Πρόεδρος. – Το επόμενο σημείο στην ημερήσια διάταξη είναι η συζήτηση σχετικά με την έκθεση για την πρόταση κανονισμού του Ευρωπαϊκού Κοινοβουλίου και του Συμβουλίου όσον αφορά την ίδρυση οργανισμού της Ευρωπαϊκής Ένωσης για την παροχή κατάρτισης στον τομέα της επιβολής του νόμου (ΕΑΑ) και για την κατάργηση και την αντικατάσταση της απόφασης 2005/681/ΔΕΥ του Συμβουλίου, της Kinga Gál, εξ ονόματος της Επιτροπής Πολιτικών Ελευθεριών, Δικαιοσύνης και Εσωτερικών Υποθέσεων (COM(2014)0465 - C8-0110/2014 - 2014/0217(COD) (A8-0048/2015))

  Kinga Gál, előadó. – Biztos Úr! Kedves Kollégák! Szeretném kifejezni örömömet, hogy mindössze egy évvel a jogalkotási folyamat megkezdése után az Európai Parlament holnap végszavazást tart az új CEPOL-szabályozásról. A folyamat gördülékeny lezajlásáért szeretnék köszönetet mondani minden árnyékjelentéstevőnek, különösen Flasikova-Benova asszonynak, akinek a támogatása és együttműködése jelentős segítséget nyújtott a tárgyalások során. Hasonlóképpen nagyra értékelem a lett elnökség munkáját, külön köszönet Indra Bule asszonynak, aki konstruktív megközelítésével és proaktív hozzáállásával segítette végig a háromoldalú tárgyalásokat.

Mindnyájan tudjuk, hogy az Unió belső biztonságát komoly kihívások érték az utóbbi időben, és hasonlóaknak nézhetünk elébe a jövőben. Ezért égető szükségünk van megfelelően képzett rendfenntartókra, bűnüldöző szervekre, akik összeurópai szinten is képesek gyorsan és hatékonyan reagálni olyan kihívásokra, mint a határon átnyúló bűnözés, az internetes bűnözés, a terrorizmus. Olyan rendfenntartókra van szükség, akik a mai migrációs krízisben is képesek teljes szakmai profizmussal fellépni. Tehát a CEPOL eszközéül szolgálhat a professzionalizmus kultúrájának a hivatásos rendfenntartók közötti megszilárdítására, erősíti a tagállamok közötti kölcsönös bizalmat és a határon átnyúló együttműködést. Hozzájárulhat egy olyan valódi európai rendfenntartó kultúra megvalósításához, amely az alapvető jogok és az európai értékek tiszteletben tartásán alapul. Mi itt a Parlamentben ezért hiszünk abban, hogy egy modernizált, hatékony, önálló és megfelelő személyi állománnyal működő CEPOL ügynökség léte életbevágó.

A társjogalkotókkal folytatott tárgyalások során fontos szempont maradt, hogy a CEPOL alapkiépítése – a nemzeti rendőrakadémiákra való támaszkodása és a velük való szoros együttműködés – változatlan maradjon. Amilyen hamar csak lehetett, a CEPOL-nak a Szerződéseknek megfelelő felhatalmazással és mandátummal kellett bírnia. A CEPOL irányítási struktúráját működőképessé tettük, figyelembe véve azokat a javaslatokat, amelyek az új Europol Szabályozás keretrendszerével összefüggő vita során elhangzottak. Hiszünk abban, hogy ezzel az új szabályozással megteremtettük azokat a feltételeket a CEPOL számára, amelyek révén hozzájárulhatnak egy valódi európai rendfenntartó kultúra kiépítéséhez.

Ez az új szabályozás, amelynek a megszavazása előtt állunk, korszerűsíti a CEPOL jogi alapjait. Összhangba hozza a Lisszaboni Szerződés módosításával és megbízza a CEPOL-t a Bizottság által 2013. márciusában javasolt bűnüldözési és rendőrképző program elveinek gyakorlatba ültetésével. Ennek magában kell foglalnia az uniós szintű stratégiai képzés szükségleteinek felmérését, a képzések akkreditációját, a közös tananyagot, a pozitív példák megosztását, valamint annak a minimális tudásanyagnak az azonosítását, amelyet minden rendőrakadémiának be kell emelnie az oktatási programjába. Tehát a CEPOL-nak képesnek kell lennie arra, hogy uniós szintű képzést és oktatókat biztosítson.

Az elmúlt években a CEPOL-ra mindenki mint hálózatra tekintett. Egy hálózat ugyanakkor nem jogi személy és nem is elszámoltatható. Pontosan ezért volt szükség arra, hogy a CEPOL az Unió ügynökségévé váljon, világos felhatalmazással, feladatokkal, felelősséggel és ami a legfontosabb, elszámoltathatósággal.

