtschaftlicher Aktivitäten auszugeben, wobei kleine und mittelständische Unternehmen im Fokus stehen sollen. Die Mittel sollen auf Partnerländer konzentriert werden, die die Kernarbeitsnormen der ILO einhalten und die sich an den weltweiten Bemühungen zur Reduktion der Treibhausgasemissionen beteiligen. Das ist ein Novum! Überhaupt ist die Kommission gehalten, sich bei der Zusammenarbeit im Energiesektor insbesondere auf Kooperationen im Bereich erneuerbare Energien zu konzentrieren.

Für das Protokoll und zur Kenntnisnahme der Kommission und der Kontrollinstanzen: Dieses Instrument ist ausdrücklich nicht dafür zu verwenden, versteckte Subventionen für das Agieren eines europäischen Telefonkonzerns in Kolumbien oder anderen Ländern Lateinamerikas zu leisten! Ich halte es für absolut wichtig und notwendig, dafür zu sorgen, dass bei der Gewährung der Finanzhilfen keine Abstriche an den Grundprinzipien der Europäischen Union gemacht werden. Bei der Förderung in Entwicklungsländern ist künftig auf die Kohärenz der Politiken zu achten, insbesondere auf Einklang mit den Maßnahmen gegen die Nahrungsmittelkrise.

Wir werden das als Parlament ständig überprüfen. Dafür haben wir in diesem Instrument auch eine besondere Berichtspflicht der Kommission verankert – auch das ist ein Erfolg! Wir wollen prüfen, ob die mehrjährige Strategieplanung von EAD und Kommission zur Umsetzung unserer Verordnung auch dem Geist der Gesetzgeber entspricht. In der Vergangenheit galt in der Kommission ja leider oft: Papier ist geduldig. Deshalb wollten wir die delegierten Rechtsakte in diesem Instrument verankern und unsere Rolle und Pflicht als Gesetzgeber mit dem Vetorecht einfordern. Im Interesse derjenigen, die von dem Förderprogramm profitieren, haben wir deshalb am Ende nicht auf dem entsprechenden Wortlaut bestanden, aber wir werden mit diesem Instrument wie mit allen anderen – und darüber bin ich mir mit den Berichterstattern einig – auch in Zukunft für dieses demokratische Recht kämpfen.

  Kinga Gál, előadó. − Elnök Úr! Biztos Úr! Kedves Kollégák! Ahogy az imént előttem szóló képviselőtársam elmondta, ugyanazt mondhatom én is. Mindnyájunkat meglepett az, hogy ezek a tárgyalások milyen ellenállást váltottak ki. Ez a parlamenti jogos követelés a demokratikus ellenőrzés jogának a gyakorlásáról elnyúló tárgyalássorozathoz fog vezetni. Szerintem egyik jelentéstevő sem gondolta, hogy ez így elhúzódik.

Ennek ellenére örülök, hogy ma itt állunk ennél a záróvitánál. A demokrácia és az emberi jogok európai eszközének társjelentéstevőjeként csak hangsúlyozni tudom, hogy ez az eszköz az emberi jogokat, a demokrácia védelmét szolgálná az egész világon. Ezzel az eszközzel támogatható a gyerekek jogaiért folytatott küzdelem, a kínzás, a kegyetlen, embertelen bánásmód elleni küzdelem, de konkrétan az emberi jogvédők védelme is. Ezen eszköz haszonélvezői olyan civil szervezetek, amelyek harmadik országokban tevékenykednek ezekért a célokért. És épp az arab tavasz eseményei mutatták meg, hogy mennyire fontos az, hogy igenis a Parlament lássa át a stratégiai kérdéseket. És mennyire nem mindegy, hogy hogyan használják ezeket az eszközöket.

A jelentés tartalmi részéről első olvasatban sikerült is egyetértésre jutnunk, és az nem volt kérdéses senki számára, hogy mindent megteszünk, hogy a civil szervezetek működését elősegítsük.

A következő két olvasatra az érem másik oldala jutott: az intézményközi vita. És én úgy látom ezt a négyes csomagot, mint az állatorvosi lovat, ahogy magyarul kifejezik. Az első szimbolikus jele volt annak, hogy el tudja-e fogadni az intézményközi rendszer, hogy az Európai Parlament szerepe valójában megnőtt, más lett 2009. december 1-je után. Örülök, hogy eljutottunk eddig a megállapodásig az intézmények között, és ezért külön köszönet Vidal Quadras képviselő kollégámnak és a többieknek, akikkel végigküzdöttük ezeket a hónapokat.

Úgy érezzük, hogy az út hosszú volt és mindannyian tudjuk, hogy minden kompromisszum lényege, hogy a felek többet-kevesebbet feladnak az eredeti elképzeléseikből. Mégis, én úgy érzem, hogy ez egy komoly előrelépés, és hogy a Tanács és a Parlament a jövőben közösen dönthet a pénzügyi eszköz stratégiai tervezési kérdéseiben. Fontos, hogy valahol ez az ígéret megvan a keretstratégiák tárgyalásában. Meg vagyok győződve, hogy a mostani megállapodás erősíteni fogja a Parlament jövőbeni tárgyalási pozícióját. Ezt a közös állásfoglalás is biztosítja. Ez pedig különösen fontos és releváns, ha demokráciáról és emberi jogokról szeretnénk beszélni a harmadik világ országai felé.

