The European Parliament,

–  having regard to the report issued by the Truth and Reconciliation Committee report led by Professor Salomon Lerner Febres on the terrible events in Peru between 1980 and 2000,

–  having regard to Rule 115(5) of its Rules of Procedure,

A.  whereas former President Alberto Fujimori was arrested in Chile on the basis of the international arrest warrant issued against him by the Peruvian authorities,

B.  whereas Mr Fujimori ruled Peru between 1990 and 2000 and faces some 22 charges in Peru for human rights abuses and corruption and, additionally, Congress and the Electoral Board has barred him from running for office until 2011,

C.  whereas the Parliament has given unreserved support for Peru's democratic process since the fall of Mr Fujimori's regime in 2000,

D.  whereas the issue of the extradition of former President Fujimori involves two countries with which the Union maintains strong partnerships in the framework of the bi-regional strategic association first decided in Rio de Janeiro in July 1999,

E.  whereas a bilateral extradition treaty exists between Chile and Peru in force since 1936,

1.  Congratulates the Chilean and Peruvian governments for their effective cooperation in their detention of Mr Fujimori by Chilean authorities;

2.  Reiterates that the fight against impunity is one of the main cornerstones of the Union's policy in the field of human rights; is of the view that it is the primary duty of all the partners to work together towards respect for democracy and human rights;

3.  Backs therefore the extradition of Mr Fujimori to Peru in order that Mr Fujimori can appear in court to face the charges of which he is accused; expresses total confidence in the Chilean judicial system and trusts this extradition to be in full respect of its procedures and applicable legislation and that Mr Fujimori's trial be conducted according to international accepted standards;

4.  Instructs its President to forward this resolution to the Council, the Commission and the governments and parliaments of Chile and Peru.
