  Christofer Fjellner, rapporteur. − Madam President, I will speak English. Normally I speak Swedish in plenary, but I did all the rest of the work in English and when I tried to prepare the Swedish, I realised that some of the words would be easier – this once – in English, because I had used them during the whole process.

After an extensive process in committee, the report on discharge for the Commission for the financial year 2010 has now arrived in plenary. First of all, I would like to express my gratitude to both the European Court of Auditors and the European Commission for their very fruitful and professional cooperation during this process. I would also like to take this opportunity to thank the opinion-giving committees for their input. Discharge is one of the main prerogatives of the European Parliament, and it is important that we all try to take part in it in one way or another.

Let me turn to the most important question of any discharge procedure: whether or not to grant discharge. As you can see in the report adopted in the committee, which followed my recommendation to grant discharge to the Commission for the financial year 2010, this was not an easy decision. We know that this is the 17th year that the Commission has not received a clean bill from the Court, and we can even see some small increases in error rates in certain areas.

The reason we came to conclusion we did is that we got adequate responses from the Commission to the four priority actions that the Commission needs to address in the upcoming months. Specifically, the following four points for action will be addressed by the Commission and I hope it will confirm this today: firstly, financial engineering instruments; secondly, the Commission’s accountability instruments; thirdly, pre-financing; and, fourthly, the Commission’s supervisory role in the cohesion area.

We want action in all of these areas in exchange for discharge. The financial engineering instruments kept us busy for most of the time. The Court of Auditors found severe weaknesses in the implementation of these instruments, especially in the area of cohesion. As you all are aware, the Commission proposed using those instruments even more often in the future, which is why we invested a lot of effort in thinking about how we could correct the weaknesses detected.

The Commission is now being asked, in particular, to objectively and critically evaluate the use of those instruments and report back, and to assess the specific risks attached to the use of these instruments. Some people make it sound like these instruments are some kind of alchemy that create gold out of nothing, but we see risk and we see costs, and we want them to be evaluated so that we know exactly what consequences they will have.

The second point I mentioned concerns how the Commission assumes its financial responsibility for implementing the EU budget. At the centre of that question is the annual activity report and the synthesis report. We need these to be improved and we need them to actually show more than they hide. As a result of our deliberations, the committee required that the Commission deliver a political declaration in which it accepts its final and overall responsibility for the implementation of the budget, including the part which is implemented under shared management.


We also need the Commission to strengthen its annual activity report and for the signature of the Commissioner responsible to be added next to that of the Director-General, to show that the Commission assumes responsibility. We also want the Commission to analyse whether the Commission’s own corporate governance arrangements could be further improved, for example by taking on some of the obligations it lays down on others in its Green Paper on EU corporate governance.

  Martin Ehrenhauser, Berichterstatter. − Frau Präsidentin! Das Wichtigste vorweg: Wir schlagen in unserem Bericht vor, der Kommission die Entlastung für die Ausführung des 8., 9. und 10. EDF für das Jahr 2010 zu erteilen und auch den Rechnungsabschluss zu billigen. Ich glaube, dass die Kommission in vielen Bereichen Fortschritte erzielt hat. Ich glaube, dass auch sehr viele Forderungen des Rechnungshofs und des Europäischen Parlaments bereits umgesetzt wurden. Trotzdem möchte ich einige Punkte ansprechen, die doch einiger Kritik bedürfen.

Da ist zum Beispiel die Frage der Integrierung des EDF in den EU-Haushalt. Wir haben im Zuge der Diskussion um den mehrjährigen Finanzrahmen eine sehr große Chance vergeben, den EDF zu integrieren. Das neue Ziel mit 2020 kann man verstehen. Das ist auch gut, das muss dringend angepeilt werden. Spätestens dann, wenn das Cotonou-Abkommen abläuft, sollten wir den EDF in den Haushalt integrieren.

Ein anderer Evergreen sind die Fehlerquoten. Die wahrscheinliche Fehlerquote von 3,4 % ist deutlich zu hoch, liegt auch deutlich über der Wesentlichkeitsschwelle von 2 % und muss gesenkt werden. Eine stabile Fehlerquote ist meines Erachtens kein Erfolg. Es gibt einige Maßnamen von Seiten der Kommission. Doch wenn die Fehlerquote immer nur stabil bleibt, muss man irgendwann einmal feststellen, dass diese Maßnahmen nicht gegriffen haben, und man muss sich um neue Maßnahmen kümmern.

Die Kommission sagt, dass die Restfehlerquote deutlich unter der Wesentlichkeitsschwelle von 2 % liegt. Hier gibt die Kommission aber keine eindeutigen Indikatoren an, mit denen sie eben genau diese Berechnung belegt. Hier arbeitet die Kommission bereits an einem Schlüsselindikator. Das sollte möglichst bis 2013 abgeschlossen werden.

Was die Kontroll- und Überwachungssysteme betrifft, so sind diese nur teilweise effizient. Hier muss man vor allem den Bereich der Delegationen ansprechen. Es wird ein elektronisches Monitoringsystem eingeführt, und darauf werden wir sicherlich einen wesentlichen Blick werfen. Ich werde dem Haushaltskontrollausschuss vorschlagen, dass wir einen Initiativbericht einbringen, um uns genau anzuschauen, wie dieses Monitoringsystem funktioniert, ob es auch wirklich effizient und auch zielführend ist.

Zur Budgethilfe: Das ist auch seit 20 Jahren ein Evergreen und immer ein Highlight und Teil der Debatte. Ich glaube, dass auch hier die Kontrollmöglichkeiten nicht wirklich greifen. Hier sollte man dringend über eine Reform nachdenken. Ich weiß, dass von Seiten der Kommission die Meinung vertreten wird, dass es hier sehr viele Missverständnisse gibt mit dem Haushaltskontrollausschuss, mit einigen Mitgliedern, was die tatsächlichen Begebenheiten angeht. Der Vorschlag, den die Kommission damals eingebracht hat, dass man nochmals ein Hearing veranstalten sollte, um genau diese Missverständnisse auszuräumen, ist sehr gut. Das wäre ein guter Weg, um hier einen Schritt weiterzukommen.

Besonderes Augenmerk haben wir in unserem Entlastungsbericht auf die Investitionsfasilität gelegt und auch auf die EIB. Es gibt schon einige Dinge, die man bemerken muss, auch, dass die investment facility nicht Teil der Zuverlässigkeitserklärung des Rechnungshofs ist und nicht berücksichtigt wird. Auch zu erwähnen ist die mangelnde Transparenz bei den Endempfängern – dass diese hier nicht eindeutig zugänglich sind, sollte man schleunigst bereinigen!

Dann ist auch die Frage der Effizienz anzusprechen, wie die Gelder eingesetzt werden. Es ist so, dass rund 14 % der investment facility über europäische Einrichtungen und Joint Ventures verwaltet werden. Das ist meines Erachtens eine sehr ineffiziente Struktur. Der Geldfluss ist viel zu lang, es gibt zu viele Institutionen dazwischen, die Geld damit verdienen, die Zinsen damit verdienen. Hier sollte man bemüht sein, dass Entwicklungshilfe nicht zum Selbstzweck verkommt. Aus diesem Grund schlage ich einen Sonderbericht des Rechnungshofs vor, in dem die investment facility genauer geprüft wird. Dafür bitte ich um Ihre Unterstützung und um weitere Vorschläge im Bericht.

  Jens Geier, stellvertretender Berichterstatter. − Frau Präsidentin! Ich vertrete heute Morgen meine Kollegin Ines Ayala Sender, die in der Wahlbeobachtungsdelegation in Algerien weilt und uns deswegen hier nicht als Berichterstatterin für die Entlastung der anderen Institutionen zur Verfügung stehen kann.

Ich will die guten Nachrichten vorwegschicken: Wir beantragen die Entlastung der meisten anderen Institutionen. Wir haben uns mit der Entlastung des Wirtschafts- und Sozialausschusses etwas schwergetan, weil zwar hier verschiedene Forderungen des Europäischen Parlaments betreffend Fragen von Reisekostenabrechnungen und ähnliche Probleme, die immer wieder für Begeisterung in den Medien sorgen, erfüllt worden sind, wir aber mit einiger Sorge betrachten, dass sich innerhalb des WSA – ich formuliere es einmal vorsichtig – Auseinandersetzungen über bestimmte Personalentscheidungen ergeben haben, wo wir besorgt sind. Die Berichterstatterin hat diesbezüglich ihre Sorgen im Ausschuss zum Ausdruck gebracht und wir werden die Lage weiter beobachten, was uns jetzt allerdings am Ende nicht davon abhält, die Entlastung zu beantragen.

Es sieht ein bisschen anders aus mit dem Rat. Zunächst einmal will ich an dieser Stelle ausdrücklich meine Genugtuung und meine Zufriedenheit darüber zum Ausdruck bringen, dass die dänische Ratspräsidentschaft das erste Mal, solange ich diesem Parlament angehöre, uns das Vergnügen macht, dieser Debatte zu folgen. Das ist ein ermutigendes Zeichen, dass wir hier aus der Phase der gegenseitigen Nichtwahrnehmung in der Debatte herauskommen, und ich will auf diesen Punkt am Ende meiner Ausführungen noch einmal zurückkommen.

Wir erleben hier dieselbe Situation, die wir alle aus dem Film „Und täglich grüßt das Murmeltier" kennen – nur jährlich. Das heißt, wir machen uns daran, den Rat für seine Haushaltsführung zu entlasten, zumindest für den Teil, wo er EU-Mittel – also die Mittel des allgemeinen Haushalts – in Anspruch nimmt. Wir begutachten die Dokumente, wir stellen Fragen dazu. Aber diese Fragen werden vom Rat nicht beantwortet.

Wir haben stattdessen vom Rat das Angebot erhalten, über ein interinstitutionelles Abkommen zu verhandeln – was zu begrüßen ist, wenigstens aus meiner Sicht, weil ich die Situation – Herr Welle, nicht persönlich nehmen! –, dass die Generalsekretäre der beiden Institutionen miteinander verhandeln, und das ohne politisches Mandat, für eine schwierige Situation gehalten habe, weil sie das Ansinnen und die Wünsche und die Positionen des verantwortlichen Ausschusses eben meiner Meinung nach zu wenig berücksichtigt haben.

Wir haben also den Vorschlag eines interinstitutionellen Abkommens auf dem Tisch, und meine Fraktion vertritt hier in diesem Haus die Position, dass wir die Möglichkeiten dieses interinstitutionellen Abkommens erproben sollten. Damit sind wir in diesem Haus leider in der Minderheit, weil die meisten meiner Kolleginnen und Kollegen auf dem Standpunkt stehen, dass die Dokumente die Aufgaben ausreichend beschreiben.

Ich will an dieser Stelle noch einmal betonen, dass es nicht die Position der S&E-Fraktion ist, von dem Recht und der Verantwortung der Entlastungsbehörde abzurücken, aber dass es schon die Position der S&E ist, an der Stelle auszuprobieren, wie weit wir mit dem Rat kommen können, wenn es darum geht, dieses interinstitutionelle Abkommen auszuhandeln. Das Hauptproblem dabei heißt Reziprozität, weil der Rat darauf besteht, sozusagen in dem Maße, in dem wir Antworten vom Rat bekommen, auch unsere Rechnungsprüfung als Parlament zu prüfen.

Ein Satz noch, Frau Präsidentin: Die rote Linie für das Parlament besteht sicherlich darin, hier zu sagen, dass wir nicht akzeptieren können, dass Beamte der Mitgliedstaaten die Volksvertretung kontrollieren, die den Willen der europäischen Bürgerinnen und Bürger zum Ausdruck bringt. Alles darunter wäre mit uns verhandelbar, und vielleicht kommen wir heute an dieser Stelle ein Stückchen weiter.

  Monica Luisa Macovei, Raportoare. − Sunt raportor pentru agențiile descentralizate ale Uniunii Europene pentru anul 2010 şi pentru întreprinderile de parteneriat public-privat. Sunt supuse procedurii de descărcare de gestiune 24 de agenţii centralizate şi 7 întreprinderi de parteneriat public-privat. Pentru trei agenţii, propun amânarea descărcării de gestiune, în principal, din motive legate de conflicte de interese şi achiziţii publice.

Câteva cuvinte despre importanţa conflictelor de interese: conflictele între sarcinile publice şi interesele private ale celor aflaţi în funcţii publice au crescut prin căderea barierelor dintre sectoarele publice şi private, prin parteneriatele publice-private, prin schimbul de personal între cele două sectoare. Aceasta a creat zone gri şi potenţiale conflicte de interese pentru cei aflaţi în funcţii publice. Conflictul de interese apare atunci când o persoană în funcţie publică trebuie să ia decizii care îi pot afecta interesele private.

Dacă nu sunt identificate şi gestionate corect, conflictele de interese pot distorsiona alocarea resurselor publice, politica de resurse umane, pot duce la risipirea banilor publici şi la scăderea încrederii cetăţenilor în instituţiile europene publice. De aceea, conflictele de interese trebuie să fie analizate şi sancţionate în cursul procedurii de descărcare de gestiune. Este rolul nostru să ne uităm la conflicte de interese atunci când verificăm şi decidem cu privire la descărcarea de gestiune a tuturor instituțiilor europene.

Recomand amânarea descărcării de gestiune pentru Autoritatea Europeană pentru Siguranţa Alimentelor. Este o agenţie implicată în autorizarea alimentelor şi băuturilor pe care le consumăm zilnic. Sănătatea noastră depinde şi de deciziile acestei autorităţi. De aceea, conflictele de interese din această agenţie, în principal din consiliul director, din board, sunt îngrijorătoare. Sunt multe exemple care au fost şi făcute publice. O să dau doar unul foarte recent: Diana Banati, care pe 8 mai, acum două zile, s-a alăturat unui institut finanţat de industria alimentară şi, la cererea Autorităţii, şi-a dat demisia din funcţia de director şi membru al boardului. Sunt şi alte cazuri în consiliul director al Autorităţii pentru Siguranţa Alimentelor, de exemplu, cum ar fi cele din grupurile de experţi. În plus, costurile întâlnirilor membrilor boardului în 2010 au fost de peste 6 000 de euro pe persoană pe întâlnire, cel mai mare cost între toate agenţiile.

Agenţia pentru Medicamente este a doua pentru care propun amânarea descărcării de gestiune. Şi aici sunt probleme de conflicte de interese, iar această agenţie este extrem de importantă în procedura de aplicare, de aprobare, de autorizare a medicamentelor pe care le folosim, care intră pe piaţă. Agenţia a elaborat un plan pentru evitarea, pentru prevenirea conflictelor de interese, dar ceea ce propun Parlamentului este să vedem cum se aplică acest plan, pentru că aplicarea, implementarea este chestiunea-cheie. Dacă se va aplica corect, desigur că, în toamnă, decizia noastră poate fi alta.

O a treia agenţie este Agenţia pentru Mediu, unde am constatat probleme de achiziţii publice, de cheltuirea banilor publici. De exemplu, o faţadă verde care a durat numai cinci luni, a costat circa 300 000 de euro, a fost făcută fără licitaţie şi fără a face parte din planul de muncă şi de investiţii al agenţiei. De asemenea, există şi alte chestiuni de achiziţii publice şi conflicte de interese, chiar ale persoanei, ale directorului executiv al acestei agenţii.

Amânarea descărcării de gestiune nu este împotriva agenţiilor, ci, dimpotrivă, le sprijină să îşi rezolve, să rezolvăm împreună aceste probleme şi este un semnal puternic pentru statele membre şi Comisie, pentru propunerile pe care le fac în boardurile acestor agenţii.

  Bogusław Liberadzki, sprawozdawca. − Pani Przewodnicząca! Sprawozdaję absolutorium budżetowe Parlamentu Europejskiego za rok 2010. Jak zawsze jest taka pokusa, żeby oceniając Parlament Europejski za dany rok, sięgnąć do szerszego zakresu spraw niż dany rok budżetowy. Chciałbym wyraźnie podkreślić: koncentrujemy się na danym roku budżetowym 2010, mając na uwadze, iż to był rok pierwszy, w którym Parlament Europejski działał w ramach reżimu traktatu lizbońskiego. Był to także pierwszy rok, w którym mieliśmy zatrudnionych asystentów przy różnym statusie niż dotychczas. I także to był pierwszy rok, gdzie mieliśmy rok pełen obliczeniowy.

Otóż niech wolno mi będzie przyznać od razu, że w ciągu tego pierwszego roku nie mieliśmy znacznych kwot przesunięć budżetowych międzyokresowych, był tu postęp w stosunku do roku 2009. Tym niemniej wciąż Trybunał Obrachunkowy wskazał trzy obszary, w których potrzebny będzie ciąg dalszy rozwiązań i uzupełnień.

Pierwsze to jest kwestia systemu płatności za grupy składające wizyty w Parlamencie. Przy czym musimy zachować ostrożność: ten system musi działać. Dwa – usprawnienia w zakresie systemu kontroli zakupów. I trzeci – lepszej dokumentacji w zakresie gospodarki kadrowej w Parlamencie Europejskim.

