European Parliament resolution on human rights violations in Transnistria (Moldova)

The European Parliament,

  • ­having regard to its previous resolutions on the situation in Moldova and the situation in Transnistria,
  • ­having regard to the Partnership and Cooperation Agreement between Moldova and the European Union, which entered into force on 1 July 1998,
  • ­having regard to the European Neighbourhood Policy Action Plan for Moldova, adopted on 22 February 2005, which sets the direction for strategic cooperation between the Republic of Moldova and the European Union,
  • ­having regard to the statements of the Organization for Security and Co-operation in Europe (OSCE) at the 1999 Summit in Istanbul and the 2002 Ministerial Council meeting in Oporto,
  • ­having regard to Rule 115(5) of its Rules of Procedure,
  • A.whereas both the decision on the arrest under charges of terrorism in the context of the internal conflict and the conditions of detention of Mr Popa and Mr Ivantoc by the separatist authority of Transnistria were illegal, incompatible with international standards and did not ensure the respect of the rule of law and of the fundamental human rights,
  • B.whereas the conflict between the separatist authority of Transnistria and the central Government in Moldova has largely contributed to the instability in the whole country,
  • C.whereas the development of good relations between Moldova and EU, the EU signed an Action Plan with the Republic of Moldova, launched the EU Border Assistance Mission to Ukraine and Moldova, opened a EU Delegation in Chisinau, signed an agreement on visa facilitation, opened a first ever common European visa application centre, increased substantially the amount of assistance offered to Moldova during 2007-2009,
  • 1.Stresses that Mr Tudor Petrov-Popa and Mr Ivantoc were released on 2 June 2007 and the expiry of the detention term was the only reason for their release, while the ECHR judgement mentioned above as well as the position of the international community was completely ignored;
  • 2.Condemns the continued repression, harassment and intimidation of representatives of the independent media, NGOs and civil society by the self-proclaimed Transnistrian authorities;
  • 3.Denounces the attempt of the Transnistrian region of Moldova to establish its independence and underlines that the political solution of the Transnistrian problem will be realized on the basis of international law in close cooperation with the OSCE, European Union, Romania, Russia, USA and Ukraine;
  • 4.Stresses that the withdrawal of the weaponry and troops of the Russian Federation represent a condition sine qua non for the settlement of the Transnistrian conflict;
  • 5.Calls on the EU Member States, within the framework of discussions on the future of the Treaty on Conventional Forces in Europe, to reiterate Moldova’s request to the international community on the replacement of the Russian peace-keeping operation in Moldova with a multinational operation of military and civilian observers under the aegis of the European Union;
  • 6.Expresses its support for the Moldavian authorities and people for the successful reforms to establish a fully functioning democracy, the rule of law and respect for human rights, which are essential for ensuring the progress of reforms;
  • 7.Instructs its President to forward this resolution to the Council, the Commission, the Government and Parliament of Moldova, the Government of Romania, the Government of Ukraine, the Government of the Russian Federation, the US Government, the Secretary-General of the OSCE and the Secretary-General of the Council of Europe.
