  Jarosław Wałęsa, rapporteur. - Mr President, first I would like to underline the fact that the year 2013 was a special one in relation to the post of European Ombudsman. Taking over from the long-standing and well-respected Mr Diamandouros was definitely a great challenge for Ms O’Reilly. Thanks to her great experience as an Irish Ombudsman, the newly-elected European Ombudsman started her work efficiently from the very beginning of her mandate.

I would like to thank the shadow rapporteurs for their valuable input during all stages of preparing this report: our cooperation was very fruitful and I tried to accommodate most of their ideas. I think we all share the view that the Ombudsman has taken up her duties with admirable commitment and has managed to accomplish a lot, considering her short time in office in 2013. I would like once again to congratulate the European Ombudsman on her efforts to make the institution accessible and user-friendly.

An example of this was demonstrated in the preparation of the annual report. It is divided into two parts: the first includes the most important statistics and the second a more detailed examination of cases of 2013. Topics at the top of the list of the Ombudsman’s inquiries in 2013 included transparency-related issues and other key topics such as ethical issues, citizens’ participation in EU decision-making and fundamental rights.

In my opinion, it is crucial for the work of the Ombudsman, and the European institutions as well, to observe the tendencies regarding the complaints. I appreciate the fact that the number of complaints about the European Personnel Selection Office (EPSO) more than halved in 2013, and the volume of complaints against Parliament also significantly declined. On the other hand, it is important for the Ombudsman to examine the significant rise in inquiries based on complaints against the Commission – and the same applies to complaints against EU agencies – and especially to monitor developments and indicate the reasons why complaints were lodged.

I would like to stress that the European Ombudsman took a very proactive attitude during the preparation of this report. Her report mentioned the statistics on incoming complaints and, on the basis of 100 exemplary ones, indicated the next steps. This is an interesting way to explain the process but, in my view, including raw data is also crucial so that it is easier to spot the tendencies over the years. This recommendation was taken into consideration and full data will be incorporated in 2014.

Moreover, I think it is important for the European Ombudsman to strike a balance between the traditional and digital communication channels. It is still possible to address a letter just with the title ‘The European Ombudsman’ and it will reach her office. At the same time it is crucial to further develop social media strategy. From what I recall, the official Twitter account has tripled and now has over 9 000 followers. Also worth mentioning is the fact that the services of the Ombudsman are available in 24 official languages, which is quite impressive considering that her office consists of 67 posts.

Last, but not least, as a PPE Group coordinator on the Committee on Petitions, I have a special interest in improving the timeframe for processing complaints. Therefore I am fond of a mechanism that is used by the European Ombudsman., namely the interactive guide, which enables her to answer requests successfully. I hope we will achieve similar goals in our committee.

To sum up, I am very content with the propositions of Madam Ombudsman and I wish her all the best in her future work.

  Emily O’Reilly, Ombudsman. - Mr President, I would like to start by putting on record my deep appreciation for the overwhelming vote of support I received in this Chamber for my re-election last month. It is a huge source of support for me personally, for my strategy and for my colleagues, who work hard on a daily basis to implement that strategy. Such wide parliamentary support is crucial to the success of any ombudsman, and I promise to build on that support by continuing to work closely with this Parliament. I cannot operate without your support, and equally I work to ensure that the people you represent will have access to an independent source of investigation and redress if they feel they have been unfairly treated by an EU institution. Our work is complementary.

Thank you, Mr Wałęsa, and all the shadow rapporteurs, for your work over the past months on the report before us today. The report shows a clear understanding of the challenges and opportunities facing the Office of the European Ombudsman as we attempt to keep pace with the evolving expectations placed upon us by European citizens. And, as their directly elected representatives, you know how fast the hopes, expectations and concerns of people in Europe today are changing.

Honourable Members, this is my first time addressing you in plenary. However, since coming into office in October 2013, I have addressed you in committee a total of eight times, including before the Committee on Petitions, the Committee on Budgetary Control and the Committee on Civil Liberties, Justice and Home Affairs. Each time I have benefited from your expertise, your advice and support, and from that of the staff who support your work. These committee hearings and our many one-on-one meetings have strengthened my understanding of our work together at European level and have fed directly into the strategy I have developed for my office.

My task as the third European Ombudsman is to take the office to the next level and make sure it continues to succeed and to thrive. My work at the end of 2013, when I took office, and over the past year of 2014 has been about putting those words into action. Recently, I published our five-year strategy entitled ‘Towards 2019’, which you refer to in paragraph 21 of today’s report. My strategy is to combine three objectives – to ensure relevance, to increase visibility and so to achieve greater positive impact.

To begin executing this strategy, I first undertook, as promised, an internal audit of the procedures and practices of the Ombudsman’s Office. This involved consulting with staff at every level and is leading to a number of internal changes, including the introduction of a modern complaint-handling system, a process begun by my predecessor, which will enable us to achieve greater internal efficiencies in complaint handling; a review of how we draft our case decisions to make them more citizen-focused; a review of our key performance indicators; and a review of our complaint inquiry processes, which will allow us to identify the key cases early and to prioritise them. These changes will, I believe, lead to an overall better service to citizens.

With an office of around 70 staff, I see it as my duty to use the resources at my disposal to the maximum possible effect.

To ensure our work becomes more relevant to the major concerns of ordinary European citizens and residents, I have made greater use of my power to launch inquiries in the public interest without necessarily a specific complaint as basis. To that end, I appointed an Own Initiative Investigation Coordinator, whose job is to drive the own-initiative inquiries in collaboration with her colleagues and to ensure that the outcomes are both speedy and effective.

Last year we opened own-initiative inquiries into the transparency and balance of Commission Expert Groups, the transparency of the Transatlantic Trade and Investment Partnership negotiations, the way in which EU institutions are implementing the new rules on protecting whistle-blowers, the Commission’s handling of the European Citizens Initiative, the way in which fundamental rights are protected in the EU cohesion fund programmes, and how Frontex ensures compliance with the Charter of Fundamental Rights in its important and difficult work.

Two other major ongoing inquiries of significant relevance concern how the Commission manages potential conflict of interest when EU officials leave for employment elsewhere – the so-called ‘revolving doors’ issue – and an ongoing inquiry into how the European Medicines Agency supports the transparency demands of Parliament in relation to clinical trial studies for medicines in the EU. I appreciate the fact that the Committee on Petitions welcomes these inquiries in point 24 of its report.

To achieve greater visibility, I have focused on ensuring that our work is better communicated to you, the elected representatives, to our stakeholders and to the public. Media commentary and media monitoring suggest that that strategy is having a significant impact, with details of our cases and other work now regularly featuring in the Brussels media outlets and also in mainstream Member State media and further afield. In addition, I now send you, the Members, a digest of our work, and I hope I have demonstrated my willingness to have ongoing dialogue with you on subjects of mutual concern.

We have also focused on our social media outreach and have trebled our Twitter followers in one year. I hope many of you have seen our new-format annual report, which uses many new media technologies to make it more readable and attractive.

I believe the new strategy has already had a positive impact and I am very grateful to all of the officials in the institutions I have dealt with for their largely positive engagement with my office. In December 2013 we had a positive response from the Commission in two major cases. One concerned an unreasonable delay in relation to a state aid investigation into certain professional football clubs; the other concerned an alleged conflict of interest for the former chair of the Ad-Hoc Ethics Committee for Commissioners. The chair stepped down after my intervention, and the Commission has since made the work of the Ad-Hoc Ethics Committee more transparent, which I welcome.

In relation to the European Medicines Agency, I believe the intervention of my Office, together with concerned Members of Parliament and civil society, helped to make sure that their new transparency policy was not rolled back, as it had appeared it would be when details of the new policy were announced in 2014.

Following, again, the strong intervention of a coalition of concerned Members of Parliament and civil society and an inquiry by my office into the lack of transparency around the TTIP negotiations, the Council released the mandate for wider public scrutiny, which I welcome. The Commission, as you know, has also announced other steps forward on transparency. Recently we made further constructive suggestions, and I expect the Commission’s response to those suggestions in March.

In recent weeks I have also listened to the new Juncker Commission. I have been heartened by the commitments on, and the real progress made toward, greater transparency, openness and accountability, particularly by Vice-President Timmermans on my right here today, and I pledge to work as collaboratively as possible with the Commission at all levels to help them achieve those goals. Indeed, the Commission is actually leading on many issues of good administration in the EU today, and for that they deserve our recognition.

To conclude, can I put on record again how impressed I am by the high standards of the European civil service, the thousands of dedicated people who work in the EU institutions and agencies all over Europe? The vast majority work hard to achieve high standards in their work and display a true ethic of public service. However, as we know, trust in both the EU and national levels of governance is not always very high at the moment in Europe. There are reasons to hope that we are slowly beginning to emerge from the painful recession and banking crisis. The people of Europe will regain trust in their governing administrations when they begin to see, for their families and in their daily lives, positive changes deriving from the decisions made. However, unlike most nation states in Europe which are largely legitimate in the eyes of their citizens, the EU administration has not yet achieved the high levels of popular legitimacy which, in the eyes of many Europeans, it should enjoy. Today’s report correctly recognises, in paragraph 3, that ‘wide gap’. This is why it is so important for the EU administration to be not only of the highest possible quality, but indeed to be the ‘gold standard’ in ethics, transparency, accountability and effectiveness.

My task as European Ombudsman is to work with the institutions and agencies to help make that happen. As you, the Members of the European Parliament, have recently trusted me to continue as European Ombudsman, I promise to do my best to continue working to fulfil that task.

Finally, let me conclude by again thanking the rapporteur, the shadow rapporteurs, their staff and the secretariats for all the work on the report, and I look forward to listening to your contributions and questions.