Otóż my także jako posłowie wskazywaliśmy na potrzebne obszary oszczędności, zwłaszcza w warunkach obecnego kryzysu. Jako sprawozdawca wznoszę także szesnaście stosownych poprawek.

Chcielibyśmy wskazać jako miejsce oszczędności po pierwsze na zlikwidowanie tzw. nagrody dziennikarskiej. Taki wniosek został postawiony w roku 2009. Wnosimy o to, żeby ten wniosek w pełni zrealizować. Dwa – wskazujemy na przekroczenie kosztów w budowie centrum dla odwiedzających. Jednocześnie także wskazujemy na potrzebę bardziej szczegółowej informacji w zakresie planowanych inwestycji w budynki Parlamentu Europejskiego, aczkolwiek wyraźnie rok 2010 pokazuje: budowanie, posiadanie własnych budynków jest tańszym rozwiązaniem dla Parlamentu Europejskiego niż wynajmowanie budynków.

Bezpieczeństwo w Parlamencie. Jest to konkretny, kolejny pakiet propozycji i rozwiązań, którym poświęcamy uwagę w tymże sprawozdaniu. Odnotowujemy postęp, wzrost wydajności w zakresie tłumaczeń, zwłaszcza tłumaczeń pisemnych. Jest tutaj wyraźny postęp, aczkolwiek dużo można poprawić wewnątrz Parlamentu odnośnie terminowości składania zamówień.

Dwie sprawy, które wymagają wciąż poprawy, to jest nasza wewnętrzna agencja podróży, gdzie wnosimy o głębszą analizę w relacjach jakość i cena, którą płacimy za usługę. Odnotowujemy postęp w dziedzinie systemu informacyjnego i chcemy zwrócić uwagę, że tylko 5,6% całkowitego budżetu unijnego poświęconego na koszty administracyjne przypada na Parlament Europejski. Tym niemniej w ramach tych 5,6% możemy osiągnąć postęp. Rok 2010 pokazał – taki postęp był osiągnięty, wzrastała efektywność pracy naszej instytucji. Chciałbym podziękować wszystkim współpracownikom i również sekretarzowi generalnemu za efektywną współpracę oraz Trybunałowi Obrachunkowemu i naszemu wewnętrznemu audytorowi za efekty, które osiągnęliśmy razem.

  Nicolai Wammen, President-in-Office of the Council. − Madam President, I am very pleased to be able to participate today in this very important debate on the correct implementation of the EU budget. I would like to take this opportunity to thank Mr Geier and the rest of this House for its very warm reception of the Danish Presidency.

Let me start by stressing the particular importance which the Council attaches to the proper spending of EU appropriations. This applies especially in times of economic and financial crisis, when many Member States have to cut their national budgets and keep their expenditure under strict control, and when European citizens and taxpayers pay even closer attention to the correct use of public funds, not only at the national but also at the European level.

On 28 February my colleague Minister Vestager was in the European Parliament’s Committee on Budgetary Control to present the Council’s recommendation to give a discharge to the Commission in respect of the implementation of the budget for 2010. On that occasion she was able to participate in a very interesting and fruitful debate on the implementation of the EU budget, which concentrated in particular on its implementation under shared management by the Commission and Member States.

It again became evident that the European Parliament and the Council share the same concerns. We therefore both addressed the fact that a large share of payments from the EU budget is still materially affected by error, and we both follow the overall aim of attaining an unqualified audit opinion from the European Court of Auditors. In that context I would like to mention that Minister Vestager has informed her colleagues in Ecofin about the issues raised by the Committee on Budgetary Control during the debate.

I can only repeat what was said in February. The Council would like to see more progress in the financial management and control of EU funds. It encouraged the Commission to fully assume its responsibility in the implementation of the budget, to reinforce its supervision and control structures and to strengthen its cooperation with and its guidance to Member State authorities.

The Council recalls in this context the importance of recoveries and financial corrections which are an essential element in protecting the Union’s financial interest and in improving the management of EU funds. Payment should be interrupted and suspended whenever significant deficiencies are identified and until corrective action is fully implemented. Unduly paid amounts should be recovered without delay and full transparency in the implementation of corrective action must be ensured.

I can assure you that the Council Presidency will make all possible efforts to make progress on this issue and I have noted that many of the Council’s priorities are also those of the European Parliament; I therefore count on your cooperation and support. We can improve the situation if all actors – the European Parliament, Council, Commission and Member States – work constructively together towards the sound financial management and an efficient control of EU funds.

The ongoing negotiations and the revision of the Financial Regulation are a perfect opportunity to improve and simplify procedures, and to reasonably strengthen supervision and control without creating any excessive administrative burden.

Finally, I have to say a few words on the disagreement between the European Parliament and the Council on the discharge procedure between our institutions. The Council is of the opinion that it is important to find a durable solution to this recurring problem and that this solution should be based on three principles: accountability, transparency and reciprocity.

Therefore, the Council has made a proposal to the European Parliament on the discharge procedure, and the Council has asked the European Parliament to appoint a formal delegation to discuss this proposal and to solve the outstanding issues.

The Danish Presidency looks forward to the continuing informal dialogue between our institutions on this issue, which we hope can pave the way to solving our disagreements. I welcome therefore this debate today and I am looking forward to a very constructive cooperation with the Commission, the European Parliament, the Member States and the Council.

  Algirdas Šemeta, Member of the Commission. − Madam President, first of all let me start by thanking you for the constructive and fruitful work achieved over the last few months. The Commission has been in close contact with your rapporteur and your colleagues on the Committee on Budgetary Control to discuss all kinds of issues related to the sound financial management of the main EU programmes.

Six Members of the Commission and the Secretary-General of the Commission participated in very lively discharge hearings. This intense dialogue between the institutions demonstrates the importance, but also the complexity, of the matters which we have to deal with. The Commission appreciated very much this trustful and good cooperation and I am looking forward to continuing to work with you on the topics we have discussed.

The rapporteur mentioned four priority actions for the Commission and I would like to stress that the Commission is fully aware of your concerns and your expectations vis-à-vis the Commission, but also vis-à-vis other financial actors.

I would like to highlight the implementation of financial engineering instruments as one example where the Commission has proactively taken into account the outcome of the discussions we had. Following the Commission’s proposal, Member States have to provide more focused and detailed reports on the implementation of these instruments. As a consequence, by the end of the year, we should have all necessary information to hand to provide you with an analysis per Member State and a comprehensive evaluation of the use of financial engineering instruments. But more has been done. In anticipation of the need for closer monitoring, the Commission proposal for the next programming period already envisages enhanced monitoring and control mechanisms for those financial instruments.

Apart from the priority actions highlighted by the rapporteur, the discharge report includes many more requests to the Commission. They are all being analysed and will be followed up. A comprehensive report on the follow-up to the discharge requests and on the concrete actions taken will be issued later this year, together with the evaluation report required under Article 318 of the Treaty.

I consider the effective implementation of these recommendations to be of the utmost importance in addressing the weaknesses identified in the implementation of the EU budget. We have discussed the role of Member States in the implementation of the EU budget many times already. Member States have a crucial role when it comes to the operational implementation of EU programmes and projects. The authorities of the Member States are paying out, and controlling on the spot, some 80% of the EU budget to final beneficiaries.

There is no doubt that the Commission will continue to assume its final responsibility for the correct implementation of the EU budget, in accordance with the Treaty. But to reduce the error rate under shared management, we do need the Member States’ cooperation and commitment to assuming their responsibility as the first-level financial actors in direct contact with the final beneficiaries.

As the last Annual Report from the Court of Auditors has revealed, Member States’ authorities did not detect and correct many errors, even though they had the necessary information available. Further work on effective – but also proportionate – supervisory and monitoring mechanisms in the current period and for the future is therefore necessary.

The Commission appreciates your support in further developing these mechanisms and improving the implementation procedures at Member State level. The provision of reliable and complete financial information and audit data by the Member States is one example of an area where improvements are necessary. We can see some progress in this regard, but this is not yet satisfactory.

This is why the Commission will, from now on, transmit the annual summaries of the Member States with an analysis of their content to the Committee on Budgetary Control, in accordance with Article 319 of the Treaty. Where appropriate, the Commission will make recommendations to the national authorities on how to further improve this reporting instrument so they can contribute better to the Commission’s assurance process. The discharge authority will be informed about these recommendations.

However, their publication remains subject to the conditions set in the legislation on public access to the EU institutions’ documents.

In this context, I would like to recall the importance of introducing a management declaration of assurance, which the Commission has proposed in the revision of the Financial Regulation. This would be an important building block towards an improved assurance chain between the management and control bodies in the Member States and the Commission services. Here as well, in the negotiations on the Financial Regulation, the Commission is on the side of Parliament to ensure the highest level of transparency and accountability from the Member States. We have, moreover, proposed introducing political accountability through the possibility of submitting national declarations of assurance. Provided that Member States’ national declarations respect necessary conditions, the Commission will, as an incentive, take those declarations into account in the establishment of its own audit strategy.

As regards the European Development Fund, we welcome the Parliament’s recommendations. The area of external aid is by nature a risky and complex one. An error level of 3.4 % is limited but remains a source of concern for both this House and the Commission. We will take all necessary actions to further improve the EDF’s financial management, securing the effectiveness and sustainability of the EU’s support, which is badly needed by the ACP countries.

This discharge procedure provided valuable input for the negotiations on the next financial period. Several new measures included in our proposals for the next generation of EU spending programmes were inspired by the European Court of Auditors and the discharge authority.

The Commission will demonstrate its firm commitment to achieving all possible improvements. The discharge report on which you will vote is a clear road map for actions to be taken by the Commission and the other financial actors.

  Vítor Manuel da Silva Caldeira, President of the European Court of Auditors. − Madam President, I am honoured to be the first President of the European Court of Auditors to be invited to address Parliament at this stage in the discharge procedure.

The discharge procedure is essential for European Union public accountability. It helps provide citizens with assurance as to what European funds were spent on, whether they were used correctly, and what was achieved with them. The primary responsibility for answering these questions lies with those responsible for managing European funds: the Commission and the relevant national authorities. They need to put in place systems capable of doing so.

The Court’s role is to provide independent assessments of the quality of their financial management and reporting systems. For the financial year 2010 the Court concluded that the European Union accounts prepared by the Commission do provide a reliable picture of what European Union funds were spent on. We noted, however, that the Commission does not yet provide a complete and reliable set of information on whether European Union funds have been correctly raised and spent.

On the basis of our own audit testing, the Court concluded that revenue and commitments underlying the European Union accounts were legal and regular in all material respects. In contrast to this, payments underlying these accounts were affected by material error with an estimated error rate of 3.7% overall. As in previous years, the area most prone to error was cohesion. We also concluded that systems were only partly effective overall and that there continued to be risks in the other areas of expenditure, which need to be managed and disclosed.

The Court recommended that due account should be taken of these risks when revising the legislative instrument for the next programming period. In particular, the Court stressed that reforms should focus on both reducing errors and improving the results we achieve with the funds of the European Union.

It is also important to ensure there is adequate provision for transparency. The Commission’s reporting on results achieved needs to be improved. In particular, we emphasised the need to set smart objectives and milestones for the new programming period. This is a point we also stressed in our recent opinions on the new legislative proposals governing the main areas of expenditure for the period 2014 to 2020.

In the discharge decision on the 2009 financial year, this Parliament invited the Court to present an opinion on the evaluation report required by the Lisbon Treaty. This report was delivered in February this year by the Commission and we will issue an opinion shortly. The Court believes that this first evaluation report represents an initial step in the right direction and provides Parliament, the Council and the Commission with an opportunity to discuss and agree how it can be made useful to the discharge authority as an instrument for European Union transparency and accountability.

The Court believes that an effective discharge procedure is essential for the European Union’s accountability and we are fully committed to working with Parliament and the other partners in this process to achieve that goal each year.

  Csaba Őry (PPE), A Foglalkoztatási és Szociális Bizottság véleményének előadója. 2012. február 13-án egy rendkívüli ülés keretében fogadtuk el az Európai Parlament Szociális Bizottságában a 2010-es pénzügyi évre szóló mentesítést. Abban a körben, ahol a mi kompetenciánk van, ez négy európai ügynökséget jelent, tehát az Eurofund-ot, a CEDEFOP-ot, a Munkahelyi Biztonsági és Egészségvédelmi Ügynökséget, illetve a Munkakörülmények Javítását Szolgáló Ügynökséget. Örömmel állapítottuk meg, hogy az éves beszámolók megfelelnek a december 31-i tényleges pénzügyi helyzetnek, és hogy a tárgyévben lefolytatott eljárások, a pénzforgalom összhangban vannak az ügynökség pénzügyi szabályaival. Egyébként megegyezett a véleményünk a Számvevőszék véleményével.

A pénzügyi beszámoló alapját képező műveletekről ugyanezt tudtuk megállapítani. Ugyanakkor fölhívtuk a figyelmet arra, hogy szorosabban együtt kéne működni a jövőbeni programok tervezésében, és üdvözöltük a Bizottságnak azt a szándékát, hogy szorosabban nyomon követi a tagállamok éves beszámolóit, például az Európai Szociális Alap tekintetében külön odafigyel ara, hogy milyen hozzáadott értéket képviselnek az európai források, illetve felhívtuk a figyelmet arra, hogy a Globalizációs Alap tekintetében utána kéne nézni annak, hogy még csak az 1/3-át hívták le annak az összegnek, amely rendelkezésre állt. Elég nagy vita kíséri ezt az alapot, de egészében véve azt kell mondanom, hogy elégedettek vagyunk, és ez az első olyan év, amikor komoly kifogást nem kell emelnünk az ügynökségek gazdálkodásával kapcsolatban.

  Jutta Haug, Verfasserin der Stellungnahme des mitberatenden Ausschusses für Umweltfragen, Volksgesundheit und Lebensmittelsicherheit. − Frau Präsidentin, liebe Kolleginnen und Kollegen! Der Umweltausschuss ist zuständig für die Haushaltslinien für Umwelt, öffentliche Gesundheit und Lebensmittelsicherheit, für 0,76 % des Unionshaushalts. Wir waren insgesamt sehr zufrieden mit den Ausführungsraten: Im Bereich Umwelt und Klima sind 99,26 % der Mittel gebunden worden, im Programm LIFE, unserem Flaggschiff und einzigen Finanzierungsinstrument für die Umwelt, sogar 99,4 %. Auch im Gesundheitsbereich lag die Rate über 99 %. Alle verfügbaren Informationen lassen uns zu der Empfehlung kommen, der Kommission Entlastung zu erteilen.

Liebe Kolleginnen und Kollegen, seit siebeneinhalb Jahren beschäftige ich mich mit Agenturen in unterschiedlichen Funktionen. Seit siebeneinhalb Jahren weiß ich, dass die dezentralen Agenturen in Europa inhaltlich die Arbeit leisten, die Aufgaben erfüllen, die ihnen vom Gesetzgeber, dem Parlament und dem Rat, in einem ordentlichen Gesetzgebungsverfahren übertragen worden sind. Seit siebeneinhalb Jahren sehe ich, dass die Agenturen unter besonderer Beobachtung der Öffentlichkeit stehen. Die Fachausschüsse kommen heute besser denn je ihrer Verantwortung nach, die politische Kontrolle über die Agenturen auszuüben. Wir wollen wissen, was das Personal in den Agenturen wie abarbeitet, was mit den Mitteln aus dem Gemeinschaftshaushalt geschieht. Weder werden im Haushaltsverfahren leichtfertig die Haushalte der Agenturen aufgestellt, noch im Entlastungsverfahren Persilscheine verteilt.

Allerdings habe ich in diesen siebeneinhalb Jahren noch nicht erlebt, wie mit Halbwahrheiten, Andeutungen und Missinformationen im Laufe des Entlastungsverfahrens eine Atmosphäre des Misstrauens und der Verdächtigungen gegenüber den Agenturen und den in ihnen arbeitenden Menschen geschaffen wurde. Das ist der normalen Arbeitsweise in diesem Haus nicht würdig. Diese fatale Melange soll aber Grundlage dafür sein, dass der Haushaltskontrollausschuss für drei Agenturen, die Arzneimittelagentur, die Umweltagentur und die Lebensmittelsicherheitsagentur, die Verschiebung der Entlastung beantragt hat. Kritik an den zu hohen Mittelübertragungen auf das nächste Jahr, an sehr hohen Kosten von Verwaltungsratsitzungen unterstütze ich selbstverständlich, doch ist sie kein ausreichender Grund, die Entlastung zu verschieben.

Ich kann uns allen mit der Erfahrung von siebeneinhalb Jahren Agenturenarbeit nur empfehlen, unsere Entlastungsentscheidung nicht auf diesem unseligen Gemisch von Halbwahrheiten, Missinformationen und Andeutungen fußen zu lassen. Wir können getrost mit den uns zur Verfügung stehenden Informationen allen Agenturen – ausnahmslos allen – die Entlastung erteilen.