Ami az adófizetők pénzének felhasználást illeti, a CEPOL hosszú utat tett meg, hogy bizonyítsa költséghatékonyságát. Megötszörözte a képzéseiben részt vevők számát, a képzései iránti kereslet növekszik, és ehhez lesz majd érdemes igazítani a költségvetését. Ezért továbbra is szorgalmazni a fogjuk a megfelelő források biztosítását, ami szükséges előfeltétele egy jól működő uniós ügynökségnek, és az átfedések megszűntetését más uniós intézményekkel. Ezért kérem a támogatásukat a holnapi szavazáson ehhez az intézményhez.

  Dimitris Avramopoulos, Member of the Commission. – Mr President, let me start by thanking the rapporteur, Ms Kinga Gál, who has worked very hard to find common ground among the shadow rapporteurs and to expedite the adoption of the regulation.

When it comes to the substance of the reform of CEPOL, we can all welcome the final outcome, as this would reinforce CEPOL’s ability to prepare police officers to cooperate effectively, to develop a common law enforcement culture and to become the centre of excellence of training of law enforcement officers in the European Union.

Training is key in this respect. The European Agenda on Security underlines that this is an essential element to enhancing the security of our Union. Training is essential to allow authorities on the ground to utilise our law enforcement cooperation tools in an operational situation. The CEPOL regulation is an evolution rather than a revolution. The network-based character of CEPOL is maintained. The agency will continue to bring together the network of training institutes of the Member States and liaise with a single national unit in each Member State.

CEPOL is now entrusted with the task of coordinating the implementation of the law enforcement training system. The overall objective of the scheme is to present a coordinated policy approach ensuring high-quality training for law enforcement officials. This new role widens the opportunities for CEPOL to support, develop, deliver and coordinate training for law enforcement officers of all ranks, and not just senior officers.

The reform also provides for the professionalisation of CEPOL’s management. The members of the management board will be appointed taking into account their knowledge of training for law enforcement officers, and they will be assisted by a scientific committee for training to further ensure the quality and coherence of training programmes. CEPOL’s work will come in addition to the welcome initiative taken by the Member States in the field of training for law enforcement personnel.

I am also very encouraged by the strong role ensured for the European Parliament in this CEPOL regulation. Parliament will receive the agency’s annual planning documents, and is the budgetary authority for all EU bodies. In addition, the management board shall consult Parliament on CEPOL’s multiannual work programme. The idea is to provide the opportunity for a strategic debate on the direction the agency should take. The Parliament will also receive all activity reports and accounts and all evaluations commissioned. The director of CEPOL will additionally report to the Parliament on the performance of his duties when invited to do so.

That said, the Commission has misgivings on two central aspects of this reform, and this comes before us today. These two aspects are the governance of the agency and respect for the European Union’s budgetary principles, which are of course very important for the Commission. On both these aspects, the outcome of the negotiation process is not in line with what the Commission has proposed or with the trilaterally-agreed common approach on EU decentralised agencies.

Let me take this opportunity to recall the institutional commitment to use such revisions of the agency’s founding acts – as with CEPOL and Europol – as opportunities to implement and to comply with the common approach. This common approach includes the reinforcement of the supervisory role of the management board, including by ensuring full participation by the Commission, ensuring a transparent selection procedure for directors and the necessary adoption of programming document with a multiannual component, the possible setting up of an executive board to ensure more assured more efficiency and the obligation to better follow-up of evaluations and audits.

The Commission regrets the lack of political commitment to ensure respect for the common approach on EU decentralised agencies, in particular regarding the role and composition of the agency’s management structures. On these two points the Commission wants to table a statement to make clear its position. I would ask you, therefore, to add the Commission’s statement to the minutes of this meeting. So allow me now to proceed to the reading of the Commission statement:

‘The Commission takes note of the political agreement reached between the

European Parliament and Council. The Commission regrets that this agreement is not fully aligned with the principles of the Common Approach on the EU decentralised agencies nor with the financial rules applicable to these agencies and considers that the agreed text on the governance of the agency and on its funding is without prejudice to any future legislative texts. The possibility of funding part of CEPOL’s tasks through ad hoc grants or delegation agreements contradicts the fundamental principle that the tasks of an agency, as described in its constituent act, are financed by the annual contribution from EU budget and not through ad hoc grants or delegation agreements. The Commission underlines that the respect of this principle is essential to allow the budget authority to take an informed decision about the annual contribution foreseen for each agency in the annual budget. The Commission refers to the Framework Financial Regulation for agencies, which limits the possibility for agencies to receive funding through ad hoc grants or delegation agreements to exceptional cases, in line with the principle of transparency and sound financial management.’