  Frans Timmermans, First Vice-President of the Commission. - Mr President, first of all I want to thank Mr Wałęsa for his report. I congratulate him on the excellent work he has done on behalf of your Parliament. Secondly, of course, congratulations are due to Ombudsman Mrs O’Reilly for being re-elected by your Parliament. You appreciate her work and so does the Commission, and I look forward to working with her along the same lines as she has just expressed.

I am really very proud to be part of the leadership of what I would call one of the best administrations public service has in the world. But I am also committed to improving the way it works, to making sure that we work more transparently, that we are more accountable and that we also change the situation when the situation is not up to the standards both Parliament and the Commission want.

We have examined the Wałęsa report with great interest. Transparency, openness, access to information, respect for the rights of citizens, high ethical standards: essential building blocks for creating greater support for European institutions at large. I fully concur with what Mrs O’Reilly just said, namely that the level of quality of our institutions is not reflected in the level of support from European citizens, and we need to work on that if we are to get the mandate from our constituents to do what needs to be done to create more prosperity and to create more jobs and to create more security for European citizens.

I also note, and Mr Wałęsa referred to it, that the share of complaints against the Commission has risen, and I have listened carefully to his call that we should reduce that, and I agree with him. I just want to, very briefly, tell you that in actual numbers, complaints between 2012 and 2013 have gone down. It is the share that has gone up – and this is unacceptable, so we will work on that – but just to make sure we do not misunderstand that there is actually, in numbers, a reduction in complaints.

I would just like to point out that if you compare the institutions, the highest compliance – 84% – by institutions with the Ombudsman’s recommendations is by the Commission, and let me just note very briefly that 100% compliance will for legal reasons probably never be possible. But I strive to have the highest possible compliance.

I also want to salute and welcome the approach of the Ombudsman to focus on strategic investigations, because strategic investigations can discern patterns, and patterns are the things we need to change if we want to improve the way we run our administration. I will support her and work with her very closely to make a success of her recommendations emanating from these strategic investigations.

I also note that Mr Wałęsa calls for common binding rules and principles on administrative procedure, and I just want to reiterate what I said at my hearing: that we will discuss the best possible way of implementing that. I know that a European law on administrative procedure is one of the options that could work there, but let us work between the Commission and Parliament on that to see what would be the best possible solutions.

I have noted also the conclusion that the percentage of complaints concerning EU agencies has almost doubled. Here again I offer cooperation, within the possibilities we have legally, to improve that on the boards of these agencies etc., and there again I would like to work closely with the Ombudsman and with Parliament to ensure improvement. Finally, the complaints against EPSO have indeed decreased significantly, and I think I would echo Mr Wałęsa’s conclusion that this is to be applauded.

Once again, I look forward to working closely with Mrs O’Reilly and her team. She has an outstanding team. They have a strong dedication to improving the quality of our administration and to answering enquiries and complaints from European citizens, and it is in all our interests to make sure that her work is successful. I will certainly guarantee you my personal commitment to making that happen.

  Peter Jahr, im Namen der PPE-Fraktion. – Herr Präsident! Zunächst möchte ich der Bürgerbeauftragten zu ihrer Wahl im vergangenen Dezember noch mal gratulieren. Die Tatsache, dass es bei dieser Wahl keinen Gegenkandidaten gab, kann sicherlich als ein positives Zeugnis ihrer bisherigen Arbeit gewertet werden.

Apropos Wahl: Ich werde mich nach wie vor dafür einsetzen, dass in Zukunft im Parlament wieder die Praxis eingeführt werden sollte, dass der oder die Bürgerbeauftragte bereits unmittelbar nach der Wahl einige Worte an das Parlament richten darf.

Vielen Dank noch mal an den Berichterstatter, JarosławWałęsa. Dem Bericht möchte ich mich zu 150 % anschließen. In dem Sinne habe ich noch drei kurze Anmerkungen oder Verdeutlichungen hinzuzufügen. Erstens: In ihrer kurzen Amtszeit ist es Frau O’Reilly bereits gelungen, die Zusammenarbeit mit dem Europäischen Parlament und insbesondere mit dem Petitionsausschuss noch weiter zu intensivieren und vor allen Dingen auch die Distanz zu den Bürger zu verringern. Zweitens: Ich freue mich auch in Zukunft auf eine sehr gute Zusammenarbeit mit ihr, beispielsweise zum Thema Kinderrechte. Speziell zum Thema Sorgerecht liegen uns im Petitionsausschuss viele Beschwerden vor. Frau O’Reilly hat uns bereits zugesichert, dass sie sich aus ihrer Sicht und mit ihrer Verantwortlichkeit diesem Thema auch widmen möchte. Gerade bei der Durchsetzung von Rechten schutzbedürftiger Personen, zum Beispiel Scheidungskinder, sollten die europäischen Stellen enger zusammenarbeiten und die zur Verfügung stehenden Mittel besser ausschöpfen.

Es ist gut zu wissen, dass wir mit Frau O’Reilly eine engagierte und fachlich hochkompetente Bürgerbeauftragte an unserer Seite haben.

  Soledad Cabezón Ruiz, en nombre del Grupo S&D. – Señor Presidente, yo también quiero comenzar, por supuesto, felicitando la elección de la Defensora del Pueblo, así como el arduo trabajo realizado no solamente por el ponente, Wałęsa —a quien, como ya digo, felicito—, sino también por los diferentes ponentes alternativos, que nos han permitido obtener importantes conclusiones en este informe.

Señorías, en estos momentos de dificultades, es obvio decir que Europa necesita más Europa. Para ello, sabemos que es crucial que la ciudadanía se encuentre o se sienta dentro del corazón de Europa y para ello tiene que sentirse dentro, en el centro, de sus instituciones. Garantizar un adecuado funcionamiento de las instituciones europeas es de suma importancia y esa es la función cardinal de la propia oficina del Defensor del Pueblo, así como de la Comisión de Peticiones, cuyo papel también debemos recordar.

Y lo es porque la ciudadanía debe sentirnos, como digo, cerca y considerar realmente que sus problemas son nuestras reivindicaciones y nuestra tarea. En este sentido, no tengo más que felicitar y decir que este es un buen informe porque ha sido buena la labor de la oficina de la Defensora del Pueblo. Aunque quiero decir que esto no debe ser muestra de autocomplacencia, sino un nuevo impulso en este trabajo y en esta línea de trabajo.

Efectivamente, en cuanto al informe en concreto, en lo que se refiere al funcionamiento de las instituciones, tengo que decir que es positiva la puesta en marcha de la página web en veinticuatro idiomas, aunque lamento que el informe no esté disponible en todos los idioma, sino solamente en inglés.

Tengo que felicitar el hecho de que se haya empezado a mejorar el acceso a las personas con discapacidad, aunque también reivindico que se haga en pro de la infancia o que se haga en pro de la igualdad de género, mejorando su lenguaje. También tengo que felicitar el hecho de que se haya puesto en marcha la Red Europea de Defensores del Pueblo, así como que se haya trabajado por la transparencia de las instituciones europeas, aunque quiero reivindicar que se incluya en esta mejora de la transparencia a todos aquellos organismos, formales o informales, que toman, en el día a día, decisiones que afectan a los derechos de los ciudadanos y ciudadanas, ya sea la troika o el propio Eurogrupo.

Tengo que reivindicar ―como ha hecho el señor Wałęsa― la necesidad de establecer plazos y garantías en la respuesta, por parte de las instituciones europeas, a todas las peticiones de los ciudadanos, para disminuir la injerencia política. Y, en cuanto al fondo, quiero decir que estoy de acuerdo con los diferentes temas que ha abordado de oficio la Defensora del Pueblo, aunque ahondaría en la necesidad del precio de los fármacos innovadores, así como en la afectación de los derechos fundamentales en la crisis.

  Νότης Μαριάς, εξ ονόματος της ομάδας ECR. – Κύριε Πρόεδρε, χαιρετίζουμε την εδώ παρουσία της Ευρωπαίας Διαμεσολαβήτριας, της κυρίας O'Reilly, και την συγχαίρουμε για την πανηγυρική επανεκλογή της. Η ετήσια έκθεση δραστηριοτήτων του Ευρωπαίου Διαμεσολαβητή κατά το 2013 αναδεικνύει τη σημαντική δράση του Οργάνου αυτού στη διασφάλιση χρηστής διοίκησης και στην προστασία των δικαιωμάτων των πολιτών. Πιστεύουμε στη συνεργασία των ευρωπαϊκών θεσμών και αποδίδουμε ύψιστη σημασία στον έλεγχο, εκ μέρους του Διαμεσολαβητή, των περιπτώσεων κακοδιοίκησης των οργάνων και των οργανισμών της Ευρωπαϊκής Ένωσης, ιδίως στην παρούσα φάση που η οικονομική κρίση έχει οδηγήσει στην αμφισβήτηση των ίδιων των ευρωπαϊκών θεσμών.

Οι πολίτες απαιτούν πλέον ενδυνάμωση των θεσμών λογοδοσίας και διαφάνειας σε επίπεδο Ευρωπαϊκής Ένωσης, συμπεριλαμβανομένης της FRONTEX, της Τρόικας αλλά και της Ευρωομάδας, προκειμένου να βελτιωθεί η ποιότητα της δημοκρατίας. Ταυτόχρονα, τα εκατομμύρια των φτωχοποιημένων πολιτών των χωρών που τέθηκαν σε προγράμματα δημοσιονομικής προσαρμογής, δηλαδή σε μνημόνια, θεωρούν αναγκαία τη διεξαγωγή μιας έρευνας, εκ μέρους της Ευρωπαίας Διαμεσολαβήτριας, σε σχέση με την τήρηση του Χάρτη των Θεμελιωδών Δικαιωμάτων της Ευρωπαϊκής Ένωσης εκ μέρους της Τρόικας.

