  Rebecca Harms, Verfasserin. – Herr Präsident, sehr geehrte Kollegen! Vielen Dank für die Unterstützung dieser Entschließung. Sie ist sehr wichtig. Das Menschenrechtsbüro der Vereinten Nationen hat jetzt gerade erst im September einen Bericht verabschiedet, in dem von schwersten Menschenrechtsverletzungen auf dem besetzten Territorium der Autonomen Republik Krim und der Stadt Sewastopol berichtet wird. Das Menschenrechtsbüro der Vereinten Nationen erklärt, wie Krimtataren, Journalisten, Blogger und jeder, der auf der Krim Kritik an der Besetzung der Krim oder der Politik Putins äußert, festgenommen und eingesperrt werden kann. Es gibt Berichte darüber, dass Menschen verschwinden, dass Menschen vom Geheimdienst terrorisiert werden und in der Haft auch psychiatrisiert und gefoltert werden.

Am wichtigsten in dieser Entschließung, die wir heute verabschieden, ist, dass denjenigen, die in den Lagern und Gefängnissen Putins verschwinden, Namen gegeben werden, dass diese Personen auftauchen.

Darüber hinaus finde ich die Forderung sehr wichtig, dass unser Auswärtiger Dienst, unsere Botschaft und auch der Europarat und die Vereinten Nationen mehr Druck dafür machen, dass die Situation auf der Krim durch internationale Delegationen beobachtet werden kann. Es kann nicht sein, dass – so wie unter Stalin – wieder Menschen von der Krim in den Lagern – heute nicht Stalins, sondern Putins – verschwinden und wir in dieser Situation, obwohl Russland im Prinzip zum Europarat gehört, nichts machen können. Wir sollten die Forderung der Ukrainer unterstützen, dass sich die Generalversammlung der Vereinten Nationen nach dem Bericht, den ich am Anfang angesprochen habe, ausdrücklich mit diesen Problemen beschäftigt.

Ansonsten müssen wir dafür sorgen, dass die Sanktionen, die wegen der Besetzung der Krim erlassen worden sind, durchgehalten werden, dass wir wie die Vereinten Nationen weiter dabei bleiben, dass die Krim besetztes Territorium ist. Wir sollten die Unternehmer bestrafen, die mit der Brücke von Kertsch oder im Energiebereich diese Sanktionen brechen.

  Petras Auštrevičius, author. – Mr President, the non-recognition of Crimea’s occupation is not just a political declaration, it is an obligation to act. I call on the European External Service: each and every case of repressed Crimean dissidents must be followed by our action, I mean by asset-freezing and a travel ban against those who are responsible. I have got a note from independent Russian analysts who say that over 130 European Union companies still enjoy trading with Crimea. An absolute majority of them have a Cypriot legal registration. This scandalous and shocking political business scheme must be stopped immediately and investigated thoroughly. The Commission must act and take all legal measures against these sanctions-violators.

  Soraya Post, author. – Mr President, dissent is not a crime. As a human rights defender, a feminist and coming from a minority myself, I must speak out against the dire situation in occupied Crimea. Today we highlight the cases of two Crimean Tatar leaders and one journalist. But the problem is much, much broader. There is a disturbing pattern of repression of independent voices. So often across the world minority groups are in vulnerable situations and we must secure their rights.

We demand that the de facto Russian authorities reverse their convictions. They must end the persecution and harassment of Crimean Tatars, human rights defenders, journalists, lawyers, and all other target groups. And as I said before, we must secure their rights.

Ich bin sehr froh, dass wir heute in dieser Angelegenheit wieder einen breiten Konsens von fünf Fraktionen haben und dass wir damit klar machen, dass wir gemeinsam die Besetzung der Krim weiterhin für einen illegalen, völkerrechtswidrigen Akt halten und dass wir uns nicht nur abstrakt um Territorien kümmern sondern sehr konkret um Menschen, die unter dieser Besetzung leiden.

