Der Präsident. − Als nächster Punkt folgt die kurze Darstellung des Berichts von Norica Nicolai im Namen des Ausschusses für die Rechte der Frau und die Gleichstellung der Geschlechter über die Lage der Frauen in Kriegen (2011/2198(INI)) (A7-0429/2011).
Norica Nicolai, Raportoare. − Nu cred că voi reuşi să epuizez toată problematica raportului în aceste patru minute, însă câteva chestiuni pe care le consider esenţiale doresc să le punctez.
Acest raport este oportun pentru că, din păcate, violul ca armă de război a fost inventat de societăţile primitive, iată că e prezent ca armă de război şi în societăţile moderne şi aşa-zis civilizate. Este un subiect actual, este un subiect de mare impact, mare impact social în special, care poate modifica matricea comportamentală şi reacţia unor naţiuni. Cu titlu de exemplu doar, în conflictul din Congo s-au înregistrat circa 16 violuri pe zi, ceea ce dovedeşte că fenomenul este departe de a fi eradicat şi combătut.
Pacea şi securitatea nu pot fi disociate, în opinia acestui raport şi ele nu pot fi gândite decât împreună. Dar nu pot fi gândite decât printr-o perspectivă de egalitate de şanse, de abordare de gen, construite împreună de femei şi bărbaţi în cadrul unui parteneriat care să privească şi prevenirea conflictului, să privească şi modul în care se desfăşoară conflictul, dar mai ales să privească ceea ce se cheamă menţinerea păcii şi rezolvarea situaţiilor post-conflict. Uniunea Europeană a încercat să facă paşi esenţiali pentru prevenirea şi combaterea acestui fenomen. Din păcate, planurile naţionale, aşa cum sunt solicitate, nu sunt prezente decât în 10 ţări membre, 5 state membre sunt pe cale de a elabora aceste planuri, ceea ce dovedeşte că suntem încă într-un pas pe loc, într-un regres cu privire la obiectivele pe care ni le-am fixat. Cred că înfiinţarea Serviciului de Acţiune Externă dă oportunitatea Uniunii Europene de a fi mult mai prezentă în soluţionarea acestui tip de problematică. Raportul cere ca delegaţiile care negociază pacea, delegaţiile care sunt implicate în conflict, să fie construite pe o abordare de gen, femeile să fie parte a acestor delegaţii, pentru că perspectiva lor poate fi utilă în adjudecarea mult mai rapidă şi mai eficientă a ceea ce se cheamă pace şi linişte socială.
Un alt punct esenţial al raportului priveşte impunitatea. Aşa cum spuneam, dreptatea şi pacea nu pot fi disociate, însă, din păcate, în practică fenomenul impunităţii este prezent. Deşi putem avea acces la Curtea Penală Internaţională, cred că trebuie să găsim pârghii juridice mult mai eficiente, ca şi în situaţia unui post-conflict, investigaţiile şi tragerea la răspundere a autorilor acestor fapte reprobabile, fapte penale, să fie realizată, pentru că în alt fel de condiţii vom ajunge la o victimizare majoră a persoanelor care au suferit astfel de fapte, şi, dacă vreţi, la o victimizare majoră a societăţii. Cred că acest parteneriat dintre Uniunea Europeană şi Naţiunile Unite trebuie să se concretizeze în aplicarea Rezoluţiei 1960, şi nu numai. Cred că Uniunea Europeană are obligaţia să fie un partener ferm al Naţiunilor Unite pentru combaterea acestui fenomen. De aceea solicităm ca în cadrul SEAE-ului să se înfiinţeze postul de reprezentant al Uniunii Europene pentru femei şi securitate. Nu este o solicitare superfluă, ci dimpotrivă, este o solicitare care vizează un angajament ferm al Uniunii Europene pentru combaterea acestui fenomen.
Credem, însă, că trebuie aplicate o serie de reguli şi pentru cei care sunt implicaţi în procesul de război şi în procesul de pace. Credem că structurile militare ale statelor membre trebuie să ţină cont de o perspectivă de gen, nu una cantitativă, ci una în special calitativă, pentru că sunt din fericire în Uniunea Europeană femei care pot face faţă celor mai înalte posturi din forţele militare şi civile, şi pentru acest lucru statele membre trebuie să analizeze o perspectivă de gen în structurile lor militare, ceea ce este o chestiune nouă.
