  Richard Corbett, Rapporteur. – Mr President, this report is the culmination of a year and a half’s work by the Committee on Constitutional Affairs, which set up a special working group that was very ably chaired by Mr Wieland, with a representative from every political group.

Our main task was to look again at our rules, two years after the big rules revision that we adopted two years ago. Some things needed tidying up, some things hadn’t worked so well – there was the question of this new device of interpellations, which I think we adopted by accident in plenary, and which didn’t sit very well with some of the other aspects of the rules. We’ve tidied all that up. But there are three big issues that have caused some controversy.

The first is how to deal with the fact that Parliament lost the court case that Mr Korwin—Mikke brought against the European Parliament when he was censured and fined by the President for using quite violently inappropriate language. The Court ruled that the balance in our rules between the right of Members to express themselves and the protection of Parliament and the public from hate speech and defamatory speech was not quite right. So we have very carefully, with the help of our Legal Service, rewritten that rule so that the emphasis now is on the use of offensive language, not so much on the content but on the intent to offend. We have defined that very carefully and we’ve even got a reference to Article 21 of the Charter of Fundamental Rights so that it covers a wide number of ways in which people may well feel offended by hate speech. We think we have that balance right, and I hope all groups accept what we have done there.

The second interesting subject is that of transparency, where we’ve been quite modest but we’ve wanted to increase the transparency in our rules where Members are dealing with lobbyists. At one level, for all Members, we say that Members ‘should’ only meet lobbyists who are on the transparency register and they ‘should’ publish their meetings online. The word ‘should’ is different from ‘shall’. It is not an obligation. It is more a recommendation. But it is an important recommendation for Members. We go further, though, for rapporteurs, where we say that rapporteurs, shadows and committee chairs in dealing with a report ‘shall’ – in other words, they have to – publish a list of scheduled meetings that they have had with lobbyists and interest representatives. ‘Shall’ but it’s only scheduled meetings. If you happen to bump into somebody on a train or in the corridor, you don’t of course necessarily control that as a rapporteur, but when you have arranged a formal meeting, it should be reported and it should be transparent.

Remarkably, the PPE Group has, I understand, asked for a secret vote on transparency. You couldn’t make it up really. It does seem to me a bit bizarre. Perhaps it’s not too late for my PPE colleagues to reconsider.

The final issue difficult issue we’ve tried to grapple with is the question of fake groups – political groups that have no political affinity as required under our rules. We had this, you may remember – some people will remember – some 15 years ago when we had a technical group composed of a political party from the far right and one from the far left. They had no political affinity. They were creating a group simply to avail of the resources that you get from Parliament – staff, money, speaking time – to use that, but were not acting as a political group within our rules. That may be a situation that repeats itself after the elections. We should protect ourselves and have a mechanism for making sure that affinity – if there is a doubt about it and we are very careful in our wording there to say that Parliament normally need not evaluate political affinity – but if there is manifest evidence, then Parliament as a whole, by an absolute majority – that’s a high threshold as a safeguard – can decide that a group has not been properly constituted. I think that’s not unreasonable.

  Věra Jourová, Member of the Commission. – Mr President, the Commission welcomes the fact that, in line with the framework agreement between our institutions, the European Parliament has sought the opinion of the Commission on amendments to the Rules of Procedure which affect us. We have set out our opinion in the letters addressed by First Vice—President Timmermans to Ms Hübner on 9 October, ahead of the committee vote, and to President Tajani yesterday, ahead of the vote in plenary tomorrow.

I will not repeat in detail now what you will all have seen in writing, but I will flag just a few points. We welcome several amendments, such as those on the transparency of intergroups, the abolition of minor interpellations, the improvements to public hearings and the ‘unfinished business’ rule as concerns citizens’ initiatives and the threshold for the verification procedure for citizens’ requests under the statute of European political parties.

We remain concerned that some of the amendments on parliamentary questions could reduce the efficiency and quality of this important means of democratic accountability, in particular with regard to the removal of the limit on the number of questions and the introduction of very tight target deadlines for replies.