  Jens Geier, Verfasser der Stellungnahme des mitberatenden Haushaltsausschusses. – Herr Präsident, verehrter Herr Kommissar, liebe Kolleginnen und Kollegen! Lassen Sie mich als ständiger Berichterstatter des Haushaltsausschusses für Agenturen einige grundsätzliche Aspekte hervorheben.

Wir hätten es nach wie vor sinnvoller gefunden, wenn der ursprüngliche Vorschlag einer Zusammenlegung von Europol und CEPOL eine Mehrheit gefunden hätte. CEPOL ist eine sehr kleine Agentur mit gerade einmal 27 Stellen im Stellenplan des Haushalts 2015. Agenturen dieser Größe müssen einen unverhältnismäßig großen Anteil ihres Personals für das notwendige administrative Rückgrat aufwenden, also Finanz- und Personalabteilung, IT, Logistik, Kommunikation und dergleichen, sodass der Teil des Personals, der im eigentlichen operationellen Bereich arbeitet, also an den Aufgaben, die in der Grundverordnung festgelegt sind, in keinem vernünftigen Verhältnis zur Gesamtstellenzahl steht.

Größere Einheiten sind somit sinnvoller und kosteneffizienter. Theoretisch könnte dies auch erreicht werden, wenn Agenturen, insbesondere solche, die in verwandten Themenbereichen arbeiten, sich diese administrativen Arbeitseinheiten teilen. Dafür wäre es allerdings hilfreich, wenn diese Agenturen dann am selben Ort angesiedelt werden. Leider wurde auch diese Chance durch die Entscheidung des Rates, CEPOL nach Budapest zu verlegen, zunichte gemacht. Ich begrüße deshalb, dass der federführende Ausschuss unseren Vorschlag aufgegriffen hat, dass die Kommission nach spätestens zwei Jahren eine Kosten-Nutzen-Analyse hinsichtlich des Sitzes vorlegen muss. Ebenso begrüße ich den Ansatz, auf weitergehende Kooperationen zwischen den diversen Agenturen im Bereich der Innen- und Justizpolitik zu drängen. Ich bin überzeugt davon, dass hier weitere Effizienzgewinne und thematische Spillover-Effekte erzielt werden können.

Ich will mich mit dieser Forderung aber keineswegs nur auf die Agenturen im Bereich der Innen- und Justizpolitik beschränken. Vielmehr glaube ich, dass wir auch in anderen Politikbereichen zu einer verstärkten Kooperation zwischen Agenturen kommen sollten. Und ich möchte die Kommission auffordern, bei anstehenden Änderungen von Grundverordnungen immer auch die Möglichkeit der Zusammenlegung oder auch der Straffung des Aufgabenbereichs in Erwägung zu ziehen. Denn eines geht nicht: Wir können nicht auf der einen Seite auf der Eigenständigkeit aller Agenturen beharren, ihnen zudem immer neue Aufgaben übertragen, und auf der anderen Seite von ihnen verlangen, dass sie all das mit immer weniger Personal bewerkstelligen sollten. Etwas mehr Ehrlichkeit in der Debatte über die Agenturen würde allen beteiligten Institutionen guttun.

  Tomáš Zdechovský, za skupinu PPE. – Pane předsedající, pane komisaři, vnitřní bezpečnost Evropské unie se stává stále důležitější stejně jako samotná bezpečnost evropských občanů. Nevím, zda zrovna samotný Cepol dokáže celou situaci vyřešit, ale jsem si jistý, že kvalitní a kontinuální vzdělávání policistů v oblasti prosazování práva povede nejen k efektivnějšímu boji proti přeshraniční a organizované kriminalitě, ale také k lepší spolupráci mezi jednotlivými národními složkami a to napříč celou Evropskou unií. A nejde jen o vymáhání práva tvrdou cestou, ale i o vzdělávání policistů v oblasti soft skills, jako je ochrana soukromí, údajů, práv obětí trestných činů či práv dětí, postižených a nemohoucích. Cepol je bezesporu agenturou, kterou musíme podporovat a vytvořit jí takové podmínky, aby její fungování bylo co nejvíce efektivní.

  Monika Flašíková Beňová, za skupinu S&D – Dovoľte mi v úvode, aby som sa poďakovala spravodajkyni pani Kinge Gál za vynikajúcu prácu, ktorú odviedla na tejto správe a za veľmi čestný súboj, ktorý zviedla v rámci trialógu za pozíciu Európskeho parlamentu.