  Tamás Deutsch (PPE), A Regionális Fejlesztési Bizottság véleményének előadója. – Mélyen tisztelt elnök asszony, kedves kollégák! Először engedjenek meg egy megjegyzést. Ma az Európai Parlament plenáris ülése 43, a zárszámadással kapcsolatos jelentést tárgyal, mintegy 170 percben, ami nem kevesebbet jelent, mint hogy jelentésenként valamivel kevesebb, mint 4 percet tudunk az európai adófizető polgárok pénzének a felhasználására fordítani. Ha kicsit a számok nyelvén másképpen fogalmazom meg, akkor olyan fantasztikus képessége van az Európai Parlamentnek, hogy percenként mintegy 1 milliárd eurónyi, az Európai Unió költségvetésében, különböző ügynökségek költségvetésében felhasznált forrás ellenőrzését tudja elvégezni Azt gondolom, hogy ha ilyen fantasztikus képességünk van, akkor ezt a testületet kéne valamifajta európai könyvvizsgáló cégnek kinevezni. Talán méltatlan ez a szűkre szabott idő ilyen terjedelmes kérdés megtárgyalására.

Ami a kohéziós politika kérdését illeti, a kohéziós politika területén a megelőző programozási időszakhoz képest csökkent a hibaarány. Ezt azért tartom fontosnak elmondani, mert a zárszámadásokat követően mintegy furkósbotként szokták mindig a kohéziós politikával szemben megfogalmazni a hibaarány kérdését. A kohéziós politika területén a hibaarány elsősorban a közbeszerzési szabályok, illetve a támogatási jogosultságok figyelmen kívül hagyásából fakad. Azt gondolom, hogy ez mindenféleképpen aláhúzza az egyszerűsítésnek a szükségességét.

  Guido Milana, relatore per parere della commissione per la pesca. − Signora Presidente, onorevoli colleghi, il lavoro nella commissione per la pesca è stato un lavoro molto approfondito, atteso che questa è materia di codecisione post-Lisbona.

In questo senso il tasso di esecuzione rilevato è del 97,20%, quindi un buon tasso di esecuzione così come contabilizzato. Nonostante ciò, però, all'interno dei capitoli un capitolo particolare, quello dei mercati della pesca, ossia 1102, ha avuto una scarsissima esecuzione sulla quale la Commissione ha dato alcune risposte in qualche modo soddisfacenti, ma che non fanno presagire un ricambio negli anni successivi.

Così come una delle questioni sottolineate è l'esecuzione negli accordi internazionali di pesca: in questi l'aspetto commerciale prevale troppo rispetto all'aspetto invece legato alla crescita del settore: il 72% è un accordo commerciale, quindi gli accordi di pesca hanno necessità di avere un'esecuzione probabilmente leggermente diversa che tenga più di conto gli obiettivi politici che questi accordi hanno.

Chiudo, Presidente, solo con un ulteriore piccolo rilievo, che è quello che esistono dossier contestati da quasi dieci anni e sui quali invece si tarda a chiudere. Questo è un richiamo formale rispetto all'intera esecuzione. Grazie del tempo soprattutto.

  Morten Løkkegaard, ordfører for udtalelse fra Kultur- og Uddannelsesudvalget. − Fru formand! Overordnet set er vi i Kulturudvalget godt tilfredse med gennemførelsen af budgettet for 2010, som det også fremgår af den udtalelse, som udvalget vedtog tidligere i år. Den tilfredshed fremgår af punkt 1-4 i vores udtalelse, som jeg ikke vil gå i detaljer med her. På et område kan vi dog ikke som udvalg eller parlament være tilfredse. Det er beskrevet i punkt 5 og handler kort fortalt om et meget lovende paneuropæisk tv-netværk, som Kommissionen valgte at nedlægge i ellevte time. Det skete uden accept fra Parlamentet og Rådet og ud fra devisen om, at vi lever i sparetider. Derfor kan man selvfølgelig undre sig over, at man i stedet for at spare de penge, vælger at bruge dem på tv-kanalen Euronews og en række pr-aktiviteter i Kommissionen.

Det kan vi selvfølgelig ikke være tilfredse med som parlament, og derfor har Kulturudvalget og i øvrigt også AFCO-udvalget valgt at tilbageholde pengene på Kommissionens budget, indtil de forpligter sig til at genetablere det omtalte netværk. Indtil det sker, kan jeg som budgetordfører i CULT-udvalget ikke anbefale at løfte den reserve, vi taler om, og jeg beder Budgetkontroludvalget om at gå ind i sagen, så vi kan få genetableret dette vigtige initiativ.

  Renate Sommer, Verfasserin der Stellungnahme des mitberatenden Ausschusses für bürgerliche Freiheiten, Justiz und Inneres. − Frau Präsidentin! Ich nehme Stellung zur Entlastung von Europol und Eurojust.

Zu Europol: Hier ist wenig, fast eigentlich gar nichts zu beanstanden. Der Jahresabschluss spiegelt in allen wesentlichen Aspekten die finanzielle Situation im Jahr 2010 wider und alle zugrunde liegenden Transaktionen sind vorschriftsmäßig und damit eben auch rechtmäßig. Auffällig sind lediglich die hohen Überträge im Verhältnis zu den insgesamt eigentlich niedrigen angelaufenen Kosten. Europol führt dies zurück auf den Umzug in eine neue Zentrale – das ist natürlich nachvollziehbar. Aber Europol sagt zu, in Zukunft weitere Maßnahmen zu treffen, um derart hohe Überträge zu vermeiden. Darüber hinaus will sich Europol dazu verpflichten, ab 2012 die Ausführung des Haushaltsplans monatlich zu kontrollieren. Ich empfehle uns, nachzuprüfen, ob das auch wirklich passiert. Vor diesem Hintergrund empfehle ich die Entlastung von Europol.

Zu Eurojust: Hier spiegelt auch der Jahresabschluss in allen wesentlichen Aspekten die finanzielle Situation im Jahr 2010 wider. Alle Transaktionen sind auch hier rechtmäßig und vorschriftsmäßig. Aber auch hier wurden hohe Betriebsausgaben ins Jahr 2011 übertragen. Nach Begründung von Eurojust lag dies hauptsächlich an einem Organisationsstrukturprojekt – einer neuen Computerinfrastruktur und Kosten im Zusammenhang mit der Datenverarbeitung. Es wird angekündigt, das alles in Zukunft zu verbessern, auch Ausschreibungsanforderungen besser einzuhalten. Ich empfehle uns, auch dies in Zukunft zu überprüfen und vor allen Dingen zu überprüfen, ob tatsächlich alle offenen Stellen in Zukunft besetzt werden. Das ist verbessert worden. Aber wenn diese Stellen nicht bald besetzt werden, dann müssten wir fast überlegen, Mittel zu streichen – und das wäre negativ für Eurojust. Ich empfehle dennoch die Entlastung.

  Véronique Mathieu, rapporteur pour avis de la commission des libertés civiles, de la justice et des affaires intérieures. − Madame la Présidente, tout d'abord, je voudrais saluer les efforts qui ont été faits par le CEPOL, qui s'est bien redressé depuis les affaires que nous avons connues. Je regrette cependant que les amendements que j'ai déposés en commission du contrôle budgétaire concernant la fusion du CEPOL et d'Europol n'aient pas été adoptés et je m'élève contre les amendements retenus lors du vote en commission et contre cette fusion.

La Commission européenne nous proposera une nouvelle base juridique, probablement à l'automne ou au début de l'année prochaine. Je pense que la commission LIBE est beaucoup plus compétente que la commission du contrôle budgétaire pour adopter cette nouvelle proposition de base juridique. Par ailleurs, je propose de donner la décharge aux trois agences (EMEA, EFSA et AEE). Pourquoi? Parce que nous n'avons pas suffisamment d'éléments pour justifier un report, voire un refus de la décharge à l'automne.

  Wim van de Camp (PPE), Rapporteur voor advies van de Commissie burgerlijke vrijheden en binnenlandse zaken. – Voorzitter, de verantwoording van publieke middelen heeft op dit moment grote belangstelling in de Europese Unie. Met name ook in deze tijd van bezuinigingen zullen wij op Europees niveau buitengewoon scherp verantwoording moeten afleggen van wat wij, in dit geval in het jaar 2010, allemaal hebben bereikt.

Ik ben ook lid van de Commissie LIBE en ik heb voor 2010 de diverse agentschappen en de prestaties van de commissie op dit vlak bekeken. Wat ons betreft, gaan we de goede kant op. Er zijn met name op het terrein van de agentschappen veel kritische opmerkingen te maken, maar ik durf wel te stellen dat het bij de Commissie LIBE - en dat mag ook wel - de goede kant op gaat.

Ik heb nog wel twee vragen aan de Commissie. Allereerst even de kwestie van SIS I en SIS II. Zijn daar op dit moment meer gegevens over bekend? Hoe ontwikkelen die uitgaven zich (te meer daar het systeem als zodanig achterblijft)?

Ten tweede, het Fonds Buitengrenzen. Ik heb de indruk dat daar op dit moment ook nog wel onderbesteding is. Het is opmerkelijk dat aan de ene kant de burgers zeggen dat de buitengrenzen beter bewaakt moeten worden, en dat er aan de andere kant onderbesteding is.

  Salvatore Iacolino (PPE), relatore per parere della commissione per le libertà civili, la giustizia e gli affari interni . – Signora Presidente, onorevoli colleghi, l'osservatorio europeo per le droghe e le tossicodipendenze riveste un ruolo importante rispetto ad una priorità che forse con maggior rigore e con maggiore incisività dovrebbe essere sostenuta dal Parlamento europeo: il contrasto alle droghe e alle tossicodipendenze, in un momento nel quale le dipendenze comunque non si esauriscono nelle droghe e nelle sostanze psicotrope, perché vi sono altre dipendenze che avrebbero dovuto e potrebbero essere meglio combattute attraverso una lista di interventi che l'Unione europea dovrebbe sostenere.

Tornando alla verifica, abbiamo riscontrato la regolarità della gestione finanziaria, riteniamo che nelle prospettive finanziarie 2014-2020 maggiori risorse debbano essere destinate a un contesto nel quale il sistema giovanile dell'adolescenza viene spesso fortemente aggredito, è importante la divulgazione nel web così come sono importanti Facebook ed Internet – ma anche questi possono talvolta sfociare in apposite dipendenze.

L'osservatorio potrebbe proporre dei miglioramenti per sostenere il multilinguismo e noi riteniamo che lo stesso possa ancora migliorare la sua attività, invero decisamente positiva, attraverso misure flessibili sul piano organizzativo. Un maggiore raccordo, che già invero sussiste, con altre agenzie e con gli Stati membri consente di affermare che le prospettive di crescita in questo delicato settore vi sono, con un principio ed un valore che è quello di una strategia complessiva sulle dipendenze complessivamente intese e quindi non soltanto sulle droghe.

  Silvia-Adriana Ţicău, Rap aviz TRAN. − În numele doamnei Ayala Sender, care este raportoare pentru aviz a TRAN şi care nu este astăzi aici, aş vrea să fac câteva precizări.

În ceea ce priveşte finanţarea TEN-T, salutăm revizuirea la jumătatea termenului a fondurilor TEN-T pentru perioada 2007-2013. Considerăm că a fost un exerciţiu interesant care a vizat utilizarea eficientă a resurselor. Procesul a fost orientat către rezultate şi am dori ca această abordare să se aplice şi altor politici ale Uniunii Europene. Din această perspectivă, salutăm noua propunere a Comisiei privind Cadrul financiar multianual.

În ceea ce priveşte siguranţa rutieră, regretăm slaba utilizare a fondurilor pentru siguranţa rutieră şi am dori, în următorii ani, să vedem această tendinţă inversată.

În ceea ce priveşte Galileo, salutăm progresul înregistrat în cadrul programelor EGNOS şi GALILEO. Lansarea primilor doi sateliţi în 2012 reprezintă un pas fundamental pentru implementarea cu succes a celor două programe.

Reamintim importanţa investiţiilor în acest sector, care va avea efecte benefice asupra multor sectoare şi politici ale Uniunii Europene, în special privind logistica, transportul sustenabil şi siguranţa în transporturi.

  Thijs Berman, Rapporteur voor advies van de Commissie ontwikkelingssamenwerking. − Voorzitter, de rol van het Parlement is, zoals voor elk parlement, wetgever zijn, de stem van de kiezer zijn en het beleid controleren. Die drie functies hebben wij. In die laatste functie, namelijk de controle van de macht, de controle op de uitvoering van het beleid, zijn wij veel slechter dan in die van wetgever of in die van stem van de kiezer zijn.

Dat geldt in het bijzonder bij onze controle op de uitgaven in het Europees Ontwikkelingsfonds. Het is een fonds buiten de EU-begroting, dus veel minder inzichtelijk voor ons dan het financieringsinstrument voor ontwikkelingssamenwerking. Het is geld dat buiten de EU wordt uitgegeven en daardoor is het nog onzichtbaarder voor ons. Toch zijn we wel bij machte er kwijting over te geven. Dat is erg knap van ons, maar ik denk dat we ons niet moeten overschatten. De nationale parlementen voeren de controle ook niet uit.

Het Europees Ontwikkelingsfonds moet daarom zo snel mogelijk binnen de EU-begroting worden gebracht. Dat zou onze controlemogelijkheden versterken. Het is zeer onbevredigend om zo te moeten werken. Maar als het dan binnen de EU-begroting wordt gebracht, mag dat geen excuus zijn om het geheel van het ontwikkelingsgeld te verminderen.

Minkejja dan, nista’ ngħid li l-amministrazzjoni globali ta’ dawn l-aġenziji li jiena dħalt fuqhom hija waħda sodisfaċenti u għandha tiġi aċċettata.   Iliana Ivanova, on behalf of the PPE Group. – Madam President, as shadow rapporteur for the Parliament’s discharge, I would like to thank our rapporteur, Mr Liberadzki, for the work he has done. In committee, I think, we reached a good compromise which identifies concrete areas for improvement. I urge all my colleagues not to accept any appeals to reject this resolution but, on the contrary, to support it. I will briefly address three points which I consider important in this report.

First: public procurement. We need clearer rules. We call on the Bureau to review all control mechanisms in order to guarantee the most competitive prices for the services and goods offered.

Second: security, which is still a major issue for many MEPs. In the report we have targeted concrete areas where improvements could be made.

Third: the internal auditors’ report. We hope this will be provided to members of the Committee on Budgetary Control on time, so that we can make a clear assessment of the situation.

Now let me quickly comment on some issues arising from the Commission discharge. First, I want to congratulate rapporteur Christofer Fjellner for his excellent work and energy during the whole procedure. There are a number of important aspects this year, of which the first is shared management. This year again, the Court of Auditors has not been able to issue a positive declaration of assurance on the Union budget. I call on the Commission to find the appropriate tools and to apply stricter and adequate sanctions in order to ensure that Member States assume their responsibilities. I note, however, the presence of the Council at today’s debate.

The second aspect concerns financial instruments. Their use is continually increasing and they are indeed useful, but we do not know to what extent. We need to assess them better, using appropriate indicators, and to establish a clear link between inputs and results.

The third aspect is that of instruments for financial assistance. The EU budget guarantees loans and the balance of payments in the European Financial Stability Mechanism for a maximum of EUR 110 billion. This is almost an annual budget, and we definitely need clearer accountability and greater transparency with regard to operations under these instruments.

Finally, I would like to welcome the important role that the Court of Auditors plays in the whole discharge process, and I am certain that our fruitful cooperation will continue on all aspects of budgetary control.

  Edit Herczog, a S&D képviselőcsoport nevében. – Az európai ügynökségek véleményét szeretném mondani az európai szocialisták szempontjából. Az ügynökségekről beszélünk, amelyek az európai intézményi felépítmény fontos részét alkotják. A kormányok a Parlamenttel egyetértésben hozták őket létre, hogy a számukra megszabott feladatok ellátásával az Európában élő emberek javát szolgálják. Ezeknek a létrehozásoknak tehát nem a véletlen az alapja. Minden egyes ügynökség politikai, szakpolitikai együttdöntési eljárás keretében jött létre, és működésük néha meglehetősen összetett. Ezért ezekkel a szervezetekkel nem szabad hatalmi, politikai játékokat folytatni, ahhoz túlságosan fontosak, és a megszüntetésük felvetése is komoly politikai következményekkel járhat.

