  João Ferreira (GUE/NGL). – Senhor Presidente, o facto de estarmos perante um relatório que tem, neste momento, mais de quatrocentas propostas de alteração mostra que está longe de ser consensual e que este processo está longe de estar suficientemente amadurecido. É um processo que terá repercussões políticas muito profundas – está longe de ser um dossiê meramente técnico – e isto aconselhava a um outro processo de maturação e de reflexão.

Se a isto juntarmos o facto de, nos últimos dias, em poucos dias, um apelo público que está disponível na Internet ter sido já subscrito por largas centenas de cidadãos, tudo isto aconselhava a que este processo pudesse ser suspenso por aqui e pudesse haver uma reflexão mais profunda sobre este relatório, que essa reflexão pudesse prosseguir na comissão especializada.

Fazíamos, por isso, apelo à sua prerrogativa, Senhor Presidente, de poder devolver o relatório à comissão, que fizesse uso dela e que pudéssemos não votar aqui, hoje, este relatório, não forçar a aprovação de um relatório que está longe de ser consensual e que terá profundas repercussões políticas no funcionamento deste Parlamento.

Quanto às considerações políticas, já as fizemos durante o debate, mas seria sensato fazer este adiamento.

  João Ferreira (GUE/NGL). – Senhor Presidente, é uma prerrogativa do Presidente poder enviar este relatório para a comissão. Se entender não fazer uso dela, nesse caso, pedíamos que o plenário se pudesse pronunciar.

  Max Andersson (Verts/ALE). – Mr President, I wish to raise a point about Rule 170 of the Rules of Procedure. We have an amendment supported by more than 100 MEPs from five different groups, Amendment 320, which proposes that former MEPs who have a transitional allowance should not be engaged in lobbying. It was declared inadmissible on the fifth version of the voting list last night. We have not received a formal explanation why this pretty good amendment was declared inadmissible, and this we find strange and unacceptable. If possible, we would like the vote on Amendment 320 to go forward.

  Presidente. – Grazie onorevole Andersson, rispondo subito alla sua domanda e poi passiamo alla votazione sulla proposta dell'onorevole Ferreira.

Per quanto riguarda la decisione del Presidente di dichiarare irricevibile l'emendamento a cui Lei fa riferimento, si tratta di una decisione definitiva perché, ai sensi dell'articolo 232 del trattato sul funzionamento dell'Unione europea, il Parlamento ha il potere di stabilire il proprio regolamento interno in base alla giurisprudenza; ciò significa che esso può decidere della propria organizzazione interna e adottare le misure adeguate al fine di garantire il corretto funzionamento e svolgimento delle sue procedure.

In tale contesto il Parlamento può disciplinare, nel proprio regolamento interno, talune questioni riguardanti i propri deputati, ove ciò sia necessario a garantire il corretto funzionamento e svolgimento delle sue procedure. Tuttavia il regolamento interno non può essere utilizzato per regolamentare le attività degli ex deputati. Da qui la decisione del Presidente. Per quanto riguarda la proposta dell'onorevole Ferreira, vorrei sapere se c'è qualche parlamentare che vuole intervenire a favore, qualcuno che vuole intervenire contro.

  Maroš Šefčovič, Vice-President of the Commission, in writing. – The Commission takes note of the fact that the European Parliament has adopted today a revision of its Rules of Procedure which includes some changes concerning the relations with the Commission. Pursuant to point 21 of the Framework Agreement between the European Parliament and the Commission, the European Parliament has taken the commitment to seek the opinion of the Commission when it comes forward with such changes to its Rules of Procedure.

By letter from President Schulz of 9 December 2016, the European Parliament transmitted for the Commission's opinion, where relevant, the envisaged amendments to its Rules of Procedure brought forward for consideration of the plenary on 13 December 2016.

The Commission regrets that Parliament did not respect its commitment for consulting the Commission in a meaningful way, as the time left before the vote by the European Parliament has not allowed the Commission to provide a considered response or even discuss the matter in the College, and the Parliament to take a Commission opinion duly into account before voting on the proposed changes.

The Commission regrets that the Parliament did not act in accordance with the principle of loyal and sincere cooperation and, despite its request, did not allow the Commission enough time to express its opinion before adopting the revision.

The Commission wishes to highlight some of Parliament's changes to its Rules of Procedure, in particular those relating to the proposed hearings in case of the appointment of a new Commissioner during the Commission's mandate or modifications in the portfolio of serving Commissioners, as well as those relating to a possible conflict of interest of a Commissioner. It must be borne in mind that those changes, if introduced unilaterally by the European Parliament in its Rules of Procedure, cannot create a role for the European Parliament which is neither provided for in the Treaties nor in the Framework Agreement and which would affect the institutional position and functioning of the Commission.

The Commission underlines in this regard that it will apply the Treaties and continue to respect the terms of the Framework Agreement. The Commission expects that the Parliament will do the same.