V tomto kontexte teda vítam predmetný návrh, nakoľko to bol práve Európsky parlament, ktorý pri viacerých príležitostiach žiadal Komisiu, aby uviedla existujúci právny rámec agentúry Cepol do súladu s Lisabonskou zmluvou a novými ambíciami stanovenými v európskej schéme odborného vzdelávania v oblasti presadzovania práva.

Vysoká kvalita odbornej prípravy príslušníkov orgánov činných v boji proti trestnej činnosti alebo orgánov presadzovania práva je zásadná pre boj proti závažnej a organizovanej cezhraničnej trestnej činnosti a k tomu je nevyhnutná moderná a efektívna agentúra Cepol s dostatočným počtom zamestnancov.

Návrh nového nariadenia na reformu Cepolu prichádza v čase, keď je Európska únia v rámci ochrany svojej vnútornej bezpečnosti nútená čeliť stále novým nástrahám. Ich úspešné zvládnutie si bude vyžadovať rozšírenie právomoci akadémie a nepôjde tiež bez navýšenia finančných zdrojov.

Utečenecká kríza, ktorej čelí Európska únia a jej členské štáty, nám všetkým ukázala, že dopyt po kvalite policajných zložiek a spolupráca medzi jej zložkami v rámci jednotlivých členských štátov sa musí v budúcnosti zlepšiť, aby Európska únia dokázala lepšie čeliť krízovým situáciám a bola schopná ochrániť svojich obyvateľov.

Som preto presvedčená o tom, že agentúre Cepol by sa mali udeliť dostatočné právomoci, aby náležite koordinovala odbornú prípravu v oblasti presadzovania práva na úrovni Európskej únie a uplatňovala zásady zakotvené v schéme odbornej prípravy v oblasti presadzovania práva. To by malo zahŕňať určenie strategických potrieb v oblasti odbornej prípravy na úrovni Európskej únie.

  Timothy Kirkhope, on behalf of the ECR Group. – Mr President, criminals do not respect national legal jurisdictions. Cross-border criminality is a feature of the modern world of increased travel and new technology. The number of prosecutions of serious crimes that involve cross-border cooperation between law enforcement authorities must increase in future. And, as the Commissioner has said, good cooperation between law enforcement authorities across Europe is an essential tool in carrying out effective and expedient investigations, resulting in the capture and prosecution of criminals.

The European Union Agency for Law Enforcement Training (CEPOL) offers a valuable platform for the exchange of best practice and skill sharing for all law enforcement officers across the EU. When it comes to the training and running of national law enforcement authorities, account must always be taken of, and respect accorded to, national sovereignty, subsidiarity and the differing pressures and crime trends in Member States, and I believe that in the area of police cooperation the EU should offer the hand of support rather than compulsion.

I would like to thank my friend, the rapporteur, Ms Gál, for her hard work and I congratulate her on this report.

  Cecilia Wikström, för ALDE-gruppen. – Herr talman! Jag vill också tacka hela teamet av kolleger, föredraganden, kommissionen och så klart också ordförandeskapet, som tyvärr lyser med sin frånvaro här i dag. Vi har alla arbetat väldigt fint och konstruktivt under gångna år. Ibland har det varit hårda, ibland tuffa, diskussioner mellan oss. Nu är vi emellertid i mål, och jag tycker att vi alla ska vara glada över det som har skett.

Utmaningen blir nu att stärka samarbetet, att utbyta erfarenheter och bästa exempel mellan medlemsländerna och de olika rättsvårdande myndigheterna runtom i vår union. Naturligtvis beklagar jag det som vi som liberaler hade som en ledstjärna, nämligen att slå samman Cepol med Europol. Det hade inneburit positiva synergier, och det hade sparat mycket pengar för våra skattebetalare runtom i EU. Nu blev det dock inte så, och vi får inse att det var en majoritet som såg annorlunda ut.

Det som är särskilt positivt nu är att Cepol numera har i sina arbetsbeskrivningar och förutsättningar att stärka respekten för de grundläggande mänskliga fri- och rättigheterna och att ägna sig åt gränsöverskridande brottsbekämpande samarbete på ett annat och mer uppdaterat sätt. Som vi vet känner brottslingarna nämligen inte av några gränser mellan länderna, och då är det ju väldigt tokigt att inte våra rättsvårdande myndigheter ska kunna jobba åtminstone lika effektivt gränsöverskridande som de kriminella gäng som de är satta att bekämpa.

Nu finns det alltså förutsättningar. Jag tycker att vi lägger historien bakom oss och inser att vi har allt att vinna på att samarbeta ännu mer. Ännu en gång tackar jag alla berörda för ett fint samarbete.

