  Karima Delli, rapporteure. − Madame la Présidente, mes chers collègues, la crise ne doit absolument pas être un prétexte pour négliger la santé et la sécurité au travail. Notre ambition est un travail de qualité pour tous les travailleurs, malgré la persistance d'un chômage de masse et l'explosion du travail précaire. Selon l'Agence européenne pour la sécurité et la santé au travail, 168 000 personnes décèdent chaque année en Europe suite à des accidents et des maladies liées au travail, dont plus de la moitié sont des cancers, et un quart des maladies cardio-vasculaires. Comment ne pas être scandalisé par ce chiffre en augmentation?

En tant que rapporteure sur l'évaluation de cette stratégie européenne pour la santé et la sécurité au travail, qui prendra fin en 2012, mes conclusions sont claires. Ce serait une faute morale que de fermer les yeux sur la souffrance au travail. Ce serait aussi une faute économique, puisque toutes les études nous montrent que les accidents et les maladies professionnelles coûtent cher, tant à nos systèmes de santé et de sécurité sociale qu'à nos entreprises.

Cette stratégie doit être, dès 2013, plus ambitieuse, plus cohérente mais surtout beaucoup plus courageuse. Ainsi, il faut renforcer le cadre législatif, adapter la législation aux nouveaux risques, tels que les risques psycho-sociaux, les troubles musculo-squelettiques ou encore les nanomatériaux. Le stress au travail ne doit pas être traité par de simples formations, ce qui s'avère complètement insuffisant alors qu'un travailleur européen sur deux est exposé à des risques affectant sa santé mentale. La vérité, il faut la dire bien haut: les travailleurs souffrent surtout de la réorganisation brutale du travail, de son intensification et des méthodes de gestion défaillantes.

Par ailleurs, nombreux sont les salariés qui alertent sur les dangers pour l'homme mais aussi pour l'environnement. Ces personnes doivent être protégées. Je suis fière que nous adressions, ici au Parlement, à la Commission européenne une demande de directive protégeant ces fameux lanceurs d'alerte.

La Commission européenne ne doit pas hésiter à lancer des procédures en infraction contre les États membres qui ne respectent pas leurs obligations. L'harmonisation européenne dans le domaine de la santé est une avancée considérable.

Il est aussi crucial de développer une culture de la prévention en Europe. Ainsi, les États doivent renforcer les effectifs de leur inspection du travail pour atteindre l'objectif d'un inspecteur pour 10 000 travailleurs, comme le recommande l'Organisation internationale du travail.

Il est absolument injustifiable d'affaiblir les règles de prévention dans les petites et moyennes entreprises ou pour les travailleurs indépendants, qui bénéficient du même droit fondamental à la protection de leur santé.

Par ailleurs, nous constatons une progression de l'externalisation des emplois et l'apparition de la sous-traitance en cascade. De nouveaux travailleurs sortent de la sphère de la prévention: travailleurs précaires, faux indépendants, travailleurs sous-traitants, notamment dans le secteur nucléaire. Compte tenu de l'exposition à de puissantes radiations et du danger lié à la gestion des matériaux radioactifs, il est essentiel qu'il y ait des normes rigoureuses de formation de sécurité au travail et d'inspection par des entités indépendantes.

Finalement, il faut prendre la mesure des risques émergents et des risques nouveaux, tels que les risques chimiques et biologiques, qui sont complexes, mais pour lesquels les données sont encore insuffisantes. Il faut rapidement agir dans le domaine de l'amiante, le silice et d'autres carcinogènes bien connus. Le règlement REACH a un rôle très important à jouer dans la prévention des cancers et des autres maladies liées au travail. Il doit être mis à jour et intégralement mis en œuvre.

Enfin, il faut reconnaître, ou mieux reconnaître les maladies professionnelles, à commencer par les cancers, afin d'identifier rapidement l'ensemble des problèmes.

Chers collègues, Monsieur le Commissaire, je vous demande donc à tous de soutenir mon rapport, parce que je sais pertinemment qu'il va permettre de relever tous ces défis et que l'Europe a un rôle à jouer: l'Europe doit protéger l'ensemble des travailleurs qui ne doivent pas perdre la vie – leur vie – à cause de leur travail.