Es ist richtig, dass wir die Tatarenführer hier namentlich nennen: Ahtem Çiygoz, İlmi Ümerov und den Journalisten Mykola Semena. Sie – und auch ihre Angehörigen und auch Russland, alle – sollen wissen, dass diese Menschen nicht vergessen sind. Deswegen haben wir auch die anderen politischen Gefangenen, die auf der Krim von den russischen Behörden festgesetzt und verurteilt worden sind, in die Liste derer aufgenommen, die hier erwähnt sind. Wir verlangen ihre unmittelbare Freilassung, denn sie sind in der Tat politische Gefangene und haben nichts anderes verbrochen, als dass sie sich für die Unabhängigkeit ihres Heimatlandes und die Zugehörigkeit zur Krim eingesetzt haben. Wir sollten diese tapferen Menschen weiterhin beim Namen nennen und politisch und moralisch unterstützen. Ich glaube, das ist unsere Aufgabe hier.

  Anna Elżbieta Fotyga, author. – Mr President, three years after the illegal annexation of Crimea, Russia is tightening its grip on the community of the peninsula by means of terror, massive violations of human, citizens’ and political rights, and by means of killings, abductions, illegal detentions and deprivation of basic rights.

This policy is affecting, in particular, the indigenous community of Crimean Tatars. Their political representation, the Mejlis, was banned and two prominent Mejlis leaders, Mr Ilmi Umerov and Mr Akhtem Chiygoz, were given lengthy prison sentences, as was Mr Mykola Semena, a journalist linked to Radio Free Europe. In our resolution we provide a long list of prisoners – political prisoners, prisoners of conscience – who are to be remembered. We also know the names of perpetrators of massive human rights violations, including judges sentencing, in the name of illegal Russian courts, the patriots of the Ukraine, of the Tatar community.

We need to broaden the group of people who are subject to our individual sanctions, to take restrictive measures against these people.

  Dariusz Rosati, on behalf of the PPE Group. – Mr President, we are going to vote today on a resolution on the two Crimean Tatar leaders Akhtem Chiygoz and Ilmi Umerov, and the journalist Mykola Semena, who have been sentenced to prison for simply expressing their views. We demand their immediate release. But our debate is more general. We are speaking here about ongoing grave abuses by the Russian Federation of human rights in the illegally annexed Crimea region of Ukraine.

The recently published UN Human Rights Council report about the human rights situation in Crimea states that imprisonments, arrests, tortures and abductions were amongst the actions targeted against people opposing the Russian annexation of Crimea. These inhuman and shameful practices demonstrate once again that Russia continuously violates international law and is a threat to European security. I therefore welcome the June prolongation of sanctions against Russia concerning its annexation of Crimea. The sanctions should be maintained and extended until the human rights of the people of Crimea are fully protected and Crimea is returned to Ukraine.

  Tibor Szanyi, on behalf of the S&D Group. – Mr President, ever since the illegal annexation of the Crimean peninsula by Russia, this Parliament has been – and must remain – in the forefront of international protest against Putin’s expansionism. As we insist on restoring the sovereignty, independence and territorial integrity of Ukraine, we must see beyond the legal and military consequences and must keep reminding Europe and the world of the human suffering and injustice the local population must endure, particularly the most daring, who challenge and fight the illegal occupation.

This motion calls for our joint solidarity with the people of Crimea, especially of the local Tatar community whose members and leaders are Moscow’s main targets in repressing and avenging opposition, similarly to representatives of the free press. The convictions and detentions of Tatar leaders – who as Mejlis leaders are actually our colleagues – Ilmi Umerov and Akhtem Chiygoz, as well as the journalist Mykola Semena, must be reversed, their freedom and human rights restored.

However, their cases represent only the tip of the iceberg as far as Putin’s reckless repression is concerned, marked by violence, torture, illegal detention and transfer of detainees to Russia. This motion recalls the names of many other Crimean Tatar and other victims and as MEPs, we must remain vigilant and active in updating this dire list and highlighting every single case of human rights abuse. Also the EU needs to further empower and supply the EEAS, and support the UN, the OSCE and the civilians in their monitoring and humanitarian efforts.