Επίσης, και σε συνέχεια της σχετικής απόφασης της Ολομέλειας του Ευρωπαϊκού Κοινοβουλίου τον Μάρτιο του 2014 για τον καταστροφικό ρόλο της Τρόικας, η Ευρωπαία Διαμεσολαβήτρια πρέπει να ερευνήσει τη σύγκρουση συμφερόντων στην Ευρωπαϊκή Επιτροπή μεταξύ του ρόλου της στην Τρόικα και της ευθύνης της ως θεματοφύλακα των Συνθηκών του κοινοτικού δικαίου.

Τέλος, πρέπει να εξετασθεί από τη Διαμεσολαβήτρια η σύγκρουση συμφερόντων μεταξύ του ρόλου της Ευρωπαϊκής Κεντρικής Τράπεζας στην Τρόικα, όπου συμμετέχει ως τεχνικός σύμβουλος αλλά και πιστωτής των κρατών του μνημονίου, και της εντολής την οποία έχει με βάση τη Συνθήκη. Για τον λόγο αυτό, και κλείνοντας κύριε Πρόεδρε, καλώ τους συναδέλφους να υπερψηφίσουν τις σχετικές τροπολογίες που έχω καταθέσει. Τέλος, θα ήθελα να ευχαριστήσω τον εισηγητή και τους σκιώδεις εισηγητές για τη συνεργασία που είχαμε.

  Bill Etheridge (EFDD), blue-card question. – Would you agree with me that in this, as with many other things in life, size matters? What we have here is tens of thousands of civil servants trying to be involved in every part of life, with hundreds of billions of euros involved. It is simply impossible to run an effective organisation with such a huge remit, with so many great ambitions to be involved in so many things. This cannot possibly ever be run efficiently. Would you agree?

  Νότης Μαριάς (ECR), απάντηση “γαλάζια κάρτα”. – Κύριε Etheridge, ο ρόλος του Ευρωπαίου Διαμεσολαβητή - ασχολούμαι με αυτό τον θεσμό εδώ και πάρα πολλά χρόνια ως καθηγητής των θεσμών της Ευρωπαϊκής Ένωσης - είναι να μπορέσει να περιορίσει τις περιπτώσεις κακοδιοίκησης σε επίπεδο Ευρωπαϊκής Ένωσης και κυρίως σε επίπεδο Επιτροπής. Θεωρώ ότι μπορεί να συμβάλει στην προστασία των δικαιωμάτων των πολιτών της Ευρωπαϊκής Ένωσης επιλέγοντας στρατηγικούς τομείς και κάνοντας συγκεκριμένες παρατηρήσεις. Ήδη υπάρχει μία αποτελεσματική λειτουργία του θεσμού του Διαμεσολαβητή και αυτό έχει αποδειχθεί στο παρελθόν και από τον ρόλο που έπαιξε και ο Διαμεσολαβητής, ο κύριος Διαμαντούρος.

En nombre del Grupo ALDE y de la Comisión de Peticiones, quiero agradecer expresamente a la Defensora del Pueblo Europeo, Emily O'Reilly, la excelente labor realizada en el año de mandato y la precisión y autoexigencia reflejadas en su informe.

Es una magnífica muestra de cómo desarrollar un trabajo institucional riguroso, con un enfoque de eficiencia operativa, de trabajo en equipo y de rendición de cuentas proactiva y permanente.

Como refleja este informe, la mayoría de las denuncias de los ciudadanos apunta claramente a un déficit de transparencia en las instituciones europeas y esa es el área de mejora que debemos destacar más.

En este sentido, me gustaría recordar las investigaciones iniciadas desde la Oficina del Defensor del Pueblo, como las relativas a la transparencia en las negociaciones del TTIP, la denuncia de irregularidades en las instituciones de la Unión Europea y de los casos de «puertas giratorias», la exigencia de transparencia en los ensayos clínicos de nuevos medicamentos y también —cómo no— el trabajo incansable en la defensa de los derechos fundamentales en la política de cohesión y de apoyo a la mejora de la Iniciativa Ciudadana Europea.

La principal prioridad del Defensor del Pueblo es garantizar plenamente el respeto de los derechos de los ciudadanos. Hemos de revisar el concepto de «buena administración» asumiendo que el objetivo es una «mejor administración», entendida como un proceso de mejora continua, como el patrón de oro al que se refiere la señora O'Reilly, que ya está puesto en marcha y está basado en un funcionariado excelente.

Esto exige no solo que se cumplan las obligaciones legales, sino también que actuemos con voluntad de servicio velando por que los ciudadanos reciban un trato correcto y puedan ejercer plenamente sus derechos.

La señora O'Reilly, primera mujer elegida para el cargo de Defensor del Pueblo Europeo, ha expresado asimismo su voluntad de trabajo en aras de la excelencia a través de su estrategia «Hacia 2019», basada en tres pilares fundamentales que suscribo con entusiasmo: Impacto, Relevancia y Visibilidad.

Quiero desde aquí refrendar todo el apoyo al trabajo de esta institución que, junto a la Comisión de Peticiones, encarna el principal cauce de participación de los ciudadanos europeos. Ese es el ámbito donde pueden expresar abierta y directamente sus preocupaciones. Pongámoslo todos, Parlamento, Comisión y Consejo, en el corazón de nuestra actividad, que no es otra que el servicio a la ciudadanía.

  Ángela Vallina, en nombre del Grupo GUE/NGL. – Señor Presidente, en primer lugar, efectivamente, felicitar a la Defensora del Pueblo por su labor, así como por su informe de actividades, por el cual elaboramos este documento.

Este informe que vamos a votar es claramente insatisfactorio para nosotras porque, cuando no maquillamos la realidad, lo que hacemos es directamente obviarla. Por poner un ejemplo, echo de menos que no se hable de las «puertas giratorias», que es uno de los asuntos que la Defensora destaca en su informe por el elevadísimo número de reclamaciones formuladas. Y, por cierto, en España, gracias al PP y al PSOE, sabemos mucho de todo esto. Sin embargo, preferimos ignorarlo, y yo me pregunto ¿por qué les produce tanta alergia y prefieren obviarlo cuando la misma Defensora lo aborda?

Echo de menos que se destaque el papel de la Defensora al investigar la vulneración de derechos fundamentales que se está llevando a cabo por parte de Frontex. Se está pasando de puntillas sobre una investigación, a iniciativa propia de la Defensora, mientras que se entierra con bonitas palabras una cruda realidad que miles de personas, especialmente inmigrantes, sin otra solución que jugarse la vida a las puertas de nuestras fronteras, sufren en sus carnes. ¿Por qué nos ponemos, de nuevo, este velo de hipocresía?

Echo de menos que se denuncie públicamente que la negociación del ATCI sea una de las más vergonzantes de la historia de la Unión Europea. Y no hace falta que recuerde que no podemos siquiera acceder a la sala de lectura de los documentos con un bolígrafo. Pero quizá al ponente de este informe le parezca normal que la negociación de un acuerdo de esta magnitud —que, sin duda, nos va a empobrecer a todos más— se lleve a cabo como en los peores tiempos de la guerra.

Ni que decir tiene que también echo de menos que se mencionen los recortes, las políticas de austericidio, que atacan el derecho de las personas a tener una vida digna. No es casualidad, señoras y señores, que la mayoría de las quejas vengan a parar a la Comisión. Barroso o Juncker. Da igual cómo los llamemos, porque, al final, son exactamente lo mismo. Podría seguir hablando sobre otros asuntos, pero lo que queda claro es que seguimos jugando a maquillar la realidad.

Por todo ello, presentamos desde nuestro Grupo una serie de enmiendas que esperamos —desde el sentido común— que sean aprobadas, ya que van en la línea de los asuntos que acabamos de explicar.

  Margrete Auken, for Verts/ALE-Gruppen. – Hr. formand! Først og fremmest tak til Jarosław Wałęsa for en god betænkning og et rigtigt godt samarbejde, hvor vi har mødt god vilje til at få så meget med fra os alle, som muligt, og jeg kan også her mærke, hvor samlet vi står, også i vores tak til Emily O'Reilley for et meget flot stykke arbejde. Hun har arbejdet videre på Nikiforos Diamandouros arbejde, og vi står, synes jeg, i den lykkelige situation i EU, at vi har en rigtig Ombudsmand. Vi har især været glade for fremhævelsen af kampen for åbenhed, som vi så slå effektfuldt igennem i forbindelse med kravene til TTIP-forhandlingerne, hvor Kommissionen havde været fuldstændig lukket. Vi ser også frem til arbejdet med Ombudsmandens særberetning om Frontex.

Når vi alligevel har stillet en række ændringsforslag, så er det først og fremmest fordi vi synes, at vi trænger til at få endnu mere kraft bag kravet om en rigtig forordning om god forvaltningsskik. Vi har lovet borgerne det. Det står i chartret i artikel 41. Det står i traktatens artikel 298. Det er på tide, at vi kommer i gang med at få dette lovfæstet! Tak til hr. Timmermans her i dag for så klart at gå med til, at vi faktisk får styrket arbejdet med at sikre god forvaltningsskik i alle EU's institutioner. Lad mig her efterlyse, at vi får serviceprincippet i centrum, hvor det er borgerne, der skal beskyttes, ikke embedsmændene, og at vi får en sand kamp mod interessekonflikter, altså mod inhabilitet. Det kniber i alle vores lande - også Danmark - at få en ordentlig forståelse af, hvad habilitet er for noget, og få det respekteret.