Vă mulţumesc, aşa cum am spus, nu am reuşit să epuizez subiectele, dar un singur lucru vă rog să-mi daţi voie: trebuie să le mulţumesc tuturor raportorilor din umbră şi tuturor grupurilor politice pentru că am lucrat la acest raport împreună.
„Catch the eye“-Verfahren
Barbara Matera (PPE). - Signor Presidente, mi congratulo per la sua elezione a vicepresidente e mi congratulo con la collega Nicolai per questa ottima relazione.
Risulta fondamentale garantire la sicurezza delle donne che decidono di intraprendere il coraggioso percorso professionale in situazioni di guerra. In numerose aree di guerra del mondo sono frequenti violenze sessuali in forma di stupri di massa e altre forme di abuso come la tratta degli esseri umani, come tattica di guerra e di cui le donne sono le prime vittime. Questi atti inaccettabili hanno gravi ripercussioni psicologiche e fisiche, soprattutto nei confronti delle donne e dei loro familiari. Occorre maggiore severità nel condannare i responsabili degli atti criminosi. L'impunità non può essere negoziabile e non può esserci pace senza giustizia. Risulta importante incrementare la partecipazione delle donne nei ruoli decisionali dei processi di pace e nella definizione delle misure di sicurezza.
Monika Flašíková Beňová (S&D). - Za ostatné desaťročie sa dosiahol len obmedzený pokrok v oblasti účasti žien vo verejnej správe. V niektorých prípadoch sa prijali kvóty a počet žien v zastupujúcich inštitúciách sa zvýšil. No aj napriek vyvinutému úsiliu predstavuje účasť žien na mierových rokovaniach, okrem niekoľkých výnimiek, stále menej ako 10 %. Ženy v armáde pritom zohrávajú dôležitú úlohu ako vzory, ako sprostredkovateľky medzikultúrnej výmeny a sú tiež povzbudzujúcou motiváciou pre miestne ženy, búrajú stereotypy miestnych mužov a takisto lepšie komunikujú s miestnymi ženami.
Vo väčšine krajín sa, žiaľ, činnostiam súvisiacim s rodovou rovnosťou a právami žien neprikladá veľká dôležitosť, pretože rodová problematika sa vníma len ako vedľajšia otázka a kultúrne, náboženské a sociálno-ekonomické zvyklosti sa mnohokrát berú ako ospravedlnenie za brzdenie pokroku v tejto oblasti. Na rodové hľadisko je preto potrebné klásť dôraz už v začiatkoch plánovania civilných a bezpečnostných misií. Práve účasť žien vo fáze budovania mieru je mimoriadne dôležitá.
Raül Romeva i Rueda (Verts/ALE). - Mr President, I think this is a crucial issue, not only because the role of women in war is important as victims and as targeted objectives in that situation, but also because of the role that women can play in peace-building.
Rebuilding societies and changing some of the patterns that have brought some societies to war: this to me is one of the crucial issues that we have to underline – not only in the resolution, but also as the United Nations is doing in their Resolutions 1325 and 1820. That is also why it is so important that the European Union has a specific special representative for this issue. As has been said – and I fully support this – there is a huge opportunity for the European Union to put that issue at the forefront of the external dimension of these activities. This is, as has been said, not a minor issue, and it is a huge opportunity that we should not miss.
Andrea Češková (ECR). - Pane předsedající, otřesné zločiny páchané na ženách a dívkách pod rouškou válečných konfliktů jsou jasnou známkou toho, že jejich práva nejsou i přes veškeré dosavadní snahy dostatečně chráněna. Sexuální násilí ve formě masového znásilňování, obchod s lidmi a jiné formy sexuálního zneužívání stále patří k válečným taktikám v konfliktních regionech po celém světě. Takovéto útoky na lidskou důstojnost nemůžeme tolerovat.
