MOTION FOR A RESOLUTION on Ukraine: the cases of Yulia Tymoshenko and other members of the former government

European Parliament resolution on Ukraine: the cases of Yulia Tymoshenko and other members of the former government

The European Parliament,

 having regard to Rule 122(5) of its Rules of Procedure

A  Whereas the Ukrainian Prosecutor General's Office in April 2011 opened a criminal case against Tymoshenko on charges of abuse of power in the conclusion of 2009 gas contracts, whereas she is accused of inflicting damage to the state to an amount of over Hr 1.5 billion by signing the 2009 gas contracts with Russia,

B  Whereas Yulia Timoshenko and other former government officials are accused of fraud in the procurement of vaccines during a flu outbreak in Ukraine in 2009.

1.  Stresses that Ukraine is an important partner for the EU and a key regional actor; notes the Ukrainian people’s European aspirations and reaffirms its readiness to establish a long-term partnership, including a European perspective for Ukraine; underlines that respect for the rule of law, human and civil rights, political pluralism and other democratic values is fundamental for deepening relations;

2. Notes the recent developments in the cases of Yulia Tymoshenko and other members of the former government of Ukraine; underlines the need for respect for the rule of law, incorporating fair, impartial and independent legal processes and stresses the importance of ensuring the maximum transparency of investigations, prosecutions and trials;

3. Appeals to the government of Ukraine, the EU and all interested countries not to interfere in the judicial cases but to respect the independence of judiciary;

4. Calls on its relevant parliamentary bodies to closely follow the case;

5. Instructs its President to forward this resolution to the governments of Ukraine, the Vice-President of the Commission/High Representative of the Union for Foreign Affairs and Security Policy and the governments and parliaments of the Member States.
