  Juan Fernando López Aguilar, Autor. − Señora Presidenta, planteamos esta pregunta oral a partir de la Resolución del Parlamento Europeo, aprobada el 11 de septiembre de 2012, sobre los vuelos ilegales de la CIA y las detenciones, también ilegales, llevadas a cabo en territorio europeo, precisamente, para darle seguimiento al trabajo previo del Parlamento Europeo.

Y es por ello que tengo el honor de plantear esta pregunta oral, para empezar, a la Comisión, para conocer si se ha investigado plenamente la violación de la normativa comunitaria en materia de asilo y cooperación judicial, si se han adoptado medidas para evitar la eventual violación de los derechos fundamentales y reforzar la capacidad de la Unión Europea de responder ante ello; y para asegurar un control parlamentario y democrático de la actividad transfronteriza de los servicios de inteligencia, en el contexto, en particular, de las llamadas comisiones de inquiry, que han tenido lugar en el ámbito de la comisión LIBE sobre las detenciones de la CIA y las operaciones denominadas de mass surveillance. Porque, en democracia, no caben agujeros negros.

Pero también queremos plantear preguntas al Consejo, por supuesto, para saber si ha practicado el principio de lealtad institucional a la hora de suministrar las actas de algunas reuniones del grupo de trabajo en Consejos relevantes en este caso, que, de acuerdo con algunas informaciones, han sido retocadas; si conoce la actividad concreta de los Estados miembros y su disposición a clarificar con las agencias europeas de seguridad el conocimiento que puedan tener del papel desempeñado en estas operaciones de la CIA.

Y también, con base en estas actividades, tenemos la obligación de conocer cuáles son los países donde se han planteado con mayor intensidad estos problemas. Hemos desplazado una comisión a Lituania, el país que en estos momentos ostenta la presidencia rotatoria, pero ha habido alegaciones equivalentes en Rumanía, Polonia, Finlandia, Italia y Reino Unido. Por tanto, tenemos la obligación de conocer exactamente lo que se ha hecho, no solamente para aclarar las actuaciones de la CIA en esos territorios, sino para asegurar que no vuelva a suceder y para despejar también cualquier impresión de impunidad de estas actividades. Porque resulta inaceptable que esto haya podido tener lugar sin que tengamos una versión clara y convincente de qué sucedió, quién hizo qué, quién estaba al tanto de lo que estaba sucediendo y, sobre todo, qué podemos hacer para que no vuelva a pasar, porque las investigaciones actualmente en curso no parecen haber llegado a ningún buen puerto.

En definitiva, por eso presentamos una pregunta oral. Presentamos también una resolución y pedimos el apoyo de esta Cámara para enviar un mensaje: un mensaje contundente, un mensaje sólido al Consejo, a la Comisión y a los Estados miembros: que el Parlamento Europeo cumple con su responsabilidad dando seguimiento a esta cuestión.

  Elmar Brok, Verfasser. − Frau Präsidentin, Frau Vizepräsidentin, Herr amtierender Ratspräsident! In der Tat ist es so, dass nach dem 11. September vieles geschehen ist, was mit unseren normalen Regeln der Zusammenarbeit und der Wahrnehmung der Rechtsstaatlichkeit nicht hundertprozentig funktioniert hat. Wir müssen deutlich machen, dass das nicht wieder passiert. Wir müssen aber auch deutlich machen, dass es unter diesen Umständen geschehen ist. Und wir müssen ferner auch deutlich machen, dass wir Regelungen rechtsstaatlicher Art finden müssen, die uns auch gleichzeitig in die Lage versetzen, Terrorismus zu bekämpfen, und nicht sagen, dass das im Gegensatz zur Terrorismusbekämpfung steht. Wir müssen auch festhalten, dass nicht die Vereinigten Staaten unser Feind sind, und dürfen in solchen Debatten nicht diesen Eindruck entstehen lassen. Auch müssen wir deutlich machen, dass wir doch sehen müssen, dass auch in einer Rechtsstaatlichkeit, wie sie die USA ausmacht, diese Fragen ebenfalls kritisch in Gesellschaft und Politik erörtert werden. Ich sage das deshalb, damit hier nicht der Eindruck einer falschen Gewichtung entsteht. Ich hoffe, dass Rat und Kommission uns in diesen Fragen weiterhelfen können, dass diese beantwortet werden können.

Ich muss allerdings auch sagen, dass es in manchen Punkten schwierig ist, das wird hier in dem Entschließungstext deutlich. Die Worte „könnte“ und „to clarify“ kommen ziemlich häufig darin vor, was bedeutet, dass es auch uns nicht klar ist, ob da im Einzelfall wirklich etwas dran ist. Deswegen sollte man es auch als behauptete Dinge festlegen, wir sind da nicht immer sicher, dass in den einzelnen Fällen etwas da ist.

Aber ich möchte hier auch eine Verbindung herstellen – deswegen interessiert mich das besonders – mit der Diskussion, die wir gegenwärtig in der NSA-Frage haben. Ich möchte die Vizepräsidentin gerne darin unterstützen, dass wir in Fragen der Klärung der Rechte europäischer Bürger, ihrer Informations- und Klagerechte, beispielsweise in den Vereinigten Staaten, entscheidend vorankommen. Dies ist die Gelegenheit, nach vorne zu schauen, um Lösungen zu finden, dass wir im Bereich des Datenschutzes vorankommen, dass wir bei den rechtsstaatlichen Möglichkeiten vorankommen, sodass wir nach vorne konstruktive Lösungen finden, damit sich zu späteren Zeitpunkten solche Dinge, die dort offensichtlich oder angeblich passiert sind, nicht wieder ereignen können. Wir müssen auch Regeln finden, damit die Rechtsstaatlichkeit nicht bei der notwendigen Zusammenarbeit von Sicherheitsdiensten auf der Strecke bleibt. Das darf kein Gegensatz sein! Deswegen ist es notwendig, dass diese Zusammenhänge von uns deutlich dargestellt werden. Deswegen müssen wir das Datenschutzrahmenabkommen mit den Vereinigten Staaten, wo die Informations- und Klagerechte der europäischen Bürger geklärt sind, endlich zu Ende bringen!

All diese Fragen scheinen mir von großer Wichtigkeit zu sein, und wir müssen diese Verknüpfung herstellen, um auf diese Art und Weise für zukünftige Zeiten verstärkte rechtliche Lösungen zu finden. Deswegen sage ich, ich bin zwar Mitverfasser der Anfrage, aber nicht Mitverfasser der Entschließung, die ich aus den vorher genannten Gründen nicht voll mittragen kann.