Az intézményközi megállapodás megerősítése a holnapi szavazás során nem az intézményközi bizalom miatt a felelősségünk. Mi, európai parlamenti képviselők felelősen kell lépjünk a harmadik országok felé is. Nem tűnhetünk komolytalannak a szemükben. Ezért kérem én is, hogy holnap szavazzák meg ezt a négy pénzügyi eszközt tartalmazó csomagot.

  Barbara Lochbihler, rapporteur. − Mr President, as co-rapporteur of this instrument, I would also like to start by saying something first on the content. The changes brought to the current instrument now entail the possibility of exceptionally covering costs related to taxes paid by NGOs when implementing programmes and projects. This is necessary to increase the flexibility of the instrument and because an increasing number of governments are no longer exempting civil society organisations from paying taxes – sometimes to increase the pressure on them and limit their freedom of manoeuvre.

In the field of human rights and democracy work, I have to say this is a worrying but very real trend we are observing, so it was very good that we could reach this change. I am confident that the conciliation has also produced positive outcomes for the future instrument for democracy and human rights promotion, which will run from 2014–2020 and on which we shall shortly be receiving a proposal by the Commission.

Indeed, as a result of our negotiations, the Commission states in its Communication on the EU budget for 2020 that ‘the future legal basis for the different instruments will propose the extensive use of delegated acts to allow for more flexibility in the management of the policies during the financial period, while respecting the prerogatives of the two branches of the legislature’. A joint European Parliament and Council declaration was also agreed on the use of delegated acts in the area of external relations for the future financial instruments, which strengthens the negotiating position of Parliament for the future instrument for democracy and human rights.

The agreement we have reached with the Council will allow us to decide together on the important strategic aspects of the instruments: objectives, priorities, indicative financial allocations and expected results. This means Parliament will have a greater say on how much money goes to one or other human rights and democracy objectives in the next instruments. For example, Parliament used to complain in the past that not enough funding went to democracy activities, including support for parliaments. Now we will be able to negotiate with the Council hopefully by means of delegated acts in the future instrument to have maximum flexibility to modify such priorities.

Delegated acts would allow us to have a say not only at the birth of the instrument when drafting the regulation, as we do now, but also on the multiannual strategy papers and thus at regular intervals during the life of the instrument.

Finally, we did not achieve everything we wanted during this round of negotiations, but it has made us determined to achieve it in the next round which will start in January.

  Gay Mitchell, rapporteur. − Mr President, the conciliation process has yielded some gains on some issues of concern for Parliament. There had previously been numerous questions concerning the extent of powers given to the Commission in implementing the programmes of the EU’s external financing instruments. I am happy to see that we have a situation where the European Parliament and the Council decide together on important strategic decisions. This is positive.

I am fully aware that the negotiations have been extremely difficult and complex, in particular since the Council has not been active and made not a single counter-proposal in the discussions. Parliament was therefore forced to move and make concessions in the interests of beneficiary countries. Many of my fellow Members in the Development Committee, including the rapporteur, Mr Goerens himself, feel that the final result on the DCI/BAM regulation is not acceptable, neither in political nor in legal terms. I will return to that point in a moment.

I would stress that the EPP Development Committee Members attach the highest importance to Section 2 of the draft legislative resolution of the DCI/BAM regulation and, in particular, to its last sentence which ‘underlines that this result does not set a precedent for future negotiations on the post-2013 external financing instruments’. I sincerely hope that Parliament demands respect for this condition in all future negotiations. If this clause is not respected, Parliament will be renouncing scrutiny powers over important multi-billion geographical and thematic strategies.

The fundamental issue is that democratic decision-making and control and respect for the Lisbon Treaty are the two most important principles in this regard, which is why I must strongly support the concerns expressed by Mr Goerens. I have to say – and I say this in your presence, Mr Vice-President – that it is time for the President of this Parliament to call for an independent review of the role that the Commission is supposed to play as honest broker in the conciliation process. It should not align itself with either institution and should ensure that the principles set out in the Treaties, as approved by the people of Europe, are upheld – as is its sworn duty. I have to say that I have some doubts that this is the case.

We can say that we have made progress in relation to financing of the development programmes. Thirty-six million children per day used to die. Thankfully, that is down now to less than 21 million. Much progress has been made, but by 2050 the population of the world will have increased by more than two billion people, 90% of whom will be born into what is now the developing world. We need to address this issue for altruistic reasons and for selfish reasons. If not, we will leave our children and our grandchildren a dreadful inheritance.

We need to educate public opinion in Europe, starting with our fellow European parliamentarians and national parliamentarians, about the importance of pursuing this issue. We need efficiency and coherent policy in relation to aid, but above all I would say that this efficiency, this effectiveness, this coherence, will only happen if there is transparency and accountability. This is not a residents’ association. This is the Parliament of Europe. We have not been shown the full respect we are entitled to by the Commission in this regard, and it is not the first time.

It took me two and a half years to negotiate the DCI because of the same approach and attitude by the Commission. If the Commission of its own volition does not return to the spirit and the principles of the Treaties, then the President of Parliament must call it to account and ensure that it does. It is our duty to defend this institution against intrusion from whatever source.

  Štefan Füle, Member of the Commission. − Mr President, the debate today on the financing instruments for external actions comes at the end of a long and difficult process. It concerns a package of important legislative amendments.

The Commission made its first proposals in April 2009. These included proposals to add developing countries under the Industrialised Countries Instrument – creating ‘ICI Plus’. This will enable us to conduct cooperation activities with them which did not necessarily qualify as Official Development Assistance.