Derudover vil jeg gerne nævne, da også hr. Wałęsa bragte det op, at vi selvfølgelig gerne vil have et fint samarbejde med Ombudsmanden og Kommissionen. Men vi skal altså have flere ressourcer! Jeg synes, at vores ressourcer skal matche Ombudsmandens. Ikke at hendes ressourcer skal skæres ned, men vi har brug for flere. Vi kan ikke klare alle vores mange klager ved bare at kvæle så mange af dem som muligt, og det synes jeg lidt en gang imellem, at jeg fornemmer, sker, ikke mindst fra EPP's side. Kan vi kvæle dem, så går det jo hurtigere - det er klart!

Lad mig til sidst sige, og det blev nævnt også fra Peter Jahrs side, at jeg synes det var lidt skamfuldt at opleve, at dette Parlamentet ikke gav O'Reilly en ordentlig velkomst. Mange af de store, gamle lande ved end ikke, hvad en Ombudsmand er. De har ikke nogen. Det har de skandinaviske lande, det har England, det har Irland, det har Holland - og lykkeligt nok også mange af de nye medlemslande. De har oplevet, hvad en rigtig, uafhængig, kvalificeret Ombudsmand er. Derfor vil jeg igen gerne takke Wałęsa for at have styrket os i, at vi har fået det til at fungere, og jeg vil gerne opfordre formandsskabet til at tage sig sammen og sørge for, at vi får en bedre velkomst, og at vi aldrig mere ser en formand, der lukker for adgangen til oplysninger om, hvem der har anbefalet Ombudsmanden. Det er barokt i strid med hele Ombudsmandens arbejde, at man pludselig beskytter medlemmerne mod at stå ved, hvem de har anbefalet. Så lad os nu få en god velkomst. Vi har en god Ombudsmand, vi burde også have et parlament, der kan leve op til Ombudsmandens bedste standarder.

  Eleonora Evi, a nome del gruppo EFDD. – Signor Presidente, onorevoli colleghi, anch'io accolgo con molto piacere il lavoro che il Mediatore europeo Emily O'Reilly ha fin qui svolto e rintracciando nel suo operato la reale volontà di avvicinare i cittadini e le istituzioni da lei rappresentate, un'istituzione che per i cittadini è stata pensata e con i cittadini vive. Ringrazio anche il collega Wałęsa per la relazione svolta, tuttavia vorrei fare delle considerazioni a partire da un dato che ho trovato molto importante: circa 68 delle 100 richieste che arrivano al Mediatore europeo non rientrano nello spettro delle sue competenze.

Questo dato forse ci dice come l'accessibilità e la pubblicità del Mediatore europeo siano assolutamente da migliorare, adoperando ogni mezzo che le nuove tecnologie ci mettono a disposizione sia per promuovere la figura stessa del Mediatore – non conosciuta ai più – sia per accrescere nel cittadino la consapevolezza dei propri diritti e non meno importante chiarire quali siano le reali competenze del Mediatore europeo.

In questo senso mi voglio anche rivolgere anche al mio paese per ricordare purtroppo qualche record che tristemente detiene: l'Italia infatti è il solo Stato a non aver istituito la figura del Difensore civico nazionale, è tra i pochissimi a non avere neppure una commissione parlamentare per le petizioni. Come se tutto ciò non bastasse, a rilevare la scarsa attenzione che le nostre istituzioni hanno verso la tutela del cittadino, voglio ricordare che con la legge finanziaria del 2010 è stata tagliata anche una figura molto importante, che è quella del difensore civico comunale privando quindi i cittadini dei riferimenti territoriali più vicini che avessero.

Auspico che anche l'Italia venga seriamente esortata a rimediare a questa situazione, come peraltro seguendo appunto le raccomandazioni nella relazione annuale del 2012 della commissione per le petizioni volta all'istituzione di una rete delle commissioni per le petizioni che comprenda tutte quelle presenti negli Stati membri. Ringrazio quindi il Mediatore europeo e gli auguro un proficuo anno di lavoro a tutela dei diritti dei cittadini.

  Edouard Ferrand (NI). - Monsieur le Président, Mesdames et Messieurs, Monsieur le Commissaire, les masques tombent. Il faut un véritable contrôle public de la Commission. 64 % des enquêtes ouvertes par notre Médiateur concernent la Commission. Le nombre des plaintes a augmenté contre la Commission. Elle agit pourtant directement sur les citoyens européens. Il faut en finir avec cette situation.

Depuis dix-huit ans, la Cour des comptes refuse d'avaliser les comptes de la Commission. Ici, le Parlement vote avec la même légèreté la décharge. Pire, vous avez refusé de voter la motion que nous avons présentée il y a quelques semaines, sans parler du mystère qui entoure le TTIP. Ni le Conseil, ni le Parlement ne se sont montrés capables de contrôler la Commission.

Alors, j'ai un seul conseil à vous donner, Monsieur le Commissaire. Un vent souffle et gronde, ici, sur l'Europe. Faites attention parce que les peuples sont très mécontents.

  Rosa Estaràs Ferragut (PPE). - Señor Presidente, en primer lugar, quiero dar la enhorabuena a nuestra Defensora del Pueblo, la señora Emily O'Reilly, y también al anterior Defensor, cuyo informe del año 2013 valoramos hoy; también al señor Wałęsa, nuestro ponente en este informe y a todos los ponentes alternativos.

Efectivamente, valoramos de qué manera los ciudadanos quieren combatir la mala gestión en algunos casos de algunos órganos, organismos e instituciones de la Unión Europea, y acuden a la institución del Defensor del Pueblo para que haga de intermediaria entre ellos y estas instituciones. Para ello se requiere no solamente cumplir la ley, sino también que haya voluntad de servicio, de tal manera que se vele para que los ciudadanos tengan una respuesta inmediata y para que los ciudadanos tengan un trato correcto.

Es una oportunidad única para que las instituciones de la Unión Europea sean eficaces y beneficiosas para los ciudadanos y podamos recuperar la confianza en todas y cada una de ellas: en definitiva, que sean instituciones abiertas y efectivas.

Viendo el informe, los principales temas que preocupan a los ciudadanos son temas en torno a la transparencia, el acceso a la información —un tema importante—, las cuestiones éticas, «las puertas giratorias» que pueda haber —problema muy ligado al tema de la transparencia— y, también, la gestión de la Comisión como guardiana de los Tratados, los derechos fundamentales y todos los proyectos y programas de la Unión Europea.

Aunque las recomendaciones de la propia Defensora del Pueblo no son vinculantes, no cabe duda de que se escuchan en un porcentaje muy alto y son una oportunidad única para solucionar un problema.

Acabo diciendo que, por lo que se refiere a los temas de accesibilidad, debo darle la enhorabuena a la Defensora del Pueblo, aunque le pido que se vele por que sea una realidad la implementación en los Estados miembros de la Convención de las Naciones Unidas sobre los derechos de las personas con discapacidad, ya que, aunque haya sido firmada por la inmensa mayoría, la realidad es muy pobre.

Kemm ilha f'din il-kariga, Emily O'Reilly uriet determinazzjoni, enerġija u effiċjenza fil-kariga tagħha. Konvinta li f'dawn il-ħames snin li ġejjin - flimkien mal-Parlament Ewropew u l-kumitat PETI - ser isir progress fil-kwalità tal-amministrażzjoni għall-gid taċ-ċittadin Ewropew.

Is-sena l-oħra kienet sena tranżitorja, però r-rapport tal-Ombudsman hu wieħed tajjeb ħafna, innovattiv u wkoll user friendly.

Iżda ma rridu bla ebda dubju naħsbu li l-Unjoni Ewropea laħqet il-livell aċċettabbli ta' akkontabilità u trasparenza. Infatti, in-nuqqas ta' trasparenza u aċċess għall-informazzjoni huma l-ilmenti l-aktar spissi li jsiru.

Barra min hekk, żewġ terzi taċ-ċittadini Ewropej jaħsbu li l-vuċi tagħhom ma tiswiex. Hu importanti li ċ-ċittadin ma jitlifx il-fiduċja fl-istituzzjonijiet tagħna, speċjalment fi żmien meta x-xettiċiżmu fil-Proġett Ewropa qed jikber.

Mod biex dan ma jsirx, u biex nimxu 'l quddiem, hu li nżommu liċ-ċittadin fil-qalba tad-deċiżjonijiet tagħna u nintegraw l-interess taċ-ċittadin fix-xogħol tal-Ombudsman u l-istituzzjonijiet kollha Ewropej. Irridu niżguraw governanza serja u rridu niżguraw li ċ-ċittadin jaraha u jħossha din is-serjetà.

Ninnota bi pjaċir, li aktar minn 23 000 ċittadin sabu għajnuna mill-Ombudsman. Però ninnota li sfortunatament, minoranza biss tal-ilmenti jaqgħu taħt il-kompetenza diretta tal-Ombudsman.

Għalhekk, biex dan l-uffiċċju importanti jkun ta' servizz aktar effettiv għaċ-ċittadin:

• Irridu ntejbu l-kanali ta' informazzjoni lejn iċ-ċittadini biex ikunu aktar mgħarrfa fuq id-drittijiet tagħhom

• Irridu niżguraw li kull cittadin ikollu aċċess għall-uffiċċju tal-Ombudsman, mingħajr diskriminazzjoni ma' min mhux abilitat b'sistemi diġitali u [li] għalhekk ma jistgħux jikkomunikaw onlajn

• Irridu naraw follow up effiċjenti għall-ilmenti biex b'hekk iċ-ċittadin ma jħossux injorat

• Irridu fuq kollox inqassru ż-żmien ta' dawk il-każi taħt investigazzjoni, biex b'hekk issir ġustizzja, jew tinstab soluzzjoni mingħajr dewmien.

Fl-aħħar nett nixtieq nawgura ħidma tajba lis-Sinjura O'Reilly u nirringrazzjaha tal-kooperazzjoni u impenn tagħha lejn din il-pożizzjoni tant oneruża.