Az ügynökségek fontos szerepet töltenek be, ezért elengedhetetlen, hogy működésük és irányításuk a lehető legtökéletesebb legyen, mert ilyenképpen lehet jó hírüket szavatolni az uniós polgárok szemében. Ugyanakkor az európai ügynökségek az Európai Unió költségvetésének nem egészen fél százalékából gazdálkodnak. A zárszámadás során ugyanolyan szoros ellenőrzésnek vannak alávetve, mint bármely uniós szerv. Az ellenőrzésüknek meggyőződésünk szerint arányosnak kell lennie a költségvetésben bírt súlyukkal. Az arányosnál szigorúbb ellenőrzés ugyanis önmagában pazarlást jelent, s jelenleg úgy érezzük, hogy a Számvevőszék és az Európai Parlament zárszámadásért felelős szervezetei a korlátozott emberi, anyagi erőforrásaival már aránytalan módon foglalkoznak az ügynökségekkel, és ennek mindenképpen gátat szeretnénk szabni. Nem lehet, hogy az erőforrásaink felét a költségvetés mintegy fél százalékát kitevő ügyekre pazaroljuk el.

Komoly aggályaink voltak az idei évben a jelentéstévő nagyon kritikus megközelítésével, mert abból indult ki, hogy bűnösséget vélelmezünk mindaddig, amíg az ellenkezője nem nyert bizonyítást. Ehelyett mi úgy gondoljuk, hogy mindaddig a jóhiszeműséget és a természetes igazságérzetet kell alapul venni, amíg ennek az ellenkezője be nem bizonyosodik. Én azt hiszem, hogy a mi megközelítésünket jól igazolták az eddig elmondott hozzászólalások, hiszen a szakbizottságok részéről készült vélemények lényegesen pozitívabbak voltak itt, a plenáris teremben is, mint a jelentéstévő véleménye, és azt gondolom, hogy a Parlament egésze sokkal inkább ebben tud egyetérteni.

Most pedig néhány, a jelentésben következetesen fölvetett pont: az esetleges összeférhetetlenségekről, különösen azoknak az ügynökségeknek az esetében, ahol szükség van az ipar vagy technikai szakértők bevonására, hogyan tudjuk a legmegfelelőbb eljárásokat és eszközöket alkalmazni ahhoz, hogy ezt megelőzzük. Javasoljuk tehát, ahogy az ombudsman is ajánlotta, hogy különös figyelmet fordítsunk ennek a kérdésnek. Határozottan támogattuk azt, hogy a Számvevőszék különjelentést készítsen erről a témáról, s határozottan támogatjuk azt is, hogy az intézményközi munkacsoport, amely a Tanács, a Bizottság és a Parlament működésében dolgozik, tartsa napirenden ezt a témát. De ez nem ok arra, hogy a 2010-es zárszámadást ne fogadjuk el. Szeretném tehát mondani, hogy a jelentéskészítő eljárása megfontolásra alkalmas. Érdemes máskor a kollégáival a saját pártjából és a többi párttal – a többi bizottságból együttműködve – olyan jelentést készíteni, amely jobban elfogadásra kerül a Parlamentben.

  Jan Mulder, namens de ALDE-Fractie. – Voorzitter, jammer genoeg luistert het Deense voorzitterschap niet, maar in de eerste plaats zou ik Denemarken hier in deze vergadering willen verwelkomen. Het is de eerste keer in vele jaren dat de Raad aanwezig is.

Het is de zeventiende keer op rij dat wij een negatief rapport hebben van de Europese Rekenkamer. Dat alleen al zou een reden moeten zijn voor het Parlement om geen kwijting te verlenen aan de Commissie. Ik denk dat er weinig nationale parlementen zijn die zo coulant zouden zijn tegenover hun regering als dat zou voorkomen. De tendens is ook niet in de goede richting.

Het Europees Parlement heeft door de jaren heen veel adviezen gegeven over hoe het zou kunnen worden verbeterd. De rol van de lidstaten daarin is essentieel. De commissaris zei het al: 80% van het geld wordt uitgegeven door de lidstaten. Daarom gaf het Europees Parlement in het Interinstitutioneel Akkoord van 2006 in artikel 44 duidelijk aan dat er jaarlijkse overzichten zouden moeten worden gegeven door de lidstaten en vervolgens zou de Commissie daarop commentaar moeten geven. Het Parlement zou dat kunnen analyseren en een dialoog beginnen met de Commissie over de verbeteringen.

Zes jaar lang heeft het Parlement geen kennis kunnen nemen van die jaarlijkse overzichten. Dat is buitengewoon merkwaardig. Als je een overeenkomst hebt tussen drie partijen, dan lijkt het mij logisch dat die overzichten ook beschikbaar zijn voor de drie partijen.

Ik verwelkom de verklaring van de Commissie, maar jammer genoeg deed de commissaris geen enkele verwijzing naar artikel 44 van het Interinstitutioneel Akkoord. Dat artikel is toch essentieel. Ik vind het buitengewoon jammer dat hij niet daarnaar verwijst. Hij heeft echter een beetje vooruitgang geboekt. Zijn verklaring zal invloed hebben op het stemgedrag van de ALDE-Fractie, dat waarschijnlijk anders zal zijn dan in de Commissiebegrotingscontrole zelf. Toen stemden ze tegen, maar de verrassing houd ik tot het einde.

  Bart Staes, namens de Verts/ALE-Fractie. – Voorzitter, ik beperk mij in dit debat tot vijf verslagen: de kwijting van de Raad en ITER enerzijds, het Geneesmiddelenbureau EMA, de Europese Autoriteit voor voedselveiligheid EFSA en het Milieuagentschap anderzijds.

Ten aanzien van de Raad doe ik nogmaals een oproep tot redelijkheid en een vraag tot toegeven aan de wensen van de kwijtingsautoriteit. We willen niets minder dan inzicht in de rekeningen. Transparantie van de uitgaven is gewoonweg noodzaak, want de uitgaven van de Raad zijn van een wezenlijk andere orde dan veertig jaar geleden.

Ten aanzien van ITER doe ik een oproep om mijn amendement goed te keuren dat erop gericht is het ITER-project te herevalueren en een duidelijk overzicht te krijgen over de toekomstige financieringsbehoeften.

Dan de agentschappen. Er is een wezenlijk onderscheid tussen het EMA en het EFSA enerzijds en het Milieuagentschap anderzijds. EMA en EFSA liggen al jaren onder vuur, bij het Milieuagentschap willen we eigenlijk even de puntjes op de i zetten. Wat betreft EMA en EFSA vraag ik aandacht voor de financiering van beide agentschappen. EMA wordt nu reeds voor 73% gefinancierd uit vergoedingen die door de farmaceutische industrie worden betaald. Bij EFSA, de Voedselveiligheidsautoriteit, is dat vooralsnog niet het geval, maar het staat wel op de agenda. En dat is gevaarlijk. Er is nood aan goede regels, zo niet ontstaat minstens de perceptie van mogelijke beïnvloeding van de resultaten bij de evaluatie van producten.

De Commissie begrotingscontrole vraagt aandacht voor de bestrijding van belangenconflicten en de draaideurpolitiek. Ten aanzien van het Geneesmiddelenbureau zitten we met de rol van de voormalig directeur, die nog tijdens zijn mandaat van directeur een consultancybedrijf heeft opgericht, daar nu werkt en nu advies verleent aan de farmaceutische industrie. Dat is een laakbare praktijk.

Ten aanzien van EFSA: ik bezocht de Voedselveiligheidsautoriteit vorige week nog in Parma met een delegatie van de Milieucommissie. Positief is de wil tot transparantie, de wil tot verandering. Het toont ook aan dat de actie van het Parlement en van individuele leden van dit Parlement, echt werkt. Het werk van de rapporteur, het werk van een collega als José Bové, is merkwaardig en is zeer nuttig. Zo erkende het EFSA veel te traag dat er iets problematisch was met het overstappen van een voormalig personeelslid naar een bedrijf als Syngenta. We vragen bijzondere aandacht voor de banden tussen leden van de raad van bestuur, wetenschappelijke deskundigen van EFSA met ILSI, een notoire lobbyorganisatie, die gefinancierd wordt door voedselgiganten als McDonalds, Coca-Cola, Nestlé, BASF, Danone, Kraft, Monzanto, Syngenta en Unilever. Dat is problematisch. Het is goed dat de voorzitter van de raad van bestuur eergisteren ontslag nam, omdat zij te nauwe banden had en heeft met ILSI. Sinds gisteren werkt zij trouwens actief voor deze organisatie.

Wetenschappelijk onderzoek van EFSA mag niet alleen steunen op onderzoek en data van de industrie. Ook onafhankelijke deskundigen en onafhankelijk onderzoek moeten aan bod komen. We moeten toezien op de banden tussen wetenschappelijk deskundigen en de biotechindustrie, de voedselbedrijven en lobbygroepen. Nu verlenen we geen kwijting, want we willen een concreet actieplan uitschrijven, zodat we in oktober ook EFSA kwijting kunnen verlenen.

Ten aanzien van de Rekenkamer vraag ik met spoed het rapport te publiceren over de mogelijke belangenconflicten bij de agentschappen EMA en EFSA.

Ten slotte het Milieuagentschap, heel kort. De nuttigheidswaarde van dat agentschap staat niet ter discussie. Wat wel ter discussie staat zijn een aantal praktijken uit het verleden: banden van de directeur met een ngo, mogelijke problemen inzake de openbare aanbestedingen. Ik roep op tot een nauwe samenwerking tussen het Parlement en het Milieuagentschap om deze zaken uit te klaren, zodat we in oktober kwijting kunnen verlenen. Ik dank u, Voorzitter, voor de enkele seconden die u mij meer gunde.

  Andrea Češková, za skupinu ECR. – Vážená paní předsedající, předně děkuji zpravodajům za jejich práci a racionální přístup. Evropský účetní dvůr zjistil stejně jako v předchozích letech v hospodaření jednotlivých orgánů a agentur celou řadu nedostatků.

Co se týče Komise, vidíme stále se opakující problém ve sdíleném řízení ve spolupráci s kontrolními orgány členských států. Vzhledem k tomu, že existují dvě oblasti s alarmujícím procentem chybovosti, je třeba urychleně přijmout režim, který by Komisi umožnil zhodnotit individuální potíže členských států a včas na ně reagovat.

Znepokojující je velké množství chyb v hospodaření jednotlivých agentur. Jsme proto rádi, že se zpravodajka rozhodla pro odložení udělení absolutoria u čtyř z nich. Měli bychom se zamyslet nad tím, jakým způsobem docílit snížení provozních nákladů, např. také sdílením služeb mezi agenturami podle blízkosti umístění nebo podle oblasti jejich politiky.

Co se týče Evropského parlamentu, podporujeme hledání úspor, např. lze snížit výdaje na udělování cen, což už tady zaznělo i od pana zpravodaje, nebo snížit výdaje na prezentaci Parlamentu, jako jsou výdaje na Parlamentárium nebo Dům evropských dějin.

Závěrem bych chtěla říci, že dokud rozpočet Evropské unie jako celek neobdrží od Účetního dvora pozitivní prohlášení o věrohodnosti, skupina Evropských konzervativců a reformistů se rozhodla nepodpořit udělení absolutoria, pokud jde o jakoukoliv část rozpočtu Evropské unie, a naopak se rozhodla podpořit odložení v těch případech, kdy je zpravodaji navrhováno.

  Marta Andreasen, on behalf of the EFD Group. – Madam President, the procedure whereby we in this House approve the use of the EU budget by the Commission and the other institutions is our greatest responsibility as representatives of the citizens of the Member States. Yet, year after year, while the Court of Auditors fails to give the EU spending a clean bill of health, this House is happy to approve the management’s performance.

The auditors’ report for the year 2010 reveals that the error rate – a fine name for the irregular use of funds – has grown from 3.3% to 3.7%. They add that 50% of the transactions sampled were affected by errors. How can we tell taxpayers that their money has been properly spent when we have this situation? Worse, how can we ask taxpayers to put even more into policy areas such as cohesion, energy and transport, where the error rate has increased to an astonishing 7.7%?

The increase in the number of agencies from three to 24 in a decade is a matter of concern. The Commission seems to have little control over them, which means that, in the discharge reports, one sees the same stories again and again: conflicts of interest and a revolving door to outside employers at least as efficient as the ones in this building.

Yet while this House is prepared to turn a blind eye to the deficiencies of those responsible for most of the budget, including itself, it puts great energy into refusing to approve the management of the Council’s budget. It is not that I want to defend the Council, but this is merely playing politics – and that, in essence, is what the discharge procedure has become, a political game. So, dear taxpayers, nobody actually cares how your money is spent. The solution? Stop sending money to Brussels!

  Søren Bo Søndergaard, for GUE/NGL-Gruppen. – Fru. formand! Den Europæiske Union omsætter for milliarder af euro. Det sker gennem Kommissionen, Rådet, Parlamentet og en lang række institutioner og agenturer. Disse mange milliarder er jo ikke faldet ned fra himmelen. De kommer fra hårdtarbejdende skatteborgere i de 27 medlemslande. Skatteborgere, som oven i købet i de seneste år har oplevet nedskæringer og forringelser. Derfor er det jo et helt centralt spørgsmål: Hvem fører på vegne af disse skatteborgere kontrol med, hvordan de mange penge anvendes?

Europa-Parlamentet er det eneste organ, der er valgt direkte af EU's borgere. Svaret er derfor Europa-Parlamentet, da de nationale parlamenter ikke kan kontrollere hele EU. Eller måske rettere sagt: Det gør Europa-Parlamentet, når det gælder de fleste institutioner i EU. Det gør Europa-Parlamentet dog ikke, når det gælder Rådet, simpelthen fordi Rådet nægter at svare på de spørgsmål, vi stiller om dets regnskab. Rådet har haft forskellige forklaringer på, hvorfor de føler sig hævet over parlamentarisk kontrol. Først henviste Rådet til en såkaldt gentleman agreement, men da vi så fandt den frem, viste det sig, at det var en ensidig erklæring fra Rådet. En erklæring, der i øvrigt var fra 1970, dvs. ni år før Parlamentet overhovedet blev direkte valgt.

Så henviser Rådet til, at Parlamentet i henhold til traktaten kun må godkende Kommissionens regnskab. Og når vi har godkendt det, så har vi også godkendt regnskaberne for alle de andre EU-institutioner. Jeg synes, det er et meget interessant synspunkt. For den eneste logiske konklusion er jo så, at vi fremover må stille vores spørgsmål til Rådets regnskab til Kommissionen. Hvis Kommissionen så ikke kan svare, så må det selvfølgelig få konsekvenser for vores godkendelse af Kommissionens regnskab. Det ville jo være absurd. Derfor håber jeg også, at Rådet vil komme til fornuft og svare på de spørgsmål, vi har stillet. Der er sjældent fuldstændig enighed i et parlament, men der var i Budgetkontroludvalgets indstilling til dette møde fuldstændig enstemmighed om at udskyde afgørelsen om Rådets regnskab til efteråret. Dermed har vi vist vores gode vilje, for det giver Rådet og det danske formandskab yderligere en mulighed for at gøre op med lukketheden og i stedet acceptere parlamentarisk budgetkontrol, som gælder for alle andre EU-institutioner. Bedre sent end aldrig!

  Lucas Hartong (NI). - Voorzitter, de Rekenkamer kwam onlangs met prima verslagen over de afsluiting 2010. Rapporteur Macovei gaf vervolgens prima commentaar op die verslagen van de Rekenkamer. Er bleek helaas heel wat mis te zijn, met name bij de agentschappen.

Vandaag stemmen we over een groot aantal amendementen op die verslagen. De socialisten zijn zoals gewoonlijk tegen meer transparantie, tegen meer controle op de uitgaven, tegen het tot de orde roepen van de agentschappen. Ook de Nederlandse partij D66 lijkt hierin mee te gaan. Die heeft namelijk een aantal amendementen ingediend om de transparantie teniet te doen en de uitstekende constateringen en aanbevelingen, met name die inzake de janboel bij de agentschappen, zo snel mogelijk te schrappen. Ongelooflijk!

Ronald Reagan zei ooit eens: "Sommigen willen de overheidsuitgaven checken, anderen willen de overheidscheques uitgeven". De PVV checkt liever dan dat ze steeds meer uitgeeft. Daarom een woord van dank aan de Rekenkamer en de rapporteur voor hun goede werk en een woord van minachting aan de socialisten en D66.

  Monika Hohlmeier (PPE). - Frau Präsidentin, meine sehr verehrten Damen und Herren, liebe Kolleginnen und Kollegen! Ich darf auf das Thema Entwicklungshilfe eingehen. Beim Thema Entwicklungshilfe beschäftigen wir uns seit vielen Jahren mit der Frage der Budgethilfen. Ich möchte ein ausdrückliches Dankeschön sowohl an den Rechnungshof für die vielfältigen Anregungen sehr sinnvoller Art zu diesem Thema aussprechen. Ich möchte aber auch ein Dankeschön an Herrn Kommissar Piebalgs aussprechen, der zunehmend versucht, das Thema Budgethilfen in einer sinnvollen Art und Weise zu regeln. Denn Budgethilfen sind dann angebracht, wenn einigermaßen gewährleistet ist, dass die Verwaltung vor Ort in der Lage ist, mit diesen Budgethilfen auch die Projekte durchzuführen, die man sich gemeinsam mit der Europäischen Union vorgenommen hat.