Ich muss hier etwas ironisch sagen: Mein Land kommt ja wenigstens in der Entschließung gut weg. Darin wird nämlich gesagt, es habe einmal einen Brief beantwortet. Aber das war eine ironische Bemerkung.

  Vytautas Leškevičius, President-in-Office of the Council. − Madam President, Vice-President of the Commission, honourable Members, I am grateful for this opportunity to respond to the various issues raised in the question which has been tabled jointly by the Committee on Civil Liberties, Justice and Home Affairs and the Committee on Foreign Affairs.

It is important to begin by recalling the legal framework within which both our institutions function. The Treaties state clearly ‘national security remains the sole responsibility of each Member State’. This means that the work of intelligence agencies of Member States falls outside the remit of the European Union and its institutions. The investigation of the allegation of involvement in the CIA programme is therefore a matter for the Member States. The activities of national security and intelligence services cannot be addressed at EU level. That is the Treaty.

And this is why the Council has not been able to follow up on your resolution which was adopted in September 2012. It is simply not possible for the Council to issue declarations concerning the activities of the security services of the Member States, given that these fall outside its competence. For the same reason the Council has not held hearings with the relevant EU security agencies. As far as the issue of mutual legal assistance in this area is concerned, this would be a purely bilateral matter between the Member States involved. Furthermore, it is not within the competence of the Council to propose safeguards so as to guarantee respect for human rights in intelligence-sharing or to provide for any delimitation of roles between intelligence and law-enforcement activities.

You will appreciate that a legal constraint on the Council and indeed on all the EU institutions in relation to this issue means that the Council has not been able to initiate any measures to provide for a follow-up to the recommendation in your report from last year.

That does not mean that the Council has been silent. It has stated clearly on several occasions that the fight against terrorism has to take place in full respect for international law, including human rights law, international humanitarian law and refugee law.

It has been clear also that the existence of secret detention facilities where detained persons are kept in a legal vacuum is not in conformity with international law. We can only be successful in the fight against terrorism in the long term if we stay true to our core values. Any violations of human rights and the rule of law by government agencies in the fight against terrorism give rise to grievances and could actually encourage individuals to resort to terrorism.

Of course such circumstances can never justify or excuse any act of terrorism under any circumstances. The EU holds a regular dialogue with the US involving legal advisers on international law aspects of the fight against terrorism. This dialogue is an opportunity to address questions such as the arrest, detention, interrogation and transfer of terrorist suspects. It also enables the EU to underline the importance of respect for international law and human rights. However, it should be clear that the specific activities of intelligence services are not covered in this dialogue.

Summaries of these meetings have been made available to Parliament but full minutes have not been released, given the need to protect the confidential nature of the discussions. Diplomatic exchanges such as these are only valuable if the participants can express themselves openly and freely. On such sensitive issues quiet diplomacy is more beneficial than more public pronouncements.

The Council does not therefore accept that it has breached the principle of loyal cooperation as far as access to documents is concerned. It handles all requests in accordance with the existing rules and practices.

Each of us operates within a legal framework which we have to respect. Where we can make progress or take measures, we are ready to do so, as in the case of our dialogue with the US but, if we want to ensure that the principles which I have just outlined are respected, our best way of achieving that is through patient diplomacy and discreet pressure. That is the most effective way of achieving results.

  Viviane Reding, Vice-President of the Commission. − Mr President, practices referred to as ‘renditions’ constitute a serious violation of several fundamental rights. They involve unlawful arrest, arbitrary detention and very often torture or other ill-treatment, and we have already underlined several times in this Chamber that the fight against terrorism cannot justify such practices.

This has also been confirmed now by the Council Presidency, which has also underlined another fact: questions of national security are outside the remit of the European Union. The Treaty does not give the Commission any competence to lead investigations into such matters, which is why the Commission has always stressed that it is up to the Member States to conduct in-depth, independent and impartial investigation to establish the truth. This is a positive obligation which derives from the European Convention on Human Rights in order to establish responsibilities and enable the victims to obtain compensation for damage.

Today the European Parliament is again asking about the possible breach of EU provisions by those Member States that, seemingly, collaborated with the CIA programme. The questions refer mainly to judicial cooperation with the United States.

Let me now put the facts on the table. At the time of the execution of these CIA programmes – between 2001 and 2003 – there was no EU provision applicable to judicial cooperation between the EU and the USA. Only in October 2009 did the Council adopt a decision approving the conclusion of two agreements with the United States: one on extradition and one on mutual legal assistance. Both agreements entered into force on 1 January 2010, and both clarify and unify the legal framework of judicial cooperation in criminal matters with the United States from that moment on.

I would like once again to make a clear distinction between two necessities. First, the obligation to uncover the truth. This falls exclusively within the responsibility of the Member States. The Commission cannot directly coordinate or even facilitate national investigations in this field, because it has no power to set up meetings of prosecutors, for example, or of other national authorities in charge of the investigations. The Council is present at our discussions today, and it has already said very clearly what its responsibility in that matter is.

The second element – to avoid reiteration – is that the EU’s and the Member States’ actions against terrorism must always comply with fundamental rights standards. One of the key changes in the legal framework since the European Parliament’s first resolution has been the entry into force of the EU-US Agreement on Extradition and Judicial Cooperation in Criminal Matters. This agreement represents the key channels for law enforcement cooperation, and the Commission has to ensure that this instrument, as well as all other relevant EU legislation against terrorism, is implemented and applied in a manner fully compatible with the Charter of Fundamental Rights.

On this basis, Commissioner Malmström and myself sent a letter on 5 March 2013 to the Ministers of the Interior and the Ministers of Justice of all Member States to stress the importance of using all relevant EU instruments in the fight against terrorism and to recall that these instruments must be implemented and applied in a manner fully compatible with the Charter.

Only six Member States have replied so far. The European Commission services reminded the other Member States about the letters in July, and the European Commission will continue to urge Member States to answer, as we have no intention of neglecting this important challenge for the future of judicial cooperation in criminal matters.

  Carlos Coelho, em nome do Grupo PPE. – Senhor Presidente, Senhor Presidente em exercício do Conselho, Senhora Vice-Presidente Reding, Senhoras e Senhores Deputados, porque os fins não justificam os meios, condenámos, firmemente, estas práticas abusivas e ilegais na luta contra o terrorismo, incluindo as extraordinary renditions, o sequestro, a detenção sem julgamento, os desaparecimentos, as prisões secretas e a tortura.

Exigimos investigações completas sobre o envolvimento cúmplice de alguns Estados-Membros com autoridades americanas.

Decidimos fazer um acompanhamento político, e o controlo dos desenvolvimentos registados, com base nas recomendações que aprovámos em Plenário.