With regard to the transparency—related amendments, the Commission looks at this issue from the angle of the negotiations on the draft interinstitutional agreement on a mandatory transparency register. The objective of the Commission’s proposal is to make the register de facto mandatory for interest representatives through a conditionality principle, requiring that decision makers in all three EU institutions meet only with lobbyists who are registered. Unfortunately, so far the European Parliament and the Council have put forward only voluntary approaches. Tomorrow you will consider the amendment that would provide that Members shall adopt the systematic practice of meeting only those interest representatives who have registered in the transparency register. The Commission would welcome such a move in the context of our negotiations on the interinstitutional agreement. By contrast, we are concerned about another amendment which would weaken the existing provision in the Rules of Procedure.

Other amendments seek to increase the information published about meetings with lobbyists. The Commission would like to point out that they solely concern the publication of meetings and so fall short of applying the conditionality principle: not on the register, no meeting.

The Commission will assess the consequences of the outcome of your vote tomorrow in preparation for the new political meeting on the proposal for an interinstitutional agreement, which we hope will take place in the margins of the February plenary session.

  György Schöpflin, on behalf of the PPE Group. – Mr President, there are two issues that I would like to touch on. First, the reform of the Rules of Procedure will give this Parliament a much stronger connection with the European Citizens’ Initiative – it has already been mentioned – so that whenever there is a successful initiative, Parliament will be in position to discuss it in plenary. Now this represents a major improvement in the process and will give initiatives much greater visibility. That, in turn, will enhance the relationship between citizens and the EU – something that is badly needed.

The other issue is evidently much more contested. How are political groups in this Parliament to be constituted? On paper, those who launch a group do so because they are linked by a political affinity; they have enough in common, politically, to act together. Hitherto, affinity has been taken on trust and mostly it has worked, but this the system can be gamed and it has been, by the EFDD, for example. Wholly divergent actors say they are linked and, thereby, they come to enjoy the rights and benefits of being a parliamentary group. Through that, they claim to represent the citizens, except as such divergent groups, they cannot and do not and that, of course, makes Parliament looks absurd – hence this reform, which is overdue.

  Jo Leinen, im Namen der S&D-Fraktion. – Herr Präsident, liebe Kolleginnen und Kollegen! Ich möchte Richard Corbett und der Arbeitsgruppe ganz herzlich für eine immense Arbeit und einen ausgewogenen Bericht danken, der hier vorgelegt wurde. Es gab ja weitaus radikalere Vorschläge, aber hier sind vernünftige Kompromisse gebildet worden.

Transparenz ist das Mantra dieser Wahlperiode. Wir haben versprochen, dass unsere Arbeit öffentlicher und nachvollziehbar wird, und mit den Änderungen in der Geschäftsordnung tun wir unsere Hausaufgaben hier im Parlament. In der Tat: Abgeordnete haben ein freies Mandat, wir können nicht gezwungen werden, jemand nicht zu treffen. Also wir sind frei, jeden zu treffen, der ein Anliegen hat. Aber wir sagen auch, dass sich Lobbyisten registrieren lassen müssen, und dass, wenn wir sie treffen, wir es möglichst auch selber der Öffentlichkeit mitteilen.

Nun haben wir festgestellt, das geht nicht verpflichtend für die Abgeordneten. Dazu brauchte man ein Gesetz und nicht nur die Geschäftsordnung. Aber sehr wohl kann man Funktionsträger hier im Parlament auffordern, ihre Treffen mit Lobbyisten dann auch online zu stellen. Das ist genau der Sinn dieser Regelung jetzt.

Ich kann nicht verstehen, warum wir darüber geheim abstimmen sollen – also wie Richard Corbett gesagt hat, über Transparenz intransparent abzustimmen, ist schon ein Stück aus dem Tollhaus hier aus der Geschichte des Europäischen Parlaments. Das geht auch in die Annalen ein, wenn es morgen so ist.