  Bill Etheridge (EFDD), blue-card question. – I listened with interest about the greater cooperation that you suggest between the police forces in the different countries. How far would you take this? How far would this cooperation go before you decide: stop, enough, national sovereignty comes into this, and you have to control your own borders and your own country’s space? So just how far would you take this cooperation then you say: hold, enough, this is our countryʼs own business?

  Cecilia Wikström (ALDE), blue-card answer. – As I put it in my speech, what we are seeing today is that criminal transnational gangs do not feel those borders between nations. I find it quite remarkable that there are still, in this globalised world where we are, and also in this Union, people like yourself who believe that putting up fences, working nation by nation, would be efficient. I believe in an enhanced cooperation between nations in order to combat these transnational criminal gangs that are actually putting ordinary people in a very difficult situation.

  Josep-Maria Terricabras, on behalf of the Verts/ALE Group. – Mr President, the CEPOL report has not been a controversial one. We, the Greens/EFA, basically disagree with the majority of the report on one point, already mentioned by our colleague, namely that the seat of CEPOL should not be in Budapest but Den Haag, where Europol is based. This would be more efficient and would make more sense. We have presented an amendment on this issue.

On the other hand, there are two aspects in the report which we welcome. First, the inclusion of an overall framework on respect for human rights. Second, the inclusion of the reference to the desired gender balance in the main managing structure of CEPOL, the management board.

  Tibor Szanyi (S&D), Kékkártyás kérdés. – Én őszintén szólva már többször végigkísértem ezt a vitát, hogy ez az ügynökség miért legyen, vagy miért ne legyen Budapesten. Magyar vagyok, tehát ilyen értelemben valószínűleg valamennyire elfogult is, de azért őszintén szeretném mondani, hogy ezen a sztereotípián, hogy melyik ügynökség hasonlít mire, gyakorlatilag előbb-utóbb mindent el lehetne vinni Brüsszelbe, Hágába, bárhova, akár a strasbourgi Parlamentet is Brüsszelbe, tehát azért lássuk be, hogy egy disztribúciónak, egy szétosztásnak az ügynökségek között lenni kell.

  Josep-Maria Terricabras (Verts/ALE), blue-card answer. – Of course we can distribute agencies, but only with some coherence and unity, and since Europol is in The Hague it would be good if the training of our police be where the central police building is. It is nothing against Hungary or against Budapest, which I like very much. That is not the problem. It is to have a rational organisation of our agencies.

  Vicky Maeijer, namens de ENF-Fractie. – De Europese politieacademie waar we vandaag over spreken, is onderdeel van het grotere Brusselse droombeeld: één groot Europees rechtshandhavingssysteem. Want als het aan Brussel ligt, dan worden onze agenten straks opgeleid op de Europese Politieacademie, gaat het Europees Openbaar Ministerie de criminelen vervolgen en bepaalt de Europese Unie welke straf zij opgelegd krijgen. De Partij voor de Vrijheid, mijn partij, zegt dan ook nee tegen een Europese politieacademie en nee tegen nog meer overheersing van ons rechtssysteem door de Europese Unie. Er is helemaal niets mis met politiesamenwerking tussen soevereine staten, maar daar hebben we Cepol niet voor nodig. Laten we het politiewerk overlaten aan de agenten in de natiestaten en niet uit handen geven aan de Europese Unie.

  Ελευθέριος Συναδινός ( NI). – Κύριε Πρόεδρε, η σχεδίαση για την αντιμετώπιση σοβαρών μορφών εγκληματικότητας, της τρομοκρατίας και μορφών εγκληματικότητας που θίγουν τα συμφέροντα δύο ή περισσότερων κρατών πρέπει να είναι απλή, εφαρμοστέα και να οδηγεί σε απτά αποτελέσματα. Η διασυνοριακή διάσταση της εγκληματικότητας και η επιβολή του νόμου αντίστοιχα όπως και η προσπάθεια δημιουργίας σαφέστερης ενωσιακής προστιθέμενης αξίας δεν πρέπει να έρχονται σε αντίθεση με τη στρατηγική εσωτερικής ασφάλειας τόσο σε επίπεδο Ένωσης όσο και σε επίπεδο εκάστου κράτους μέλους. Σαφέστατα η ενισχυμένη συνεργασία μεταξύ των εθνικών αρχών αστυνόμευσης είναι απαραίτητη και επιδιωκόμενη, πρέπει όμως να βασίζεται σε αρχές και κανονισμούς, ιδίως όταν αποτυπώνεται στο οργανόγραμμα των ευρωπαϊκών θεσμών επιβολής νόμου. Τέλος, πρέπει να συζητηθεί η γνωμοδότηση της Επιτροπής Προϋπολογισμών του Κοινοβουλίου για συγχώνευση της Ευρωπαϊκής Αστυνομικής Ακαδημίας με τη Εuropol όχι μόνο για λόγους εξοικονόμησης πόρων αλλά κυρίως για λόγους συνέργειας Ακαδημίας και επιχειρησιακής αστυνομίας.