Registamos, infelizmente, a falta de empenhamento de alguns Estados-Membros em investigar o envolvimento europeu no programa da CIA. É lamentável o atraso que continua a existir na realização de inquéritos independentes e efetivos que permitam recolher provas concretas e fornecer um esclarecimento completo e apurar responsabilidades pelas violações dos direitos humanos cometidas ao abrigo desse programa, de forma a se poder proceder à reparação e indemnização das vítimas, como disse a Vice-Presidente Reding, e a garantir que os mesmos acontecimentos não se repitam no futuro.

Considero, porém, que as investigações levadas a cabo pelos Estados-Membros têm de se basear em provas sólidas e no respeito pelos sistemas judiciais nacionais e pela legislação da União Europeia.

O Conselho devia fazer um esforço para limpar a má imagem com que este Parlamento e os cidadãos ficaram da sua atuação durante este processo, começando por mostrar um papel mais ativo no apoio à descoberta da verdade e no trabalho de apuramento da responsabilidade dos Estados-Membros e garantindo que não voltará a mentir ao Parlamento, como o fez no passado.

O Partido Popular Europeu reafirma o seu compromisso com os valores do Estado de direito e com a defesa e proteção dos direitos fundamentais da pessoa humana.

Quer deixar bem claro que o voto diferente que a maior parte dos membros desta bancada irá fazer em diversos pontos da resolução têm a ver com discordâncias face ao texto e não face aos princípios que partilhamos.

  Tanja Fajon, v imenu skupine S&D. – Pred letom dni smo v resoluciji od evropskih vlad zahtevali odgovore v zvezi z domnevnimi pridržanji ameriških zapornikov v okviru tajnega programa CIA in grobim ravnanjem z njimi. Resnici še do danes nismo prišli do dna, saj niti ena država niti Evropska komisija niti Svet niso zares sledili pozivom te hiše.

Še vedno nihče ni prevzel odgovornosti za te sramotne in najbolj hude kršitve človekovih pravic v povojni evropski zgodovini. Vlade se izogibajo sodelovanju. Ni neodvisnih preiskav, medtem ko na dan prihajajo nova dejstva. Že leta v Parlamentu opozarjamo, da Evropa ne sme pomesti lastnih napak pod preprogo.

To se nam je in nam se spet dogaja v novi človeški tragediji pred otokom Lampedusa, kjer je po zadnjih podatkih umrlo skoraj 300 beguncev iz Sirije. Evropa mora biti vzor varovanja človekovih pravic. Evropejci vztrajamo, da smo najbolj moderen del sveta, ampak s tako ignoranco, ko pred očmi dopuščamo tako hude kršitve, izgubljamo ugled, verodostojnost, posebej naših državljanov.

In kako lahko to potem zahtevamo od drugih. Koliko nedolžnih oseb mora še umreti, koliko življenj moramo še izgubiti, da se bo Evropa zbudila, da bo prevzela odgovornost. Danes po letu dni ponovno zgolj govorimo tu, v hramu demokracije, o strogem posegu v suverenost držav, o kršitvah človekovih pravic in svoboščin, med katere sodijo pridržanja ameriških zapornikov, mučenje in druge oblike grdega ravnanja, kršitve načela nevračanja ter prisilno izginotje posameznikov.

Na plan vsak dan prihajajo nova odkritja in dejstva, ki potrjujejo, da so evropske vlade sodelovale z Združenimi državami in agencijo CIA v skrivnih programih. V resoluciji zato jasno pozivamo predsedujočo državo Svetu – Litvo –, naj razpravo o domnevni evropski odgovornosti za te hude kršitve uvrsti na dnevni red zasedanja pristojnih ministrov.

Z razočaranjem ugotavljamo, da še vedno osem držav Unije ni odgovorilo na pismo Združenih narodov o skrivnih zaporih-programih v luči boja proti terorizmu. Poseganje tujih varnostno-obveščevalnih služb v zadeve suverenih držav članic Unije se ne sme ponoviti, čeprav smo na žalost priča, da temu še zdaleč ni tako.

Afere prism, NSA, prisluškovanja globoko načenjajo zaupanje in potrpljenje Evropejcev. Tako kot evropske vlade tudi Komisija ni v zadovoljivi meri odgovorila na našo resolucijo izpred leta dni o domnevnih kršitvah človekovih pravic na evropskih tleh.

Pričakujem zato dragi kolegi, spoštovana komisarka, predstavnik Sveta, da bomo jutri v Evropskem parlamentu resolucijo odločno podprli, saj imamo dolžnost, da kot glas ljudstva na te kršitve in nepravilnosti vseskozi opozarjamo. To je naša skupna evropska odgovornost.

  Krzysztof Lisek (PPE), pytanie zadane przez podniesienie niebieskiej kartki. – Panie Przewodniczący! Szanowna pani komisarz! Szanowna pani poseł! Bardzo cenię panią poseł, ale chciałbym zapytać, czy przeczytała pani dokładnie tytuł naszej debaty? W tytule debaty jest mowa o rzekomych transportach i przetrzymywaniach. Nie zakończyło się żadne śledztwo w żadnym z państw. Śledztwa trwają. Więc chciałbym zapytać, czy nie uważa pani, że byłoby jednak bardziej odpowiedzialne mówienie, że są to rzekome transporty, domniemane przetrzymywania, a nie stwierdzanie faktów, które nie zostały udowodnione przez system prawny żadnego z państw Unii.

  Tanja Fajon (S&D), Odgovor na vprašanje, postavljeno z dvigom modrega kartončka. – Strinjam se z vami, da je naslov te resolucije domnevna pridržanja in prevozi. Ampak dejstvo je, da praktično vsak dan oziroma vsak mesec preko medijev, preko organizacij na dan prihajajo nova dejstva. Dejstvo je tudi, da nobena institucija, kot tudi ne evropske vlade, v resnici niso odgovorile na naše pozive izpred leta dni.

Da veliko preiskav je bilo zaustavljenih ali se ne nadaljuje, med drugim tudi v predsedujoči državi Litvi. Tako da jaz mislim, da do zdaj nihče resnici dejansko ni prišel do dna in da je naša odgovornost, da na te grobe kršitve vsakič znova opozarjamo.

  Sarah Ludford, on behalf of the ALDE Group. – Mr President, this resolution does two things: it repeats our decade-long criticism of the US-led extraordinary rendition programme of kidnapping, secret and illegal imprisonment and torture, and European countries’ complicity in that programme. It was in fact ten years ago last month that I organised the first hearing in the European Parliament on Guantánamo – plus ça change.