Indeed, Putin behaves in Crimea like the worst kind of occupation force, following the most appalling inhuman Stalinist patterns, ignoring all norms of international law of human rights and of decency. I believe Crimea is the testing ground, as far as Europe’s tolerance and democratic determination is concerned. Let the Crimean Tatars’ fate be a reminder of this to all, in or out of the EU, who still nourish illusions about Moscow’s intentions, and who tend to regard the illegal annexation as a kind of fait accompli.

  Charles Tannock, on behalf of the ECR Group. – Mr President, Russia’s illegal occupation and annexation of Crimea continues, and so must the EU’s resolve to protest about its action. Sadly, the situation is not getting any better. There are now new allegations of human rights violations in Crimea detailed in the UN Human Rights Agency’s report. It is also the case that the Crimean minority group, the Tatars, continue to be persecuted, which echoes the treatment of their grandparents under Stalin. The imprisonment of prominent Tatar dissidents, Akhtem Chiygoz, Ilmi Umerov and the journalist Mykola Semena, as well as the fact that the Tatars’ Parliament, the Majlis, has been closed, is deeply alarming.

My group, the ECR, will continue to oppose Russia’s actions via EU sanctions and international pressure. The indigenous Turkic-speaking population must be allowed to live peacefully in their homeland of Crimea, and any efforts by the Russian Government to force them to leave the peninsula through policies of persecution or withdrawal of their democratic rights is totally unacceptable.

  Urmas Paet, on behalf of the ALDE Group. – Mr President, the situation in Crimea tends sometimes to be overshadowed by other developments, but we cannot let this happen. According to the latest UN report, the human rights situation in Crimea has significantly deteriorated under Russian occupation. There are arbitrary arrests and detentions, enforced disappearances, ill-treatment and torture. Also, the imposition of Russian citizenship has affected tens of thousands of people. Persons holding a residence permit and no Russian Federation citizenship in Crimea cannot own agricultural land, vote or be elected, register a religious community, apply to hold a public meeting, hold positions in the public administration, and so on.

The Russian Government has an obligation, as an occupying power, to uphold human rights for all and effectively investigate alleged torture, abductions and killings. But of course, the only fundamental solution lies in Russia ending the occupation of Crimea and returning it to Ukraine.

  Jiří Maštálka, za skupinu GUE/NGL. – Pane předsedající, žádné porušování lidských práv samozřejmě nemůže být tolerováno. Jistě je dobře, že se snažíme zabývat každým jednotlivým případem, ale mám obavu, abychom pro jednotlivosti nezapomínali na porušení práv a utrpení velkých skupin lidí. Stačí se podívat na Ukrajinu, kde již tři roky panuje vleklý konflikt s dopadem na miliony lidí. Jeho součástí je zabíjení, mučení a týrání lidí, jakož i likvidace nepohodlných novinářů. I podle zprávy Úřadu vysokého komisaře OSN z léta letošního roku, kterou kolegové zde také citovali, dochází: „K systematickému porušování práva na spravedlivý proces v případech souvisejících s konfliktem.“ Pravidelně zde na plénu pranýřujeme situaci na Krymu, je to evergreen. Podle mého názoru ale potřebujeme konečně přestat s politikou dvojího metru.

  Bronis Ropė, Verts/ALE frakcijos vardu. – Krymas – tai saldus kąsnis Rusijai, kuri senokai į jį gviešiasi. Šis pusiasalis Rusijai visais laikais buvo labai svarbus strategiškai. Rusijos agresija prasidėjo dar XIX a. viduryje, tęsėsi XX a. pradžioje, o po Antrojo pasaulinio karo Stalinas deportavo visus Krymo totorius, nes jie neva bendradarbiavo su naciais. Ir dabar XXI a. Rusija vėl aneksavo Krymą. Tokia padėtis yra šiurpiausia Krymo totoriams, kurių Kryme liko nedaug, tačiau jie yra šios žemės senbuviai, šeimininkai. Krymo totorių istorija yra daug kuo panaši į mano tautos istoriją, tačiau jiems teko patirti nepalyginamai žiauresnę ilgametę tremtį.

Turime aktyviau padėti Ukrainai susigrąžinti pusiasalį ir tokiu būdu kartu užtikrinti ramybę ir ateitį taip pat ir Krymo totoriams.