  Kazimierz Michał Ujazdowski (ECR). - Panie Przewodniczący! Też gratulacje dla Pani Rzecznik! Jej sprawozdanie pokazuje, że Unia cierpi na deficyt transparentności i bardzo często zdarza się tak, że to instytucje narodowe są bardziej przejrzyste niż instytucje unijne. W tej sprawie trzeba przejść od słów do konsekwentnych czynów. Ja proponuję, żeby Pani Rzecznik, nie czekając na Komisję Europejską, opracowała kodeks przejrzystości – zestaw zasad, które uczynią instytucje unijne bardziej transparentnymi.

I wreszcie kwestia druga: mamy nowe prawo obywatelskie, obywatelską inicjatywę prawodawczą. Pani Rzecznik się tym zajęła, ale nie chodzi o zwykłe zainteresowanie, chodzi o to, by stanąć po stronie tych, którzy korzystają z tego prawa. Po stronie największej inicjatywy, jaką była „One of us”. Niestety Komisja Barroso odrzuciła tę inicjatywę popartą przez blisko 2 miliony obywateli. Oczekuję, że Pani Rzecznik w takich przypadkach/sprawach będzie wyraźnie, jednoznacznie stała po stronie praw obywateli, mieszkańców Unii Europejskiej.

  Cecilia Wikström (ALDE). - Herr talman! Först och främst vill jag rikta ett stort tack till Jarosław Wałęsa och också till de ledamöter och sekretariatet som har jobbat med det här betänkandet, som är viktigt för oss alla. Som ordförande för utskottet för framställningar är det naturligtvis en stor glädje för mig att i dag gratulera ombudsmannen till det förnyade förtroendet. Jag ser fram emot ett fortsatt gott samarbete.

Ombudsmannens roll är nämligen en mycket viktig del i att skapa en europeisk union som kan åtnjuta respekt och få förtroendet tillbaka hos våra medborgare. Precis som Jarosław Wałęsa skriver i det betänkande som jag hoppas att vi med bredast möjliga majoritet kommer att anta alldeles snart i detta plenum, är transparenta beslutsprocesser och ansvarsutkrävande hos dem som har makt och ansvar en mycket viktig hörnpelare och hörnsten och en av de viktigaste aspekterna för den moderna demokratin.

I detta sammanhang tänkte jag att jag än en gång skulle ta upp det krav som parlamentet flera gånger har ställt till kommissionen, nämligen att den ska presentera en fullvärdig, effektiv förvaltningslag för Europeiska unionen. En sådan lag skulle enkelt och tydligt reglera, inte bara våra institutioner, utan också hur alla EU:s myndigheter ska agera i förhållande till medborgarna i våra medlemsländer. Först i och med den rättsliga grunden som infördes i Lissabonfördraget blev detta möjligt. Det har dock varit möjligt ett antal år nu. Jag tycker att det är hög tid att ni utnyttjar den möjligheten, eftersom det skulle kunna bidra till att underlätta också ombudsmannens arbete.

Det är därför som jag nu vänder mig med förtroende till er, kommissionär Timmermans, och ber om att ni skyndsamt tar tag i denna fråga som handlar om en europeisk effektiv förvaltningslag.

Våra nationella institutioner och myndigheter lyder nämligen redan under dessa lagar, och det är hög tid att vi får enhetliga regler på plats också på EU-nivå. Här kan säkert koden om gott administrativt uppträdande ligga till grund för vidare arbete.

Avslutningsvis vill jag önska ombudsmannen, kommissionären och alla kolleger och våra medarbetare i utskottet lycka till. Jag ser fram emot vårt fortsatta samarbete under detta fortfarande ganska nya år.

  Morvai Krisztina (NI). - Elnök úr, kedves kollégák és kedves európai polgárok, akik talán követnek bennünket! Vagy egy nagyon fontos pozíció az Európai Unióban, az ombudsmannak a pozíciója. Ez egy komoly jogászi tevékenység, amelynek lényege, hogy az 500 millió európai polgár – akik között ugye egyre több a jogfosztottságtól szenvedő – jogainak az érvényesítését és érvényesülését vizsgálja. Azt tehát, hogy a jogszabályokban, bírósági gyakorlatban, jogelvekben biztosított jogaik mennyire érvényesülnek. Olyan furcsa érzésem van, mert itt van két önéletrajz a kezemben, az egyik ombudsman asszonyé, és ebből az derül ki, a másik pedig a raportőrünké, ebből az a furcsa kép tárul a szemünk elé, ami valószínűleg meglepné a jogkeresőket, hogy a mi ombudsmanunk, és ez nyilván tévedés, tehát a kérésem, kérdésem arra irányul, hogy legyen kedves elmondani azt, hogy Ön milyen jogi képzettséget szerzett az élete során, és hogyan képezi folyamatosan a jog területén tovább magát. Önéletrajzából az derül ki, hogy soha egy szemeszter jogot sem tanult és az Ön munkáját ellenőrzi az a kollegánk a Parlament részéről, aki szintén soha életében egy szemeszter jogot nem tanult. Elnézést, ha ez félreértés, ez derül ki az önéletrajzukból.

Nagħmel punt ieħor: aħna għandna nagħtu wkoll l-appoġġ kollu lil kull Ombudsman fil-pajjiżi tagħna tal-Unjoni Ewropea. Fil-każ ta' Malta l-Ombudsman qed jieħu l-inizjattiva biex iwaqqaf l-International Ombudsman Law Insititute f'pajjiżna. Din hija inizjattiva tajba u li jien nagħti l-appoġġ sħiħ tiegħi għaliha.

Sinjura O'Reilly, nirringrazzjak u jien ninsab ħerqana li nkomplu nsaħħu l-koperazzjoni tagħna tul is-snin li ġejjin.

Întrebarea mea este: nu credeți că această instituție ar trebui să analizeze mai mult situația țărilor membre ale Uniunii Europene unde bugetele sărăcesc pentru că se pierd procese pe drepturile omului în țară și se câștigă la Curtea Drepturilor Omului și, practic, banii se plătesc de la buget și nu de către cei care greșesc?

  Lidia Joanna Geringer de Oedenberg (S&D). - Panie Przewodniczący! Chciałabym serdecznie pogratulować pani Emily O’Reilly pierwszego sprawozdania Europejskiego Rzecznika Praw Obywatelskich. Sprawozdanie dotyczy roku 2013, w którym urząd ten sprawował jeszcze poprzedni rzecznik, profesor Nikiforos Diamandouros, rokrocznie bardzo pozytywnie przez nas oceniany. Cieszę się, że jego metoda współpracy z Parlamentem, w szczególności z Komisją Petycji, jest także obecnie kontynuowana.

W 2013 r. o pomoc do rzecznika zwróciło się ponad 23 tysiące obywateli. Z tej liczby blisko 20 tysiące otrzymało poradę drogą internetową. Zarejestrowano 2420 skarg, co stanowi ich spadek o dokładnie 22 w porównaniu z rokiem poprzednim. Wszczęto 350 nowych dochodzeń, zamknięto 461 rozpoczętych już dochodzeń, 77% dotyczyło skarg złożonych przez indywidualnych obywateli. Do najczęstszych należały te dotyczące przejrzystości w instytucjach unijnych i udziału obywateli w unijnym procesie decyzyjnym.

Uczynienie instytucji rzecznika jak najbardziej przyjazną dla obywateli powinno stać się motywem przewodnim obecnej kadencji. I Pani, jako pierwszej kobiecie na tym stanowisku, bardzo serdecznie tego życzę.

  Steeve Briois (NI). - Monsieur le Président, chers collègues, le rapport relatif aux activités du Médiateur européen permet de mesurer à quel point l'Union européenne est en totale déconnexion avec les préoccupations des citoyens des États membres.

Pour l'année 2013, moins de 24 000 citoyens ont ainsi consulté les services du Médiateur et seules 461 enquêtes ont été clôturées, ce qui est ridicule au regard, par exemple, de l'activité du défenseur des droits français, qui a traité près de 90 000 dossiers pour la seule année 2011. Ce chiffre prouve le désintérêt des citoyens de chaque État membre à l'égard des procédures et des institutions européennes.

De plus, près de 20 % des propositions du Médiateur n'ont pas été mises en œuvre par les institutions européennes. À ce titre, il aurait été opportun de demander pourquoi ces propositions n'ont pas été suivies de fait. Par exemple, le Médiateur a demandé à la Commission de respecter les règles élémentaires de transparence concernant les négociations du TTIP et du CETA. Il semble cependant que la Commission n'ait pas tenu compte de ces recommandations, ni communiqué aux députés européens les tenants et les aboutissants des négociations de ce traité de libre-échange.

Alors non, le Médiateur européen n'est pas à la hauteur des enjeux et ne pèse quasiment rien face à la toute-puissante Commission européenne.

  Csáky Pál (PPE). - Elnök úr, szeretném megköszönni Wałęsa kollégának is az elvégzett munkát. Üdvözlöm a tisztelt Ombudsman asszonyt, és sok sikert kívánok a munkájához! Azért kértem szót a vitában, hogy megerősítsem a parlamenti jelentésben leírtakat. Fontos ugyanis hangsúlyoznunk, hogy az európai ombudsman intézménye kulcsfontosságú intézmény, amely az uniós demokrácia megerősítését szolgálja. Az uniós polgároknak a választások során emberközelibb Európát ígértünk, ezen ígéretünk megvalósításához elengedhetetlen az uniós polgári jogok erősítése és tiszteletben tartása. A végső cél ugyanis nem más, mint az Európai Unióba vetett bizalom megerősítése, és ha ez sikerül, akkor mindannyian sikert értünk el. És ha az ombudsman munkája során eléri azt, hogy az európai uniós intézmények hatékonyabbá és polgárközelibbé válnak, azt mindannyian sikerként értékelhetjük majd, és kedves Ombudsman asszony, ezen az úton természetesen számíthat mindannyiunk támogatásával.