I will come back to the defective legal thinking which underpinned the wrong path that the US and the European allies took. But just for a moment I want to focus on the second thing the resolution does, which is to demand accountability at national level, including my country the UK, and to call for the EU institutions – the Commission and Council – to assist in that process by monitoring and supporting national accountability exercises.

No, Minister – if I may say so to the Lithuanian Presidency – this does not fall outside the remit of the EU or the Council. Why else do we have human rights clauses in EU Treaties or the Charter? What is the point of declarations that counter-terrorism operations must respect human rights and humanitarian law, when you will not follow up – nationally or at European level – on a huge body of evidence? It is almost time to drop the ‘alleged’ because there is so much evidence that these laws have been breached – our own and international laws.

Getting back to the international legal framework, the fact is that, with its war on terror, the US has tried to subvert these long-standing international norms. Under President Obama, the terminology has shifted from ‘war on terror’ just to ‘war’. The fact is that the US still asserts an exclusive right to define the war and to make up its rules. It is under the global war paradigm that the US last weekend snatched Abu Anas al-Libi off the streets of Tripoli. It is under the same pretext that drone strikes are used for so-called targeted killings. Indeed, Guantánamo is still open, and contains people who have never been charged, let alone tried.

Even if EU institutions will not help call Member States to account for torture and disappearances, they should take the lead in asserting the true nature and proper application of international law. As Vice-Chair of Parliament’s Delegation for relations with the United States I want the best for America. When your best friend goes off the rails you try to pull them back on, not push them further off. MEPs are trying to do that; the Commission and Council are not.

  Hélène Flautre, au nom du groupe Verts/ALE. – Monsieur le Président, comme cela a été rappelé, nous avons adopté, il y a un an maintenant, un rapport qui faisait suite, d'ailleurs, au long travail fastidieux et très consistant mené sous l'autorité de M. Coelho dans cette commission d'enquête. Ce rapport a été adopté, il y a un an, à une large majorité et, personnellement, je souhaite que ce large consensus pour la justice et pour la vérité se retrouve demain lors du vote de notre résolution.

Depuis un an, cette résolution fait le point sur les actes et les faits qui se sont déroulés. Je dirai à notre collègue polonais que, par exemple, depuis un an, nous avons eu la décision de la Cour européenne des droits de l'homme concernant la Macédoine dans l'affaire El-Masri, c'était en décembre dernier; que la Finlande a lancé une enquête à travers son médiateur, c'était en novembre de l'année dernière; que des condamnations d'officiels des services secrets militaires italiens et d'officiels américains de la CIA ont eu lieu en Italie. Ces enquêtes sont terminées.

Nous avons également de nouvelles victimes qui réclament justice auprès de la Lituanie, c'était en septembre dernier, le mois dernier. En Pologne, en juin dernier, une victime a plaidé sa cause et la reconnaissance de son statut de victime en Pologne. Chaque jour et chaque mois apportent son lot d'informations. Je crois vraiment qu'il serait vain que les États membres se recroquevillent et mettent la tête dans le sable en espérant finalement que tout cela finira dans les limbes de l'histoire et que nous ne saurons jamais la vérité.

Beaucoup de personnes travaillent et beaucoup de cas sont aujourd'hui devant la Cour européenne des droits de l'homme. Vous incarnez, Monsieur, la Présidence du Conseil. Vous êtes Lituanien, et votre pays a toujours soutenu, toujours dit, qu'il rouvrirait une enquête, qu'il était disponible pour le faire, si de nouveaux faits lui étaient présentés. Ces nouveaux faits existent, et je vous demande de bien vouloir assumer cette responsabilité de créer un cadre européen pour soutenir les enquêtes dans les États membres, pour que, enfin, les citoyens européens puissent être assurés que les politiques qui sont menées au nom de leur sécurité se font dans le plein respect des droits de l'homme.

  Timothy Kirkhope, on behalf of the ECR Group. – Mr President, of course the accusations levelled at Member States cannot be ignored. They must be treated with the full seriousness they deserve. Torture and inhumane treatment are not, and can never be, the tools on which we can build and preserve a strong and free society.

My own country, the United Kingdom, is one of the countries against whom these allegations have been levelled, a country whose long-established principles are freedom and fairness under the rule of law. I welcome the opportunity of an investigation in order to reinstate the reputation of our security services, which is currently tarnished. However, such an investigation must be carried out by an established process – a judicial inquiry if necessary – which is fully independent and held and investigated at Member State level.

But I do not believe it is for this Parliament to set demands on how these inquiries are conducted. Unfortunately, here, accusations are too often treated like facts and recommendations are treated like condemnations. This must stop, if the credibility of this place is to be preserved. Once again, this Parliament wishes the European Union to play a bigger role in the oversight of the intelligence community as a whole, but I would question: why? How would it carry out such a role in a sensible, credible and rational way? I have no idea, and nor do others who apply objectivity and fairness to this issue.

  Marie-Christine Vergiat, au nom du groupe GUE/NGL. – Monsieur le Président, il y a un peu plus d'un an, effectivement, nous adoptions un texte sur les activités illégales de la CIA sur le territoire de l'Union européenne. Il a constitué un jalon crucial dans la détermination des responsabilités dans ce fameux et sinistre programme de la CIA sur notre territoire. Il contenait des recommandations claires et concrètes.

Un an après ce vote et de nombreux rapports, entre autres, du Conseil de l'Europe, il était donc important de faire le point, et je voudrais remercier, à mon tour, Hélène Flautre pour sa ténacité.

Où en sommes-nous? Au point mort ou presque. La plupart des recommandations n'ont pas été suivies; même les enquêtes judiciaires, pourtant lacunaires pour la plupart, n'ont quasiment pas progressé. Oui, pourtant, de nouvelles informations viennent sans cesse étayer les faits. J'appelle cela des dysfonctionnements judiciaires dix ans après les faits. Cette inertie est purement scandaleuse. Certains, ici, veulent même revenir en arrière et se contenter de généraliser. Les raisons m'échappent.

Notre ligne de conduite pour la résolution qui sera soumise au vote de demain sera la même qu'en 2012: nous en tenir aux faits pour que chacun prenne ses responsabilités et que les victimes – vous l'avez dit, Madame la Commissaire – obtiennent enfin réparation.

Les violations des droits de l'homme sont toujours intolérables, y compris et notamment quand ce sont les États qui sont en cause. Monsieur le Ministre, s'il vous plaît, considérons-nous majoritairement dans cette enceinte que le respect des citoyens, des droits des citoyens nous concerne? Alors pitié! Cessez de vous cacher derrière vos compétences pour refuser de répondre aux questions.