  Marie-Christine Arnautu , au nom du groupe ENF. – Monsieur le Président, Malawi, Maldives, Crimée, que de sujets cruciaux pour les Européens que nous sommes censés défendre ici!

Mais il y a quatre jours, à Marseille, un islamiste a égorgé deux jeunes filles innocentes, qui s’ajoutent à la longue liste des centaines de victimes d’une guerre de religion qui tait son nom. Pourtant, elle se tient dans nos murs, où elle est menée par des ennemis qui n’ont rien à y faire, mais qui profitent de votre laxisme et de votre aveuglement pour commettre leurs crimes.

Ce matin, nous assistons donc à un réquisitoire anti-Poutine, au prétexte du sort de personnes qui ont été régulièrement condamnées pour troubles à l’ordre public, incitations à la subversion, menées antidémocratiques ou même, ironie du calendrier, si l’on pense à ce qui s’est passé dimanche dernier en Catalogne, pour tentatives d’empêcher, par la violence, la tenue du référendum sur l’autonomie de la Crimée.

Charité bien ordonnée commence par soi-même. Occupons-nous donc de la démocratie au sein de l’Union et, après seulement, vous pourrez donner des leçons à la terre entière.

Ja nic nie rozumiem: wczoraj słyszę z ust pana Timmermansa, że najważniejsze są rządy prawa, a dziś chcecie zaprowadzić w Rosji ustrój totalitarny, by pan Putin mógł na wasze polecenie zmieniać wyroki niezależnych sądów. Wy pragniecie totalitaryzmu! O Krymie i Rosji nie wiecie nic. Ja byłem na Krymie, tam było 70 % Rosjan na okrągło, 10 % Ukraińców, 10 % Tatarów i 10 % Ukraińców mówiących po rosyjsku. To byli ludzie rządzący Krymem, bo tam, aby być u władzy, trzeba było być Ukraińcem. Teraz ci sami ludzie są już Rosjanami i ci sami ludzie rządzą na Krymie i tak samo traktują Tatarów. Cytuję za „The Guardian” pana Zaira Smiedlajewa, działacza tatarskiego, który za rządów ukraińskich był oskarżany o separatyzm, bo powiedział, że pewnego dnia Krym będzie tatarski. I on mówi tak: „Teraz ci sami ludzie z ukraińskich służb bezpieczeństwa, którzy grozili mi i oskarżali o separatyzm, noszą mundury rosyjskie. Popatrzcie, kto stał się separatystą!” Z Krymu do Moskwy jest dalej niż do Kijowa i to jest jedyne, co się zmieniło z punktu widzenia Tatarów krymskich.

  Lars Adaktusson (PPE). – Mr President, the alarming reports about the abuse of human rights in Crimea should not come as a surprise to anyone. Yet again, we observe how the Kremlin uses the judicial system as a tool to silence fair criticism and discontent among the people. Any state established upon the rule of law must ensure the protection of minorities and freedom of speech.

On these most fundamental human rights, the Russian Federation is falling short. As representatives of the EU, we must condemn the unjust sentencing and demand the immediate release of Crimean Tatar leaders, Akhtem Chiygoz and Ilmi Umerov. The charges against journalist Mykola Semena should be dropped. Moreover, the EU must condemn the persecution and unfair policies against Crimean Tatars and continue to defend the European security order as we have known it since World War II.

  Kati Piri (S&D). – De Krim gaat nu al ruim drie jaar gebukt onder de Russische bezetting, waarbij mensenrechtenschendingen aan de orde van de dag zijn. Er is sprake van martelingen en willekeurige arrestaties.

De situatie van de Krim-Tataren is het meest schrijnend. De zaak Umerov, Chiygoz en Semena, die we hier bespreken, is exemplarisch. Zij betalen nu een hoge prijs voor het bekritiseren van de illegale annexatie. Na een schimmig proces zijn ze alle drie veroordeeld tot een buitenproportioneel lange gevangenisstraf.

Als EU is het onze plicht om op te komen voor journalisten en mensenrechtenactivisten, ook buiten onze grenzen. De Krim mag niet vergeten worden. De situatie van de inwoners van het illegaal geannexeerde gebied moet internationaal op de agenda blijven.