Dann will ich auch in meiner Zeit über die Bildung von politischen Gruppen reden. Ich weiß ja, dass hier einige noch intervenieren. Also eine politische Gruppe, wie der Name das sagt, muss irgendeine politische Affinität haben, sonst ist es keine politische Gruppe. Man kann nicht einfach kommen und sagen: Wir legen uns mal zusammen, damit wir die Zahl erreichen, dann haben wir alle Vorteile, aber wir tagen nicht zusammen, wir stimmen nicht zusammen ab, wir haben auch kein gemeinsames Programm. Das ist keine politische Gruppe – da kann man noch so viel protestieren –, das ist gegen den Sinn, wirklich auch gegen die Seriosität hier im Parlament.

Ich hoffe, dass das morgen eine Mehrheit bekommt, weil man in der Tat nach der nächsten Wahl auch Gefahr laufen könnte, dass wir mehr als eine Fake-Gruppe hier haben, die dann auch nicht sinnvoll ist und die Arbeit auch nicht befördert.

Alles in allem: Richard, danke, und ich hoffe, das hat morgen eine große Mehrheit.

  Marek Jurek, w imieniu grupy ECR. – Panie Przewodniczący! 12 września 2018 r. to będzie data historyczna, ale nie tylko dlatego, że to była 335 rocznica odparcia przez Jana III Turków spod Wiednia, ale również dlatego, że tego dnia Parlament Europejski uznał, że oddane głosy nie zostały oddane.

To pierwsze takie wydarzenie. Teraz idziemy krok dalej, teraz Parlament będzie decydował, czy posłowie mają prawo do zrzeszania się czy nie, ponieważ to kierownictwo Parlamentu ma decydować o tym, czy posłów, którzy chcą się zrzeszyć, łączą logiczne związki. Tak fundamentalnego ataku na prawo do zrzeszania się jeszcze nie widziano. Pytanie, w którą stronę my idziemy. Kiedy to na przykład Komisja Europejska będzie decydować, czy komitet wyborczy w wyborach jest oparty na logicznych wnioskach, czy może go nie rejestrować, dlatego że to się nie podoba? Idziemy naprawdę w bardzo groźnym kierunku. Prawa fundamentalne stanowiące podstawę rządów prawa są kwestionowane, i to właśnie przez władze Unii Europejskiej, które lubią o nich deklamować. Naprawdę, jeżeli będziemy iść tak krok po kroku, to z tego miejsca, które powinno być gwarancją wolności słowa, powstanie największe zagrożenie dla wolności słowa w Europie.

  Max Andersson, för Verts/ALE-gruppen. – Herr talman! I en demokrati ska man inte kunna köpa sig politiskt inflytande. Det finns mer än 30 000 lobbyister i Bryssel, och de flesta jobbar åt kommersiella särintressen med att hjälpa sina arbetsgivare att få igenom sin vilja. Gång på gång ser vi politiska förslag urholkas av lobbyister.

Utskottet har ett bra och balanserat kompromissförslag om lobbyism, som innebär att den ska ske öppet, inte i hemlighet. Om en energipolitiker exempelvis bara lyssnar på gaslobbyn, och aldrig på miljörörelsen, borde väljarna få veta det. Förslaget uppmuntrar politiker att lyssna på båda sidor, och transparensen i detta förslag innebär att spelplanen mellan dem som har mycket pengar och dem som har bra argument blir jämnare.

När jag hör argumenten mot förslaget, så undrar jag om EPP överhuvudtaget ens har läst det. Det gäller inte alla möten med människor på gatan eller i hissar. Det gäller scheduled meetings, som är planerade och införda i en kalender. Om man inte vill ha ett möte med någon i en hiss bokfört, boka i så fall inte in ett möte med någon i en hiss! Så enkelt är det. Stöd kompromissförslaget!

  Helmut Scholz, im Namen der GUE/NGL-Fraktion. – Herr Präsident! Gut, dass wir wenigstens die heutige Aussprache im Plenum haben. Jede Geschäftsordnung und deren Abänderung bedarf der ungehinderten und intensiven demokratischen Debatte über Zweck und Inhalt. Das ist wichtig, auch in Bezug auf die Glaubwürdigkeit unserer Arbeit als Volksvertretung. Wir können nur nach außen fordern und vertreten, was und wie wir im Umgang hier im Haus und gegenüber den anderen EU-Institutionen selbst täglich praktizieren, wie wir die Arbeit des Europäischen Parlaments organisieren.