La lutte contre le terrorisme ne doit effectivement jamais justifier certaines libertés prises avec les droits de l'homme. Il y a besoin de vérité et de justice et, s'il y a des dérapages, ils doivent être reconnus et sanctionnés afin d'éviter les répétitions de tels actes. Dix ans après les faits, il serait temps!

  Gerard Batten, on behalf of the EFD Group. – Mr President, if people have been illegally transported across European borders by the CIA, then that is wrong. Every criminal suspect is entitled to open justice and a fair trial. However, this oral question is not about that. It is about asking the Commission to introduce more measures to bring national security services under its control. The public can read more about this plan in the Commission’s own document entitled ‘European Security Strategy: A secure Europe in a better world’, published as part of the Stockholm programme.

These proposals are just another step along the road to creating a United States of Europe. Just as the EU now has its own foreign policy and is taking control of Member States’ armed forces, so it needs control of their security services to complete the picture. The EU does not yet have the power to do that and we must ensure that it never does.

  Γεώργιος Παπανικολάου (PPE). - Κύριε Πρόεδρε, κάνοντας μια σύντομη αναδρομή, θα έλεγα ότι, πέντε χρόνια πριν, όταν ξεκίνησε η συζήτηση στο Κοινοβούλιό μας (ορισμένοι εξ ημών δεν ήμασταν καν εκλεγμένοι ευρωβουλευτές), εκπονήθηκε μία έκθεση η οποία, βάσει των τότε στοιχείων και των εκατέρωθεν καταγγελιών, κατέληγε σε ένα κείμενο που δεν έτυχε ομόφωνης έγκρισης, διότι κάποιες κατηγορίες και δηλώσεις, θεωρήθηκαν τότε ως ανακριβείς και ως πολιτικά υποκινούμενες.

Τα αναφέρω αυτά, ορισμένα χρόνια μετά, για να διευκρινίσω, θέλω να πιστεύω εκ μέρους όλων μας, ότι είμαστε υπέρ της προστασίας και του σεβασμού των ανθρωπίνων δικαιωμάτων. Και είμαστε, σε κάθε περίπτωση, ξεκάθαροι σ’ αυτό: όλοι είμαστε κατά της παράνομης κράτησης συνανθρώπων μας και οφείλουμε να σεβόμαστε τους νόμους και τις Συνθήκες και, βέβαια, κάθε παραβίαση της Συνθήκης για τα Ανθρώπινα Δικαιώματα είναι απαράδεκτη και καταδικαστέα.

Αυτά είναι πλέον σαφή και για τον λόγο αυτό, όταν πέρσι, για πρώτη φορά, ήρθα σε επαφή με το θέμα αυτό στο Κοινοβούλιο, ψήφισα υπέρ της έκθεσης Flautre και πολύ ευχαρίστως θα υπερψήφιζα εκ νέου ένα τέτοιο κείμενο. Όμως, έναν χρόνο μετά, χωρίς να έχουν προκύψει πολλά νέα δεδομένα, βρισκόμαστε ενώπιον ενός ψηφίσματος, το οποίο έρχεται αύριο προς ψήφιση, και το οποίο περιλαμβάνει κατηγορίες που είναι αναπόδεικτες καταδεικνύοντας ονομαστικά συγκεκριμένα κράτη μέλη χωρίς όμως να προκύπτουν απτά στοιχεία.

Δεν μπορούμε να κάνουμε αναφορές με όρους επικοινωνίας ή με όρους πληροφοριών που προέρχονται από τα μέσα μαζικής ενημέρωσης. Χρειάζεται διερεύνηση, χρειάζεται εξακρίβωση και νομική διαδικασία όπως αυτή ορίζεται σε κάθε κράτος μέλος.

Κλείνοντας λοιπόν επαναλαμβάνω: είμαστε σαφώς υπέρ του απόλυτου σεβασμού των ανθρωπίνων δικαιωμάτων, αλλά, προσωπικά, είμαι πολύ επιφυλακτικός όσον αφορά το αυριανό ψήφισμα το οποίο περιλαμβάνει ανακρίβειες και κατονομάζει, ψευδώς σε πολλές περιπτώσεις από όσο είμαι σε θέση να γνωρίζω, μεμονωμένα κράτη μέλη.

  Ana Gomes (S&D). - Agradeço a Hélène Flautre o trabalho que nos conduziu a esta resolução pela qual constatamos que governos de Estados-Membros e países candidatos, a Comissão e o Conselho e as autoridades dos Estados Unidos continuam a não dar resposta aos pedidos de aplicação das recomendações anteriores deste Parlamento sobre as graves violações dos direitos humanos infligidas às vítimas dos programas de rendition da CIA, com sequestro, tortura e cárcere em Guantánamo e prisões secretas.

No quadro desta investigação do Parlamento, eu própria dirigi novos pedidos de clarificação sobre 27 aviões que identifiquei em território português entre setembro de 2001 e agosto de 2006. A carta que mandei em outubro de 2011 ao atual governo português continua, displicentemente, sem resposta.

Isto acontece não obstante decisões de tribunais europeus e nacionais e novos relatórios de ONG confirmarem a cumplicidade de autoridades europeias nessas grosseiras violações dos direitos humanos e o encobrimento, obviamente, constitui em si um crime.

A impunidade dos criminosos responsáveis por estes programas tem encorajado a violação de direitos fundamentais nas políticas de contraterrorismo da União Europeia e dos Estados Unidos da América, como revelam os programas PRISM da Agência Nacional de Segurança americana e a Operation Socialist da agência britânica GCHQ sobre a empresa Belgacom.

A pretexto de combater o terrorismo que, de facto, não se combate - até se lhe doa a mão de empréstimo - com os métodos obscenos e criminosos, esta criminalidade organizada e impune passa a espionagem industrial e política, com apropriação de dados pessoais e violação da privacidade.

Desta forma, agências de inteligência americanas e os seus congéneres europeus são expostos aos olhos dos cidadãos como antros de criminalidade, provedores de insegurança individual e coletiva.

E a competência nacional pela segurança, a que se referia o representante do Conselho, é uma monumental balela! Esta ultrapassagem da imaginação orwelliana estaria impedida se se exercesse o controlo parlamentar, que falhou miseravelmente nos Estados Unidos, onde o Congresso tem poderes que não exerceu. E que falha na Europa porque os Parlamentos nacionais também não exercem as suas competências e porque este Parlamento ainda não as tem.

Quanto mais tempo isto persistir, mais continuaremos a falhar aos nossos cidadãos e às nossas democracias. E mais nos confrontaremos com graves desconfianças e tensões na relação transatlântica como as que, neste momento, exigem a suspensão dos Acordos Safe Harbour, SWIFT e PNR.