Daarom pleit ik er ook voor dat de EU Rusland hierop blijft aanspreken en zich hard maakt voor de vrijlating van deze drie mensen.

  Kosma Złotowski (ECR). – Szanowna Pani Komisarz! Krym jest terytorium okupowanym przez Rosję ze wszystkimi tragicznymi konsekwencjami, z jakimi okupacja się wiąże. To jest dla wszystkich nas jasne – z wyjątkiem pana posła Korwin-Mikkego. Aresztowania, prześladowania i represje polityczne to codzienność ludności tatarskiej, która wytrwale stara się bronić wartości, które podobno dla Unii Europejskiej są fundamentalne: praw człowieka i szacunku dla mniejszości.

Wzywamy Federację Rosyjską do uwolnienia tatarskich i ukraińskich więźniów politycznych, których jedyną winą jest wytrwały opór przeciwko bezprawiu. Bo Rosja tam jest bezprawnie, a Unia powinna stać na straży nienaruszalności granic. Oskarżenia i wyroki dla przywódców Tatarów krymskich Achtema Czijgoza, Ilmiego Umerowa oraz dziennikarza Mykoły Semeny to ważna, ale jedynie niewielka część prawdy o skutkach rosyjskiej okupacji Krymu. Wielu podobnych historii miałem okazję wysłuchać osobiście. Te same metody i te same represje Rosjanie stosowali przeciwko Polakom, Bałtom, Węgrom czy Czechom w nieodległej wcale przeszłości. My to jeszcze pamiętamy.

Tylko stanowcza reakcja Zachodu i ciągła presja ekonomiczna mogą zakończyć tę tragiczną sytuację Tatarów na Krymie.

  Илхан Кючюк (ALDE). – Г-н Председател, г-жо Комисар, ситуацията в Източна Украйна продължава да бъде нестабилна, несигурна и опасна. Липсата на политическа воля да се изпълнят напълно споразуменията от Минск превръща конфликта в замразен и на практика засилва тенденциите за разделяне.

Уви, в условията на опасност от военно изостряне човешките права винаги биват системно потъпквани. Такъв е и случаят в Източна Украйна, където правата на малцинствата биват системно погазвани, а дискриминационните действия срещу татарското население се превръщат в тежка реалност.

Г-жо Комисар, всички страни, упражняващи власт, трябва да се придържат към международните закони и норми и да гарантират изконните човешки права и свободи на всички граждани, независимо от техния етнически произход, пол и религия. Кримските татари са неизменна част от населението на Крим и техните културно-исторически ценности трябва да бъдат зачитани.

  Pavel Svoboda (PPE). – Pane předsedající, paní komisařko, dnes zde diskutujeme následky okupace části území Ukrajiny Ruskem. Rusko proti všem pravidlům mezinárodního práva okupuje Krym a Sevastopol. Připojení těchto území k Rusku nikdy neuznáme a tato území pro nás zůstávají územím Ukrajiny. Být na straně práva je pro kremelský režim zjevný zločin. Oběti lidské zvůle mají konkrétní jména obsažená v naší rezoluci, např. Oleg Sencov, Ilmi Umerov nebo Roman Sušenko a mnozí další. Nejen oběti, ale i ruská zvůle má svá konkrétní jména. Pachatelé těchto zločinů je třeba identifikovat a potrestat. V tuto chvíli je EU může přidat na své sankční seznamy.

  Marek Jurek (ECR). – Panie Przewodniczący! Rebecca Harms pięknie powiedziała, że ofiary nie mogą pozostać bezimienne, to najlepsze, co możemy od razu dla nich zrobić. Również prześladowane narody nie mogą pozostać bezimienne.

Historia Tatarów krymskich, historia Krymu w XX wieku to historia heroiczna, to jest opór wobec rewolucji bolszewickiej (pamiętajmy, że kontrrewolucja kończyła swój bohaterski opór właśnie na Krymie i Tatarzy w nim brali udział), to ukonstytuowanie się w państwo uznane przez Ligę Narodów, państwo Tatarów krymskich, to straszliwa, dzika deportacja w czasie wojny przez Stalina i to bohaterski powrót na swoje ziemie. Tak naprawdę los Tatarów krymskich jest testem, zawsze testem tego, co dzieje się na Krymie.

