European Parliament resolution on the case of the journalist Perwez Kambakhsh 
B6‑0116/2008

The European Parliament,

   -having regard to its previous resolutions on Afghanistan and Iran,
   -having regard to its previous resolutions on the death penalty,
   -having regard to the Afghan Constitution of 2004,
   -having regard to Rule 115(5) of its Rules of procedures,

A.  whereas the young Afghan journalist Perwiz Kambakhsh, of 23 years of age, has been sentenced to death by a Tribunal in Mazar I Sharif on 23 January 2008 for "blasphemy", having spread out among the students of the University of Balkh the content of an Iranian blog on Islam and women,

B.  whereas according to the journalist's declarations to "The Independent" of 25 February 2008 his process has not been fair and just, since it was held in camera and without a lawyer defending him,

C.  whereas Perwiz Kambakhsh can both make an appeal to another Tribunal and be graced by the Afghan President,

D.  whereas there has been international mobilization in support of Kambakhsh's absolution and liberation, both in Afghanistan and elsewhere in the world,

1.  Calls on the Afghan authorities to pardon and release the Afghan journalist Perwiz Kambakhsh;

2.  Stresses the importance of respecting fundamental rights everywhere in the world;

3.  Hopes that the next Tribunal handling the case of Perwiz Kambakhsh will consider all the necessary elements to deal fairly with this case and in the respect for the Afghan Constitution and the principles of the Afghan and the international rule of law;

4.  Calls also on President Karzai to exert his power to bestow his grace on Mr Kambakhsh;

5.  Instructs its President to forward this resolution to the Council, the Commission, the governments of the Member States and the government and the President of Afghanistan.