  Mirosław Piotrowski (ECR). - Panie Przewodniczący! Zarówno w dzisiejszym pytaniu ustnym jak i w proponowanych rezolucjach w sprawie rzekomych więzień CIA w Europie Parlament troszczy się o zagwarantowanie poszanowania praw człowieka. W pytaniu wzywa się Radę, żeby zareagowała tak, aby agencje wywiadowcze nie otrzymywały zezwolenia do przyjmowania uprawnień do aresztowania i zatrzymywania. Rada – jak słyszeliśmy – nie posiada w tym względzie żadnych kompetencji. Wszyscy w tej Izbie opowiadają się za poszanowaniem praw człowieka.

W proponowanej przez EKR odrębnej, najkrótszej i najlepszej rezolucji w punkcie pierwszym stwierdzamy, że skuteczne środki antyterrorystyczne i poszanowanie praw człowieka nie stanowią sprzeczności. Jeżeli instrumentalnie będziemy wtrącać się do sposobu działań operacyjnych względem terrorystów, to ja chciałbym oficjalnie zapytać, jakie praktyczne efekty wynikły z aktywności unijnych instytucji w walce z terroryzmem? Czy ciągle zadawalamy się stawianiem pytań i uchwalaniem kolejnych rezolucji?

  Jacek Protasiewicz (PPE). - Panie Przewodniczący! Pani Komisarz! Nie ulega wątpliwości, że ewentualne przypadki naruszenia prawa, o ile miały miejsce, przy okazji wojny z terroryzmem powinny być wyjaśniane. Obserwując to, co dzieje się w państwach w tej wojnie uczestniczących, zarówno tych z naszego kontynentu, ale też i w USA, można stwierdzić, że przed sądami toczą się dochodzenia, zapadają wyroki i, o ile organy ścigania były w stanie udokumentować zarzuty i postawić w stan oskarżenia czy to żołnierzy, czy agentów, wyroki te zapadają nawet bardzo surowe. Jestem przekonany, że podobnie będzie w sprawie domniemanych tajnych więzień na terenie państw Unii Europejskiej.

Chciałbym wyraźnie zaznaczyć, że w Polsce, kraju wymienianym w rezolucji, trwa postępowanie prowadzone przez niezależną od rządu prokuraturę, która działa wedle własnego planu śledztwa i, jestem o tym przekonany, z dobrą wolą wyjaśnienia ewentualnych zarzutów i podejrzeń. Nie jest to postępowanie łatwe, co trzeba wyraźnie zaznaczyć. Wiele kwestii podlega klauzuli tajności, a wiele dowodów znajduje się poza terenem Rzeczpospolitej Polskiej. Zarzuty braku przejrzystości formułowane przez autorów rezolucji są w tym kontekście, moim zdaniem, niezrozumiałe. Myślę, że ocenianie działań organów sprawiedliwości poszczególnych państw członkowskich zawarte w tekście rezolucji jest wątpliwej natury. Kwestie te należą, o czym mówił przedstawiciel Rady, do kompetencji wyłącznej rządów narodowych. Jeśli nie dokonamy poprawek w tekście rezolucji polegających na wycofaniu bezpośrednich odniesień do działań organów wymiaru sprawiedliwości, sądów i prokuratur państw członkowskich, obawiam się, że ani ja, ani koledzy z mojej delegacji nie będziemy w stanie poprzeć tej rezolucji.

  Jacek Protasiewicz (PPE), odpowiedź na pytanie zadane przez podniesienie niebieskiej kartki. – Brałem udział w wysłuchaniach, które miały miejsce kilka lat temu w Komisji Wolności Obywatelskich, Sprawiedliwości i Spraw Wewnętrznych, gdzie rzeczywiście bardzo szczegółowo analizowano sytuację w poszczególnych krajach. Jeśli chodzi akurat o Polskę, to nawet niezależni eksperci i obserwatorzy przyznawali, że jest to kraj, którego prokuratura działa z wolą wyjaśnienia kwestii. Nawet jeśli pojawiały się – bo rzeczywiście były formułowane w imieniu domniemanie poszkodowanych osób przez ich obrońców czy nawet przez przedstawicieli niezależnych organizacji – zarzuty dotyczące przejrzystości, to chciałbym tylko przypomnieć jedną rzecz: mamy do czynienia ze śledztwem, które dotyka materii objętej klauzulą tajności, a więc domaganie się pełnej jawności niestety nie może być często spełnione, nie z powodu braku woli, tylko z powodu przepisów, jakie w tej kwestii obowiązują.

  Oldřich Vlasák (ECR). - Vážený pane předsedající, dodržování lidských práv je zásadním principem, o který se opírá evropská společnost. Jako politik, který si velmi dobře pamatuje období komunistické totality, moc dobře vím, jak mohou být lidská práva ignorována, pošlapávána a omezována.

Základním lidským právem je právo na život a bezpečí. Útok na Světové obchodní centrum v New Yorku, bombové atentáty na indonéském ostrově Bali, bombová agrese v Madridu anebo teroristické útoky v Londýně, to jsou jen vybrané ukázky, kdy došlo k pošlapávání základních lidských práv. Pokud někdo ohrožuje životy a bezpečí druhých, nesmí se divit, že se s ním nejedná v rukavičkách. Nebýt amerických výzvědných služeb, nikdy by mnozí pachatelé nebyli dopadeni a řada dalších lidí by přišla o život.

Přiznejme si, že Evropský parlament hraje v boji proti terorismu nulovou roli. Nerozumím proto postoji některých kolegů, kteří se snaží házet našim americkým spojencům klacky pod nohy a interpelují v tomto ohledu členské státy či Komisi.

V tomto ohledu je nominace přeběhlého špióna Edwarda Snowdena, obviněného z krádeže vládního majetku a vědomého vyzrazení tajných informací, na Sacharovovu cenu za svobodu myšlení jenom dalším plivnutím partnerovi do tváře.

  Axel Voss (PPE). - Herr Präsident, liebe Kolleginnen und Kollegen! Die Einhaltung von Grundrechten und Menschenrechten ist natürlich eines der Schlüsselelemente der Politik der Europäischen Union. Deshalb liegt es auch auf der Hand, alles Notwendige dafür zu tun, dass sie eingehalten werden, und dass wir dort aktiv werden, wo diese missachtet werden.