Unsere Fraktion unterstützt erstens ausdrücklich die vorgesehenen Änderungen zu Transparenz und Nachverfolgbarkeit unserer gesetzgeberischen Arbeit, einschließlich des obligatorischen Nachweises von Treffen der Ausschussvorsitzenden, Berichterstatter und Schattenberichterstatter mit Vertretern der sogenannten Lobby-Strukturen. Ich hoffe, dass Sie, liebe Kolleginnen und Kollegen, dieser Neufassung der Geschäftsordnung mit großer Mehrheit folgen. Es schränkt nicht die Freiheit des Mandats ein, sondern kann dazu beitragen, Politikverdrossenheit in breiten Kreisen der Bevölkerung in allen EU28-Mitgliedstaaten entgegenzuwirken.

Zweitens meinen wir, dass die Geschäftsordnung keine Politisierung erfahren sollte, was mit den Änderungsanträgen 86 und 87 erfolgen könnte. Darüber hätten wir ausführlich im Ausschuss sprechen sollen. Nach welchen Kriterien dies geschieht, bleibt bei den Vorschlägen nämlich völlig offen, und der Änderungsantrag 88 gibt nur etwas mehr Hilfestellung.

  Fabio Massimo Castaldo, a nome del gruppo EFDD. – Signor Presidente, onorevoli colleghi, è notte fonda per una discussione così importante; è notte fonda per la democrazia! Una discussione che neanche volevate perché probabilmente ve ne vergognate; e meno male che "trasparenza" era il mantra di questo mandato. Una revisione alla chetichella: una discussione così cruciale come quella sulla composizione dei gruppi politici che non avete mai sollevato né nel gruppo di lavoro, né in commissione e che arriva con tre emendamenti dell'ultimo minuto da parte di tre deputati di quello che ormai posso definire l'ancien régime, che rimettono nelle mani della maggioranza la decisione sulla sopravvivenza delle opposizioni. L'esatto contrario del senso profondo della parola democrazia.

Tocqueville sarebbe stato d'accordo con me: questa è una tirannia della maggioranza. Crede che il Parlamento possa decidere a maggioranza assoluta – neanche a maggioranza qualificata – sulla sopravvivenza dei gruppi. Ma sono così scomode e fastidiose queste opposizioni? Un giudizio sull'affinità politica senza fornire alcuna definizione della stessa, né alcun parametro né criterio oggettivo di misurazione. Che possiamo dire della vostra affinità politica? Che possiamo dire della vostra, a fronte del fatto che ci sono delegazioni nel PPE che sono state sfiduciate da oltre la metà del proprio gruppo politico – vero onorevole Schöpflin? Fate finta di litigare, ma in realtà, dai Socialisti fino a Fidesz, siete tutti d'accordo quando si tratta di schiacciare i diritti dei gruppi che vi possono in qualche modo infastidire.

E qui volete anche una legittimazione giuridica per farlo, per fare in modo che i deputati che non sono allineati, o che vengono giudicati tali dalla maggioranza assoluta, vadano a finire nei non iscritti, che spesso non possono lavorare perché non solo messi in condizione di farlo, vista la scarsa allocazione di risorse e di funzionari che vengono loro dati. Al posto di sanare questa asimmetria, voi avete fatto l'esatto contrario: avete cercato di mettere in quelle condizioni quanti più movimenti alternativi possibile, forse perché, tutto sommato, avete magari paura dei termini di paragone.

Signori, questo è un vero attacco alle basi della democrazia, un attacco perpetrato da una singola maggioranza senza alcun criterio oggettivo: avete tentato in tutti i modi di tenerlo nascosto, evitando persino una discussione, ma i cittadini – ve lo assicuro – hanno occhi per vedere e orecchie per sentire e vi ricordo anche che non c'è peggior dittatura di una falsa democrazia.

