European Parliament resolution on Egypt - Sudan

The European Parliament,

–     having regard to its previous resolutions on human rights in Egypt,

-   having regard to the EU - Egypt Association Agreement,

-   having regard to Rule 115(5) of its Rules of Procedure,

A.    whereas on 30 December 2005 the Egyptian Security Forces evacuated by force about 1500 Sudanese migrants and refugees who were settled in Moustafa Mahmoud Square in front of UNHCR Headquarters and had been asking to be relocated to third countries since 29 September 2005,

B.   whereas it has been reported that at least 27 individuals died, whilst others were imprisoned and many others were injured following the Egyptian Security Forces' attack,

C.  whereas human rights violations in Egypt have increased in the past months, including the arrest on charges of forgery of the Egyptian opposition leader and Member of Parliament Ayman Nur and other defendants after the last elections and whereas Ayman Nur has been sentenced to 5 years' imprisonment,

1.  Condemns the violent repression carried out by the Egyptian police; calls on the Egyptian Government to launch an investigation into the killings of at least 27 Sudanese protesters on 30 December 2005;

2.  Recalls that Egypt is a state party to the Convention against Torture and other international agreements which expressly prohibit the forcible return of anyone to a country where they would be at risk of torture or ill-treatment;

3.  Asks therefore the Egyptian authorities to halt a forced deportation to Sudan of up 650 Sudanese nationals, as the group is believed to include asylum seekers and refugees recognised by the United Nations High Commissioner for Refugees (UNHCR), who would be at risk of torture if returned to Sudan;

4.  Recognises the mandate of the UNHCR and the importance of its efforts to protect and promote lasting solutions for refugees and other uprooted people, who are its concern, and expresses its support for the UNHCR’s work;

5.  Calls on the Egyptian authorities to provide information on the places where Sudanese migrants and refugees arrested have been placed or detained since 30 December 2005 and to release all Sudanese nationals detained during or following the events in question;

6.  Requests the Egyptian authorities to take measures to ensure that police officers will act in compliance with the international standards including the UN Code of Conduct for Law Enforcement Officials and to put an end to the disproportionate use of force by providing adequate training on fundamental human rights, for example;

7.  Asks the Commission and the Council to voice serious concern to the Egyptian authorities regarding the incidents of 30 December 2005 and to follow closely any further developments in those cases;

8.  Calls on the Council, the Member States and the Commission actively to support the aim of the Euro-Mediterranean Agreement regarding respect for human rights in a permanent political dialogue with Egypt;

9.  Reasserts the need for the Commission and the Council likewise to do their utmost to ensure that an Association Agreement with Egypt leads to an improvement of human rights in Eygpt;

10.  Calls on the Commission to assess at regular intervals Egypt's compliance with human rights standards and hopes that the Commission will annually report on its findings in the framework of the Euro-Mediterranean Partnership;

11.  Welcomes and supports the worldwide calls to release Ayman Nur; notably, appeals to the Egyptian Court of Appeal to overturn the verdict of 5 years' imprisonment; strongly urges the Egyptian authorities, furthermore, to ensure that Ayman Nur is well treated and not subject to torture or other form of ill-treatment and to ensure that he is given prompt, regular and unrestricted access to his lawyers, doctors and family;

12.  Instructs its President to forward this resolution to the Council, the Commission, the governments of the Member States and the government and parliament of Egypt.