Monsieur le Commissaire, j'espère que, dès 2013, il y aura bien une stratégie européenne de santé et de sécurité au travail et j'espère réellement que nous avancerons de manière assez rapide.

  Συλβάνα Ράπτη (S&D). - Κυρία Πρόεδρε, θέλω να συγχαρώ και να ευχαριστήσω την Karima Delli για την εξαιρετική έκθεση που έχει κάνει. Είχα τη χαρά και την τιμή να είμαι σκιώδης εισηγήτρια από την πλευρά των σοσιαλιστών για την έκθεση αυτή και θεωρώ υποχρέωσή μου να θυμίσω το αποτέλεσμα της ψηφοφορίας για την έκθεση αυτή στην επιτροπή: 36 ψήφοι υπέρ, 2 μόνο κατά. Νομίζω ότι είναι ένα πολύ σημαντικό στοιχείο.

Να θυμίσω επίσης ότι ο αμίαντος σκοτώνει τους εργαζόμενους· να θυμίσω ότι οι μυοσκελετικές παθήσεις ταλαιπωρούν τους εργαζόμενους· να θυμίσω ότι το στρες οδηγεί εργαζόμενους στην αυτοκτονία. Η άμυνά μας σε όλα αυτά είναι μια νέα στρατηγική για την υγεία και την ασφάλεια στον χώρο εργασίας από το 2012 και μετά. Το όπλο μας για να αμυνθούμε σε όλη αυτή την κατάσταση είναι μία νέα νομοθεσία, μία νέα οδηγία. Και αυτό, κύριε Επίτροπε, είναι στα δικά σας χέρια, έχετε όλα τα επιστημονικά στοιχεία, έχετε όλη την τεκμηρίωση και έχετε –το κυριότερο– την υποστήριξη του Ευρωπαϊκού Κοινοβουλίου για να προχωρήσετε και να διασφαλίσετε συνθήκες υγείας και ασφάλειας για τους εργαζόμενους, ιδιαίτερα σε αυτούς τους δύσκολους καιρούς οικονομικής κρίσης που περνάει η Ευρώπη.

  Danuta Jazłowiecka (PPE). - Pani Przewodnicząca! Kryzys ekonomiczny jest zazwyczaj okresem niezwykle trudnym nie tylko dla przedsiębiorców, ale również dla pracowników. Firmy, starając się ograniczyć koszty funkcjonowania, przykładają o wiele mniejszą wagę do kwestii przestrzegania zasad bezpieczeństwa i higieny pracy. Nie możemy zapominać, że europejska strategia na rzecz zdrowia i bezpieczeństwa pracy jest realizowana w określonych okolicznościach ekonomicznych i to one w dużej mierze wpływają na jej skuteczność.

Obecnie największym zagrożeniem dla pracowników jest nieustające ryzyko utraty pracy i ściśle powiązane z nim zbyt często występujące zjawisko mobbingu. Pracodawcy i przełożeni mogą wykorzystywać swoją pozycję, wiedząc, iż sytuacja na rynku pracy stawia ich w uprzywilejowanym położeniu. Niewiele osób jest w stanie przeciwstawić się doświadczanej agresji, wiedząc, iż może to skończyć się utratą jedynego źródła dochodów. Dlatego też uważam, że powinniśmy się skupić na tym zjawisku. Niewątpliwie ogromnym niedopatrzeniem jest brak wspólnej i jednolitej definicji zjawiska mobbingu na szczeblu europejskim. Z tego też powodu przyłączam się do apelu Komisji i państw członkowskich, aby opracowały krajowe strategie walki z przemocą w miejscu pracy. Strategie te muszą być jednak oparte na wspólnej dla państw członkowskich definicji mobbingu oraz skutecznej kampanii informującej o przysługujących prawach. Na apel mojej koleżanki Karimy o zaakceptowanie i wsparcie tego sprawozdania, mówię „tak”.