Zum Zweiten ist es notwendig, dass wir im Bereich der Entwicklungshilfe tatsächlich einmal zu einem geschlossenen Konzept kommen. Ich sage jedes Mal, bei jeder Entlastung, dass es endlich einmal notwendig wäre, die Entwicklungshilfeausgaben alle geschlossen gemeinsam in den Kommissionshaushalt einzuführen, und dies nicht nur deshalb nicht zu tun, weil wir die 1%-Grenze nicht überschreiten wollen. Die Gelder werden ja ausgegeben. Die Frage ist nur, ob sie koordiniert, geschlossen und gemeinschaftlich ausgegeben werden und letztendlich vom Europäischen Parlament nicht nur kontrolliert, sondern auch mitgestaltet werden können.

Desweiteren halte ich es für notwendig, dass wir auch im Rahmen der Entwicklungshilfe das Thema langfristige und kurzfristige Maßnahmen ins Visier nehmen. Wir brauchen langfristige Maßnahmen, die nachhaltig sind, und zwar langjährig sichtlich aufbauend Verbesserungen in den jeweiligen Ländern hervorrufen. Wir brauchen natürlich auch kurzfristige Maßnahmen, die bei entsprechenden Katastrophen – Erdbeben oder ähnlichen Dingen – kurzfristige Hilfen bieten. Man darf bei den langfristigen jedoch nicht zulassen, dass die jeweiligen Projekte unter Umständen – weil die Verhältnisse im Land nicht so besonders sind – etwas lockerer gesehen werden. Unsere Projekte müssen Sinn und Ziel machen, ansonsten ist das Geld umsonst ausgegeben!

  Jens Geier (S&D). - Frau Präsidentin! Die Kollegin Andreasen hat gerade den europäischen Steuerzahler aufgefordert, kein Geld mehr nach Brüssel zu überweisen, weil sich hier angeblich niemand für die Ausgabenpraxis interessiert. Das Gegenteil ist der Fall. Dieses Plenum interessiert sich massiv für die Ausgabenpraxis der EU-Institutionen und dafür, was mit dem Geld des europäischen Steuerzahlers passiert. Das Problem ist nur, dass wir an dieser Stelle zu anderen Bewertungen kommen als Frau Andreasen. Und die S&D-Fraktion kommt maßgeblich zu anderen Bewertungen, was die Situation der europäischen Agenturen angeht.

Ich will das an dieser Stelle einmal kurz durchdeklinieren für den Fall der Europäischen Arzneimittel-Agentur (EMA). Dank der Arbeit unseres Berichterstatters vom vergangenen Jahr, Georgios Stavrakakis, hat die EMA heute das strengste „Conflict of interest“-System in der ganzen Europäischen Union. Die Berichterstatterin der EPP kommt zu dem Ergebnis, dass das nicht reicht, und schlägt uns die Vertagung der Entlastung vor, mit der Begründung, dieses System müsse sich erst beweisen. Das ist exakt die Umkehr der Beweislast, so wie es die Kollegin Herczog vorhin in ihrem Beitrag dargestellt hat.

Wenn es darum geht, liebe Kollegin Macovei, dieses System jetzt auf seine Wirkungsweise zu erproben, dann ist das die Aufgabe des nächsten Berichterstatters, das ist der Kollege Gerbrandy von der Fraktion der Liberalen. Wenn wir dann sehen, dass das System nicht funktioniert, dann kommen wir zu Nachjustierungen. Aber in einer solchen Situation darauf zu bestehen, dass nicht entlastet wird, solange das System sich nicht bewährt hat, das stellt die Beweislast auf den Kopf.

An dieser Stelle kann ich auch Ihre Aussage nicht nachvollziehen, Frau Kollegin, dass Sie sagen, es geht hier nicht darum, die Agenturen zu beschädigen. Dieser Schaden ist doch schon längst eingetreten! Wir brauchen uns doch nur die Medienberichterstattung aufgrund Ihres Berichts anzusehen, wonach im Prinzip die Unabhängigkeit von Interessenvertretern oder Sachverständigen in den Agenturen gar nicht gegeben sei. Damit ist der Schaden doch da, den Sie hier erklären, nicht anrichten zu wollen.

Nein, wir haben tatsächlich ein Problem. Wir haben das Problem, dass wir keine unabhängigen Berichterstatter, keine unabhängigen Experten finden, weil Sie die Universitätsprofessoren, die noch nicht für die Industrie gearbeitet haben, schwerlich finden werden. Es ist auch die Aufgabe der Agenturen, an der Stelle eben auch mit dem Privatsektor zusammenzuarbeiten.

Vielleicht müssen wir ja tatsächlich dann zu sauberen Erklärungen, zu sauberen Trennungen und zu sauberen Regeln kommen. Aber mit der Entlastung, Frau Kollegin Macovei, funktioniert das nicht. Deswegen werden wir Ihrem Bericht nicht folgen.

  Gerben-Jan Gerbrandy (ALDE). - Voorzitter, collega's, ik zou u willen vragen wie van u de uitvoerend directeur van het Europees Milieuagentschap, professor McGlade, persoonlijk kent? Ik vraag dat omdat u in meerderheid op het punt staat om haar integriteit ernstig in twijfel te trekken. Dat ondanks het feit dat het Europees Milieuagentschap jaar in jaar uit gezien wordt als een voorbeeld van hoe een agentschap gemanaged moet worden, dat de Europese Rekenkamer jaar in jaar uit aangeeft dat alles klopt bij het Europees Milieuagentschap, en dat het Milieuagentschap zelf alle beschuldigingen heeft weerlegd of heeft aangetoond dat ze simpelweg niet waar zijn.

Uitstel van kwijting is niets anders dan een politieke motie van wantrouwen tegen de huidige directeur. Ik moet eerlijk zijn: het enige belangenconflict dat ik zie bij professor McGlade, is dat tussen haar ongelooflijke inzet van twintig uur per etmaal voor het agentschap en haar persoonlijke gezondheid. Want dat is het enige echte conflict.

Het ontbreken van iedere grond voor het uitstel van kwijting van het Milieuagentschap doet bij mij de vraag rijzen of er hier een verborgen agenda is. Is het Milieuagentschap misschien te sterk? Is professor McGlade misschien te goed als directeur? Ik hoop dat dat niet het geval is en ik doe dus ook een dringend beroep, vooral ook op de PPE, om geen spoken na te jagen, maar het Europees Milieuagentschap gewoon de kwijting te verlenen waar het recht op heeft.

  José Bové (Verts/ALE). - Madame la Présidente, j'interviendrai sur la question de la décharge des agences et spécifiquement de l'Agence européenne de sécurité des aliments. Il y a plus de deux ans, j'ai interpellé M. Dali sur l'existence d'un conflit d'intérêts en la personne de la présidente de cette agence, Mme Banati. Il s'est avéré que j'avais raison: hier, Mme Banati a été contrainte de démissionner à la veille du vote qui va suivre. Dès sa démission, elle a été recrutée comme directrice du plus gros lobby international de l'agroalimentaire, l'ILSI, où l'ensemble des entreprises du secteur sont présentes. Nous avons aujourd'hui un véritable problème. Chacun le reconnaît, y compris la directrice de cette agence. Il faut mettre à plat la question des conflits d'intérêts et de la transparence des évaluations. C'est la même chose pour les médicaments. Ce que je demande aujourd'hui, c'est qu'on reporte le vote de la décharge, non pas pour une question financière, mais, très clairement, pour demander à la Commission de mettre en place des règles claires de transparence et de lutte contre les conflits d'intérêts.

  Edit Herczog (S&D), blue-card question. – Madam President, I would like to ask Mr Bové whether he would agree that we should call on the Council to ensure that they send the right people to the Management Board. It is not the right way not to give discharge for 2010. We have to call on the Council to make a good decision in selecting the Management Board. It is the Council’s job and the responsibility of the Member States. This may be right or wrong but it has nothing to do with the discharge.

This is our point. We are very happy that the Council is here. I ask Mr Bové if he would agree that we should ask the Council to take measures to send the right people to any management board?

  José Bové (Verts/ALE), réponse "carton bleu". – Je pense qu'il s'agit d'une démarche positive, mais qu'elle n'est pas suffisante. Nous avons besoin de règles claires. Or, aujourd'hui, nous n'avons pas de règles claires sur les conflits d'intérêts, non seulement concernant la nomination des conseils d'administration mais aussi la nomination des experts. C'est pour cela, je crois, que nous devons prendre le temps. Si nous refusons cette décharge, nous avons une occasion historique d'organiser la transparence pour qu'il n'y ait pas d'ambiguïté sur les agences. Je suis favorable aux agences, à leur développement et aussi à l'augmentation de leur financement public pour éviter les conflits d'intérêts avec le privé. Je me bats aujourd'hui pour le renforcement des agences, mais cela passe absolument par la lutte contre les conflits d'intérêts et par la transparence.

  Philip Bradbourn (ECR). - Madam President, here we are again. Year after year, nothing changes and European taxpayers’ money continues to be wasted. The stark truth is that in 2012 we are still being asked to grant discharge to accounts which the Court of Auditors has condemned. ECR MEPs believe that taxpayers have a right to expect their money will be spent properly, so today we will be voting against the discharge. In some areas we have gone backwards in tackling mis-spending. The error rate in Structural Funds has increased significantly, which is particularly disappointing given the Commission’s rhetoric on improving the situation in regional policy. There has been a clear failure of oversight from the Commission so I am encouraged that the Committee on Budgetary Control accepted our proposal that there should be a full-time budgetary control commissioner in the next Commission term. Such an important role cannot be a part-time job if we are serious about protecting taxpayers’ money.

It is also good news that the committee agreed with us on refusing to grant discharge to three agencies, but we should not have granted discharge to any of the agencies until they could demonstrate responsible management of public money. In such a difficult time for the European economy it is completely unacceptable that even a penny of taxpayers’ money is squandered.

Ich habe aber eine Frage an Sie anlässlich des Befundes des Europäischen Rechnungshofs, dass das Vereinigte Königreich für 10 % der Fehler in der Kohäsionspolitik verantwortlich ist: Was unternimmt die konservative Partei Großbritanniens dagegen, dieses Missmanagement britischer Verwaltungsbehörden zu beseitigen?

  Mikael Gustafsson (GUE/NGL). - Herr talman! Jag kommer att enbart fokusera på betänkandet om ansvarsfrihet för Europeiska jämställdhetsinstitutet (European institute for Gender Equality, EIGE). Som ni alla vet lever EIGE upp till alla de krav som finns på en god ekonomi och fullföljer sina åtaganden enligt uppdrag.

Dessvärre har det i punkt 3 i utskottets förslag smugits in en mening som föreslår en sammanslagning av EIGE och Europeiska unionens byrå för grundläggande rättigheter (European Union Agency for fundamental rights, FRA). Det här är ett mycket märkligt förslag, med tanke på att EIGE upprättades för bara några år sedan, efter mer än 10 års påtryckningar från det här parlamentet. Även om det naturligtvis finns beröringspunkter med FRA så är det även mycket som skiljer dem åt.

EIGE fokuserar uteslutande på genus och de strukturer och den politik som kan göra oss mer effektiva inom jämställdhetsområdet. Det handlar om arbetsmarknad, socialförsäkring, beslutsfattande och att kunna förena arbete med familjeliv. Europaparlamentet sätter jämställdheten högt på dagordningen även när medlemsstater ibland brister i visioner och idéer. Vi behöver därför ett fullfjädrat institut som är en resurs och utför vägledande bakgrundsarbete och uppföljning inom detta viktiga politikområde. Därför bör punkt 3 strykas.

  Hans-Peter Martin (NI). - Herr Präsident! Als Berichterstatter für die Entlastung der Agenturen im Jahr 2008 habe ich entsprechende Erfahrungen gemacht. Damals habe ich in verschiedensten Berichten geschrieben, was hier im Plenum kritisiert wurde, und vorgeschlagen, dass bei 16 von 20 Agenturen die Entlastung nicht erteilt wird. Es wurde damals alles weggestimmt. So kann ich jetzt mit der Kollegin Macovei mitfühlen, da es immerhin gelungen ist, im Ausschuss eine Mehrheit in drei Berichtsfragen zu bekommen, die aber offenbar hier wackelt. Das ist sehr bedauerlich. Ich denke, es entspricht eben nicht diesem Anspruch des Parlaments, dass wir doch entsprechende Kontrolle ausüben sollten.

Bedauern möchte ich aber außerdem, dass es Ihnen nicht gelungen ist und es offenbar keine Initiativen gab, zu einem Bericht ebenfalls keine Entlastung zu erteilen, nämlich betreffend das Unternehmen ITER. Wenn man da Ihren Bericht durchliest und sieht, dass Sie in unzähligen Punkten enorme Kritik vorbringen, in den Punkten 2, 4, 5, 7, 10, 12, 13, 27, ist nicht nachvollziehbar, dass da nicht ebenfalls die Entlastung nicht erteilt wird.

  Marian-Jean Marinescu (PPE). - Cooperarea interinstituţională dintre Parlament şi Consiliu este vitală în supravegherea implementării bugetului. De aceea, orice impas generat de lipsa de conformare din partea Consiliului cu cerinţele emise de Parlament, în calitatea sa de autoritate decisivă privind descărcarea de gestiune bugetară, este regretabil şi dăunează acestui proces. Decizia de a amâna acordarea descărcării bugetare nu trebuie percepută ca un obstacol în procesul de negociere dintre Parlament şi Consiliu. Parlamentul trebuie să îşi menţină însă poziţia actuală şi să refuze acordarea descărcării de gestiune bugetară, în cazul în care Consiliul nu se va conforma cerinţelor şi nu va îndeplini toate condiţiile emise de Parlament.

Comitetul Economic şi Social a răspuns prompt la observaţiile formulate de către Parlament. Parlamentul urmăreşte însă cu atenţie investigaţiile OLAF şi ale Ombudsmanului European privind presupusele nereguli din administraţia Comitetului Economic şi Social.

Curtea Europeană de Justiţie a luat măsuri pentru optimizarea fluxului de lucru intern, prin introducerea aplicaţiei e-Curia. Curtea Europeană de Conturi a luat decizia de a creşte numărul de posturi dedicate exclusiv sarcinilor de audit cu 6%. Este necesară urmărirea cu atenţie a proiectului-pilot privind externalizarea sarcinilor de audit. Grupul PPE va susţine descărcarea de gestiune a acestor instituţii.

  Barbara Weiler (S&D). - Herr Präsident, liebe Kolleginnen und Kollegen! Ich möchte mich zum Entwicklungsfonds äußern, und ich bin zuversichtlich, dass wir zu diesem Bereich nicht nur im Ausschuss, sondern auch im Plenum eine einheitliche Meinung finden. Diese Debatte – das ist sicherlich auch wichtig zu erwähnen – findet unter besonderen Vorzeichen statt, unter dem Vorzeichen einer harten Zeit der Wirtschafts- und Finanzkrise innerhalb der Europäischen Union und im Grunde ja auch weltweit. Schon deshalb ist die Aufmerksamkeit der Öffentlichkeit auch auf unsere Debatte hier zur Entlastung und zur Prüfung des Haushalts gerichtet. Denn wir wollen ja eigentlich alle, dass der Haushalt korrekt ausgeführt wird, sinnvoll und vor allen Dingen – das sage ich besonders bei dem EDF – auch nachhaltig. Der EDF ist unser wichtigstes Instrument zur Armutsminderung, also im ureigensten Interesse der Europäischen Union, um Kriege zu verhindern und auch den Menschen eine Zukunftsperspektive zu geben. Ich bin definitiv überzeugt, dass das auch von den Bürgern und von den Steuerzahlern so gesehen wird.

Die Sozialdemokraten unterstützen den Bericht, über den wir im Ausschuss abgestimmt haben. Allerdings auch erst, nachdem unsere Änderungsanträge angenommen worden sind und der Bericht eine etwas andere Richtung bekommen hat, denn sinnvolle und notwendige Kritik ist richtig. Aber hier ist, wie Frau Herczog schon gesagt hat, versucht worden, eine Politisierung vorzunehmen, zum Beispiel bei der Kritik an der UNO. Selbstverständlich muss die UNO effizienter und vor allem transparenter werden. Aber sie ist auch ein ganz wichtiger Partner für unsere Arbeit und hat eine hilfreiche Infrastruktur. Wir müssen auf jeden Fall die Büros schulen und die Kapazitäten ausbauen, denn nur so kann man effiziente Arbeit machen.

Das möchte ich betonen und zum Schluss noch anmerken, dass wir eine gemeinsame Beurteilung der Fehlerquote brauchen und natürlich auch eine andere Agrarpolitik.

  Olle Schmidt (ALDE). - Herr talman! Europa har stora ekonomiska och politiska problem. Det finns inga ursäkter för slarv med offentliga medel, och felkvoten i budgeten är oacceptabelt hög. Men det är inte kommissionen själv som ansvarar för alla fel, det vet vi.