The Commission also made proposals for measures to accompany the deal in the Geneva WTO trade talks. These measures concern banana-producing countries – hence the Banana Accompanying Measures or ‘BAM’.

Tomorrow, after two years of negotiation, the Parliament will vote on the package of amendments to the Development Cooperation Instrument, to the human rights instrument, and the ICI Plus. The Council has already approved the compromise agreed in conciliation.

The negotiations addressed complex issues concerning the EU’s functioning after the Lisbon Treaty. Despite differences of opinion between Parliament and the Council, the Commission considers that the institutions have achieved a balanced compromise. The Commission – and in particular my colleagues Cathy Ashton and Andris Piebalgs – would like to acknowledge the efforts of both sides in reaching this result.

Thanks are due also to Vice-President Vidal Quadras and the members of his team, as well as to the successive Council Presidencies, culminating in the agreement under the Polish Presidency.

Failure of this package is not an option. If we did not have this compromise, it would be a severe blow to the European Union’s reputation as a credible trade negotiator and as a trusted development partner. We would also be unable to pursue cooperation in some key areas with our strategic partners.

Therefore, the Commission welcomes the agreement covering the short period left between now and 2013. This compromise allows the Commission to immediately start implementing the budget for the ICI Plus initiatives and the Banana Accompanying Measures.

For this reason, the Commission is grateful for amending budget 6/2011, agreed on 18-19 November between Parliament and the Council. The additional EUR 13.4 million for the Banana Accompanying Measures means we can start implementation as soon as possible. The actions to be funded will improve the projection of the European Union’s interests at international level and comply with the development commitments made in Geneva to finally end the long-standing banana dispute in the WTO.

The compromise text addresses Parliament’s request for more clarity on the financial allocations in broad terms. At the same time, the proposal respects the Council position that the legislation should not include specific financial allocations for individual countries and regions.

Turning specifically to the Banana Accompanying Measures: the compromise text includes additional information on the three criteria to be followed by the Commission in determining the financial allocations per country. It also includes an indication of how the criteria will be applied. It also adds an explicit reference to the Commission’s intention to come forward with a formal implementing Commission decision on the indicative country allocations. This will give Parliament and the Council the opportunity to express their views on the financial allocations.

The accompanying measures promised in the framework of the banana trade agreements are important for the ACP countries. The tariff cuts have already started kicking in, and the ACP countries have requested this additional support. Last but not least, I would like to the remind the House that the funds we promised to the ACP countries’ banana producers in Geneva must be additional and cannot be taken out of the European Development Fund. Moreover, as we are also at the end of the 10th European Development Fund Financial Protocol, there is no margin of manoeuvre left within this instrument.

A few words about ICI Plus: under ICI Plus, minimum percentage floors for the three priority areas (public diplomacy, economic partnership and people-to-people links) and a maximum percentage ceiling for administrative costs have been included in the text. The four percentages add up to less than 100%, leaving sufficient margin to decide on final allocations during programming. This gives the necessary flexibility to take account of developments and needs on the ground. At the same time, it provides for involvement of the co-legislators in overall priorities for ICI Plus.

Mr President, to conclude, the Commission therefore looks forward to the final approval of the package by Parliament.

  Maurice Ponga, au nom du groupe PPE. – Monsieur le Président, chers collègues, demain, nous allons nous prononcer pour la troisième fois sur le nouvel instrument de coopération au développement qui prévoit des mesures d'accompagnement dans le secteur de la banane pour les pays ACP exportateurs de bananes suite à la réduction de leurs préférences tarifaires, le MAB.

Ce programme d'aide est doté d'un budget de 190 millions d'euros et s'adresse à dix pays ACP jusqu'en 2013. Il est d'une importance cruciale pour nos partenaires africains et des Caraïbes, dans la mesure où le secteur de la banane a un poids considérable au niveau économique et social dans ces pays. Si l'ensemble des revendications du Parlement concernant l'application des actes délégués n'ont pas été retenus pour cet instrument, je le regrette fortement.

Nous avons néanmoins réussi à obtenir des avancées. En effet, le texte prévoit des objectifs clairs et des critères précis pour l'allocation des ressources à la Commission. La Commission a également fait une déclaration précisant la méthodologie utilisée. De plus, nous avons une déclaration du Conseil sur le prochain cadre financier pluriannuel, précisant que ce dernier tiendrait dûment compte des actes délégués dans les instruments de l'aide extérieure après 2013. Enfin, dans sa résolution, le Parlement précise – et ce point me paraît capital – qu'il ne s'agit en aucun cas d'un précédent.

Je reviens du Togo, où se tenait la 22e session de l'Assemblée parlementaire paritaire ACP-UE, et je crois pouvoir vous dire que nos amis ACP comptent sur nous, eu égard à l'urgence de la situation. Les fonds auraient dû être débloqués il y a deux ans. Nous devons avoir conscience des conséquences déplorables pour nos partenaires ACP si l'ICD/MAB était rejeté. La situation de certains agriculteurs est dramatique, nous ne pouvons plus attendre et devons agir en conséquence. Je compte donc sur vous pour soutenir le texte.

  Richard Howitt, on behalf of the S&D Group. – Mr President, can I begin by saying that although we are dealing with the legality of the regulations, we must not forget that we are debating the 10% of the European budget which the EU commits to its relations with the rest of the world and to the European Initiative on Democracy and Human Rights (EIDHR), in which I have a direct interest. This is the money which we give to the victimised, the oppressed and the threatened of the world, very often against the wishes of the governments of their own countries who are the perpetrators of human rights abuse.