  Alessandra Mussolini (PPE). – Signor Presidente, onorevoli colleghi, io avevo preparato un intervento, ma vorrei rispondere al dibattito che si è acceso in quest'Aula riguardo alla sede e riguardo all'accorpamento tra CEPOL ed Europol.

Noi crediamo che in un momento di così grave difficoltà, viste le mutate esigenze, perché come è noto CEPOL è stata istituita nel 2005, noi non dovremmo parlare di dove sarà la sede – all'Aia o a Budapest – e se ci può essere l'accorpamento con Europol per una questione anche di bilancio, economica. La cosa più importante è la formazione delle persone di polizia che devono contrastare la criminalità organizzata grave, i flussi migratori clandestini, il terrorismo. Allora ci dobbiamo concentrare su questo. Ecco perché noi crediamo che il fatto di avere un'entità, un'agenzia autonoma svincolata sia di fondamentale importanza.

Ciononostante ci deve essere assolutamente una cooperazione, una rete sempre più forte, per ovviare a quello che diceva la relatrice sui doppioni o sovrapposizioni con Europol, Eurojust e Frontex, che tra l'altro dovrà essere anche rimodulata. Quindi è chiaro che dobbiamo mettere mano a CEPOL, perché lo dice il trattato di Lisbona e, l'ultimo passaggio, lo voglio fare, perché ci sia anche il rispetto dei diritti fondamentali nelle attività di contrasto, come si deve fare, e nella protezione e assistenza delle vittime, con particolare riguardo ai minori, ai bambini.

  Kristina Winberg (EFDD). – Herr talman! Jag är kluven inför Cepols vara eller icke vara. Å ena sidan kräver den situation som medlemsstaterna befinner sig i ett ökat polissamarbete, å andra sidan inser jag att den stora orsaken till detta behov är just de öppna gränser som EU tvingat fram. Detta är ett typexempel på hur hjärnorna bakom EU-projektet först skapar ett problem för att sedan presentera en lösning som av regel även har effekten att EU får ökad makt.

I den situation vi befinner oss idag med en Schengen-förordning som gör att människor kan resa helt fritt ser vi en ökning av narkotika, människosmuggling, trafficking. Hur ska Cepol kunna utbilda våra poliser när politiker inte ens kan få bukt med de problem som vi ser idag och framför allt inte ens vill erkänna orsaken till dem? För att underlätta för våra poliser borde det ju vara rimligt att låta medlemsstaterna få möjlighet att upprätthålla sina gränsskydd.

  Gilles Lebreton (ENF). – Monsieur le Président, le CEPOL est une agence européenne chargée de la formation des policiers, des douaniers, des gardes-frontières et des procureurs des États membres. Créé en 2005, il présente un bilan décevant. Je condamne fermement la proposition qui nous est faite aujourd'hui de le rénover.

Le CEPOL est une agence inutile et coûteuse. Plutôt que de le rénover, il faudrait le fondre dans Europol, comme la Commission de Bruxelles l'avait d'ailleurs préconisé. Si on le maintient sous le statut d'agence, c'est uniquement pour faire plaisir à la Hongrie, où il est implanté.

Le CEPOL est une usine à gaz que les Britanniques ont eu la sagesse d'expulser de leur territoire. Il est consubstantiel aux calamiteux accords de Schengen et mérite le même sort qu'eux, la mort.

  Jiří Pospíšil (PPE). – Pane předsedající, já bych chtěl podpořit ve svém vystoupení paní zpravodajku. Byl jsem dlouhá léta ministrem spravedlnosti České republiky a věnoval jsem se vzdělávání soudců a státních zástupců a jejich přípravě na přeshraniční kauzy a vím, jak velmi důležitá byla spolupráce s Evropskou justiční akademií. To samé platí pro vzdělávání policistů a celníků. Není možné vzdělávat pouze národně na území jednotlivých států, zkrátka a dobře, a bylo to tady několikrát řečeno, zločin dnes má přeshraniční charakter, a není tedy pouze věcí jednotlivých zemí, jak připraví své policisty, celníky a státní zástupce. Je to dneska věcí celé Evropy a je nutné na tom spolupracovat a k tomu je nutná agentura. Jsem o tom hluboce přesvědčen jako člověk, který se tomuto tématu na české politické úrovni věnoval. Chci tedy podpořit stanovisko paní zpravodajky, chci podpořit renovaci této agentury. Doufám, že tato agentura nebude jenom o komunikaci mezi jednotlivými akademiemi v jednotlivých národních státech, ale že bude schopna vytvořit společné osnovy a doporučit, jak vzdělávat policisty a celníky v boji s přeshraničním zločinem. Je to, podle mého názoru, velmi důležité. Pro mě osobně není důležité, kde ta agentura sídlí, jak bude financována, ale co bude dělat, jak pomůže k většímu vzdělání policistů, kteří bojují s přeshraničním zločinem. Bude-li tato agentura v Maďarsku, já s tím osobně nemám žádný problém.