Doch wir müssen uns fragen: Was ist eigentlich der heutige Mehrwert dieser Entschließung, über die wir morgen abstimmen wollen? Wir haben bereits 2012 über diesen Sachverhalt abgestimmt – über den Initiativbericht unserer Kollegen Frau Flautre. Er war sachlich ausgewogen, er war akzeptabel, und es ist auch richtig, dass wir die Kommission oder eben auch den Rat fragen, was eigentlich daraus geworden ist und wie wir damit weiter umgehen. Es ist auch richtig, diese Sache wieder in Erinnerung zu rufen.

Aber es ist meines Erachtens nicht richtig, dass wir uns erneut mit den gleichen inhaltlichen Dingen beschäftigen. Wenn wir einfach nur das wiederholen, was wir letztes Jahr schon einmal gemacht haben, dann ist das eine Selbstbeschäftigung. Und ich muss mich fragen, warum dieser Tagesordnungspunkt eigentlich auf der Tagesordnung steht, wenn wir nicht einfach nur die Fragen an Rat und Kommission haben.

Zudem geht diese Entschließung natürlich auch noch über das hinaus, was wir 2012 bereits beschlossen haben. Die in dem Text dargelegten Forderungen überschreiten schlichtweg einerseits die Zuständigkeiten, andererseits auch die Möglichkeiten, die wir als EU überhaupt haben. Das sollten wir einhalten. Daher wäre es eigentlich richtiger gewesen, sich auf Fakten zu stützen, auf Neuerungen, auf adäquate Lösungen!

  Csaba Sógor (PPE). - A titkosszolgálati együttműködések légyege, hogy a biztonságunk érdekében fedett, titkos, több állam részvételével zajló összehangolt akciókat hajtsanak végre. Azt gondolom, senki sem kérdőjelezi meg, hogy a terrorizmus elleni fellépés során szükség van a titkosszolgálatok tevékenységére, a köztük levő együttműködésre, a szövetséges szolgálatokkal való közös cselekvésre. Itt azonban arról beszélünk, hogy európai államok területén olyan gyakorlatot folytattak, amelyek szöges ellentétben állnak azzal az emberi jogi rendszerrel, amelyet évtizedek alatt alakítottunk ki, és amelyre méltán vagyunk büszkék. Sokszor elmondottam már: ha mi nem vesszük komolyan a saját szabályainkat, akkor hogyan kérjük ezt számon a világ más pontjain? Ennek az ügynek szimbolikus jelentősége van. Megtörténhet az Európai Unióban az, hogy következmények nélkül marad nemzetközi egyezmények sorának megsértése, amelyre ráadásul állami szervek tudtával került sor? Azt gondolom, hogy a legalapvetőbb elvárás az, hogy az európai polgárok tisztán lássanak az ügyben.

  Krisztina Morvai (NI), Kékkártyás kérdés. – Teljesen egyetértettem Sógor képviselőtársammal és szeretném megkérdezni, hogy egyetértünk-e abban is, hogy ezeknek a durva jogsértéseknek a kivizsgálásában, legyen az akár az USA által telepített CIA-börtönök, akár a prizma, illetőleg egyéb jogsértések. A nemzeti kormányoknak nagy szerepet kell vállalni, és egyetértek Sógor képviselőtársammal abban, hogy saját országunknak, a magyar kormánynak is komoly szerepet kell vállalnia Snowden-ügy, illetőleg a CIA börtönökkel kapcsolatos állítások alapos kivizsgálásában és elítélésében.

  Csaba Sógor (PPE), Kékkártyás válasz. – Nyilvánvaló, hogy egyetértek azzal – a kérdésre megpróbálok válaszolni –, hogy tagállami feladat a kivizsgálás. Hagyjuk, nem sorolom most föl az érintett országokat, hogy az ottani kivizsgálás megtörténjen. Egyebekben nem igazán tudom, hogy mit válaszoljak, legyen a Snowden-ügy vagy a CIA-ügy, nyilvánvaló, hogy elsősorban tagállami hatáskör. Segíteni kell, ha nem boldogulnak. Egyébként országainkról annyit, hogy ugye Románia is érintve van, én onnan érkezem, úgyhogy én nem tudok beleszólni a magyarországi kérdésbe.

  Jarosław Leszek Wałęsa (PPE). - Panie Przewodniczący! Zaproponowany projekt rezolucji zawiera kilka elementów, które są dla mnie nie do przyjęcia. Za szczególnie naganne uważam insynuacje o rzekomym braku przejrzystości polskiego śledztwa w tej sprawie. Po pierwsze, chciałbym przypomnieć, że kwestie dotyczące bezpieczeństwa narodowego oraz działania służb specjalnych leżą w wyłącznej kompetencji państw członkowskich. Ponadto podkreślam, że niezawisły i działający w oparciu o literę prawa wymiar sprawiedliwości w Polsce prowadzi w tej sprawie niezależne dochodzenie. Dlatego naciski polityczne w tej sprawie są niedopuszczalne. Dochodzenie trwa, a jego zakończenie uzależnione jest nie tylko od sprawności polskiej prokuratury, ale przede wszystkim od faktu, że przeprowadzenie dochodzenia dowodowego jest utrudnione w związku z tym, że większość dokumentów jest w posiadaniu USA i często jest objęta klauzulą tajności.

Chociaż doceniam podstawy i znaczenie tej debaty, muszę wyraźnie podkreślić, że ochrona obywateli jest naszą najwyższą odpowiedzialnością. Podczas debaty często zapominamy, że terroryzm jest aktualnie największym zagrożeniem dla bezpieczeństwa obywateli w Unii Europejskiej i dlatego musimy robić wszystko, co w naszej mocy, w obronie wolności i naszych wartości. Niewinni obywatele stają się celami ataków różnych grup terrorystycznych, używających coraz bardziej okrutnych i niekonwencjonalnych metod. W odpowiedzi zmuszeni jesteśmy podejmować wszelkie możliwe starania w zakresie zapobiegania im i ich zwalczania. Musi to oczywiście mieć miejsce i musimy działać w granicach obowiązującego prawa z poszanowaniem praw człowieka.