  Miroslav Mikolášik (PPE). - Napriek faktu, že v oblasti bezpečnosti a ochrany zdravia pri práci existuje rozsiahle acquis communautaire, praktické skúsenosti pracovníkom v bežnom živote dokazujú, že samotná prijatá legislatíva často nepostačuje. Zabezpečenie dodržiavania jedného zo základných práv, práva na zdravie, si vyžaduje pravidelnú modernizáciu právnych predpisov a ich vykonávacích opatrení v súlade s najnovšími medicínskymi poznatkami o zdravotných rizikách. Za hlavný súčasný problém považujem nedostatočnú pozornosť venovanú chemickým rizikám, ktoré majú vysoko negatívny vplyv na pracovníkov. Komplexné štúdie takýchto rizík stále chýbajú hoci sa prudko zvyšuje výskyt nádorových ochorení a iných chronických chorôb. Zamestnanci by mali byť pravdivo a primerane informovaní o rizikách spojených s dlhodobým vystavovaním sa karcinogénnym látkam, ktoré, žiaľ, zatiaľ nie je možné nahradiť. Identifikácia takýchto látok musí zároveň viesť bez zbytočných prieťahov k ich náhrade.

  Derek Roland Clark (EFD). - Madam President, how many men does it take to change a light bulb? In one English council, tenants must send for council staff, who may not use ladders, only scaffolding. That is three people: one holds the rigging, one changes the bulb and one supervises.

That is the crazy English, but I do have better examples. At a meeting six years ago, I was astonished to hear of the number of young people injured at work. The independent body – unconnected with the EU – which had called the meeting suggested a range of safe practices which they claimed had reduced these figures – without legislation.

As I have said before, good ideas always spread, and a Latvian took these documents to use locally. But the EU legislates; we do it every day. Why – if good results can be achieved by unbiased advice from non-political sources? So I ask that elements of this draft report, such as simplifying existing legislation, implementing national strategies and adjusting to the context of Member States, carry through to the final, advisory version. Voluntary systems are always best: no infringement proceedings.

  Silvia-Adriana Ţicău (S&D). - 168 de mii de cetăţeni europeni mor în fiecare an din cauza accidentelor de muncă sau a bolilor profesionale, iar alte 7 milioane sunt răniţi în accidentele de muncă. Aproximativ 50% dintre lucrătorii din Uniunea Europeană nu au acces la servicii de prevenţie la locul de muncă, în special în cadrul IMM-urilor şi al lanţurilor de subcontractare. Investiţiile în politicile de prevenire a riscurilor de accident în muncă asigură creşterea productivităţii şi a competitivităţii, asigură sisteme viabile de securitate socială şi scăderea cheltuielilor de securitate socială, estimate la 5,9% din PIB.

Măsurile de austeritate din timpul crizei economice nu trebuie să pericliteze măsurile privind sănătatea şi securitatea în muncă. Atrag atenţia asupra recunoaşterii condiţiilor grele de muncă şi a adoptării măsurilor de sănătate şi securitate, necesară pentru acest gen de locuri de muncă.

Consider că perspectiva de gen trebuie integrată în politicile strategiei europene 2007-2012 privind sănătatea şi securitatea în muncă pentru a reflecta mai bine riscurile specifice cu care se confruntă femeile în muncă.

In common parlance, this is a no-brainer. Obviously, the healthier and safer workers are, the more productive they will be, the happier they will be and the greater sense of ownership they will have. There will be a concomitant reduction in terms of absenteeism and social security costs.

While legislation cannot do everything, it is nevertheless important that we legislate, particularly in the areas that Mrs Delli mentioned of carcinogenic, biological and chemical risks. Also, my experience is that, where legislation is taken seriously, people actually go beyond that legislation. Recently I was asked to present the National Health and Safety Awards for all sorts of businesses – big and small – in Ireland. I was absolutely amazed at the lengths to which companies went to secure the health and safety of their workers and the bond that it created within and between the workforce and the management. Certainly a great deal can be learned from that.