Medlemsstaterna bär huvudansvaret, och de stora brister som tidigare nämnts vad gäller hur pengarna använts på nationell nivå är oacceptabla. Ansvariga politiker i dessa medlemsstater måste svara för de här felen – tories eller icke tories, labours eller icke labours. Och det duger inte att peka finger åt Bryssel och EU när slarvet sker i den egna hanteringen. Ett antal av medlemsstaterna har också vägrat att offentliggöra sina årliga rapporter om EU-pengarna. Varför detta smusslande?

Herr kommissionär, ni har idag lovat att alla rapporter ska göras tillgängliga. Det är bra och det är efterlängtat, men jag tycker att det kommer väl sent. Vi bör få längre tid på oss att kunna läsa igenom de här rapporterna och göra en noggrann analys. Jag anser därför att vi bör skjuta upp beslutet om ansvarsfrihet för kommissionen så att vi får tid att gå igenom alla fakta. Jag tycker att det är ett rimligt krav, och med tanke på vad kollegorna i min grupp tidigare har sagt så tycker jag att fler borde kunna stödja det.

Slutligen vill jag också kommentera ansvarsfriheten för Europeiska utvecklingsfonden. Det är ett problem att EUF fortfarande står utanför EU:s budget. EUF måste bli en del av den normala budgetkontrollprocessen.

  Satu Hassi (Verts/ALE). - Arvoisa puhemies, hyvät kollegat, valvonta on tärkeää. Onnittelen valiokuntaa ja mietinnön esittelijää siitä, että muun muassa EFSA on saatu parantamaan jääviyssääntöjään.

Oikeudenmukaisuuteen kuuluu kuitenkin myös, että kun kysymyksiin on saatu tyydyttävät vastaukset ja mahdolliset virheet korjattu, vastuuvapaus myönnetään. Ympäristöviraston kohdalla tilanne on tämä. EEA:n johtajan väitetty jääviys on tutkittu, ja jääviyttä ei löytynyt.

Julkisia hankintoja koskeva kritiikki on kohdistunut vihreään julkisivuun. Se oli taideteos ja hankittu taideteoksia koskevien sääntöjen mukaan. Vihreä julkisivu oli erittäin onnistunut biodiversiteetin teemavuoden tiedotushanke: yli puoli miljoonaa ihmistä näki sen. Kontaktihinta oli noin 50 senttiä. Guardian-lehti valitsi sen Euroopan kolmanneksi parhaaksi biodiversiteetin tiedotushankkeeksi, ja tanskalaiset maan parhaaksi turistikohteeksi. Virastoa tulisi onnitella eikä moittia näin onnistuneesta tiedotuksesta.

  Peter van Dalen (ECR). - Voorzitter, onlangs stelde de Commissie voor de begroting voor 2013 met 7% te verhogen. Onbegrijpelijk. Regeringsleiders in Griekenland, Frankrijk en Nederland moeten vertrekken omdat ze moeten bezuinigen, maar de Europese begroting zou met 7% omhoog kunnen? Onbegrijpelijk.

Er is nog een reden om kritisch te zijn over de omvang van de Europese begroting. Bij de kwijting over 2010 is door uitstekend werk van de rapporteur duidelijk geworden dat bij diverse agentschappen het budget onverantwoord is besteed. Met name bij het Milieuagentschap blijkt nog veel mis te zijn. Zolang de verantwoording van de agentschappen niet op orde is, moeten we de kwijting aan die agentschappen opschorten.

Tegelijk zeg ik dat de verantwoording voor de begroting van het Europees Parlement ook onder de maat is. Zolang Europarlementariërs zonder verantwoording af te leggen maandelijks 4 300 euro aan algemene onkosten kunnen besteden, moet dit Parlement terughoudend zijn met het veroordelen van andere Europese instellingen.

  Claudio Morganti (EFD). - Signor Presidente, onorevoli colleghi, vorrei soffermarmi sul discarico da concedere a due organismi europei, il Comitato delle regioni e il Comitato economico e sociale.

Al di là di alcuni gravi errori di gestione, soprattutto per quanto riguarda il Comitato economico e sociale, a lasciarmi perplesso è la natura stessa dei loro bilanci, puramente amministrativi: per entrambi abbiamo infatti un 70% di spese destinate al personale e il restante 30% riferibile agli immobili. Mi domando quale sia il reale valore aggiunto che queste Istituzioni possono dare all'Europa. Io sono sicuramente favorevole a un'Europa delle regioni, ma l'organo che qui dovrebbe rappresentarle, così com'è strutturato mi pare di scarsa utilità.

Si spendono per queste due Istituzioni oltre duecento milioni di euro all'anno senza alcun ritorno concreto. Così come sono concepiti oggi, questi due comitati consultivi, sostanzialmente privi di potere, rappresentano quello che non dovrebbe essere l'Europa, ovvero una serie di apparati burocratici fini a sé stessi.

  Andrew Henry William Brons (NI). - Mr President, it is not primarily our job to give an opinion on whether the money was spent as we would wish or in agencies of which we would approve. It is, of course, to decide whether or not it was spent in accordance with the authority given to the agency in question. Some of these reports contain few, if any, criticisms, and the criticisms are minor. Assuming the rapporteurs were provided with accurate information and that they took account of that information, then Parliament should attest to that.

A good example of this is Mrs Macovei’s report on the European Centre for Disease Control. But her report on the budget for the European Environment Agency does provide some evidence for suspicions of overlaps of spending – I will speak cautiously in that way – with NGOs or pressure groups with which staff of the agency had rather too close a relationship.

Her report on the budget for the Food Safety Agency was unexceptionable in itself, but I am concerned about amendments that would seek to water down the recommendations of the original report to prevent conflicts of interest.

  Ingeborg Gräßle (PPE). - Herr Präsident, Herr Ratspräsident, Herr Kommissar, Herr Präsident des Rechnungshofs! Willkommen Sie alle! Wir freuen uns, dass Sie zum ersten Mal so in trauter Runde an dieser Entlastungsdebatte teilnehmen. Das ist für uns wirklich wie Weihnachten und Ostern an einem Tag. Das ist heute etwas ganz Besonderes, und ich möchte es doch noch einmal hervorheben.

Ich möchte die Gelegenheit nutzen und mich zuerst an den Präsidenten des Europäischen Rechnungshofs wenden. Die Debatte hat gezeigt, dass wir in Sachen Agenturen Ihren Sonderbericht über das Benchmarking der Agenturen wirklich brauchen. Sie haben dem Parlamentspräsidenten angekündigt, dass Sie aus Personalgründen außerstande sind, diesen Bericht zu machen. Ich möchte Sie ganz herzlich bitten, uns diesen Bericht zu geben! Das ist ein nützlicher Bericht, auf den wir in der Arbeitsgruppe Agenturen sehr gesetzt haben und sehr setzen. Ich möchte Sie nochmals herzlich bitten, uns diesen Bericht zu geben, zumal die Zahlen, die wir kennen, ganz vielversprechend sind. Wir brauchen diese Zahlen! Bitte geben Sie sie uns! Und wir brauchen auch Ihre Stellungnahme zum Thema Interessenkonflikte in den Agenturen!

Was wir hier erleben, ist ja für die Verhältnisse im Europäischen Parlament schon bürgerkriegsähnlich. Ich möchte einfach einmal darauf hinweisen, dass es durchaus Gründe gibt, an den Agenturen Kritik zu üben. Es wurde Kritik geübt an drei Agenturen von 32 – also drei Agenturen, bei denen wir und unsere Berichterstatterin Probleme sehen. In einem Punkt möchte ich mich ausdrücklich hinter die Berichterstatterin stellen, nämlich bei der Umweltagentur. Liebe Kollegen von der sozialistischen Fraktion– und auch Herr Gerbrandy – Ihr macht hier einen Fehler! Wir haben hier Dinge entdeckt, und je länger man sich damit beschäftigt, umso mehr muss man Fragen stellen. Es ist eben nicht in Ordnung, dass eine Agentur Zuschüsse an eine Nichtregierungsorganisation gibt, diese Nichtregierungsorganisation in entfernten Weltgegenden Seminare veranstaltet und die Mitarbeiter dieser Agentur sich auf diese Seminare einladen lassen. Also, ich finde das nicht in Ordnung! Wenn ihr das in Ordnung findet, umso schlimmer! Ich finde, wir müssen hier etwas tun.

Ich möchte mich noch an den Rat wenden: Sie sprechen von gegenseitigem Screening. Es ist aber halt so, dass das Parlament die Entlastung erteilt, Sie geben die Empfehlung ab. Deswegen haben wir gestern auch wieder eine nette Debatte gehabt im Zuge der Verhandlungen zur Haushaltsordnung. Wir brauchen eine Auslegung des Artikels 319 im Vertrag und des Artikel 335 – Autonomie der Institutionen. Wir haben dazu Vorschläge vorgelegt. Aber es wäre an Ihnen, sich dazu zu äußern.

  Γεώργιος Σταυρακάκης (S&D). - Κύριε Επίτροπε, αγαπητοί συνάδελφοι, πρώτα από όλα θα ήθελα να ευχαριστήσω όλους τους εισηγητές των εκθέσεων για τη μεθοδική δουλειά που έκαναν και τις πολύ καλές εκθέσεις τους. Στα πλαίσια της τρέχουσας οικονομικής και χρηματοπιστωτικής κρίσης η πίεση στα δημόσια οικονομικά ποτέ δεν ήταν μεγαλύτερη. Η αποτελεσματική χρήση του δημόσιου χρήματος είναι πιο σημαντική από ποτέ. Ταυτόχρονα ο ρόλος μας ως Κοινοβουλίου είναι η λογοδοσία προς τους πολίτες και πρέπει να βεβαιώνουμε ότι τα χρήματα των φορολογουμένων χρησιμοποιούνται σωστά, με διαφάνεια και αποτελεσματικότητα.

Δεδομένου ότι η πολιτική συνοχής βρίσκεται στο επίκεντρο της συζήτησης σχετικά με το ποσοστό λάθους και τον αντίκτυπο που έχει στον προϋπολογισμό της Ευρωπαϊκής Ένωσης, είναι ζωτικής σημασίας να υπογραμμίσουμε τι συνιστά λάθος και τι όχι. Λάθος συνιστά μία συναλλαγή που δεν συνάδει στο σύνολό της με τους ισχύοντες κανονισμούς. Λάθος δεν σημαίνει ότι οι πόροι έχουν χαθεί ή έχουν σπαταληθεί ή ότι έχει διαπραχθεί απάτη.

Με στοχευμένη προσπάθεια από την Επιτροπή και συγκεκριμένα κράτη μέλη το ποσοστό λάθους μπορεί να μειωθεί σημαντικά. Είμαι σίγουρος ότι όλοι θα συμφωνήσουμε ότι, στο πλαίσιο της επόμενης προγραμματικής περιόδου, στην πολιτική συνοχής θα πρέπει να υπάρξει ένας μεγαλύτερος βαθμός απλούστευσης, διαφάνειας, υπευθυνότητας και ελέγχων που να συνδυάζουν αποτελεσματικότητα και κόστος, στοιχείο το οποίο τελικά θα μας βοηθήσει να βελτιώσουμε την προστασία των οικονομικών συμφερόντων της Ευρωπαϊκής Ένωσης.

Κατά την περσινή διαδικασία απαλλαγής προσπαθήσαμε και, κατά τη γνώμη μου, πετύχαμε την αύξηση της διαφάνειας και την αυστηρότερη πειθαρχία στη διαχείριση του προϋπολογισμού. Αυτό, φυσικά, δεν σημαίνει ότι όλα είναι τέλεια, ότι δεν υπάρχει περιθώριο για βελτίωση και ότι δεν υπάρχουν καθόλου προβλήματα. Αλλά προσπαθούμε να εντοπίζουμε τα προβλήματα και να τα αντιμετωπίζουμε. Στη σημερινή μεγάλη οικονομική και κοινωνική κρίση η σημασία της παρακολούθησης έχει γίνει πιο σημαντική από ποτέ και όλοι μαζί – Ευρωπαϊκό Κοινοβούλιο, Οργανισμοί, Επιτροπή και Ευρωπαϊκό Ελεγκτικό Συνέδριο – πρέπει να είμαστε αποφασισμένοι να αντιμετωπίσουμε και να λύσουμε τα προβλήματα ώστε να πετύχουμε ακόμη μεγαλύτερα αποτελέσματα.

  Michael Theurer (ALDE). - Herr Präsident, liebe Kolleginnen und Kollegen! Wir diskutieren heute den Haushalt 2010, den Bericht des Rechnungshofs hierzu.

Erfreuliches und weniger Erfreuliches zeigt sich in diesem Bericht: Licht und Schatten. Zum einen ist bei den von der EU-Kommission direkt kontrollierten und auch verwalteten Fonds festzustellen, dass die Fehlerrate nach unten geht, insbesondere in der Agrarpolitik wurden erfreuliche Ergebnisse erzielt, mit 2,3 % Fehlerrate.

Andererseits haben wir in der Kohäsionspolitik – wie seit Jahren – das Sorgenkind mit einer Fehlerrate von 7,7 % – und zwei Drittel dieser Fehler hätten von den Mitgliedstaaten korrigiert werden müssen. Das darf uns an dieser Stelle nicht ruhen lassen, auf die Mitgliedstaaten dahingehend einzuwirken, dass diese Fehlerrate nach unten geht.

Ich möchte an dieser Stelle zunächst – für die ALDE-Fraktion, aber auch als Ausschussvorsitzender – Herrn Kommissar Šemeta ganz herzlich für die gute Zusammenarbeit danken, ebenso wie dem Präsidenten des Rechnungshofes. Ich schließe mich ausdrücklich den Kollegen an, die heute begrüßen, dass mit Minister Wammen von der dänischen Ratspräsidentschaft der Rat auch vertreten ist. Die Zusammenarbeit mit der Kommission und dem Rechnungshof ist vorbildlich. Die Zusammenarbeit mit dem Rat, Herr Minister Wammen, ist verbesserungsbedürftig –  und zwar von Seiten des Rates. Und ich möchte Sie bitten und ermutigen, das auch den anderen Ratsmitgliedern zu übermitteln.

Wir als Parlament erwarten, dass die Mittelverwendung in der geteilten Zuständigkeit verbessert wird, dass hier im Trilog jetzt der Rat auf das Parlament zugeht, damit wir in Zukunft die Fehlerraten nach unten bekommen. Denn wir müssen endlich auch bei der Ratsentlastung einen Fortschritt erzielen. Es kann nicht sein, dass es öffentliche Ausgaben gibt, die keiner demokratischen Kontrolle unterliegen! „No taxation without representation" war der Kampfruf der amerikanischen Revolution. Die Demokratie sagt, keine öffentliche Ausgabe ohne demokratische Kontrolle. Und wenn Sie das Prinzip der Reziprozität ansprechen, dann stimmt das ja nicht im Bereich des Verhältnisses von Rat und Parlament, nein, im Lissabon-Vertrag ist eindeutig geregelt, dass der Rat empfiehlt, aber das Parlament entscheidet. Das ist keine Reziprozität, das ist keine Symmetrie, das ist eine Asymmetrie und hier gilt es, dem Parlament als dem direkt gewählten Gremium der Bürgerinnen und Bürger sein Recht zu verschaffen.

  Ryszard Czarnecki (ECR). - Panie Przewodniczący! Ja popieram koncepcję, aby był specjalny komisarz do spraw kontroli budżetu. Ja bym tej koncepcji nie poparł, gdybym nie wiedział, że i tak musimy stworzyć jedno dodatkowe stanowisko komisarza, ponieważ będziemy mieć za chwilę nowy kraj członkowski – Chorwację. W związku z tym, jeżeli musimy stworzyć to stanowisko, to stwórzmy je w tej sprawie, ponieważ obywatele państw członkowskich Unii Europejskiej bardzo dużą uwagę przywiązują do rozliczania pieniędzy, którymi Unia Europejska, agendy i państwa członkowskie dysponują. To po pierwsze.

Po drugie. Możemy się różnić: niektórzy są za zwiększaniem budżetu i budżetu także agencji, inni przeciwko temu. Ale wszyscy uważają, że konflikty interesów są absolutnie niedopuszczalne i te sprawy trzeba raz na zawsze wyjaśnić, skończyć, żeby to było transparentne, przejrzyste, jasne i klarowne. Inaczej autorytet instytucji Unii Europejskiej będzie się obniżał, także autorytet naszego Parlamentu, który nie będzie w stanie na to reagować w sposób zdecydowany.

  Nicole Sinclaire (NI). - Mr President, I have lost count. Is this the 17th year in which the auditors have failed to give a positive declaration on the EU’s budget or, in other words, have we now reached 17 years in which taxpayers’ money has not been properly accounted for? I note the statement in the resolution on the discharge of the Commission budget that progress has been made since the resignation of the Santer Commission, but I have to ask: ‘Really?’