Commissioner, on the legalities I add two things: First I fully support my colleagues Mrs Gál and Mrs Lochbihler in saying that the hard fought interinstitutional agreement will win codecision for this Parliament on strategic decisions post-2014, including on the financial allocation of different priority areas with minimum percentages. This must be honoured.

Secondly, both before and after 2014, we have developed an informal but important strategic dialogue between Parliament and Commission on the projects supported by the EIDHR. For the people concerned, if their projects become publicly known it could lead to their lives being at risk. We found a way to balance confidence and scrutiny and I hope the Commissioner tonight will express his confidence that this arrangement will continue.

  Catherine Grèze, au nom du groupe Verts/ALE. – Monsieur le Président, chers collègues, si vous me permettez cette formule, les actes délégués ce n'est pas très sexy mais c'est fondamental.

Je voudrais tout d'abord saluer le travail accompli par M. Goerens pour défendre les droits qui ont été accordés par le traité de Lisbonne à cette "maison", à cette instance démocratique.

Le groupe Verts/ALE est, bien entendu, favorable à l'octroi de mesures d'accompagnement dans le secteur de la banane même s'il faut rappeler, au passage, que la compensation ne va en rien résoudre les problèmes des petits producteurs face à l'Amérique latine sur un marché mondialisé, en l'absence de mesures équitables à l'OMC.

En revanche, notre groupe est farouchement opposé à ce que nous renoncions aux droits accordés par le traité de Lisbonne. Le Parlement a un droit de regard sur les 190 millions qui vont être accordés et ne peut, en aucun cas, donner un chèque en blanc à la Commission ou aux États membres.

Je vous appelle, chers collègues, à rejeter le compromis sur l'instrument de financement ICD/MAB qui revient, en définitive, à ce que nous, parlementaires, sabordions nous-mêmes notre propre pouvoir.

  Willy Meyer, en nombre del Grupo GUE/NGL. – Señor Presidente, hay que reconocerle al señor Vidal-Quadras que se haya intentado mover por la arquitectura política laberíntica de la Unión Europea —que es una arquitectura realmente laberíntica— para intentar que, efectivamente, este Parlamento no quede excluido de la codecisión en temas tan importantes como estos instrumentos.

Yo quiero decirles que mi grupo parlamentario es muy crítico respecto a dos instrumentos: el Instrumento de Estabilidad y el Instrumento de promoción de la democracia y de los derechos humanos a escala mundial.

Para nosotros, la democracia y los derechos humanos son universales. No se puede priorizar un derecho humano sobre otro y las experiencias recientes de nuestra relación con Mubarak, Ben Ali, Gadafi, la actual Arabia Saudí o Marruecos evidencian que tenemos una experiencia de priorizar unos derechos humanos sobre otros.

Por lo tanto, es un instrumento claramente ideológico e injerentista. Nosotros no estamos de acuerdo con este instrumento y creemos, por contra, que tendríamos que plantear una defensa completa de lo que son los derechos humanos.

  Krzysztof Lisek (PPE). - Szanowny Panie Komisarzu! Koleżanki i Koledzy! Chciałem powiedzieć kilka słów i skupić się na akcie prawnym dotyczącym instrumentu finansowego na rzecz wspierania demokracji i praw człowieka, instrumentu, który wspiera na całym świecie demokrację, ochronę praw człowieka, polityczny pluralizm, demokratyczne uczestnictwo i reprezentację oraz faktycznie umożliwia interwencję w bardzo trudnych czasami sytuacjach. Żyjemy w XXI wieku, ale jesteśmy cały czas świadkami tortur, kar śmierci, dyskryminacji, prześladowań, wykorzystywania dzieci itd. Oczywiście nie naprawimy świata przy pomocy tego instrumentu, ale na pewno może on sprzyjać rozwojowi społeczeństwa obywatelskiego, demokracji, kształtowaniu się niezależnych mediów czy wolności słowa. Nasza działalność jest więc niezwykle ważna.

Mówiąc o wyniku procedury pojednawczej, można by użyć cytatu ze znanego filmu „nobody is perfect”, ale moim zdaniem dzisiaj naszym zadaniem jest zaakceptowanie tego kompromisu, aby może powrócić kiedyś do sprawy wzmocnienia pozycji Parlamentu w kontroli nad tym instrumentem.

  Ana Gomes (S&D). - Mr President, I am happy to acknowledge that, with respect to the European Instrument for Democracy and Human Rights, we already have a procedure developed between us and the Commission that does allow for scrutiny. We need to develop procedures that are flexible and publicised, specifically by the EU delegations who should work more on the ground with human rights defenders, civil society organisations, the media and so on.

This Parliament needs to be kept abreast of the implementation of projects while ensuring protection for the persons and organisations that are supposed to be assisted by this instrument. We need as well to explore more effective ways to help media escape and counter censorship, particularly internet censorship.

Let me now turn to the negotiating procedures regarding the delegated acts, and in particular in terms of the DCI instrument. I join colleagues who deplore the blackmail tactics used by the Council and the Commission to try to make this Parliament relinquish the powers that were conferred on it by Article 290 of the Lisbon Treaty. These are powers that this Parliament cannot abandon; it is an absolute must to exercise democratic control of an instrument – the DCI – with tremendous potential for development and empowerment of people worldwide.