Διαδικασία «Catch-the Eye»

  Caterina Chinnici (S&D). – Signor Presidente, onorevoli colleghi, credo che avvertiamo tutti oggi, in tema di sicurezza, la necessità che le forze di polizia e le autorità di contrasto siano sempre più qualificate e interconnesse in virtù di un sistema integrato di formazione permanente. E per questo ritengo utile il consolidamento della struttura e del ruolo di CEPOL, un istituto che con un bilancio e un organico limitato ha curato, grazie all'interazione con le Accademie nazionali, la formazione di decine di migliaia di funzionari con centinaia di attività.

L'inquadramento di CEPOL come agenzia autonoma dell'Unione è coerente con l'obiettivo di costruire una cultura comune europea di applicazione della legge, fondata sul rispetto dei diritti, e può anche garantire un buon rapporto costi-benefici. E questo sarà ancora più vero andando a concentrare le risorse su alcuni settori tematici dotati di una chiara dimensione europea e transfrontaliera e di un'importanza strategica, primo fra tutti la lotta alla criminalità organizzata.

  Νότης Μαριάς ( ECR). – Κύριε Πρόεδρε, η CEPOL, δηλαδή η Ευρωπαϊκή Αστυνομική Ακαδημία, είναι αρμόδια για την κατάρτιση στον τομέα της επιβολής του νόμου και για τον λόγο αυτό θα πρέπει να λειτουργεί με διαφάνεια και υπό τον δημοκρατικό έλεγχο του Ευρωπαϊκού Κοινοβουλίου. Η CEPOL καλείται, αξιοποιώντας τα κατάλληλα εργαλεία, να προσφέρει κατάρτιση στις αστυνομικές δυνάμεις, προκειμένου να διεκπεραιώνουν με επαγγελματικό και συνάμα νόμιμο τρόπο το καθήκον τους.

Ωστόσο, λαμβάνοντας υπόψη την αστυνομική δράση σε διάφορες χώρες, διακρίνουμε συχνά την αυξημένη άσκηση βίας κατά των πολιτών, ιδίως σε πορείες και διαδηλώσεις ενάντια στις πολιτικές λιτότητας· βία η οποία είναι δυσανάλογη και η οποία οδηγεί σε παραβίαση των θεμελιωδών δικαιωμάτων των πολιτών. Επομένως, η κατάρτιση που θα διεξάγει η CEPOL πρέπει να περιλαμβάνει οπωσδήποτε διδασκαλία και κατάλληλη εκπαίδευση, προκειμένου να εξαλειφθούν τα συχνά περιστατικά παράνομης άσκησης αστυνομικής βίας. Καλούνται, λοιπόν, το Ευρωπαϊκό Κοινοβούλιο και η Επιτροπή να διασφαλίσουν ότι η CEPOL θα συμβάλει στην οικοδόμηση μιας αυθεντικής ευρωπαϊκής παιδείας στον τομέα της επιβολής του νόμου, που θα εδράζεται στον σεβασμό των θεμελιωδών δικαιωμάτων.

  Ivan Jakovčić (ALDE). – Gospodine predsjedniče, mada pripadamo onima koji zagovaraju da se Europol i CEPOL i druge agencije koje se bave sigurnosnim pitanjima u Europskoj uniji na neki način spoje ili da barem snažno koordiniraju svoj rad, ovdje prije svega moram reći da je važna borba protiv prekograničnog krijumčarenja, terorizma i svega onoga što nosi organizirani kriminal, koji, naravno, ne poznaje granice.

Gospodine povjereniče, želim Vas upozoriti na činjenicu da je ova migrantska kriza također pokazala da je zapadni Balkan jedan od onih područja u kojima imamo velikih problema. Organizirani kriminal, balkanske rute, kako god to nazivali, zaista definitivno postoje. I zato je važno da se u CEPOL uključe i sve one policijske snage i druge institucije zemalja kandidatkinja i potencijalnih kandidata jer prekogranični kriminal i terorizam ne poznaju granice, a te su zemlje u srcu Europske unije.