Jednoznačně proto souhlasím s návrhy zpravodajky týkajícími se zavedení kodexu chování pro osoby sloužící ve vojenských a civilních misích, který jasně stanoví, že sexuální zneužívání představuje neospraveditelné a kriminální chování. Zavede přísné postihy, nulovou toleranci sexuálního zneužívání dětí, dívek a žen v ozbrojených konfliktech i v uprchlických táborech. Podporuji návrhy týkající se posílení účasti žen na vedoucích pozicích politického dialogu. Zastoupení žen v mezinárodních týmech a v civilních a bezpečnostních misích by se mělo stát základní podmínkou pro poskytnutí podpory v rámci mírového procesu.
Mariya Nedelcheva (PPE). - Monsieur le Président, pendant les deux premières guerres mondiales, les femmes perdaient leur mari et leurs fils au front. Aujourd'hui, les femmes sont des victimes directes des conflits. Déplacées, prisonnières, violées, les femmes sont particulièrement vulnérables dans ces situations.
Je suis heureuse que notre Parlement se prononce enfin pour que les violences sexuelles en temps de guerre soient considérées comme des crimes de guerre. Pour cela, il faut saluer le travail remarquable de notre rapporteure, Mme Nicolai.
Les conséquences sur les victimes sont de deux ordres: des conséquences physiques et des conséquences psychologiques. Mais ces violences ont aussi un impact beaucoup plus large: un impact sur les hommes, qui n'ont ni su ni pu protéger leurs femmes, un impact sur les enfants, un impact sur la communauté. Les effets de la guerre sont donc étendus dans le temps et à travers les générations.
Je salue toutes les solutions présentes aujourd'hui dans ce rapport. Les femmes ont un rôle à jouer dans la résolution des conflits, dans les dialogues politiques pour la paix. Elles ont un rôle à jouer dans les missions civiles, mais aussi militaires de résolution de conflits.
Enfin, je crois que notre Union gagnerait à avoir un représentant spécial pour la femme, la sécurité et la paix. Ma question, Madame la Commissaire, est la suivante: peut-on envisager la création d'un tel poste? Si oui, pour quand?
Petru Constantin Luhan (PPE). - Şi Comisia de securitate şi apărare este foarte preocupată de acest subiect. Sunt de acord cu raportorul, respectiv criminalii de război ce comit infracţiuni împotriva femeilor trebuie aduşi mai rapid în faţa instanţelor de judecată, impunitatea nefiind negociabilă în aceste cazuri. Din păcate, în situaţiile de conflict din lumea actuală, violenţa împotriva femeilor este folosită ca tactică de război, şi din nefericire, aceste cazuri rămân de cele mai multe ori neraportate şi nepedepsite. Tocmai de aceea, cred că Serviciul European de Acţiune Externă trebuie să desemneze un observator special pentru protecţia femeilor în zonele de conflict, care să asigure protecţia femeilor faţă de toate formele de violenţă sexuală sau violenţă bazată pe gen.
Michèle Striffler (PPE). - Monsieur le Président, chers collègues, les violences sexuelles et les viols de masse utilisés comme armes de guerre sont, malheureusement, en augmentation à travers le monde.
Notre Parlement s'est alarmé, à plusieurs reprises, de la situation qui s'aggrave, notamment dans l'Est de la République du Congo, et de l'impunité généralisée.
Je me suis, en particulier, rendue au Sud-Kivu il y a quelque temps. Je peux témoigner de la gravité de la situation et des conséquences physiques et psychologiques dévastatrices sur les femmes et les petites filles suite à de tels actes. Ne nous trompons pas de combat. Face à de telles atrocités, la santé reproductive et sexuelle doit être abordée sans tabou.
Il est impératif que l'Union accorde dans ses actions une place centrale à la santé reproductive et sexuelle et à la protection des droits des femmes dans le domaine de la sexualité en temps de guerre. Nous le savons, un viol est un crime. Pendant la guerre, c'est un crime de guerre. Donc, une femme – il faut toujours le rappeler – n'est pas un instrument de guerre.

Kristalina Georgieva, Member of the Commission. − Mr President, let me start by thanking the rapporteur, Ms Nicolai, most sincerely. Thank you, too, for the scheduling of this item immediately after we talked about a similar issue here in Europe.
In the European Union we take very seriously the issue of the role of women, and in particular the role of women in peace and security through implementation of United Nations Security Council Resolution 1325 and other related resolutions. Our approach is a comprehensive one: we bring this concern to all our external instruments and all related policies and programmes.