Üdvözlöm azt a tényt is, hogy az ombudsman 2019-ig szóló stratégiájának egyik pillére a „láthatóság” fogalma. Közép-európai képviselőként úgy látom, hogy ez az egyik legnagyobb kihívás: láthatóvá tenni, érzékelhetővé tenni az uniós jogokat és ezen belül az európai ombudsman szerepét. Mindent meg kell tennünk annak érdekében, hogy üzenetünk elérjen a polgárokhoz. Ezért fontos például a dokumentumok több nyelven történő elérhetővé tétele. Ezen az úton is tovább kell haladnunk, kedves Ombudsman asszony, és mindezt nem azért mondom, hogy Ön és a hivatala munkaterheit növeljem, hanem azért hogy az Európai Unió minél több tudatosan cselekvő, tájékozott polgár közössége lehessen.

Én azt szeretném, tudni, hogy ha pár szóban meg tudná világítani, hogy melyek ezek a tipikus közép-európai problémák, amelyek az európai ombudsmant érintik, hiszen én magam is Közép-Európából származom, és érzem, hogy azért van különbség Európa különböző régiói között.

  Csáky Pál (PPE), Kékkártyás válasz. – Elnök úr, szeretném a következőt válaszolni. Közép-Európa fogalma alatt, Kelet-Közép-Európa fogalma alatt elsősorban a posztkommunista országokat értem. Azért mondtam azt, hogy nagyon fontos, hogy az ombudsman szerepe is és az emberi jogok szerepe is nyilvánvalóvá váljon az emberek előtt, mert másképp szocializálódtak a volt kommunista országokban élő emberek. Nem annyira fejlett a demokratikus érzékük, mint a nyugat-európai országokban, ahol nem volt 40-50 évig tartó megszakítás. Ezért gondolom azt, hogy kiemelten fontos az, hogy mi, a 2004-ben csatlakozott tíz tagállam képviselői és polgárai jobban tudatosítsuk ezt és beszéljünk otthon a médiában is ezekről a kérdésekről.

  Jude Kirton-Darling (S&D). - Mr President, I welcome today’s report, as it emphasises the crucial role that the Ombudsman has to play and the importance of her three key pillars for the next five years: relevance, visibility and impact.

The EU can sometimes appear as a faceless bureaucracy, and as parliamentarians we share a common duty with the Ombudsman to make European democracy a tangible reality. Our Ombudsman has been leading from the front in this regard as her actions, particularly on TTIP, demonstrate. A lack of transparency in the TTIP negotiations has generated tremendous frustration across Europe; it only reinforces people’s concerns. Our Ombudsman has responded proactively, investigating, requesting and obtaining greater transparency. This achievement bears testimony to the commitment and efficiency of our Ombudsman. I will be voting for this report today as a sign of my support and recognition.

  Heinz K. Becker (PPE). - Herr Präsident, Frau Bürgerbeauftragte, Herr Vizepräsident, verehrte Kolleginnen und Kollegen! Vorneweg meine Gratulation und Dank an den Berichterstatter Wałęsa für den exzellenten Bericht, den wir ja in der EVP-Fraktion vollinhaltlich stützen.

Als Mitglied des Petitionsausschusses dieses Europäischen Parlaments möchte ich ausdrücklich betonen, dass wir in Europa darauf stolz sein können, dass wir eine Institution wie die Europäische Bürgerbeauftragte haben – als direkten Ansprechpartner aller 500 Millionen europäischer Bürger. Es ist nachweislich und erfolgreich Beschwerden über die Arbeitsweise von Behörden und Verwaltungen nachgegangen worden, und es konnte Kontrolle ausgeübt werden und nachweislich in den Ergebnissen Verbesserungen und Änderungen in der EU eingeführt werden.

Ich begrüße in diesem Zusammenhang auch die von der Bürgerbeauftragten und ihrem Team initiierten Untersuchungen zum Thema „Ethisches Verhalten und transparente Lobbyarbeit“. Der vorliegende Jahresbericht zeigt, dass diese Themenfelder ganz oben in der Problemliste der Bürger stehen. Ich glaube, dass die Bestrebungen von Frau O´Reilly, die Einrichtungen der Bürgerbeauftragten noch zugänglicher zu machen, zu unterstützen sind. Przede wszystkim obraz, który mamy ze sprawozdania Pani, rysuje się jako obraz po prostu pozytywny i to był dobry powód, dlatego że pan poseł Wałęsa przygotował również bardzo przyzwoite sprawozdanie. Tak więc, jeżeli można, w nurcie dyskusji dwa momenty, które tutaj padły.

Moment pierwszy, pytanie, że Pani Rzecznik dobrze funkcjonuje, pomimo że nie jest prawnikiem. Dodajmy, że symbolem prawa jest Temida. Temida ma zasłonięte oczy. Pani ma mieć oczy otwarte, bo Pani reprezentuje interes obywateli! I dobrze, że Pani nie jest prawnikiem.

Padł także drugi zarzut, że we Francji to są dziesiątki tysięcy rozpatrywanych spraw. Pani poinformowała tylko zaledwie o kilkuset rozpatrywanych. Po pierwsze, Pani nie może sobie zamawiać tysięcy, żeby wpływały, i uzasadniać Pani istnienie. Ba, co więcej, gdyby żadna sprawa nie wpłynęła, dalej racja bytu rzecznika praw obywatelskich jest ze wszech miar uzasadniona, bo Pani ma być reprezentantem obywateli, ale także swoistym strażnikiem przestrzegania standardów przez Komisję Europejską.

Senhora Provedora, partilho da opinião dos meus colegas e, em particular, do meu colega Wałęsa, que a felicitaram pela excelência do trabalho que tem levado a cabo. Gostaria de recordar o seu antecessor, Nikiforos Diamandouros, que nos deixou um extraordinário legado.

A instituição que representa reveste-se de extrema importância. O bom funcionamento da administração pública é não apenas um pilar fundamental de um sistema democrático, como um direito dos nossos cidadãos e o facto de mais de 23 000 cidadãos se terem dirigido ao Provedor de Justiça é revelador não só desta importância, mas também da confiança que nele depositam.

No ano de 2013 vi com muito agrado o relatório especial relativo à Frontex, que deve servir de encorajamento para a abordagem sistémica que pretende imprimir em certos inquéritos. Aliás, é com muita expectativa que espero resultados da sua estratégia rumo a 2019.

Foram, no entanto, as questões de transparência que dominaram 2013. Vimos recentemente com a Europol que esses problemas persistiram em 2014. Espero, por isso, que a sua ação futura se dedique intensamente a este tema. Não posso estar mais de acordo consigo que é intolerável que acordos internacionais permitam a Estados terceiros limitar os poderes das nossas instituições, poderes que estão fixados nos Tratados, ou criar obstáculos ao livre exercício das suas competências.

Espero que continue a trabalhar afincadamente. Obrigado. Continuação de bom trabalho.

  Vilija Blinkevičiūtė (S&D). - Dėkoju pranešėjui, o taip pat ombudsmenei už pristatytą jos pirmąjį metinį pranešimą ir už tą atliktą darbą padedant stiprinti atskaitomybės ir skaidrumo struktūras ir institucijas Europos lygmeniu, bei skatinant iš tiesų tinkamą administravimą kiekvieno Europos Sąjungos piliečio labui. Labai vertinu ir tai, kad pranešimą be tradicinės popierinės versijos dabar galima gauti ir persiunčiamą interaktyvią versiją. Tai išties daro Europos ombudsmeno instituciją prieinamesnę, patrauklesnę vartotojams ir šia linkme reikėtų dirbti ir toliau ir tuo pat metu nepaliekant užribyje ir tų mūsų piliečių, kurie galbūt dar neturi galimybės naudotis internetu. Vertinu ir ombudsmenės gerą bendradarbiavimą su Parlamentu, ypatingai su Peticijų komitetu. Žinoma, pozityvu yra tai, kad 2013-ais metais skundų dėl Europos personalo atrankos tarnybos sumažėjo, tačiau nerimą kelia tai, kad skundų padaugėjo dėl Komisijos ir dėl Europos Sąjungos agentūrų, todėl labai prašau ponią ombudsmenę įsigilinti dėl kokių priežasčių tai atsitiko ir kokių priemonių mes bendrai turime imtis? Iš tiesų, labai svarbu yra skaidrumas, atvirumas ir galimybė gauti informaciją mūsų piliečiams.

  Емил Радев (PPE). - Искам да поздравя омбудсмана Емили О'Райли за ключовата роля в правенето на работата на Европейските институции по-разбираема и прозрачна, а европейската администрация по-ефективна за всички европейски граждани, включително българските. Отделният доклад за доброто административно управление е важно нововъведение към годишния доклад и бих искал да насърча г-жа О'Райли той да се е превърне в традиция.

Бих искал да отправя две препоръки. На първо място, бих искал да призова офиса на омбудсмана да задълбочи сътрудничеството си с европейските омбудсмани в рамките на Европейската мрежа на омбудсманите. Вярвам, че обмяната на опит и успешните практики между г-жа О'Райли, националните и регионални омбудсмани неминуемо ще допринесе до повишаване качеството на услугите на националните администрации в различните страни и на европейските институции.