In 2008, Commissioner Mandelson was accused of a conflict of interest after holidaying with a Russian oligarch whose company subsequently benefited from his department’s decisions. In June 2011, Commission President Barroso ran up a EUR 25 000 hotel bill for a four-night luxury stay in New York. Then there was the Commission memo issued by DG Trade in 2009 which encouraged officials to conceal information from public scrutiny. The EU and its institutions have failed to practise what they preach and what places them above the citizens they purport to represent. It is time the UK left this mess.

  Radvilė Morkūnaitė-Mikulėnienė (PPE). - Mr President, I would like to touch on a question regarding the report on the European Institute for Gender Equality.

Paragraph 3 proposes the merger of the European Institute for Gender Equality and the European Union Agency for Fundamental Rights. Gender equality is a founding value of the European Union and has implications broader than simply those of human rights. I have to say that these two bodies have completely different objectives. The Institute for Gender Equality was planned over more than 10 years. The initiative for it came from this Parliament, and after long preparations it started work in 2010. I have not heard anything to suggest that its work has been inefficient. The main argument is that of saving resources.

In this House we often speak about greater integration in the European Union, in order to bring it closer to our citizens. Agencies, institutes, other EU bodies and the Member States all help us to deliver the message of the European Union. To have more Europe in every Member State is our goal. These bodies contribute a great deal to both EU and national policies. If we are concerned with saving resources, we need to talk about reform in a broader sense, systematically, and not only merely in terms of merging some of the EU institutions or agencies.

When we talk about savings, we can talk about Strasbourg and about other things, but money is not always what is at issue. There are certain things that we deliver to our citizens, and I think that having this kind of agency in Member States is crucial. I call on you to vote today not to merge these institutions.

  Cătălin Sorin Ivan (S&D). - Atunci când vorbim de descărcare de gestiune, automat vorbim de utilizarea banilor europeni şi de atenţia foarte sporită pe care trebuie să o avem asupra felului în care banii europeni sunt folosiţi. Am fost raportor pe raportul privind protecţia intereselor financiare ale Uniunii Europene şi sunt de acord că, mai ales în perioade de criză, dar chiar şi în perioade de creştere economică, banii europeni trebuie folosiţi cu foarte mare grijă.

De aici însă, până la a transforma descărcarea de gestiune bugetară într-o scenă pe care raportorul să defileze şi să lucreze la propria imagine este o distanţă foarte mare. Eu zic că este o reacţie politică disproporționată între ceea ce se întâmplă în agenţiile europene şi ceea ce doreşte în realitate raportorul.

Eu cred că dna raportor Monica Macovei nu caută decât să îşi facă imagine pentru că avem şi procedurile, şi instrumentele necesare pentru ca atunci când apar probleme, să le rezolvăm din timp. Cred că este o reacţie politică mult exagerată şi dna Macovei nu caută decât să îşi creeze propria imagine.

  Bogusław Sonik (PPE). - Posiadamy obecnie 32 agencje europejskie zatrudniające 5,5 tysiąca osób. Koszty funkcjonowania to około 700 mln euro. Niewątpliwie ich funkcjonowanie w większości jest uzasadnione: pracują wszak na rzecz instytucji europejskich, ułatwiając podejmowanie decyzji, wypełniają też zadania wspólnotowe, jak chociażby agencja FRONTEX strzegąca naszych granic. Tym niemniej potrzebny jest przegląd ich funkcjonowania, w szczególności zasad, jakie w nich obowiązują w kwestii konfliktu interesów, których to wiele przypadków ujawniono w ostatnich latach. To może podważyć wiarygodność ocen, ekspertyz i certyfikatów wydawanych przez niektóre agencje, a w konsekwencji uderza również w autorytet Komisji i Parlamentu.

Należy również ocenić politykę finansową agencji, niektóre – jak to jest w przypadku Agencji Praw Człowieka w Wiedniu – nie potrafią wykorzystać swojego budżetu, wydając na gwałt gros środków w ostatnim miesiącu roku, lub starają się przenieść je na następny rok. Trzeba rozważyć, czy by w przyszłości nie powołać tymczasowej komisji w Parlamencie ds. przeglądu funkcjonowania agencji pod kątem zasadności istnienia każdej z nich jako odrębnego ciała, a ponadto poddać analizie zasady ich funkcjonowania, w szczególności problemy konfliktu interesów, bezstronności czy wycieku poufnych informacji. Są to niezwykle ważne sprawy. Trzeba przeprowadzić na pewno debatę nad tym, czym jest konflikt interesów, żeby z jednej strony zabezpieczyć wysoki poziom pracowników agencji, a z drugiej – przejrzystość procedur. Musimy pamiętać, że w czasach kryzysu gospodarczego, kiedy od państw członkowskich wymagana jest wstrzemięźliwość budżetowa, szczególnie ważne jest, żeby Unia Europejska wykorzystywała swoje zasoby starannie, ograniczając marnotrawstwa czy też nieprawidłowości, a nawet i oszustwa.

  Monika Flašíková Beňová (S&D) - V úvode by som chcela zdôrazniť, že agentúry Európskej únie vrátane Agentúry pre ľudské práva majú v súvislosti s dosahovaním cieľov a politík Európskej únie zásadný význam. Napriek tomu, že tvoria len 1 % rozpočtu Únie, ich prínos pre občanov členských štátov je nespochybniteľný.

V súvislosti s absolutóriom za plnenie rozpočtu Agentúry pre základné práva však považujem za potrebné zdôrazniť, že ak má agentúra naďalej fungovať a vyvíjať svoju činnosť čo v najefektívnejšej podobe, musí prijať viacero opatrení, ktoré jej pomôžu prekonať hlavné problémy, ktoré súvisia s rozpočtovými aktivitami, výdavkami, financovaním projektov, či prijímaním zamestnancov. Veľmi znepokojujúce sú aj tvrdenia o údajnom obťažovaní zamestnancov, pričom v tejto súvislosti bola podaná už aj žaloba. V súčasnosti je preto nevyhnutné, aby agentúra na tieto obvinenia primerane reagovala a objasnila zaobchádzanie s informátormi, pretože dôsledné uplatňovanie existujúcich pravidiel na ochranu informátorov nie je jednoznačné a agentúra by o ňom mala Európsky parlament informovať a predložiť písomnú správu. Ďalší negatívny aspekt súvisí s plánovaním rozpočtu. Agentúra by sa v tomto smere mala takisto zlepšiť. Vysoký objem prenesených finančných prostriedkov je totiž znepokojujúci a Dvor audítorov naň už takisto opakovane upozorňoval.

Verím však, že v budúcnosti sa dostane aj k takej podrobnejšej diskusii o práci jednotlivých agentúr a ďakujem Vám za túto otázku, považujem za dôležité rozobrať ju v budúcnosti aj tu v pléne Európskeho parlamentu.

  Anneli Jäätteenmäki (ALDE), ulkoasiainvaliokunnan lausunnon valmistelija. – Arvoisa puhemies, puhumme nyt vuoden 2010 budjetista, sen valvonnasta ja vastuuvapauden myöntämisestä.

Kansalaisilla on oikeus tietää, mihin heidän verovarojansa ja veroeurojansa käytetään. Julkisten varojen käytön tulee olla läpinäkyvää ja avointa.

Puhun ulkoasiainvaliokunnan puolesta, ja haluaisin nostaa esille yhden tulevaisuuteen liittyvän kysymyksen. On tärkeää, että me tiedämme, miten ulkosuhdebudjetti käytetään. Komissio ja neuvosto voisivat harkita, että kehitysyhteistyövarat, kaikki ulkosuhdebudjetin rahat, olisivat aivan päivittäin ja viikoittain Internetin kautta seurattavissa. Se on nykypäivää, ja sitä kautta kansalaiset voisivat seurata, mitä hyvää heidän veroeurojensa käytöstä seuraa esimerkiksi Afrikan köyhillä alueilla.

Haluaisin nostaa esille myös ongelman, joka ei koske kylläkään ulkosuhdebudjettia, mutta on ongelma. On todella käsittämätöntä, että komissio on viimeiset kuusi vuotta viitannut kintaalla yhteisille sovituille säännöille ja pimittänyt parlamentilta neuvoston varojen käyttöön liittyvät asiat.

  Barbara Matera, relatrice per parere della commissione per l'ambiente, la sanità pubblica e la sicurezza alimentare. − Signor Presidente, onorevoli colleghi, parlo come relatrice del parere sul discarico 2010 della commissione per i diritti della donna e l'uguaglianza di genere e volevo parlare dell'Istituto europeo per l'uguaglianza di genere.

Il 2010 è stato un anno particolare per questo istituto perché è diventato finanziariamente indipendente. A distanza quindi di due anni da tale indipendenza finanziaria, il 92,3% dell'organico in termini di risorse umane di questo istituto è stato completato ed è ora pienamente operativo e funzionante.

L'istituto svolge un ruolo centrale nell'identificazione di misure adeguate volte a superare le numerose discriminazioni nei confronti delle donne, in particolare mediante l'attività di elaborazione di studi, ricerche, dati statistici, scambi di buone pratiche in materia di pari opportunità all'interno dell'Europa a 27. L'istituto in questo momento svolge un ruolo fondamentale per i diversi Stati membri e per la Commissione europea, che stanno valutando di introdurre una legislazione sull'incremento delle donne nei ruoli decisionali delle imprese, e quindi l'attività di questo istituto è fondamentale.

Sono quindi contraria alla richiesta di prendere in considerazione la fusione dell'istituto di Vilnius con l'Agenzia dell'Unione europea per i diritti fondamentali di Vienna. Questi due istituti hanno dei ruoli completamente differenti – come ho detto l'istituto di Vilnius si occupa di tematiche di pari opportunità mentre l'agenzia di Vienna si concentra sui diritti umani – quindi chiedo a tutti i colleghi di sostenere l'emendamento per la soppressione del paragrafo 3.

  Zofija Mazej Kukovič (PPE). - Ker sem bila velik del življenja v gospodarstvu, bi si predstavljala, da danes obravnavamo razrešnice za leto 2011, ne za 2010, kajti po tolikem času je težko govoriti o odstopanjih in o nujnih popravkih, ki jih je potrebno narediti.

Državljani vsak dan poslušajo, in državljanke, enkrat o rasti, drugič o varčevanju in zato bi pri agencijah, ki so sicer izjemnega pomena za države članice, morali se tudi osredotočiti na lastno porabo, na lastno znižanje stroškov, na varčevanje.

Tukaj je gotovo, da mnogo priložnosti, hkrati pa povečanje učinkovitosti in odzivnosti za državljanke in državljane.

  Elena Băsescu (PPE). - Susţin poziţia raportoarei şi colegei mele, dna Monica Macovei, cu siguranţă una dintre cele mai potrivite persoane să se ocupe de amânarea descărcării bugetare pentru Agenţia Europeană de Mediu, dar şi EFSA şi EMA. Este o măsură necesară pentru a clarifica şi a remedia aspectele problematice identificate în gestiunea lor financiară.

Am în vedere, în special, existenţa unor conflicte de interese care reprezintă o problemă atât la nivel european, cât şi în statele membre, inclusiv în România. Deciziile luate în asemenea situaţii sunt contrare interesului public şi duc la folosirea necorespunzătoare a banilor contribuabililor. Cei peste 30 000 de euro acordaţi pentru o călătorie care seamănă a vacanţă reprezintă un exemplu grăitor. Având responsabilitatea controlului bugetar, Parlamentul nu poate trece cu vederea aceste cazuri. Altfel, cum mai putem pretinde ca cetăţenii să aibă încredere în instituţiile europene?

  Vítor Manuel da Silva Caldeira, Président de la Cour des comptes. − Monsieur le Président, je profite de ces derniers moments pour d'abord remercier les membres de cette assemblée pour les mots d'appréciation qu'ils ont adressés à la Cour des comptes et à l'égard de son travail.

L'octroi de la décharge est un privilège du Parlement européen. Nous avons entendu aujourd'hui des appels à une meilleure supervision du travail, à un meilleur feedback, à une meilleure gestion financière, à une simplification accrue, au renforcement des mécanismes de reddition des comptes et de la transparence. Je pense qu'il s'agit aussi d'une occasion qui s'offre à toutes les institutions de revoir le cadre réglementaire et le cadre de mise en œuvre de la prochaine période de programmation. Nous devons avoir des règles plus claires et plus simples et poursuivre des objectifs qui ont vraiment un sens en eux-mêmes, dans le but de créer une valeur ajoutée pour l'Union européenne.

L'évolution que connaît la gouvernance économique de l'Union nous pose aussi des questions nouvelles, notamment en ce qui concerne le mécanisme de reddition des comptes. Le mécanisme européen de stabilité s'inscrit dans le cadre de cette évolution. Je suis heureux de pouvoir vous annoncer qu'un comité d'audit composé d'auditeurs indépendants a été mis en place et qu'il présentera ses rapports au Parlement. J'ai aussi entendu des appels à la Cour des comptes pour qu'elle soumette dans les meilleurs délais son rapport sur les conflits d'intérêts dans les agences. Je l'avais déjà indiqué par écrit à plusieurs reprises à cette institution: soyez assurés que vous aurez ce rapport. Mais laissons-nous le temps de bien le réaliser et de mener une procédure contradictoire avec les agences concernées, de façon à ce qu'il vous apporte une réelle valeur ajoutée pour vos débats motivés par d'autres raisons.

  Algirdas Šemeta, Member of the Commission. − Mr President, I would like to thank all the Members who participated in this fruitful debate. Your contributions demonstrate the will of the discharge authority to contribute to more effective budget execution, aiming not only to meet policy objectives but also to ensure that financial support reaches those who need it most. This is a question of effectiveness, fairness and justice. Moreover, the European budget is the most concrete expression of the solidarity among European people and, therefore, it deserves the utmost care and commitment on the part of those managing and controlling it.

Improving the EU’s financial governance is a demanding task involving many stakeholders and financial actors. At the forefront are the citizens of Europe and the benefits they derive from EU-financed projects and programmes. Their interests and the protection of EU taxpayers’ money are the main drivers for our ambitions and our efforts to improve the financial management of the EU budget.

Next, we have the financial actors. The Commission is fully committed to endorsing its final responsibility regarding implementation of the budget. But the effective involvement of all financial actors, without exception, and their commitment to value for money and sound financial management are instrumental to further reducing the risk of errors. In this respect, more effort is needed, in particular on the effectiveness of control and management systems, but also on the transparency and accountability of the European and national authorities in charge of ensuring optimal use of EU money.

That is why the Commission will endeavour to keep this Parliament, as discharge authority, fully informed of the execution of the European budget. It will therefore continue to provide the necessary information in the accounts and via the various reports announced during the hearings of the Commissioners responsible. Moreover, the Member States’ annual summaries, accompanied by an analysis and guidelines, will be transmitted in a user-friendly manner to the Committee on Budgetary Control in accordance with the provisions of Article 319 of the Treaty.

Several concrete questions were raised during this debate, and I would like to reply to them. Ms Ivanova raised the issue of outstanding commitments, and I can only agree that the outstanding commitments need to be substantially reduced. Therefore the Commission has proposed an appropriate level of payments for the 2013 budget. Then Mr van de Camp raised the issue of external funds in relation to the Schengen Information System (SIS I and SIS II). You will know that many difficulties were encountered in the past in the development of this system. It is now operational and the Commission is carefully monitoring it to ensure it functions in an effective and reliable manner. The Commission is ready to report on it if requested to do so.

With regard to the funds for external borders, the Commission can execute the allocated budget when we receive claims from the Member States. I will pass your concerns on to my fellow Commissioner in charge of this matter.

Several of you, namely Mr Berman, Ms Hohlmeier, Mr Schmidt and Ms Jäätteenmäki, raised the issue of the status of the European Development Fund (EDF). In the financial framework for 2014-2020 the Commission has proposed keeping the same setting, i.e. outside the Union budget, but it has also made a clear commitment to assess all other options for the financial period post-2020.

There were, of course, many points made about the agencies, and I would like to say a few words regarding the Food Safety Agency, in response to Mr Bové. The Commission regrets the appointment of Ms Diána Bánáti as an executive director of the International Life of Science Institute, as that position is clearly incompatible with her role at the EU Food Safety Agency. The Commission will decide with the Council on the next steps to be taken to replace Ms Bánáti.

For the future, I want to inform you that the interinstitutional working group on traditional agencies, in which Parliament is participating, has addressed the need to develop a consistent policy on preventing conflicts of interest for staff, advisers, experts and board members. This work has to be done in the working group and I hope it will produce an appropriate solution.

To conclude, I want to assure you that the Commission will address all other measures and actions included in the discharge resolution to be adopted today. Many of these measures have already been proposed in the review of the Financial Regulation and in the legal bases for the next financial framework.

The Commission will also invite all the other parties actively concerned to join our efforts and to share our objective of further improving the execution of the EU budget.