My nie możemy ich traktować tylko jako szczególny przypadek, jako społeczność, wśród której są ofiary, ale jako podmiot, który ma prawo wypowiedzieć się o przyszłości swojej ziemi.

  Michaela Šojdrová (PPE). – Pane předsedající, v záhlaví naší rezoluce jsou uvedená jména tří krymských Tatarů: Čijgoz, Umerov, Semena. Podle zpráv, včetně Úřadu vysokého komisaře OSN, víme, že těch, kteří jsou pronásledováni, zatýkáni, mučeni, unášeni nebo jsou nuceni odejít do exilu za kritiku ruské okupace Krymu, je mnohem více a stále jich přibývá. Evropský parlament nesmí k této situaci dál mlčet.

Během okupace byla silně potlačena svoboda médií, ta v podstatě přestala existovat a dnes jsou k dispozici pouze proruská zpravodajství. Máme zprávy o tom, že lidé na Krymu jsou nuceni spolupracovat s ruskými bezpečnostními složkami pod výhružkami. Něco takového si velmi dobře pamatujeme z doby totality v naší zemi do roku 1989. Stále ještě jsou však na Krymu lidé, kteří to nevzdali a brání lidská práva. Pro ně musí být podporou také naše usnesení a požadavek, aby byla zřízena mezinárodní pozorovatelská mise na Krymu v rámci OSN, která by podala zprávu o situaci.

  Jaromír Štětina (PPE). – Pane předsedající, vítám, že se touto rezolucí zastáváme lídrů krymských Tatarů. Jména Achtem Čijgoz a Ilmi Umerov pro nás nezůstávají neznámá. Právě tak jako novinář Mykola Semena.

Tato rezoluce má však mnohem hlubší význam, než je jenom odmítnutí nespravedlivých rozsudků. Tato rezoluce znovu evokuje naši paměť. Připomíná naši povinnost splácet dluh těm krymským Tatarům, kteří se v roce 1968 postavili proti okupaci mé země – Československa – sovětskou armádou. Připomíná, jak tragicky se může opakovat historie – byli to právě krymští Tataři, kteří už jednou byli podrobeni genocidě. Mám na mysli jejich násilné vystěhování z Krymu v roce 1944.

Tato rezoluce však má ještě jeden obecný smysl. Dokazuje, že Evropský parlament neuhýbá a stále nazývá věci pravými jmény: okupace Krymu je porušením mezinárodního práva.

  Julie Ward (S&D). – Mr President, it is important that we keep on speaking out on the human rights violations that are happening on our doorstep in Ukraine and occupied Crimea. This resolution makes a clear call for the release of imprisoned Tatar leaders and activists. But we should not forget Ukrainian political prisoners in Russia, who have been languishing in prisons for years now. In particular, I have followed the case of the talented filmmaker Oleg Sentsov, who is in prison in Siberia, convicted on trumped-up charges.

We must send a message out from this House that we will not be quiet and we will not forget these people who have been locked away. The EU must continue to put more and more pressure on the Russian Government to end its human rights violations and let these people go.

  José Inácio Faria (PPE). – Senhor Presidente, Senhora Comissária, nas últimas semanas do passado mês de setembro Ilmi Umerov, destacado crítico da ocupação russa e líder do povo tártaro da Crimeia, o jornalista ucraniano Mycola Semena e o líder do Mejlis, Akhtem Chiygoz, foram condenados a penas de prisão acusados de ameaçar a integridade territorial da Federação Russa. As condenações destes três destacados críticos da anexação russa da Crimeia constituem o mais recente episódio de usurpação de direitos e liberdades fundamentais na península ucraniana e de instrumentalização do sistema judicial como ferramenta política de repressão daqueles que se opõem à ocupação e anexação russa. Esta não é a primeira vez que condenamos, nesta Casa, o recurso sistemático da Rússia a perseguições, torturas, prisões arbitrárias e execuções extrajudiciais para silenciar as vozes dissidentes e reduzir a população tártara da Crimeia à submissão.