We do not accept those tactics, particularly the threat of defaulting on the commitments made under the Banana Accompanying Measures. This will not work; the Parliament will not relinquish such powers.

  Lena Kolarska-Bobińska (PPE). - Mr President, I very much regret that Parliament was unable to fully defend its position during the negotiations with the Council and the Commission. I support the position that, in the future, Parliament should have a greater say on how funding under this instrument is used. It should be the elected representatives and not the working groups in the Commission who should decide on these important matters.

In spite of this fact, I will vote in favour of the European Instrument for Democracy and Human Rights because I believe this programme is too important to delay any further. We must continue to work towards greater democracy in Belarus, Iran and the Ukraine.

We now need to enlarge our actions in this domain. In addition to the European instrument for democracy we should now move towards the creation of a European endowment for democracy. The original idea of the European instrument for democracy was for an endowment and now is the time to fulfil this idea. In combining both instruments, I believe the role of the European Union in promoting democracy in the world will definitely be strengthened.

  Patrice Tirolien (S&D). - Monsieur le Président, chers collègues, notre coordinateur Thijs Berman ne peut finalement être présent ce soir pour des raisons personnelles. Cependant, je sais qu'il partage complètement mon analyse sur ce dossier.

La conciliation sur ce paquet législatif a été longue et fastidieuse et si le résultat sur les instruments "droits de l'homme" et IPI+ est satisfaisant, nous sommes très loin du compte concernant l'instrument "bananes". Ainsi, le compromis trouvé sur ce texte balaie d'un revers de la main le mandat qui avait été donné à notre équipe de négociation, qui était de placer le Parlement au même niveau que le Conseil pour toutes les décisions de programmation concernant le choix des priorités stratégiques et les dotations financières. Car ce sont bien des pouvoirs de notre Assemblée et de l'esprit même du traité de Lisbonne dont il est question ici.

Le choix des priorités de programmation est une décision hautement politique, sur laquelle notre Assemblée doit avoir son mot à dire. En refusant catégoriquement que soit reconnu un quelconque pouvoir de contrôle au Parlement et en usant de chantages honteux le Conseil a, une nouvelle fois, fait montre d'un repli idéologique condamnable. Mais les États membres doivent comprendre que l'action extérieure de l'Union européenne est dorénavant une compétence partagée entre nos institutions.

C'est pourquoi notre Parlement doit rester souverain et rejeter la proposition sur l'instrument "bananes". C'est la seule façon que nous avons de montrer au Conseil et à la Commission que le Parlement souhaite davantage de transparence dans les décisions communautaires. Si nous perdons cette bataille, l'absurde voudrait que nous devrions attendre d'avoir un nouveau traité pour obtenir, finalement, les pouvoirs que prévoit, pourtant déjà, celui de Lisbonne.

Jako przewodniczący Delegacji do spraw stosunków z Białorusią wiem, jak ważne jest, aby Komisja Europejska, a w ogóle Unia, posiadała instrument wspierania finansowego organizacji pozarządowych działających na rzecz demokracji i praw człowieka w warunkach dyktowanych przez autorytarne reżimy. Przykład – smutna historia Alasia Białackiego, który został skazany właśnie na Białorusi na 4,5 roku ciężkiego obozu pracy za to, że korzystał z pomocy zagranicznej – dowodzi też, że te instrumenty powinny być maksymalnie elastyczne, tak żeby ułatwiać korzystanie ze środków, które przeznaczamy na wsparcie dla tych ludzi, i jednocześnie chronić ich przed represjami.

Cieszę się, że obecne negocjacje doprowadziły do przyjęcia obecnych regulacji. Cieszę się, że w stosunku do wcześniejszych rozwiązań są one nieco bardziej elastyczne, ale liczę, że przyszłe rozwiązania pozwolą jeszcze skuteczniej wspierać organizacje, działające na rzecz demokracji i praw człowieka w krajach takich jak Białoruś.

  Jaroslav Paška (EFD) - Od apríla roku 2009, keď Komisia prijala návrh nariadenia, ktorým sa mení a dopĺňa nariadenie Spoločenstva č. 1934 z roku 2006, ktorým sa mal ustanoviť nástroj financovania spolupráce s industrializovanými krajinami a územiami a inými krajinami a územiami s vysokými príjmami, sa postoj Európskeho parlamentu a Európskej rady v mnohých bodoch rozchádzali. Preto bolo začiatkom tohto roku potrebné prikročiť k zmierovaciemu konaniu, aby sa rozdielne pohľady týchto inštitúcií na príprave nariadenia zosúladili a umožnili nové nariadenie uviesť do života. Počas ôsmich trialógov od marca do konca októbra sa podarilo posunúť rozdielne pozície Parlamentu a Rady tak, že dnes môžeme hovoriť o dohode v tom, že dôležité strategické rozhodnutia budú prijímané v rámci procesu spolurozhodovania a pri využívaní delegovaných aktov bude pozícia Parlamentu posilnená. Vytvoria sa tým isté predpoklady pre úspešné pokračovanie tohto legislatívneho procesu.

  Elena Băsescu (PPE). - Salut discutarea acestui raport, în contextul schimbării balanţei economice mondiale. De aceea, trebuie încurajată cooperarea cu statele în curs de dezvoltare, care exercită o influenţă comercială majoră în momentul de faţă. Subliniez relevanţa paragrafului 5 al raportului. Astăzi, relaţiile comerciale ale Uniunii trebuie diversificate geografic. Este nevoie ca parteneriatele Europei să ia în considerare provocările prezentului. Spre exemplu, condiţionarea ajutorului financiar prin îndeplinirea cerinţelor de mediu.