  Jaroslav Paška (EFD). - Súhlasím s tým, že je potrebné pokračovať v úsilí o sústavné zlepšovanie bezpečnosti našich pracujúcich.

Treba si však uvedomiť, že hospodárska situácia tlačí na zamestnávateľov, aby šetrili ochranné prostriedky, šetrili na bezpečnostných školeniach, dokonca niektorí siahajú k tomu, že sa uchádzajú o čiernu prácu. Na druhej strane táto hospodárska situácia tlačí aj na nezamestnaných, na ľudí, ktorí chcú pracovať a sú ochotní riskovať viacej pre zamestnanie, pre získanie práce a sú ochotní, samozrejme, pracovať v niektorých prípadoch aj na čierno. Preto je potrebné, aby sme dokázali veľmi operatívne a pohotovo reagovať na spoločenské zmeny, ktoré v súčasnosti nastávajú, a doplňovať naše pracovné predpisy tak, aby reagovali na túto situáciu. Musíme zdôrazňovať, že za pracovnú bezpečnosť vždy musí v plnej miere byť zodpovedný zamestnávateľ. Ten musí svojich zamestnancov vyškoliť, ten ich musí zabezpečiť ochrannými prostriedkami a ten, samozrejme, v prípade nejakého zranenia alebo nejakej príhody, musí niesť aj dôsledky. Treba zamestnancom pomôcť pri súdnych konaniach a vymáhaní škody, potom sa aj zamestnávatelia naučia, že sú zodpovední za prípadné zranenia alebo za poškodenie zdravia.

Takže z tohto pohľadu musíme viacej vstúpiť do našej legislatívy a usilovať sa o zlepšenie týchto pravidiel.

  László Andor, Member of the Commission. − Madam President, in February 2007 the Commission adopted a communication entitled ‘Improving quality and productivity at work: Community strategy 2007-2012 on safety and health at work’.

The strategy provided a political framework for improving occupational safety and health over the period 2007 to 2012 and laid out a road map for stakeholders to play an active role in achieving the objectives it identified. The fact that it was welcomed by all EU institutions highlights the importance of such an EU strategic framework for coordinating national policy and ensuring that workers enjoy safer and healthier conditions at work.

In particular, this House adopted a resolution on 15 January 2008 calling on the Commission to report to it on progress made at the half-way stage. In April this year the Commission published a staff working paper entitled ‘Mid-term review of the European strategy 2007-2012 on health and safety at work’. It takes stock of what has been achieved now that the strategy has reached the half-way mark, re-examines the policy orientations and sets out proposals for the future of EU policy on safety and health at work.

The results of the mid-term review confirm that the strategy remains broadly fit for purpose, despite the changes that have taken place in the Union since 2007, and in particular the impact of the financial and economic crisis.

The strategy’s prime objective is achieving an ‘ongoing, sustainable and uniform reduction in accidents at work and occupational illnesses’. Given the overall reduction in incidence in the period covered by the previous EU strategy, the strategy set an ambitious target to reduce the total incidence of accidents at work in the 27 Member States by 25% from 2007 to 2012. A final estimate for the whole period covered by the strategy may not be available until 2014. This is because of time constraints related to collecting and processing national data by Eurostat. The findings in the mid-term review show a general positive development involving a reduction in accidents at work over the period 2007 to 2009.

But, despite this progress, there is still work to do under the current strategy. From the Commission’s viewpoint, the assessment of the first part of the period covered by the strategy highlights a number of priorities.

First, there is a need to simplify and update existing legislation and finalise proposals for legislation, after consulting the social partners and the stakeholders extensively. This relates in particular to the proposal for a revision of Directive 2004/40/EC on electromagnetic fields (the Commission proposal was adopted in June 2011 and is now being discussed by the co-legislators) and the proposal for a new directive on ergonomics to replace the existing Manual Handling and Display Screen Equipment Directives (the Commission proposal may be adopted in the first half of 2012). Furthermore, the Commission will carry out an extensive screening of the implementation of all EU health and safety legislation, covering the period 2007 to 2012. The Commission is required to present its final report on this in 2015 at the latest.