In 2008 the EU adopted a comprehensive approach on the implementation of two resolutions – 1325 and 1820 – covering the whole range of policy tools available to it during and after conflict. The approach is based on the ‘three Ps’ of Resolution 1325: women’s participation, protection and the prevention of violence against women.
Let me say a word here about funding. We have the EU Instrument for Stability, which is a key instrument that we can apply for stabilising measures and capacity-building measures. In this instrument we have fully mainstreamed the gender perspective; and protection of the most vulnerable – the most vulnerable in humanitarian catastrophes being children, women, the handicapped and the elderly – is often a key objective of what I do as Commissioner for humanitarian aid.
We support the protection of women, especially in conflict zones, through our humanitarian aid instrument, but we also support the empowerment of women through cash-for-work programmes that specifically target women in conflict zones. I will be in the Democratic Republic of the Congo in three weeks’ time and my main objective will indeed be this issue: the issue that is the topic of this report, the protection of women, and specifically stopping the rape of women as an instrument of war. Overall, the EU is active in more than 70 countries, and the EU institutions and Member States have reported allocating a total of approximately EUR 200 million in 2009 and early 2010.
Let me now turn to the EU common security and defence policy (CSDP). Most CSDP missions and operations include a human rights and gender exercise. We now have a package of three fully fledged training modules on human rights, gender and child protection in the context of CSDP, which are being finalised in 2012. We also work very closely with the EU military staff in order to have a good common understanding of all the humanitarian aspects in conflicts, but in particular of how conflicts affect the most vulnerable – among them, women.
While we do a lot on the external side, it is also important to perform well internally by appointing women negotiators or mediators. By appointing more women in key positions in the European External Action Service, our Member States are the most proactive in the UN context. Thirteen of the EU Member States have adopted national action plans. Others, like Germany, have come up with special initiatives on women, peace and security. The first EU report on the indicators that measured the implementation of UN Security Council Resolution 1325 was finalised in May 2011. It shows that the EU has taken concrete steps to enhance protection of most vulnerable groups, including women.
We can be proud of our efforts but we still need to be vigilant and go on working in all forums and in all countries to tackle sexual violence in conflicts and to ensure women’s meaningful participation in peace processes and public representation.
To respond to the question on whether the EU is considering appointing a special representative, Vice-President/High Representative Ashton announced in December that she is looking into the creation of the post of EU special representative for human rights, and is considering the definition of this function.

Anneli Jäätteenmäki (ALDE), kirjallinen. – Kannatan lämpimästi ajatusta perustaa EU:n ulkosuhdehallintoon naisten, rauhan ja turvallisuuden erityisedustajan virka, kuten tänään äänestetty mietintö "naisten tilanteesta sodissa" suosittaa. Tämä auttaisi ulkosuhdehallintoa valtavirtaistamaan tasa-arvonäkökulma osaksi ulkopolitiikkaa, erityisesti kun kysymykseen tulevat sodat ja konfliktit. Tällä hetkellä alle 10 prosenttia rauhanneuvottelijoista on naisia, vaikka rauha on kaikkien – miesten ja naisten – asia.
Sodat ja konfliktit koskettavat naisia monella tavalla. Yksi raaimmista tavoista on seksuaalinen väkivalta sodankäynnin muotona. Iosif Matula (PPE), in writing. – In order to encourage their participation in situations of war, women must be visible contributors to the prevention, mediation and resolution of conflicts. Beyond engaging in behind-the-scenes roles, assuming leadership roles is key to building upon the foundation of gender equality. As women account for half of the EU population, it is logical that their participation in these three phases mirrors this statistic. Aside from this simple democratic principle, what is perhaps the strongest argument for women’s participation is the unique perspective they bring to the table and the message their empowerment sends to the world. Women need to be better represented in the military, for example, not just to fill a proportional requirement but also because they interact and communicate more effectively with local women. On the other spectrum, local women’s empowerment must be strengthened. Education is a crucial means through which local women can gain integrity and be better equipped to engineer preventive measures against war and violence in their communities. In addition to the active participation of a proportional representation of women at the negotiation table, women’s knowledge is also critical in the peace-building process as women are more aware of the challenges faced by their communities.