  Rainer Wieland (PPE). – Herr Präsident! Blaue Karte ist ja nicht das gleiche wie Redezeit. In der Tat handelt es sich bei diesem Bericht um den Nachschliff der großen Reformen, und die allermeisten Dinge sind weitgehend unstreitig. Leider wurde der Bericht jetzt zum Anlass genommen, die Freiheit des Mandats zu beeinträchtigen. Ich bin da anderer Meinung als andere Redner. Es wird versucht, den Organisationsauftrag des Präsidiums mit kleinteiligen Regelungen, auf die das Präsidium verpflichtet werden soll, zu belasten. Das gehört nicht in eine Geschäftsordnung. Und es wird versucht, Abgeordnete zu Buchhaltern ihrer Arbeit zu machen. Zu sagen: Es ist ja gar nicht geplant, dass ungeplante Treffen da aufgenommen werden – aber am Ende würde es sich so ausweisen, dass sogar ein shake hands auf der Straße schon in ein gewisses gräuliches Licht kommen würde; Dem werden wir uns widersetzen.

Aber es ist halt Wahlkampf, und wer Gabriel García Márquez gelesen hat – „Liebe in Zeiten der Cholera“ –, dem fällt unwillkürlich bei dieser Frage ein: „Vernunft in Zeiten des Wahlkampfs“. Wir haben ganz offensichtlich Wahlkampf. Und jetzt wurde in den letzten Tagen noch ein bisschen Aufregung angezettelt bei der Frage der geheimen Wahl. Die EVP-Fraktion hat nichts zu verbergen, die Abstimmungsliste wird morgen jedem zugänglich sein. Die EVP-Fraktion hat klar gesagt, sie ist gegen diese Regelung. Aber wir sehen, dass Abgeordnete unter Gruppendruck, unter der Gefahr der Stigmatisierung, ihre Arbeit machen müssen. Und deshalb wollen wir die Möglichkeit geben, dass jeder hier frei seine Stimme abgeben darf.

Herr Kollege Corbett, Ihre Pressemitteilung, dass die EVP-Fraktion sich verstecken will, ist – sage ich jetzt mal – weit hinter der intellektuellen Brillanz, die wir von Ihnen gewohnt sind, zurückgeblieben. Das war ein sehr einfaches Argument. Und Herr Castaldo, Sie greifen hier Geld ab und bilden eine Fraktion, und ich hätte Sie gern gefragt: Wie oft hat diese Fraktion überhaupt getagt? Kein einziges Mal, Herr Kollege!

  Paulo Rangel (PPE). – Senhor Presidente, eu queria saudar esta iniciativa no sentido de reforçar a transparência. Devo dizer que há aqui um problema claro com a liberdade de mandato. Eu devo dizer que estou claramente contra esta ideia de tornar a democracia representativa uma espécie de democracia direta.

A democracia representativa não deve ir atrás do populismo e o populismo quer o voyeurismo e é isso que está essencialmente na alteração 20. É um voyeurismo que nos aproxima, não das democracias representativas, mas das democracias diretas e este é um mau caminho.

Mas justamente porque somos uma democracia representativa, também quero aqui dizer, em meu nome pessoal e em nome da delegação portuguesa do PSD no Grupo PPE, que estou frontalmente contra o voto secreto. Considero que o voto secreto não é compatível com a democracia representativa numa questão destas.

E por isso tenho pena, apesar de votar com a linha do grupo PPE, que não estejamos aqui a votar abertamente à frente de todo o povo que nos elegeu, porque essa é a forma justamente de fazer democracia representativa e de mostrar que os colegas que querem transformar o Parlamento numa espécie de caixa aberta em que nós somos apenas marionetas e não temos um papel próprio com liberdade, isto não possa ser feito de forma aberta perante todos. Portanto quanto a isto, neste ponto, não acompanho o meu grupo e penso que a votação devia ser uma votação transparente e aberta, embora eu votasse totalmente com a linha PPE.

  Elisabeth Morin-Chartier (PPE). – Monsieur le Président, Madame la Commissaire, chers collègues, je vous parlerai ici, en tant que présidente du comité harcèlement, du code de conduite appropriée que vous avez inséré, M. Corbett, dans votre rapport.