Second, we need to consolidate the encouraging results of the first phase of implementation and to take them further in terms of adopting and implementing national strategies for occupational safety and health.

Third, we need to build on experience with Scoreboard 2009, with a view to developing a structured and commonly-accepted monitoring tool for evaluating future EU strategies for occupational safety and health.

Fourth, we need to carry out the final evaluation of the current strategy and, based on the findings, to identify the next steps in the health and safety area for the period after 2012.

The Commission welcomes the Parliament’s decision to discuss and adopt a report on the mid-term review of the EU strategy on health and safety at work.

I appreciate the ambitious nature of this document and share the House’s view of the importance of occupational safety and health policy, which is one of the most advanced areas of European social policy. The importance of health and safety at work does not diminish at a time of crisis and my recent visit to the Bilbao Agency for Occupational Health and Safety was meant to signal this.

In line with the Europe 2020 Strategy, improving working conditions goes naturally with job creation, promoting permanent employment and higher productivity, as the Commission highlighted in its communication on ‘An Agenda for new skills and jobs’.

In 2012 the Commission will complete the final evaluation of the current strategy and adopt a communication on EU occupational safety and health policy priorities for the post-2012 period based on the results of that evaluation. I can also add that I have started to work very closely with the Danish Presidency to keep health and safety among our priorities in the European Union.

  Iosif Matula (PPE), in writing. The European strategy 2007-2012 on health and safety at work ensures the fundamental right of EU citizens to have access to safe and favourable working conditions.

While those in high-skilled positions enjoy a work environment that safeguards the health and safety of its employees, those in low-skilled and low-paying positions are subject to increased vulnerability as a result of illness, accidents and other work-related traumas. Acknowledging the pervasiveness of precarious working conditions is the first step in challenging the status quo.

A number of roadblocks exist, of course. Undeclared labourers are arguably most at risk because of the informal agreement between them and their employers. They must be incentivised to guarantee the provision of a set of fair working conditions regardless of the skill level of their employees. Like other Member States, Romania’s Labour Code explicitly provides for the protection of the health and safety of workers, yet applying it in practice remains a significant challenge.

  Jutta Steinruck (S&D), schriftlich. Ich danke der Kollegin Delli für diesen Bericht. Die Wichtigkeit der Gesundheit kann nicht oft genug unterstrichen werden. Gemäß der Europäischen Agentur für Sicherheit und Gesundheitsschutz am Arbeitsplatz in Bilbao erklären fast 28 % der europäischen ArbeitnehmerInnen, dass sie unter erheblichen gesundheitlichen Problemen leiden. Damit ist jeder/jede vierte ArbeitnehmerIn in Europa betroffen. Deshalb müssen wir die bestehenden Gesetze zum Gesundheitsschutz am Arbeitsplatz nicht nur besser in den Mitgliedstaaten anwenden. Wir müssen sie auch weiter entwickeln und verbessern, denn auch die Arbeitswelt verändert sich ständig. Wo früher physische Krankheiten an der Spitze der Arbeitskrankheiten standen, sind es heute vor allem psychische Erkrankungen, die in der Arbeitswelt auf dem Vormarsch sind. Genau diese Entwicklung muss durch eine noch bessere Gesundheitsüberwachung sorgfältiger untersucht werden. Die Maßnahmen müssen daran angepasst werden. Auch die Prävention muss eine größere Rolle spielen. Weiterhin dürfen wir nicht vergessen, dass bestimmte Gruppen auch einen besonderen Gesundheitsschutz brauchen. Junge und ältere ArbeitnehmerInnen, MigrantInnen und ArbeitnehmerInnen in unsicheren Beschäftigungsverhältnissen sind erwiesenermaßen in höherem Maße berufsbedingten Gesundheitsrisiken ausgesetzt. Wenn ohne vorherige Ausbildung oder die erforderlichen Fertigkeiten gearbeitet wird, steigt die Gefahr einer Krankheit oder eines Unfalls schnell an. Das gilt es zu verhindern.