Atrag atenţia asupra faptului că ţările în curs de dezvoltare, cu potenţial economic, înregistrează deficienţe în acest domeniu. Astfel, este esenţial aportul lor la implementarea tratatelor de tipul Protocolului de la Kyoto. Mai mult, aceste state trebuie să asigure respectarea legislaţiei elaborate de Organizaţia Internaţională a Muncii. Dezvoltarea economică rapidă poate genera abuzuri şi încălcări ale drepturilor fundamentale.

W przypadku polityki zagranicznej, to jest działań zewnętrznych, w tym polityki rozwojowej, Stosowane instrumenty wymagają szczególnej finezji w wyborze. Jak rozłożyć priorytety? Ile dać na edukację? Ile na pomoc finansową i rzeczową? Gdzie umieścić rozwój przedsiębiorczości czy pomoc humanitarną oraz rozwój demokracji czy wreszcie pomoc na rozwój dla organizacji pozarządowych? Parlament Europejski jest instytucją wybraną przez społeczeństwo, ma więc szczególne prawo do podejmowania decyzji o przeznaczeniu środków na rzecz budowy i rozwoju wolności, demokracji i praw człowieka, budowy społeczeństwa obywatelskiego oraz spełnienia wymogów społecznych i środowiskowych.

  Štefan Füle, Member of the Commission. − Mr President, this debate has been interesting and has paved the way for a better understanding and, I hope, also more cooperative interaction in the future.

In this regard, I have heard the concerns of Parliament. I am confident that they will be met in the next Multiannual Financial Framework when the Commission presents its proposals for the new instruments in the coming weeks. I agree with many of you who said that even now we need protection to be provided to those defending human rights. The Commission agrees that it is a problem when regimes use tax laws to further oppress human rights NGOs. The changes agreed allow us to accept taxes as eligible costs so that the attention of the authorities is not drawn to NGOs or to Commission funding.

Honourable Members, I would like to remind you that the Commission is sensitive to the European Parliament’s requests and has already made the formal commitment to fully comply with the new provisions of the Lisbon Treaty. In its Communication ‘A Budget for Europe 2020’, the Commission made that commitment to the extensive use of delegated acts. Ms Lochbihler has referred to that part of the text, so I will not quote it again.

Let me just restate that the compromise before you represents today a fair balance between Parliament and the Council. Each side can see things it likes, and things which it does not like. However, I would insist on having a more forward-looking vision going beyond the limited field of interinstitutional relations.

As I stated in the debate, failure of this package is not an option. There is no Plan B. If Parliament does not adopt this legislation tomorrow, the Commission will have no basis to implement the budget for ICI Plus and the Banana Accompanying Measures. For the ICI Plus, we will be unable to promote our interests and value abroad. For the Banana Accompanying Measures, the Commission wants to state clearly that funds are not available from any other source, such as the European Development Fund.

If it fails to adopt the Banana Accompanying Measures, the European Union will be seen as an unreliable trade partner and, what is even more dramatic, unreliable for our poorest ACP partners. This is not what our citizens are expecting from the European Union.

Nevertheless, I would like to stress the fact that this compromise is a good result for the European Union as a single player in its external dimension, both for the European Union’s cooperation with its strategic partners and for its cooperation with the ACP banana-producing countries.

  Charles Goerens, rapporteur. − Monsieur le Président, je viens d'entendre à l'instant monsieur le commissaire Füle, qui a évoqué – je le cite – "une bonne action coopérative, ici, dans le cadre de cette séance". Nous voulons bien coopérer avec ceux qui sont présents, mais il est difficile de coopérer avec ceux qui sont absents: il n'y a personne en face. Je n'ai pas entendu un seul argument ni ce soir ni au cours des huit trilogues que nous avons eus avec le Conseil.

Si le Conseil avait été présent ce soir, nous aurions pu échanger sur ce qui nous sépare; nous aurions aussi pu parler de ce qui nous unit. J'ai souvent eu l'occasion de le faire dans le cadre de la commission du développement du Parlement européen. Nous aurions pu parler, par exemple, d'une vision commune de la coopération au développement de l'Union européenne, Commission et États membres dans leur ensemble, à laquelle nous invite d'ailleurs le traité de Lisbonne. Cela devrait se traduire dans un partage des responsabilités. Je dis bien des responsabilités.

Or, quelle est la situation aujourd'hui? Les États membres dépensent à peu près 80 % sous leur responsabilité propre, dans le cadre de la coopération au développement. Il est normal que les États membres, de ce point de vue, aient le dernier mot pour ce qui concerne leurs budgets nationaux. Le Parlement n'a rien à y dire.

Par ailleurs, les États membres confient à la Commission un montant important que celle-ci exécute sous le mandat confié par les États membres: c'est le Fonds européen de développement. Tant que nous n'aurons pas obtenu la budgétisation du FED, le Parlement européen restera à l'écart. Là non plus, le Parlement européen n'a rien à y dire, pour déjà presque 90 %.

Puis, pour une partie infime, qui est confiée à la Commission, le Parlement peut invoquer l'article 290, qui le met sur un pied d'égalité avec le Conseil et, là encore, le Conseil veut nous tenir à l'écart, ce qui est inadmissible. Veut-on que le Parlement européen joue aussi son rôle dans le cadre de l'élaboration d'une vraie politique de coopération au développement? Oui ou non? Je persiste à croire que le Conseil n'a pas compris le message.