  Krisztina Morvai (NI). – Az Európai Bizottság jelen lévő képviselőjétől arra szeretnék választ kapni – nagyon örülök, hogy ezek szerint tud magyarul, mert nincsen rajta tolmácskészülék, tehát biztos így is érti, amit mondok –, tehát azt szeretném tőle megkérdezni, hogy pontosan mennyi pénzbe kerül az európai adófizetőnek a határokon átívelő szervezett bűnözéssel szembeni fellépés, akár ennek a CEPOL intézménynek a formájában, akár az Europol formájában, és mit kap cserébe. Mert, hogy amit látunk az az, hogy a határokon átívelő bűnözés, a szervezett bűnözés köszöni szépen, nagyon jól van, virágzik.

Amit sokan migrációs krízisnek vagy menekültválságnak neveznek, azt büntetőjogi megfogalmazásban úgyis meg lehet fogalmazni, hogy a szervezett bűnözésnek a virágzása, az embercsempészésnek a CEPOL, Europol és egyéb szervek létezése ellenére való virágzása. Milyen magyarázatot tud erre az Európai Bizottság képviselője? Várom válaszát.

  Doru-Claudian Frunzulică (S&D). – Mr President, I strongly believe that, in order to ensure its effectiveness and impact, CEPOL’s limited resources should be focused towards a few thematic areas with a clear European added value, taking into consideration the current situation of the European Union with migratory waves and other challenges to our stability, by no means duplicating the work done at the level of the Member States and in line with the principle of subsidiarity. Focusing on a more limited number of thematic areas would free resources to put more effort into quality and attractiveness. In order to use scarce resources efficiently, a more effective coordination among JHA agencies providing training is important, exploiting synergies and eliminating duplication. Finally, I believe that sufficient funding should be safeguarded for CEPOL to properly execute its new tasks.

  Dimitris Avramopoulos, Member of the Commission. – Mr President, today we deliver one important element of the European agenda on security. There is no doubt that training is key to our common law enforcement culture. Today, we ensure that we give CEPOL the right means and the structure to perform its mission.

We can all welcome the final outcome, as this would reinforce CEPOL’s ability to become the centre of excellence of training of law enforcement officials and officers of the European Union.

The Commission maintains its misgivings on two important points of the text, as it emerged from the interinstitutional negotiations, and underlines the importance of maintaining the common approach as agreed trilaterally between the institutions. My thanks once again to the rapporteur Ms Kinga Gál for her hard work on this fight.

  Kinga Gál, előadó. – Biztos Úr, Kollégák! Ez a vita is bizonyította, és köszönöm az észrevételeiket, hogy nem kevés küzdelem és eltérő álláspont összehangolása után jutottunk eredményre. Viszont figyelembe kell venniük, hogy az új szabályozás révén végre végetvethetünk az eddigi bizonytalanságnak, amely árnyékot vetett a CEPOL-ra az elmúlt években. Bizonyára emlékeznek rá, a CEPOL-nak az addigi Bramshill-ben lévő bázisa helyett új székhelyet kellett találnia. Ráadásul a Bizottság azt javasolta, hogy a CEPOL-t és az Europolt vonják össze a költségmegtakarítás jegyében. Így a CEPOL-nak egy időre nem volt székhelye, de még a puszta léte is kérdésessé vált.

Ami az összevonást illeti – Önök azt mind tudják, hiszen itt szavaztunk róla –, az Európai Parlament és a Tanács határozottan elutasította a Bizottság felvetését az összevonásról. A székhely vonatkozásában számos tagállam ajánlotta fel, hogy otthont biztosít a CEPOL-nak. Végül Budapestre esett a választás, miután Magyarország tette le a legjobb ajánlatot.

Mindannyian tudjuk, hogy szükségünk van professzionálisan képzett rendfenntartókra, kifejezetten most, ezekben az időkben, akik összeurópai szinten is képesek gyorsan és hatékonyan reagálni. Ehhez fektettük le az alapot most ezzel az új szabályozással, és megteremthetjük a feltételeket a CEPOL számára, amelyek révén hozzájárulhat egy valódi, európai rendfenntartó kultúra kialakításához. Én úgy gondolom, hogy erre szükségünk van, épp a hatékonyság, a határon átnyúló bűnözés elleni hatékony fellépés érdekében.

És még egyszer szeretném megköszönni minden árnyékjelentéstevőnek, tanácsadónak és a LIBE-titkárságnak odaadó munkáját, hiszen egy eredményes tárgyalássorozat után vagyunk.