Estas últimas detenções representam também mais uma grave violação do direito à liberdade de expressão, à segurança e a um julgamento justo garantidos pela Convenção Europeia dos Direitos Humanos, da qual a Federação Russa é signatária, e por isso apelamos à retirada das acusações e à libertação imediata de Akhtem Chiygoz, Ilmi Umerov e Mycola Semena.

  Stanislav Polčák (PPE). – Pane předsedající, já samozřejmě naprosto souhlasím s textem toho usnesení, protože je nepochybné, že v dané věci jsou ty rozsudky nelegitimní, jsou nespravedlivé, jsou porušením lidských práv. Okupace Krymu je obecně porušením mezinárodního práva, to je naprosto jasné a Rusko nemůže, podle mého názoru, využívat svoji justici k tomu, aby legitimizovalo tyto kroky. Rusko se stalo součástí vymahatelného okruhu mezinárodních práv a těch, které jsou zaručeny systémem Rady Evropy. A myslím si, že buď ta práva platí, nebo je to takový jídelníček, kdy platí jenom určitá část.

My bychom se měli snažit pomoci Radě Evropy k tomu, aby část své vymahatelné jurisdikce uplatňovala i vůči Rusku zabavováním podílů ruských společností. Musíme vyjádřit právě podporu Radě Evropy, protože ona má tento systém vybudovaný. My můžeme pouze dále trvat na tom sankčním seznamu. To je náš výraz solidarity za naše špatné svědomí, jak bylo jednostranně porušeno Budapešťské memorandum z roku 1994.

  Doru-Claudian Frunzulică (S&D). – Mr President, the European Union and the international community do not recognise the illegal annexation of Crimea and continue to condemn the violation of international law, as well as the oppressive acts that represent a clear infringement of the human, civil, political and cultural rights of Crimean Tatars and other Crimean freedom fighters. Russia, as the occupying power of Crimea, has to respect international law.

At the same time, I call on the Commission to look thoroughly at and to address the situation in Ukraine, where recently the Ukrainian authorities took measures against the rights of national minorities in Ukraine. This is a terrible situation. While all of us here are fighting for the rights of Ukrainians in Crimea, Ukraine is taking measures against the national minorities in Ukraine, forbidding their right to learn in their mother tongue. This situation has to be addressed as well.

Ami a Krímben történik ezekben a hónapokban és években, az jól példázza, hogy milyen retorziókra számíthat egy nemzeti kisebbség, ha a politikai hatalom birtokosa ellenségnek minősíti. Az európai történelemben is találunk példákat erre, szerencsére ma már a Krímben alkalmazott módszerek elképzelhetetlenek lennének az Európai Unióban. Kérdéssel. Ez azonban nem jelenti azt, hogy a nemzeti kisebbségek maradéktalanul elégedettek a helyzetükkel az EU-ban, ellenkezőleg, egyértelmű igény mutatkozik rá, hogy az uniós intézmények foglalkozzanak azzal a mintegy 60 millió uniós polgárnak a speciális helyzetével, akik nemzeti vagy nyelvi kisebbséghez tartoznak az EU-ban.

A többség és kisebbség közötti párbeszéd beindításához hozzá kell járulnia az EU-nak, másképp mindig csak elítéljük az EU területén kívüli jogsértéseket, majd tudomást sem veszünk a saját problémáinkról. Majd ha eléggé elmérgesedik a helyzet, akkor párbeszédre hívjuk fel az érintett feleket, mint a katalán esetben. Talán hasznosabb lenne, ha a párbeszéd még azelőtt létrejönne, hogy az álláspontok megmerevednek és az egész EU-ra kiható következményekkel jár a problémák szőnyeg alá seprése.