  Nicolai Wammen, formand for Rådet. − Hr. formand! Ærede medlemmer! Hr. kommissær! Lad mig her ved afslutningen af debatten slå fast, at det har været spændende, interessant og vigtigt at lytte til de mange indlæg fra parlamentets medlemmer. Det er mit håb, at vores to institutioner snart kan indgå en holdbar aftale om en moderniseret dechargeprocedure. Det er på høje tid, at vi i fællesskab finder en løsning.

Som jeg nævnte i mit indledende indlæg, så fremlagde Rådet allerede tilbage i marts 2011 et forslag til et "memorandum of understanding" for samarbejdet mellem Parlamentet og Rådet under den årlige dechargeprocedure. Dette memorandum indeholder konkrete forslag til, hvordan vi kan udveksle de nødvendige oplysninger og dokumenter på en måde, der respekterer vores institutioners respektive roller i proceduren. Lad mig derfor i dag slå fast, at Rådets forslag ikke er et ultimatum. Det er klart, at vi må have gang i forhandlingerne mellem vore institutioner for at nå en aftale, og jeg håber derfor, at Parlamentet snart vil kunne nedsætte en forhandlingsdelegation, så vi kan komme i gang med arbejdet. Vi må alle være vores ansvar bevidst og gøre vores til at finde en løsning. Det skylder vi ikke mindst de europæiske skatteydere, som har krav på, at vi i fællesskab finder en effektiv og holdbar måde at holde kontrol med vores institutioners udgifter.

Hr. formand, kære medlemmer! Tiden er ikke til kampe mellem institutioner, i stedet er tiden til samarbejde og til, at vi viser vores borgere, at vi kan indgå kompromiser og levere resultater. Jeg håber derfor, at vi i fællesskab meget snart vil kunne sætte os til forhandlingsbordet.

  Christofer Fjellner, rapporteur. − Mr President, I am sorry that I could not be here for the whole debate. I am very happy that the Danish Presidency is here – they are in other places as well having trialogues – but I have followed the debate extensively.

The problem here is shared management, and shared management is exactly the same as it was when I was a kid and my sister and I had the shared responsibility of cleaning the house. Nobody cleaned the house and then we stood there blaming each other. The problem is not all over the place. It is in structural funds and in all Member States. 60% of the errors come from three Member States: 31% from Spain, 18% from Italy and 10% from the UK. 58% of the errors could have been corrected by Member States, according to the Court of Auditors. I think it is high time that the Council debates this amongst themselves; it is your taxpayers, it is your money.

That does not mean that the Commission is without responsibility. They have the responsibility to control and sanction those who do not play by the rules. I ask myself: does the Commission not have the tools to do that? Or do you not use the tools that you have? My response has been that it is a combination. You lack some tools, but you do not use the tools which you have effectively enough. Therefore, we have a responsibility in the upcoming programming period to give you the tools which you need now when we are co-legislators. That goes for the Council as well. But we demand of you, as a part of this discharge procedure, to use the tools you have more effectively.

The reason that I decided to propose to grant discharge is because I heard your sincere wish to change the way you work with sanctions, suspensions and interruptions and that is the reason we give you discharge. If, next year, we do not see any change, then it is a whole new deal. However, I think that we are on the right track and I am happy that you have been listening to the recommendations we have given in our resolution. I think that it is a good basis for improving the situation for next year.

  Martin Ehrenhauser, Berichterstatter. − Herr Präsident! Die Agenturen waren ja ein sehr konfliktträchtiges Thema in dieser Aussprache, darum möchte ich vielleicht meine zweite Redezeit dafür nutzen, um kurz auf die Agenturen einzugehen.

Frau Haug hat recht, die Agenturen wurden in den letzten sieben Jahren und mehr sehr, sehr heftig kritisiert. Meines Erachtens nach aber zu Recht. Es gibt Doppelgleisigkeiten, es gibt fragwürdige Standortentscheidungen, es gibt Fragen in Bezug auf die primärrechtliche Grundlage, es gibt aufgeblasene Verwaltungsräte und und und. Also hier sind ganz dringend einige Fragen zu stellen. Das sind natürlich horizontale Fragen, das ist mir schon klar.

Aber jetzt sind neue Fragen aufgetaucht zu drei spezifischen Agenturen. Hier geht es um Interessenkonflikte, hier geht es um mehrere Interessenkonflikte, nicht bloß um einen. Hier geht es um offene Fragen in Bezug auf Ausschreibungsverfahren. Hier geht es um Fragen der Verschwendung von Steuergeld.

Natürlich ist es die Sache jedes einzelnen Abgeordneten, wie er diese Fälle beurteilt, ob er die Entlastung erteilt oder nicht. Aber ich möchte das Haus schon daran erinnern, dass wir vor kurzem sehr, sehr massive Korruptionsfälle hier in diesem Haus hatten und dass dieses Haus genau aus diesem Grund auch verpflichtet ist – es ist wirklich verpflichtet! –, sich ausreichend um Interessenskonflikte zu kümmern. Und ich möchte auch daran erinnern – auch vielleicht an die Adresse des Herrn Geier –, dass es heute bei der Entscheidung nicht darum geht, die Entlastung zu verweigern.

Es geht um den Aufschub der Entlastung. Es geht also um die Frage, haben wir noch länger Zeit, hat die Agentur noch länger Zeit, die offenen Fragen zu klären? Aus diesem Grunde bin ich sehr wohl der Meinung, dass hier jeder Abgeordnete die Pflicht hat, diesen längeren Zeitraum einzuräumen. Aus diesem Grunde möchte ich auch für Unterstützung für den Vorschlag von Frau Macovei werben. Ich finde ihre Arbeit ausgezeichnet und ich möchte ihr auch auf diesem Wege ein Kompliment dafür aussprechen.

  Jens Geier, Berichterstatter. − Herr Präsident! Lieber Martin, das fügt sich ja ganz schön, dass ich gleich auf deine Frage antworten kann.

Mir ist schon klar, dass es an diesem Punkt nicht um die Verweigerung der Entlastung geht. Aber wenn die Berichterstatterin zu der Entlastung der Agenturen Vorwürfe gegen die Agenturen erhebt, die zum Teil außerhalb der Verantwortung dieser Einrichtungen liegen, weil die Besetzung bestimmter Gremien, die du zu Recht als aufgeblasen dargestellt hast, in der Verantwortung der Mitgliedstaaten liegt, dann wird es im Oktober nur die Möglichkeit geben, die Entlastung zu verweigern, weil sich diese Situation nicht geändert haben wird, weil die Mitgliedstaaten ihr Verhalten gegenüber den Agenturen nicht geändert haben werden. Deswegen ist das politische Instrumentarium nicht das passende.

Die S&D-Fraktion ist nun wirklich die letzte, die Interessenkonflikte nicht ernst nehmen würde. Der von Kommissar Šemeta gerade angesprochene Fall ist ja einer, der sozusagen nochmals ein aktuelles Licht auf die Situation wirft. Aber das Problem ist mit dem Aufschub der Entlastung nicht gelöst. Ich habe im Ausschuss immer wieder dazu argumentiert, dass die Frage so gelöst werden muss, dass wir den Bericht des Europäischen Rechnungshofs, den uns Präsident Caldeira dankenswerterweise auch angekündigt hat, abwarten sollen, um dann auf der Basis einer vertieften Faktenlage zu Ergebnissen zu kommen, die wir dann auch seriös diskutieren können.

Ich bin dabei, Situationen anzuklagen, wie beispielsweise die auch von dir angesprochene Frage der Auswahl von Sitzen von Agenturen. Ich habe selber in einer Presseerklärung kritisiert, dass uns die britische Regierung dazu zwingt, eine Agentur in Canary Wharf anzusiedeln. Das ist der teuerste Immobilienmarkt, den die Europäische Union anzubieten hat. Das ist dieselbe Regierung, die der EU Einsparungsvorschläge macht. Die soll doch mal einfach bei ihren eigenen Entscheidungen anfangen.

Insofern gibt es in der Frage der Kritikwürdigkeit viel weniger Meinungsverschiedenheiten, als das vielleicht den Anschein hat. Es gibt Auseinandersetzungen in der Frage, was die politische Antwort darauf ist.

  Monica Luisa Macovei, rapporteur. − Mr President, I will try to answer and to sum up the debate. I would like to start by saying that the work has changed and we must follow these changes. Transparency and proper management of conflicts of interest has become vital for both governments and our citizens.

Secondly, conflicts of interest – I repeat what I said this morning – must be a criterion in the discharge procedure for all the EU institutions. I repeat that in particular for our Socialist colleagues. The discharge procedure is the place to evaluate conflicts of interest because, if they are not correctly managed, conflicts of interest can distort the allocation of public resources and human resources policies, and can lead to public funds being wasted. So, yes, this is the place to discuss it.

Once again we took this opportunity to call on the Council, the Commission and the Member States to revise the way they appoint members of the management boards of the agencies, as well as the directors. I am glad to hear from Commissioner Šemeta today that this will be taken into account and the policy revised. This will only help the agencies. I believe that the postponement will also help the agencies to finish the clearing, or at least to have in place, in an irreversible way, a structured policy against conflicts of interest.

I will not respond to the personal criticism from the Socialists. I would just like to say that I have not heard any concrete argument as to why discharge for the three agencies should not be postponed. Once again, this is nothing to do with the work of the agencies. This is not going against the agencies. Rather, it is to help the agencies, and also to increase people’s trust in the work of the agencies and of Parliament, to see that we take it seriously when we carry out the discharge. We do not put stamps on some other reports.

Finally, I am grateful to all of you for this debate and for the discussion we have had, including those who criticised my proposals. I am very glad that the conflict of interest issue was the subject of such a large debate. I am sure that this will continue.

  Vilija Blinkevičiūtė (S&D), raštu. Norėčiau kolegas paraginti balsuoti už biudžeto kontrolės komitete priimtą pranešimą dėl Europos lyčių lygybės instituto (angl. EIGE) 2010 m. biudžeto įvykdymo patvirtinimo. Taip pat norėčiau paraginti kolegas palaikyti socialdemokratų frakcijos vardu įregistruotą pakeitimą, kuriuo siūlome iš prie Parlamento sprendimo pridedamos rezoliucijos ištrinti siūlymą ateityje apsvarstyti Europos lyčių lygybės instituto ir Europos pagrindinių teisių agentūros sujungimą. Mieli kolegos, įvertinus šio instituto svarbą skatinant lyčių lygybės aspekto įgyvendinimą Europos Sąjungos bei jos šalių narių politikoje, taip pat pastangas siekiant užtikrinti lyčių lygybės įgyvendinimą valstybių narių darbo rinkose bei piliečių sąmoningumo udymmą šiuo klausimu, negalime balsuoti už šio instituto panaikinimą ateityje. Lyčių lygybė yra viena iš Europos Sąjungos pamatinių vertybių, dar kartą patvirtintų strategijoje „Europa 2020“ bei visuose šios strategijos įgyvendinimo dokumentuose. Progresyvus mąstymas mums turėtų neleisti net svarstyti tokios galimybės. EIGE įgaliojimai, palyginti su Europos pagrindinių teisių agentūra, yra unikalūs, nes jie yra susiję su moterų ir vyrų de facto lygybės kontrole, reiškiančia moterų ir vyrų praktinę lygybę visose gyvenimo srityse, įtvirtinamą pagal ES politiką. Dovolte, abych jako zpravodajka Výboru pro rozpočtovou kontrolu zdůraznila důležitost zprávy Evropského účetního dvora č. 7/2011 nazvané „Je agroenvironmentální podpora dobře nastavena a řízena?“ a našich doporučení (body 74–83), které obsahuje zpráva. Agroenvironmentální opatření jsou důležitou politikou EU a prostředky EU vyčleněné na tyto platby pro období 2007–13 činí 22,2 miliardy EUR. Od roku 2000 jsou agroenvironmentální platby součástí politiky rozvoje venkova EU, Komise sdílí řízení s členskými státy. Komise hodnotí a schvaluje programy rozvoje venkova, které členské státy vypracovávají a předkládají. Cílem plateb je motivovat zemědělce, aby používali metody slučitelné s ochranou a zlepšováním životního prostředí.

Dle Účetního dvora agroenvironmentální politika nebyla nastavena tak, aby přinášela konkrétní přínosy životnímu prostředí. Cíle agroenvironmentálních plateb nejsou natolik konkrétní, aby bylo možné posoudit jejich dosažení, uváděné problémy životního prostředí nepředstavují jednoznačné odůvodnění pro poskytnutí agroenvironmentálních plateb, plnění politiky není možné snadno monitorovat. Z toho pro členské státy plyne, aby stanovily jasně zacílené programy rozvoje venkova, pro Komisi, aby programy před schválením posuzovala přísněji. V této souvislosti s příštím programovým obdobím je nezbytné zacílit agroenvironmentální režimy na specifičtější priority. Agroenvironmentální platby mohou dosáhnout požadovaných účinků v oblasti biodiverzity, zachování a rozvoje systémů zemědělství a lesnictví s přírodní hodnotou, v oblasti ochrany vody a boje proti klimatickým změnám.

Wykonanie budżetu w 2010 r. stanowiło wyzwanie, gdyż był to pierwszy pełny rok obowiązywania nowego Statutu posła i Statutu asystenta wraz z szeregiem zmian w przepisach wykonawczych do obu statutów, stanowiących znaczne dodatkowe obciążenie dla administracji Parlamentu. Tym niemniej budżet PE został wykonany zgodnie z zasadami dobrego zarządzania finansowego, co potwierdziła ocena Trybunału Obrachunkowego, stwierdzająca brak poważnych uchybień przy ocenie zgodności systemu kontroli i nadzoru z rozporządzeniem finansowym.

W tym kontekście z zadowoleniem przyjmuję otwarcie w 2011 roku Centrum dla Odwiedzających, które odwiedziło już ponad 100 000 obywateli, sugerując jednocześnie przeprowadzenie analizy po 12 miesiącach jego działalności, tak by ocenić reakcję opinii publicznej, a także związane z nim koszty i korzyści z myślą o opłacalności tej inwestycji. Nie zgadzam się natomiast z krytyką skierowaną pod adresem EuroparlTV, którą osobiście postrzegam jako udane przedsięwzięcie, na ocenę którego należy jeszcze poczekać, z uwagi na trwającą wciąż fazę pilotażową projektu.

W kontekście udzielenia absolutorium za rok 2010, wielki niepokój budzą natomiast wydatki Parlamentu związane z utrzymaniem siedziby w Strasburgu, które wyniosły w 2010 r. - 51.500.000 EUR oraz koszty już poniesione i prognozowane na najbliższych 20 lat w odniesieniu do budynku KAD w Luksemburgu, przekraczające 800 000 euro.

  Rareş-Lucian Niculescu (PPE), în scris. Primul fapt care surprinde, chiar după o simplă consultare a ordinii de zi de astăzi, este numărul ridicol de mare al agenţiilor europene. Parlamentul are astăzi în faţă 43 de rapoarte de descarcare de gestiune, referitoare la tot atâtea instituții europene.

În aceasta perioadă, în care utilizarea înțeleaptă a banilor publici este esenţială, Parlamentul ar trebui să se aplece asupra unei analize riguroase cu privire la utilitatea şi necesitatea acestor agenții. Ideea comasării CEPOL si EUROPOL, de exemplu, este binevenită. Cred că şi alte soluţii asemănătoare ar putea fi identificate.

O astfel de analiză este cu atât mai necesară în condițiile suspiciunilor extrem de grave privind modul în care sunt cheltuiți banii publici în aceste agenții şi cu privire la posibilele conflicte de interese. Voi vota pentru amânarea descărcării de gestiune în cazul anumitor agenţii. Această măsură nu este o soluție pentru problemele menţionate, însă cred că poate reprezenta punctul de pornire a unei analize riguroase a modului de funcționare, a cheltuielilor şi a utilităţii agenţiilor, exagerat de numeroase la nivelul Uniunii Europene.

Norėčiau išreikšti nepritarimą siūlymui sujungti Europos lyčių lygybės institutą su Europos Sąjungos pagrindinių teisių agentūra, įtrauktą į 2010 m. biudžeto įvykdymo patvirtinimą. Toks siūlymas grindžiamas lėšų taupymu ir noru išvengti veiklos kartojimosi. Noriu atkreipti kolegų dėmesį, kad abiejų institucijų tikslai skiriasi. Šis institutas būtent ir buvo įsteigtas todėl, kad kai kurių su lyčių lygybe susijusių uždavinių tuo metu veikiančios institucijos nevykdė. Europos lyčių lygybės instituto uždaviniai yra išskirtiniai: tai ir mokslinių tyrimų duomenų, ir informacijos koordinavimas, centralizavimas ir platinimas, tinklų kūrimas, moterų ir vyrų lygybės matomumo didinimas ir kt. Institutas buvo įsteigtas tik 2007 m., darbuotojų įdarbinimas irgi baigėsi neseniai. Todėl, kai pagaliau institutas gali efektyviai vykdyti savo funkcijas, manau yra neracionalu ir nepagrįsta jį performuoti.