Второ, бих искал да я насърча да посвети още повече усилия за защита правата на хората с увреждания и да гарантира, че администрацията на Европейския съюз е запозната с отговорностите си по отношение на тези права. Считам, че ролята на Европейския Омбудсман е централна в новосъздадената мрежа на Европейския съюз за наблюдение на прилагането на член 33, параграф 2 от Конвенцията на ООН за правата на хората с увреждания. Считам, че е наше задължение като европейски законодатели също да гарантираме, че хората с увреждания могат достойно и пълноценно да се ползват от своите права и свободи на европейски граждани.

Последната ми препоръка към Вас е да обърнете специално внимание на прилагането на европейското законодателство по отношение на третирането на животните в държавите членки и по-конкретно да проучи дали Европейската комисия и държавите членки спазват задълженията си по директивата за зоологическите градини, регламента за защита на животните по време на тяхното транспортиране, както и регламента за защита на дивата флора и фауна. Решението на Омбудсмана относно ненужните лабораторни тестове върху животни и необходимостта от по-добра координация от страна на Европейската агенция по химикалите е първа стъпка в тази насока.

Mi mindannyian egyetértettünk itt abban, hogy az ombudsmani intézmény az egyik legfontosabb európai intézmény, és abban, hogy O'Reilly asszony egészen nagyszerű munkát végzett az elmúlt időszakban. Ez az intézmény az, amelyik védi az európai polgárok jogait, ez az intézmény az, amelyik kiáll az európai intézmények kiszámíthatósága és átláthatósága mellett, és ezáltal a demokrácia minőségének a javításán dolgozik. Engedje meg O'Reilly asszony, hogy fölhívjam a figyelmét arra, mennyire fontos, hogy mindazoknak a jogait, emberi méltóságát is képviselje az Ön intézménye, akik a társadalom peremére szorultak. Azok, akiknek nincs erős politikai érdekérvényesítő képességük. Arra kérem Önt és az Ön intézményét, hogy a befogadó Európa jegyében fokozott gonddal figyeljen ezeknek az embereknek a jogérvényesítő képességére, álljon ki a jogaik és az emberi méltóságuk mellett!

  Tomáš Zdechovský (PPE). – Pane předsedající, děkuji panu Diamandourosovi a paní

O'Reillyové za výsledky jejich úřadů. Jako nový europoslanec jsem si prošel výroční zprávu, protože jsem chtěl vědět, jak hodně se Evropská unie zabývá transparentností, etickými otázkami, základními právy a celkovým zapojením občanů do politiky Evropské unie. Musím říct, že mě aktivita evropského ochránce práv příjemně překvapila. I proto jsem Vás, paní O´Reillyová, podpořil při získání dalšího mandátu. Žádná instituce Evropské unie nemůže být úspěšná bez silné, pracovité a charizmatické osobnosti, kterou jste prokázala během svého mandátu i během slyšení.

Samozřejmě má paní ombudsmanka před sebou řadu úkolů, které je potřeba co nejrychleji implementovat, aby se její orgán stal přístupnější především pro evropské občany. Jako strážci transparentnosti by se paní O´Reillyová a její úřad měli také více podílet na transparentnosti v rámci vyjednávání základních směrnic, jako je třeba příklad TTIP.

A závěrem mi dovolte, paní ombudsmanko, jednu úsměvnou poznámku. Ve zprávě konstatujete, že výroční zpráva za rok 2013 doznala nové podoby a že je ke stažení i interaktivní verze ve formě elektronické knihy. Já osobně tento „pokrok“ považuju ve 21. století za úsměvný a žádám, aby pro příští období byl prováděn automaticky. Přeju všechno dobré.

  Alberto Cirio (PPE). - Signor Presidente, onorevoli colleghi, anch'io voglio congratularmi con il lavoro che è stato svolto dalla Mediatrice, che è stato svolto dal suo ufficio, e credo che da una lettura approfondita della relazione si evincano con chiarezza alcuni elementi che sono di profonda soddisfazione. Anch'io sono un nuovo deputato e vengo qua al Parlamento con il desiderio di vedere un'Europa aperta, un'Europa permeabile, un'Europa con cui i cittadini, specie i più piccoli, i più semplici, i più deboli, possano parlare.

Vedo con grande favore, grande positività il fatto che questo ufficio e il ruolo della Mediatrice stia diventando sempre di più un riferimento costante nella vita delle persone. A volte quando si guarda all'Europa si pensa a qualcosa di lontano, con cui sia difficile parlare, come un mostro di burocrazia. Ecco perché questo ruolo è estremamente importante, perché è la prova concreta che non è così, perché è la prova concreta che invece questa è un'Europa in cui se si vuole conoscere, si può conoscere, se si vuole sapere si può sapere, se si vuole la trasparenza si può avere la trasparenza.

  Csaba Sógor (PPE). - Madam President, I take this opportunity to raise two elements that are of great importance. The first is that of overall transparency and accessibility, if information needs to be increased and if we want to keep, or indeed restore, the reputation of our institutions. Secondly, I want to suggest a greater focus, in the work of the Ombudsman, on the struggle of traditional minorities in Europe. Specific measures should be developed to inform these communities, which account for 8% of European citizens, about the work of the Ombudsman. Their rights as enshrined in the EU Charter and the Council documents, and especially their vulnerability, should be kept in mind.

I therefore call on Ms O’Reilly to undertake an own-initiative inquiry on the subject of persons belonging to traditional minority communities and their access to information provided by the European institutions, along the same lines as a past own-initiative inquiry that focused on people with disabilities. It would be extremely useful to verify how sensitive the Commission is in its dealings with these issues.

  Nicola Caputo (S&D). - Signor Presidente, onorevoli colleghi, mi congratulo con la Mediatrice O'Reilly per il lavoro svolto. Le statistiche relative al ruolo svolto dal Mediatore europeo registrano una partecipazione in un dialogo diretto con i cittadini significativi ma sicuramente migliorabili. Accolgo con favore una serie di importanti indagini che il Mediatore ha avviato come l'indagine in materia di trasparenza dei negoziati TTIP e CETA, la segnalazione di illeciti da parte di dipendenti nelle istituzioni dell'UE e la trasparenza nei gruppi di esperti della Commissione. Per le istituzioni ciò implica un ulteriore stimolo al rispetto dello Stato di diritto, dei principi di buona amministrazione e dei diritti fondamentali, operando un dialogo amministrazione cittadino basato sulla mediazione, senza ricorso alla fase giudiziale rappresentando un'opportuna valvola di decompressione della litigiosità in rapporto con le istituzioni.

Penso anche che i social media come canale per la comunicazione siano essenziali e incoraggio quindi gli uffici del Mediatore ad avvalersi maggiormente di questi strumenti per sensibilizzare l'opinione pubblica sulle attività del Mediatore e rendere la sua attività più fruibile. La fiducia nei cittadini verso le istituzioni è essenziale nel difficile contesto congiunturale, ben venga quindi la nuova strategia verso il 2019 con la proposizione di indagini sui problemi di impatto e di pertinenza e di visibilità e mi associo al desiderio di vedere il Mediatore come custode della trasparenza dell'Unione.

Ich möchte Ihnen, Frau O’Reilly, mein Kompliment machen und mich auch bedanken, auch für den Haushaltskontrollausschuss, für eine wirklich gute Zusammenarbeit. Sie sind ein starker Punkt und ein starker Pfeiler für Glaubwürdigkeit und eine ganz wichtige Anlaufstelle, nicht zuletzt auch für EU-Beamte.

Sie haben im Jahr 2013 ein halbes Dutzend Verfahren in Sachen OLAF gemacht. Da ist auch noch nicht aller Tage Abend. Und Sie haben viel Einfluss – es stimmt ja nicht, was heute hier so gesagt wird, Sie haben viel Einfluss! Wieviel Einfluss Sie haben – und wir sind dankbar dafür –, kann man ermessen, wenn man die letzte Entscheidung des Jahres 2013 nimmt, nämlich den Ad-hoc-Ethikausschuss und den Vorsitz. Die Kommission hat sich zwei, drei Jahre nach Parlamentskritik nicht bewegt, aber nach Ihrem Bericht hat sie sich bewegt. Auch dafür herzlichen Dank.

Herr Vizepräsident Timmermans, da stellen sich viele Fragen nach lessons learned. Es wäre schön, wenn es nicht immer irgendwelcher langer Verfahren bedürfte, sondern es selbständige Reaktionen der Kommission gäbe. Das würde ich mir heute wünschen.

Ombudsman, I would like to bring to your attention a matter that has been totally ignored by the Irish and the European media: the destruction of thousands of millions of euros. It began in March 2011, when three billion was destroyed, and resumed last year with the destruction of a further one billion in two tranches of 500 million each. This obscenity is the legacy of the bail-out in 2010 of the failed institutional investors in two failed non-systematic Irish banks. It served its purpose, bought some time for the euro, prevented the onset of the feared contagion had those banks been allowed to fail.

There was a fall-out, however. The insistence by the ECB that, because the Irish Central Bank printed that money, that must now be taken back into circulation. So you have this obscene situation where a broke, hugely indebted country, where the austerity programme has already wrought havoc, especially among those who can least afford it, is forced to borrow thousands of millions to destroy. The social repercussions of the bank bail-out cost in Ireland have been horrendous: record numbers lying on trolleys; growing numbers suffering from depression; growing numbers taking their own lives; a quarter of a million emigrating. I ask you, please, as a priority, to have a look at this abomination. You talk about confidence in the European institutions; people in Ireland cannot have confidence until this changes.

  Milan Zver (PPE). - Zahvaljujem se kolegu iz skupine Evropske ljudske stranke poročevalcu Jarosławu Wałęsi za pripravo uravnoteženega poročila o dejavnostih evropske varuhinje človekovih pravic Emily O'Reilly ter njenega predhodnika.

Delo varuhinje je pomembno, saj državljanom Evropske unije daje možnost pritožbe v primeru, da evropske inštitucije kršijo zakonodajo in pravila. Žal pa se veliko več kršitev zgodi v državah, v nacionalnih ustanovah, kot pa v evropskih.