Zgadzam się w zupełności z panią poseł sprawozdawczynią czy z panią poseł Gomez w jednej sprawie: powinniśmy walczyć z łamaniem praw człowieka i powinniśmy zwalczać metody terroru stosowane wobec więźniów. W tym się w całości zgadzamy. Natomiast nie zgadzamy się pewnie co do jednego, czyli co do tego, aby doniesienia prasowe czy oświadczenia złapanych terrorystów mogły być wystarczającym powodem do tego, aby tak poważne ciało jak Parlament Europejski podejmowało stosowne uchwały. W tym dokumencie – i wielokrotnie o tym dzisiaj mówiliśmy – była poruszona kwestia dochodzenia w Polsce. Mogę potwierdzić, tak jak pan poseł Wałęsa czy pan poseł Protasiewicz, że dochodzenie w Polsce trwa, jest prowadzone przez prokuraturę apelacyjną w Krakowie, czyli prokuraturę wysokiego szczebla. Śledztwo to może być zakończone już z końcem października, więc bardzo niedługo. Wydaje się więc, że wszystkie organy międzynarodowe powinny w pierwszej kolejności dać szansę organom krajowym, zgodnie z zasadą subsydiarności, by zakończyły dochodzenia, śledztwa i wydały prawomocne wyroki w tej sprawie. I jeszcze jedna rzecz: w czasie, kiedy te sprawy miały miejsce, w Polsce był rząd lewicy. Zarówno prezydent Kwaśniewski, jak i ówczesny premier Miller czy minister spraw wewnętrznych Kalisz – działacze europejskiej lewicy – zaprzeczają, jakoby takie więzienia istniały w Polsce.

  Paul Murphy (GUE/NGL). - Mr President, a recent report by Open Society Justice Initiative confirms what Irish people have known for quite a long time, that Ireland is one of 54 countries which helped facilitate the use of illegal actions by the CIA by permitting the use of its airspace and airports for fights associated with the so-called ‘extraordinary rendition’.

In 2005, the then government stated that inspections of military planes in Shannon were not necessary because it had received assurances from the US Administration that detainees had not been and would not be transported illegally through Irish territory. But it is undeniable that successive Irish Governments have known that rendition flights did travel through Ireland and they knew that this violated international conventions on torture. But for the sake of maintaining good relations, a special relationship with the US, they did nothing except cover up kidnapping and torture.

That is a microcosm for what has happened across Europe. The secret detention centres have to be closed. The rendition flights have to be ended. All those [detained] have to be either released, or charged and given a fair trial.

  Vytautas Leškevičius, President-in-Office of the Council. − Mr President, let me state again that the Council fully shares the view that respect for human rights and international law in the fight against terror is fundamental.

A number of speakers this evening have called on the Council to investigate allegations of Member States’ involvement in a programme of transportation and illegal detention of prisoners by the CIA.

The Council consists of the representatives of the governments of the 28 Member States. Even if it had the legal basis to do so, the Council would never have the political support of all 28 Member States to issue a statement about such involvement, let alone initiate investigations. I realise that may be frustrating to Members of this House to hear, but we also operate within the framework of rules which have to be respected.

If there are allegations of inappropriate involvement by Member States in such activities, this is first and foremost an issue of scrutiny by national parliaments, by national authorities, by national legal authorities, and there are channels at the national level for holding national executives to account.

These can, of course, also go wider than national level, because all Member States are contracting parties to the European Convention on Human Rights and Fundamental Freedoms. So mechanisms do exist, but they are not mechanisms which are under the control of the Council. That is why the Council has been unable to follow up on the recommendations in your resolution. It has nothing to do with an absence of loyal cooperation. It has everything to do with the legal and constitutional framework within which we all operate. I therefore ask for your understanding and thank you for your attention.

  Marian-Jean Marinescu (PPE), în scris. – Rezoluţia referitoare la presupusa folosire a unor ţări europene de către CIA pentru transportarea şi deţinerea ilegală de prizonieri, adoptată de către PE cere, din nou, instituţiilor UE şi statelor membre să investigheze în detaliu operaţiunile CIA. În 2007, raportul final al comisiei temporare TDIP recomanda, printre altele, monitorizarea acţiunilor CIA într-o etapă ulterioară, urmată de rezoluţia adoptată în 2012, care cerea PE să revină asupra acestui subiect, după un an. Rezoluţia nu aduce elemente noi şi, în plus, face recomandări care depăşesc competenţele Parlamentului şi ale UE. Pe lângă paragrafele greşite din punct de vedere juridic (punerea sub semnul întrebării a dreptului şefului statului italian de a acorda graţiere), există şi elemente false precum responsabilitatea statelor membre pentru existenţa închisorii Guantanamo, din cauza refuzului acestora de a accepta deţinuţii pe teritoriul lor. Rezoluţia se adresează unui număr de 13 state membre, printre care şi România, în vederea declanşării rapide a unei anchete „independente, imparţiale, detaliate şi eficiente” cu privire la implicarea acestora în programul închisorilor CIA. Dreptul PE de a investiga violarea drepturilor fundamentale de către statele membre UE este întărit, acesta reiterând recomandările sale către Consiliu, cerându-i să facă o declaraţie de recunoaştere a implicării statelor în programele CIA.

  Cristian Dan Preda (PPE), în scris. – Nu sunt de acord cu redeschiderea discuţiei despre presupuse închisori CIA: în condiţiile în care nu există vreun element nou, a dezbate iarăşi despre „alegaţii” pare un gest pur electoral. Mă opun şi relansării criticilor la adresa autorităţilor române în acest dosar. Nu există niciun fel de dovezi din care să rezulte că pe teritoriul României au existat centre de detenţie secrete ale CIA sau că aeroporturile româneşti ar fi fost utilizate de către CIA pentru transportul sau detenţia unor prizonieri suspectaţi de acte de terorism. În România a fost instituită o comisie de anchetă specială la nivelul Senatului, care a ajuns la această concluzie încă din 2008. În plus, România a cooperat în mod transparent cu toate mecanismele de investigare internaţionale. Paragrafele rezoluţiei despre România nu pot decât să pună Parlamentul într-o lumină defavorabilă prin sursele îndoielnice folosite. Nu ne putem fonda nici pe o emisiune a unui post de televiziune al unui fost colaborator al Securităţii judecat actualmente pentru spălare de bani, nici pe afirmaţiile fostului şef al Serviciului de Informaţii Externe din perioada guvernării neo-comuniste Iliescu. Votez împotriva acestui text.

  Véronique Mathieu Houillon (PPE), par écrit. Le PPE a toujours défendu l’état de droit et affirmé que si des détentions illégales de prisonniers par la CIA ou des actes de torture avaient eu lieu sur le territoire européen il les condamnerait fortement. C’est pourquoi le PPE avait soutenu le rapport Flautre de suivi de la commission TDIPen 2012. Nous restons aujourd’hui fidèles à nos valeurs et engagements. Cependant depuis l’adoption de ce rapport aucun élément nouveau significatif n’a été porté à notre connaissance. Cette résolution contient un grand nombre d’allégations non étayées ainsi que de graves accusations contre plusieurs États membres que nous ne pouvons en aucun cas soutenir sans preuves. C’est pourquoi le PPE a décidé de s’abstenir sur le vote final.