Une fois de plus, le Conseil exige que le Parlement reste à l'écart et c'est d'ailleurs – on s'en souvient – le mandat que le Conseil avait fixé à la présidence hongroise. D'un côté, on appelle à la coordination de la politique, de l'autre, on nous prive des moyens pour nous faire respecter. On ne nous accorde même pas les moyens qui seraient susceptibles de nous conférer un tant soit peu de respect vis-à-vis de nos partenaires institutionnels.

Le Parlement n'est, quant à lui, pas resté muet. Nous avons, contre vents et marées, appuyé la Commission lorsqu'il s'était agi d'intégrer l'effort de développement dans le service pour l'action extérieure. Je prends à témoin tous ceux présents sur ce banc et les défie de s'inscrire en porte-à-faux contre ce que je viens de dire. Nous n'avons ménagé aucun effort pour vous permettre d'exister aux côtés de la nouvelle haute représentante pour les affaires étrangères.

J'estime, Monsieur le Président, que les efforts déployés par notre Parlement, et notamment par la commission du développement, auraient mérité de trouver un écho bien plus perceptible de la part des institutions, et notamment de la part du Conseil.

  Helmut Scholz, Berichterstatter. − Herr Präsident, Herr Kommissar! Der Kritik meines Kollegen Goerens am Rat kann ich mich nur anschließen, auch ich vermisse den Rat heute sehr. Trotzdem möchte ich nach all den würdigenden Worten der Kompromisse und auch der aufgezählten Dissense zum Abschluss der Debatte die Gelegenheit nutzen, nochmals darauf hinzuweisen, dass die Kommission nun ein komplett überarbeitetes Strategiepapier zum ICI+ vorlegen sollte.

Es kann nicht sein, dass wir als Gesetzgeber das Instrument grundlegend neu ausrichten, und die Kommission dann mit einem alten Strategiepapier weitermacht, das schon vor der Gesetzesnovelle geschrieben wurde, das also als Referenzdokument an der alten Mitteilung „Global Europe“ festhält. Die Gesetzgeber haben der Verordnung vielmehr einen ganz neuen Tenor gegeben, nämlich den der partnerschaftlichen Herangehensweise und des wechselseitigen Nutzens. Die Gesetzgeber stellen die Verordnung in den Kontext anderer zentraler Politikziele der Europäischen Union, insbesondere der Kohärenz mit Entwicklungspolitik, der Durchsetzung internationaler Normen im Arbeitsrecht und der Bekämpfung des Klimawandels. Das Strategiepapier jedoch ignoriert nach wie vor diesen Willen. Das Ziel der Mehrjahresplanung sei namentlich die Durchsetzung europäischer Wirtschafts- und Gewinninteressen. Das Instrument solle – so wörtlich – „Schwierigkeiten bei der Penetrierung bestimmter Märkte durch EU-Unternehmen beheben“. Darauf haben wir als Gesetzgeber mit dem Instrument und den entsprechenden Steuergeldern nicht abgezielt. ICI+ soll ein modernes Kooperationsprogramm sein und keine Eroberungswaffe.

Herr Kommissar, aus meiner Sicht besteht nach wie vor die Pflicht, den Willen der Gesetzgeber auch künftig umzusetzen. Wir wollen Planungs- und Strategiepapiere nicht selbst schreiben. Das haben wir immer wieder deutlich gemacht. Das soll auch weiterhin die Kommission machen. Aber wir benutzen und beanspruchen ein Vetorecht, falls die Vorgaben, die wir aufgeschrieben haben, ignoriert werden. Deshalb: Die Vorschläge für die neuen Generationen von Finanzierungsinstrumenten müssen das Prinzip der delegierten Rechtsakte sinnvoll einsetzen.

  Kinga Gál, előadó. − Köszönöm a vitában elhangzottakat és az itt elhangzott problémákat is. Szeretném hangsúlyozni, hogy teljesen megértem azokat a kollégákat, akik aggódnak, hogy nehogy egy negatív precedenst teremtsünk itt. Mindnyájan azt szeretnénk itt közösen, hogy effektív, használható, koherens pénzügyi eszközei legyenek az Uniónak, és ez különösen igaz az emberi jogok és demokratizálódás területére.

Ahhoz, hogy valóban elhiggyék Európa polgárai, hogy ezek a milliók jó ügyet szolgálnak, ahhoz szükség van olyan stratégia kialakítására, amit a Parlamenttel együtt alakítanak. Tehát a legtermészetesebb igény részünkről, hogy többéves kerettervet, stratégiát ne lehessen a mi beleegyezésünk, együttdöntésünk nélkül elfogadni. Ezért érthetetlen és keserű mindenki számára az, hogy a Bizottság és a Tanács részéről miért ez az ellenállás.

Ahogy mondtam, megértem a jelentéstevők fenntartásait, de ugyanakkor látnunk kell, hogy eljutottunk a kompromisszumig, és gyakorlatilag a demokratizálódásért és az emberi jogokért létrehozott pénzügyi eszköz tekintetében ezt egy komoly előrelépésnek értékeljük. Ugyanakkor elvárjuk, hogy érvényesüljön is majd ez a megállapodás, ez az állásfoglalás az elkövetkező stratégia és keretterv kialakításában. Szeretném hangsúlyozni a kettős felelősségünket vagy többes felelősségünket és hitelességünket is, amely ebben az immár két éve elhúzódó vitában most már mindnyájunkat egyre jobban kötelez.