Ob hudem kršenju človekovih pravic v državah članicah se morajo državljani Evropske unije obrniti na sodišče v Strasbourgu, na inštitucijo Sveta Evrope. Evropska unija je pri teh vprašanjih popolnoma nemočna in dosedanja prizadevanja, da se stvari na tem področju izboljšajo, so zelo počasna.

Vesel sem, da obstaja Evropski varuh človekovih pravic, a žal ime te inštitucije daje preveč prazno upanje. Potrebujemo pravega polnomočnega Evropskega varuha človekovih pravic, ki se bo lahko odzval tudi na mnoge kršitve v državah članicah in celovito varoval človekove pravice in svoboščine v Evropski uniji.

  Ignazio Corrao (EFDD). - Signor Presidente, onorevoli colleghi, io volevo complimentarmi sia con il relatore, con il collega Wałęsa, che con la Mediatrice, la sig.ra O'Reilly, e volevo porre un augurio per il futuro lavoro che l'aspetta durante questa legislatura, perché è vero che il punto di partenza è positivo per quanto riguarda la funzione del Mediatore europeo, ma è anche vero che dobbiamo cercare di fare di più e ha ragione il collega Cirio quando dice che per i cittadini europei, spesso e volentieri, l'Unione europea viene vista come una cosa esterna, lontana, difficile da comprendere e da raggiungere quindi, probabilmente, se riusciamo a centralizzare e ad utilizzare bene la figura del Mediatore europeo gli stessi cittadini possono sentirsi più vicini a quest'istituzione e possono comprenderne meglio la funzione. In tal senso, dovremmo cercare di pubblicizzare, di rendere più conoscibile e più facile l'accesso del normale cittadino, che non si interessa di politica internazionale, a quelle che sono le denunce e le possibilità di accedere al Mediatore.

  Frans Timmermans, Member of the Commission. - Madam President, I have listened carefully to the Members’ contributions and I have a number of reactions on some of the points made.

First of all, this Commission is strongly committed to improving transparency and accountability. We have taken measures to that effect in the first weeks of coming into office. Obviously this is not reflected in the report about 2013, which is now two years ago. So, if you want to hold us accountable, also hold us accountable on our actions. I am glad to be accountable in that respect, and I would actually urge this Parliament to follow the example the Commission has set on transparency – for instance, on contacts with lobbyists. This is something on which Parliament could follow suit, and that would be my suggestion.

Secondly, I note that we still need to do much to improve our situation. I would not agree with those of you who have argued that the situation in national administrations is better than at European level. There are many Member States where the levels of transparency and accountability are not the same as in the Commission and the other EU institutions, but still I do acknowledge that we need to improve the situation and I will work very closely with the Ombudsman to that effect.

I also want to point to the fact that, in relation to the Transatlantic Trade and Investment Partnership, we did exactly what the Ombudsman required, and I thank her as well as Mr Wałęsa for acknowledging that. I also acknowledge that most complaints are about the Commission, and that is because most of the legislation and decisions affecting citizens directly are indeed acts taken by the Commission. So there is a correlation with the fact that we are the biggest institution and that we have the most effect on citizens: citizens will then complain. I want to try and increase, as much as I can, the level of compliance with the Ombudsman’s recommendations. As pointed out before, we are at 84%, which is the highest level among the institutions. I will try to get it even higher, with the proviso that, in certain cases and for legal reasons, we may not always be able to implement the recommendations of the Ombudsman.

In conclusion, let me say that I am very much looking forward to working closely with Ms O’Reilly and her team. They are making a strong contribution to creating a more accountable Europe, a more transparent Europe and a Europe that is closer to its citizens.

  Emily O’Reilly, Ombudsman. - Madam President, honourable Members, I would like to thank you all very much for your contributions and the thought that you have brought to them. I take everything that you say on board. I take the compliments, obviously, but I also take the criticism because, without feedback from you, who are even closer to the people than I am, I cannot really know what their true concerns are. I see you as a very valuable resource in relation to that. There were many issues raised, and obviously I cannot deal on an individual basis with all of them, although of course you are more than welcome to come to me as individual MEPs and discuss any matter that you want. But there are a number of general issues that I want to discuss.

A lot of you talked about the visibility of the office. I hope that I am demonstrating that this is certainly a priority for me and that, if people do not know that I am here, the service that I can provide for them is fairly redundant. I have made a very big effort to make the office more visible through a number of techniques.

What is also very important – and some of you have alluded to this – is your own national ombudsmen, Member State ombudsmen, the Petitions Committee or regional ombudsmen and the work that I can do to improve that. As you probably know, as European Ombudsman, I chair the European Network of Ombudsmen, and just yesterday I had a strategy meeting in relation to how they can help me. Equally I can also help them with their own situations. Two of the things I am doing include, for the first time next year, producing an annual report on the work of the Network, in which I will highlight not just my own work but also the work of the Member State ombudsmen. Hopefully, if they agree with this, then they too can present that alongside their annual reports to their respective parliaments.

I am also just about to start for the first time a joint investigation with a number of Member State ombudsmen in relation to Frontex, on one particular element of their work which is bringing people back, i.e. deporting people from countries. We are going to be looking at how Frontex deals with human rights issues that arise in the context of those flights. So for the first time, the European Ombudsman is working with Member State ombudsmen, we are pooling our resources in our respective jurisdictions in order to make an even bigger impact on that. I will be looking for more areas in which to work on that.

Some of you have challenged me and my office in relation to compliance, and also challenged the Commission and the agencies. I set my own challenges as well. Right from the start, I have said that the compliance rate of 80% + is not high enough, because in many Member States, including my own – Ireland – the compliance rate for the recommendations of the Ombudsman is often as high as 95% or even 100%. That is a very high target, but it is one that I will strive to achieve.

In relation to effectiveness, a lot of you have pointed to the fact that many of the complaints that come before me are outside of my remit. Obviously most complaints that European citizens have are with their Member States, but one of the functions of the office is to be as helpful as possible and to direct anybody who comes to us to where they can have their problem resolved. But this is partly why I have begun to focus very intensively on the own-initiative investigations, to see what systemic issues I can deal with which my office and the resources that I have can add greatest value to.

I suppose my overall ambition for the office is simply to be useful – more useful to the citizen, more useful to Parliament, more useful to the Commission and so on. To do that, I need to collaborate with you. You have to support me if you find that my recommendations are rational and that you wish to support them, because without your help I cannot succeed as I might. I also need to collaborate well with the Commission and with the agencies. They have to trust me, just as the citizens have to trust me.

So I thank you all for your contributions. I will take them on board. I just want to make one point about the Troika. Many people have come to me over the last year to see what I can do to investigate the Troika. The Troika is not an EU body per se, even though the ECB and the EU Commission are critical parts of it. What I have said to individual MEPs is that, if they wish to work with me and if there is a particular issue or facet of the work of the Troika, as it relates to an EU institution, that they feel I could legitimately investigate, then that is something that I would be very happy to do. At the moment, as the Irish Members know, there is an investigation into the banking collapse and the financial crisis in Ireland. They are trying to get the ECB over to explain itself to the Irish people, and we will see how that evolves.

This annual report refers to the year 2013; there are lot of issues that came up last year which are going to be addressed in future annual reports, so maybe the debate on this report is not the place to address these. Le médiateur est également un fidèle relais entre les institutions et les citoyens européens. Le projet européen ne peut pas uniquement se construire à Bruxelles. Tous les citoyens doivent pouvoir être en mesure de porter une pierre à l'édifice qu'est l'Union européenne. Je félicite Monsieur Diamandouros et Madame O'Reilly pour leur action en 2013.

  Barbara Kudrycka (PPE), na piśmie. W ciągu zaledwie ostatniego roku rzecznik podjął działania w 2 354 przypadkach, a aż 19 418 osób otrzymało porady za pomocą interaktywnego przewodnika znajdującego się na stronie internetowej, co świadczy o skuteczności systemu umożliwiającego szybkie odpowiadanie na skargi obywateli. Ze sprawozdania wynika jednak, że w dalszym ciągu dostęp do dokumentów instytucji unijnych oraz przejrzystość niektórych procedur są niewystarczające, biorąc pod uwagę, że aż 25,6 % zamkniętych dochodzeń było z tym związanych. Na szczególną uwagę i pochwałę zasługuje opublikowanie nowego wydania Europejskiego Kodeksu Dobrej Praktyki Administracyjnej. Wszystkie instytucje unijne powinny wdrożyć zasady tego kodeksu i w pełni ich przestrzegać, a nowo powołana Komisja powinna przyjąć wspólnie wiążące zasady postępowania administracyjnego dla struktur administracji UE oraz przedstawić projekt rozporządzenia w tej sprawie.

Na szczególną aprobatę zasługuje kilka ważnych dochodzeń wszczętych przez rzecznika: przede wszystkim postępowanie w sprawie odmowy Europejskiej Agencji Zarządzania Współpracą Operacyjną na Zewnętrznych Granicach Państw Członkowskich Unii Europejskiej (Frontex) wprowadzenia w życie mechanizmu składania skarg, co skutkowało specjalnym sprawozdaniem pani rzecznik, dochodzeniem dotyczącym przejrzystości w negocjacjach transatlantyckiego partnerstwa handlowo-inwestycyjnego (TTIP) oraz poinformowaniem o nieprawidłowościach w instytucjach UE. Chciałabym pogratulować pani O’Reilly udanej misji na rzecz zwiększenia przejrzystości w instytucjach oraz pogłębiania dialogu z obywatelami oraz ich skutecznego informowania w kwestii pełnego korzystania z przysługujących im praw.