Depuis 2014, je travaille dans ce parlement à l’objectif «zéro harcèlement». Je suis soumise à la confidentialité et, soyez rassurés, je ne romprai pas le secret ce soir, mais je connais par cœur toutes les plaintes que j’ai dû instruire depuis 2014, tout le processus d’instruction de ces plaintes, que j’ai dû mettre en place.

Je voudrais vous dire ici: ne nous abritons pas derrière la liberté de mandat parce que le harcèlement est un délit. C’est un délit pour chacun d’entre nous qui le commettrait, et vous risquez d’être traîné en justice et vous risquez le pénal. Alors, on ne s’abrite pas derrière le secret quand il s’agit du harcèlement.

C’est la raison pour laquelle la loi, qui est la même pour tous, doit nous permettre d’avoir une politique ouverte, incisive, sérieuse de lutte contre le harcèlement, et qu’elle doit et que nous devons, ici dans ce parlement, refuser qu’une personne qui rejette le code de conduite puisse obtenir des représentations du Parlement, des postes importants. Il en va de notre honneur, de votre honneur, de l’honneur du Parlement. Nous le devons à tous nos concitoyens: je vous appelle à voter les amendements 13 et 68.

  Stanislav Polčák (PPE). – Pane předsedající, já bych se nejprve chtěl vyjádřit jako člen skupiny PPE, že pro mě je rovněž ne příliš pochopitelné, proč bychom o této otázce a o transparentnosti měli hlasovat netransparentně. Já si myslím, že buďto máme určitý názor a jsme schopni ho unést a deklarovat ho veřejně před veřejností nebo potom se tedy schováváme za tajné hlasování. Já rozhodně chci hlasovat v této věci veřejně.

Rád bych se vyjádřil i k tomu, co řekl pan zpravodaj Corbett ohledně otázky zpravodajů a jejich hlášení těch kontaktů, které mají mít s lobbisty. Myslím si, že ta úprava, která se navrhuje – to znamená, že musí hlásit ty lobbistické kontakty –, je správná. Já jen chci upozornit, že ta plánovaná jednání, předpokládám ta kalendářní jednání, by měla být možná lépe osvětlena. Také si umím představit situaci, že někdo na poslance konkrétní situaci nahraje, tzn., že vyvolá určitý efekt, zdání se, že je takové jednání naplánovano, a on potom bude např. veřejně popotahován. Mohou to být opravdu velmi politicky citlivé věci, myslím, že to by bylo dobré ještě vyjasnit.

  Maria Grapini (S&D). – Domnule președinte, eu cred că suntem de acord, toți cei care suntem aici la dezbatere, că era nevoie de o îmbunătățire a regulamentului. Și, iată, s-a oferit această dezbatere, și văd că chiar colegii care au cerut-o nu sunt aici în sală. Dacă erau interesați, ar fi trebuit să fie la dezbatere. Eu sper ca prin acest regulament să îmbunătățim nu numai formal, scris, ci și aplicarea regulamentului, să nu ne mai întâlnim că un președinte de comisie decide fără să consulte grupul, sau un coordonator al comisiei decide să trimită scrisoare Președintelui Parlamentului fără să consulte grupul, așa cum s-a întâmplat acum, chiar zilele astea, cu pachetul pe mobilitate. Cred că trebuie ca factorii responsabili ai Parlamentului să urmărească acest lucru, și da, doresc transparență! De ce trebuie să votăm secret? Populația trebuie să vadă, trebuie să știe, să ne asumăm votul și cred foarte mult că nu trebuie să mai existe incidente în Parlament. Noi trebuie să dăm un exemplu pentru cei pe care îi reprezentăm și nu sunt de acord cu un limbaj așa cum am aflat până acum aici, pentru că nu cred că un om care reprezintă cetățenii trebuie să aibă un comportament indecent cu colegi de ai lui în Parlament.