  Barbara Lochbihler, rapporteur. − Mr President, let me come back to the instrument for democracy and human rights.

The contributions in this debate have also shown that this instrument is one in which Parliament has always had great faith and for which it has had a keen passion. But we also see, for example in the ongoing discussion on the European Endowment for Democracy, that we clearly need to render this instrument more flexible, and readier to support urgent cases like human rights defenders, civil society under threat, unregistered actors and social movements, and so on.

Let me also repeat that the principle of greater involvement of the European Parliament in the establishment, running and control of the human rights and democracy instrument has been accepted on all sides, from the EU institutions to Member States to civil society. Therefore, I would like to invite and to call on colleagues to get ready for the upcoming struggle. Last time we had to fight for the very existence of the instrument. Now we will have to work to support its improvement.

  Gay Mitchell, rapporteur. − Mr President, first of all may I also thank our colleague Mr Vidal-Quadras for his efforts in the conciliation process though there are concerns which remain. I realise that he did his very best to bring this agreement to the most successful conclusion he could in all of the circumstances.

But I do want to say this: with the advent of the Lisbon Treaty, on which my country had not one but two referenda, we were told that there would be clear codecision powers between Parliament and Council in a variety of areas, one of which is in the development cooperation area, and I do not accept in this instance that this has been the case.

Anywhere where Council is involved, Parliament should be involved in relation to the legislative process. At no stage do I want to see Parliament involved in micro-management: we have neither the skills nor the time nor the interest in doing that, but in the legislative process – post-Lisbon in particular – it is our responsibility, it is our duty and it is our Treaty-based power to do so.

I believe that handsome is as handsome does – to use the phrase that I was taught as a young boy – that is, there is no point in telling us we are going to do this and that and then do something else. We know you by what you do. I say this to the Commission: what you have been doing in relation to the respect for the mutual legislative powers of Parliament and Council leaves a lot to be desired. It is really sowing a lot of sourness, and there will be a time when you will come back to Parliament and Parliament may not be as accommodating as you may wish if you do not treat Parliament with the basic respect that it is due.

Can I say in relation to the particular instrument for which I have responsibility, the Financial Instrument for Development and Cooperation, that it is clear that if we could get cohesion working properly a lot of lives could be saved – I think the Commission’s own figure is 6 billion per year, perhaps the Commissioner might indicate this.

  Alejo Vidal-Quadras, Presidente de la Delegación en el Comité de Conciliación Señor Presidente, a estas alturas de este debate, si se me permite un pequeño desahogo subjetivo, yo, como Presidente de la Delegación del Parlamento Europeo en el Comité de Conciliación, me siento como ese alumno que presenta al profesor una redacción de alta calidad en su contenido, su vocabulario, su ortografía y su sintaxis, con un pequeño borrón de tinta en la última línea, y le suspenden. Señor Presidente, esto es muy doloroso.

Yo quiero agradecer a sus Señorías sus amables palabras y, ya que hemos hablado de precedentes, ¿es o no es un magnífico precedente que todos los elementos esenciales de esos instrumentos estén en este acuerdo transitorio bajo codecisión? ¿Es o no es una excelente señal para el futuro que en este acuerdo transitorio el Consejo nos ofrezca una declaración política, por la que se compromete a considerar adecuadamente el uso de actos delegados en futuros instrumentos de financiación?

Por consiguiente, cuando se habla de cuestiones estratégicas, yo creo que, estratégicamente, con este acuerdo hemos dado un interesante paso adelante. Por supuesto, cuando la Comisión se sienta a negociar con cada país concreto exportador de bananas cómo se va a gastar en ese país el dinero que se ha decidido, bajo control del Parlamento, según sus criterios y sus prioridades, en ese momento los Estados miembros tienen algo que decir de acuerdo con el antiguo procedimiento. Pero me parece que exigir que los Estados miembros queden excluidos de ese último paso final concreto era apurar un poco la suerte.

Por consiguiente, teniendo en cuenta que hay pasos adelante y teniendo en cuenta que las consecuencias políticas y sociales de un fracaso serían muy negativas, me reitero en mi posición de solicitar a la Cámara...

Salut acordul găsit în urma procedurii de conciliere dintre Parlament și Consiliu în ceea ce privește Regulamentul de instituire a unui instrument de finanțare pentru promovarea democrației și drepturilor omului la scară mondială. Schimbările convenite aduc o mai mare flexibilitate în utilizarea fondurilor europene destinate promovării drepturilor omului în lume prin faptul că stabilesc ca fiind eligibile, în cazuri speciale, cheltuielile privind impozitele și taxele plătite de beneficiarii acestor fonduri. Această flexibilitate va putea conduce la sporirea eficienței acestor fonduri și deblocarea finanțărilor programelor și proiectelor din țările terțe. Totuși, este important ca acordarea acestei eligibilități să se facă de la caz la caz și nu de manieră automată, pentru a elimina orice abuzuri. La fel de important este faptul că revizuirea acestui Regulament contribuie, de asemenea, la mai multă coerență a Uniunii Europene în ceea ce privește instrumentele de finanțare ale politicii sale externe, ținând cont de faptul că Instrumentul european pentru democrație și drepturile omului era, alături de Instrumentul de cooperare pentru dezvoltare, singurul care nu prevedea niciun fel de excepție de la principiul neeligibilității cheltuielilor privind impozitele și taxele.