  Věra Jourová, Member of the Commission, on behalf of the Vice-President of the Commission / High Representative of the Union for Foreign Affairs and Security Policy. – Mr President, the human rights situation in the Crimean Peninsula has been deteriorating severely, as most recently documented in a report by the United Nations High Commissioner for Human Rights on 25 September. This report highlights the fact that Russian law has replaced Ukrainian law, in violation of international humanitarian law, that prisoners have been transferred to Russia (something which is prohibited under international humanitarian law), that there are systemic restrictions of fundamental freedoms, that there have been multiple failures to uphold the right to a fair trial and, not least, that there are arbitrary detentions, enforced disappearances, ill-treatment and torture.

The three cases before us regrettably illustrate very well the worsening situation. On 11 September, the Deputy Chair of the Mejlis, Akhtem Chiygoz, was sentenced to eight years’ imprisonment for participating in a pre-annexation rally held in support of the territorial integrity of Ukraine. On 22 September, the journalist Mykola Semena received a two-and-a-half-year suspended prison sentence merely for doing his job and, on 27 September, the Deputy Chair of the Mejlis, Ilmi Umerov, was sentenced to two years in prison for defending Ukraine’s territorial integrity in television interviews.

These three cases are clear violations of fundamental freedoms, particularly that of expression. In addition, the EU does not recognise the illegal annexation and, therefore, we do not recognise the application of Russian law in the peninsula, including the politically motivated sentences given to Mr Chiygoz, Mr Umerov and Mr Semena. The European External Action Service has issued a statement in each of these cases.

The EU also raises the issue of human rights violations and abuses in Crimea in public statements in international forums. EU officials regularly meet human rights defenders and journalists from Crimea, to be well informed about the situation on the ground. Currently, we are following closely the situation of four Crimean Tatars detained on Monday. All illegally detained Ukrainian citizens in Crimea and Russia should be released and their right to legal counsel and access to consular officers must be fully respected. Access to health care must be ensured, there should be full, free and unhindered access to the peninsula for international human rights personnel.

The EU remains unwavering in its support for the territorial integrity and sovereignty of Ukraine and does not recognise the illegal annexation of the Crimean Peninsula, which is a violation of international law.

  Mark Demesmaeker (ECR), schriftelijk. – Na de Europese schertsvertoning over het brutale geweld van Spanje ten aanzien van de vredelievende Catalanen kan men zich afvragen met welke geloofwaardigheid de EU mensenrechten verdedigt. Toch blijft het onze plicht om op te komen voor het lot van vervolgde politieke activisten waar ook ter wereld. Daarom steunt onze delegatie deze resolutie. De vervolging van Krim-Tataren door Moskou gaat onophoudelijk verder. Vandaag voegen wij twee van hun leiders en een journalist toe aan de lijst met politieke gevangenen. Ilmi Umerov, Akhtem Chiygoz en Mykola Semena kwamen op voor hun volk, cultuur en toekomst. Voldoende om hen na een schijnproces tot zware straffen te veroordelen. Oude en zieke tegenstanders opsluiten is voor Poetin het cynische middel om de illegale annexatie en de culturele assimilatie van de Krim te handhaven. Het is tijd dat Rusland alle politieke veroordelingen intrekt en alle politieke gevangenen vrijlaat. Tot slot moeten de sancties tegen Rusland verder worden uitgebreid en dienen de rechters die betrokken waren bij deze schijnprocessen, gesanctioneerd te worden.

  Monica Macovei (ECR), in writing. – The Russian occupation of the Ukrainian Crimean peninsula has inflicted grave human rights violations, especially concerning the rights of journalists and issues pertaining to freedom of speech. Crimean leaders, including Akhtem Chiygoz and Ilmi Umerov, are being prosecuted for opposing Russia’s annexation of Crimea. The same is true for journalists, like Mykola Semena, who has been a vocal critic of Russia’s occupation and suggested that Ukraine should have blockaded the peninsula. He was convicted of acting against the ‘territorial integrity of the Russian Federation’, leaving him with a two-year suspended sentence and three-year ban on public activities.

While Semena does not have to serve a prison sentence, he is banned from public activities, including journalism, which takes away his freedom of speech and expression. If he violates this ban, he will be imprisoned by the Russian authorities. Ukrainian officials are working to bring Semena back to the Ukraine. There is a dire need to hold Russia accountable for their violations of human rights and to bring justice for the victims of these violations.