  Νότης Μαριάς (ECR). – Κύριε Πρόεδρε, επανειλημμένα, έχω επισημάνει στην αίθουσα αυτή ότι ο Κανονισμός περιορίζει την άσκηση της εντολής των βουλευτών. Πρώτα από όλα, περιορίζει τον αριθμό των ερωτήσεων σε πέντε. Δεύτερον, με πρόσφατη αλλαγή του Κανονισμού δεν μπορεί ο βουλευτής να υποβάλλει τροπολογίες παρά μόνο στη δικιά του επιτροπή. Αν θέλει ο βουλευτής να υποβάλλει τροπολογίες σε άλλη επιτροπή, πρέπει να βρει συνάδελφο της αντίστοιχης επιτροπής. Τρίτον, έτσι όπως εμφανίζεται, υπάρχουν, πλέον, περιορισμοί σε σχέση με την συγκρότηση των πολιτικών ομάδων. Διότι λένε ότι θα πρέπει να υπάρχει πολιτική συγγένεια. Ποιος θα κρίνει την πολιτική συγγένεια; Φαίνεται ότι οι μεγάλες πολιτικές ομάδες θέλουν να διαλύσουν εν τη γενέσει τους οποιεσδήποτε νέες ομάδες θα συγκροτηθούν στο Ευρωπαϊκό Κοινοβούλιο και, φυσικά, να «αρπάξουν» και τους πόρους. Αυτά είναι πράγματα πάρα πολύ απλά. Τέλος, πρέπει να σταματήσει ο προληπτικός έλεγχος των ερωτήσεων. Υποβάλλουμε ερωτήσεις και τις απορρίπτει το Προεδρείο λέγοντας ότι είναι εκτός δικαιοδοσίας ή ότι δεν έχει αρμοδιότητα η Επιτροπή. Ποιος θα το κρίνει αυτό; Εμείς ως βουλευτές θα θέτουμε τις ερωτήσεις και αν η Επιτροπή εκτιμάει ότι δεν έχει αρμοδιότητα θα το πει. Δεν θα το λέει το Προεδρείο αυτό, κύριε Πρόεδρε.

  Dobromir Sośnierz (NI). – Panie Przewodniczący! Pan Reiner Wieland się tutaj martwi, że tworzenie grup to są pieniądze. No to pytam, po co stworzyliście taki system, w którym uzależnia się pieniądze dla posła od jego przynależności. To jest niesprawiedliwe i to stwarza nierówność. Macie pełne usta równości w deklaracjach, a stwarzacie nierówność tutaj, bo pieniądze otrzymywane przez posła są uzależnione od tego, do jakiej grupy i do jak dużej grupy politycznej należy. To jest polityczna korupcja i to jest naganne, a nie to, że można tworzyć grupy, jak się chce. Więc to, że ogranicza się tu znowu w tych kolejnych poprawkach wolność słowa, że feministki po raz kolejny chcą zamykać usta na niewygodne tematy. Tylko wyborcy mogą odebrać posłowi prawo do wypowiadania się, bo on się wypowiada w ich imieniu, a nie w imieniu przewodniczącego czy kogokolwiek innego.

Nie może być cenzury w Parlamencie, ani Europejskim, ani żadnym innym. Grupy mają potwierdzać, że będą realizować cele Traktatów. A niby dlaczego? Jeśli obywatele chcą, żeby zmieniać cele Traktatów, to posłowie mają takie prawo. I nie można na wstępie uniemożliwiać jakieś inicjatywy politycznej tylko dlatego, że ona się nie zgadza z celami dotychczas zadekretowanymi. Jeśli chcecie tutaj wprowadzić takie ograniczenia w tworzeniu grup, to wpiszcie od razu przewodnią rolę grupy chadecko-socjalistycznej do Traktatów i będziemy mieli załatwioną sprawę.   Richard Corbett, Rapporteur. – Mr President, I wish to thank all the colleagues who have contributed, and indeed the Commission. I think we are making progress, too, on that other front you mentioned, on the work on the transparency register. This is, I hope, not incompatible with that, but rather complementary.

However, there are certainly some misunderstandings. These issues were discussed at the committee stage – they have not suddenly come out of the blue. We had quite long discussions. And, Mr Sośnierz, we’re not saying that no groups can propose changes to the Treaty. Of course, they can propose changes to the Treaty. But mostly there seems to be a high level of support for most of the proposals in my report. The controversial one, it appears to me, is the secret vote, and I’m glad some PPE Group members are not going to support that.

