European Parliament resolution on the situation in Ethiopia and new border conflicts

The European Parliament,

   -Having regard to its June and October 2005 resolutions on the situation in Ethiopia,
   -Having regard to the European Union Election Observation Mission preliminary report of 25 August 2005, J
   A.Disturbed by recent news on large scale human rights abuses following a massive and unprecedented crackdown where political leaders, human rights defenders, independent journalists, NGO workers and young people were arrested in Addis Ababa and in different parts of the country,
   B.Considérant que les manifestations, à l'appel de la "coalition pour l'unité démocratique", pour protester contre la fraude électorale, ont été durement réprimées, y compris par des tirs à balles réelles et l'utilisation de véhicules blindés ;
   C.Whereas the political detainees include Hailu Shawel, president of the CUD, Professor Mesfin Woldemariam, former chair of the Ethiopian Human Rights Council (EHRCO), Dr. Yacob Hailemariam, former UN Special envoy and former prosecutor at the International Criminal Tribunal for Rwanda, Ms Birtukan Mideksa, former judge and Dr. Birhanu Nega Mayor-elect of Addis Abeba,
   D.Whereas many of the above mentioned prisoners have been on hunger strike since 28 November in protest at their continued detention without charge
   E.Whereas according to some information thousands of youths arrested in Addis Ababa, were taken to the Dedessa River (South West of Ethiopia) and are being held in an open field in a malaria-infested area,
   F.Seriously disturbed by the information received from the World Organisation Against Torture according to which the young people detained in Dedessa do not have shelter, that food and drink are not easily available, and by reports that a number of youths have been eaten by crocodiles from the river, and that many youths have fallen ill,“
   G.Disturbed by a "wanted for treason" list which includes members of parliament, journalists, aid workers, members of NGOs and artists
   H.Worried by the crackdown on the dependent press and the collapse of the independent press resulting from arrests of several journalists, by the fact that scores put on the government's "wanted for treason" list have gone into hiding and by the cancellation of media licences and confiscation of property; alarmed that journalists will face treason charges,
   I.Considérant la déclaration commune de l'Union européenne et des Etats-Unis appelant le gouvernement à "relâcher tous les détenus politiques", "à mettre immédiatement fin à l'usage de la force brutale", " à la réouverture du dialogue politique" et demandant une "enquête indépendante sur les évènements de juin et novembre ;
   J.Welcoming the release of about 8000 people but worried that this figure by itself shows the massive scale of detention and by the fact that the government did not so far disclose the total number of people actually in detention and still less their where about,
   K.Recalling that the European Union has deployed an important long term election observer mission in Ethiopia and its preliminary report was made public on 25 August 2005,
   L.Whereas the European Union has made an important effort to solve the post election crisis by democratic, transparent and peaceful political means,
   M.Considérant que l'Ethiopie reçoit l'équivalent d'un milliard de $ d'aide internationale chaque année (dont 490 millions de l'Union européenne), ce qui représente ¼ de son PIB ;
   N.Whereas Ethiopia is a signatory of the Cotonou agreement which enshrines in article 96 respect for human rights and fundamental freedoms as essential elements of the ACP-EU cooperation,
   1.condamne les violences et l'usage de moyens de répression disproportionnés par les forces armées ainsi que les arrestations massives
   2.Calls on the Ethiopian government to release immediately and unconditionally all political prisoners including party leaders, journalists, human rights defenders, youths, NGO workers,
   3.Opposes the possible charge of treason against the detainees including Hailu Shawel, president of the CUD, Professor Mesfin Woldmariam, former chair of the Ethiopian Human Rights Council (EHRCO), Dr. Yacob Hailemariam, former UN Special envoy and former prosecutor at the International Criminal Tribunal for Rwanda, Ms Birtukan Mideksa, former judge and Dr. Birhanu Nega elected Mayor of Addis Abeba,
   4.Calls on the Ethiopian government to disclose the total number of persons detained throughout the country and to allow all the detainees access to their families, legal counsel and the medical care that their health situation may eventually require,
   5.Calls on the government to guarantee that detainees shall not be subject to torture, ill treatment or forced disappearance in conformity with international conventions on Human rights,
   6.Demande la reprise du processus de réforme et d'amélioration des institutions démocratiques, ce qui passe par un examen sérieux et international des résultats des élections législatives de mai ;
   7.Calls on the establishment of an independent international commission of enquiry under the UN responsibility to investigate on the human rights abuses and identify and bring those responsible to justice,
   8.Considers that, despite the political dialogue between the EU and the Ethiopian government under Article 8 of the Cotonou agreement, the latter has failed to fulfil its obligations with respect to human rights, democratic principles and the rule of law,
   9.Calls on the Commission and the Council to consider taking targeted sanctions against members of the Ethiopian government if the current situation is not significantly improved,
   10.Calls on the Commission and the Council to take a coordinated stance in line with article 96 of the Cotonou agreement,
   11.Calls upon on the Council and the Commission to provide humanitarian aid for the population of Ethiopia through NGOs and UN specialised agencies in order to help directly the population,
   12.Calls on the Ethiopian government to respect the Universal Declaration of Human Rights and the International Covenant on civil and political rights which include freedom of opinion, the right to hold peaceful demonstration and organise political meetings,
   13.Considers that freedom of expression and information including the right to seek, receive and impart information is a fundamental and inalienable human right and an important component of the democratisation process
   14.Calls on the Ethiopian government to put an end to the state media monopoly and allow the independent press to function by releasing all arrested journalists and returning confiscated property; calls for a code of conduct for the press to be put in place,
   15.Demande la reprise du processus de réforme et d'amélioration des institutions démocratiques, ce qui passe par un examen sérieux et international des résultats des élections législatives de mai ;
   16.Expresses its full support for UN Security Council Resolution 1640(2005), which calls on Eritrea to reverse immediately its decision to ban UNMEE helicopter flights and all other restrictions imposed on UNMEE, demands that both parties return to the 16 December 2004 levels of deployment of their troops, and calls on Ethiopia to fully accept the final and binding decision of the Eritrea-Ethiopia Boundary Commission;
   17.demande à l'Union africaine, dont le siège se trouve en Ethiopie, de prendre une position claire, prouvant sa détermination à faire progresser la démocratie sur le continent africain ;
   18.Instructs its President to forward this resolution to the Council, the Commission, the Ethiopian government, to the two main Ethiopian opposition parties and the African Union.