On this question of political groups, there is already a requirement in our rules – there always has been – that political groups have to have affinity, as they do in most national parliaments.

We have already, on one occasion, dissolved a political group because it did not have political affinity. That case went to the Court. The Court ruled that Parliament was right to dissolve such a group. So it’s not unreasonable to check that this existing provision is actually applied properly and that we have a procedure for dealing with it. In those cases where there is serious doubt, we have to have the possibility of examination – where there is serious doubt and it warrants investigation.

Creating a political group in the European Parliament is much easier than in national parliaments. You only need just over 3% of the membership. If you have that you have access to significant resources: you can effectively help yourself to taxpayers’ money. If you’re not really a political group – if you are a fake group set up just for that purpose – then it’s right that we defend the taxpayer against abuse.

This Parliament gives equal rights to all its Members as individuals, but the right to create political groups in any Parliament is intended to facilitate the work of the Parliament, so that people can speak on behalf of large numbers of other Members, to improve the work of the Parliament – so that you, Mr President, have an easier time giving the floor to different people, and every view can be expressed in a coherent way. Fake political groups do not help the work of the Parliament – they abuse the work of the Parliament.

  João Ferreira (GUE/NGL), por escrito. – A profunda e arrastada crise da União Europeia, a par do ataque a conquistas e direitos sociais e do retrocesso de dimensão civilizacional que lhe está associado, comporta igualmente uma inquietante dimensão de ataque à própria democracia. O ataque a direitos sociais e o ataque à democracia andam de mãos dadas. Assim se devem ler os sucessivos ataques à soberania nacional dos Estados, a tentativa de esvaziamento das suas instituições de soberania e a concentração de poder em instâncias supranacionais, ao serviço do grande capital e das grandes potências. À luz desta realidade mais geral devem também ser lidas as sucessivas alterações introduzidas ao Regimento do Parlamento Europeu, visando limitar a intervenção dos deputados e dos grupos políticos de menor dimensão, burocratizar o funcionamento do parlamento e diminuir e enfraquecer instrumentos de escrutínio do processo legislativo e da ação das diferentes instituições da UE. É significativo que estes esforços unam a direita e a social-democracia. Aqui denunciamos e repudiamos vivamente a tentativa de criar novos e gravosos obstáculos à formação de grupos políticos, com base num critério arbitrário e subjetivo de “afinidade política”. Trata-se de um passo mais na caminhada que tem vindo a pôr em causa a democracia e o pluralismo que, hipocritamente, direita e social-democracia afirmam defender.

  Tom Vandenkendelaere (PPE), schriftelijk. – Procedureregels zijn belangrijk voor een parlement. Ze vormen het fundament van parlementaire interactie. Continuïteit in procedure zorgt voor voorspelbaarheid, wat een goede zaak is want dat maakt het parlementaire werk overzichtelijk en transparant. Maar een procedure mag nooit een wet van Meden en Perzen worden. De maatschappij evolueert constant en dat geldt a fortiori voor het maatschappelijk en politiek debat. Goed geïnformeerde en mondige burgers verwachten terecht een doorzichtig politiek proces. Het veronderstelt een openheid van zowel het ambt zelf als van de uitvoering ervan. De wijzigingen in de parlementaire procedureregels, zoals aanvankelijk voorgesteld door collega Wieland in een interne werkgroep, komen grotendeels tegemoet aan deze veranderde publieke verwachting. Een groot deel van het Parlement deelt ook deze mening waardoor het basisrapport erg makkelijk in AFCO werd goedgekeurd. In aanloop naar de plenaire stemming werd de tekst echter op cruciale punten geamendeerd. Onder meer over het publiceren van geplande ontmoetingen met officiële lobbygroepen of vertegenwoordigers ervan, over transparantie aangaande het gebruik van de onkostenvergoedingen én over het verplicht ondertekenen van een gedragscode werd hevig gediscussieerd. Ikzelf heb echter niet moeten nadenken. Op elk van deze punten heb ik gestemd voor de grootst mogelijke transparantie.
